Christmas in July Boat Parade Thank you to the Cape May County Herald Times for providing the cover photograph of the area’s Christmas in July Boat Parade. It was taken by Al Campbell on July 28, 2007. “During the gala, boaters and dock owners pretend it’s Christmas,” Campbell said. “Everyone decorates and parties appropriately!” The “line of transit” – a nautical way of saying “parade route” – was at least Campbell a couple of miles long, through back bay channels from North Wildwood to Wildwood. Alfred S. “Al” Campbell is managing editor and online editor for the Herald Times. He has worked at the paper since 1988. He started his newspaper career as photographer and reporter “long ago,” he said. A resident of Cape May Court House, Campbell still enjoys photography. “Taking photos is part of me, although now I must force myself out of the office to snap images around Cape May County.” This photo was used on Page 1 of the August 1 issue of the Herald Times. nJPa’s service to members is outstanding

As I see it...

As we start the 151st year of our existence as an association serving New Jersey’s newspapers, it is a good time to remember everything we do at NJPA to assist and nurture this industry we all love and respect. I am sure the group of editors who met to form NJPA in 1857 had no idea what we would be doing a century and a half later — many of them things they could not even imagine. Today, most members take NJPA’s services for granted. Every so often, however, it is a good idea to review them and see if there is something available that you may be missing. So, to kick off our 151st year, here is a list of the services we provide: Information Center

Every day, NJPA staff members answer a broad range of members’ questions. We maintain current information on press issues and will research unusual queries. We are also a resource for those outside the newspaper business who desire information about the industry and our readers. Legislative Monitor

One of the most important functions of NJPA and its Government Affairs Committee is to monitor the activities of the New Jersey Legislature. Staff and committee members meet with lawmakers, testify on proposed measures, issue position papers and seek sponsors to introduce bills that will benefit the newspaper industry and open public government. Publications

InPrint, NJPA’s monthly newspaper, features industry news and personalities, help-wanted ads, job candidates, current issues and NJPA activities. NJPA also publishes a weekly e-mail bulletin, NJPA Notes.

Legal Hotline

The hotline provides legal advice, at no charge, to NJPA member newspapers. This is especially valuable for smaller daily and weekly newspapers with no communications lawyer on staff. Reference Manuals and Guides

We distribute two reference manuals to members, The Publication Laws of New Jersey and The Reporter’s Handbook on Press Law and the Courts, which are popular and updated regularly. We also publish a long list of brochures available from NJPA. Workshops and Seminars

Each year, NJPA offers more than 20 daylong and half-day workshops and training seminars on a broad range of topics including editorial, photography, advertising, circulation and management. In the fall, our Annual Meeting dinner features a speaker on a topic of interest to all newspaper departments. Speakers Bureau

NJPA staff members regularly speak to civic groups and associations throughout the state about the New Jersey newspaper industry. NJPA also serves as a resource for our members when they need speakers for organizational meetings or staff training.

New Jersey Newspaper Network

Inaugurated in 1991, NJNN is a resource for advertising agencies and accounts wishing to place ads in any combination of NJPA member newspapers. In addition to the convenience of one order, one bill and one check, NJNN provides market research and analysis, and advertising placement in papers throughout the nation. Last year, NJNN placed over $15 million of advertising in our member newspapers alone. New in 2007, NJNN now offers online advertising placement services for member newspaper websites. Statewide Classified Advertising Network (SCAN)

SCAN enables advertisers to reach more than 4 million readers in over 140 daily and weekly member newspapers for one low price. NJPA processes the ads and sends them to participating newspapers, which share in the year-end rebates through dues reductions. 2x2 Display Advertising Network

Like the successful SCAN program, this network is for weekly members only. Advertisers can place a 2-column x 2inch display ad in more than 125 weekly newspapers statewide, which have more than 2.2 million circulation, for one low price and with one call.

Better Newspaper Contest

We sponsor the annual NJPA Better Newspaper Contest, one of the strongest and most competitive contests of its type in America. Member newspapers compete for awards in news, advertising, photography and circulation promotion categories. Out-of-state newspaper professionals judge the contest. The awards are presented in the spring at the Advertising & Circulation Awards Dinner and Press Night, the editorial and photography awards dinner.

Market/Readership Survey

NJPA regularly commissions a statewide survey of the buying and reading habits of New Jersey residents. The published results have been an invaluable aide to newspaper members and NJNN reps in their ad sales efforts. Internship/Scholarship Program

New Jersey Press Foundation administers a fund that provides thousands of dollars each year for journalism training. The foundation sponsors a broad range

of programs and awards for students interested in newspaper careers. The NJPF Internship/Scholarship program grants 10-week paid summer internships to journalism students from New Jersey. These internships are served at NJPA member newspapers. Upon successful completion of their internships, these students receive grants toward their next academic year. Job Bank

NJPA maintains a file of résumés from applicants who are seeking newspaper employment. We provide members with potential candidates through our monthly publication, our website or by specific request. We do not screen applications. Press Release Service

NJPA’s PressReach program provides businesses and agencies with a convenient way to submit and distribute press releases to multiple newspapers, radio and TV outlets in New Jersey. Low-Cost Insurance

Greater value and low cost are offered on a variety of insurance coverages available through NJPA, including group health, life and libel insurance. Other Press Associations

NJPA receives bulletins and publications from other press associations in the United States, and directs news and information to its membership. NJPA’s executive director belongs to the Newspaper Association Managers organization, which meets frequently each year to exchange ideas and information. Technical Support

Our information technology manager assists smaller newspaper members with computer, software and web-related questions. Since many do not have IT people on their staffs, this is becoming an increasingly useful and important service. ❖

 a Brief history  nJPa  One hundred fify-one years ago, on Feb. 25, 1857, 28 editors from 26 New Jersey newspapers founded the association for the “brethren of the press of New Jersey.” Their aim was to advance the interests of newspapers and to increase awareness in the benefits of newspaper readership. We are still at work to safeguard the right of the state’s newspapers to print what the public needs to know, and to charge enough to stay in business. Less than a month after its organization, NJPA scored a victory in the Legislature, pushing through a bill permitting a higher rate for legal advertising. The struggle for equitable legal rates still continues. The need for more intensive study of the problems of the press led to the first New Jersey Newspaper Institute, held in affiliation with Rutgers University in 1922. These ties also led to the establishment of journalism instruction at Rutgers in 1925. The first libel law was enacted in 1928 after 21 years of struggle. First Shield Law

The first shield law in the United States, giving a reporter immunity from arrest, went on the books in 1933. The law was first proposed by the NJPA in 1930 and became the model for other states. In 1934, two important NJPA-sponsored measures became law, one requiring all actions for libel against a newspaper to be filed within a year after publication (instead of two years) and the second made it a misdemeanor for anyone to interfere with or assault news reporters or photographers. First Executive Secretary

NJPA’s first executive secretary was Kenneth E. Olson, named in 1935. He also directed the Rutgers Journalism Department. A central office was opened at Rutgers University and a monthly publication started in November 1935. Committees were formed

and clinics and roundtable discussions held for all departments, including advertising. Better Newspaper Contests

In 1940, the positions of executive secretary and journalism director were separated and the Competitive News Photo Contest was added to the Institute. The name of the newspaper contest was changed to the “NJPA Better Newspaper Contest.” In 1988, the first writing contests were sponsored for college and high school newspapers, and in 1989, the first promotion contest was added. World War II

World War II saw every eligible daily in the state as an NJPA member. Carrier boys sold war stamps and the association’s newspaper missed the December 1944 issue “because of a paper shortage.” The 1945 annual meeting was cancelled by the board of directors at the request of the War Mobilization Director. In 1946, having accepted a form of subsidy from Rutgers University for 11 years, NJPA severed its academic ties. The executive secretary and his office assistant became full-time employees of the association. The only connection with the university was the continued use of office space. First Press Seminar

The first of the press seminars sponsored jointly by Rutgers and NJPA was held in 1952, and the Associate Membership Division began in 1953. Legislation during the early 1950s included legal advertising rates and publication of special matters. A court ruling prevented municipalities from imposing license fees on newspapers. As NJPA geared for its centennial, a new legal rate bill supported by the association was signed into law. The legislation ended the distinctions based on the class of city or county in which the newspaper was located and set the rate solely on the basis of circulation.

NJPA Scholarship Fund

The early 1960s saw what began as a $100 scholarship to a Rutgers journalism student develop into the NJPA Scholarship Fund, Inc. From 1977 through 1991, more than $400,000 was raised for the New Jersey Press Foundation from an annual pre-season football game between the New York Giants and other National Football League teams to provide in-service training to journalists, students and college professors, and to fund educational programs, including the Rutgers University Journalism Resources Institute and the Newspaper in Education Program. Move to Trenton

In 1978, NJPA moved its offices from Rutgers University to the heart of the historic State House district. NJPA purchased a 100-year-old building, 206 West State Street, Trenton, a short walk from the State Capitol. Legislative and Court Victories

In 1982, NJPA narrowly won a legislative victory that lowered the age of news carriers from 12 to 11 years of age. NJPA also has victories in the courts in the spring of 1982. A primary focus of the NJPA during 1983 and the first few months of 1984 was the battle for access to court hearings, court and police records and public meetings. In April 1983, as a result of NJPA arguments, the New Jersey Supreme Court ruled that pre-trial hearings in cases that may result in the death penalty should be open to both the press and the public. The association was also successful in amending the legislation (A1851) prescribing New Jersey’s method of execution to include guarantees of media access to death-row inmates, as well as to the execution itself. Legislative advances in 1983 also included passage of Senate bill S-1044 authorizing the state’s newspapers to — Continues on Page 46

raise their rates for all official paid advertising. Passage of the bill was the culmination of a three-year effort by NJPA to increase the rates for public notice advertising. Executive Orders 123 and 69

Responding to complaints from journalists across the state that they were denied access to even the most routine police information, NJPA and state prosecutors collaborated in 1984 and early 1985 on an executive order directing law enforcement officials to release police news. Governor Thomas Kean signed the order in Nov. 1985. The order provides more access to police news and an immediate appeal process for the press. In 1997, Governor Christine Whitman signed a strengthened version, Executive Order 69. Fair Trial and Free Press

In March 1985, the state Supreme Court approved a statement of fair tri-

al and free press issues, including new guidelines covering release of information by law enforcement agencies. The statement replaced the 1972 “Principles and Guidelines for Reporting Criminal Procedures,” which was outdated by recent constitutional decisions. The statement was developed by the NJPA’s Court Press Relations Committee and the Supreme Court’s Committee on Relations with the Media. Newsracks Placement

NJPA concerns also included regulations and fees imposed on the installation and placement of vending boxes. NJPA has objected to payment of any fee because honor boxes have been found to have full constitutional protection under the First Amendment provisions of speech and the press. NJPA fought the NJ Department of Transportation in the Supreme Court over restrictive regulations limiting placement of newsracks in state high-

way rights of way. The case was settled in 1989. In 1987, the association scored a victory in the New Jersey Supreme Court. With NJPA entering the Mayo Sisler vs. The Courier-News, Bridgewater, libel case at the Supreme Court level, the court created a new public figure category that offers the press important protection. The court also overturned the $1.05 million libel judgment against the newspaper. In a second state Supreme Court decision, the court upheld the right of newspapers to evaluate products in a case involving Sentinel Publishing Co. Auto Advertising, Recycling

New state auto advertising regulations also went into effect in 1987. The Division of Consumer Affairs revised the automobile regulations to accommodate and protect both the consumer and the automobile dealers. — Continues on Page 47

In December 1989, responding to bills pending in the legislature that would mandate the use of recycled newsprint in New Jersey, NJPA adopted a newsprint recycling policy statement, passed a Board resolution and formed a Newsprint Recycling Task Force to encourage newspapers to use recycled newsprint. Legislative Battles

In 1990, the association retained a firm of professional lobbyists. In December, 1991, NJPA’s Access to Public Records (Title 47) bill was released from committee after four years of drafting and negotiation. The bill provided a universal procedure for processing requests for public information, and placed the responsibility for determining what is and what is not a public record on the agency that maintains the records. In late 1997, NJPA dropped support of this bill owing to changes and amendments that tended to nullify the bill’s potential effectiveness. In 1999, after negotiations with the Governor’s office, a revised version of Title 47 was introduced into committees in both

houses. The bill still awaits a hearing. The Association’s Legal Rate Bill, A1195, calling for a ten percent per annum increase over the next three years in the rates chargeable for public notices, was defeated in the Senate during the last session of 1993. Bell/BRC Agreement

At the end of 1991, the Association unsuccessfully opposed a legislative move by New Jersey Bell to become deregulated and to replace its state-wide copper wire network with fiber optic cable at consumer expense. This move was part of a nationwide strategy to prepare for the entry of the Bell Regional Operating Companies into the business of providing electronic information services. In March, 1993, a Bell/NJPA agreement was reached mandating that any NJ Bell information services be run by a corporate subsidiary with separate management, staff, marketing, facilities and accounts. NJ Bell would have to do business with that affiliate and any competing electronic publishers — including NJPA member newspapers — on the same terms. In effect, NJPA had suc-

ceeded in leveling the playing field. Free Newspapers Admitted

After several negative votes in previous years, NJPA’s membership voted in the fall of 1993 to admit free distribution newspapers to the association, and to provide a special category of membership for college newspapers. In 1997, members voted to admit non-English language newspapers to membership of the association. Later, members voted to add a specialty publications membership classification. Move to West Trenton

In December, 1995, NJPA moved its headquarters out of downtown Trenton to Mountainview Office Park, close to Interstate 95 in West Trenton. In early 1997, an NJPA Web site was set up by Packet Online, a division of Princeton Packet, Inc. Access Bill Becomes Law

After a more than 15-year struggle by NJPA, Acting Gov. Donald DiFrancesco signed a new Access To Public Records Law on Jan. 8, 2002. The law brought New Jersey from last place to a spot in the top 10 on the list of states with superior access laws. Members — Continues on Page 48

In 2007, NJPA celebrated its 150th Anniversary with a series of symposiums that focused on the future of the industry. New Media experts from throughout the country took part in the well-attended events. The year-long celebration culminated with a Gala Celebration on October 16 that featured hilarious entertainment by The Capitol Steps, a nationally-known comedy group. Tom Cafferty, NJPA’s long-time general counsel, was honored that evening for over 35 years of dedicated service to NJPA. Malcolm Borg, chairman of North Jersey Media Group, was also honored for his many years of service to the New Jersey Press Foundation. Current Membership
