OCEA President’s Message You Are Not Alone To steal a phrase from a great labor leader, our very own General Manager Nick Berardino, “You Are Not Alone.” Nick spoke those words at an emotional rally in support of some of our fellow union members of UNITE HERE Local 11 as they continued their struggle for the protection of their healthcare benefits by participating in a hunger strike. As we continue our fight to save jobs and maintain benefits for all of our members employed by the County, Court, cities, and other agencies, know that you are not alone. The leadership team, staff, Board of Directors, Stewards, and all other member leaders are working tirelessly on your behalf. From Sacramento to San Clemente

and all points in between, OCEA is meeting the challenge. You are not alone. On a recent trip to the capitol we were forewarned about the coming state budget. The state must cut 20 billion dollars from the budget over the next 16 months. It would be unrealistic to think that these cuts will not involve taking some money from local governments. We will remain on top of this issue and use every available resource to minimize the impacts. You are not alone. At a recent meeting with Orange County CEO Tom Mauk, he committed to working with OCEA and the departments to find “fits” for laid-off employees. Our members
continue to step forward with cost-savings measures and innovative ideas to save money in the workplace. Feel free to contact me with any issues, concerns, or questions you may have, and remember, you are not alone. Yours faithfully,

OCEA General Manager’s Message “Somebody’s Mother” and the Labor Movement Remember the old poem, “Somebody’s Mother,” by Mary Dow Brine? It was first published around 130 years ago, and it has been reprinted countless times since. It tells the story of a boy who helped an elderly lady across the street. Afterwards, in explaining his actions to his friends, the boy stated: “She’s somebody’s mother, boys, you know, For all she’s aged and poor and slow, “And I hope some fellow will lend a hand To help my mother, you understand, “If ever she’s poor and old and gray, When her own dear boy is far away.” The poem can be viewed as a reminder for us in many situations. Whenever you see someone who is obviously having a rough time, whether because of financial problems, or infirmities of age or illness, just remember that they are somebody’s mother, or father, or brother, or sister—and if not, we still know for certain that they are somebody’s son or daughter. I once heard that there is a sense in which babies—infants and a bit older—belong to the world. That makes sense to me. It is easy to appreciate that view when you see a child being pushed in a stroller, or stumbling along as a toddler. I think that most of us, perhaps subconsciously, feel a vague sense of responsibility for these newly-minted creations. I think most of us would risk our lives—without thinking— to save a baby from peril.
We can presume that few of us will feel the acute connection with his fellow man that Bradford did. Nonetheless, in the union movement, a lot of the power comes from union members understanding the problems of their fellow workers, and from the sharing of trouble. The slogan, “An injury to one is an injury to all,” is closely connected to this discussion. The expression was popularized by the Industrial Workers of the World (IWW), which is one of the key labor organizations in our nation’s history. The IWW was formed in 1905 by socialists, radical trade unionists, and anarchists from throughout the country. The organization was formed mainly in opposition to policies of the American Federation of Labor, and among its organizers were such famous “labor” people as “Big Bill” Haywood (from the militant Western Federation of Miners), Eugene Debs (well-known socialist), “Mother” Jones (the “most dangerous woman in America”), and Ralph Chaplin (writer of “Solidarity Forever”). Most of us would probably disagree with

some of the IWW’s tenets, but the organization was a major force during the early twentieth century, and it gave us the above-mentioned slogan, “An injury to one is an injury to all.” (It’s been said that this slogan may have been based on a similar slogan of the Knights of Labor, that “an injury to one is the concern of all”—certainly not quite as punchy as the IWW version!) In the labor movement, we value some labels, such as those of “mother,” and “brother,” and “sister.” But more than that, most of us hope to recognize times when it is appropriate to help, and times when we should be ready to be helped. It’s a two-way street! So, when you see others who are less privileged than you are, remember “Somebody’s Mother”! In solidarity,

This altruism perhaps grows a little weaker (maybe with some justification), when we look at some examples of humanity—drug addicts, murderers, robbers, extortionists. We know how depraved people can be, and we know the evil they are capable of committing. But it’s definitely a case of, “There, but for the grace of God, go I.” As many of you know, the origin of this phrase lies in the 1550s statement of the imprisoned Reformation theologian John Bradford: “There, but for the grace of God, goes John Bradford.” Bradford later became one of the so-called Marian martyrs, burned during the reign of “Bloody” Mary, in the year 1555.

OCEA Legislative Corner Ballot Initiatives That Public Did You See This From the Employees Will Be Confronting Governor’s Office? Coming down the pike are initiatives, or proposed initiatives, that deal with major issues that relate to public employees and unions. Anti-employee and anti-union interests are supporting proposed initiatives designed to make life more difficult for unions and their members. One of the more dangerous is the “Paycheck Deception” concept, which is being floated around again, after being clobbered on more than one occasion before. (Remember Proposition 75?) It’s billed as Paycheck Protection, but in reality it is a thinly-disguised attempt to weaken the union movement and disenfranchise union members. (It would prohibit the use of payroll deductions for employee dues that are used for political purposes.) See Ballotpedia, http:// ballotpedia.org/wiki/index.php/ California_Paycheck_Protection_Act_(2010), for a summary, and some of the claims of the proponents.
In January, Governor Schwarzenegger’s office made the following claims: “In 1999, the legislature boosted lifetime pensions for government employees without setting aside enough money to pay for them. A decade later, annual pension costs are up over 2,000 percent just in the last ten years and will keep on growing and crowding out other programs unless we take action.” Here, in part, is what Aaron Read & Associates (OCEA’s lobbyists in Sacramento) said about this. (Aaron Read & Associates is the premier lobbying firm in Sacramento, and no lobbying firm is more highly regarded.) Here goes: “The Governor’s proposal is the same as last year, to roll back the SB 400 benefits. He stated that pension costs have increased by 2,000% over the last decade, which is a
completely distorted figure. This figure compares the nadir of contributions, when the state was taking a pension holiday, with the post-economic meltdown. “A realistic analysis shows that the State of California pays less as a percentage of payroll today than it did in 1981/82.

OCEA Professional Nurses Forum February 2010 April Barrio, Comprehensive Care Nurse Practitioner in the Correctional Mental Health program, retired in mid-February to pursue a new occupation in Germany. She’ll be working as a Mental Health Nurse Practitioner at Landstuhl Regional Medical Center, the largest American military hospital outside the U.S. She’ll be providing treatment to injured soldiers returning from Iraq and Afghanistan, and even to their families, if necessary. HCA’s budget may be jeopardized by future cuts from the state, especially if the governor’s requested federal funding for social programs doesn’t come through. At this time, HCA is maintaining its commitment to neither furlough people nor lay people off. We will resume meeting on the CMS LVN work schedules and are looking at the possibility of a pilot program at Theo Lacy, as we were last year.

An update on the progress of Protocols development was provided. The Protocols for CMS may have to be finished through the new CMS/CMHS Best Practices committee. There is no firm timeline through this forum to finish the markups on the job descriptions, but they are proceeding. Corrections is looking at hiring Physicians Assistants in lieu of, or in addition to, Nurse Practitioners. There are some differences in how independently they can work, but except for not being able to handle case management, we’re wondering what the delineation of job duties will be. This will need to be discussed with HCA. It was suggested that the NP in HIV be reclassified to CCNP and have the ability to provide services in the jails one or two days per week. The range of services provided in the HIV clinic are comprehensive, which is not reflected in the NP classification, and there will be a need to provide the inmate HIV community. This would add flexibility to the Department. There was a very good suggestion that HCA apply for a grant to fund a position or two to try to ensure the continuity of care between incarceration and release. HIV-infected inmates often end-up in the clinic and no records are provided. This concept might also work well for JHS. Tests performed on juveniles (STDs, pregnancy, pap smears, etc.) may not have been followed-up on, or had results returned before the minors are released. Quite often the Public Health nurses can’t locate a minor who tested positive for an STD while in Juvenile Hall, but whose family has moved without knowing about the result.

Health Care Agency LMC Update OCEA Labor Relations Representative Bo Gutierrez
Announcements: • The LMC Intranet site is being updated on an ongoing basis by one of the co-chairs. Sponsor Reports: • Management is closely watching the developments of two key ballot initiatives—Propositions 10 and 63. Both have some serious financial implications for the County. There were two Town Hall meetings scheduled Tuesday, February 23. • OCEA is dealing with layoffs and furloughs in several County and non-County agencies. Otherwise the same attention is being paid to the developments in the State that management expressed. • HCA Employee Recognition Day was March 4, 2010. Recruitments are still down except for hard-to-fill positions which have not been frozen, such as in CMS. There is a supervisor camp running right now, to provide training. New Business: There was no new business. Recruitment: Concerns about the possibility of retaliation or some other negative workload impact have been expressed by potential candidates to fill LMC vacancies. This was discussed as unfounded due to the levels of support for the committee, and the understanding that workload is supposed to be adjusted to account for the time spent on LMC activities. Management will work with the program areas of underrepresentation to identify some candidates. Workplace Enhancement: • Another complaint has been received about smoking near a facility. That facility is a commercial site occupied by several other businesses. • The Smoking Policy has been reviewed by Executive Management and County Counsel. There is a possibility that one site that is County-owned and solely occupied might be established as a “smoke-free” campus, by way of a County ordinance. The possibility of a 100-foot perimeter restriction would not be feasible for most and/or all of the other facilities due to either problems with other tenants, or the extension taking the restriction out beyond a building’s property. There were also some concerns about restricting what employees do on their own time. The committee liked the idea of an ordinance for the one location and will provide that information to the Executive Management Team. • Fears about job security have been expressed, and may be keeping employees from submitting valid workplace issues. There was discussion about the effectiveness of the BHS Best Practices LMC in taking-on issues that would have come to this committee in the past, as well as the Professional Nurses Forum being used as a venue for nurses in the agency.
• One of the subcommittee members presented two ideas – one to use a kaizen process to solve problems, and one to develop a PR campaign to heighten awareness of the LMC. The discussion on these topics involved aspects of a program that would involve all of the subcommittees, and the members were given assignments for the next meeting.
Social Services Agency LMC Update OCEA Labor Relations Representative Tim Steed
There have been some exciting changes in the Social Services Labor Management Committee so far in 2010! First, there has been a new co-chair selected on the Management side. Mike Walsh is an Administrative Manager II in the Children and Family Services division of SSA. Mike has been an active member of the LMC. OCEA welcomes him as the new co-chair, and also would like to congratulate outgoing chair Jan Taraszkiewicz for his excellent service in the past year. At both the January and February LMCs, the topic of cost-savings was discussed. In the past year the LMC has been reviewing any cost-savings ideas that have come from the CEO’s office. We have not received any new cost-savings ideas from the CEO as of late, but we have received some new ones from SSA employees. One such suggestion was to have two-sided court reports to save on the cost of paper. Also, Children and Family Services (CFS) has piloted a program for electronic signatures for petition documents. If you have any more cost-savings ideas, please send them to Tim Steed: TSteed@oceamember.org or 714-835-3355. Also, OCEA is looking for some more OCEA members who want to participate in the Labor Management Committee. The LMC is a standing meeting between Labor and Management Representatives that seeks to resolve workplace and agency issues. The LMC allows both sides to come together and make improvements in the Social Services Agency, but it can only work with an active and engaged membership. OCEA Steward Closeups OCEA Says “Farewell” to Coach Bennett! When some people hear the word “Coach,” they may think of Bear Bryant, or John Wooden, or Pop Warner. But not around OCEA! When we think “Coach,” we think of Wellington “Coach” Bennett!
Coach Bennett, in a relaxed moment, near the front of the OCEA headquarters building.
Coach Bennett was hired by the County in 1979, and he joined OCEA the same year. He is a long-time OCEA Steward, and he has served OCEA on many bargaining teams.
Few OCEA members have received as many formal accolades from OCEA than Coach has. Coach has received the OCEA President’s Award, OCEA’s highest award for service to OCEA and his fellow members, on multiple occasions. He also has received OCEA Steward Perfect Attendance awards many times, including the last six years straight. In 2009, he was honored as a member of our OCEA Steward Advisory Committee. It’s difficult to say goodbye to friends who have been close for many years, and this is certainly the case with April Barrio, one of our OCEA Stewards in the Health Care Agency (Correctional Medical Services). April has retired from County service, and she will be moving to another job, with new challenges.
April has had a long career with the County. She served 18 years in the position of Comprehensive Care Nurse Practitioner, specializing in Psych Mental Health with the Orange County Jail. April has worked in a wide variety of correctional-institution settings, including Theo Lacy Facility, the Central Jail Complex, Intake and Release Center, James A. Musick Facility, and the Women’s Jail. She also worked temporary assignments with Westminster Mental Health, and Evaluation and Treatment Services. In her County duties, April was extremely successful, and she gained the admiration of both labor and management for her skillful handling of her job duties and her union responsibilities. April has been one of our most committed members during her time with OCEA. April was a member of the first bargaining team for the then-new Healthcare Professional Unit, back in 2001. She has also served us on other bargaining teams, including the 2009 Coalition Bargaining Team. We once asked April what she believed was the most fulfilling part of her job, and here is what she said: “Patients in the jail are complex and challenging, requiring all my physical and mental health assessment skills. The incarceration process is very interesting and often brings changes in individuals who would never otherwise consider changes. Being instrumental in those new choices and changes can be very gratifying and rewarding.” On two occasions, April received OCEA’s highest accolade, the OCEA President’s Award, in 2007 and 2009. April unselfishly has given countless hours of her own time for the benefit of her co-workers.

Joe Flint is a Senior Maintenance Technician III with the Orange County Water District, and an outstanding member of OCEA! Joe developed a procedure for monitoring UV lamp use and replacement, in connection with a system of nearly 4,000 lamps which need periodic replacement. His methods have brought substantial savings to the Orange County Water District and the Orange County Sanitation District. Congratulations, Joe!
Danna McIntosh is the Environmental Services Coordinator for the City of San Clemente, and she is the Treasurer of the San Clemente City Employees Association. Danna is responsible for the City’s aggressive recycling programs, including close coordination with the planners of special events, businesses, and those who lease public facilities. She’s an active SCCEA Board member and participates in negotiations and special committees. Danna, congratulations!

March is Social Workers OCEA Steward Meetings! Appreciation Month Each month, our OCEA Stewards have the option It’s that time of year again! Throughout the month of March 2010, OCEA staff-members are holding meetings with OCEA members in the Social Services Agency and Health Care Agency. Many of the OCEA members attending the meetings will be Social Workers. Among our members in these two agencies, we have hundreds of Social Workers. As a part of our celebration, we are distributing little gifts (hand-sanitizer with an OCEA message on the container) to OCEA’s Social Worker members, in recognition of their dedication and selflessness.

Either way, our Steward meetings provide a great way for our members to stay up to date on some of the important issues OCEA faces.
For more than a year now, our Social Workers have been a major focus of the County’s layoff efforts. The attention focused on the Social Workers during these difficult times has made their work better known among the general public. That’s a silver lining, but it has been a year of dark clouds overall. Some employees who were laid off have been rehired, but the sad reality is that many of the County’s former Social Workers are now looking for jobs. Those who remain have found themselves working under heavier workloads. As we reflect on the essential services that our Social Worker members provide, we have an increased sense of appreciation and pride for the jobs that they are doing. Our Social Workers are doing fantastic work in helping care for our County’s children, aged, and uncared-for.

OCEA Board of Directors Closeups Arlyn Buck, OCEA Second Vice President Arlyn Buck is an enthusiastic OCEA Board of Directors member who works diligently for our members in many ways. She currently serves in the office of OCEA Second Vice President. Arlyn has also served us as OCEA Secretary. Arlyn has been employed by the County for over 21 years. She is employed as an Office Supervisor C in the Social Services Agency, Adult Services and Assistance Programs, at the Central Regional Office (CRO), where she principally supervises Office Technicians and Data Entry Technicians. Prior to her employment with the County,
Arlyn served in the US Army, and during her service she lived in Heidelberg, Germany. Arlyn enjoys being a member of the Board of Directors, because it allows her to take part “in making life better for County employees by having a say in issues that affect their working conditions and benefits.” Arlyn has been an OCEA member for more than 19 years, and she has served as an OCEA Board member for about 11 years now. In addition to all this, Arlyn is one of those people who is “upbeat” and always has

Frank has been a member of our Board of Directors since 1985, longer than any other present member of the Board. Frank is one of the true standouts in OCEA Board history, and some measure of this is the fact that OCEA has established the Frank Eley Award, of which Frank was the first recipient, in 2009. Frank is employed as a System/ Programmer Analyst II in OC Public Works. Frank is a 27-year OCEA-member, who joined OCEA the same year he was hired. He is an OCEA Steward, and member of our Political Action Committee executive board (of which he served as Chair for ten years). He is also a trustee for the OCEA Health & Welfare Trust. Frank was our OCEA Treasurer from 1988 to 1992, and he was our OCEA President from 1992 to 1999. Then Frank served as Past President, then Insurance Officer, and then (in 2008) President again. At present, he is again our Past President. As OCEA President, Frank led us with great distinction during the period of the 1994 County bankruptcy. As a member of the Retirement Board, Frank has served since 1998. He has long understood the importance of retirement benefits to County employees. Frank has done all he can to alert our members (and indeed all other County employees as well) to the fact that our retirement

Frank Eley benefits must be vigorously protected. Frank eased the way for Safety Retirement benefits for Probation Officers, Counselors, and Supervisors. Frank was chairman of the OCEA/County committee dealing with the elimination of the old Tier II benefits, and he played a key role in the final “good riddance” to Tier II, when OCEA secured an agreement with the County for “2.7% at 55” in six of our County units in 2004. Frank lives in Tustin with his wife Brenda, and their two sons, Evan and Sean.

Lezlee Neebe is a long-time OCEA Board of Directors member, and she helps provide the balance that has been a key to many of OCEA’s successes in the past. Lezlee has been a Court employee for 17 years, and she joined OCEA immediately after being hired. Lezlee is employed as a Courtroom Clerk. Lezlee has been a member of our Board of Directors since 1994, and she has also served us as a bargaining team member and as an OCEA Steward. During her years as a Board member, Lezlee has served as OCEA First Vice President (currently), OCEA Insurance Officer, and OCEA Secretary, as well as Insurance Chair and Newspaper/Communications Chair. Lezlee is well-known for her positive attitude, and she has never shied away from hard work on our behalf. Lezlee is married and has two lovely daughters, Allysha and Kimberly. OCEA EMPLOYEE

Facing Tough Times Together!
OCEA’s Cities and Districts Members Participate in Conference Co-Sponsored by OCEA On Saturday, February 27, 2010, union activists from all over the County braved torrential rains to attend a conference entitled “Navigating Tough Times Together.” The event was jointly sponsored by OCEA, SEIU Local 721, and the Orange County Labor Federation. The conference took place at Cal State Fullerton, and it ran from 9:00 a.m. to 3:00 p.m. Included were educational presentations by experts in many fields, on some of the “hot topics” of the day. The conference provided information of special interest to our members in the cities and districts. Brief introductory remarks, including a statement by our OCEA General Manager Nick Berardino, kicked off the event. Next came the keynote address, by Lee Cokorinos, who kept the audience riveted with a PowerPoint presentation on public employment and relevant financial issues. Lee is the president of a consulting group called Democracy Strategies, and in his presentation, he focused on “Privatization and the Great Recession.” In addition to providing a great overview on what has been happening in local government during the recession, Lee noted that
collapsing state and local revenues have driven lawmakers toward privatization of assets (e.g., selling real estate) for short-term cash, and contractingout services. These privatization plans have often been dismal failures. After Lee’s presentation, attendees broke into two groups. One group took part in a discussion session entitled “The Future of Retirement.” The presenters were OCEA General Manager Nick Bart Diener and Mark Klein (both Berardino addresses the group. of SEIU Local 721), who exploded many of the anti-employee myths surrounding retirement plans for public employees. The other group focused on “Privatization and Responsible Contracting.” This discussion was led by Don Cohen, the President and Executive Director of the Center on Policy Initiatives. Don shared some of the strategies his group has used to thwart unnecessary contracting-out in San Diego. After lunch, two more breakout discussions were held. One was called “Cost Savings Through Efficiencies.” It was led by Barbara Maynard, President of Maynard Consulting services, who has for many years been a key advisor to unions. The other afternoon breakout group was “The California State Budget and Local Governments.” This included a roundtable discussion by Tony Cardenas (Orange County Regional Manager, The League of California Cities); Beth Krom (Irvine City Council Member); and Tony Mendoza (Assemblymember, 56th District).

You’ll find the word “REGISTER.” Click on that word, and you will see a form that you need to fill out. Items marked with an asterisk (*) are “required” items. 2. In filling out the form, please pay special attention to the “Username.” Your username does not have to be your real name. NOTE: If you use a name that is already in the system, and you click the “Submit” button, you will be returned to the form. Above the “Username” field, you will see this message: “Someone else has already chosen this login name. Please try another.” 3. If all of the fields have been filled out properly, and you click the “Submit” button, you will see a welcoming note with a brief explanation. 4. We brought you more than just the weekend . . . You’ve probably seen the nutshell description of the labor movement: “the folks who brought you the weekend.”
That was back in the 1940s, 20 years before the Meyers-Milias-Brown Act. In later years, the list of benefits OCEA achieved grew longer.
That’s true enough, as you know if you have studied labor history.
By the time of our 50th anniversary back in 1987, the list of OCEA’s accomplishments for County employees was extensive. We achieved, among many other benefits:
But OCEA has played its part. We were founded in 1937. We’ve been representing County and Court employees for 72 years, since long before any other organization began representing County employees. In Volume 1, Number 1 of this publication—62 years ago, when we had a longer name!—we said:

“The Orange County Employees Mutual Benefit Association was organized in 1937 for the purpose of initiating and supporting measures for the improvement of the conditions of County employment. Activities may consist of appearance on behalf of employees before the Board of Supervisors on such matters as salaries, sick leave, vacations and the like; or they may, through the League of County Employees Associations, consist of support for certain measures before the State Legislature.”
