By Marian SAMPSON SEVEN mature trees on the Bridal Trail between Dutchman’s Beach and Nelson Bay have been marked with yellow crosses.

This vandalism is causing community concerns after a large tree at the Bagnalls Beach Reserve was recently marked with a yellow cross and was subsequently cut down.

Landcare member Roz Armstrong told News Of The Area, “I became aware of these trees through the Landcare network, several trees have been marked with a yellow cross and we are unaware as to why these trees have been marked at this point in time.

Hideaway Drive, Salt Ash, following reports a white Ford Ranger utility had hit a tree.

Officers from Port Stephens-Hunter Police District attended along with NSW Ambulance paramedics and located a male driver suffering a fatal gunshot wound.

He was later identified as 45-year-old David King.

A short time later, officers located a burntout white Santa Fe located on Masonite Road, Heatherbrae, which police believe is allegedly linked to the shooting.

Detectives established Strike Force Breve to investigate the incident, with assistance from State Crime Command’s Homicide Squad.

“Investigators have been working around the clock since 29 August, and this week, we’ve made some significant arrests in regards to the incident,” Commander Chad Gillies said.

On Friday 5 November 2021, two men – aged 27 and 39 – were arrested and charged.

They are currently before the courts.

Following further inquiries at 9am on Friday 12 November 2021 police arrested a 26-year-old man at Grafton Police Station.

He was charged with murder, take/ detain person in company without to obtain advantage, possess shortened firearm (not pistol) without authority and

aggravated sex assault- offender in company with other person/s.

Police will allege in court that after shooting David King, the men fled the scene in a white Santa Fe, where the 26-year-old man allegedly sexually assaulted a woman in the car without her consent.

The car was then allegedly set on fire and destroyed.

The 26-year-old appeared in Grafton Local Court last week where he was refused bail, to reappear in Raymond Terrace Local Court on Monday 20 December 2021.

AN inquest into the death of a Port Stephens First Nations man who died falling eight metres whilst trying to escape custody has understood that correctional staff treatment contributed to the man’s avoidable death.

NSW Deputy state coroner Elaine Truscott heard that Wiradjuri man Bailey Mackander was taken to hospital in November 2019 after reportedly swallowing batteries and razor blades.

Mr Mackander died after escaping custody, climbing over a concrete barrier and falling eight metres.

“There has been quite a large tree with another yellow cross on it on Government Road that has been brought down.

“When the community gathered to draw attention to these trees they have had no response from the Council as to what is happening.”

Roz believes that Council is letting the community down by not notifying the community in advance as to what's happening and giving concerned locals a chance to say something.

“I think it is part and parcel to do with all the transparency issues that are happening at the moment we don't know what's happening in our community.”

Roz would like to see a simple notification in the newspapers advising the community why these trees or trees in the future are scheduled for removal before they're removed.

Sue Olsen from Nelson Bay West Landcare Group and Econetwork Port Stephens told News Of The Area, “When I see a tree with a large yellow cross - it's alarm (sic) - it's destined for removal.

“We've seen that with the yellow cross tree that's on Government Road that was recently cut and we don't know why, on the weekend when we saw these trees marked we emailed various Council officers and they've got back to us saying that they don't know why these are marked and they're trying to get to the bottom of it, so it is of great concern as to why these things are happening.

“It’s a credit to Council that on this occasion that they're looking into it, but we've been disappointed with the number of trees that have come down in different places… we moved here because we love a green tree scape and that's been repeatedly lost through developers and not enough

“Of course the trees do more than provide us with shade.

“The roots actually stabilize and the hollows provide homes for wildlife.

“Now the biggest trees have gone and these younger trees don't have as many hollows or the right size necessarily for wildlife and we see aggressive birds like Lorikeets occupying those hollows at the expense of other less aggressive birds such as the Eastern Rosellas that are pushed out which is actually changing the biodiversity of the area.”

Sue Olsen said she had been told Council are unable to find any scheduled works for these trees and that Council is continuing to search and to get to the bottom of it In the meantime members of the community are imploring anyone that hears a chainsaw in the vicinity of the trees to immediately contact Council and their

Tomaree Ratepayers and Residents Association said, “The TRRA and Econetworks has taken up the wider issue of tree policy with Council; we sent a letter to them back in September and we're waiting for a response before we take it any further but we're very concerned about the whole issue of trees, tree lopping or tree removal on public land because there's just been too many instances recently of major materials coming down for no apparent reason and we think Council needs to really have a review of the whole tree management policy.”

In the meantime the fate of these trees is in the hands of the community reporting any vandalism, as there is no known or justified reason for their removal.

Port Stephens Council erected signage stating that the trees had been vandalised however the signs were removed in just two days.

FOR Leah Anderson, the decision to run for Mayor on Port Stephens Council came from a desire to see a community better served by its elected officials.

As most of us do, she and her family feel blessed to live in Port Stephens.

We enjoy a wonderful environment, an enviable lifestyle and we all have the opportunity to contribute to our community.

That is something Leah Anderson has been doing locally for 16 years.

Leah Anderson told News Of The Area, ”I have been proudly serving our community for the past sixteen years in the following roles; founder, and President of Port Stephens Women In Business - a successful Women's Networking Group that is still going strong to this day; Chair of Nelson Bay Town Management for two years when I was the local Bank Manager at Westpac Nelson Bay; President of Business Port Stephens for four years, helping the organisation transition from the Tomaree Business Chamber to the entire LGA of Port Stephens;

Director for Port Stephens Tourism for two years, working with the team to deliver the new branding ‘Port Stephens Incredible By Nature’; and I have been a koala carer at Port Stephens Koala Hospital for almost three years.”

On top of this Leah has been an active Rotarian for eleven years, and has previously served as President of the Salamander Bay Rotary Club and is currently serving as the Club’s Vocational and Youth Director. q

Meet Andrew Cole: Candidate For Port Stephens Council

ANDREW Cole has decided it is time for a change.

While some of us are prepared to vote with our feet, Andrew has put his hat into the ring for the people of Port Stephens to consider voting him onto Council as their community representative.

Andrew grew up in the Manning Valley and he and his wife have settled in Port Stephens, raising their three children.

The Area, “We spent twelve years living in Raymond Terrace, then moved to a property in Glen Oak. “Over the years I’ve worn many hats work wise as a farmer, truck driver, tradie, stay at home dad and now small business owner.

“After considerable requests from a few family members I decided to put my hand up to run for Council.

“I believe the main thing is that we as a community examine the people we elect to represent us.

“I think as an area we have to expect better from our Council, the people from West Ward are looking for the area not to be forgotten, there have been a lot of promises and no action or substance and meaning behind the words.

“There needs to be engagement for services, delivery on roads and communications and transparency on what is being done in the region.”

FOR locals there’s not much of a need to introduce Giacomo Arnott, he’s known as the young Councillor that fights for the underdog.

Giacomo has spent the last four years on Council, often in opposition to the majority of sitting councillors.

Giacomo has been a West Ward Councillor on Port Stephens Council since September 2017, when he won the highest number of votes in the ward at his first election and became the youngest person ever elected to Port Stephens Council at 23 years old.

Giacomo is a professional Firefighter with Fire & Rescue NSW, having served with them for nearly five years and currently the Deputy Captain at the Raymond Terrace unit.

He has two degrees – one in Business and one in Law. He has worked as an

JASON Wells is known to locals around Medowie through his volunteer work at Medowie Little Athletics and for his role at Medowie Public School.

For Jason, being a part of the community is about building bridges and partnerships.

Partnerships with parents and community organisations and building trust with students.

Jason is now running for a Central Ward councillor position on team Leah Anderson in the upcoming Port Stephens Council elections.

Jason Wells told News Of The Area, “I have worked for sixteen years in my local NSW public school as a dedicated and trusted classroom teacher.

“Over that time I have

built strong partnerships with parents and community organisations in the pursuit of providing quality education outcomes for all students.

“I have a particular interest in collaborating with nonprofit community groups to the betterment of a child’s education and preparedness for adulthood.”

Jason's work with local youth doesn’t stop at the school gate.

For the last five years he has held the role of President of Medowie Little Athletics Centre.

“I thoroughly enjoy engaging with the local community, especially where community spaces are activated and improved.

“I have worked collaboratively with local government to build

Kindlebark Oval into a quality sporting facility.”

In fact you will often find Jason out marking lines on the oval and encouraging our local youth as they train.

ROZ Armstrong is running as a candidate for Port Stephens Council in East Ward.

She is second on Leah Anderson’s ticket and could potentially take a seat on Council based on primary votes for Anderson as well as her own votes.

Roz is a keen environmentalist participating in her local Landcare Group and is a citizen scientist participating in the NSW Water Watch program; she also sits on local environmental committees.

A Soldiers Point resident, Roz arrived in ‘the Bay’ in 1979 where she opened a coffee shop and her children went to local schools.

She was an active member of the Chamber of Commerce and a Director of Harbourside Haven.

“I was very disappointed when Giacomo Arnott’s motion to have low cost housing included in The Ingenia Boardwalk did not get a seconder,” she said.

Representing the Liberal Party in the Local Government Election, Matt is partner to existing Councillor

and Management.

He also has a Diploma in Financial

He is a qualified financial planner and has a Bachelor of Business from the University of Newcastle where he majored in Human Resources

Affirmative Consent Bill

THE Legislative Assembly of the NSW Parliament has taken a significant step in passing a Bill which requires consent to be actively sought and obtained before engaging in any sexual activity.

Member for Port Stephens Kate Washington addressed the Assembly, speaking of its necessity and importance.

“Many people have known this for a long time and have been pushing for change for years because for too long, women have been let down by the law,” Ms Washington said.

Right now only a small number of sexual assault cases even reach those courtrooms in the criminal justice system and of those cases that even make it to that point where charges are laid and aggresses are held to account, only 1.5% of sexual assaults result in a conviction.

“Survivors of sexual assault, be they women, men, or transgender people need to be able to find justice in the system.

“The bill before us today is a step towards much needed welcome change,” Ms Washington said.

Changes include a positive obligation to ascertain consent prior to a sexual activity and revoking of consent and the point that consent is not everlasting.

“Under these changes, there is no consent if the

person does not, within a reasonable time before or during the time of the sexual activity, say or do anything to find out whether the other person consents to the sexual activity, the concept of consent is expanded in both a positive and negative sense.

“Under this bill, consent is when someone freely and voluntarily agrees to this sexual activity, it can be withdrawn at any time and if sexual activity continues after consent being withdrawn, it is not consent.

“If consent is given in regards to a particular sexual activity, it's not necessarily consent to another sexual activity.

“Consent given to a person on one occasion is not to be taken as consent with that person on another occasion,” Ms Washington said.

The Bill aims to recognise that there is no consent if a person does not say or do something to communicate consent, and that there is no consent if someone does not have the capacity to consent.

The Bill also proposes changes to the Criminal Procedure Act 1986 to introduce five new directions about consent for judges to give juries at a trial.

“These changes are designed to try to overcome the bias against victims and survivors, as identified by the New South Wales Law Reform Commission.

“Essentially what we're doing here today is trying to legislate respect,” Ms Washington said.

It is now up to the Legislative Council to pass the Bill for ‘Affirmative Consent’ to become the law in NSW.

FOR carers across the region, COVID lockdowns have been particularly difficult.

Isolation when dealing with a loved one's illness and demise can be heartbreakingly lonely.

The Port Stephens Parkinson’s Support Group had not been able to have a function since June 2021 due to lockdown and Stay at Home orders.

However, as the restrictions eased, the group has at last been able to recommence their program of events.

These activities are so important for people living with Parkinson’s.

Remembrance Day Around Port Stephens

By Marian SAMPSON AT the going down of the sun and in the morning we will remember them.

Australia as a fledgling nation sent her sons to war.

WWI took so many Australian lives that nearly every town and outpost in the nation sadly remembers the losses from their community.

Even Indigenous Australians, ineligible to vote at the time, fought in the Great War, the war to end all wars.

Every year we turn out and remember that on the eleventh hour of the eleventh day of the eleventh month the guns stopped and the war was effectively over.

We honour those who died not just in WWI, but WWII, Korea, Vietnam and Afghanistan, and every war where the citizens of this nation have served.

Last Thursday, communities across Port Stephens gathered in Remembrance.

Port Stephens Councillor Chris Doohan attended a Remembrance Day Service in Medowie and told News Of The Area, “On the eleventh hour of the eleventh day of the eleventh month, we will remember them.

“Lest we forget.

Cr Doohan quoted a piece of writing from an unknown author.

“To understand a military veteran you must know: we left home as teenagers or in our early twenties for an unknown adventure.

“We loved our country enough to defend it and protect it with our own lives.

“We said goodbye to friends and family and everything we knew.

“We learned the basics and then we scattered in the wind to the far corners of the earth. q

“We found new friends and new family.

“We became brothers and sisters regardless of colour, race or creed.

“We had plenty of good times, and plenty of bad times.

“We didn’t get enough sleep.

“We smoked and drank too much.

“We picked up both good and bad habits.

“We worked hard and played harder.

“We didn’t earn a great wage.

“We experienced the happiness of mail call and the sadness of missing important events.

“We didn’t know when, or even if, we were ever going to see home again.

“We grew up fast, and yet somehow, we never grew up at all.

“We fought for our freedom, as well as the freedom of others.

“Some of us saw actual combat, and some of us didn’t.

“Some of us saw the world, and some of us didn’t.

“Some of us dealt with physical warfare, most of us dealt with psychological warfare.

“We have seen and experienced and dealt with things that we can’t fully describe or explain, as not all of our sacrifices were physical.

“We participated in time honoured ceremonies and rituals with each other, strengthening our bonds and camaraderie.

“We counted on each other to get our job done and sometimes to survive it at all.

“We have dealt with

fun at the other branches.

“We know however, that, if needed, we will be there for our brothers and sisters and stand together as one, in a heartbeat.

“Being a Veteran is something that has to be earned, and it can never be taken away.

“It has no monetary value, but at the same time it is a priceless gift.

“People see a Veteran and they thank them for their service.

“When we see each other, we give that little upwards head nod, or a slight smile,

victory and tragedy.

“We have celebrated and mourned.

“We lost a few along the way.

“When our adventure was over, some of us went back home, some of us started somewhere new and some of us never came home at all.

“We have told amazing and hilarious stories of our exploits and adventures.

“We share an unspoken bond with each other, that most people don’t experience, and few will understand.“We speak highly of our own branch of service, and poke

knowing that we have shared and experienced things that most people have not.

“So, from myself to the rest of the veterans out there, I commend and thank you for all that you have done and sacrificed for your country.

“Try to remember the good times and make peace with the bad times.

“Share your stories.

“But most importantly, stand tall and proud, for you have earned the right to be called a Veteran.

Blockade Australia halts coal trains

By Tara CAMPBELL AT 6am on Tuesday 9 November, the first member of Blockade Australia halted coal trains headed towards the Newcastle Coal Port, the largest coal port in the world.

Zoe, 20, was suspended twenty metres up an electrical pylon from 6am, hanging on a rope tied to a monopole on the rail bridge that provides all access to the port.

This was the second of multiple actions last week which started on Monday 8 November, which have shut down operations on the world’s biggest coal port to get in the way of the extractive

Australian project.

Zoe is expected to be arrested as a result of causing hours of disruption to the functioning of the port, an integral piece of Australia’s economy.

“Australia is a death cult driving global climate collapse.

“This is a call for people to get in the way of it - most people on this continent want change but Australia doesn't, so we need to do it ourselves with direct action like this,” they said.

For over seven consecutive days Blockade Australia has halted coal trains headed towards Newcastle Coal Port, the largest in the world.

Coffee Pod Recycling Trail

RESIDENTS of Stockton can now join in on a project being conducted to recycle aluminium coffee pods.

An Australian-first pilot program will allow 3,000 households in Newcastle to recycle aluminium coffee pods through their kerbside bins.

Households participating in the Curby Coffee Capsule trial will receive a specially designed bright orange bag to collect their used aluminium capsules, which they can then place in their kerbside recycling bins for collection.

City of Newcastle joins Mosman and Willoughby Councils in Sydney to be the first Australian councils to trial the scheme, which is being run by Australian recyclers iQ Renew and CurbCycle.

The trial will provide vital insights to help inform the development of a national coffee capsule recycling scheme, which is being developed in collaboration with Planet Ark. City of Newcastle Manager of Waste Services Troy Uren said the trial would add to the suite of waste-recovery initiatives in Newcastle, which are all designed to reduce the amount of rubbish going to landfill.

"A survey of more than

500 Newcastle residents last year found 98% felt it was important to divert waste from landfill," Mr Uren said.

"City of Newcastle already has a number of well-received waste-reduction initiatives and is in the process of researching and designing its new generation recycling collection systems, which include the development of a new Materials Recovery Facility at the Summerhill Waste Management Centre.

A key pillar to this approach is identifying key partners in the industry, which will allow us to offer innovative and flexible services to cater for changes over time in what and how we recycle.

"With the introduction of the Curby Coffee Capsule trial, we're pleased to offer residents an opportunity to become involved with another innovative solution to increase resource recovery at the kerbside."

Paul Klymenko, Planet Ark CEO congratulated the City of Newcastle for taking part in the program.

"It is great to see this trial occurring and we want to thank all the collaboration partners for making this possible," Mr Klymenko said.

"By providing their communities with the

additional option of kerbside collection it will allow more people to recycle their coffee capsules and contribute to creating a circular economy."

Under the ‘Curby’ trial, the capsules will be separated from other recycling at iQ Renew’s Materials Recovery Facility at Somersby and transferred to the existing Nespresso recycling system in NSW for separating into coffee grounds and aluminium.

From here, the aluminium will go to aluminium producers, saving 95% of the energy required to source aluminium from scratch, with coffee grounds going to local commercial compost. iQ Renew CEO Danial

Gallagher said the trial shows the community's desire for new kerbside recycling solutions using the yellow lidded bin.

"The trial is proving that we can harvest the Curby bag containing aluminium capsules at the recycling facility," Mr Gallagher said.

“The number of the bags received at the MRF during the trial so far has been very encouraging and we look forward to receiving even more volume from City of Newcastle households.”

Port Stephens Community Arts Centre Reopens

MEMBERS of the Port Stephens Community Arts Centre are celebrating the centre and gallery being reopened after the COVID-19 lockdown.

In spite of the inconveniences that Covid regulations imposed, there were many positive comments, and expressions of delight, as members returned to their creative sessions.

Meryl Miller of the Port Stephens Community Arts Centre told News Of The Area, “On Monday 18 October, under the strict Covid regulations, the door to the Westralia Room swung open.

“Our masked members were back with their paints and canvases ready to face the 'new norm’, creating and enjoying community and friendship.”

There have been a lot

of chores to get done to ensure the Centre remains COVID-Safe.

“Our craft rooms are fully stocked with innovative creations made during lockdown.”

The Gallery opened to visitors on 1 November.

COVID Marshals will be on duty for the first few weeks, to support the Gallery volunteers and deal with any problems.

There are plans to open the weekend Café around mid-January.

“Our Christmas Hampers raffle tickets will be available from the gallery on 10 November.”

Currently on exhibition at the gallery is ‘What’s On Your Plate?’ in the main gallery until 14 December, featuring all things deliciously edible – realistic, interpretive or futuristic.

“Come and see how our artists have interpreted this theme.

“The annex will be filled with handmade Christmas craft items from 10 December where you will find plenty of great stocking stuffers.”

The Port Stephens Community Arts Centre Board has welcomed two new members voted in at the AGM on 14 September.

They are Secretary, Louise Leddie and Melanie Delaney, Director for Group Liaison.

“They both bring great

skills and energy to the Board and have had to hit the ground running this past week!” said Meryl.

“We thank Robyn Killen for devoting endless hours of her time volunteering at the Art Centre.

“We are so lucky that Robyn took up art and that she has shared her passion for art and her leadership skills for the benefit of our community!

“Colleen Sessions, Group Leader Director as well as Occupational Health and Safety also stepped down from the Board.

“Thanks to Colleen for her hard work and improvements implemented during her two terms on the Board,” she said.

Members of the centre are happy to be welcoming the community back to enjoy the art that their 300 members create.

Port Stephens SES The Port Stephens SES Unit have been hard at work over the last week, been retraining, working on specific skills for storm training.

This included ladder work, stabilisation with props, walking on roofs, tar taping and lashings.

Motor Vehicle Theft Over the last week, the Port Stephens-Hunter Police District recorded seventeen thefts from motor vehicle offences.

Detective Superintendent Chad Gillies discussed this.

“Our Crime Prevention Officers and Crime Prevention Unit have been engaging with tradies at a number of Bunnings Warehouses across our district, including Maitland Heatherbrae and Taylors Beach.

“Our main goal has been engaging with our community providing information and education around securing your possessions,” Commander Gillies said.

Vehicle owners are reminded to lock and secure vehicles, utes and trailers, as well as ensuring that valuable tools, equipment and possessions are not left out.

Scams It’s Scam Awareness week and Crime Stoppers are bringing awareness through the TALK acronym.

The number one way you can prevent scams is by talking about them.

T: Talk to your friends, family, neighbours, colleagues about a scam you’ve come across, and share information.

THE Nelson Bay Croquet Club’s Annual General Meeting was held at Nelson Bay Bowling and Recreation Club on 10 November 2021.

Despite another difficult year due to COVID, the annual reports indicated a successful year both financially and competitively for the Club.

In tournaments that were able to be held, Club members had done well both in State competitions, including two State titles, and in local club carnivals.

The Club’s Constitution requires that half the 8-person committee stand-down each year, with officers elected for a 2-year term commencing on 1 January each year.

The positions to be elected for 2022 were President, Treasurer, Club Captain and Ordinary Committee Member. David Wilson was reelected as President with Jan Puckeridge (Treasurer), Rae

The Constitution also limits officers to two consecutive terms of 2-years, so Liz Friend was required to stand-down and not seek re-election after two very successful terms as Treasurer.

President David Wilson formally thanked her for her outstanding contributions to the Club.
