2013: Moving Forward With Purpose

The PBCMS Board of Directors have set forth a focused agenda for the coming year .The priorities outlined include: enhancing our communication and programs to inform ,educate, and engage our members on the latest developments affecting the practice of medicine , continuing strong advocacy and legislative efforts and providing support to the graduate medical education programs in our community. The By-Laws Committee has presented recommend changes to the by-laws to streamline and enhance the efficiency of the Society. The proposed By-Laws changes are posted on line at www.pbcms.org and will be discussed at the Board of Directors Meeting to be held on Monday, March 4 at the Palm Beach County Health Care District. Members are encouraged to attend. A summary of the proposed by-law amendments and ballot will be mailed to members and a vote will take place at the General Membership Meeting on April 25, 2013. The proposed changes include the establishment of five Councils to guide the work of the organization. Council on Member Services , Council on Advocacy and Legislation, Council on Administration and Finance, , Council on Communications and Technology and the Council on Medical Education. I hope that you will join a Council. This is an excellent way to become engaged, meet your colleagues, and truly make a difference in your profession. The Council on Advocacy and Legislation is off to a strong start reviewing legislative issues, establishing legislative key contacts and planning PBCMS Doctor’s Day trip to Tallahassee in March and participation at the AMA Advocacy Conference in Washington DC. The newly launched Palm Beach County Medical Society Management Services will host an information session on February 28, 6pm at the Society offices. Join us to learn from our practice management professionals how to improve your bottom line, enhance practice efficiencies and maintain your practice autonomy. Space is limited and reservations required. Medical Society Services will host their annual meeting on March 14th at the Atlantis Country Club. The evening will recognize the accomplishments of over 1,750 volunteers engaged in Project Access, HERC, Medical Reserve Corp, Future of Medicine, Community Call to Action and Triple Aim Initiative , our funders and community partners. Douglas Dedo MD will be installed as President, Michael Dennis MD, Vice-President, Ivy Faske MD Secretary and Don Chester ,Treasurer. Be sure to mark your calendar for the 10th Annual Heroes in Medicine Celebration on May 9 at the Kravis Center Cohen Pavillion . Chaired by Sally Chester and Greg Quatelbaum, this year’s event promises to be a great success. Our ambitious agenda for 2013 will only be possible with the support of our members. generalist and specialist, conservative and progressive.I also want to thank everyone who supports attendance, the charitable arm of our organization, the Palm Beach County Medical Society Services. Your generosity supports Project Access a truly successful program that has allowed Palm Beach County doctors, labs, imaging centers, and hospitals to provide over $9 million in free care to uninsured patients in Palm Beach County. The funds donated to Medical Society Services to help support Project Access probably save at least four times as much money, over $32 million, in the long run by cutting down on repeated un-reimbursed ER visits and nighttime specialist consults. Money is also saved because medical conditions are controlled before they become so acute that emergency care and hospitalization, again un-reimbursed, is necessary. Your involvement matters and I thank all of our sponsors and our volunteering individuals and institutions. Another valuable community project made possible by your support of Palm Beach County Medical Society Services is the Healthcare Emergency Response Coalition, or HERC. This organization works to assure that Palm Beach County is ready when disasters such as hurricanes or other events that challenge the county’s healthcare delivery resources strike. HERC interacts and communicates with local, regional, and national agencies to provide emergency health care services where they are needed and provides ongoing training to personnel responsible for handling local emergencies. HERC works together with the volunteer physicians, allied health providers, and other interested professionals such as interpreters, office staff, hospital administrators, and chaplains who make up the Medical Reserve Corps of Palm Beach County to position staff and resources in the right places at the right times to assure we are ready when unanticipated emergency medical needs arise. Moving forward my mission, and the mission of PBCMS is to make sure that doctors and their patients have a voice locally in Palm Beach County, work regionally with Dade and Broward County Medical Associations, and on the state level and nationally though our alliances with the Florida Medical Association and the American Medical Association in the years ahead, years which promise to bring significant change in the way health care is delivered and provided. With the election season behind us it is now more certain that much of the Affordable Care Act will ( P R E S I D E N T S R E P O R T- C O N T. )

be implemented over the next decade and we need to be prepared to make sure it is implemented in a way that protects the physician and his or her patients from harm. Providing more of the United States’ population with health insurance is a noble goal but if the proper implementation is not there, if there are not enough doctors to serve the community, or if poorly thought out rules and regulations are made by bureaucrats who don’t know what things are like on the front lines of health care then we will all suffer. I insist we physicians will be part of the political conversation and I insist that we physicians will continue to protect and care for all of our patients as we would our own family members. I care deeply about the total health of all Americans. I also believe in Palm Beach County Medical Society initiatives which we should all support such as the new obesity coalition and the new diabetes initiative modeled after the Institute for Healthcare Improvements’ Triple Aim program …..health care in the future should work toward achieving 3 goals…..a better patient perception of the care experience, lower per capita health care costs, and better actual population health results. We as doctors must take the lead in making this goal a reality, and indeed because we are the first medical society in the country to spearhead a Triple Aim program with the help of our community partners. I have a vision for this reality. The best way to achieve this is to help our patients and the community at large take control of their own health outcomes. In my own experience I know there are safe, inexpensive ways to achieve the same goals that are currently most often achieved through expensive, aggressive interventions. When I perform weight loss surgery I wonder if perhaps children were sent to school with more healthful lunches; if schools and parents encouraged the consumption of cheap but healthy foods like fruits, beans, canned fish like salmon, whole grains, popcorn, all-natural nut butters, and healthfully prepared vegetables and insisted their (CONT. MEMBER SPOTLIGHT: Mark J. Hirsh MD, FACP

PBCMS would like to introduce member Mark J. Hirsh MD, FACP; a nationally active, board-certified rheumatologist. A native Floridian, Dr. Hirsh graduated Phi Beta Kappa with his Bachelor of Science degree and medical degree from the University of Florida. After an internship at Northwestern University in Chicago, he completed residency in internal medicine at Jackson Memorial Hospital, University of Miami. He served on the faculty for one year as Chief Resident before completing his sub-specialty training in rheumatology at the University of Miami. Dr. Hirsh is the founding physician of Advanced Rheumatology Center, a three-physician, single-specialty medical practice located in Delray Beach, FL. As a board and panel member of numerous medical organizations, Dr. Hirsh remains active on a local and national level. Dr. Hirsh is dedicated to the integrity of ultrasound in medicine. He is a nationally recognized musculoskeletal ultrasound instructor involved in the education of other physicians in various specialties including orthopedics, pain management, physiatry and rheumatology. Dr. Hirsh is individually credentialed in musculoskeletal ultrasound and Advanced Rheumatology Center is the first and only Florida practice accredited in musculoskeletal ultrasound. With the use of ultrasound for diagnostic and advanced techniques like ultrasound-guided cortisone injections and ultrasound-guided PRP injections, Dr. Hirsh has helped provide relief for many people.

Doctors in Florida get sued on average about once every nine years. Some surgical specialists get sued more often, roughly once every five years. These malpractice lawsuits can last up to ten years, with the average being about two and a half years from the time a doctor receives notice of a lawsuit to the time of final resolution. Of course if a case goes through a jury trial the timeframe is much longer. That means that a doctor practicing for twenty five years in Florida will on average spend ten years fighting extremely personal and stressful lawsuits, with higher risk specialists spending even more years defending themselves. In other words up to 40% of some Florida doctors’ practice lives are spent defending themselves! This is a true affront to America’s doctors and has been called a national disgrace! Doctors train long and hard to be completely prepared to practice excellent medicine so that they can take the very best care of their patients but unfortunately they spend very little time preparing to defend their own reputations in a court of law and especially in the critical deposition stage. Usually with only a few days left before their first round of depositions and the mental and emotional stress of the drawn-out lawsuit process starting to crescendo, doctors are given some tips by their defense lawyers and then basically turned loose to suffer the scornful and often tricky verbal warfare of trained and experienced plaintiff attorneys.These sessions can be the unfolding of doctors’ worst nightmares, to say the least, particularly because doctors are not accustomed to facing such challenges so unprepared. Dr. Frank Kucera spent 38 years practicing general surgery in Delray Beach and way too much time fighting malpractice insurance claims. He not only helped his own defense team defend his reputation but assisted countless other doctors defend theirs. His wealth of knowledge on this subject is broad and his peers will gain much by taking note of his many great pearls of wisdom.

Q. How should a doctor who is being sued prepare for a deposition? A. First read every word of the hospital chart very carefully so you will know exactly what is in and what is not in the

record. Do the same for your office records. In preparation for your deposition, the average defense attorney will say "just tell the truth and answer the questions."

Actually, there is much more that you need to know. The goal of the plaintiff attorney is to get you talking too much so that you will give him information harmful to your case, and to intimidate you into settling the case. If a case goes to trial only one attorney wins but if the case is settled, both attorneys win. Your goal is to not give the plaintiff attorney anything he does not already have. What does he already have? He has a copy of the hospital record and the opinions of his expert witness. Ideally, you will add as little as you can to what he already knows. Before a plaintiff attorney decides to sue you, he obtains a copy of the hospital record and has it reviewed by his expert. Hopefully, if an attorney requests the hospital records on one of your patients, the hospital medical records clerk will so inform you. At the deposition, you will be asked your name, office address, names of partners, professional training and experience, structure of your corporation or partnership, your insurance company, your policy limits, marital status and if you have

you protected any of your assets. If there is no way the plaintiff attorney can get at any of your assets, he will either lose interest or offer you immunity if you agree to testify against the other parties in the lawsuit. Any notes, records or papers you bring can be examined by the plaintiff attorney, copied by him, and used against you. If you bring your copy of the hospital record, be sure you have not written any notes or comments on it. Above all do not alter the hospital record in any way or make any additions. Remember, the plaintiff attorney received a copy of the hospital records before you knew you were being sued, and if your copy shows any subsequent alterations by you, you have just lost the case. Altering the hospital record is indefensible. The same advice goes for your office records. If you have made any notes on your hospital record, both attorneys will have a copy and you can use one of theirs. You will be asked if such and such textbook or medical article or person is authorative in your opinion. The correct answer is always no. If you say yes, and he can then find a statement in that text or article that disagrees with your testimony or treatment, then you have lost that point and will look bad in front of the jury. "Doctor, your partner Dr. Jones is also being sued in this case so I presume you have discussed this case with him". The correct answer is “no, I only discussed this case with my attorney". The plaintiff attorney can do nothing with this answer and cannot pursue this line of questioning further. “Doctor, what did you read and research in preparation for this deposition?" The correct answer is "nothing, I am relying on my training and my experience." That will end this line of questioning. Any texts or articles you mention can and will be used against you.

Probably the biggest mistake doctors make in a deposition is to attempt to try the case, wherein they talk much too much and give the attorney information that he will use against you. Just answer the questions; you will try the case later. Too many doctors lose their case by just talking too much at their deposition. Time does not show on a deposition. You can walk to the window, look out and think about the question. You can privately consult with your attorney and take time out for a potty break. "Doctor, I want you to comment on a hypothetical case." This is a trick question wherein a hypothetical case similar to your case will be presented and then your answers will be taken out of context. The correct answer is: “Mr. Attorney, I am here to testify on my case and do not wish to testify on any hypothetical case.” He may threaten you but you are not obligated to testify about any hypothetical case.

Keep your answers short and try not to give the attorney anything he does not already have. Dr. Frank Kucera is a Past President of the Palm Beach County Medical Society, Past President of the 5 county Independent Physician’s Association and a past chairman of the Committee on Legislation for the Florida Medical Association. Dr. Kucera has given seminars on how to do a deposition for the FMA, has served as an expert medical witness in dozens of medical malpractice cases and has reviewed dozens of alleged medical malpractice cases for FPIC and other professional liability insurance companies. children developed a t a s t e for these foods; if governments and doctors stood up to powerful interests that place unhealthy foods in school cafeterias and allow soft drink companies to sponsor TV shows and sporting events when these foods and beverages are now causing more deaths than tobacco products; if physical education once again became an important part of the school-age curriculum and if; worst of all, our legislatures stopped subsidizing the production of processed corn and soybean based junk food as a handout to wealthy agricultural interests, artificially making more healthful foods relatively more expensive..…I wonder how much money could be saved down the road. More surgery is not the ultimate answer to our country’s health and obesity epidemic. I know firsthand patient directed, doctor guided lifestyle interventions can save money and save lives. My own wife, Ivy, the American College of Sports Medicine Certified Health Fitness Specialist was diagnosed with MS at the University of Miami 14 years ago. Our first best-selling book the Gold Coast Cure introduced an anti-inflammatory diet that has worked to keep her condition in remission ever since. I knew the diet would work because I took the time to research it…..if you have a supportive doctor and a motivated patient, one who is involved in their own health you can’t lose! My wife and I have lived Triple Aim…..better patient perception of their care, lower costs, and better health outcomes. Nutrition and lifestyle based interventions should become the cornerstone of all of our medical practices and we as members of the Palm Beach County Medical Society should educate ourselves better on this subject and support efforts politically to this end. I want to make Palm Beach County a better place for doctors to work and as president will fight hard to that end but in the long run there is a bigger goal….. the good health and the ultimate economic future of our nation. To this goal the medical society will continue to support grand initiatives like the Future of Medicine conference and the Triple Aim project. I look forward to continuing in this direction in 2013. We have an excellent group of professionals on the 2013 PBCMS Board of Directors. And new 2013 Board of Trustees will be challenged with the development of a leadership academy and building improvements.
