Advisory: Memorial Day Holiday Weekend DUI Enforcement Blitz Los Angeles County, CA – The Avoid the 100 DUI Task Force/Los Angeles County Sheriff’s Department, Traffic Services Detail, is sending DUI officers out this holiday weekend for DUI/Driver’s License Checkpoints and DUI saturation patrols countywide. Officers are targeting drunk or drugged drivers on this first holiday weekend of the summer driving season. This weekend traditionally finds travelers heading to local parks or waterways for outdoor activities, along with family and friends gathering for backyard barbeques. It’s also the time for college and high school graduation celebrations. The County’s DUI Task Force kicks off Friday night by deploying DUI/Drivers License checkpoints in the cities of West Hollywood and Paramount with special DUI Saturation Patrols deploying in the city of Lancaster. The California Highway Patrol is deploying all available officers Memorial Day weekend onto freeways and county roads as part of their Maximum Enforcement Period. Law enforcement is asking for everyone’s support this holiday weekend and all summer long: • Plan ahead. Arrange rides home for your friends, family, co-workers and yourself be-
fore the drinking begins. Call a taxi or get a ride from Uber, Lyft or Curb. • Those hosting activities should limit drinks to your guests or patrons. Don’t serve more than one or two over several hours. • Cut back on the amount of drinks you plan to bring to the gathering – and provide plenty of food. • If you see dangerous driving, Report Drunk Drivers – Call 9-1-1! Recent statistics reveal that 30 percent of drivers in fatal crashes had one or more drugs in their systems. A study of active drivers showed more tested positive for drugs that may impair driving (14 percent) than did for alcohol (7.3 percent). Of the drugs, marijuana was most prevalent, at 7.4 percent, slightly more than alcohol. Everyone should be mindful that if you’re taking medication – whether prescription or over-the-counter – drinking even small amounts of alcohol can greatly intensify impairment effects. In addition to the Memorial Day DUI crackdown, law enforcement nationwide is looking to stop and ticket those who have failed to buckle up or secure young passengers. Remember Click It or Ticket!

Poll: African-American Voters Feel Democratic Party Takes Them for Granted By Madlen Grgodjaian California Black Media LOS ANGELES—A recent poll revealed many Black voters in California strongly identify with the Democratic Party, although 58 percent feel the establishment takes them for granted. Commissioned by the African American Voter Registration, Education and Participation (AAVREP) Project, The California African American Policy Priorities Survey sampled 800 potential African-American voters in Los Angeles, Sacramento and the San Francisco Bay Area. The May 5-17 poll was conducted by telephone. Pollsters targeted registered voters who participated in either of the last two primary or general elections. They asked the survey participants questions on a range of topics, including state ballot initiatives, policy priorities and federal and state election candidates. Nearly half of the respondents were ages 65 and older, reflecting a higher voter turnout in past elections. The partici-
pants were also Californians who are more likely to vote this election year. During a telephone press conference, Los Angeles County Supervisor Mark Ridley-Thomas said this recent poll is a followup to others conducted in the past. “This is a following on some of the polling that we’ve done in the past, measuring the
outcome of the AfricanAmerican voters in the City of Los Angeles and then one in the county of Los Angeles,” he said. The survey revealed voters over 40 invariably favor Hillary Clinton as the Democratic Presidential nominee. Hello Readers , It is a holiday weekend and please be safe. It is good to be safe for yourselves and for others. We need to be mindful of our fellow man when we are having fun and look out for one another. This is a good time to remember those who died and bled for us to have this land we call freedom. To remember all those who have paid a great price, is what this day is all about. But for African Americans we are to remember our history as we appear to be repeating it, especially since there are so many who don’t seem to know it. Let us be grateful for this time of laughter and having fun with our family and friends. Also, a reminder for all who desire to hear the Word of God, please join me at People’s Independent Church of Christ on Saturday, May 28 at 10 am. We are bound to have a good time breaking bread and breaking the Bread of Life. Pray for the filling of the Holy Spirit and for the anointing to fall fresh on me as God use me to bring forth His Word. Praise Him all day every day.

in the United States. The decision effectively superseded the 1896 Plessy v. Ferguson decision upholding racial segregation. In an earlier case, Chief Justice Roger G. Taney wrote in the Dred Scott decision in 1857 that he believed that Blacks “had no rights which the White man was bound to respect; and that the Negro might justly and lawfully be reduced to slavery for his benefit. He was bought and sold and treated as an ordinary article of merchandise and traffic, whenever profit could be made by it.” Brown was lauded as a long overdue break with that kind of defective thinking and was expected to pave the way for the equal treatment of all of the nation’s citizens. Not only were the public schools not immediately desegregated in the wake of Brown, more than six decades later, we seem less committed to school desegregation. A research paper produced by the Civil Rights Project at UCLA documents a troubling trend. “Since 1970, the public school enrollment has increased in size and transformed in racial composition. Intensely segregated nonWhite schools with zero to 10% White enrollment have more than tripled in this most recent 25-year period for which we have data, a period deeply influenced by major Supreme Court decisions (spanning from 1991 to 2007) that limited desegregation policy,” the paper stated. “At the same time, the extreme isolation of White students in schools with 0 to 10% nonWhite students has declined by half as the share of White students has dropped sharply.” Over the years, the Civil Rights Project has identified the most severely segregated states as New York and Illinois, followed closely by Michigan and New Jersey. Maryland and California have now joined that group. Michigan, partly because of a shrinking public school base, has dropped in the rankings. “Because of the dramatic changes in southern segregation produced by the enforcement of the 1964 Civil Rights Act, none of the 17 states that completely segregated schools by law (e.g., the type of mandatory segregation that was the focus of the Brown decision) have headed this list since 1970 – in spite of the fact that twelve of them have higher shares of Black students than the most segregated states today. The ironic historic reality is that the decisions of the U.S. Supreme Court supported very demanding desegregation standards for the South while the interpretation of Supreme Court decisions and federal legislation limited the impact of Brown in the North and West.” It wasn’t until almost two decades after Brown that the Supreme Court issued a school desegregation order involving a district
outside those 17 states. That decision, Milliken v. Bradley, covered the city of Detroit, but not most surrounding suburban districts. The report also noted, “The statistics we report … show that all racial groups are experiencing a stunning increase in the average share of poor students attending their schools… Over a 20-year period, the proportion of poor students (as defined by federal standards for subsidized or free lunch eligibility) in the school of the typical White student has shot up from 17% to 40%, which is actually higher than the school poverty level was, on average, for Black students at the beginning of the same period. Black students at that time were in schools where lowincome students made up 37% of their peers. In 2013, that same figure for Black students is 68%, identical to the number reported for Latino students.” Authors of the report state that the family income and race of students matters. “Black and Latino students were in the most impoverished schools two decades earlier but those schools had a clear majority of non-poor classmates. Now the pattern is reversed, so that Black and Latino students attend schools with substantial majorities – two-thirds – of poor classmates. This double segregation means serious isolation from racial and class diversity and exposure to the many problems that systematically afflict poor families and communities.” It added, “The Civil Rights Project has issued many reports on these enrollment changes and their impacts on segregation of schools across the country in the last 20 years,” it noted. “We have done that because of massive and growing research evidence that (1) segregation creates unequal opportunities and helps perpetuate stratification in the society and (2) diverse schools have significant advantages, not only for learning and attainment but for the creation of better preparation for all groups to live and work successfully in a complex society which will have no racial majority.” The report recommended, “The need for governmental action is urgent, and while the Obama Administration’s recent efforts are an encouraging first step, the magnitude and complexity of these issues requires more substantial efforts. “Given the expanding and deeply rooted nature of segregation highlighted here, the sustained focus of all three branches and levels of government is desperately needed. It will also take efforts beyond schools, such as serious economic strategies to raise the income of families so that they have enough money to pay for their children’s school lunches and meet other basic needs.” George E. Solid Foundations By James Clingman For decades several conscious and committed Black men and women have spoken, written books, taught, advised and, more importantly, initiated economic empowering projects and movements to help propel us to a higher level of mutual support and, thus, creating a solid foundation upon which our children can stand and build upon. We have demonstrated, in many ways and by several means, the solutions to the economic problems to which many of our “leading Blacks” just give lip-service. This article is dedicated to Black folks who are willing to pay their blessings forward by helping others among us. It also cites, by way of relevant example, the magnitude and power that has accrued to one relatively small group of people in this country who work collectively in support of one another. Sheldon Adelson, the international casino magnate, with a net worth of $25.5 billion (Source: Forbes Real Time Ranking), is among the ten wealthiest persons in the U.S. and ranks high among the wealthiest in the world. Of course, if you have not heard, he gives hundreds of millions to the Republican Party and its candidates. But he also started the Adelson Family Foundation in 2007, the primary purpose of which is to strengthen the State of Israel and the Jewish people; the Adelson Medical Research Foundation focuses on healthcare. Aside from Adelson’s political ideology, something most of us would concentrate on and spend hours discussing, he is using his wealth to empower his people and to pay for medical research, special housing for the afflicted, and education for children with special needs—laudable by any measure. His is just one example of a member of what could be called a “minority group” that should, among other things, cause us to reflect on our philanthropic actions toward one another, that is, the power to control our collective financial assets to empower ourselves. Sometime in the very near future, the Blackonomics Foundation will be introduced; formally established a few months ago, it will not be unveiled for several more months. Timing is everything, you know. Until then, and even afterward, there are Black foundations that are doing great work and are worthy of our praise and our dollars. In my first two books (1998 and 1999) I lauded basket-
ball great, Dikembe Mutomboand his foundation, whose mission it was to build a hospital in the Congo. I also acknowledged Patrick Ewing and Alonzo Mourning for contributing to that worthy cause. By the way, only three or four NBA players helped Mutombo in his effort to raise $49 million for the hospital. (The lack of support for our foundations, however, does not only exist among those who are super-rich; those of us at the lower rungs of the economic ladder fail to support them as well.) There are others, but here is a great example: For nearly two decades now, NBA Hall of Famer, Alonzo Mourning,and his wife, Tracy, have headed many charitable efforts as part of their commitment to “give back” to their community, especially to the young people of Miami. The Mourning Family Foundation has raised tens of millions of dollars toward that end and helped thousands of people; they are truly exemplary of what more Black folks should be doing. In 2013, Mourning hired the former President of the Miami-Dade Chamber of Commerce, Bill Diggs, who invited me to speak at a chamber function in Miami a few years ago. With Diggs at the helm as President, and the Mourning’s having paved the way and set the tone, their Foundation will continue to maintain its high standards of excellence for years to come. You folks in Miami should direct some of your money to the Mourning Family Foundation and show that you are willing to support this worthwhile charitable organization. Go online, check it out, and make it a monthly recipient of your overall tax -deductible donations. We must do a better job of supporting those who support us and our children. Relatively speaking, each of us can do better, not only rich athletes but also the rest of us. If we would simply reflect on the greatness of our ancestors, their will to live and to provide for us, their progeny, we would do better. If we would consider the benefit of collective economic activity, the potential treasures we could amass for our progeny with our resources, Black people would surely live up to the greatness that is within us all. Mutombo cited a proverb to drive home his message, “Judge not the poor for their poverty, but judge the community for its indifference.” Well stated; but well-done beats well said every time. EDUCATION & COMMUNITY NEWS GAO Report: Segregation Increasing at Some U.S. Schools By Lauren Victoria Burke (NNPA News Wire Contributor) A recent report by the Government Accountability Office (GAO) found that the segregation of African American and Hispanic students nationwide is getting worse. In particular, a notable increase in segregation among K-12 public schools was pointed out in the study. The study also found that charter schools may often take students from public schools and enroll them into less diverse schools. The study also found that Hispanic students were “triple segregated” by economics, race and language barriers. The report was released on the 62nd anniversary of the landmark decision in the 1954 U.S. Supreme Court case Brown v. Board of Education of Topeka, which declared that segregated schools were unconstitutional. On May 16, a judge in Cleveland, Miss., found that schools in the town were just as segregated as they were a
half-century ago. “The delay in desegregation has deprived generations of students of the constitutionally guaranteed right of an integrated education,” U.S. District Judge Debra Brown wrote. At a press conference on Capitol Hill, Congressional Black Caucus Chairman G.K. Butterfield (D-N.C.), House Education and Workforce ranking Democrat Rep. Bobby Scott (D-Va.), and House Judiciary ranking member Rep. John Conyers (D-Mich.) along with Reps. Xavier Becerra (DCalif.), Sheila Jackson Lee (D -Texas) spoke on the issue. Reps. Conyers, Butterfield and Scott will author a bill that would require schools to “designate at least one employee” to work on complying with diversity requirements. “The percentage of schools where 75 percent of students are both low-income and Hispanic or AfricanAmerican has increased from 9 percent in 2001 to 16 percent in 2014,” Rep. Conyers
said.
The report also found that schools that were segregated offered fewer courses in science, technology, engineering and math (STEM) related fields and college preparatory classes. “Segregation in public K-12 schools isn’t getting better. It’s getting worse, and getting worse quickly,” Rep. Bobby Scott of Virginia said. Senator Bernie Sanders tweeted that, “There are 6,727 highly-segregated schools in our nation, where one percent or less of the school population is white. #BrownVBoard.” In a statement about the report, National Urban League President Marc Morial said that the findings in GAO report confirm “that the promise of Brown remains a promise that has gone largely unfulfilled.” Morial continued: “In too many communities, students of color are now more segregated with less access to equitable educational opportu-
nities than in decades prior.” NAACP Legal Defense Fund Director Sherrilyn Ifill said that the report shines a light on worsening education inequities that that cannot be divorced from our nation’s legacy of racial discrimination that has perpetuated racial and socioeconomic isolation. Ifill said: “It is our imperative on the 62nd anniversary of the U.S. Supreme Court’s ruling in Brown v.

Michael Goes To Astro Camp By Israel Matthews, Contributing Writer
Hello, Michael went to Astro camp with his classmates. Astrocamp is a fun place to learn about space. He had so much fun. Michael went zip lining, he went on the sky coaster and he had a chance to see the moon, planets and some constellations through the telescope. Astrocamp had great food too. Michael stayed up later and played games with his classmates. This was one of Michael’s best three days of his life and he will always remember that trip he took in the 6th grade. The end. "We risk being in a post -antibiotic world," said Thomas Frieden, director of the U.S. Centers for Disease Control and Prevention, referring to the urinary tract infection of a 49-yearold Pennsylvania woman who had not travelled within the prior five months. Frieden, speaking at a National Press Club luncheon in Washington, D.C., said the infection was not controlled even by colistin, an antibiotic that is reserved for use against "nightmare bacteria." The infection was reported Thursday in a study appearing in Antimicrobial Agents and Chemotherapy, a publica-
tion of the American Society for Microbiology. It said the superbug itself had first been infected with a tiny piece of DNA called a plasmid, which passed along a gene called mcr-1 that confers resistance to colistin. "(This) heralds the emergence of truly pan-drug resistant bacteria," said the study, which was conducted by the Walter Reed National Military Medical Center. "To the best of our knowledge, this is the first report of mcr-1 in the USA." Life is a series of choices and we should make informed choices, whenever possible. There are a number of health choices surrounding breast cancer that is shortening women’s life spans by an average of twenty years. Stringent governmental studies of breast cancer began over fifty years ago, but still more than 46,000 heroic women transpire from this disease annually, where each day roughly 100 women in the United States are told by their doctor that they have breast cancer. However, what most will not be told is they have life-giving choices, where a badly treated diet may have caused the cancer and by choice an improved diet can be a highly effective method to bring an arrest to the cancer. Environmentally, bad air, food, water and ionizing radiation contribute considerably to all types of diseases. Still, most health professionals will rarely speak about how animal fat and processed sugar push the risk of poor health like breast and colon cancer, premature puberty, heart disease, and more. Even with the accumulation of evidence moving toward the certainty that dietary factors are principally responsible for well over 50% of all diseases. CBC Members Worry Proposed FCC Rule Could Hurt Black Media Companies By Lauren Victoria Burke (NNPA News Wire Contributor) In an unpredictable, disruptive media environment featuring new ways for consumers to receive video content over Wi-Fi, apps and live streaming, established media companies are bracing for a future driven by big tech and consumer choice with new profit models. It happened in the newspaper industry. It happened in the music industry. It happened in the book publishing industry. And now it’s happening slowly, but surely in broadcasting as a host of new entrepreneurs are set to arrive on an increasingly competitive scene. In February, Tom Wheeler, the chairman of the Federal Communications Commission (FCC), moved to free consumers, who are now collectively paying $20 billion every year, from buying or renting a set-top box for cable TV. The FCC wants to “unlock the box” and allow others to provide video content such as Google and Apple. The move would be a shakeup of the status quo. The technology around video-ondemand is clearly changing as seen in companies such as YouTube, Hulu, TiVo, Kweli.tv, Netflix and

Poll: African-American Voters Feel Democratic Party Takes Them for Granted by 16 percent among voters under 40. A majority of the voters had an unfavorable opinion of Donald Trump, and two-thirds are motivated to vote specifically to keep him from being elected. The census also explored general perceptions of other leading political candidates on the June 7 Presidential Primary Election ballot. California Attorney General Kamala Harris is viewed favorably by 53 percent of Black voters. Thirty percent of the voters are in favor of U.S. Representative Loretta Sanchez, however, many say they are unfamiliar with her or do not know enough about her to offer an
opinion.
On November ballot initiatives, participants strongly supported proposed education bond and gun control measures.. Nearly fourin-five said they would support a $9 billion bond measure to fund improvement and new construction for K-12 schools and community colleges. Over three-quarters supported gun control initiatives that would outlaw large-capacity bullet magazines and require background checks for ammunition purchases. The marijuana legalization measure was favored by a small margin. Statewide, 52 percent of respondents were for legalizing the
recreational use of cannabis. When asked about policy priorities, Black voters in all of the three major regions in the state identified homelessness as a serious problem. Ninety-three percent recognized it as a high priority for elected officials to address the ongoing epidemic. Over half of the respondents believe law enforcement agencies should be held accountable for excessive use of force. Other high priority policies included making housing more affordable, improving access to quality health care, and fighting discrimination and institutional racism. However, climate change and illegal immigration –
two issues that poll high with the general population – did not factor as top priorities among Black voters. Ridley-Thomas said polling is a fundamental feature of the democratic process. “The right to vote was hard fought, and continues to be, in terms of every round of debate pertaining to the voting rights,” he said. “And so this is yet another tool to make sure the promises of democracy are properly fulfilled.”
Wheeler said on the issue. Last week on Capitol Hill, Congressional Black Caucus Chair G.K. Butterfield and Rep. Yvette Clarke (D-N.Y.) announced a new Congressional Caucus on Multicultural Media that will “focus on the state of diversity and inclusion in the media and in the telecommunications industry.” Clarke said that the potential harm that the proposed FCC rule could do to multicultural media companies is very real. She suggested delaying action on the proposed rule, “until the Congressional Research Service (CRS) and the Government Accountability Office (GAO) complete their prospective studies on the impact on multicultural media under this proposed rule.” Clarke and Butterfield were joined by TV One CEO Al Liggins and BET Networks Executive Debra Lee at the press event announcing the new caucus. Both Clarke and Butterfield serve on the House Energy and Commerce Committee. “While we must be open to the rising cultural expectations to make programs available ondemand or through streaming ser-
vices, we also have to balance these interests with the assurance that we are not pitting the few diverse programmers out there against each other or allowing some to pick winners and losers,” Butterfield said. The phrase, “few diverse programmers” is an understatement. African Americans own less than 1 percent of all TV properties and less than 2 percent of radio as reported by Pew Research. “We think that the marketplace is robust enough as it is and [the proposed FCC rule] is unnecessary,” said Liggins. “We believe competition should be there, but we believe it should happen in an app form which protects all the rights and the license agreements that we’ve made with the existing paid TV providers.” Butterfield expressed concerns that the FCC’s plan to “unlock the box” might risk the progress in diverse programming that television audiences have seen in recent years. Despite that progress, minority-owned media companies represent a minuscule portion of all broadcast media and many Black media company owners are push-
ing for the FCC change, saying that the status quo has done little to affect the ownership disparity. On a conference call an hour after Reps. Clarke and Butterfield announced the new caucus, Peggy Dodson, the CEO of the Urban Broadcasting Company offered an alternative view and supported the FCC “unlocking the box.” “We’re about creating a producing urban content, but that content has to be searchable, it has to be found and it has to be monetized,” Dodson said. “The genie is out of the box. The hourglass has been turned over. I think what is being missed between Comcast and Time Warner fighting with Google and thinking that Google is going to take over, is the minorityowned producers and content creators. We’re being swept under the rug. We need diversity. We do not own anything.” Dodson continued: “Opening the box is inevitable. It is the answer. It’s happening. We can’t stop it. People are choosing what platforms they want to see programing on and how they want to see it and when they want to see it. Everyone can make money.” Dodson said that she’s not trying to put TV One or anyone else out of business. “That is not my goal. My goal is to have the opportunity to monetize and have people see the content on a platform that is searchable and that can be monetized,” Dodson added. Clifford Franklin, CEO of GFNTV, said that he was shocked to hear the comments from BET and TV One. “It’s shocking to me to see the comments from BET and TV One because they know this has been a very anti-competitive situation that we’re in. At the end of the day we have to disrupt this industry,” Franklin told reporters. “We’ve been inundated with baboonery and thugs and antisocial behavior and some of that has come from our urban channels,” Franklin added. “We need a lot more diversity of thought from our content creators. They have pretty much been shut out of the game.”
California Mayors Ask for Governor's Support for Highway Cameras after Shootings By Brendan O’Brien Five mayors in northern California on Thursday asked Governor Jerry Brown in a letter to have surveillance cameras installed on state highways in the area after a string of shootings that have gripped their communities. The request came two days after a man was shot in the leg while traveling eastbound on I-80 in Hercules, California, the 28th such shooting on the state highway system east of San Francisco during the last six months, authorities said. "This is of increasing concern to our elected officials and residents who feel as if our communities are under siege," said the letter signed by the mayors of Pinole, Richmond and Hercules. The mayors of San Pablo and El Cerrito also signed the letter. Since November 2015, four people have been killed and 12 wounded in shootings that authorities believe are largely gang related, the California Highway Patrol said in a statement. Local and state law enforcement agencies began targeting known gang members and increased patrols since the shootings began along the freeways, the patrol said. The mayors asked Brown

NATIONAL/STATE & REGIONAL NEWS Supreme Court Upends All-White Jury Verdict, Death Sentence By Mark Sherman From the greenwichtime.com WASHINGTON (AP) — The Supreme Court upended the conviction and death sentence of a black Georgia man Monday because prosecutors violated the Constitution by excluding AfricanAmericans from the all-white jury that determined his fate. The 7-1 ruling in favor of death row inmate Timothy Tyrone Foster came in a case in which defense lawyers obtained strikingly frank notes from prosecutors detailing efforts to keep AfricanAmericans off of Foster's jury. The decision broke no new ground in efforts to fight racial discrimination in jury selection, but underscored the importance of a 30-year-old high court ruling that took aim at the exclusion of minorities from juries. Chief Justice John Roberts wrote for the court that "prosecutors were motivated in substantial part by race" when they struck African-Americans from the jury pool, focusing on the decision to exclude two black jurors. Two such jury strikes "on the basis of race are two more than the Constitution allows," Roberts wrote. The high court returned Foster's case to state court, but Stephen Bright, Foster's Atlantabased lawyer, said "there is no doubt" that the decision Monday means Foster is entitled to a new trial, 29 years after he was sentenced to death for killing a white woman. The decision did nothing, however, to limit peremptory strikes, lawyers' ability to reject potential jurors without offering any reason. The late Thurgood Mar-
shall, the first African-American to serve on the Supreme Court, once said that racial discrimination would persist in jury selection unless peremptory strikes were curtailed. Justice Clarence Thomas dissented, saying he would have respected the decisions of state judges who sided with prosecutors and rejected Foster's claims. Thomas, a Georgia native, recounted Foster's confession to having murdered a 79-year-old retired schoolteacher "after having sexually assaulted her with a bottle of salad dressing." When the case was argued in November, the justices did little to hide their distaste for the tactics employed by prosecutors in north Georgia. Justice Elena Kagan said the case seemed as clear a violation "as a court is ever going to see." Still, Georgia courts had consistently rejected Foster's claims of discrimination, even after his lawyers obtained prosecutors' notes that revealed their focus on the black people in the jury pool. In one example, a handwritten note headed "Definite No's" listed six people, of whom five were the remaining black prospective jurors. The sixth person on the list was a white woman who made clear she would never impose the death penalty, according to Bright. And yet even that woman ranked behind the black jurors, he said. The court was not persuaded by the state's argument that the notes focused on black people in the jury pool because prosecutors were preparing to defend against discrimination claims. not so much contest his guilt as try to explain it as a product of a troubled childhood, drug abuse and mental illness. They also raised objections about the exclusion of African-Americans from the jury. On that point, the judge accepted prosecutor Stephen Lanier's explanations that factors other than race drove his decisions. The jury convicted Foster and sentenced him to death. The jury issue was revived 19 years later, in 2006, when the state turned over the prosecution's notes in response to a request under Georgia's Open Records Act. The name of each potential black juror was highlighted on four different copies of the jury list and the word "black" was circled next to the race question on questionnaires for the black prospective jurors. Three of the prospective black jurors were identified in notes as "B#1," ''B#2," and "B#3." An investigator working for the prosecutors also ranked the black prospective jurors against each other in case "it comes down to having to pick one of the black jurors." Roberts noted that La-
nier's reasons for excusing people from the jury changed over time. The chief justice also focused on an apparent different standard for prospective white and black jurors. One African-American man was excused in part because his wife worked at a local hospital, Roberts said. "But Lanier expressed no such concerns about white juror Blackmon, who had worked at the same hospital" and served on the jury, Roberts said. Thomas objected to his colleagues' late intervention. "Foster's new evidence does not justify this court's reassessment of who was telling the truth nearly three decades removed from voir dire," Thomas wrote, using the term for jury selection. Foster's case is the rare instance in which the prosecutors' files contained clear evidence of racial discrimination, Bright said. Still, he said, "Courts should know it might be there and be more vigilant in finding it." The case is Foster v. Chatman, 14-8349.
