Love vs. science This week the Supreme Court of the United States listened to arguments on Proposition 8, which banned same-sex marriage in California in 2008, as well as the federal Defense of Marriage Act, enacted in 1996. It’s likely the court won’t hand down a decision until June, which means months of speculation on how exactly the judges will rule.

In the meantime, legal experts and pundits are already speculating that Roe v. Wade, which in 1973 established a woman’s constitutional right to a first-trimester abortion in the United States, may impact the ruling.

By not allowing states to rule individually on abortion, the Supreme Court ultimately complicated the process, argues John C. Eastman, the chairman of the National Organization for Marriage and a law professor at Chapman University.

Eastman told The New York Times that the “lesson [the Supreme Court judges] should draw is that when you are moving beyond the clear command of the Constitution, you should be very hesitant about shutting down a political debate.”

Actually, no.

Regardless of one’s feelings on Roe v. Wade, one of the main reasons abortion remains a contentious issue isn’t just for so-called moral values, but because people—lawyers, scientists, theologists, et al.—continue to debate when, exactly, a life becomes viable.

When it comes to love and marriage, however, there’s no need for science unless we’re discussing the physical chemistry that attracts two people to one another.

For legal guidance, the Supreme Court need look no further than its decision in Loving v. Virginia, the 1967 case that invalidated all state laws outlawing interracial marriage.

Marriage is an issue of civil rights, not science—with only the most technical of parallels to Roe v. Wade.

The decision should be easy.

Homelessness is not a choice

Re “Cat and ‘river rat’ game” by Dave Kempa (SN&R Frontlines, March 14): Park ranger David Henry doesn’t feel sorry for most of the campers, who he thinks gets lots of services. He thinks “their lifestyle is a choice.” Some more likely choices that unsheltered homeless people make letter of the week are: choosing not to commit crimes in order to pay rent, choosing to escape a violent domestic situation, choosing to not stand in the line for a shelter known to have 200 people on the waiting list, choosing to not complain of their situation and appear proud, choosing to not be separated from loved ones.

Homelessness is caused by the lack of housing, not by people choosing to be homeless. Give every unsheltered homeless person a key to their own room or apartment to prove my point.

Public has right to know Re “Tuesday night live!” by Nick Miller (SN&R Frontlines, March 21): This article, regarding restoration of the three-minute rule for speakers before the Sacramento City Council, exhibited a lack of understanding of how city business is currently conducted by the city council, which is far removed from the way it was conducted 20 and more years ago, when the city was quite efficient and quite effective, and had no fiscal problems.

First, thanks to Gov. Jerry Brown, open government has been gutted in California by removing funding for the [Ralph M.] Brown Act and the California Public Records Act. The amount of money involved doesn’t buy paper clips for the state. This evisceration of the public’s right to know has gone almost unnoticed in the press. Government without public input and oversight is government out of control.

Second, a large number of very complicated public-policy issues will come before the Sacramento City Council in the coming months, and highly technical matters take more than 120 seconds to lay out, especially when one must effectively refute and debunk “facts” rendered by a city staff which, at times, has had its own agendas.

Thirdly, city staff has been known to leave out important facts or distort them in staff reports. In the early 1980s, I led the drive to save the 1850s E.B. Crocker mansion from city plans to demolish and replace it with a tilt-up concrete structure.

We were able to prove the city staff engineering report was absolutely not true in public testimony before the council, and the mansion is now restored. ...

Only through public testimony can these abuses be put before the city council and the public. It is important that the council and the public be aware that staff reports should not be blindly accepted as

accurate and complete. This also can spur city staff to render only the best work, as was the general course in decades past.

Why pick on BarWest?

Re “A trivial pursuit” by Nick Miller (SN&R Midtown&Down, March 14): Being a resident of Midtown, I can tell you that I knew what I was getting myself into by moving into this part of the city. With the J and 28th streets block having bars and music venues for over the last 20 years, I find it hard to believe that the residents had no idea of the situation that they were moving into. I have been frequenting the restaurants, bars and music venues on this block for the last eight years and think it’s very unfair to target BarWest for violence and crime. I have witnessed firsthand countless altercations and excessive drinking at every venue on that particular block.

Also, [I’m] confused as to why there is uproar regarding BarWest’s application for an entertainment permit. Blue Cue, Harlow’s [Restaurant & Nightclub] and [The Momo Lounge] have live music and deejays, so I find it a little concerning that the local residents would have a problem with another venue having the same permit that three other venues on the same block already have. When you have six restaurants, bars, clubs and music venues compressed into a one-block radius, it seems only logical that one would not be surprised to see violence or crime from time to time. It seems as though the Marshall School/ New Era Park Neighborhood Association has unfairly chosen one venue to crucify for the proverbial sins of all of the venues located on the J and 28th streets block.

Goal keepers Local soccer team rescues women from addiction, homelessness It’s a Sunday afternoon, and Angelina Lowney is sitting, sweating in the bleachers next by to a soccer field at the Mather Sports Dave Kempa Complex. Just a few hundred yards away stands the building in which three d a vek@ newsr evie w.c om years ago, the 37-year-old mother of five decided to abandon her meth habit and clean up once and for all.

Her younger children chase one another across the field as she rests, exhausted from an afternoon of spirited practice.

“For me, joining the team was about being able to show [my children] something different, and being accountable,” she says. “I was addicted to methamphetamines. But I also am addicted to street life. Gangs, drugs, money. All that kind of stuff.”

Today, she is clean.

Lowney plays for the Sacramento Lady Salamanders, one of six street-soccer teams across the nation geared toward helping homeless women transform their lives. Here in Sacramento, the program is taking on a style and energy all its own.

It has grown into an outfit dedicated to serving women as they recover from both homeless situations and addiction, teaching them to respect and care for each other while also providing a safe haven and outlet for their children.

The Lady Salamanders Initiative functions as part of Street Soccer USA, a program started in North Carolina in 2004. Over time, founder Lawrence Cann independent has expanded his program to 20 cities reporting for this across the country, with the Sacramento story is funded by a grant from Mohawks team coming to town in 2009.

But as SSUSA grew and men’s Sacramento emergency Foodlink. participation expanded, volunteers found women’s participation in decline.

Sacramento was no exception.

“It started to expose more and more that these women needed their own space, a safe place,” says Sacramento Lady Salamanders’ coach Tiffany Fraser. Many of the women coming to practice, Fraser says, often carried several children in tow, and others were formerly mired in abusive relationships.

With this in mind, Fraser and the team’s other coach, Lisa Wrightsman, started the women’s-only offshoot of the city’s Mohawks team two years ago, and last December, they officially took up the name of Sacramento Lady Salamanders.

Sacramento’s women’s street-soccer team is unique. It is the only team of its kind in the nation solely consisting of BEFORE

which almost always includes members of the Mohawks men’s team, as well as any number of the women’s 30 or so children.

They are currently preparing to play other homeless women’s street-soccer teams in the West Coast Cup next June in San Francisco. After that, they hope to raise enough funds to bring the team to New York City and compete in the national finals, held in Times Square. They also plan to send one or two players to represent the United States in the Homeless World Cup, held this year in Poland.

Lowney refers to life on the streets for women as “degrading.”

“Now, I’ve learned to develop these relationships with these women and to appreciate them. Not try to beat them up or degrade them. I love them. It’s different.”

Lowney, also president of the Serna Village transitional-living community, was hospitalized last month due to complications associated with a lung condition, developed from smoking cigarettes and meth. And while her teammates came to the hospital with a soccer ball and held practice with her there, running through the hallways, still hooked up to the IV, Lowney says she was determined to get back on the field and be with her team on the day they tried out the new inflatable court.

“I don’t have time to lay around and be sick,” she says.

In the end, coach Wrightsman says, it’s about self-worth. “A lot of it is about having a purpose,” she says, “having something to give to somebody else.

What those outside the Sacramento bubble say about the city’s new arena proposal When Kevin Johnson tweeted this past Saturday afternoon that, finally, an arena deal was struck, he also posted a photo: the mayor, talkby Nick Miller ing on the phone, pumping his fist in the air.

Local Sacramento Kings fans took the bait and ni c k a m @ began tweeting their own photos mimicking ne w s re v i e w . c o m the mayor’s move. Quickly, it was trending.

An online meme was born: “#KJing.”

Indeed, for Kings fans and City Hall brass, Saturday was all about back patting, kudos and “selfie” pics. Later that evening, a couple dozen members of a pro-arena group called Crown Downtown cheered at a press conference announcing the Kings plan. This latest “term sheet,” which city council was sure to greenlight this week (SN&R went to print on Tuesday before the scheduled vote), would develop a $448 million “entertainment and sports complex”—with the city kicking in nearly a quarter-billion dollars—plus upward of 1.5 million square feet of new housing, retail, a hotel and office space on and near the Downtown Plaza mall site.

Tale of two deals

City leaders and supporters say the nonbinding agreement protects taxpayers and the general fund, is an improvement over last year’s pact with the Maloofs, and—in addition to the city’s other lobbying efforts—will surely persuade NBA owners to keep the Kings in Sacramento.

Meanwhile, critics of the term sheet, many outside the Sacramento bubble, are baffled.

Some reaffirmed that Seattle still has a far better deal—for both the NBA and the Emerald City’s taxpayers—and that Sacramento taxpayers are getting, well, screwed.

The city of Seattle, for instance, is only paying for 25 percent, or $125 million, of its $490 million arena; Sacramento will foot 58 percent, or $258 million, for arena construction.

A bigger sticking point, however is how the two cities plan to finance their contributions.

Sacramento cobbles its nut together with $38 million in land, including the 800 block

of K Street, which will be given to the investors, plus $212.5 million in bonds, which are backed by future revenue from its parking cache. More than $9 million of this parking money goes toward the general fund each year; city brass say that parking revenues, ticket surcharges and at least $1 million in arena profit-sharing will backfill the generalfund loss.

If the numbers don’t add up, though, Sacramento will have to tap into hotel-tax revenue. So, basically, taxpayers will be accountable for the deficit.

In Seattle, however, it’s a different story.

As writer David “Goldy” Goldstein wrote on The Stranger’s blog last Monday, Seattle will pay off its bonds with new arena revenue—and, if there’s a shortfall, investors Chris Hansen and Steve Ballmer are “contractually obligated to make up the difference.” Taxpayers are off the hook, unlike in Sacramento.

Other Seattle reporters (no surprise) were quick to point out the Sacramento deal’s disadvantages.

Chris Daniels, with Seattle’s KING5 TV, reminded that Hansen/Ballmer are much further along. The arena-financing was approved in October 2012, and the city’s design board has given it preliminary approval, too.

He also noted that Seattle’s unemployment rate is now 5.9 percent, while Sacramento’s hovers above 10, which draws into question this city’s revenue projections, since they are based on ticket surcharges and parking dollars during Kings gameattendance heyday.

Many Sacramentans’ beef with the new Kings arena proposal is, again, the city subsidy to pay for construction. They altogether disprove of a public dollars being used to pay for an arena; as SN&R contributor Cosmo Garvin has reported in the past, a telephone poll last year by EMC Research found that 51 percent of those queried did not want a publicprivate arena partnership (see “Poll shows Mayor Kevin Johnson not invincible”; SN&R Frontlines; February 2, 2012).

Eye on Sacramento, a local watchdog group, argued that the actual Sacramento contribution is upward of $334 million if you count revenue from digital billboards and free parking spaces.

Even those who can stomach multimilliondollar public subsidies, however, questioned the math in this year’s term sheet.

Specifically, he argued that the city’s strategy to take out $212.5 million in bonds, via forming a nonprofit corporation to oversee its publicly owned parking spaces, to pay for part of its share is very risky and still leaves the Sacramento vulnerable to revenue shortages, which would force it to dip into its general fund. “The only way the city could magically pay for everything using parking revenues ‌ is if the arena itself more than doubles the amount of money the city earns from each of its downtown parking spaces,â€? he concluded.

Councilman Steve Hansen, whose district would house the proposed new arena, wrote on Facebook on Monday that more time to dissect the plan is needed, and that the city “should have at least until Thursday to decide,� which would have given everyone five days.

If, a few weeks later on April 18, the NBA shoots down the Seattle investors’ bid, which includes a binding contract to purchase the Kings and move them to the Emerald City (they’ve already given the Maloofs $30 million as a deposit), then the Maloof family has the option of selling to the Sacramento investor team.

If this does happen, supporters will be KJing in the streets. Opponents, however, will be preparing for lawsuits and referendums. Ί

Small = glorious Why can’t Europe-adoring vacationers bring a lesson home?

I find it fascinating that so many people from Sacramento and elsewhere across the United States love going to Europe, by Todd Walton because so much of what used to be a writer, musician and true about America is still true there. longtime contributor Small towns, little farms, ancient to SN&R ways of life ongoing; cities with crooked streets, winding roads, trains going everywhere; all kinds of different kinds of people and ways of living and existing side by side; so many people walking and riding bicycles and buying bread at local bakeries, every loaf unique.

Lovely shops and bookstores and villages, old picturesque churches, little museums and art galleries, and fabulous food found in marvelous pubs and cafes and restaurants and inns, no two alike—richness and diversity!

Why don’t these people, some of them my dear friends, make the connection between where we buy things and the ongoing ruination of America and the world?

Then, these millions of Europeadoring people come home to the United States and shop at big-box stores and chains, because why pay $1.49 for that can of tomato sauce at your neighborhood grocery store when you can get the same can of tomato sauce at Walmart for 99 cents? Why pay $14 at your local bookstore for the same book you can get on Amazon.com for 30 percent less? Why shop at your local stationery store if you can get 500 of those same-sized envelopes at Office Depot or Staples for practically nothing?

And these Europe-loving folk never seem to make the connection between the way they buy things in Europe and what they love about Europe—variety, surprise, depth, small, unique, locally grown, fresh!

Nor do they connect the way they buy things in America and what they hate about America—sameness, blandness, stale, shallow, plastic,

made somewhere else. Why, I wonder, don’t these people, some of them my dear friends, make the connection between where we buy things and the ongoing ruination of America and the world? Perhaps because we have become so enslaved to convenience and the illusion of paying less for more, that to admit our actions are the cause of the problem and then change our behavior would be too painful for us, too inconvenient, too costly.

After leaving my Sacramento home, I made my way to a new home in Mendocino on California’s coast, a popular tourist destination largely because there are no chain restaurants, no big-box stores, no Starbucks or McDonald’s or Taco Bell adorning the bluffs overlooking the mighty Pacific Ocean. The houses and storefronts are old and quaint, relatively speaking, and to fully enjoy the town and discover her secret charms, one must walk around. Imagine. The best way to experience the European feel of the few square blocks in Mendocino is to leave the car behind and stretch those legs. What a concept! I actually think walking around, that act alone, is a big part of what people like about coming here.

“Paris!” countless people have said to me. “We walked everywhere!

It was glorious.”

“England! They have trains and buses that go everywhere. So many wonderful villages and small towns and winding country roads.

Glorious!”

“Holland! We walked and rode bicycles everywhere! And the cheese! The bread! Glorious!” Ditto Sweden, Spain, Italy, Germany, etc.

So, the next time you pull into Walmart or Staples or Costco, any of those places you go to save a few bucks, think about the Buddhist idea that we are the owners of our own karma, that we create our happiness and unhappiness through our actions and the choices we make, both as individuals and collectively. Then we might better understand that choosing to shop locally at one-ofa-kind stores is how we can help create a happier and more interesting reality right here at home. Ω

If you count measures Q and R from 2006, it’s safe to say voters flat-out hate arena subsidies.

“If the council is fixated on this subsidy, they should give the public an opportunity to vote it up or down,” says Patrick Soluri, a local attorney fighting against the subsidy and pushing for a public vote on any arena plan.

Sure, it’s still a long shot that the NBA owners will approve the sale of the Kings to the team of local whales—nixing what appears to be a solid offer from a group of Seattle investors. But if that happens and the Sacto whales strike a final, legally binding agreement with the city, then expect a campaign from Soluri’s group or someone else to gather signatures and put the plan to a referendum in a special election.

The main problem with Soluri’s group is that it won’t say where it gets its money.

Is it Seattle money? Soluri just says, “It’s a purely local coalition. All of the money is local, and we are pursuing local goals.”

Soluri is a land-use attorney. In fact, he once represented the Westfield Group, recent owners of Downtown Plaza, in challenging the city’s plans to develop the downtown rail yards. Coincidence? How do we know he’s not getting money and support from some other local development interest, pursuing their own angle?

We don’t, and that will be a point for arena supporters to attack. But that doesn’t mean a referendum isn’t a good idea. Mark Paul, a former Sacramento Bee opinion writer, former California deputy state treasurer, and co-author of the great book California Crackup, makes an eloquent argument for a public arena vote on his blog, The California Fix. “The referendum is about holding a conversation,” he wrote. “Our representatives make decisions and through the referendum we voters tell them whether they got it right, or should go back and try again.”

Sounds reasonable. Healthy, even.

Sacramento citizens have been trying for some time to tell City Hall they don’t like arena subsidies and have other priorities for public money. Ultimately, they may resort to the referendum in order to be heard. Ω

by CoSMo G and the rushed vote, it’s clear that the cosmog@ newsrev iew.c om proposed arena plan has some major risks. As you know, it diverts about $9 million in public-parking money away from the general fund and into a newly created parking authority to pay the bonds for a Kings arena.

The money is supposed to be backfilled by several sources, the biggest being a 5 percent ticket surcharge, which the city estimates will bring in $3.7 million a year.

That same number was used in last year’s arena deal with the Maloofs. The team owners hired Beacon Economics to assess the plan, and Beacon blasted it, noting the revenue projection is based on rosy attendance numbers from years ago, way above what Sleep Train Arena is currently drawing in.

You can object that Beacon’s analysis was paid for by the Maloofs, who wanted out of the deal, anyway. But it’s at least as trustworthy as any of the glowing economic reports you’ll see generated by the mayor’s Think Big Sacramento organization.

A more conservative estimate would count on current attendance, but then the deal wouldn’t pencil out.

Another $3 million will be generated by a little maneuver described thus in the city’s term sheet: “The Public Parking Financing model will be structured in such a way to provide $3 million annually to backfill the City’s portion of the General Fund revenue.”

Short a few mil? Just “structure” your model to spit out more money. No further explanation needed. It appears that the plan is to borrow a little extra when the bonds are issued and to use that to partially pay back the general fund. It’s basically borrowing money to pay for cops and other basic services, at least in the early years.

But don’t be nervous: Later on, the parking system is supposed to generate a lot more revenue—what with all the revitalization going on. But a lot of things have got to go right; otherwise, this thing blows a hole in the general fund.

Bites doesn’t get the impression that the public is clamoring to get this deal done.

Past polls done of city residents have indicated everything from apathy to antipathy for public participation in any arena scheme.

No to hate Two recent acts of violence in the region have us pondering the legendary Rodney King question: “Can we all get along?”

It was Sunday, March 17, when two young men attacked a man in his 40s at 20th and D streets in Midtown. One made anti-gay slurs while the other clobbered him in the leg with a baseball bat. The victim’s name was not released. And as of press time, the assailants have not been found.

This incident was shocking, especially since it happened only a week after a brutal anti-gay attack in Davis. On March 10, Lawrence “Mikey” Partida, a 32-year-old Davis resident, was jumped and beaten bloody and savagely for being gay. Police arrested a 19-year-old Davis resident on suspicion of this crime; an arraignment is set for April.

The incidents herald back to 1998, when Matthew Shepard, a gay 21-year-old student from the University of Wyoming, was tied to a fence, tortured and left in a coma to die. Shepard’s tragic death sparked a national movement to extend hate-crime legislation to protect gays and lesbians.

But the law has not yet removed the hate.

In Davis, 300 people showed up at a candlelight vigil held a few days after the assault on Partida. The victim, still in recovery, felt cheered up by the gathering and also when his mother read to him the hundreds of support messages posted on the Mikey’s Justice Fund Facebook page. “I never thought I’d be that big of a movement,” he said.

But you are and should be, Mikey. Local hate crimes like the Midtown and Davis ones should not be tolerated.

Silence is not an option. We must all unite around a resounding no to hate. Ω

Predatory practice The practice of payday lending—where short-term loans are offered at sky-high interest rates to people who run short of cash before payday—has been getting more scrutiny these days. It’s about damn time. The industry has always been an exploitative one because it tends to snare those (especially low-income and young people) who don’t understand that high-interest rates are likely to trap them in a never-ending cycle of debt.

Increasingly, state governments have attempted to shield people from these lenders by imposing caps on interest rates or by banning the practice outright. Fifteen states now have bans—California is not one of them, though it has placed limits on loan amounts. Unfortunately, Sacramento has more payday-loan storefronts than most cities in the state.

Recently, we’re seeing a new development in this saga: Payday lenders have increasingly been setting up shop online from bases in the Bahamas or other foreign locales.

As recently revealed in The New York Times, major banks—like Bank of America, JPMorgan Chase and Wells Fargo—have actually helped these Internet-based lenders do a regulations runaround by allowing online payday lenders to tap borrowers’ checking accounts regardless of state rules or bans.

Early this month, Assemblyman Roger Dickinson, now chairman of the Assembly’s Committee on Banking and Finance, held information hearings on the subject. Good questions were asked; much was revealed about a business in need of serious inquiry. Let’s hope the hearings lead to closure of unlicensed online lenders, a clampdown on the banks that have been aiding and abetting them, and more scrutiny, in general, on this predatory practice. Ω

CEQA needs reform because it doesn’t address threats on the environment posed by climate change

The state Legislature adopted the California Environmental Quality Act more than 40 years ago. But today, anti-growth activists are now using the landmark environmental law to stymie projects that would help fight climate change.

In the past few years, a consortium of business and some labor groups in California has pushed for sweeping reforms of the law. And this year, they hope to convince legislators in Sacramento to overhaul it. They already have a powerful ally in Democratic Gov. Jerry Brown.

As mayor of Oakland, Brown witnessed firsthand the use of CEQA to block smart growth and has called reforming the law “the Lord’s work.”

Although many environmental groups recognize that CEQA is sometimes misused, they staunchly oppose the most recent calls for reform out of fear that the law will be gutted. They correctly note that CEQA still plays a vital role in protecting California’s numerous endangered and threatened species, and provides an important check on suburban and rural growth projects, highway expansions, and 16 | SN&R | 03.28.13

proposals for new refineries and fossil-fuel power plants. Over the years, CEQA also has helped protect low-income communities from toxic incinerators and landfills.

From that perspective, the law does not need to be overhauled. But there is ample evidence that it does need reforming, particularly when it comes to smart growth and transit-oriented development.

“It has gotten in the way of projects that arguably should be considered environmentally sustainable,” noted Jeremy Madsen, executive director of Greenbelt Alliance. “Climate change has changed the whole game.”

Indeed, the numerous threats posed by climate change prove definitively that aspects of California’s signature environmental law are woefully out-of-date.

According to a 2009 report from the U.S. Environmental Protection Agency, the nation’s transportation sector produces 28 percent of all greenhouse-gas emissions in the country, and that figure rises to as much as 40 percent in some states, including California.

According to a 2010 UC Irvine study, rural and suburban residents in California consume up to nearly three times as many gallons of fossil fuel each year as city dwellers.

CEQA is the least of Sacramento’s problems Mother Nature or the almighty dollar—what’s the bigger obstacle to smart growth in Sacramento?

Listen to the rumblings from under the Capitol rotunda dome, and you’d surely finger the environment and, specifically, an oft-tossed four-letter word: CEQA. For the acronym averse, it stands for California Environmental Quality Act, or the state’s oldest law protecting the Earth’s goods. Basically, CEQA makes it mandatory for local governments to evaluate a project’s ecological impact well before a shovel ever hits dirt. The law keeps the air and water clean and emissions to a minimum, and restricts noise and traffic, among other protections.

Lately, though, a bipartisan contingent says that CEQA victimizes smart growth—a sustainability-minded catch term for high-density, mixed-use, walkable and transit-friendly urban development. CEQA lawsuits stall projects for months, even years, which can cost developers hundreds of thousands of dollars, critics argue. Sometimes, the law discourages lenders from financing certain projects altogether. Now, these groups want to see the law not just tweaked, but reformed.

The catch is that here in Sacramento, CEQA is but an anthill when it comes to the undulations that forestall smartgrowth development.

A more real culprit: money, money, money.

“It’s financing,” explained Bay Miry, developer with D&S Development, who specializes in urban-redevelopment projects such as the 700 block of K Street downtown and 1409 R Street (the building with Shady Lady Saloon and Magpie Cafe). “It’s always the toughest obstacle, making sure the lenders that are out there believe in those type of projects.”

Smart growth is a relatively new concept to banks and lenders. Previously, moneymen weren’t confident that sustainable urban-infill projects could be profitable. And, until the last 15 or so years, cities and local groups like the Sacramento Area Council of Governments didn’t include sustainability goals in their general plans or blueprints.

But many say the pendulum is now swinging, and banks are starting to grasp that smart growth is a new wave.

“Lenders are starting to really see the movement that more and more generations … want to live in the urban core,” Miry said.

So, urban-infill projects are moving dirt in Sacramento. La Valentina, a mixed-use residential-retail complex located at a light-rail stop, opened this past summer. The 7th & H Street Housing Community for lower-income residents opened late last year. And “netzero” luxury apartments 16 Powerhouse complex should break ground this May. But that’s hardly the 45,000 units worth of residential housing that was either in the pipe or being built in the region some 10 years ago, according to Mike McKeever, SACOG’s executive director.

“In the near term, the economics of development of all kinds are very, very severely challenged,” is how he put it.

This steep, wild decline and subsequent bumpy ride is not just the economy’s fault, either. “The abolishing of the redevelopment program in the state has taken away, at least for now, a very critical part of what helped those projects work,” McKeever reminded.

Over at the Capitol, however, there’s little discussion of the future of redevelopment and more movement to sate the anti-CEQA contingent’s thirst.

Earlier this year, for instance, Democratic state senator from Bakersfield Michael Rubio kicked off the legislative session with big chatter about exempting local agencies from CEQA review. He argued, essentially, that cities and counties today boast sufficient environmental protections as part of their general plans, so CEQA in many ways is redundant.

Rubio spent years building coalitions to reform CEQA. He had business and labor interests in his corner. 2013 was going to be the year the decades-old law lost its teeth. But then Rubio resigned from the statehouse—to go work for Chevron Corp.

Critics erupted at the chutzpah of his departure, and this unexpected move has stalled talks of significant CEQA reform. For now.

Still, some 20 bills that would pinch CEQA remain in the mix this session.

“Environmental law”continued from page 16 And while many Republicans still claim that climate change is a hoax, a new study released earlier this month revealed that global temperatures are higher now than at any time in the past 4,000 years.

Even Wall Street is betting on the fact that climate change is going to unleash serious impacts on the environment. Recently, Bloomberg Businessweek reported that Wall Street hedge funds and other firms are pumping loads of cash into financial ventures that hope to profit from the severe effects of global warming.

But CEQA, because it was adopted more than four decades ago, is not designed to adequately address the multiple threats on the environment posed by climate change.

Many smart-growth projects, for instance, do not receive proper credit for supplying housing close to jobs so that people can walk, bike or take mass transit to work. Instead, the law, and the anti-growth activists who use it to block smart growth, still treat all development—be it urban, suburban or rural—as essentially the same.

“The fact that development can be done that is environmentally beneficial is a new paradigm,”

noted Madsen of Greenbelt Alliance, which supports modest reforms to CEQA to encourage more smart growth.

According to a recent study by the law firm Holland & Knight, 59 percent of the development projects challenged under CEQA in state appellate courts or the California Supreme Court from 1997 to 2012 involved infill development. In addition, the prospect of spending years in litigation sometimes prompts developers to just give up on their projects—which is exactly what people often referred to as NIMBYs (short for “not in my backyard”) want to happen.

“The law has become so dysfunctional,” said Jennifer Hernandez, an attorney for the Holland & Knight firm, who advocates for broad reforms of CEQA. “To call this environmental protection anymore ... it’s really about quality-of-life” issues.

Although CEQA was patterned after the National Environmental Policy Act, it has unique characteristics. Similar environmental laws in other states only allow bona fide environmental groups to sue to block development, said Hernandez.

But that’s not the case in California.

Here, virtually anyone can file a

lawsuit under the state’s primary environmental law.

California also does not require transparency. Groups who sue to block development do not have to disclose the identities of their members or who funds them, Hernandez said.

The numerous ThreaTs posed by climaTe change prove definiTively ThaT aspecTs of california’s signaTure environmenTal law are woefully ouT-of-daTe. And sometimes, businesses just do it openly. The CEQA Working Group, a coalition of business and labor organizations that wants to broadly reform the law, has been chronicling instances in which CEQA has been

misused. One example involves the owner of a San Jose gas station, Andy’s BP, who filed a CEQA lawsuit in 2010 against his competitor across the street, Moe’s Stop gas station, because the owner of Moe’s wanted to add three gas dispensers to his business. The owner of Andy’s BP cited “traffic impacts”—and won in court, forcing the owner of Moe’s to conduct a full-blown environmental impact report.

Ultimately, the owner of Moe’s completed the EIR and installed his gas dispensers. But the whole process cost him $525,000 more than it would have had he not been sued.

“That’s not allowed in any other state,” Hernandez said of environmental lawsuits filed by one business to block a competitor’s project.

California legislators, however, are unlikely to change the law to require transparency in CEQA lawsuits or limit the filing of them to environmental organizations. The reason, Hernandez explained, is that unions sometimes file CEQA litigation—or threaten to do so—when a project does not guarantee that it will employ union labor. As a result, there’s no appetite in the Democratic-controlled Legislature “for even requiring disclosure,” Hernandez said.

Before he resigned last month to take a job with Chevron Corp., Michael Rubio, a moderate Democratic state senator from Bakersfield, had been leading the charge for a sweeping overhaul of CEQA. But Rubio’s reform proposals were not limited to smart growth in cities, and likely would have paved the way for more suburban and rural projects as well. Understandably, many environmental groups responded with concern.

Senate President Pro Tem Darrell Steinberg is an advocate for smart growth and is expected to take a more cautious approach to reform now that Rubio is gone. Steinberg is the author of Senate Bill 375, a landmark climate-change law enacted in 2008 that is designed to increase urban density in California. Nonetheless, several prominent environmental groups, including the Sierra Club and the Center for Biological Diversity, still oppose the push for CEQA reform this year out of concern that the Legislature will render the law toothless.

However, fears that the Legislature will gut CEQA this year appear to be overblown—precisely because some environmental and labor groups (the labor community is divided over whether to reform the law) fervently oppose such a plan. It seems far-fetched to believe that Democrats will vote for proposals that substantial portions of their two main constituencies don’t want.

And that’s a good thing. CEQA still has a vital role to play in protecting our environment, as it should. One would be hard-pressed to make a case for reforming an environmental law so as to green-light more suburban development or more pollution-causing projects.

California also still needs environmental protections in urban areas for industrial projects that put people’s health at risk.

But for urban centers and areas on or near major transit corridors, there’s still plenty of room for reform. City dwellers who don’t want more traffic in their neighborhoods shouldn’t be able to use the state’s main environmental law to block projects that actually help the environment overall.

And this misuse of the law likely won’t stop as a result of incremental reform. Instead, the only sensible solution is to exempt all smart growth— urban transit-oriented development projects that are designed for housing or a mix of retail or commercial space and housing—from CEQA lawsuits.

The primary environmental law should protect the environment against the greatest threat it faces—climate change—and not make it harder to implement solutions that help fight that threat. Ω A longer version of this story was published in the East Bay Express; read it at www.eastbayexpress.com.

It won’t get a push until next year, according to those inside the building, but Steinberg’s bill would surgically streamline certain CEQA projects and financially incentivize local governments to update their smart-growth plans.

Steinberg and others call this the modernizing of CEQA, and it’s not a new effort.

SACOG even helped pass Senate Bill 375 last year, which accomplished similar smart-growthfriendly goals. And the year before that, the senator passed a law that gives the governor power to cherry-pick blue-chip projects for CEQA exemptions (the proposed new Sacramento Kings arena, for instance, might qualify for such immunity).

“We need to take advantage of the opportunity to improve and strengthen this great law by making the process more efficient, timely and effective,” Steinberg said in a written statement.

Environmentalists argue that these and other CEQA bills are less prudent, or unnecessary.

Republican state Sen. Tom Berryhill, for instance, introduced Senate Bill 787 last month; critics say it would offer carte blanche for exemptions and make it easier for municipalities to greenlight sprawl and polluting projects.

Meanwhile, the irony is that urban developers aren’t too worried about CEQA. “The nice thing about doing urban infill is that there aren’t a lot of environmental issues,” Miry responded, when asked if the law was an impediment.

Indeed, a 2012 survey by Gov. Jerry Brown’s Office of Planning and Research quizzed 540 state planning departments and discovered that infrastructure constraints, lot issues, a lack of funding or bad economy and NIMBYs were the biggest deterrents to urban infill. CEQA was 12th on this list of concerns.

So, while modernizing the state’s oldest environmental protection law will continue, Sacramentans want to see a focus on other priorities—such as persuading investors, reviving redevelopment, and updating city and county codes.

“The real challenge,” McKeever said, “is doing things fast enough to catch this next economic wave.” Ω

Before the band starts, local promoter Jerry Perry breaks in to remind the audience to move in closer and to, again, up the noise level—louder, more enthusiastic, more energy.

It’s not typical for Perry, who’s been booking bands in town since the ’80s, to prod the audience, but this is no ordinary performance; rather, it’s the first taping of Alive & Kicking TV, a new Access Sacramento cable show that he co-produces with Jim Bailey, a television crew member at the Sacramento-based media-production company.

The show’s inaugural episode aired in January, and in the months since, the pair has learned that staging a television show comes with a unique set of considerations. For example, during the recording of that first episode (which also included singer-songwriter Parie Wood and the band Walking Spanish), Perry instructs a cameraman to be sure to zoom in tight enough to make the audience look like a packed club—the kind of thing he never had to think about while booking regional or touring acts.

SCENE& HEARD “We’re trying to create good TV, and it’s different than a good concert. It’s not like a regular show, deliberately so,” Perry says. “[During the shoot, we] were really manipulating shots to have a good energy to them. I would tell the bands, ‘Oh, could you stand here?

Don’t stand there.’ Just ridiculous directions, like, we had applause signs.”

The operation for each show is usually the same: Each episode is filmed using three or four cameras— tripod-mounted and handheld. In between performances, Perry and Bailey scramble to conduct interviews with the artists, the results of which will be interspersed between live shots once the final episodes are assembled.

The process is sometimes a bit chaotic, fitting perfectly with that anything-goes late-night-cable vibe, really.

“We’re trying to squeeze as much out of the moment as we can. We’re trying to get a lot done in a finite chunk of time. I want it to feel like we [just] went in and shot this band, but in reality, while we were shooting one band, we were interviewing another,” Perry says.

Before the shoot, the two set up a custom audio feed with Bailey placing microphones around the room to capture the ambience of The Refuge.

“Everyone involved worked very hard. Jerry’s doing a really great thing for local music with the show,” Barringer says.

Perry, of course, has been supporting the Sacramento music scene since the early ’80s, when he first started promoting shows at venues such as the Vortex and, later, the Cattle Club. At the Cattle Club in particular he placed a heavy emphasis on local bands, booking Sacramento acts in the opening slots for big names such as Nirvana, NOFX, Weezer, the Cranberries and No Doubt. Back then, he says, if a band’s manager didn’t want a regional act on the bill, he simply wouldn’t take the show.

In 1991, Perry launched a music-related newspaper, also called Alive & Kicking, which published on and off for 17 years. Not surprisingly, the paper’s focus was local, with Sacramento bands dominating the cover. The paper folded in 2008, but even before its demise, Perry says he’d been thinking about branching out into other mediums.

“I wanted to do TV, but I wasn’t sure how,” he says.

And then, Perry met Bailey. The two first encountered each other a couple years ago at one of Perry’s events. Bailey had been attending shows regularly, taping artists he liked and then cutting the footage together for

There are only 90 minutes to go on this particular Sunday before Crossroads packs up its guns, gear and glory, and moseys on to its next show. A Huntington Beach vendor with a leathery bosom bemoans the nine-hour drive ahead of her to Southern California. On her table lay the remnants of her biggest seller: a $2 paper target of President Barack Obama made to look like a ghoulish, green zombie. “You gotta have at least one Obama,” she chirps. I buy one for my editor, who’s not really into guns or political assassinations, and then go hunting for myself.

As sleepy-eyed vendors stare into space, the crowd wanders the pavilion and jams the line to purchase ammo.

A man in a floral shirt talks up surgical-elastic handgun holsters that slide down the front of your pants. Now that crotch-bulge can make babies and obliterate them. “I have a hard time convincing women to buy those,” he admits.

At another table, a tubby vendor strokes a .45-caliber Glock. “Oh, I’m not selling that one,” he explains. “That thing has more sentimental value than my old lady.”

It wouldn’t matter. These guns are all way beyond my price range. A Colt Single Action Army revolver with a buttery handle is priced at $5,200. Even a single-shot pistol tinier than my palm is $200. I wander past tables cluttered with action figures, electrode hand massagers, an exploding SpongeBob SquarePants piñata, toy swords, real knives with comfy grips (for your stabbing pleasure) and all kinds of firearm-related minutiae only a true gun nut could appreciate.

I finally spot a man selling a simple, wood-handled rifle so ancient and rickety it looks like it went to school with George Custer’s gun. Even this black-powder boom stick is $180, but because it’s more than 50 years old, the state requires no paperwork on it. It’s untraceable. I wonder why there aren’t more gang shootings involving muskets.

I scurry to find an ATM and ask my editor whether the paper will let me expense a gat. You know, for journalism. I am repeatedly shot down.

So, this is what it feels like to have one’s Second Amendment rights trampled upon. Meh, I’ll live.

“I’m not booking these bands because they’re the popular thing in town; it’s because I think they’re good. ... I’ve got to be able to say, ‘I like these guys. I’m not embarrassed to have them on my show.’”

During the shoots, however, Bailey typically isn’t in the club with Perry. Rather, he and the remainder of the crew are stationed inside the Access Sacramento van— essentially just an old recreational vehicle that someone donated to the station. The vehicle’s been gutted and turned into a mobile television studio with monitors, audio equipment, a switcher and everything else needed for recording. Here, Bailey typically works the audio, while the director watches the monitors and gives the cameraman directions via headsets.

Ultimately, the performances, taped over the course of a couple hours, yield three episodes—one per band.

It’s all a lot of work, considering that there’s no money in it for Perry or Bailey—or the bands. This is, after all, public-access television. The first season, shot through late 2012, produced 12 episodes, and the pair hopes to shoot 20 episodes for the second season, set to start production later this year. The new episodes will be taped at Harlow’s Restaurant & Nightclub, according to Perry.

All the acts are local, but moreover, Perry says, they fit a particular consideration.

“I’m not booking these bands because they’re the popular thing in town; it’s because I think they’re good.

They just have to be bands that Jim and I like,” he says.

“We’ve got to be able to stand by it. I’ve got to be able to say, ‘I like these guys. I’m not embarrassed to have them on my show.’”

The Kelps’ lead singer Cory Barringer says he found the experience rewarding.

Now, neither Perry nor Bailey remember whose idea it was initially to work on a TV show, but at some point, it dawned on Perry to use the Alive & Kicking name.

“It’s got some branding, and it gives people an idea of what we’re about from the get-go,” Perry says.

Their working relationship proved copacetic. Perry had the connections with the bands and could set up shoot days at The Refuge, while Bailey brought not just technical expertise, but also a crew of friends and co-workers willing to volunteer.

Now, they say, part of what makes filming in a club such as The Refuge so appealing is that they maintain total control. Eventually, the team hopes to expand beyond live music—perhaps adopting some of Perry’s regular Alive & Kicking newspaper features, such as accompanying a band to the drive-in theater for a movie review or, similarly, eating with musicians at a local greasy spoon.

“The idea of taking that to a TV level, that would be really fun, do segments like Entertainment Tonight programs, but that’s very ambitious,” Perry says.

The Hideaway fills a niche that Sacramento might not have known it lacked: It’s got a vague rockabilly vibe, with a lot of greased hair on the men, brightly dyed hair in retro styles and cat-eye glasses on the ladies, and an abundance of black H clothes and tattoo sleeves for all.

A burger with an excess of salt (it’s topped with both salty bacon and salty blue cheese) keeps a perfectly medium-rare burger just short of excellence. A meaty veggie burger (one of three veggie sandwich options) gets crunch from fried pickles and sweet heat from barbecue sauce. The fish sandwich is more like a crunchy batter sandwich with a little bit of fish, but the dill tartar sauce brings the whole thing together. The juicy slabs of breast in the fried-chicken sandwich are dripping with a spicy, vinegary hot sauce that tingles the taste buds, and just enough coleslaw.

Estelle’s offers an espresso bar and a wide assortment of teas and muffins and rolls for the breakfast crowd as well as sweets, including DayGlo macarons. For the lunch-inclined, there are soups, salads, sandwiches and meat or meatless quiche. One of the authentic touches is the spare use of condiments. The smoked salmon is enlivened by dill and the flavor of its croissant. Its tomato bisque is thick and richly flavored, and, in a nice touch, a puff pastry floats in the tureen as accompaniment. Grange Restaurant & Bar You won’t find any “challenging” dishes on this menu—just delicious local and seasonal food such as the Green Curry & Pumpkin Soup, which has a Southeast Asian flair. A spinach salad features ingredients that could be considered boring elsewhere: blue-cheese dressing, bacon, onion. But here, the sharply cheesy buttermilk dressing and the woodsy pine nuts make it a salad to remember. Grange’s brunch puts other local offerings to shame. The home fries are like marvelously crispy Spanish patatas bravas.

Midtown 24K Chocolat Cafe This cafe, located in a labyrinthine Spanishcolonial-style structure that also houses meditation classes, a gift shop heavy on the crystals and clowning workshops, serves a solid, if very limited, brunch and lunch menu. One offering is a firm wedge of frittata with a strong tang of sharp cheddar that almost but doesn’t quite jibe with the slightly spicy mole sauce on the plate.The spinach curry, made creamy by coconut milk rather than dairy, comes topped with cubes of tofu and tiny diced scallion and red bell pepper and rests atop a smooth potato cake. A side of garbanzo-bean salad is well-flavored with the surprising combination of mint and apricot. The place, located inside Ancient Future, has “chocolat” in the name, and chocolate is everywhere: for sale, along with tea and coffee in the small boutique area, and in the form of truffles plated on a side table. It’s also in many of the menu offerings, including a tiny cup of hot Mexican drinking chocolate, and chocolatecherry scones served crisp and hot, studded with big chunks of bittersweet chocolate and tart dried cherries. Hook & Ladder Manufacturing Co. The restaurant, by the same owners as Midtown’s The Golden Bear, sports a firefighting theme (a ladder on the ceiling duct work, shiny silver wallpaper with a ratand-hydrant motif, et al) and a bar setup that encourages patrons to talk to each other.

An interesting wine list includes entries from Spain and Israel; there are also draft cocktails and numerous beers on tap.

The brunch menu is heavy on the eggs, prepared in lots of ways. One option is the Croque Madame, a ham-and-Gruyere sandwich usually battered with egg. This one had a fried egg and béchamel, with a generous smear of mustard inside. The mountain of potato hash alongside tasted flavorful and not too greasy. The menu also features pizzas and house-made pastas, but one of its highlights includes an excellent smoked-eggplant baba

charcuterie board is more like a groaning board, stocked with abundant regional meats and cheeses. The pickle plate looks like Peter Rabbit’s dream, all teeny turnips and tangy carrot chunks.

These days, a business owner can’t just put 8 million beers on draft and expect brew lovers to come sprinting through the doors. The Yard House model is done. Even in suburban Sacramento, where two relatively new beer destinations are making their mark. Final Gravity (9205 Sierra College Boulevard in Roseville) leads the charge: It specializes in American beers, with an emphasis on local (Track 7 Brewing Co., Knee Deep Brewing Co., Berryessa Brewing Co., Auburn Alehouse).

This is changing, though, as I recently saw a bottle of Freitgeist gose by one of my new favorite breweries outside of Cologne, Germany, on Final Gravity’s Facebook page. Boneshaker Public House (2168 Sunset Boulevard, Suite 104 in Rocklin) plays a similar American-ale game, with beers by Allagash Brewing Company, The Bruery and Ballast Point in regular rotation.

Arden/ Carmichael El Pollo Feliz For a restaurant dubbed “the happy chicken,” El Pollo Feliz sure smokes a lot of birds. These chickens get one heck of an afterlife: Their parts are rubbed with earthy Mexican spices and then slow-cooked in a smoker for hours. Their flesh becomes

fall-off-the-bone soft and infused with an aromatic wood-chip flavor. The restaurant’s signature dish is barbecue chicken, and customers can purchase wings, breasts, drumsticks and thighs in a variety of amounts—from as few as two to 12 pieces. An eight-piece combo is basically an entire chicken. You can also order it covered in a chocolatey and peppery mole-poblano sauce; shredded and scattered atop a plate of nachos; on top of a salad; inside a torta-style sandwich; or stuffed into a burrito.

There’s a friendly neighborhood vibe here, and much of the cooking happens in the parking lot directly in front of the mom-and-pop joint.

Land Park/ Curtis Park Pangaea Two Brews Cafe Tables, tall and short, are large and communal, fostering that casual camaraderie that should be the goal of any selfrespecting brewpub. There’s a fairly extensive menu, including breakfast items.

Not to put too fine a point on it: Pangaea’s offerings are not beers that will be found at a Save Mart Supermarket or even Nugget. They are nuanced. Brewed with artisanship. In some cases, for hundreds of years. There’s the usual panoply of French dip, hot pastrami, Reuben and so on. Among the signature offerings is The Gobbler.

Turkey, natch. Cranberry sauce, natch. Then red onion, several roma tomato slices, a thicket of green leaf and pepper jack cheese, all shoehorned into a big baguette.

Jin Men The restaurant bills its itself as Chinese, but it actually specializes in KoreanChinese food. The most popular Korean specialty dish is its ja jang myun, based on the Chinese dish zhajiangmian (fried noodles with sauce). Jin Men’s rendition is made with little squares of chewy pork and tiny shrimp mixed with lots of sweet sautéed onions and slightly salty black-bean paste. This addictive dish is served in a bowl just the right size to keep all to yourself.

The jambong is a spicy seafood soup nicely spiked with chili and perfect for curing a cold. Chinese-style offerings include mu shu chicken and a ho-hum vegetable fried

Yippee for Yogurtland Sacramento already has plenty of fro-yo places: Yogurtagogo, Mochii Yogurt and Yummy Yogurt Cafe, to name a few. In January, the city saw the addition of the Irvine, Calif.-based chain, Yogurtland (2381 Fair Oaks Boulevard, Suite 5). The company also plans to open nine more franchised locations in the Sacramento area in the next few years, according to a press release. This might be bad for other yogurt businesses, but not for customers.

Prices at Yogurtland (currently 35 cents per ounce) are less than most of the other stores. Plus, it offers approximately a dozen flavors, which rotate regularly; copious fresh-fruit topping options; and a bright, ultramodern interior. With more Yogurtlands (and warm weather) on the way, local yogurt shops will need to step up their game to compete. Salvaged swank Bunker’s Attic Way before Macklemore & Ryan Lewis advocated rocking your Grandma’s coat, 45-year-old Missippi transplant Vicki Bennett has been turning old-timey bits and baubles into jewelry for the fashion-forward set. It all started back in high school, when she and her best friend came across a trove JEWELRY of antique clothing and jewelry in the attic of a family named Bunker and started forming an aesthetic for the one-of-a-kind pieces that are now sold exclusively at local shops Sugar Shack Boutique and Krazy Mary’s Boutique.

Bennett’s pieces are whimsical and playful. Among my favorites is a necklace made out of a pewter decanter label that reads “vodka.”

But for those who don’t wish to advertise their drink of preference, necklaces and bracelets more often feature repurposed brooches depicting flora and fauna.

Bennett scours estate sales, garage sales and the closets of friends and family in order to find the right materials.

“I am always looking for impractical, weird items to make something unusual,” she says.

And Bennett doesn’t limit her crafty prowess to just jewelry, either; her Facebook page welcomes inquiries for custom wall murals, canvas art and window displays.

“Basically,” she says, “I can do anything within reason. If it’s not within reason, I may consider it anyway.”

Yes, but that doesn’t mean you are now perfect. When the expectation of perfection is projected onto a person, he or she is being seen as incomplete. The human personality is usually more complicated than the goodor-evil split conveys. Growing up includes the realization and acceptance that human beings contain a mix of qualities, and we are called to guide each other to act from the best. Every religion reminds us of this responsibility. The journey to maturity also invites us not to reject religion, but to reflect on faith and make choices inspired by our spiritual development.

Dr. Martin Luther King Jr.’s legacy remains one of the most vivid examples of a person who preached nonviolence—only to be murdered. by Maxwell McKee Along with fellow peace-loving martyrs (think the big J and Mohandas), he became a symbol for the hatred that must be experienced before change can happen for a people.

Capital Stage presents Katori Hall’s play about MLK’s final night on Earth in The Mountaintop, directed by Anthony D’Juan, where the civil-rights leader battles himself and fate as a beautiful angel ushers him into the special light. Beethovan Oden takes on the part of King and depicts him majestically, as ZZ Moor plays the cussin’, drinkin’ angel Camae. Both have moments of extreme passion, something the script offers well.

The dingy Memphis, Tenn., motel room outside of which an escaped convict will assassinate King serves as the set, and stage designer Jonathan Williams’ work here is minimal, serving its purpose well. Oden grapples with King’s

The telltale puppet The Raven and Other Images of Edgar Allan Poe

It takes a pretty creative mind to blend Edgar Allan Poe, poetry and puppets together. That imagination belongs to Sacramento State University professor emeritus and renowned puppeteer Richard Bay, who has made a name for himself in the puppet world for the last 30 years.

Bay has resurrected and revised a show he first produced at CSUS in 1979 —The Raven and Other Images of Edgar Allan Poe—for a current production at the Chautauqua Playhouse.

It’s an evening with Poe that explores both the writer and his works by using live actors who examine Poe’s life and a range of puppets that act out scenes of Poe’s greatest writings.

The puppets used are Japanese Bunraku style, with two people controlling one puppet by manipulating it through rods and gloved hands for gestures. The results are often mesmerizing and breathe new life into the poems and stories we think we know, including The Raven, The Tell-Tale Heart and Annabel Lee. Because the puppets lack facial expressions and the puppeteers stand onstage, it takes a few minutes to become engrossed in the characters. But thanks to the skilled puppeteers’ fluid gestures and talented dialogue delivery, the figures soon become animated and believable.

The two live characters are Poe, with Jon Jackson doing a memorable portrayal of a distraught and disturbed writer, and a narrator (Kara Ow) giving background on Poe’s life. The narration is a nice addition, though as written, she doesn’t quite have the intensity to match Poe and the seven puppeteers.

where the play falls flat. It seems to set out to say that King would have been scared to accept his inevitable death. But in doing so, it casts him as a cog in a divine plan, when in reality he was murdered in cold blood by a hatemonger, just as many peaceful martyrs before him.

To say it is part of a divine plan, however, is only an attempt to soften the blow and almost seems to undermine what happened as a result of his death. God didn’t have Martin Luther King Jr. killed; James Earl Ray murdered him. Ω

more human desires vs. the ones we’ve all read in the history books. The impressive changes from the “I need some coffee” King to the “I have a dream” King work well to show a more realistic side of the historical giant. Moor has to fight to keep up with Oden at times, and with only the two of them onstage, it makes for occasionally jarring moments. However, she has a vivacity that is a treat to watch and makes those moments forgettable.

The story is a strange amalgam made from something like an Edward Albee version of Touched by an Angel and The Last Temptation of Christ. King is told he will be killed in the name of his cause, and that he should accept this fate as being part of a larger divine plan. He resists, but ultimately understands his place and accepts his death with ethereal dignity. In fact, that’s

Adapted by Brian Harrower, under the inspired direction of Benjamin T. Ismail, this must-see pastoral comedy makes its mark by bringing the French duchy and Forest of Arden to Sacramento—literally. Rosalind (Jamie Kale, in a standout performance) flees the court to live a life of banishment in the strange Forest of Arden and encounters odd characters that show her a life devoid of time and embellishments. Other notable peformances include Mary Katherine Cobb as the devoted cousin, Celia; Casey Worthington, who brings the fire in his flaming Touchstone; and Matthew Donaldson, who shows off perfect deadpan timing as the lovelorn Silvius. Runaway Stage Productions gets frisky and risky with this raunchy musical comedy. A talented cast runs riot with the innuendo, sex jokes and politically incorrect humor of this grown-up version of Sesame Street. Scott Bolt (in the dual roles of Princeton and closeted investment banker Rod) leads the cast, with Amanda Goldrick (as the virtuous Kate Monster and loose Lucy) and Andy Hyun (as Nicky and Trekkie). But two songs present the show’s big problem: While preaching tolerance, acceptance and avoidance of stereotyping (“Everyone’s a Little Bit Racist”), it takes too much joy in making fun of the Asian character Christmas Eve (“The More You Ruv Someone”).

The first sort-of joke in Admission is actual Harvard University alumnus Wallace Shawn playing Princeton University’s dean of admissions, by Jonathan Kiefer wielding a freshly published best-colleges guide and deciding that a slip in rank from No. 1 to 2 is grounds for his retirement. Ah, well, how droll.

Plotwise, this could be a promotion opportunity for one Portia Nathan, played by Tina Fey as a prim woman who, by now, is starting to seem like an admissions-office lifer anyway. All that stands in Portia’s way toward deandom is a rival colleague (Gloria Reuben)

with the same goal, and, of course, Portia’s own unawareness of how unfulfilled she really is. Pointedly childless, she has Michael Sheen for a tenure-track professor boyfriend who pets her like a dog and reads Chaucer aloud in bed, another of those sort-of jokes, but soon enough, he’s more or less lost to a lazy subplot anyway.

But Portia gets to work, making her recruitment rounds at high schools. And unlike all the eager young dynamos in the usual preparatory feeder schools, students at the alternative Quest School—where all the buildings look like architect-designed sustainable treehouses, and Paul Rudd teaches a Third World development practicum—tend to greet Portia with bemusement, saying things like, “Princeton is a corporation, no different than an oil company,” or “I’ll tell you what I’d like to know: Why should I apply?” One student, however, cleverly inquires about her Shakespeare-heroine namesake and makes a slightly odd but generally good impression. This is Rudd’s star pupil, played with very plausible eccentric smarts by Nat Wolff. And what follows is somehow a romantic comedy, between two other people, about whether or not he’s Princeton material.

Did we mention Portia’s childlessness?

Well, the movie does, also dwelling awkwardly on the idea that her career stability is a kind of stasis. Not that moving around a lot would be any better: Rudd’s character, having made a life

of humanitarian travel to forsaken places, once adopted an African boy who now yearns for rootedness and a little bit of undivided parental attention.

Speaking of being a parent—which, again, Portia isn’t—Lily Tomlin plays her mom, a feminist scholar much admired in rarified academic circles for a book she wrote called The Masculine Myth. So, now we have a romcom, a sort-of parable about one unconventional young genius’s quest to penetrate America’s exclusive higher-education system, and, most excitingly, a chance to behold Tina Fey and Lily Tomlin onscreen together, pluckily working their way through what Tomlin’s character calls “all this mother-daughter role-playing crap.” Regrettably, it turns out just to be another of those lazy subplots.

Given the movie’s title and its milieu, a raging satire would have been a brave and interesting alternative, but Karen Croner’s script, from Jean Hanff Korelitz’s novel, didn’t seem to allow it. Not that director Paul Weitz, most recently of Little Fockers and Being Flynn, would go there anyway. And, of course, ruthless contempt really wouldn’t be right for Fey, who’s so winningly immune to its chill; nor for Rudd, who can show a vicious streak but seems lately to have played up his own warm fuzzies in order to ascend in Hollywood. Together they seem a little stranded in a movie which, if we’re really making decisions based on merit here, doesn’t quite deserve them. If anything, it highlights the limits of their respective ranges.

As romantic and comedic and dramatic and parental complications ensue, false notes tend to ring out from Portia’s predicament.

But there are, too, some right-seeming small details, like the quaint yet oppressive smugness of ivy-league a cappella groups. And Weitz does at least allow us a chance to behold the admissions team fielding student and parent reactions to their decisions, including rejoinders such as “I hope you get rectal cancer.”

If Admission teaches us anything, it’s that movies can be like universities: Some are hard to get into. Ω

A Good Day to Die Hard

Tough cop John McClane (Bruce Willis) flies to Russia to check up on his son (Jai Courtney) who has landed in jail—only to learn that Junior is really CIA, and it’s all part of his mission to spirit a political prisoner (Sebastian Koch) out of the country. Now Daddy is in the middle of things and about to either ruin everything or save the day—or both. This series ran out of gas with the first sequel and has been on life support ever since; writer Skip Woods and director John Moore fail to revive it here, but they cram in all they can think of, with Willis and Courtney surviving concussions, broken bones, explosions and outrunning machine-gun bullets. Is Courtney being groomed to take over when Willis finally has enough?

What’s next? Never Say Die Hard? Do or Die Hard? Who cares? Die hard, already! J.L.

The Call

A 911 operator (Halle Berry) loses her nerve when she feels responsible for a kidnap and murder; six months later, she fields a call from a victim in a car trunk (Abigail Breslin) who may have fallen into the clutches of the same killer. The artless sadism works for a while, thanks to Berry’s strong performance and support from Roma Maffia as her sympathetic boss and Morris Chestnut as her cop fiancé. Alas, Richard D’Ovidio’s script (from a story by himself, Nicole D’Ovidio and Jon Bokenkamp) runs out of ideas; the killer’s contrived backstory takes over, and the movie degenerates into a low-rent The Silence of the Lambs, turning Berry into a low-rent Jodie Foster. Director Brad Anderson, short on ideas himself, can only tighten the screws on the audience, and the movie becomes more unpleasant by the minute. J.L.

Greedy Lying Bastards

Activist Craig Scott Rosebraugh steps into the documentary game with this directorial debut, unfortunately, just another one of those smarmy, quasi-journalistic, sign-this-petition spiels. Rosebraugh’s Al Franken-style title only highlights his comparative humorlessness, without even elaborating what the movie’s really about, which is the pernicious political influence of moneyed climate-change deniers (and their big-energy benefactors). It’s the usual talking heads and peppy infographics, and it’ll be catnip for viewers already inclined to indignation about the greedy lying bastards who value profits over planet health. But Rosebraugh’s narration seems more smug than sincere—like a borrowed voice, or one synthesized from those of all the similar documentaries whose style he apes. Worse, his appetite for ironic scenes of weather-wrought catastrophe verges on its own kind of insensitive opportunism. J.K.

Terrorists seize the White House and the president (Aaron Eckhart), virtually annihilating the Secret Service; only one agent (Gerard Butler) remains—the one who sacrificed the first lady (Ashley Judd) to save the president in an auto accident 18 months earlier. Creighton Rothenberger and Katrin Benedikt’s script is soaked in post-9/11 nightmare images and mayhem to cover all the whoppers along the way (a garbage truck that converts into an assault vehicle? Really?), and they get away with it more than they have a right to expect. Director Antoine Fuqua hammers the action out with all the breakneck abandon and CGI $70 million can buy, and there’s a good supporting cast to sell it: Angela Bassett as Butler’s boss, Morgan Freeman as the acting president, Robert Forster as a trigger-happy general are some. As the United States occupies Japan after World War II, Gen. Douglas MacArthur (Tommy Lee Jones) assigns Gen. Bonner Fellers (Matthew Fox) to investigate whether Emperor Hirohito should be prosecuted for war crimes—with a broad hint that he should not. This could have made a good movie, but writers Vera Blasi and David Klass and director Peter Webber largely botch it. The two stars are miscast: The handsome Fox is a poor match for the stolid Fellers, while Jones plays MacArthur the way he played Thaddeus Stevens in Lincoln—though his last scene with Hirohito himself (Takatarô Kataoka) has the ring of truth. The movie also gives Fellers a fictional prewar romance with a Japanese woman (Kaori Momoi) and makes his efforts to find her in the ruins of Japan appear more important than the investigation at hand. The Croods

A prehistoric family is forced to face the outside world when their teenage daughter (voiced by Emma Stone) meets a handsome stranger (Ryan Reynolds). It’s recycled Flintstones, only without even the meager inspiration of that oldie-but-not-very-goodie. At least William Hanna and Joseph Barbera ripped off The Honeymooners; writer-directors Kirk De Micco and Chris Sanders can only think to rip off some of the worst animated features of all time: Rio, Ice Age, Madagascar—distended shorts that mistake frantic activity for energy and flailing invention for ingenuity. With negligible characters and a threadbare story, there’s nothing to pass the time but identifying the voices. Nicolas Cage is dad, Catherine Keener is mom and Cloris Leachman is grandma. There now, I’ve saved you the trouble of seeing it at all. J.L.

Revisiting the 1988 plebiscite by which Chile shook off a terrible dictatorship, director Pablo Larraín’s film nicely subdues feel-good instincts in favor of nuanced, stoic insight. It depicts the surreally historic moment when international pressure forced a referendum on the Pinochet regime, and pro and con campaigns sprang up to duke it out on Chilean TV. Gael García Bernal stars as a hotshot ad exec who takes charge of the risky bid to rally fellow citizens against eight more years of official brutality. Told he needs an anthem, he shrewdly insists on a jingle instead—“Chile, happiness is coming!”—and the battle for freedom takes shape as a contest between callow, too-chipper “advertising language” and duplicitous fear-mongering propaganda. Daringly, the whole movie was shot on U-matic video, for that visually parched, late ’80s look. With the TV imagery and the jean jackets looking equally washed out, Larraín’s aesthetic cleverly enlists the audience in yearning for a more beautiful future. It also illuminates a moral intelligence that’s rare among retrospective election movies: something beyond just black and white. J.K.

Oz the Great and Powerful

As Tim Burton took on Lewis Carroll, so Sam Raimi has a go at L. Frank Baum: under the deadening influence of Disneyfication. It’s not Raimi’s fault that never again will any movie have the cultural staying power of The Wizard of Oz, but still his quasi-prequel seems to lack perspective. Before becoming the man behind the curtain, he was James Franco, as a Kansas con man with a two-bit carnival magic act. Good idea, theoretically, but Oz as protagonist needs more than the nonpersonality of a perpetually stoned, spread-thin performance artist. Too much CGI doesn’t help. Over the rainbow and abetted by an orphaned broken-legged porcelain doll and a servile flying monkey with the voice of Zach Braff, he tangles with a trio of variously meddlesome witches (Mila Kunis, Rachel Weisz, Michelle Williams). The thing about Oz-related entertainment properties, which indeed have become abundant over the past century, is the spirit with which they’re carried off. Some tornadoes are stronger than others. be fine to credit Robinson with an imaginative fabrication, had he used more imagination. But for all its suspense-stoking theatrics, his movie has the lethargy of a lazy mash-up, like every grave-situation-on-a-submarine film of the past 20 years, plus maybe a couple of Star Trek episodes, rolled into one unabashedly corny and somewhat budget-challenged chamber drama.

Sometimes it is solid in a no-nonsense way, like some workmanlike B-movie from a bygone Hollywood. Most times, it’s stilted as hell. J.K.

Spring Breakers

Four pals (Ashley Benson, Selena Gomez, Vanessa Hudgens, Rachel Korine) rob a restaurant to finance spring break vacation in St. Petersburg, Fla., where they get busted for cocaine and are bailed out by a lowlife dealer and pimp named Alien (James Franco, almost unrecognizable with his braids and flashy gold teeth), who relishes the fresh young meat.

Writer-director Harmony Korine (remember when he was hot?) doesn’t push the envelope, he rips it to shreds, and the movie takes on the enervating negative energy of Alien’s slurring, addled monologues. Korine dares us to look away, and he’s right, we can’t—but that’s not necessarily a compliment. Only Franco and Gomez (whose character bails out early) manage to stand out amid the sun-soaked delirium; Hudgens, Benson and Korine’s wife Rachel remain indistinguishable. J.L.

Stoker

A teenage girl (Mia Wasikowska), grieving for her father killed in a car crash, sees an uncle she didn’t know existed (Matthew Goode) suddenly moving in with her and her mother (Nicole Kidman). Korean director Chanwook Park has never made a movie in English before, and writer Wentworth Miller has never written a screenplay at all, and it shows—their movie is a ridiculous crock of hopeless hooey.

With his teenage-girl-and-Uncle-Charlie setup, Miller rashly invokes the memory of Alfred Hitchcock’s classic Shadow of a Doubt, and it’s a mistake; he and Park have a long way to go before they’re anywhere near that league.

Park imbues the movie with visual folderol in lieu of style, but can’t conceal the implausibilities of the far-fetched script. Kidman’s role amounts to little more than a diva cameo. J.L.

In writer-director Todd Robinson’s waterlogged thriller of Cold War brinksmanship, Ed Harris plays a Russian submarine captain with an unexpected chance to save the world. All that stands in his way is a fellow Russian played by David Duchovny. Weird, right?

Darkness, then light Singer-songwriter Hans Eberbach on how he returned from the brink of depression and got his groove back

Watching Hans Eberbach perform—be it with his eight-piece soul band Joy and Madness or the rock-dance hybrid Hans! and the Hot Mess— by Aaron Carnes it’s hard to picture him mired in depression.

Yet, between 2004 and 2009, the singer says he found himself living through the darkest time of his life.

It started after a near brush with fame. His rock band Sweet Vine had signed to Columbia Records, but broke up shortly thereafter in 1999.

Eberbach continued to play music, but never achieved quite the same level of success. Then in 2004, he became a father and decided to take a full-time clerical position with the Sacramento County Sheriff’s Department. Long work hours coupled with parenthood made for tough times.

The release of the album wouldn’t have been possible were it not for two key things that happened in 2009. Both would change the singer’s life. First, a friend told him how he’d been able to quit his day job by playing regular paid acoustic gigs, covers mostly—an idea he found intriguing. Then, the Nibblers, a local soul cover band, asked Eberbach to join as the lead singer.

Eberbach hesitated to accept.

“I honestly felt a bit queasy about being in a cover band because I considered myself an ‘artist,’ but at that point, I was barely playing out live, I had no real band and I had grown so tired of endlessly working out this record in solitude,” Eberbach says.

Eventually, he says, he realized the band did the songs justice—and not in a gimmicky fashion. “[When] it became obvious we were not going to be learning ‘Brick House’ and donning Afro wigs, I began to release myself into it, and performances started getting bigger and wilder,” he says.

“ I was sick of chasing the rabbit down the hole for yet another solitary, highly technical experience.”

“I was exhausted all the time and felt like a complete asshole because I had this beautiful family, a nice house and a solid job, but I hated my life,” Eberbach remembers. “I gained weight, smoked a lot of pot and started drinking. ... I felt like the light and magic in me had been snuffed out. I began breaking down periodically.”

Music, however, didn’t completely disappear from his life. During that period, Eberbach says he worked in solitude for hours on end, writing and recording the songs that ended up on his first solo album, 2010’s Up Is the Only Way Out. “As much as I had given up on a lot of my dreams [when] I was writing and recording this record, it was also my lifeline,” Eberbach says.

The final result is a well-recorded, cohesive batch of songs that sound like a cross between Maroon 5 and Jamiroquai, neatly balancing heartfelt expression, cerebral ponderings and groove.

Still, he didn’t give up the singer-songwriter ghost. After releasing Up Is the Only Way Out, he tried playing solo shows by building prerecorded loops on his guitar and using keys and drum machines to back him. This approach, however, proved challenging, so he formed Hans! and the Hot Mess.

“I was sick of chasing the rabbit down the hole for yet another solitary, highly technical experience,” Eberbach says.

In 2012, however, disagreements among key members of the Nibblers resulted in the band firing Eberbach. In return, he, along with a significant portion of the original Nibblers’ lineup, reformed as Joy and Madness, which, like its predecessor, plays originals and soul covers.

The change, Eberbach says, suits him well.

He’s quit his day job, and these days, in addition to playing numerous gigs, he’s also recording a new batch of songs with local producer David Houston.

“In one lifetime I can’t cover enough ground in music,” he says. “There is so much out there, I just want to gorge myself. … I need fresh stimulus.” Ω

2006. As the festival, happening on March 30, in San Bernardino, Southern California, approaches, The Road to Paid Dues tour is taking over cities along the way—including a stop in Sac. The real story of the March 21 show at Harlow’s Restaurant & Nightclub, featuring Murs along with Prof and Fashawn, existed in emcee Prof’s innate ability to move a crowd with a crazy fusion of styles that ran the gamut from poetic to crunk.

The real story that cannot go untold however, exists in the magical tale of the chance meeting between underground hip-hop and some burlesque dancers.

As we walked up to the venue, two women swaggered out of Harlow’s. Clad in costume lingerie, one sported a skimpy police “uniform.” Either this was the going to be the best hip-hop show ever or the Sacramento entertainment police had drastically changed its image to appeal to a younger, sexier generation.

As it turned out, the Sizzling Sirens Burlesque Experience had just finished its set—just in time for the hip-hop show. And so, after a brief layover in the club’s upstairs Momo Lounge as the Harlow’s staff cleaned the tassels and glitter off the floor, it was time for the music.

Fashawn played the opener, starting the show off with his signature style of hard-hitting, personal raps.

The Fresno phenom ran through classic verses from his critically acclaimed Boy Meets World album before dropping some fresh, new material.

Up next was Prof, who used the crowd as a sixth man, whipping them into a frenzy, so he could fuel off of its chaotic energy. His set was both hyphy and conscious at times, reminiscent of a white Tech N9ne without the face paint.

The wiry, mustached Minnesotan jumped around, spitting lyrics like Atmosphere on an intravenous Red Bull drip.

Murs closed the show with his typical high-energy performance, but sans dreadlocks. Newly clean cut, he performed all the classics, including “Whatuptho.” Murs patented the no-frills, California-underground style, and he’s just as good at it today as he was a decade ago.

Paid Dues boasts a killer lineup that includes Black Hippy, Macklemore & Ryan Lewis, and Sacramento’s own First Dirt. The only thing that could make it any better is if it opened with a burlesque show.

Goodbye, hello: You know how it feels after you give notice at a job?

Like, suddenly, there’s nothing more urgent than packing up and moving on already. Yeah, that’s exactly where The Hangar owner John Baccigaluppi’s head is at these days.“I think I’m already past the emotional-grief stage, and I’m on to the anger stage,” Baccigaluppi said with a laugh recently as he finished packing boxes.

Yes, The Hangar studios, which has seen artists as varied as Wild Flag, Sea of Bees, Two Sheds and Kanye West, has finally closed up shop. Long story short, the landlord needed to make costly repairs that would’ve forced the crew to shut down for six months—and then return to higher rent. But you know the saying: When one door shuts, another one opens. In this case, make that two doors: In Sac, Baccigaluppi and Chris Woodhouse will operate a new studio located in the General Produce Co. building on North B Street. Meanwhile, Baccigaluppi will also run a studio in Marin County, where the location should serve as something of a mecca for touring acts.

“Don’t forget my chair.”

The Sac space should be operational by May with the Marin locale following suit sometime this summer.

In the meantime, Baccigaluppi’s been involved in a media goodbye tour of sorts, sharing stories about the studio’s ramshackle accoutrements (skateboard ramp, stacks of Heckler magazines, etc.) and famous guests.

Kanye’s chair earned a lot of ink this month, you know? But now, it’s time to move on. For reals. And the whole thing’s more than a little bittersweet, Baccigaluppi says.

“I’m bummed we lost our space— the [original] Hangar was so unique … but it evolved into something more complex with more out-of-town bands, more freelance engineers, and we started catering more to that,” Baccigaluppi says. “Now, in the new [Sacramento] location, the goal is to get a rock band up and running. You can just walk in the door, and an hour later start hitting tape.”

That and mosh and party—pretty much anything having PUNK to do with old-school ’90s punk rock. The group combines meaty punk-rock licks and power-pop songwriting with plenty of lyrics about imbibing. What else is there to do at a punk-rock show other than drink (besides getting in on the circle pit, of course)? Bar Fly’s been around since 2007 but has been gaining more momentum these last couple years. Crystal Bowersox sings from the place where blues and gospel reside. She melds blues, country, folk and rock, and she probably could have been a torch singer in a different era. She placed second in the ninth season of American Idol, where she belted out “Midnight Train to Georgia,” “Me and Bobbie McGee,” and the song that brought many—including herself—to tears, “People Get Ready.” Don’t label her, though. She’s also an actress and will play the role of Patsy Cline on Broadway. This singer-songwriter BLUES has one album behind her and her sophomore release, All That For This, drops three days before her first tour stop at Harlow’s Restaurant & Nightclub on Friday. 2708 J Street, www.crystalbowersox.com.

Stockton native Grant-Lee Phillips first received national attention in the 1980s for his post-punk band Shiva Burlesque, but it was the 1990s-era band Grant Lee Buffalo that garnered acclaim for Phillips’ smartly emotional pop-centric songwriting. In the 2000s, ALTERNATIVE Phillips mined solo territory and played out one of the best (and longest) indie-rock cameos in television history, appearing as the wandering town troubadour on Gilmore Girls.

Phillips’ newest album, Walking in the Green Corn, explores the singer’s Native American roots. Here, 10 tracks delve into Phillips’ Muskogee lineage, marrying not just the past and the present, but also the political and the personal. 325 Spring Street in Nevada City, www.grantleephillips.com.

Ace of Spades, 7 p.m., $10 George Clinton and Parliament Funkadelic will always be the eccentric band tearing up a stoner frat house in the 1994 movie PCU with a sold-out concert. All shenanigans aside, Clinton—with his signature rainbowcolored dreads—is widely known as a main innovator of funk alongside Sly & the Family Stone and James Brown. Oddly enough, Clinton started his musical career not as a funk master, but with a doo-wop group inspired by Frankie Lymon & the Teenagers.

He even spent time as a staff songwriter for FUNK Motown. To add to his résumé, Clinton also produced the Red Hot Chili Peppers’ second album, Freaky Styley.

Let’s count the reasons Erika Wennerstrom of Heartless Bastards deserves a spot on everyone’s list of cool musicians: 1. She named her band Heartless Bastards because she thought it was funny. 2. Her voice is like the moody offspring of Lucinda Williams and Nina Simone. That’s only two reasons, but they’re more than enough. Wennerstrom, the frontwoman of the band originally from Ohio and now based in Austin, Texas, comROCK mands the bluesy, grungy and folksy group with a mournful swagger. Seldom these days do you hear vocals used as an instrument—wielded with precision and for a purpose—rather than simply a tool for carrying a melody; Wennerstrom never lets you forget. 2708 J Street, www.theheartlessbastards.com.

It’s been almost four years since French alternative rockers Phoenix unleashed its breakout album, Wolfgang Amadeus Mozart, and boy did we eat it up. From the jangly, driving pop-rock hooks and ROCK dance-inducing chorus of “Lisztomania,” to the groovy and insanely catchy “1901” that record was full of knockout numbers which helped make it arguably the best summer album of 2009.

Fans have been eagerly awaiting another record for a while now, and with Bankrupt! due out Tuesday, April 23, the wait is nearly over. Smoke will pour out the top. Everyone who lives nearby will think the volcano is getting ready to explode. Don’t forget to videotape the event for YouTube. Later, when you reveal the hoax, your video will go viral, and you’ll become a celebrity.

April fool! I don’t really think you should try this prank. It’s old hat. Back in 1974, a guy named Porky Bickar did it to Alaska’s Mount Edgecumbe. Here’s my real oracle for you: It is a good time to boost your visibility by doing something funny. Or to build your brand by being mischievous. Or to demonstrate your power by showing off your sense of humor.

LEO (July 23-Aug. 22): In the animated

TV show The Simpsons, 10-year-old Bart is constantly getting into trouble because of the monkey business he loves to perpetrate. His teachers punish him by compelling him to write corrective declarations on the classroom blackboard. It so happens that some of those apologetic statements should be coming out of your mouth in the coming week, Leo. They include the following: “I will not strut around like I own the place.” “I am not deliciously saucy.” “I will not instigate revolution.” “I will not trade pants with others.” “I will not carve gods.” “I will not Xerox my butt.” “I will not scream for ice cream.” April fool! VIRGO (Aug. 23-Sept. 22): The sport of

ferret legging is an endurance contest.

Participants vie to determine who can last longest as a live ferret runs loose inside their pants. The current record is five hours and 30 minutes. But I predict that a Virgo will soon break that mark. Could it be you? April fool! I misled you. I don’t really think you should put a ferret in your pants, not even to win a contest. It is possible, however, that there will soon be a pleasurable commotion happening in the area below your waist. And I suspect that you will handle it pretty well.

LIBRA (Sept. 23-Oct. 22): Risk being

a crazed fool for love, Libra. Get as wild and extreme as you’ve ever been if it helps you rustle up the closeness you’re hungry for. Get down on your knees and beg, or climb a tree with a megaphone and profess your passion. April fool! I was exaggerating a little. It’s true that now is an excellent time to be aggressive about going after the intimate connection you want. But I suggest you accomplish that by being ingenious and imaginative rather than crazy and extreme.

SCORPIO (Oct. 23-Nov. 21): British

comedy team Monty Python did a sketch in which a policeman apprehends a criminal.

The bad guy says, “Yes, I did it, but society is to blame.” And the cop says, “Right! We’ll arrest them instead.” You should adopt this attitude, Scorpio. Blame everyone else but yourself for your problems and flaws. April fool! I lied. In fact, the truth is the opposite of what I said. It’s time to take more responsibility for your actions. Bravely accept the consequences of what you’ve done— with your sense of humor fully engaged and a lot of compassion for yourself.

SAGITTARIUS (Nov. 22-Dec. 21):

Banzai skydiving is a step beyond ordinary skydiving. To do it, you hurl your folded-up parachute out of the airplane, wait a while, and then leap into midair yourself. If all goes well, you free-fall in the direction of your parachute and catch up to it. Once you grab it, you strap it on and open the chute, ideally before you hit the earth.

This is the kind of beyond-ballsy activity that would be perfect for you right now.

April fool! In truth, I don’t recommend banzai skydiving now or ever. Plain-old skydiving is fine, though. The same principle applies in relation to any adventurousness you’re considering: Push yourself, yes, but not to an absurd degree.

CAPRICORN (Dec. 22-Jan. 19):

Should you relocate to Kazakhstan and grow sunflowers? Is it time to think about getting a job in Uruguay and living there for the next 10 years? Can you see yourself building your dream home in Morocco on a bluff overlooking the Atlantic Ocean?

I suggest you spend some quality time thinking way, way outside the box about where you belong on this Earth. April fool!

I went a bit overboard in my recommendations. It is true that you should brainstorm about the kind of home you want to create and enjoy in the future. But that probably means revising and refining your current situation, rather than leaving it all behind and starting over.

AQUARIUS (Jan. 20-Feb. 18): Your

brain has a bigger capacity than you realize. According to professor of psychology Paul Reber, it can hold the equivalent of 3 million hours’ worth of television shows. As I’m sure you know, your brain is not even close to being full of that much data. And in accordance with the current astrological omens, I suggest you cram in as much new material as possible. April fool! I told you a half-truth. While it’s correct that now is an excellent time to pour more stuff into your brain, you should be highly discerning about what you allow in there. Seek out the richest ideas, the most stimulating information, the best stories. Avoid trivial crap.

PISCES (Feb. 19-March 20): July 2012

Might as well jump On the first Tuesday of every month, Sky High Sports (11327 Folsom Boulevard in Rancho Cordova) hosts a Special Days for Kids With Special Needs event. For three hours, parents and therapists can bring their special needs child to a bounce fest in one of Sacramento’s first trampoline gyms. The music is turned off and the ruckus kept to a minimum so that each kid may play at his her own pace.

Owner Jerry Raymond says he knows how important it is to have time dedicated to play and interaction in a safe and welcoming environment—he’s raising a specialneeds child and says he appreciates those moments when happiness and understanding go hand in hand.

Raymond and his brother, Ron, own several Sky High Sports trampoline gyms across the country, with several more in the works to open soon. Raymond’s dedication to exercise, family and fun are what keep him going in an economy that is trying to hold him back.

How did you get into the trampoline business?

Every day, my kids wanted to go to work with my wife because she was the manager of movie theaters. I owned a computer-consulting business, which didn’t interest them much. My brother Ron and I agreed that we wanted to own a business where we could spend more time with our families; something we could all enjoy together. It’s great to be able to share [this] affordable family fun and fitness with other health-conscious families around the country.

Why do you think it’s been successful?

Even during a bad economy, we’ve been able to grow. I think it proves that parents place a priority on family time even when budgets are tight.

We now have 15 locations across the [United States] with three more opening soon. We are fortunate.

How did you end up opening a franchise in Sacramento?

I live in the Bay Area with my wife, Yvette, and two of our three children. My brother Ron and I opened our first Sky High Sports in Santa Clara, [and] Sacramento was the obvious next choice because it’s a terrific city and a great community to raise a family. Plus, we have lots of family there.

Tell us a little bit about your son.

getting a workout. Exercise is important for all kids—including special-needs kids.

When he was very young, my son was diagnosed to be on the Asperger’s [syndrome] spectrum. He’s very highfunctioning, so we’ve been very fortunate. During grade school, he attended a private school that specialized in learning differences. Our main goal was making sure that he was always included with other kids—all kinds of kids. As long as his ability allowed him, he went out for team sports, which allowed him to be more integrated and socially adept.

Why did you decide to have a trampoline day reserved for special-needs kids?

Accommodating the special-needs community was always part of my business plan. Here’s the thing: “Special” families need more places to play together. I’m filling a need that I understand as a parent.

I’m really happy to be able to do that. My family has been jumping together since we opened our first Sky High location. Both of my younger boys took to it right away.

Jumping … is terrific exercise and develops balance and coordination. It also helps in the development of social skills. It’s good exercise for everyone, but it’s so much fun, most kids don’t even realize they’re

What kind of changes do you make on those days?

On any weekend day, the atmosphere at Sky High might make some kids uncomfortable, so on these special afternoons, we turn off the music, limit attendance and dial down as many distractions as we can.

One of our trampoline courts is designated “especially quiet” for kids with sensory issues and kids with physical challenges.

During our special hours, families can relax and have fun with other like-minded families. We enjoy the camaraderie.

While it’s important for the kids to have an atmosphere where the distractions are dialed down, this is also fun and relaxing for the “neurotypical” siblings and parents. When you’re here for special jump, no one has to explain why their brother “plays differently” than other kids. Parents can enjoy some regular time—I’m all about giving parents a break, too, because being a parent—of any child—can be exhausting.
