OCEA President’s Message Introducing . . . OCEA President Robert Gibson! Dear Members, Hello, please allow me to introduce myself. To those of you who do not yet know me, I am Robert Gibson, a Deputy Juvenile Correctional Officer with the Probation Department, assigned to Juvenile Hall. I am also your newly-elected President of OCEA. It is my tremendous honor and privilege to have this opportunity to serve you and our union. We at OCEA are dedicated to advancing the welfare and security of Orange County local government employees and their families. Any success I or OCEA may have in the future can be directly attributed to our Past President, Frank Eley. So I would especially like to thank him for his dedication and service during his most recent term as President. Frank will continue to serve on the OCEA Board of Directors, and as an employee-elected member of the Orange County Employees Retirement System Board. I will rely heavily on his leadership and expertise during my presidency.

extremely important because presently OCEA is fighting one of the biggest battles in the history of our union. The financial meltdown of our county, state, and nation threatens to destroy America’s middle class. Some would like to seize upon this crisis to further an agenda of eliminating the middle class while leaving just the

working poor and the privileged class in this country. We cannot and will not let this happen. While we understand shared sacrifice, it must truly be shared and equal, with management and executives within the County participating in the sacrifice. The car allowances and bonuses of our elected officials and executive management will not be tolerated—no more than the citizens of our country will tolerate the Learjets and bonuses of Wall Street and corporate America. However, we cannot accomplish these goals alone. Your union requires your participation and help in our fight. I was heartened and uplifted by the turnout of our members at the rally protesting the Board of Supervisors lobby remodel. Further, I look forward to our members continuing to show our strength through unity. OCEA General Manager’s Message Layoffs: A Solution That Doesn’t Solve Anything, Especially When Perks Are King Layoffs are not the answer. You might expect to hear that from a union advocate, but others have come to the same conclusion. The present crisis has made it clear that the County’s analysis of layoffs is superficial. “As long as we cancel out the shortfall with the same dollar-value of compensation,” the County thinks, “we are fine.” Common sense would indicate that there has to be more to solving the problem than that. And, indeed, there is, but you will never hear this from the County. Let me share a few observations with you, written by people who seem more or less unbiased. BNET (www.bnet.com), which bills itself as “the go-to place for management,” says: Many companies use layoffs to help boost the bottom line, but in the long run, such hasty measures cost a company more than they save. . . . In the near term, owners will incur the costs of severance and benefits continuance, but other indirect and direct costs come into play, which may make layoffs less appealing. And in the long run, the cost savings pale in comparison to what owners will spend on staffing once their businesses ramp up again.

John Rey, an author and management consultant, says: According to an article by Will Helmlinger of The Resource Development Group, ‘the cost to replace one Customer Service Representative earning $18,000 annually is nearly $58,000’. If you attended the public hearing on the County’s financial crisis, held on January 23, you heard one of our Welfare Fraud Investigators testify to the fact that these investigators prevent tens of millions of dollars in fraud each year, at a cost to the County of less than $6 million. Yet the County wanted to lay off Welfare Fraud
“At first glance, it’s hard to understand why the County’s analysis of this whole situation has been so shallow.” found that ‘turnover costs for a manager average 150% of salary, including tangible costs of hiring new workers and relocation, and intangible costs such as the new worker’s inefficiency and lost productivity while the job is vacant.’
Of course, these are referring to the private sector, so the considerations are somewhat different. My theory is that in the public sector the costs to the public are overall greater than in the private sector. That’s in part because many of our County employees actually save taxpayer money, directly or indirectly.
Investigators because of decreases in state funding that goes toward their salaries. At first glance, it’s hard to understand why the County’s analysis of this whole situation has been so shallow. But I have a theory there as well. To me, it all comes down to a very strange approach to managing the County’s money. The budget shortfall in SSA was about $30 million. The County’s budget is about $6.7 billion. The shortfall is less than one-half of 1% of the County’s budget. Isn’t there such a thing as planning for a rainy day, to cover those kinds of things? Well, yes, there is. In fact, the County has a “secret surplus” of $300 million. But they don’t want to spend it, or even one-tenth of it, on salaries. County officials have no desire to Chop at the Top. County officials do not want to give up perks. The real truth is that they don’t want to provide services to the citizens of the County. So, no! Layoffs are not the answer. In solidarity,

OCEA Salutes Our Social Worker Members
March is Social Workers Appreciation Month Throughout the month of March, OCEA will be holding meetings with OCEA members in the Social Services Agency and Health Care Agency, and many of those attending the meetings will be Social Workers. We have hundreds of Social Workers in these two Agencies. Our Social Workers have really been “up against it” in recent months, and many people in the general public are now beginning to have a better understanding of the work that Social Workers do. Unfortunately, it has been the layoffs of about 200 employees in the Social Services Agency that have brought the Agency most of its recent publicity. Many SSA employees have lost their livelihood, and those who remain have found themselves with increased workloads. We have never been more proud of our members, and OCEA will continue to fight to preserve as many jobs as possible among our Social Workers and other threatened jobs.
As we reflect on the essential services that our Social Worker members provide, we have an increased sense of appreciation for the job that they do in helping our County’s children, aged, and uncared-for.

Labor and Business Working Together
OCEA Helps Form Orange County Commission for Economic Stimulus and Recovery You’ve probably seen the press coverage of the Orange County Commission for Economic Stimulus and Recovery, or you may have read about it on our website. The Commission is doing all it can to preserve and create jobs in Orange County, and to bring federal funds back to the County. The Commission is chaired by Lucy Dunn (President and CEO of the Orange County Business Council). It is co-chaired by Scott Baugh, Chairman of the Republican Party of Orange County, and Frank Barbaro, Chairman of the Democratic Party of Orange County. The Commission has the participation of community leaders representing a wide spectrum of approaches, including business, labor, and government. OCEA played a key role in the formation of the Commission. In a mid-January letter to community leaders proposing the formation of the Commission, OCEA said, in part:
Today we once again face an overwhelming challenge to the County’s economic well-being. In the opinion of many we are on the verge of encountering the greatest threat to our economic stability since the great depression. That threat will not differentiate its targets by political party, will not discriminate in favor of any ideology, and will not care whether an enterprise is public or private. It will target us all. As we did during the County bankruptcy we must once again come together in a spirit of cooperation and bipartisanship to face the coming economic challenges, to prepare Orange County to assume its natural leadership role, and to be poised to take advantage of available resources so that Orange County is first to rebound and embark on another era of economic prosperity. To accomplish this goal, we propose the creation of the Orange County Commission for Economic Stimulus and Recovery. The goals of the commission could be, among others, to:
1. Increase jobs in Orange County 2. Enhance the County’s ability to maximize public and private participation in any Federal stimulus package 3. Predict and prepare for future economic impacts to Orange County as a result of legislation or economic trends 4. Evaluate and respond to public safety issues related to the economy 5. Provide care and assistance to community members who have suffered as a result of job loss or other events related to the economic downturn Further goals and actions will be determined by the commission. The commission should be action oriented and focus solely on those specific areas its members determine it is capable of effectively addressing.
The Commission has begun meeting, and it will provide a unified voice that will benefit business, labor, and the County in general.

“I Love My Job!” Nadia Shah Clinical Social Worker, Health Care Agency I love my job despite all the documentation! Assessing, diagnosing, crisis intervention, therapy, short-term problem-solving, great co-workers, great supervisors, are just a few of the many reasons I love my job. I am a Clinical Social Worker for Older Adult Services. Each day is different from the next. I’ve interned with Older Adult Services during the 2006-2007 school years and have been employed there since August 2007. How many recent Master of Social Work graduates (from Cal State Long Beach), at the age of 25, can say they work for the County and have the exact position they want? Although each day can be stressful and oftentimes emotionally draining, I have
never complained or considered changing jobs. The reason is that I am doing what I have always wanted to do: Help people and make their lives a little easier. I love my older adult clients and am always eager to tackle the challenges that are posed in this field. And yes, I am oftentimes overwhelmed with documentation, but each job has its difficulties, right? Another great part of Older Adult Services is the teamwork we all display. I can honestly say that I have been to every co-worker of mine and picked their brains for tips on how to better assist my clients. And how did I get to this career and job? I overcame expectations from my Pakistani culture and decided I would encourage

Our OCEA Executive Committee Each year, our Board of Directors elects the Board officers, who serve on the OCEA Executive Committee. The Executive Committee also includes the Past President. The Executive Committee spends much time in between regular Board meetings. Its members attend regular Executive Committee meetings. They make decisions on matters that do not require action by the entire Board of Directors. They also review other matters and make recommendations to the full Board. Here are our current officers, who make up our Executive Committee:
Robert Gibson—President Probation Department
Robert Gibson is a Deputy Juvenile Correctional Officer II with the Probation Department. He has been a County employee since 1988, and he joined OCEA in 1995. Robert has been a member of the OCEA Board of Directors since 2005. He is currently serving as President. He has also served as OCEA First Vice President. Robert has been an OCEA Steward since 2002. He has been a member of the Probation Services Unit Executive Committee and a PSU Safety Representative. He currently serves as Chairperson of the OCEA PAC Executive Board. Robert has twice received the OCEA Outstanding Recruiter Award, and he has been a member of many OCEA bargaining teams.
Lezlee Neebe—First Vice President Superior Court
Lezlee Neebe is a Court Clerk II in the Superior Court. She was hired by the Court in 1992, and she has been an OCEA member since that same year. Lezlee has been on the OCEA Board of Directors since 1995. Lezlee is currently serving as First Vice President. It would be very unwise to do that! Below are some insights into the financial costs and other problems you could face if you cancel your insurance. (If you find yourself unable to make an insurance payment on time, contact a licensed agent to see what options are available to you.) At Velece, we strive to provide education, and we offer a level of service above that of the competition. When you fail to pay your auto/home insurance premium you are subject to the following: • If your payment is not received by the insurance carrier, approximately 7-10 days after your payment due-date a cancellation notice is mailed to you, to your finance company, and to the Department of Motor Vehicles. • Most insurance carriers will include a cancellation billing fee of approximately $5.00 to $25.00. • Your finance company and the Department of Motor Vehicles will not take any action until the final cancellation notice is received from your insurance carrier. • If final cancellation is received, your finance company will purchase an insurance policy that only covers physical damage to your vehicle, leaving you solely responsible for all damages, including but not limited to damages to others’ property and for any bodily injury. The finance company’s policy can cost you up to three times the cost of your standard insurance policy, and it does not provide you any personal protection. This cost will be added to your car payment. • If your home lender receives final cancellation, they will purchase an insurance policy for you that only covers the structure of your house, leaving you responsible for any losses that occur, including but not limited to your personal property, and bodily injury to another party. This cost will be added to your house payment. • If the Department of Motor Vehicles receives a final cancellation, they will suspend your driving privileges, as well as your vehicle registration. In order to reinstate, you will be required to provide proof of insurance, and pay a $14.00 reinstatement fee. (If you receive notice of suspension, you can contact DMV by calling 1-866-664-4545.)

2008 OCEA Steward Awards Dinner OCEA’s workplace Stewards personify five of the pillars which support OCEA: communication, visibility, service, member involvement, and a positive attitude. They undergo extensive training, and they know how OCEA works. They communicate valuable information to their coworkers, and they help organize and mobilize our Stewards. Each year, we say “thank you” to our Stewards at a special dinner. Our 2008 OCEA Steward Awards Dinner was undertaken during difficult circumstances. OCEA General Manager Nick Berardino was unable to attend, because of pending layoffs in the Social Services Agency, and OCEA Labor Relations and Communications staff returned to OCEA headquarters immediately following the dinner. Nonetheless, the dinner itself was a success, and it followed a year of hard work by OCEA.

OCEA Plays Key Role in Public Hearing on Orange County’s Economic Crisis January 23rd Hearing Was Chaired by Assemblyman Jose Solorio On January 23, 2009, from 9:00 a.m. to noon, a public hearing was held concerning Orange County’s economic crisis. The hearing was sponsored and chaired by Assemblyman Jose Solorio (69th Assembly District), and it was the first hearing of its kind during the current crisis. An overflow crowd—mainly union members and supporters of working men and women—defied the rains to attend the hearing. On the panel with Assemblyman Solorio were Larry Agran (Mayor Pro Tem, City of Irvine); Lorri Galloway (Councilmember, City of Anaheim); Andrew Nguyen (Trustee, Westminster School District); Dina Nguyen (Councilmember, City of Garden Grove); and Vince Sarmiento (Councilmember, City of Santa Ana). The first presenter was Tom Mauk, County Executive Officer, who gave a simplistic summary of the County’s budget situation, backed by PowerPoint presentations of two other County representatives. After that, OCEA made its presentation. The first presenter for OCEA was OCEA General Manager Nick Berardino, who pointed to flaws in the County’s
presentation and stressed that the County’s attitude throughout this crisis has been one of non-cooperation with OCEA and non-responsiveness to OCEA’s proposals. OCEA further indicated that the County possessed approximately $300 million in reserves that could have been used to delay layoffs. We stated that some individual County Departments also possessed reserves that were available to the County. We again pointed to the County’s failure at high levels to relinquish any of their perks, and to exhaust all other means of saving money prior to layoffs. We pointed to the County’s failure to plan for the present events, and we criticized the lack of foresight demonstrated by the $26-million (in cash!) recently spent by the Social Services Agency on a new facility in Tustin. Other presenters for OCEA’s positions included OCEA President Robert Gibson (Deputy Juvenile Correctional Officer II), OCEA Board member Luisa Camino (Social Worker, Adult Services), Tefere Gebre (Executive Director, Orange County Central Labor Council), Mike Sutton (Welfare Fraud Investigator), Wayne Quint (President,

Association of Orange County Deputy Sheriffs), Herman Martinez (Employment and Eligibility Specialist), Noreen Grella (LCSW Child Welfare Expert), and many others. Many OCEA Board members were present at the hearing, as were many other OCEA members and staff members. The hearing represented a key display of public interest in the problems that OCEA is now confronting.
