They did not, however, count on the expertise of the police forensic team which uncovered the ruse in no time by using backlight, revealing how the crime was committed. The gruesome murder took place in Thanaletchumy’s home in Kampung Pasir Baru here during daylight, believed to be between 10am and 11am yesterday. Kajang police chief ACP Abdul Rashid Wahab said the killers, believed to have been at least two, took time to clean the house. “It’s clear they were trying to cover up the murder. Man rams police bikes and ignores warning shot DETERMINED to get away from the law, a Myanmar national not only crashed his car into two police motorcycles but also ignored a warning shot by them at the Selayang wholesale market on Monday. Kuala Lumpur CID chief Datuk Ku Chin Wah said two policemen were patrolling the area at 7pm when they spotted the suspect in a Proton Saga near the wholesale market entrance. Suspecting something amiss, the policemen approached the vehicle and stopped behind it. Ku said before the policemen were able to get close, the driver suddenly reversed the car into the two motorcycles. "One of the policemen fired a warning shot but the driver ignored it and sped off," he said. He said the motorcycles were badly damaged but the policemen, in their 30s, were not injured. Checks later revealed the car's registration number was fake and the driver was said to be a regular at the area. "We believe the driver could be involved in criminal activities. We hope to catch him soon," said Ku.

News of grandma's murder stuns residents of peaceful Kampung Pasir Baru THE murder of a 64-yearold grandmother S. Thanaletchumy shocked Kampung Pasir Baru residents who never experienced any form of crime for the past three decades. "It is shocking. I can't believe such an incident happened here. This village is peaceful and we have a close-knit community," said K. Shankaran, 49, who has lived there for more than 20 years. Shankaran said he never heard of any robbery or even a snatch theft in the neighbourhood. He said there were about 40 families staying in the village and most of them knew one another. "I've known Thanaletchumy for a long time. I even attended the family's function last Saturday. She seemed happy and excited serving her guests,"

Nationwide arrest order IGP tells States to nab cybercafe gamblers

POLICE in all States are to arrest gamblers in cybercafes with immediate effect. Inspector-General of Police Tan Sri Ismail Omar (pic) issued the order following moves by Penang and Selangor police to crack down on such outlets. Ismail said he instructed all 14 State police chiefs to come down hard on gamblers and cybercafe operators alike. “This needs to be done to eradicate the gambling menace, especially among minors who are easily influenced and led astray by such activities,” he said. “As now, many youths are tempted to skip school to gamble. We need to put a stop to this.” Towards achieving this, police will not only detain the operators of the offending cybercafes but also their patrons — the gamblers, young and old. Previously, patrons at such outlets during raids only had their statements recorded, with the cybercafe operators being the ones charged. Now, patrons can be investigated under Section 7 (2) of the Common Gaming House Act 1953 which carries a fine of up to RM5,000, a maximum six-month jail term or both.

Errant or repeated gambling operators can also be charged under the Restricted Resident Act 1933. Selangor police chief Datuk Tun Hisan Tun Hamzah said the move was the first step towards eradicating gambling in the state. He also said the gambling menace had been a nuisance for years, forcing police to re v i e w h ow t o tackle the issue. Tun Hisan said the move made sense, as gamblers were major contributors to the income of cybercafe operators.

Parental guidance best for gambling minors MINORS detained during police raids at cybercafes could be sent to juvenile detention centres for rehabilitation as a last resort, but parental guidance is best to resolve the matter. Federal Criminal Investigation Department (CID) principal assistant director for anti-vice, gambling and prostitution SAC Abdul Jalil Hassan said provisions under the law enabled police to arrest and charge those under 18 as juveniles for gambling. “Minors can also be charged under Section 7 (2) of the Common Gaming House Act 1953, the same as for adults. However, being underaged they cannot be sent to prison. So, if found guilty, juveniles could be sent to a correctional facility for rehabilitation,” he told The Malay Mail

In July, the Women, Family and Community Development Ministry wanted an amendment to the Child Act 2001 to prevent children who commit minor offences from being sent to juvenile detention centres. Its minister Datuk Seri Shahrizat Abdul Jalil said children, caught for petty theft and even house break-ins, should not have to languish in such centres. She said child offenders should, instead, be placed under a community service order programme and given counseling or sent for rehabilitation rather than being placed under remand longer and forced to be at detention centres.

Part of the money stolen by MACC officers recovered POLICE recovered part of the US$300,000 (RM900,000) stolen by three Malaysian Anti-Corruption Commission (MACC) officers from a moneychanger at the KL International Airport (KLIA) on Sept 15. Inspector-General of Police Tan Sri Ismail Omar said a police team retrieved part of the stolen money from a location in the Klang Valley. He declined to disclose the amount recovered. “The remand order for

the three suspects has been extended for another three days until tomorrow for further investigations,” said Ismail at a Hari Raya open house at the KL police headquarters. Police are looking for two more suspects linked to the robbery. Their photofits were released last Friday. On Sept 15, three men, believed to be senior officers attached to MACC headquarters in Putrajaya, approached the victim, in

his 40s, at KLIA, when he was about to board a plane for Singapore. The suspects, claiming to be from MACC, demanded the money changer to hand over the cash he was carrying. When he refused, they grabbed the money and fled. The victim lodged a police report and the suspects were ordered to go to the Selangor police headquarters. After their statements were taken, they were arrested.

Year-long spree ends with arrest of seven drug-addict car thieves A YEAR-LONG crime spree in the Klang Valley, Kedah and Penang by a seven-member car theft gang came to a halt last Saturday when they were nabbed at a flat in Seri Kembangan. Interestingly, the all-male gang members were junkies. They comprised a disgraced ex-Immigration officer who was their leader adept at stealing vehicles by first cutting off the alarm system, a runner to scout for potential cars to be stolen, three mechanics to dismantle the car parts for resale, and two 'marketing officers' to peddle the stolen goods to kereta-potong outlets (car scrapyards). Selangor deputy police chief, Datuk A.Thaiveegan (pic) said

the gang specialised in stealing Honda cars. "Their leader, using a master key, broke into cars at parking lots in shopping malls and housing estates. The cars were then cannabalised for parts for sale to kereta-potong outlets," he said. "The gang members hail from Kedah. We believe they have been active in their home state, Penang and the Klang Valley for the past year." Acting on a public tip-off last Saturday, police went to the Sri Indah flats at Taman Lestari Perdana in Seri Kembangan where they spotted three Honda Civic cars on the ground floor. "All three Hondas were stolen. At 11.40pm when

five members of the gang came down, we moved in," said Thaiveegan, adding the cars were stolen at Seri Kembangan, Alor Setar, and Prai in Penang. “There was a brief scuffle as they tried to escape but we apprehended them and then went to their unit to arrest the other two members." At the unit, police found the premise stuffed with car spare parts such as headlights, taillights, signaling apparatus, mufflers, exhaust pipes, car seats and fake car plate numbers.

"After questioning them, we recovered another Honda they stole at Sungai Petani in Kedah," said Thaiveegan, adding that police are still determining the extent of the gang's crime spree. "Urine tests on the seven suspects, in their 20s and 30s, tested positive for methamphetamine (syabu). They used the Sri Indah flat as their base for the past half year." Checks showed five of the members, including the ex-Immigration officer who was discharged in 2008, had previous criminal records for car thefts and drug abuse.

Sabah vet department studying report on abuse THE Sabah Department o f Ve t e r i n a r y S e r v i c e s & Agricultural Industr y (DOVSAI) is acting on a report from the Kota Kinabalu chapter of the Society for the Prevention of Cruelty to Animals (SPCA) concerning the inhumane treatment of stray dogs by dog catchers. The incident occurred near an apartment building in Kota Kinabalu on Sept 15. "The SPCA report was sent to us on Sept 23 and is now with our legal department which will investigate if there is sufficient evidence to bring the case to court," said DOVSAI director Dr Yeoh Boon Kiat (pic), when contacted by The Malay Mail. "We will also interview the apartment's management which hired the dogcatchers and the individuals who witnessed the acts of cruelty and had made police reports." Dr Yeoh said if his department was satisfied with the evidence, they would submit a report to the AttorneyGeneral's office for further action. He said that under the Cruelty to Animals (Prevention) Ordinance 1925, any person convicted can be fined up to RM500 and

She also quickly contacted the SPCA which sent a re s c u e t e am which managed to convince the dogcatchers to release the surviving strays. S P C A Kota Kinabalu president Mohammad Iskandar Shah said they met the apartment's management on Sept 21 to get their side of the story. "We then submitted our report to DOVSAI which told us our report would remain confidential while they carried out their own investigations," he said. THE introduction of a National Transplantation Act will not be able to curb the illegal trade in kidneys and other human organs unless there is an agency dedicated to enforcing it. Such was the view of several medical practitioners concerning Health Minister Datuk Seri Liow Tiong Lai's announcement of a new law to govern organ donations and transplants. Ma l ay s i a n Tr a n s p l a nt Association (MTA) president Datuk Dr Harjit Singh said there is a need to have a "solid agency" to monitor organ transplants for the new Act to be effective. "Right now there are hospi-

tals which are not following the rules and proper procedures on organ transplants and, as such, stringent checks must be conducted or else the illegal trade and transplants of human organs will continue," he said, adding that police and court action should also be taken against offenders. BLIND-FRIENDLY information technology is something not many people would have heard about. Braille-based computer equipment and speech technology are some of the adaptive tools being introduced by the Malaysian Association for the Blind (MAB) to enable the blind community to use information technology and the Internet effectively. The tools will be introduced at the Information Communication and Technology (ICT) course — one of the activities planned during MAB's fund-raising campaign from tomorrow to Nov 21 in conjunction with its 60th anniversary. Officers empowered to issue summonses for traffic offences from Saturday FROM Saturday, Kuala Lumpur City Hall officers will, for the first time, be able to issue RM300 summonses to motorists for traffic offences beyond wrongful parking and failure to pay parking tickets. KL mayor Tan Sri Ahmad Fuad Ismail said that with this move, City Hall will be the first local council to be given powers similar to those of the traffic police. "From October, our officers can issue summonses to motorists who commit traffic offences such as running red lights, stopping in yellow boxes and jumping queues, with fines up to a maximum of RM300," Ahmad Fuad said at a Press conference yesterday. CITY HALL plans to increase its tow-truck fleet to take more regular and wider action against indiscriminate parking. "We now have 30 tow-trucks and will be adding more such vehicles soon," said KL Mayor Tan Sri Ahmad Fuad Ismail who, however, did not specify how many more. "There are six 'hotspots' where we constantly tow away

illegally-parked vehicles and we will not let up as they cause traffic congestion and inconvenience for other road users." From January to August, City Hall towed away 5,852 vehicles and collected RM1,063,637 from offenders, including compound fines, towing and storage charges. 'Smile' drive for friendlier services TO encourage all 11,000 employees of City Hall to be friendlier with the public, KL Mayor Tan Sri Ahmad Fuad Ismail yesterday launched a "smile" campaign themed Kami menyambut anda dengan senyuman (We welcome you with smiles). "The purpose is to improve and strengthen our services at our counters for the public, as we want all our staff to be people-friendly, especially in face-to-face situations with complainants," he said, adding they currently have 216 service counters and 50 payment counters under their jurisdiction. Tourism income to triple by 2020, says Yen Yen

MALAYSIAN tourism's contribution to Gross National Income (GNI) could almost triple to RM94 billion by 2020. "Last year, we received 24.6 million tourists generating a GNI of RM34 billion, making tourism the fifth largest contributor to our national economy, and Malaysia is currently ranked ninth in the list of the world's most travelled destinations," said Tourism Minister Datuk Sri Dr Ng Yen Yen amid World Tourism Day celebrations at her ministry's new building in Precinct 5 yesterday. "The ministry is working on a Malaysian Tourism Transformation Plan which aims to lure at least 36 million tourists each year and this

hopefully will ensure the tourism GNI will reach RM94 billion by 2020." Celebrated globally every Sept 27, World Tourism Day for Malaysia saw the toasting of the industry's evolution and achievements over the decades, along with a Riang Ria Aidilfitri open house and a musical performance by local artistes. Traders encroach on road Diners posing danger to motorists, say Cheras residents

FOOD sellers outside the Velodrome in Cheras are encroaching on the road when they are supposed to be confined to the designated parking area. "Tables and chairs are being placed on the road as more and more people dine there," says Cheras resident T. JAMES. "This is not only illegal but leaves only half the road left for vehicles to squeeze through. "I often use the road to go to the mini-market and I have to be extra careful not to crash into the diners." He says this has been going on for a few years but City Hall has not taken any action. JAMES also says he learned that some of the traders do not have licences. Another resident, ABDUL

HAMIDI, says the diners do not seem to be worried about getting involved in an accident. "The traders have been doing business there for close to two years and I have yet to see any action by the authorities.'' ● CITY HALL deputy director-general Datuk Amin Nordin Abdul Aziz says its enforcement officers will be working with the People's Volunteer Corps (Rela) to keep a lookout for illegal traders operating there. “Even as we speak, there are officers from both sides stationed there," he says. Amin Nordin says action will be taken against illegal traders as well as those who place tables and chairs on the road.

THE Royal Malaysia Police (PDRM) are stepping up measures to encourage public confidence in the force. I see positive potential in having law enforcement officials interact with the public. This was proven during the recent launch of the PDRM Twitter and the first anniversary of the PDRM Facebook. I notice many suggestions coming from the public and it is crucial for the police to see how well the subordinates do their job, and whether local residents and community organisations have grouses. Online social networking and micro-blogging services, such as Facebook and Twitter, have allowed PDRM to not only mingle with their fans on the Internet but also be effective in reaching out to more people at one time than ever before. PDRM’s Faceb o ok and

Twitter have reached out to different members of the community, specifically young people, who rarely come to any meetings organised by the police. Within the problem-solving process, the force could work closely with the community to clearly identify the underlying causes of crime or other problems that negatively affect the community's safety and security. They could then actively partner with the community to find and implement solutions. With PDRM’s Twitter and Facebook, they get at the heart of both social media and policing, allowing for the delivery of messages to the public in a direct way. This builds on the trust, confidence and legitimacy areas which are so important to delivering excellent local policing.

The experiences of PDRM illustrate social media can be of great value to law enforcement agencies. Online social media sites are a perfect outlet for community policing as they allow for both outreach and prevention. Furthermore, sites like Twitter and Facebook provide a private forum for members of the community to communicate valuable information about a suspect or simply their safety concerns to the police. Information sharing with the public has always been a priority of the police. Social media also enables PDRM to accomplish pre-existing operational goals by facilitating the transfer of specific and targeted information in more efficient and innovative ways. The proof in the pudding will be if we start losing viewers. That will be the message to us that we are not doing

things right. As long as we keep growing in numbers, we will know we are hitting the right mark. The police are committed to developing trust and confidence in our communities. They strive to put the public at the centre of everything they do. I commend DSP Lai Lee Ching and her team from the Bukit Aman Public Relations Department for the courageous and bold leadership they have shown during the recent successful launch of the PDRM Twitter and the PDRM Facebook's first year in service. IN my opinion, Indah Water Konsortium Sdn Bhd (IWK) should have carried out surveys or studies on why many people have failed to pay the national sewerage company's service charges. They should meet the people and ask them to answer several simple questions to determine the real reasons why they are reluctant to pay

these charges. Only then will IWK be in a position to conclude whether the people “take IWK service for granted” or not. Develop a few surveys or questionnaires, which can be easily comprehended, and hand them out to as many respondents as possible. The surveys should be distributed to various zones such

as high, medium and low density areas. The zones can be further broken down into types of houses like low-cost flats, medium-cost apartments, condominiums, landed properties and so on. IWK is owned by the government and the government belongs to the rakyat. Thus, IWK must always reach out

to the people and take into consideration their problems and their voices. To a certain extent, they have a right to shape the directions of IWK and demand strong p erformance from IWK, simply because IWK belongs to the people. Saridzayana Mat Sarip

KLang: Prefects resign en masse (Sept 27)

Sticky selection THE Klang High School prefects are selected from the best students in the school and even then do not get to be a prefect immediately. They are put into a trial and probation period before a final selection is made and, most of the time, only half make the cut. Unlike some other schools where prefects are chosen and recommended by the teachers (usually the teacher's pet), these boys are reviewed by senior prefects and board members first and foremost before being recommended to the school's administration for approval and appointment. This has been the school's tradition of vetting and grooming the next leader. The Prefectorial Board prides itself as to being an almost independent and mature student body and being a part of it is a privilege instead of a chore. So, when there is direct intervention by the principal, no matter what the reason, it is clearly a statement from the principal she has no trust and faith in the currently selected Board of Prefectorial Committees, and discredits the decisions made by the previous board on the selection of the current one. So what is the correct, sensible and mature thing to do? Resign

and make way for a new selection of committees to be proposed again. Even in the corporate world, when shareholders, being the owners of the company, voted to dismiss the CEO or replace the board, they are expected to do the same thing too, that is, to leave gracefully and make way for the next selection. The very action of the principal in appointing her own choice of head prefect, however, is clearly taking over what has been traditionally the function of the immediate preceding Prefectorial Board. To add insult to injury, a Form 4 boy as head prefect? One who has yet to be able to prove his worth and mettle in the school? The strength of a prefectorial body is reflected by the people in it. If you put a person who has not earned respect, he will get none. What will happen to the body this person represents? The whole board are not respected either. So what does this mean? The Klang High School's Prefectorial Board is reduced to being just another run-of-the-mill body in a regular school. What a shame! Ex-board member

Bone to pick DURING my days as a prefect, from 1979-1980, selection was made through a campaign and "house" election process, but some do get nominated into the prefect board. Nowadays, most of the members in the Prefectorial Board are selected through nominations. Thus, the criteria of selection is critical and those involved must have "competency", to a certain extent, on the selection process. Having said that, the parties involved in the selection of "good for nothing" prefects must

also take some ownership for their nominations, not to mention, coaching and nurturing the new batch. Let us look at the whole situation. Starting from the selection process, the prefect must be given a fair chance to grow once he or she is selected, . I am certainly not supporting a Form 4 student to hold the head prefect's post as he or she will not get acceptance or respect from the more senior students. Noor Hisham

It comes after the company officially denied it used cookies to follow people's movements online, the Herald Sun reports. Australian technician Nik Cubrilovic blogged about the tracking and was called by Facebook's engineers in the US yesterday. "Even if you are logged out, Facebook still knows and can track every page you visit," Cubrilovic wrote in his blog post. Courtroom thriller Death versions clash as trial of Jackson doctor opens

MICHAEL JACKSON'S doctor was guilty of "gross negligence" which led to the pop icon's death, a prosecutor said yesterday — but the medic's lawyer countered bluntly that the star killed himself. At the start of Conrad Murray's long-awaited manslaughter trial, his lawyer said the King of Pop took two different drugs while the doctor was out of the room at the star's rented Holmby Hills mansion on June 25, 2009. In haunting scenes, a photo of Jackson's dead body under a white cover on a hospital gurney was shown in the court, which also heard an audio recording of the star apparently heavily drugged, less than two months before his death. "He did an act without his doctor's knowledge, without his doctor's permission, against his orders, he did an act that caused his own death," said Murray's lawyer Ed Chernoff. Specifically, he said Jackson swallowed eight two-milligram

lorazepam pills, pushing his blood concentration of the anti-anxiety drug to 0.169 micrograms per milliliter, enough to put six people to sleep. Jackson "did this when Dr Murray was not around," Chernoff said, claiming the 50-year-old singer also gave himself an extra dose of the powerful sedative propofol, which he was using to help him get to sleep. "The scientific evidence will show you that when Dr Murray left the room, Michael Jackson self-administered a dose of propofol that, with the lorazepam, created a perfect storm in his body." The combination "killed him instantly... He died so rapidly, so instantly, he didn't even have time to close his eyes," he said. Murray, 58, faces up to four years in jail if convicted by a jury of seven men and five women of involuntary manslaughter in the death of Jackson, as the star was preparing for a series of comeback

concerts. The physician is alleged to have given Jackson an overdose of the powerful sedative propofol — which Jackson himself referred to as "milk" — to help alleviate his insomnia. In the prosecution's opening statement, deputy district attorney David Walgren said: "The evidence... will show that Michael Jackson literally put his life in the hands of Conrad Murray. "That misplaced trust... cost Michael Jackson his life," he added, claiming Murray was motivated more by his US$150,000 (RM471,450) contract with Jackson than by his duty of care to the singer. The doctor made a series of phone calls — and even emailed an insurance agent dismissing media reports that Jackson was too sick to play the London concerts — while Jackson lay dying, he said. 'Price of sex hits all-time low'

THE "price" of sex has dropped to new record lows with an increasing number of women bed-hopping during dates, without expectations about long-term commitments, social psychologists revealed, the Times of India reports. More than 25 per cent of young women are giving it up within the first week of dating, increasing the pressure on other women and changing the expectations of men, the report said. "The price of sex is about how much one party has to do in order to entice the other into being sexual," the New York Post quoted Kathleen Vohs, of the University of Minnesota as saying. "It might mean buying her a drink or an engagement ring. These behaviours vary in how costly they are to the man and that is how we quantify the price of sex." Researchers also found 30 per cent of young men's sexual relationships involves just sex and no romance — no wooing, dating or goofy text messaging. However, if sex continues to be cheap over the course of multiple relationships, it will only add to men's reluctance to commit, warns Mark Regnerus, a sociologist at the University of Texas. "Sexual strategies for making men 'fall in love' typically backfire, because men don't often work like that," Regnerus said. He said its time women return the balance of sexual power by crossing their legs so the price of sex would soar and women would regain control of the "meet market", he added.

Round two for Tsai Chin Pix and story by LOONG WAI TING waiting@mmail.com.my KNOWN for her hits, wit and strong stage persona, Taiwan’s legendary singer, Tsai Chin, will once again be in Malaysia for another concert at the Arena of Stars, Genting Highlands on Nov 5 at 8pm. “I was told a lot of the fans couldn’t make it to my concert earlier this year because there weren’t enough tickets. So, to make sure they get to see me, I will be coming back for another round,” Tsai said in a telephone interview recently. She said fans can expect the upcoming concert to have more or less the same repertoire, embellished by roughly the same look and feel. “It wouldn’t be nice and a little unfair if I included a completely new rundown, particularly for those who missed the first round. For those who have seen it the first time and

would love to come again, please feel free to do so,” she said. Currently performing in China, Tsai had not been slowing down since her concert in Malaysia in April. After a short rest at her home in Taipei, Tsai had been jetsetting to several different countries including Macau and Australia for shows and concerts. The 53-year-old singer has recently been declared very fit by her doctor when she went for a regular medical check-up.

“My doctor was impressed. He was especially very happy with my exercise regime,” said the singer who is well-known for her strict health regime and diet. Tsai was all praise when it came to her Malaysian fans who had always supported her every performance. She said Malaysian fans are especially great listeners and definitely know what they want. While fans can certainly hope for an even better show from the truly energetic singer, Tsai assured fans

that she is just as excited. “Of course I am excited! I will be waiting for you to come to my encore performance,” she added.

Shaun Chen plays Ah Hai, a character whom he describes as a “very bad person.” “Ah Hai is a sexually-transmitteddisease (STD) carrier. He abuses his wife and infects her with the STD,” Chen said. “But as viewers get deeper into the storyline, they might begin to understand a different side of the man,” Chen said. Playing his poor onscreen wife is Singaporean actress, Yvonne Lim. This is her second time working with Chen, whom she says she is “comfortable” with. “There’s certainly chemistry between us as an on-screen couple,” she said. “Working on the series and filming it in Malaysia have been joyful for me. It is definitely a fresher approach after being involved in a Chinese production in China for a while,” she said.

demanding drama.” Lim added that there is a good flow between the storyline and the characters. “But it’s really a sad drama! Even after the director yelled, 'cut', I couldn’t stop myself from crying, and that scared the wits out of everyone!” Lim laughed. For Chen, he said that as an actor, he just needed to be as natural as possible to bring his character to life. He also said it was important not to try too hard to impress. “I feel my character is unique enough and I do not have to work too hard to stay afloat among the two female leads,” he said. — By

The Penal Code does not have a Section 1291. Section 192 speaks about fabricating false evidence, Section 415 on cheating while Section 416 is on "cheating by personation". The letter also said "action taken against Sports Commissioner Datuk Yasin Salleh under Section 119 (a public servant concealing a design to commit an offence which is his duty to prevent) and criminal conspiracy (Section 120A)". The third paragraph of the letter, which included Chin’s chronology of the events that took place, says, "the synopsis provided hereunder forms the basis for our police report lodged and additionally for our legal counsel to file the proceedings in Court". Here's a quick lesson. When a police report is lodged, the powers of investigation lie with the police. Investigation is done based on present laws of the country including the Penal Code. If there is a strong case at the end of the investigation, it will be handed to the Deputy Public Prosecutor. It is the duty of the prosecutor to initiate legal action. Article 145 (3) of the Federal

Constitution states: "The AG shall have power, exercisable at his desecration to institute, conduct or discontinue any proceedings for an offence". This is also seen in Section 376 (1) of the Criminal Procedure Code (CPC) which reads: "The AG shall be the public prosecutor and shall have the control and direction of all criminal prosecution and proceedings under the CPC". The first two paragraphs of Chin's letter speaks about the Penal Code, which is usually raised when there are criminal elements leading to a criminal proceeding, but the third paragraph speaks about a possible civil suit instead? Copies of the letter was sent to the Prime Minister's Department and to Sports Minister Datuk Ahmad Shabery Cheek. Yasin, who is one month short of celebrating his first year as the Sports Commissioner, had this to say: "We are prepared to face anyone. We have all the documents so let's wait and see." "I think the way the country has recovered so far is impressive," he said in an interview posted on the team website. "Of course, there is still a long way to go, but the progress has been remarkable." Kobayashi, who is in his third season at this level and could better his haul of 32 points last term, said it was great that the race was going ahead in Japan. THE step-father and ex-manager of a top female boxer faces 10 years in prison after shooting her in the hand and legs just before a world title fight, as his trial began this morning. Former world champion Rola El-Halabi, 26, was shot in her changing room by her 44-year-old step-father, who has been identified only as Roy E, just before she was due to fight in Berlin on April 1. He is charged with aggravated assault and attempted grievous bodily harm. On the first day of his trial, Berlin's regional court heard how he went to the trotting track in Karlshorst in a suburb of the German capital, originally to pick up his son. He has admitted that he shot his step-daughter after an altercation with security guards at the stadium just before lightweight El-Halabi, who was born in Beirut, Lebanon, was due to fight Bosnia's Irma Adler in an IBF world title fight. El-Halabi told the court how she had found her stepfather to be a difficult man. She described how she was hit by four shots that were aimed at her hand, knee and both feet before the accused also shot the security guards,

who later recovered. After the attack, El-Halabi spent several weeks in a wheelchair and has had several operations on her hands and feet. The background to the shooting was a private dispute between the boxer and her step-father, after his contract to manage her was terminated in January. GOALKEEPER Petr Cech is under no illusions as to the size of the task facing Chelsea when they play Valencia in a Group E match at the Mestalla tomorrow (2.45am) but is confident of picking up three points. Chelsea made a winning start to their Champions League campaign with a 2-0 home win over Bayer Leverkusen earlier this month, while Valencia drew with Genk. Valencia have proved their European pedigree in recent years and Cech is expecting a tough game. However, the Czech Republic international can take positives from the Blues' recent record against the Spanish side. "We have good memories of Valencia," Cech said on his website. "We played against them in

the Champions League twice in recent years and each time we won. We know nothing easy is awaiting us there. Everyone consider us and Valencia the main favourites for advancing from the group. "They have been doing well in Primera Liga which they have started well, but we will manage to win as we want to secure qualification as early as possible." Chelsea will have inside knowledge of Valencia's strengths and weaknesses from midfielder Juan Mata, who left Los Che during the transfer window to move to Stamford Bridge. Mata has made an impressive start to life with Chelsea and Cech hopes he will turn in another strong performance against his former club.

"Juan knows them through and through so he will surely have a lot to say on Valencia's style of play," said Cech. "He has been a great signing for us and he has been doing well right from the start. That's good for him as well as for us."

Young saves United blushes after Basel fightback

MANCHESTER UNITED needed a last-gasp goal from Ashley Young to snatch a 3-3 draw with Swiss side FC Basel this morning in a thrilling Champions League battle at Old Trafford. Young steered in a 90th minute header from a Nani cross to deny Basel a famous victory after two goals from Alex Frei and one from namesake Fabian Frei had fired the Swiss side into a 3-2 lead at Old Trafford. United, missing the injured Wayne Rooney, had looked to be cruising to victory early on after two first-half goals in the space of a minute from Danny Welbeck helped them into a 2-0 lead at the break. But Sir Alex Ferguson’s men were left shellshocked by a superb second-half fightback from the Swiss visitors, who ruthlessly punished slack defending by the English champions to go within a whisker of a famous upset. “We were careless. They made two or three chances in the firsthalf but a lack of concentration killed us,” Ferguson said afterwards. “It was a really good performance in the first-half but we were left grappling to get a result in the second-half. We threw it away. “Losing three goals at home should be a wake up call for us.” The draw leaves Basel on top of Group C with four points from two games, with Portuguese side Benfica second on

goal difference. United are two points off the pace after two games. United were given a let off after only six minutes, Basel captain Marco Streller sending Fabian Frei racing into the box with a deft reverse pass through the legs of defender Phil Jones. The covering Rio Ferdinand did just enough to unsettle Frei but the striker should have done better with his shot, which flew high and wide. United’s response was swift, Ashley Young beating his marker before curling a cross to the far post which Antonio Valencia headed wide. Basel were back under pressure soon afterwards, goalkeeper Yann Sommer forced to save from Young’s shot on 14 minutes after more good work from Valencia. With United probing Basel menacingly, it appeared only a matter of time before the visitors defence buckled and on 16 minutes United took the lead. Valencia sent fullback Fabio charging into the box with a perfectly weighted pass that sprang the Basel offside trap, and the young Brazilian squared for Ryan Giggs, who laid off for Welbeck to screw a low angled shot in off the post. The celebrations from that effort had only just subsided when Welbeck grabbed his second a minute later, Giggs threading an exquisite pass through to Welbeck for the United striker to

stab home. Yet the remainder of the half was anything but one-sided, and had Basel possessed a more clinical finisher the visitors might easily have scored, Alex Frei squandering good openings in the 24th and 36th minutes. United maintained their commanding two-goal lead at halftime but Basel were far from ready to concede defeat after the break and should have pulled a goal back on 51 minutes through Streller. Once again, United’s defence were caught out by lax marking and Streller found himself with only David de Gea to beat.

But with the goal at his mercy Streller took a fraction too long to get his shot off and the Spanish keeper was able to block with his legs. That ought to have been warning enough for United, but seven minutes later the English champions were found wanting again. De Gea saved brilliantly from a Streller header but United were slow to clear and Fabian Frei had time to lash home for 2-1. Two minutes later and Basel were level. Granit Xhaka sent Fabian Frei racing away down the right flank with a lovely ball,

who then floated a wonderful cross into Alex Frei who steered his header beyond de Gea to level it. On 75 minutes United’s worse fears were realised when Jones tried to pass the ball out of defence and Basel went on the attack once more. Streller darted forward onto the loose ball and when Valencia bundled him over, referee Paolo Tagliavento immediately pointed to the spot. The veteran Frei duly stepped up to shoot Basel ahead. That looked to have settled it until relentless late pressure secured Young’s late strike. — AFP

MANCHESTER CITY boss Roberto Mancini has insisted striker Carlos Tevez (right) is “finished” with the club after he refused to go on in the defeat at Bayern Munich in their Champions League match this morning. “Yes, he refused to go on,” confirmed Mancini, who had wanted to make Tevez his second substitution during City’s 2-0 defeat in Munich. “I don’t know, but with me he is finished,” fumed the Italian when asked where Tevez’s future lies now and added the decision to sell Tevez is in the hands of City chairman Khaldoon Al Mubarak.

“Yes, I am really disappointed, because he is Carlos. “When one player refuses to go on to help his teammates in a match as important as this, it is very disappointing.” The former City captain has had a troubled time at City since being released from Manchester United in 2009 with Tevez even handing in a written transfer request last December citing family reasons and a break-down in relations with the club. The matter was later resolved with Mancini saying he thought the Argentinian star would stay but stripped him of the captaincy.

But Tevez’s latest tantrum at Munich’s Allianz Arena left the Italian repeating the star striker is finished at the Eastlands club, as far as he is concerned. “He refused to warm up, he was going to be my second substitution,” said Mancini. “If one player earns a lot of money for Manchester City and refuses to go on, for me, he is finished. “If we want to improve, Carlos can’t play with us, he is finished. “We will speak about this with the chairman in the next few days. “He is the chairman, he makes the decision.” — AFP
