In compliance with article 222.1 of the Civil Code, guardianship is established if there is no one to exercise parental authority or if there are disabled persons involved, and must always be established through the courts. As stated in article 35.11, legal capacity for initiating a guardianship corresponds to the Autonomous Community in whose custody the minor is to be found. To this end, the case must be addressed to the competent court, which then proceeds based on the minor’s future place of residence; the corresponding agreement must be attached, together with the consent of the entity that is going to assume guardianship.
