John Mitchell Eight months after the application was lodged, Palerang Council finally considered an application to make a change of use and alterations to the small cottage and outbuilding at 14 Malbon Street at its

September ordinary meeting. The property, the remnant of a two lot subdivision, had been purchased from the Council. For months the Council’s planners had been insisting that the applicant must build a concrete driveway in a right of way adjoining the applicant’s site to allow for goods deliveries to the rear of the site. Their authority, they said, came from the ‘RMS Guidelines for Providing Access.’

The applicants responded that the guidelines were for guidance only, that they were not meant for a development this small and that the guidelines allowed for leniency for heritage buildings. They argued that they were being asked to build a road on land they didn’t own, against the expressed wish of the current councillors, to accommodate a need they didn’t have.

Days before the Council meeting the applicants’ solicitor wrote to the Council, summarising the planners’ actions so far and saying that, if the condition was not withdrawn, they would seek legal remedy. The condition was withdrawn by staff prior to the meeting. A second point of contention was condition 9 of the planners’ recommendations which required that all build-

ing work is comply with the Building Code of Australia, and made specific reference to fire proofing of external walls and openings within 3 metres of the boundary. If pursued to the letter of the law, the applicants will be required to remove the full length of the external timber framed and clad walls on the east and west sides of the building, and part of the north and south walls as P8

Local horticulturalist Dennis Dempsey won the Grand Champion Daffodil, with a $50 Open Order at Muttons as the prize, with daffodils that date back

to early last century. “We rescued them from Mum’s garden at Emu Flat. There is just so much depth of colour in them,” he said. He won also three other firsts and a second for his camelias. He then went on to win the first prize in the Daffodil Fair Raffle, a $500 Open Order at Braidwood Rural & Building Supplies. The flower section was

judged by champion florist Marilyn Carle. The first prize placegetters included Di Izzard, Jenny Bunn, Maureen Stachow, Pat Stephen, Gilly Burke, Tess Gurling, Ted Younger, Durham Hall, Katie Lyons, Helen Small, Braidwood Preschool, Jarrah Parsons and Scarlet Bunn. The much coveted award for Best Sponge Cake went to Katie Lyons.

Press Release Federal Member for Eden-Monaro, Peter Hendy, recently inspected the work being conducted as part of the Federal Government’s $64 million plan for better local roads in Eden-Monaro. “Roads are critical to the residents of Palerang. They provide access to our homes, jobs, and schools.” “The Government’s $64 million local roads plan is delivering $5.7 million under the Roads to Recovery Program to Palerang Council to upgrade local roads,” Peter Hendy said. “On Cooma Road near Braidwood, this has seen 2.6 kilometres of the road resealed, upgrading this important local road with $620,914 in funding from the Government. “The existing pavement is aged, rough, and narrow. DARGUES CORNER Welcome to Dargues Corner. By now you would probably know that Unity Mining has withdrawn its proposal to use cyanide for processing at the Dargues Gold Mine. During the public exhibition period, many in the local community and beyond expressed concern about those elements of the proposal related to cyanide. Given the volume and, at times, intensity of the opposition to onsite processing, reverting to the original proposal is the right thing to do by the community and the company. You will know that we put our arguments strongly and widely, and other members of the community did the same. As a result we all gained a pretty good understanding of what the majority of the community wants, which is the whole point of public exhibition. It’s now time for the community to re-unite. Whether for or against the proposal, I wish to thank the local community for their high level of engagement. As you also may have heard, as of 30 September 2015, I will be resigning as Managing Director of Unity Mining. I’m proud of what Unity has achieved during my tenure and appreciate the hard work of the staff and consultants along the way. Small communities grants CAPTAINS FLAT SENIORS NEWS Press Release The Foundation for Rural and Regional Renewal (FRRR) have called for applications for two grants that will benefit small communities. Small Grants for Rural Communities Grants of up to $5,000 are available for projects and activities that offer clear public benefit for communities in rural, regional or remote Australia. Priority is given to communities of 10,000 or fewer. Applicants must be not-for-profit community organisations with an ABN or incorporation certificate. Applications close on 5

October 2015. REAPing Rewards Supports locally-driven projects and programs that directly benefit people up to 18 years of age, and their educators, through grants up to $10,000. The program is open to not-for-profit groups and staff who deliver quality, positive educational experiences in the early childhood, primary and secondary years. Applications close 21 September 2015. FATHERS AND CARERS DAY 1st Bungendore Cubs celebrated Father and Carers Day with a campfire on what can only be described as a beautiful mild night. The Cubs made their Dads ‘a cuppa,’ cooked eggs inside potatoes, along with sausages and onion. A few challenging games were played which were a lot of fun. Thank you to all the Dads and Carers that game along and we hope you had a good time. SKIING WEEKEND Our Skiing weekend was also a huge success with perfect snow and weather conditions. Thank you to everyone involved in organising this annual event. VENTURER UNIT 1st Bungendore has a strong and active Venturer Unit, the largest in the District. ROYALLA COMMON C’TEE Wednesday 12 August / With Cr Hicks attended the meeting of the Royalla Common s355 Committee. The Committee has been successful with a VMT grant for $53,116 towards the construction of the new amenities building on the Common. Stage 1 of that project is now fully funded and proceeding apace. DARGUES MINE MODIFICATION Wednesday 19 August / With other councillors and members of staff, met with Dr Peter Beck (GHD) to discuss the report he had produced on the Dargues Mine Modification. That is now complete and as per the resolution from the EM in Braidwood, Council has registered its opposition to the proposal to allow CIL processing on-site. MILLEARA SUBDIVISION Monday 24 August / With members of staff, met with representatives of the Milleara Estate (off Ellendon Street, just south of King Street) to discuss options to resolve problems with the drainage easement across the rear of their properties. STATE FUNDING Tuesday 25 August / With the GM, met with Damian Callachor, Senior Advisor to the Hon Warren Truss, Minister

for Infrastructure, to discuss funding proposals for both the Bungendore Car Park and the Back Creek Bridge (Cooma Road). LGNSW FINANCE SUMMIT Thu 27–Fri 28 August / With the GM, attended the LGNSW Finance Summit in Sydney. This meeting was conducted in the context of the FFtF program with the subtitle of ‘Fix the Funding First’. Speakers from Canada, New Zealand and Tasmania provided insight into the funding models in their respective jurisdictions, and Greg Smith, Chair of the Commonwealth Grants Commission provided a fascinating insight in the federal taxation system. The focus of much of the Summit was on dealing with the reality that there is no money tree out there anywhere and that councils need to look carefully at the services they deliver, how they deliver them and broadly at innovative ways of strengthening their own revenue base. FFTF PROGRAM Tuesday 1 September / With the GM and Cr France, met with LGNSW President Keith Rhoades and CEO Donna Rygate to discuss progress on the FFtF program and other local government issues. ABBEYFIELD’S PLANS Tuesday 1 September / With the GM, met with Abbyfield Australia CEO Chris Reside

The ‘box cut’ from which the Dargues Reef tunnel will start and local committee member Anne Goonan to discuss Abbyfield’s plans for a facility in Bungendore. For those who may not be aware, Abbyfield is a community housing provider that offers a range of assisted independent living and ‘low care’ aged care accommodation. They have been working with the Bungendore community for about four years now to identify a suitable location and layout for a local facility. FEDERAL FUNDING Wednesday 2 September / With the GM and Director of

Works, met with local member Dr Peter Hendy to inspect works on the Cooma Road and discuss funding proposals that were currently being pursued by Council—the Bungendore Car park, Back Creek Bridge, the Black Spot program targeting road locations with a crash history, and ABC Radio retransmission facilities. And, as usual, I also spoke to the local radio, TV and print media on a range of subjects, although most of the interest this month was in the modification to the Dargues Mine approval.

NOTES FROM OUR CHURCHES ST MARY’S PARISH St Mary’s parish is very happy to welcome the parish of St Bede’s in Braidwood has back into the Queanbeyan Mission which includes Hoskinstown, Gundaroo, Michaelago. We are also delighted to have Father Peter Day ministering to St Mary’s and St Bede’s. The new Mass times for St Bede’s Braidwood are Tuesday 10am and Saturday 6pm. There has been a noticeable increase in participation by young parents with primary school age children and St Mary’s welcome these new parishioners. To cater for their needs the children’s liturgy on Sundays has been re-established with the help of the Sisters of Charity. It is currently led by Elizabeth Van Gessel. BUNGENDORE ANGLICAN St Philip’s is turning 150, and will celebrate its connections with the local community. From 10am-3pm on Saturday 10 October there will be a Family Fun Day in the grounds, with jumping castle, food, fun activities and craft, historic reflections and a big cake. At 9am on Sunday 11 October, a commemorative service will be led by Bishop Stuart Robinson. The St Philip’s Bungendore Anglican community remains a solid part of our local community. The first St Philip’s church was built in the 1840s, when the village boasted just 30 people. This was replaced with the current building, completed in 1865– twenty years before the railway came to town bringing a rapid population boom. The Anglicans have served the local community through thick and thin– commemorative occasions, war heroes, prominent characters, fun events and activities, and a caring touch. Worse still, before the Council subdivided the site for sale in 2011, the western side of the building was well beyond the 3 metre limit. Planning consultant Luceille Yeomans addressed this point before the councillors started their deliberations. “If condition 9 is applied as read it will be impossible to achieve.. The BCA allows variations to these clauses for heritage buildings,” she said. Co-applicant Annabel Beith said clauses 93 and 94 of the Environmental Assessment Act point out that it is not mandatory that a building complies. “You have discretion in how you apply the requirement of the BCA.. One of the most important considerations is that people are able to get out of the building quickly and safely [and that is satisfied by our proposal]. If we are to comply strictly with the code, two sides of the building must be taken down and rebuilt in other materials..” Mayor Harrison. “As I understand it the fire ratings are a matter for the building certifier.” Director of Planning, John Wright. “The reference in condition 9 is drawing attention to the fire matters.. As you say, details of how you comply will be dealt with by the certifier.” Mayor Harrison. “At the end of the day the applicant can seek an amendment.” Cr Hogarth-Boyd. “I move that the staff recommendation be approved with the [reference to specific actions] in condition 9 removed.. I believe this clause is a red herring and there are provisions for discretion in the BCA..” Cr France. “I support this motion.. This little cottage is the trailblazer [and] ripping off weatherboards and replacing them with brick doesn’t make any sense.. There are many unintended consequences. This clause hasn’t been thought through properly.” Cr Hogarth-Boyd. “What is the relevant document that relates to [Council’s] discretion?” Mr Wright. “I’m not aware of specific provisions in the BCA .” Cr Hicks. “I’d like to go with the original staff motion.” Cr Cockram. “A question for the GM. Assuming that people who own buildings that don’t conform with the BCA insure them, if they burn down, will their insurance company find reason not to pay?” Mr Bascomb. “I can’t say. But there was a case where a restaurant [under another Council’s jurisdiction] burned down because there was a leak in a stove exhaust duct. The Council didn’t know anything about the leak but was liable for the loss of the building anyway.” Cr Cockram. “Then I can’t support Cr Hogarth-Boyd’s motion. I’m for the contrary motion.” Cr Hogarth-Boyd. “If the motion is adopted what are the options?” Mr Wright. “The applicant can appeal the conditions.” Cr France. “Will that be an additional cost to the applicant?” Mr Wright. “Yes.” Cr France. “Then I withdraw my seconding of the motion.” Cr Hicks agreed to second the motion. Cr Hogarth-Boyd [in reply]. “It’s been a really hard long, road.. I can understand Cr Marshall wanting to leave it on the table for a month. But it’s also been a long, hard road for the applicants. I believe the conditions [will help them get an outcome].” The motion was put and tied. For: Crs Harrison, Hicks, Hogarth-Boyd and Schweikert. Against: Crs Cockram, France, Marshall and Morrison. Mayor Harrison then used his casting vote to pass the motion. Laneway an attractive asset

Petition against Abbott’s NBN I have launched a petition against the Abbott Government’s National Broadband Network (NBN) rollout, which will negatively affect house values across large areas of Eden-Monaro, and result in higher costs for rural and regional residents. The Government’s ‘archaic’ approach to the NBN is creating two classes of homeowner in EdenMonaro: those who had fibre-to-the-premises connected for free under Labor and those who are receiving Tony Abbott’s inferior fibre-to-the-node system. The result is an unfair home-valuation differential and business disadvantage for all EdenMonaro residents who live outside Central Queanbeyan and Googong. The National Broadband Network is the biggest, most important infrastructure project in Australia's history. It is vital to the way we will provide health services, deliver a world class education and build a strong and growing economy.

Under Labor, 93% of homes and businesses were to receive a superfast version of the NBN that uses fibre optic cable to deliver speeds of up to 1 gigabit per second. Instead, Tony Abbott's Liberal Party is building a network that creates two classes of Australians –those fortunate enough to have received the super-fast Labor NBN and those who are stuck with the second rate Liberal NBN. Unfortunately residents of Eden-Monaro who live outside of Queanbeyan or Googong- including those in Jerrabomberra- will be getting big ugly green cabinets and unreliable copper to the home because they are under the Liberal NBN. And, while Labor’s plan included connection to C3

On Thursday 3 September, the General Manager recommended the Right of Way (ROW) for vehicle access entitlement for 12 Malbon Street over the land between it and 14 Malbon Street be removed from the contact of sale. The recommendation was considered by the Council in closed session, but it is likely that it was adopted. The Council also publicly agreed to remove the ROW or vehicle access from 14 Malbon Street for the same stretch of land at the owner's request. This means that neither property will now be able to use the land for vehicle access and the potential to use the area as a quasi-road will no longer exist. This has huge positive implications for Bungendore.The development process for 14 Malbon Street has highlighted unexpected difficulties in the change of use requirements set by Council for heritage buildings

It was fortunate that members of the BRG purchased the property with the intent of protecting its heritage, and despite the ongoing development issues, the cottage will continue to be restored and will be an asset to Bungendore’s commercial and tourist precinct. It was fortunate also the BRG were vigilant enough to identify a ROW or vehicle access had been included in the contract of sale for 12 Malbon Street and Council was formally asked that it be removed. When the process is complete, this will result in further protection of both properties from the potential negative impact a ROW would have had. The BRG appreciates the support and input of Councillors in assisting to resolve the entire ROW issue. Have your livestock got Fluke? Press Release The liver fluke is a flatworm that infects a wide range of animals including sheep, cattle, horses, rabbits, wallabies and even humans. The adults live in the bile duct and feed on blood, which can lead to chronic disease and impairment of performance, but greater impacts are usually seen from the damage caused by the immature flukes developing within the liver. The liver fluke has an indirect life-cycle that includes a snail intermediate host in addition to the final mammalian host. Adult worms lay up to 50 000 eggs each day. The eggs travel with the bile into the intestine and are released into the environment with the host animal’s faeces. If an egg is deposited in a suitably wet area, a swimming larva (miracidium) will develop and hatch out (after about 21 days in ideal conditions). The miracidium searches for a suitable snail host (only certain species

within the family Lymnaeidae). The larva penetrates the snail and a series of three asexual reproductive cycles is completed before up to 4000 larvae (cercariae) are released. These larvae swim away from the snail and encyst on vegetation just below the water surface. This encysted stage (metacercaria) is infective to livestock and can remain viable for many weeks when conditions are suitable. Following ingestion by a suitable host, the parasite burrows through the wall of the gut and into the liver. It migrates around the liver for about seven weeks as it grows and then emerges into the bile duct where it matures, mates and starts laying eggs about eight to ten weeks after ingestion. The worms can potentially survive for about a year in adult cattle and up to eight or nine years in sheep. The good news is we can control Fluke. Testing for fluke is important. Using chemical treatments at optimum times and choosing the right product for your situation. Also fencing off wet areas, can help break the lifecycle of the Fluke. Angie Angel The big Arts story of the year is that Carwoola artist, Kerry McInnis, was a finalist in the 2015 Archibald prize with her portrait of Omar Musa, the MalaysianAustralian rapper and poet from Queanbeyan. Of about 850 entries, Kerry’s pensive and thoughtful portrait, titled ‘Omar Musa– the poetry of unease’ was to make the finals and will be on display with the 50 or so chosen others at the Art Gallery of NSW until 27 September. Kerry said, “As a fan of hip hop, I thought it might be appropriate to portray Omar in a marginalised role of counter-culture advocate. I painted his portrait listening to his rap albums and included phrases from one of his poems, ‘Blood C1

poetry,’ graffitied onto the stairs of his apartment. His cat’s name is Sinbad.” But the other, equally prestigious but more lucrative Australian National portrait prize, the Doug Moran, is coming up, and Kerry was this last week putting the last finishing touches on a second, but slightly different portrait of Omar, in order to

He has released three hip hop albums, two poetry books, appeared on ABC’s Q&A, and received a standing ovation at TEDx Sydney at the Sydney Opera House. His first novel, ‘Here come the dogs,’

was published in August 2014, and was long-listed for the 2015 Miles Franklin Literary Award.” Kerry McInnis has been a family friend of the Musas for many years. Husband and wife team, sculptor Mike McGregor and painter Kerry McInnis have been very active at their Carwoola home and studio. Mike is working towards an exhibition at the Belconnen Arts Centre this month and almost exactly a year ago the couple had a combined show at the M16 Art Space in Canberra with paintings and sculptures inspired by a trip to Antarctica.

One of the paintings from ‘Colour Light Space’ Press Release Bungendore local Kate Bender graduated from the ANU School of Art in 2014. She is a painter whose practice is in abstraction, primarily concerned with an expression of her deep love and sense of connection with colour. Colour Light Space is an exhibition of oil paintings that explore the expression of colour, the representation of light and the ambiguities and perceptions of space through abstraction and the numerous forms of contrasts employed within. These vibrant and colourful works on canvas combine elements of illusionism with pure abstraction, resulting in a degree of playfulness in the immediate visual and aesthetic experience, alongside a deeper philosophical and metaphorical reading of the works. On first impression these paintings are energetic and dynamic yet

they also have a contemplative quality, encouraging the viewer to spend time with them. The intriguing and ambiguous descriptions of space and the multidirectional representation of light create a sense of uncertainty, the viewer’s perception is questioned. Hard edges, dynamic angles, defined structures and spaces contrast with soft forms, blurred boundaries and expressions of light, forms of solid colour contrast with soft areas of subtle shifts of colour. Forms emerge and dissolve, moments of clarity contrast with indistinct traces of presence. DISTRICT WEATHER Lovelock-Fay in Tour de Korea PALERANG THIS WEEK'S FORECAST

Bungendore rider Mitchell Lovelock-Fay (front) riding for the Avanti team in the Tour de Korea Mick Fay Bungendore cyclist Mitch Lovelock-Fay, along with his team mates from Avanti Racing Team, recently headed over to South Korea to compete in the Tour de Korea 2015, a UCI 2.1 on the Asian Tour. Twenty teams and 120 cyclists faced the heat and generally flat terrain. The 2015 Tour was raced over eight stages, with riders racing 1249 kms in total. Avanti Racing Team, Orica GreenEdge, Drapac, Tabriz

Petrochemical, Malaysian and Korean National Teams were just a few of the teams who lined up to battle out who would take the overall win, as well as the Best Team classification. The Tour saw the riders race stages through Busan, Gumi, Muju, Yeosu, Gangjin, Gunsan, Daejeon and finishing up for the final circuit stage in Seoul, where racing was centred around the Seoul Olympic Park. At one point, the Seoul stage was in danger of being

cancelled due to the MERS outbreak. The majority of stages ended up with bunch sprints at the finishing line, which meant the Tour was really a sprinters tour. Mitch and his team mate Fraser, went to Korea knowing that they would be riding in a support role for team mates, and in particular the sprinters Bevin, Van der Ploeg and Giacoppo. Day in and day out, Mitch and Fraser would follow attacks, or be seen to be riding the front of the peleton either

together or one at a time with riders such as Jens Mouris and Leigh Howard from Orica GreenEdge, in order to bring back breakaways that had been allowed to get away as the game of cat and mouse was often played. Stage 1 was marred by crashes coming into the final sprint and Avanti sprinter, Bevin was taken out along with Caleb Ewen of Orica Greenedge. Avanti rode superbly to podium in the remaining stages while also taking the win by Bevin in Stage 4. This was a fantastic result not only for Bevin, but for the entire team and brought Bevin right up as a definite contender for the overall winner. Avanti fought hard over the remaining stages to ensure that Patrick remained in second place, with the final result being Caleb Ewen from Orica GreenEdge claiming the Tour win and Pat Bevin finishing in second, beaten by only 0.00.04 seconds. Avanti Racing Team won the Best Team Classification, which was an awesome result up against Orica GreenEdge and other international professional continental teams. Their results were: Stage 2/ 2nd, 5th & 7th Stage 3/ 2nd Stage 4/ 1st Stage 5/ 2nd & 7th Stage 6/ 3rd Stage 7/ 2nd Stage 8/ 2nd The overall results for the Avanti team were: (2nd) Bevin and (7th) Van der Ploeg. Avanti’s mantra is that “team work wins races” and they couldn’t have had a better result than what they achieved in Korea. Mitch’s next big Tour is Tour of China 2 which will be held in October.

Furthermore the winter sports have all concluded and what a splendidly athletic lot we Palerangians are! The Tigers, Tigerettes, Mudchooks, netball and basketball players

are all finishing the season on top– or very close to it– of their respective competitions. Well done! And isn’t it good to see little Jarryd Hayne, the former Tigers water boy, getting a run with the San Francisco Under 9ers. pack over summer in case of spontaneous combustion. There are, of course, those heady perennial sports of which golf is one. And so it came to pass that on Sunday 6 September, fired up by the recent victories of Australia’s very own Jason Day, a number of this healthy Shire’s golfers gathered at the Hall for the Wamboin Spring Trophy sponsored by Joan and Lofty Mason who provided sustenance and prizes. Our thanks to both. It was a crisp, partly cloudy day with many of the neighbouring ACT’s floral emblem in bud or, indeed, bursting forth. It moved local clergyman, the Rev Tom Gray to suggest that they might be “wasting their sweetness on the desert air” but we told him to suck it up and not to waste his own energy in a country churchyard. Our sponsors declared it a three-club day with stroke play to determine the outcome. And off into the mountain scrub we flew, as district journalist A B Paterson so cleverly put it. Afterwards, around the fire back at the Hall the Googly Ball was again awarded to Helen Locke for putting her second shot on Hall NTP into the bonfire when the rest of her foursome
