Le présent guide tient compte du classement au 31/12/2009. Les clients sont invités à s’informer d’une éventuelle modification de classement au moment de la réservation.

II – PRIX Les prix “tout compris” (taxes et services), sauf la taxe de séjour, établis par jour, sont ceux indiqués par les hôteliers eux-mêmes selon la règlementation en vigueur à la date d’impression.

Ils sont donnés à titre indicatif, varient selon les saisons et pourront être modifiés en cours d’année. Par Arrêté Municipal en date du 18 décembre 2003, les hôteliers doivent percevoir une taxe de séjour (par jour et par personne*) dont le montant a été fixé selon la catégorie de l’hôtel. Les clients doivent donc régler cette taxe de séjour qui s’ajoute à la note de l’hôtel.

G É N É R A L E S introduire dans la chambre des tierces personnes non connues de l’hôtelier, sauf autorisation de ce dernier. De même, le client ne peut louer une chambre pour un nombre de personnes supérieur à celui prévu par les règlements en vigueur.

L’hôtelier ne doit pas subordonner la prestation de la chambre à celle de prendre les repas à l’hôtel, sauf s’il a décidé de ne vendre que des pensions ou des demipensions. Il n’y a pas de maintien dans les lieux depuis de très nombreuses années.

Si le client refusait de partir et que l’hôtelier soit amené à déménager ses effets, il ne commettrait pas le délit de violation de domicile.

2) Les arrhes Le client, s’il veut avoir la garantie d’une réservation doit envoyer des arrhes. Les arrhes versées plus de 3 mois à l’avance porteront à intérêts au taux légal à compter du 4e mois et jusqu’à la date du séjour, et viendront en déduction de la facture de l’hôtel.

Si le client annule, l’hôtelier peut les garder à titre de dommages-intérêts et ceci, même si le client avait de très bonnes raisons de ne pas venir. De son côté, l’hôtelier, non seulement doit rembourser les arrhes, mais également une somme égale (il a reçu 100 , il doit rendre 200 ) dans le cas où, même par force majeure, il ne pourrait recevoir le client. Les droits sont donc équilibrés. Dans le cas d’une réservation verbale ou par correspondance, avec dépôt d’arrhes, si le client n’a pas pris possession de la chambre à la date convenue, l’hôtelier se trouve libéré de tout engagement à compter du lendemain et les arrhes lui restent acquises. L'hôtelier peut demander au client un paiement d'avance, cela se pratique partout à l'étranger.

3) Séjour écourté Si le client part avant la date d’expiration du séjour qu’il avait arrêtée, qu’il y ait ou non versement d’arrhes, l’hôtelier est en droit de demander la réparation du préjudice subi, à condition qu’il puisse le démontrer ; ce sera le cas s’il n’a pas pu relouer la chambre. Le principe même de cette réparation de dommages a été reconnu depuis longtemps par les tribunaux.

4) La filouterie Le client qui ne paie pas sa note et qui avait décidé de ne pas la payer commet le “délit de filouterie” puni de 6 mois d’emprisonnement et d’une amende de 7622  par l’article 313-5 du nouveau Code Pénal. Il est recommandé aux hôteliers, pour tout séjour, de présenter la note au client chaque semaine.

5) Bagages laissés à l’hôtel Le client qui laisse ses bagages à l’hôtel et ne donne plus signe de vie s’expose à les voir vendre par l’hôtelier dans des conditions prévues par la Loi du 31 mars 1896.

L’hôtelier a un droit de rétention sur les bagages du client qui ne paierait pas une note ; ce droit est applicable sur l’ensemble des bagages, bijoux, voiture, deux roues... dans une mesure raisonnable, en fonction de l’impayé.

6) Responsabilités Le client est responsable de lui-même ou de ses préposés : c’est ainsi, par exemple, qu’un enfant qui tache, abîme ou déchire, oblige le client à indemniser l’hôtelier pour les dégâts causés. Le fait que l’hôtelier puisse s’assurer dans ce domaine sur le plan commercial, ne retire en rien le droit pour l’hôtelier de se faire indemniser de tout préjudice qui serait né du fait des clients. D’abord, il doit garantir la sécurité du client et ensuite au niveau des objets appartenant aux clients (art. 1952-19531954 du Code Civil).

7) Fiche de police Il n’y plus d’obligation pour les hôteliers, de tenir un registre de police, ni d’établir des fiches de police pour les clients français. En revanche, les fiches de police sont toujours exigibles pour les clients étrangers. Juridiquement l’hôtelier peut demander au client son identité (notamment pour la réception du courrier).

8) Divers L’hôtelier délivrera une note détaillée des prestations fournies et refusera la délivrance de tout document de complaisance. L’hôtelier indiquera au client l’heure de l’occupation de la chambre et l’heure limite pour libérer la chambre. Le client ne doit pas emporter la clé de sa chambre à l’extérieur. Le tapage, même diurne, est interdit, le client causant du désordre ou du scandale sous quelque forme que ce soit, pourra être renvoyé sur le champ. Dans l’intérêt de la tranquillité de l’établissement, tout bruit doit cesser entre 22 heures et 7 heures.

II – RATES All inclusive day rates (tax and service-charges), exclusive of visitors' tax, shall be indicated by the hotel according to the regulations in application when documents are printed. They are provided for general information, since they may vary according to season and may be changed over the course of the year. For your information: A Municipal Decree dated 18 December 2003 stipulates that hotels shall also charge visitor's tax (per day and per person*), the amount of which is fixed according to the hotel category. Guests must pay this tax which is added to the bill.

O R M A T I O N The Hotel shall not hire rooms preferentially because meals are taken at the hotel, unless it operates exclusively on a full or half-board basis.

Guests are not entitled to stay in the hotel for unlimited duration. If a Guest refuses to leave the hotel, the Hotel may lawfully remove the belongings of the Guest. This act shall not constitute a forcible entry.

2) Deposits A deposit must be paid in order to secure a booking. Deposits paid more than 3 months in advance shall bear interest at the legal rate (3.87% for 1997) from the 4th month onwards until the date of arrival and shall be subtracted from the total amount of the hotel bill.

If the Guest cancels a booking, the Hotel is entitled to keep the deposit as compensation for the loss, whatever the reasons for cancellation. Similarly, if due to a case of force majeure, the hotel is unable to accommodate the guest, it shall refund the initial deposit and pay to the guest an additional amount equal to the amount of the deposit paid (for 100 deposit, the hotel shall refund 200). Both parties thus have equal rights.

If the Guest does not arrive at the hotel on the specified date in the event of verbal or written bookings confirmed by the payment of a deposit, the hotel is free to use the room booked and to keep the deposit as from the day after the due date of arrival. The hotel is entitled to claim advance payment from guests, as is the case every-where abroad.

3) Interrupted bookings If the Guest leaves before the end of the period booked, regardless of the payment or non-payment of a deposit, the Hotel is entitled to claim compensation if it has proof of the initial booking; this is applicable for rooms which have not been let in the meantime. Compensation is a long-established right recognised by the law.

4) Fraud A guest who deliberately leaves without paying his/her bill, is guilty of fraud and shall be liable to 6 months unprisonment and a fine of 7622  under article 313-5 of the new version of the Penal Code. We recommend that all Hotels charge their Guests with weekly bills for all stays.

5) Luggage left at the hotel The Law of 31 March 1896 specifies that the Hotel may proceed with the sale of any luggage left behind if the Guest makes no claim for it.

The Hotel is entitled to retain the belongings of any Guest who fails to pay his/her bill. This right includes all luggage, jewellery and personal belongings, vehicle, etc., within a reasonable extent and in accordance with the amount of the bill.

6) Liability The Guest is liable for his own acts and those of the persons accompanying him. He will therefore be held responsible for repairing all damage in the event of a child staining or otherwise damaging hotel property and must pay the appropriate compensation to the Hotel.

This remains applicable despite hotel coverage by any business insurance and guests causing damage must proceed with the repair of such.

The Hotel must first guarantee the safety of its guests and protect and insure the belongings of its guests (articles 1952-1953-1954 of the Civil Code).

7) Police formalities It is no longer compulsory to fill in police cards or identity records for French guests.

Police cards must still however be filled in for all foreign visitors and the Hotel is legally empowered to check the identity of its Guests (particularly for mail delivery).

8) Miscellaneous The Hotel shall establish a detailed bill listing all the services provided and shall refuse to deliver any inflated bills. The hotel shall inform the guests of the times at which they may use their rooms and the deadline for leaving their rooms. Guests must leave their keys at the hotel at all times. Excessive noise, including in the day time, is prohibited in hotel premises. Any guests causing any type of disturbance shall be immediately dismissed from the hotel. Guests are expected to respect silence in hotel premises between 10 p.m. and 7 a.m.

Ein Hotelier ist der Leiter eines Unternehmens, zu dessen Funktionen der Empfang und die Unterbringung der Kunden zählen. Der Kunde benutzt, gegen Bezahlung, die Räume in denen er aufgenommen wird.

1) Die freiheit zum empfangen Während der Kunde frei ist, sein Hotel nach Belieben zu wählen, steht es auch dem Hotelier frei, bestimmte Kunden abzuweisen, deren Haltung oder deren Begleitung, sowohl von Personen als auch von Tieren, die anderen Kunden stören könnte. Der Kunde ist nicht berechtigt Drittpersonen, die dem Hotelier nicht bekannt sind, ohne dessen Erlaubnis in sein Zimmer mitzunehmen. Der

I N F O R M A T I O N E N Kunde darf ein Zimmer nicht für eine Personenanzahl mieten, die höher ist als die von den gültigen Vorschriften vorgesehene. Der Hotelier darf die Dienstleistung der Zimmervermietung nicht von der Einnahme der Mahlzeiten im Hotel abhängig machen, ausgenommen dann, wenn er Tages- oder Halbtagspensionen zu verkaufen beschlossen hat. Es gibt seit vielen Jahren keinen Räumungsauf-schub mehr. Falls sich der Kunde weigert, das Hotel zu verlassen und der Hotelier sich gezwungen sieht, seine Sachen zu entfernen, wird dies nicht als eine Verletzung des Hausrechtes betrachtet.

2) Die Anzahlung Wenn der Kunde seine Reservierung garantiert haben will, muß er eine Anzahlung leisten. Die mehr als 3 Monate im vorhinein erlegten Anzahlungen, tragen ab dem 4. Monat Zinsen zum gesetzlichen Zinssatz (3,87 % für 1997) und dies bis zum Zeitpunkt des geplanten Aufenhaltes.

Sie werden von der Hotelrechnung abgezogen. Wenn der Kunde seine Reservierung annulliert, kann der Hotelier die Anzahlung als Schadenersatz behalten, auch dann, wenn der Kunde triftige Gründe zur Absage hatte. Seinerseits hat der Hotelier die Anzahlung zurückzuzahlen, und sogar eine gleichwertige Summe zusätzlich (er erhielt 100, er zahlt 200 zurück) falls er den Kunden nicht unterbringen kann, und dies auch in Fällen Höherer Gewalt. Die Rechte sind damit ausgeglichen. Im Falle einer mündlichen Reservierung oder Reservierung per Korrespondenz, mit Hinterlegung einer Anzahlung, bei der der Kunde nicht zum festgelegten Zeitpunkt in sein Zimmer einzieht, ist der Hotelier ab dem darauffolgenden Tag von jeder Verpflichtung entbunden und die Anzahlung bleibt in seinem Besitz. Der Hotelier kann vom Kunden eine Vorauszahlung verlangen, dies ist im Ausland üblich.

3) Verkürzter Aufenthalt Wenn der Kunde vor dem Ende des ursprünglich vorgesehenen Aufenthaltes abreist, ist der Hotelier berechtigt, unabhängig davon ob eine Anzahlung geleistet wurde oder nicht, Schadenersatz zu fordern, unter der Bedingung, daß er in der Lage ist den erlittenen Schaden zu belegen. Dies ist der Fall wenn es ihm nicht gelungen ist das Zimmer erneut zu belegen. Das Prinzip dieses Schadenersatzes wird seit langer Zeit vor Gericht anerkannt.

4) Zechprellerei Ein Kunde, der seine Rechnung nicht bezahlt und beschlossen hatte, nicht zu bezahlen, macht sich der «Zechprellerei» schuldig. Die Bestrafung beläuft sich gemäss Artikel 313-5 des neuen Strafgesetzbuches auf 6 Monate Gefängnis und 7622 . Den Hoteliers wird empfohlen, dem Kunden wöchentlich einmal die Rechnung zu präsentieren.

5) Im Hotel eingestelltes Gepäck Ein Kunde, der sein Gepäck im Hotel hinterläßt und nicht mehr von sich hören läßt, muß damit rechnen, daß es vom Hotelier unter den im Gesetz vom 31. März 1896 vorgesehenen Bedingungen verkauft wird. Der Hotelier ist berechtigt, das Gepäck von Kunden zurückzubehalten, die ihre Rechnung nicht bezahlt haben. Dieser Anspruch betrifft das Gepäck, Schmuck, Auto, zweirädrige Fahrzeuge..., in vernünftigem Ausmaß, je nach der geschuldeten Summe.

6) Haftung Der Kunde haftet für sich selbst und für seine Beauftragten; wenn zum Beispiel ein Kind Gegenstände verschmutzt, beschädigt oder zerreißt, ist der Kunde verpflichtet dem Hotelier dementsprechenden Schadenersatz zu leisten. Die Tatsache, daß der Hotelier in diesem Bereich handels-mäßig eine Versicherung aufnimmt, versagt ihm nicht das Recht für alle von Kunden verursachten Beeinträchtigungen Schadenersatz zu fordern. An erster Stelle muß er die Sicherheit des Kunden gewähren, danach die Sicherheit aller Gegenstände, die im Besitz des Kunden stehen (Artikel 1952-1953-1954 des Code Civil [französisches BGB]).

7) Polizeikarte Die Hoteliers sind bei französischen Kunden nicht mehr verpflichtet ein Polizeiregister zu halten, noch Polizeikarten auszufüllen. Bei ausländischen Kunden werden die Polizeikarten jedoch immer noch gefordert. Vom rechtlichen Standpunkt her, kann der Hotelier den Kunden nach seiner Staatsangehörigkeit fragen (insbesondere für den Empfang der Post).

8) Verschiedenes Der Hotelier erstellt eine detaillierte Rechnung über alle geleisteten Dienstleistungen und weigert sich Gefälligkeitsdokumente auszustellen. Der Hotelier informiert den Kunden über die Belegungszeit des Zimmers sowie über die genaue Uhrzeit zur Freigabe des Zimmers. Der Kunde soll den Zimmerschlüssel nicht außerhalb des Hotels bei sich behalten. Jegliche Ruhestörung, auch untertags, ist verboten. Ein Kunde, der in irgeneiner Form Unruhe oder Skandal stiftet, kann auf der Stelle aus dem Hotel ausgewiesen werden. Damit im Hotel die erforderliche Ruhe herrscht, darf zwischen 22 Uhr und 7 Uhr keinerlei Lärm gemacht werden.

II – PREZZI I prezzi con l’indicazione “tutto compreso” (tasse e servizio), salvo la tassa di soggiorno, che è giornaliera, sono quelli indicati dagli albergatori a seconda del regolamento in vigore alla data di pubblicazione del presente opuscolo. Sono dati a titolo indicativo e variano a seconda delle stagioni. Potranno essere modificati durante l’anno.

Per Ordinanza Municipale del 17 luglio 1990, gli albergatori devono percepire una tassa di soggiorno (al giorno e a persona*) il cui importo è fissato a seconda della categoria dell’hôtel. I clienti devono quindi pagare questa tassa di soggiorno che verrà aggiunta al conto dell’hôtel.

L’albergatore non deve subordinare la prestazione della camera all’obbligo della ristorazione presso lo stesso hotel, a meno che non abbia deciso di utilizzare il suo albergo solo a pensione o a mezza pensione. Non vi può essere occupazione dei luoghi da molti anni. Se il cliente si rifiutasse di andare via e l’albergatore fosse costretto a metterne fuori gli effetti personali, non commetterebbe nessun reato di violazione di domicilio.

2) La caparra Se il cliente vuole avere una garanzia di prenotazione deve versare una caparra.

Le caparre versate con più di 3 mesi di anticipo frutteranno un interesse secondo il tasso legale (3,87 % per il 1997) a partire dal 4e mese fino alla data del soggiorno.

Tali interessi, insieme alla caparra, verranno dedotti dal conto dell’hotel.

Se il cliente annulla la prenotazione, l’albergatore può trattenere la caparra a titolo di indennizzo e ciò anche se il cliente avesse avuto ottime ragioni per non venire.

Dal canto suo, l’albergatore non soltanto deve rimborsare la caparra, ma anche un corrispettivo (per esempio ha ricevuto 100, deve restituire 200) nel caso in cui, anche per cause di forza maggiore, non potesse accogliere il cliente. I diritti sono quindi equilibrati. Nel caso di una prenotazione verbale o per corrispondenza, con deposito di caparra, se il cliente non ha preso possesso della camera alla data concordata, l’albergatore è libero da ogni impegno a partire dal giorno seguente e la caparra gli resta. L’albergatore può chiedere al cliente il pagamento anticipato.

Tale richiesta è d’uso in tutti i paesi esteri.

3) Soggiorno accorciato Se il cliente parte prima della data fissata per il soggiorno richiesto, l’albergatore ha il diritto di chiedere un risarcimento, a patto che possa dimostrare il danno subito: per esempio se non avesse potuto riaffittare la camera. Da molto tempo i tribunali hanno riconosciuto il principio di questo indennizzo.

4) La truffa Il cliente che non paga il conto e che aveva deciso di non pagarlo commette il “reato di truffa”, punibile con una pena di 6 mesi di prigione e di una ammenda di 7622  prevista dall’articolo 313-5 del nuovo Codice Penale.

5) Bagagli lasciati in albergo Il cliente che lascia i suoi bagagli all’hôtel e non da più segni di vita si espone al rischio che l’albergatore li venda secondo le condizioni previste dalla legge del 31 marzo 1896. L’albergatore ha un diritto di ritenzione dei bagagli del cliente che non paga il conto; questo diritto è applicabile all’insieme dei bagagli, ai gioielli, alla macchina, ai motorini... in misura ragionevole rispetto al conto non pagato.

6) Responsabilità Il cliente è responsabile di se stesso o delle persone da lui dipendenti: per esempio, se un bambino sporca, rovina o strappa qualcosa, il cliente sarà obbligato ad indennizzare l’albergatore per i danni subiti. Il fatto che l’albergatore possa essere assicurato in questi campi dal punto di vista commerciale non pregiudica affatto il diritto dell’albergatore di ricevere un indennizzo dovuto ad un danno causato dal cliente. Innanzi tutto l’albergatore deve garantire la sicurezza del cliente, quindi quella degli oggetti che gli appartengono (art. 1952-1953-1954 del codice civile).

7) Scheda per la polizia Non vi è più l’obbligo, per gli albergatori, di tenere un registro per la polizia, né di redigere delle schede per la polizia, per quanto riguarda i clienti francesi. Tali schede però possono essere richieste per i clienti stranieri. Giuridicamente l’albergatore può chiedere l’identità del suo cliente (in particolar modo per il ricevimento della posta).

8) Varie L’albergatore rilascerà una ricevuta fiscale dettagliata delle prestazioni fornite e rifiuterà il rilascio di qualunque documento di favore. L’albergatore indicherà al cliente l’ora in cui potrà occupare la camera e l’ora in cui dovrà liberarla. Il cliente non deve portare la chiave della sua camera all’esterno. Il chiasso, anche diurno, è vietato, il cliente che causa disordini scandali di qualunque natura può essere immediatamente allontanato. Nell’interesse della tranquillità dello stabilimento, ogni rumore deve cessare tra le ore 22.00 e le ore 07.00.
