When it all goes to custard When the worst happens, with weather events or other natural disasters, are you prepared? Karen Trebilcock writes.
ome days are just bad – when the plate cooler won’t work/the effluent irrigator ties itself into knots/the tapes are set up wrong so the cows end up around your house instead of in the night paddock – but then there are days when things cannot be much worse. Flooding, earthquakes, volcanic eruptions, heavy snow and high winds can all impact not only the day-to-day running of your farm but also its long-term future. No one likes to think about what can go wrong and on a dairy farm it can be lots but having plans in place before they happen means less stress for everyone – including for your staff and your cows. Who to ring, what to check, who can help, who needs to be helped are all important to know and wracking your brains while the water is rising over the tops of your gumboots is not the time to be doing it. In your dairy, where everyone knows where it is, should be a phone list of all the staff and their partners (or parents), your vet, electrician, power company, pump specialist and the contact for your milk company.

Also have a phone list of neighbours. Include the 111 emergency number and most importantly the RAPID numbers for your farm so, when someone has to ring, the ambulance knows where to go. GPS coordinates are a good idea too. If your farm is susceptible to flooding or high winds, talk through with staff what to expect and what needs to happen. Know what a bad weather forecast looks like. Make sure you have flood maps which show the order in which the paddocks go under, which tracks become impassable and ways around them and feed supplies such as balage stacks that need to be shifted before the water gets too high. Tractors and other equipment may need to be moved and your tanker driver informed if they’re not going to be able to make it up the driveway or along your road. Also make sure your cows are not going to go swimming. With those four stomachs for buoyance they are pretty good at it and if fences are down, the power off, they could go wandering. With high winds, make sure all staff know where tie-down points for irrigators
are and to watch driveways, tracks and fence lines for fallen trees and other debris. Keeping staff safe is always top priority and you may have to make the call that it’s too dangerous to go outside because of flying debris, the flood waters are running too swiftly to enter, or that thunder storm is too close. Milkings can be missed, cows can be replaced, but people can’t. Make sure the staff houses on your farm are safe and if not, help out. If your staff live off farm, make sure they can get home and their families are safe. When the worst has happened make sure you take a deep breath afterwards before making decisions. And know the consequences of those decisions – changing to once-a-day milking will cause your somatic cell count to go up, putting the bulls out early instead of continuing with AI will make sore feet problems worse. You may be saving money in the short term but the effects could take months to overcome. Talk to your bank manager and your accountant so budgets can be refigured and ways found to get through financially. Understand that for the first few days you will be running on adrenalin, but also

Just like people, cows get nervy after earthquakes, exhausted after standing for hours in driving rain or snow and they don’t like high winds either. Give them some extra time walking to the dairy, keep things as calm as possible around them and, if you can, give them more feed. And make sure you keep the milking minerals up to them. If paddocks are flooded, cows won’t be going to a trough to drink so find another way to get allimportant magnesium and calcium into them. Don’t forget your staff. They are probably doing extra work – taking cows off paddocks to put on to pads, dealing with mud on udders when putting cups on and coping with interrupted milkings due to power outages. A lunch out where everyone can relax and have a laugh, a gift voucher to say thanks or an extra sleep in when it’s all over are easy things to do and are always appreciated. If someone offers you help, take it. Don’t be embarrassed or too proud. And if no one is offering you help then ask for it. Get on the phone and ring DairyNZ and Fonterra or whichever your milk company is. They all have people employed to do this. Get them working for you. That’s why you pay them a levy every month. long as the plastic hasn’t been damaged, grass underwater will rot if temperatures are warm. Use Google, ask the neighbours, ask DairyNZ, ask your farm advisor, ask your insurance rep. DairyNZ’s website has step-by-step guides on what to do – type in your adverse event (flood, earthquake, high winds, snow) into the search engine (where the little magnifying glass symbol is on the top right of the page) to find them. There’s also a decision tree on how to get flooded paddocks back growing grass. And don’t forget the neighbours. You might have got through, made the right decisions, but your neighbours might not have. Ring, and if they don’t answer then visit, offer to help or get help for them. Hot meals, access through your farm because their driveway is flooded, feed for their cows all may be needed. If their dairy is under water, or damaged following an earthquake, or has lost power, they could need yours. Be aware too, that when it is all over, your cows are back in feed up to their

bellies, your tracks are mended, your buildings fine, that the pressure on you will still be there. You will have taken a financial hit. The season you were hoping was going to be a stunner is now a ruin and you may never feel safe again because if it happened once, it can happen again. This is the time when you really have to step up and be strong. No one will completely understand what you’re going through, you may not even realise it yourself, but give yourself some time off, do something that you know makes you happy and enjoy the people who are around you. The belly wrap nieka Venekamp and Nick Templer are doggedly determined to own a slice of Godzone and farm their own piece of paradise but while they’re working hard to achieve that goal they’re also determined to enjoy the journey. The couple were 2015 Southland Otago farm managers of the year, winning the title in their third season contract milking for Lyall and Jan Hopcroft near Balfour, in Northern Southland. They had 25 mixed-age cows in the herd back then and 58 heifers. They’re still with the Hopcrofts, it’s been a great partnership and thanks to the contract agreement with them they’ve been able to grow stock numbers and now, in their seventh season, they have 200 of their own cows in the 650-cow herd. As well as their contract milking payment Anieka and Nick receive a lease payment for their cows and are able to keep 30 heifer calves each year. As a payment for artificially inseminating (AI) the rising-two-year-old heifers at one of the Hopcrofts’ two owned runoffs they get half of the resulting heifer calves too. “We have a really good relationship with our farm owners and they’ve been very supportive in helping us progress,” Anieka says. They work in well together as a team on the farm with Lyall and Jan both actively involved. The relationship extends beyond the farm too with Lyall and Jan often helping out with babysitting Anieka and Nick’s four-year-old daughter Maycie. As the daughter of sharemilkers, who then went on to buy and convert their own farm, Anieka knows only too well

the effort it takes to make it to farm ownership. Her parents Frans and Jeanine migrated to New Zealand in the 1990s from The Netherlands when Anieka was just a tot and moved up the sharemilking ladder in Southland and Otago before buying a drystock property at Tuatapere. Anieka worked her way up to herd manager on a neighbour’s dairy farm and when her parents converted she returned home as manager. She’d met Nick, a sheep and cattle farmer and he moved back to the home farm with her and worked as a dairy assistant, learning the dairying ropes. Before long the two ventured out on their own, first in a joint 2IC position and in 2012 went to work for the Hopcrofts. Northern Southland is notorious for the dry spells that inevitably hit sometime through the summer and the variability of the season can mean equally big variations in pasture production for Anieka and Nick. “The main thing is don’t panic,” Nick says. “Down South they panic if it doesn’t rain for a couple of weeks but we know the dry will happen at some stage every summer so we farm for it. Eventually the rains will come,” Anieka says. The Hopcrofts too are well aware of the climatic challenge and choose to have a good level of supplements on hand. On average cows will get about 1.2 tonnes drymatter (DM)/cow/year as supplement. With pasture production about 4-5t DM/ha below irrigated or reliably rainfed pastures the level of supplement goes a long way to replacing that shortfall and enables production of 500-525kg milksolids (MS)/cow or 1440kg MS/ha. Bought-in supplement is in the form of locally sourced wheat, palm kernel, silage and corn gluten meal. The grain, palm kernel and meal are all fed in the 54-bail farm dairy with the amount fed automatically dispensed by the DeLaval DelPro system according to body condition score and production. “If a cow is lighter and high producing she’ll be getting fed but if she’s fat and not producing she’ll be licking the bin and that’s all,” Nick says. Anieka body condition scores the cows several times through the season and gets the vet and farm consultant Ivan Lines to calibrate her eye occasionally when they’re on farm. As well as the supplement, they make good use of a cropping programme 83

NZ Farm Life Media Limited’s Rights 4.1 NZ Farm Life Media Limited in its discretion may: a. At any time and without notice to the Client cancel, reject or refuse to publish or continue publishing any Advertisement without providing any reason for such rejection or refusal at any time before or after publication of the Advertisement, provided this right will not be unreasonably exercised. In the event that an Advertisement has been cancelled or rejected by NZ Farm Life Media Limited and where advertising rates have been agreed on the basis of a specified number of Advertisements appearing within a prescribed timeframe, any Advertisement already run shall be paid for at the rate that would apply if the entire order were published. b. Remove from its publications or websites any Advertisement that contains matter that NZ Farm Life Media Limited views, in

its sole and absolute discretion, to be objectionable or inappropriate for inclusion. c. Warranty 5.1 The Client represents and warrants that: a. NZ Farm Life Media Limited is entitled to reproduce any written material, advertising or images supplied by the Client to NZ Farm Life Media Limited, without further cost to the Client, in other NZ Farm Life Media Limited publications and media. b. That the Advertisement complies in every way with the Advertising Codes of Practice issued by the Advertising Standards Authority Incorporated and with every other code or industry standard relating to advertising in New Zealand. c. Publication of the Advertisement will not give rise to NZ Farm Life Media Limited incurring any liability or to a claim against NZ Farm Life Media Limited. d. The information provided to NZ Farm Life Media Limited is true and correct and that the Client will advise NZ Farm Life Media Limited of any changes to the information or details. e. The Client repeats the representations and warranties in clause 5.1 on each occasion that an Advertisement is Booked and each time an Advertisement is provided to NZ Farm Life Media Limited for publication. f. The advertising space will be used only by the Client for advertising their usual business, with the exception of employment advertising which is permitted, and may not be transferred by the Client to another person. g. The Advertisement the Client provides does not: (i) Contain material that is considered obscene, offensive, defamatory or which otherwise offends against generally accepted community standards and is unsuitable for publication and is likely to be misleading or deceptive or otherwise infringe the Fair Trading Act 1986 or any other statute, regulation or rule of trade. (ii) Infringe copyright, trademark or any other intellectual property rights. (iii) Breach any provision of any statute, regulation, by-law or other rule of law. h. The Advertisement the Client provides complies in every way with the Human Rights Act 1993 (HRA). Under the HRA, it is
unlawful, subject to certain exceptions contained in the HRA, for employment Advertisements to restrict applicants because of their sex, marital status, religion, ethical belief, colour, race, ethnic or national origins, disability, age (over the age of 16), political opinions, employment status, family status or sexual orientation. For the avoidance of doubt, where an employment Advertisement does not fall within one of the exceptions contained in the HRA, that Advertisement shall be regarded as being open to applications from males and females.
6. Limitation of Liability To the fullest extent permitted by law, NZ Farm Life Media Limited will not be liable for any loss, costs, damages or harm or misrepresentation including without limitation liability for indirect or consequential loss, loss of business, loss of revenue or profit as a consequence of any action or omission by it, its employees, contractors or agents. 7. Advertising Material and Content 7.1 It is agreed that: a. The Client is responsible for proof-reading and approving all Advertisements before submitting them to NZ Farm Life Media Limited for publishing. b. If the Client does not sign off their final advertising proof within the allocated timeframe, NZ Farm Life Media Limited reserves the right to sign it off without consequence or liability (as per clause 6). c. The Client is fully liable for any errors or omissions in the Advertisement that remain after the Client has provided the final Advertisement to NZ Farm Life Media Limited or has approved the final proof. d. The Client acknowledges that it is responsible for notifying NZ Farm Life Media Limited as soon as possible (and in any case, within 10 days of the date the Advertisement appeared or should have appeared) of any error it identifies in any Advertisement the Client has placed. Where NZ Farm Life Media Limited receives notification of such an error, NZ Farm Life Media Limited will consider that error and take any steps it considers reasonable or necessary to remedy that error at the next available opportunity. After 10 days any claim is deemed waived. e. When any change of Advertisement is not received by the Material Deadline, an Advertisement run in previous publications may be published in its place. f. All advertisements that have 50% or more editorial of the total ad size, must have the words ‘Advertorial’, ‘Advertisement’, or, ‘Content supplied by (your business name)’ on top of the ad and copy must be

Advertisement Cancellations a. NZ Farm Life Media Limited, in its sole discretion, may agree to cancel an existing work order for print and/or NZ Farm Life Media Limited Website Advertising by the Client. b. The Client will remain liable for the cost of any work performed or materials purchased on behalf of the Client, including the cost of services and, where relevant, paper and/or printing. c. All cancellations of Advertising must be made in writing to NZ Farm Life Media Limited. d. Changes to or cancellations of print Advertising by the Client will be accepted by NZ Farm Life Media Limited in its sole discretion, and will incur a cancellation fee of 100% of the Advertisement cost plus GST, if cancelled after the Booking Deadline. e. Changes to or cancellations of NZ Farm Life Media Limited Website Advertising by the Client will be accepted by NZ Farm Life Media Limited in its sole discretion, and: i. Cancellations received within six to 14 Business Days before the campaign start date will incur a cancellation fee of 50% of the Advertisement cost plus GST; ii. Cancellations received within five Business Days of the campaign start date will incur a cancellation fee of 100% of the Advertisement cost plus GST; iii. If the digital material required from the Client for the website advertising or communication regarding cancellation is not received then the Client will incur a cancellation fee of 100% of the Advertisement cost plus GST. 9. Rates 9.1 The Client acknowledges that: a. All Advertisements will be charged, and the relevant amount due will be paid to NZ Farm Life Media Limited, in accordance with the Rate Card applicable at the time an Advertisement is Booked, unless otherwise agreed in writing. b. Where a rate is agreed between the parties, that differs from the Rate Card, on the basis that the Advertisement will appear in a specified number of publications within a certain period of time, and the Client does not subsequently advertise in the specified number of publications within the agreed timeframe, the Client will be liable for the difference between the rates agreed and those which are prescribed in the Rate Card, for the number of Advertisements actually published. c. Unless otherwise stated by NZ Farm Life Media Limited, advertising rates are quoted exclusive of GST and the Client will pay GST in addition to such rates. NZ Farm Life Media Limited will not charge GST if a Client can provide written confirmation that it is not a resident in New Zealand for GST purposes (i.e. not a resident for income tax purposes and not carrying on an activity in New Zealand through a fixed or permanent place in New Zealand). Clients must advise NZ Farm Life Media Limited should their position alter. 10. Payment/Costs a. All invoices are due for payment on the 20th of the month following

the date of the invoice for any Advertisement (Due Date). b. The Client must advise NZ Farm Life Media Limited as soon as possible and, in any event, before the Due Date, if the Client believes there is any error with the invoice(s) it has received. c. In the event that NZ Farm Life Media Limited does not receive payment within five Business Days of the Due Date, NZ Farm Life Media Limited may send to the Client a notice of demand for payment (Final Demand). d. If the Client does not pay all outstanding amounts owed to NZ Farm Life Media Limited within Five Business Days of the date of any Final Demand, the Client will become immediately liable for all costs and expenses incurred in recovering the debt including, but not limited to, full legal costs, debt collection and court costs and any interest on the amount due from the Due Date to the date the amount due has been recovered, charged at the ‘use of money’ interest rate prescribed by the New Zealand Inland Revenue Department. e. Clients who are deemed to be a Bad Debtor by NZ Farm Life Media Limited will not be eligible for future advertising until payment is received, and may be required to pre-pay for all future Advertisements. f. NZ Farm Life Media Limited reserves the right to cancel without notice any forward bookings if the Client has become a Bad Debtor. g. Clients based outside of New Zealand may be asked to pre-pay for their advertising, at NZ Farm Life Media Limited discretion, to ensure payment is received on time. h. NZ Farm Life Media Limited reserves the right to request Clients pre-pay for advertising before it runs. Once payment is received the Advertisement will then be placed in the next available publication. i. NZ Farm Life Media Limited is entitled to charge for its services in the creation of marketing material and Advertisements specifically requested by Clients. Ownership of such material shall pass to the Client upon payment in full of all amounts due to NZ Farm Life Media Limited by the Client for these services. The intellectual property in all original material supplied by NZ Farm Life Media Limited such as photographs, graphics, and editorial content will remain with NZ Farm Life Media Limited and the Client acknowledges and agrees that its use by the Client or a third party (other than with express written consent of NZ Farm Life Media Limited) is prohibited. 11. General 11.1 Advice The Client acknowledges that before accepting these Terms and Conditions it has had the opportunity to obtain advice, including independent legal advice, as it requires, regarding these Terms and Conditions and their effect. 11.2 Whole Agreement These Terms and Conditions govern the relationship between NZ Farm Life Media Limited and the Client and supersede all prior representations or agreements between the parties whether oral or in writing, unless expressly stated otherwise. 11.3 Invalidity If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable, it shall be read down or severed to the extent of the invalidity or unenforceability and that event shall not affect the validity or enforceability of the remaining provisions. 11.4 Governing law the laws of New Zealand govern these Terms and Conditions. 11.5 Jurisdiction
Each party irrevocably and unconditionally submits to the nonexclusive jurisdiction of the courts of, or exercising jurisdiction in, New Zealand and waives any claim or objection based on absence of jurisdiction or inconvenient forum; or immunity in relation to these Terms and Conditions in any jurisdiction for any reason; and 11.6 Amendment NZ Farm Life Media Limited may amend these Terms and Conditions from time to time at its sole discretion. The amended Terms and Conditions will not apply to Advertisements that are confirmed as Booked unless otherwise agreed between NZ Farm Life Media Limited and the Client. 11.7 Waivers The failure of NZ Farm Life Media Limited to enforce or a delay by NZ Farm Life Media Limited to enforce any right conferred upon it by these Terms and Conditions shall not constitute a waiver of any such right or operate so as to bar the exercise or enforcement there of at any time or times thereafter. 11.8 No assignment The Client shall not assign these Terms and Conditions or otherwise transfer the benefit of these Terms and Conditions or a right or remedy under it. 11.9 Survival Not withstanding termination of this Agreement, this clause 11.9 and the following clauses shall survive any termination: i. Clause 3 (Indemnity); ii. Clause 6 (Limitation of Liability); iii. Clause 10 (Payment/Costs); iv. Clause 11 (General); and v. All other clauses required giving effect to this clause. 12. Definitions/ Interpretation 12.1 In these Terms and Conditions, unless the context otherwise provides, the following definitions shall apply: a. The expression ‘Client’ means the advertiser and where advertising has been placed with NZ Farm Life Media Limited by an advertising agency, includes that agency. b. ‘Advertisement’ means any Advertisement supplied to NZ Farm Life Media Limited by or on behalf of the Client, including any design and/ or text. c. ‘Booked’ means an Advertisement that has been confirmed by the Client and which NZ Farm Life Media Limited has generated a booking confirmation for. d. ‘Booking Deadline’ means the time by which NZ Farm Life Media Limited must receive confirmation of an order for an Advertisement from the Client, as contained in the Rate Card for the relevant publication. e. ‘Material Deadline’ means the time by which NZ Farm Life Media Limited must receive material for an Advertisement from the client. f. ‘Business Day’ means a time between 8am and 5pm, which is not a weekend or a public holiday. g. NZ Farm Life Media Limited website means nzfarmlife.co.nz h. ‘Rate Card’ means the rate card for the relevant publication in which the Advertisement is to appear which contains the advertising rates and relevant deadlines for that publication, as amended from time to time. i. ‘Bad Debtor’ means a Client who has failed to make payment of an outstanding advertising invoice within 60 days of its due date.
