This year’s primary election gave the members of CN&R’s editorial board

fits. In some cases, it’s because we’re not happy with the incumbents in certain races, yet we don’t feel comfortable with their challengers being able to do the job competently—at least from the get-go—because they lack substantive experience.

In other cases, our frustration stems from having to weigh the intricacies of what comes down to philosophical differences of opinion, especially on marijuana. For the record, we believe the herb should be treated like cigarettes—legalized for recreational use and taxed.

After several rounds of deliberations, we’ve come to consensus. As always, we urge readers to do their own research. The League of Women Voters website, www.smartvoter.org, is an excellent resource.

Local offices and measures

Protest of Israel’s occupation under attack effective global boycott, divestment Aandincreasingly sanctions (BDS) campaign supporting justice for n alarming trend is afoot in reaction to the

Palestinians. BDS is a nonviolent resistance strategy urging consumers and entities such as corporations and churches not to do business with Israel until Israel ends its military occupation of Palestine, ends illegal settlements, ends its blockade of Gaza, and ends its violent oppression of millions of innocent Palestinians.

legislation that prohibits governmental bodies or state-sponsored entities from contracting with organizations that boycott or divest from firms that benefit from Israel’s occupation of Palestine, denying businesses the right to make the economic or political decision to observe BDS. (Hillary Clinton opposes BDS). Illinois became the first state to pass such a law, and more than a dozen other state Legislatures, including California’s (Assembly Bill 2844), plus the U.S. Senate, are weighing similar legislation. The Israeli lobby is so strong that many legislators fear reprisal if they oppose it.

Anti-BDS is also being promoted on numerous U.S. college and university campuses, including University of California attempting to establish regulations that penalize students and groups that support BDS or criticize Israel’s repressive policies, again naming such actions as anti-Semitic.

The situation in Palestine is urgent. Right now, about 25 acres of Gaza, including farm land and beaches, are being flooded by the collapse of a sewage reservoir in Gaza—one of many devastating results of the Israeli blockade. BDS is the only active global nonviolent campaign to end the occupation of Palestine and the Gaza blockade.

BDS and our right to free speech must not be stopped. □

Supervisors—District 1: Bill Connelly; District 5: Doug Teeter; District 4: Steve Lambert. Butte County faces financial challenges, including figuring out a way to pay for fire protection. Given that the incumbents have kept the coffers solvent, and that their challengers have little to no public-service experience, we are endorsing them despite reservations based on their actions at the dais—namely, not having the guts to ban fracking.

Measure E: Yes. Whether or not the local geography is conducive to hydraulic fracturing, the latest research concludes that fracking can, indeed, contaminate groundwater. Let’s also remember that there’s a fracked well in Glenn County. We cannot allow the Tuscan Aquifer—the source of our drinking and ag water—to be jeopardized now or ever by fracking.

Measure G: No. Medical marijuana is already not covered under the Right to Farm Act because it’s not federally legal. Adding this verbiage serves only to keep Butte County behind the times if and when growing pot becomes legal in the U.S. Don’t buy the pro-G signs saying it “supports public safety.” It has absolutely nothing to do with public safety.

Measure H: No. The voters approved Measure A, the medical marijuana cultivation ordinance, after years of haggling. If it still doesn’t work (and it does have problems), the county should consider the suggestions of all interested parties, not just the one dropping the hammer.

State initiative

Prop. 50: No. The intention of this constitutional amendment sounds great at first blush. A politician has been suspended, accused of a crime, but is still drawing a paycheck? Not cool. What Prop. 50 would do is halt pay for suspended members of the Legislature on a two-thirds vote. But what about due process? Everyone deserves it, even pols. Furthermore, lawmakers can already hand down sanctions, including expulsion.

State Assembly, District 3: Edward Ritchie

U.S. Senate

Steve Stokes. The life-long Los Angeleno wants to reinstate GlassSteagall, opposes the Trans-Pacific Partnership and wants to end Citizens United. Sounds similar to the views of a Vermont senator we like.

U.S. Congress

Jim Reed. Reed is solid on progressive issues. We respect Chico Republican Joe Montes’ local work, including his efforts establishing a youth court, but his support of Trump and his vow to defund Planned Parenthood mean he’s cut from the same cloth as incumbent Doug LaMalfa, who did both of those things recently.

U.S. President

Democrat: Bernie Sanders. This one was an easy consensus. Sanders is authentic. He opposes a U.S. plutocracy. He has been consistent throughout his career on core issues, and has the will to take on corporate interests.

We don’t trust Hillary Clinton. She’s tied to Wall Street. She came late to the party on supporting LGBT rights. Even President Obama has regrets over what happened in Libya during Secretary Clinton’s tenure.

Republican: No endorsement. A Donald Trump presidency spells disaster for our nation. Period. □

Re “Political super powers” (Cover story, by Ken Smith, May 12): Well-written piece about delegates to the Democratic National Convention. Secretary Hillary Clinton, so far, has received over 3 million more votes than Bernie Sanders. Thus, she has 250 more grassroots delegates than Sanders.

The superdelegates (DNC congressional members and governors) overwhelmingly support Clinton. In 2008, then-Sen. Clinton had more popular votes than Sen. Obama, but Obama had won more delegates.

Obama got the nomination with superdelegates putting him over the top. No complaints from anyone. Sanders did not vote for Obama at that convention.

What has bothered DNC members was Sanders stating that Clinton has more delegates than he but “many are from the deep South” (i.e., AfricanAmericans), while praising his delegates (all white) from Utah, Idaho, Alaska, Wyoming, etc.

The Democratic nominee for president has not won the white vote since 1964 (LBJ) and AfricanAmericans give the Democrats about a 90 percent vote.

I believe Sanders will campaign hard for the ticket all over the country, including for U.S. Senate candidates.

Trump’s positions, straight from the 1950s, will get him some new white male voters with a 10th-grade education, but for every one of those, there will be three new Latino voters for Clinton.

In other news, this week we’ve published our endorsements for the June primary (see page 4). It took a couple of meetings of the CN&R’s editorial staff to come up with the picks. And the end result in some races surprised even us.

I’ll probably get hate mail. That’s fine. I’m getting used to it. I got a nice little batch this week in response to my extolling the virtues of Bernie Sanders, along with the reasons I’m on Team Sanders.

I guess that makes me some sort of degenerate. In case you missed our last issue (see “Political super powers,” Cover story, May 12), local superdelegate Bob Mulholland basically implied that Sanders supporters are a bunch of pot-smoking troglodytes. In addition to being an unfair characterization, it’s the kind of attitude that’s going to further alienate independents—and, in many cases, Democrats.

It’s hard to believe Mulholland doesn’t understand Sanders’ appeal or why many longtime voters are fed up with the status quo.

Considering the Vermont senator won by 11 points in Oregon on Tuesday—the state has a closed primary, and Hillary Clinton was favored to take it by 15 points—Mulholland and other establishment insiders appear to be the cave-dwellers.

Back in March in this space, I wrote about having to go through jury selection at Butte County Superior Court in Oroville. Coincidentally, I’d been summoned for a murder trial that the CN&R had planned on covering—the People vs. Zir Ion Weems.

Weems was accused of strangling his wife, Angelica, the mother of his four children. The case was interesting for a number of reasons, including the fact that Angelica’s two sisters are romantically linked to two of Weems’ brothers.

Days into the selection process, immediately following the defense attorney’s efforts to vet me as a prospective juror, the judge, Robert Glusman, cut me loose. He didn’t give me a reason, but I suspect it was because I knew more about the case than the average citizen. I’d also previously interviewed a few of the potential trial witnesses, though not about the case.

To be honest, I was relieved to get the boot. I thought it would be distracting for Managing Editor Meredith Cooper to see me in the jury box each day. And likewise, it likely would be distracting to see her in the gallery. Cooper spent weeks in Oroville, covering each day of the trial. And in this issue, the week after Weems received the maximum sentence for first-degree murder, she tells the story of the proceedings, during which some of the details of Angelica’s short, abuse-filled life were revealed (see “History of violence,” page 20). She was just 23 years old at the time of her death.

Short of purchasing transcripts from the court, you will not be able to read about it anywhere else. That’s because Cooper was the only journalist to cover the length of the trial—a high-profile case.

That says a lot about the state of the local media landscape. It’s especially disconcerting considering that this is a story of domestic abuse ending in the worst possible outcome, a story that needs to be told to help others trapped in abusive relationships.

gas to be explored, and since the few exploratory wells are dry and abandoned, this is much ado about nothing.

I would prefer that the antifracking crowd spend their energy stopping the transportation of the Bakken crude oil currently being transported by rail through the Feather River Canyon. If you want to see contamination, picture a derailment of oil into Lake Oroville.

Vote no on Measure E—don’t reward the Chicken Littles of our county.

With all the negative letters published about Measure E, I must tell you of my experience with fracked gas wells.

Just Google my old farm and rice field along County Road 62 and WW in Glenn County. Tap on the images at the bottom of the page. You will see gas wells all along Road WW. They are within a few hundred feet of potable water wells—wells bordering beautiful green rice fields. There’s 1) no contamination of waterfowl that regularly use the area as a flyway, and 2) no adverse health issues from humans consuming their well water.

Referendum not moot Re “Two views on fracking” (Letters, by Colleen Cecil, May 5): A recent letter to the editor said that Butte County doesn’t have shale, so there wouldn’t be any fracking here anyway, hence the Measure E moratorium is moot.

However, if you Google “active gas wells Butte,” you will see quite a few between Chico and Yuba City. Plus, fracking is happening on sand foundation in Glenn County.

Better safe than sorry. Note: To say no to fracking, you actually need to vote yes on E. Protect our aquifers.

‘Hell of a story’ Re “‘The big question’” (Letters,

by John Matlin, May 12): Are there homeless drug addicts from healthy, stable homes with no diagnosable mental or physical disabilities and a minimal genetic predisposition to addiction? Very few. The vast majority of people on the streets experience some combination of PTSD—often from extreme childhood trauma—mental illness, physical disability and, if they are hard-core addicts, a strong genetic predisposition to addiction.

Considering the Third World level of social services available to street people in Butte County, it is indeed remarkable that letter writer John Matlin is in recovery.

But, it is also highly probable that he represents the end of the bell curve with the least number of obstacles to recovery. (That is, if Matlin experienced extreme

As they deny the very nature of mental and physical disability, too many people persist in believing that homeless people must make sweeping behavioral changes on the basis of “will” alone. This is a convenient belief, as it exonerates society and justifies our medieval approach to poverty on the streets.

Organizing for Palestine Democracy in action. That’s what May 10 demonstrated for seven people from the Chico Palestine Action Group and nearly 70 others, many from Jewish Voice for Peace, who came to Sacramento to meet with Assembly members.

Our purpose was to shed light on Assembly Bill 2844 and why it must be stopped. AB 2844 is a bill authored by Assemblyman Richard Bloom (D-Santa Monica). It would penalize businesses that support the boycott, divestment and sanctions (BDS) movement. BDS is modeled after the 1948 boycott to abolish apartheid in South Africa and is a nonviolent movement advocating for cultural and economic withdrawal from Israel until it recognizes Palestinian human rights.

Inherent in this bill is a plan to create and monitor a McCarthystyle blacklist of businesses supporting BDS. The Attorney General’s Office calculates that this would require a staff of six people and would cost about $1.2 million per year. The wider concern is that boycott is constitutionally

protected speech.

Enloe Medical Center’s fundraising campaign to build a dedicated cardiovascular care center got a quarter-million-dollar boost from a local family last week, according to a press release from the hospital.

The $250,000 gift, from the Chuck and Sharon Patterson Charitable Fund, also pushed monies raised for the heart health facility to more than $1 million. The new facility carries a $17 million price tag, and the Enloe Foundation—which oversees the hospital’s fundraising efforts—hopes to raise $5 million in charitable gifts over the next five years for the project. The remaining costs will be covered by the hospital’s operating fund.

The planned center, which will be built inside the hospital’s existing building, would more than double the hospital’s capacity for heart care, and include new procedure rooms, imaging equipment, bays for pre- and post-surgical care, meeting rooms and a family lounge. The hospital also hopes the new center will serve as a recruiting tool for heart specialists.

“We’re saying thank you to the people of Chico for their business at our dealership and tow company throughout the years,” said Chuck Patterson, who has owned a local car dealership since the mid-1960s.

TUESDay NIGHT RIOT

Chico police officers responding to reports of a large fight near the intersection of West First Avenue and North Cedar Street Tuesday night (May 17) arrived to find between 30 and 40 people engaged in verbal and physical altercations. It took officers several minutes to calm the crowd and get to the source of the chaos, according to a Chico Police Department press release.

Witnesses told officers the incident began with a physical altercation between Colby Thompson (pictured) and his girlfriend, after which Thompson walked away upset and allegedly began challenging onlookers to fight. A 34-year-old male neighbor, whose name was withheld by authorities, began arguing with Thompson and armed himself with a metal pipe.

Thompson allegedly stripped him of the weapon during the ensuing dust-up and struck the man in the hand, severing the victim’s pinky finger.

Thompson fled the scene, but called police several hours later to turn himself in. He was arrested and charged with assault with a deadly weapon and battery with significant injury. His bail was set at $80,000. The victim was treated at Enloe Medical Center.

The plan, which also includes keeping Bidwell Park restrooms open seven days a week, is in recognition of the dilemma posed by the council’s decision in March to criminalize urination and defecation on public property: If homeless people need to relieve themselves, where can they go if there are no open restrooms in the city?

The council had punted the stinky issue to its Internal Affairs Committee.

Working with Public Works staff, the IAC came up with several recommendations designed to address this longstanding issue.

As mentioned, park restrooms would be open every day, with city employees and a private janitorial service sharing cleaning duties through Labor Day. Also, some $25,000 in capital project savings would be used to upgrade the plaza restrooms to accommodate 24-hour use, and the city would pay the Downtown Chico Business Association’s Cleanup Brigade $10,000 to do one more cleanup each day. The brigade is a group of homeless people trying to work their way into housing; it has been responsible for cleanups following DCBA events at the plaza and reportedly has done a good job.

The sticking point was the potential for late-hour illicit use of the plaza restrooms.

Police Chief Mike O’Brien said he was concerned.

Nevertheless, the council voted to try it for 90 days and assess its success every 30 days. Erik Gustafson, the city’s public works director-operations and maintenance, said he hoped to start the remodeling in late June.

When it comes to moving Chico Scrap Metal

from its current location, “you’re damned if you do and damned if you don’t,” Councilman Randall Stone said.

That’s because, as council members readily acknowledge, the city has botched the situation in several ways.

First, back in the 1980s, it compelled the business to move from its former location on Humboldt to its current site on East 20th Street, which at the time was on the edge of town—but close to Chapman Elementary School and the Chapmantown neighborhood.

Then, in 2004, the city adopted the county-created Chapman/Mulberry Neighborhood Plan and subsequently called for the amortization (read: gradual removal) of the business. It and the county also promised to assist financially in that removal.

That assistance never happened, even though at the time the city was rolling in redevelopment money. Then the recession hit, and the city was broke.

City staff members were never told to look for other ways to fund CSM’s move.

Instead, the city set deadlines for removal that CSM ignored. And the city allowed Habitat for Humanity to build several new homes next door to the scrap yard, promising that the company would move.

Instead, CSM is staying put. On Tuesday, council members approved the final reading of two ordinances approved on May 3 that remove CSM from amortization and OK a development agreement between the business and the city. The vote was 4-3 in both instances, with Ann Schwab, Tami Ritter and Stone dissenting.

The agreement gives the city greater regulatory control over CSM and requires the recycler to make numerous on-site improvements, including a new perimeter fence and vegetation.

Members of the ad hoc group Move the Junkyard, who believe that CSM produces wind-borne toxins that drift into Chapmantown, made a final, desperate attempt to convince the council to hold off in order to give city staff time to come up with a win-win alternative.

But the four council members who approved the ordinances May 3— Reanette Fillmer, Andrew Coolidge, Vice Mayor Sean Morgan and Sorensen—stood firm. Sorensen said forcing CSM to move constituted a “one-sided taking” and was probably illegal.

“We hear a lot about promises,” he said. “Yeah, promises made with somebody else’s property.”

In other council news: Chico residents

who get a new roof, install solar panels or otherwise need a “miscellaneous” building permit will pay more for same in the future. The council voted unanimously to hike the fees to capture 100 percent of the city’s permitting costs and thereby add $200,000 to $300,000 annually to the Private Development Fund.

The council also unanimously approved a creative plan to assist the Torres Community Shelter that will change the lease agreement with Torres to allow it to rent out its large commercial kitchen. It also approved the creation of a corporate giving program among city employees, some of whom no doubt would elect to give their money to the shelter.

Finally, at Stone’s request, council members agreed to consider adopting an ordinance requiring massage parlors to obtain permits. The idea is that, by requiring fingerprinting and background checks, the city will drive out those parlors that are fronts for prostitution.

Stone said there are at least 13 such parlors in Chico whose sex workers are being held against their will.

The council voted unanimously to refer the issue to its Internal Affairs Committee. □

Prune problems Spring storms wreak havoc on Butte County’s No. 4 crop between rows of trees in his family’s orchards, Paul McGowan made an easy pivot and slipped his hand under a Sthin,triding leafy branch. He pulled it back, as if a street magician, and

there in his palm lay a green oval fruit, perhaps an inch long: a prune.

Butte County (in fact, the valley region from Yuba City to Red Bluff) is a prime area for growing the variety of plum that’s dried to become the products associated with the name “prunes”; the process starts on farms like the McGowans’, along Nord Highway north of Chico.

The piece of produce in his hand Tuesday (May 17) was perfect. Quality is not the problem. What prune farmers—and everyone dependent on them—are concerned about is quantity.

“Normally, this time of year, there’s a lot of fruit on the tree,” McGowan said. “The limbs are lined, everything’s loaded; they’re bowing down—twice as much fruit as what we have on here now.”

Indeed, the McGowans (including Paul’s father, Rich, and sister, Vic) estimate they’ll wind up with a crop yield just half as large as usual. They and the county’s approximately 100 other prune growers got hit with a “triple whammy” of climate conditions.

First came late chilly rains, during the spring season when the trees usually bloom in warmth. Next came winds blowing young prunes off trees. Finally, hail struck swaths of the North State, taking a toll on fragile young fruit.

Louie Mendoza, the county’s new agriculture commissioner, said every grower has lost between 50 percent and 90 percent of the crop.

Considering that prunes represent the fourth-richest ag yield for Butte County—worth $41 million annually (per the most recent Agricultural Crop Report, 2014)—the impact is significant. The 2016 crop likely will have a value of $16 million, Mendoza said, so he filed for a federal agricultural disaster declaration on behalf of Butte County and the growers.

“We feel fortunate that we have any crop at all,” said McGowan, whose father sits on the board of the Butte County Farm Bureau.

Talking to fellow Sunsweet Growers co-op members in surrounding counties, they’ve learned that “there are a good percentage of growers that will not harvest at all.”

The ripple effect of the crop loss will have local repercussions beyond

supermarket pricing of prunes. Mendoza cited a UC Davis study that determined every dollar of crop value translates into $4 of local economic activity. Losing $25 million worth of prunes, then, could siphon $100 million from Butte County.

McGowan said tree crops such as prunes are different from others because many costs are fixed. Trees require the same watering whether they’re bearing fruit or not. At harvest, growers use the same equipment and need the same number of workers whether the branches are half- or fully laden.

Silver lining: “This year, with half a crop, the size will be really good—nice and big,” he said. Growing fewer, “the tree has plenty of energy, so it will produce nice, large, goodquality fruit.”

However, total tonnage still will be down.

Burning the budget Butte County explores cost-saving alternatives to 85-year-old relationship with Cal Fire June, as the Butte County of Supervisors worked to LsetastBoard this fiscal year’s budget, one

item sparked heated discussion that continues to simmer today. The cost of labor for the county’s fire protection for 2015-16 increased by $1.1 million due to pay raises and increased costs of employee benefits, but the county had no say in labor negotiations.

The county’s absence at the bargaining table is due to the fact that it has a cooperative agreement with Cal Fire, a state agency, for fire services, and has since 1931.

The Board of Supervisors directed county staff to explore options to restructure these services and weigh the effects of possible budget cuts. With public input, the board could choose a new fire service model as soon as September.

“The cost of fire and other public safety services by and large comes from the county’s general fund,” said Casey Hatcher, public information officer for Butte County. “The county can’t just sit and watch these costs go up and up and up when we have no control over it, so we have to look at

other options.”

“We’ve seen some rather large increases, and because of the nature of our relationship with Cal Fire, we’ve had no other choice than to just fork it over,” Supervisor Larry Wahl said in a phone interview. Wahl also said the county is happy with the services provided by Cal Fire, and that the board’s decision to consider new models is purely a financial one.

Currently, the county funds 105.5 full-time equivalent positions, all of which are overseen by Cal Fire, which also contracts with the cities of Biggs and Gridley and the town of Paradise. The collective unit, then, is known as Cal Fire-Butte County, which addresses fire protection needs in those municipalities and unincorporated areas of the county. Chico and Oroville have their own, separate fire departments.

The county’s first step in determining reorganization was to hire Matrix Consulting Group to identify its options. The consultancy came up with six possible ways to restructure fire services, and

in February the board narrowed them down to three: maintain the county’s relationship with Cal Fire with significant budget cuts to county fire services; create a standalone county fire department, meaning the county would be responsible for creating positions, pay and benefits packages and dealing with labor organizations; or create a single countywide fire district overseen by the Board of Supervisors, allowing them to contract with outside organizations— including Cal Fire—for services.

The last option would require voter and LAFCO approval.

In an effort to make the public

aware of possible changes to fire services and let locals weigh in on the options chosen by the supervisors, the county ran an online survey from April 12 through last Sunday (May 15). Hatcher said the survey garnered nearly 1,000 responses, which her office is currently tabulating.

Furthermore, public meetings will be held in June in each of the county’s five districts, though dates and locations have yet to be set.

“We have a very diverse county, and the fire service needs of people in the valley are much different than those in the foothills,” Hatcher said. “We want to make sure we give everyone the opportunity for input.”

She said that, if all goes according to plan, a final decision could be made by the Board of Supervisors as early as September.

Unit Chief Darren Read halfjokingly said he would prefer the supervisors choose “Option four, the one they didn’t pick, which would be to let us provide the current level of service without cutting our budget.”

Read said that, as prompted by the supervisors, his department has been looking at the effects of cutting from $3 million to $5 million from the fire budget. “So far, we’ve put together a draft of what $3 million in cuts would look like, and it would definitely involve cutting some staff and closing some fire stations,” he said, adding he was unable to disclose which stations might face closure.

He also explained that the $1.1 million pay increase this year was due to statewide hikes in the cost of CalPERS benefits and the minimum wage, and that the county would have had to pay the same amount if it had its own independent fire department. He added that Cal Fire employees hadn’t had a raise in many years, and actually took 5 percent pay cuts in the fiscal years 2011-12 and 2012-13. He said cutting staff will also be difficult, as the department lost seven positions at the height of the recession in 2009, and has yet to recover that personnel.

Read said Cal Fire and the county have an exemplary, longstanding relationship that he hopes to maintain.

“We are Butte County’s fire department, no matter what patch we might wear,” he said. “Our firefighters live and work and raise their families here, and we’re totally committed to safety and service in this community.”

Medi-Cal reimburses entities such as NVIH at higher rates than individual offices; with demand for services already greater than the number of OB-GYNs, North State women with publicly funded insurance tend to wind up on waiting lists. The center resolves both issues.

“It wasn’t our board coming to us saying, ‘We want a prenatal clinic,’” Miller said. “It was the community coming to us and saying, ‘We need this.’ So it really was, from the beginning, a partnership with the community to try to protect services and try to help.”

ant mother who’d driven an hour entered the reception area. She hadn’t made an appointment. She had no insurance. She had no idea how to proceed. She just knew she needed health care.

Within an hour, she had a Medi-Cal application submitted (she was immediately covered via “presumptive eligibility”), received prenatal counseling through the Better Babies program and began her comprehensive exam with Certified Nurse Midwife Ann Wright—all on-site.

She’d found her medical home.

Dr. Andy Miller, medical director of NVIH, said he came into the day thinking that the first scheduled patient, a young Native woman who had made an appointment, would be the success story. Instead, he and the staff found an even greater sense of satisfaction from helping the woman who

showed up unexpectedly.

“That couldn’t have happened before— not all that happening,” he said.

No private physician’s office can give presumptive eligibility, which is determination under the Affordable Care Act that a patient qualifies for Medi-Cal benefits and can receive immediate care. Only hospitals and designated clinics make that call.

Plus, he added, “there’s a hard time getting seen for prenatal care in Chico.”

Anywhere else, she wouldn’t have been seen that day.

These aspects, plus all the support services, made Miller think, “That’s the reason.”

That’s why NVIH opened the Women’s Health Center.

Filling a need, as well as the missing piece of

NVIH’s cradle-to-grave quilt, the tribal nonprofit has been contemplating this venture for years—roughly since 2012, when it took over the Chico Children’s Health Center from Enloe Medical Center. Not coincidentally, the Women’s Health Center and Children’s Health Center are located right across from each other on Cohasset Road.

Prenatal Services Director Betsy Mott has worked at both facilities. She says NVIH

hopes women’s clinic moms with newborns will find a smooth transition into the children’s clinic.

“Those moms go oversupported,” Mott added, “and that same support continues when they go across the street with their babies.”

The Women’s Health Center has taken form of the children’s center in its Enloe days. Wright is the Women’s Health Center’s regular practitioner, and NVIH has one Chico obstetrician—Dr. Maurice Valcarenghi—working a half-day a week.

Staff do provide the gynecological aspect of OB-GYN—though Miller admits he needed some convincing. “It was really just to keep the scope small; bit off a small chunk and try to do it well,â€? he said of initial thoughts of an OB-centered clinic. “As it got closer, many people pointed out that that’s kind of a false distinction; even at your post-partum visit, you’re already doing gynecology‌. “We’ve ordered most of the equipment, most of the providers want to do both, so we’ll do them both. Campus goes green A new recycling program at Blue Oak shows students how much of an impact they can make story and photo by

School, were among more than a dozen students who jumped at the chance to form a “green team” on their campus. They felt it was a great way to give back to their school, make it look nicer and also they see themselves as important role models for their fellow students.

“We help the school as much as possible.

A lot of people litter at our school and we’re trying to stop that,” Genesis said. “So we’re helping with recycling and teaching people how to treat our school.”

Part of their job is emptying recycling bins and green-waste buckets as part of the school’s new recycling initiative to reduce its carbon footprint and keep their campus beautiful.

Blue Oak started the program in March as part of the state-sponsored Keep California Beautiful recycling challenge, said Heidi Lang, the school’s nutrition coordinator. The contest encourages K-12 schools throughout California to increase their recycling for a chance to win some cash. While Blue Oak didn’t win, Lang said it was still an important exercise because it started the muchneeded program and instilled in students important values like responsibility and sustainability.

“I started here in January and I was shocked that they didn’t have a recycling program,” Lang said. “It’s a responsible way of life; I think we should all be more sustainable.”

To purchase the materials needed to enter the contest, like new bins for mixed recycling and organic waste, Lang and Principal Stephanie Nichols requested about $400 from the school’s student council, a student government group consisting of students from sixth to eighth grades. Getting the kids involved in purchasing the materials with funds they’d raised gave the student leaders special ownership of the project, Lang said, and taught them a small, yet important, lesson in civic engagement.

“We had been trying to implement something like this for at least a year,” Nichols said. “Things like this take time to get leadership and initiative. It’s hard being a charter school. We do everything in-house; we can’t just call up the district and say, ‘Hey, we need this.’”

The new program has been a huge success, Lang said, and has vastly reduced the amount of waste at the school. Before the new recycling program, Blue Oak filled two 96-gallon mixed-recycling totes that were collected once a week by Recology. These days, it’s filling 10 of the same size totes that now have to be picked up twice a week.

Plus, 25 gallons of organic waste are picked up weekly by a student’s family, which uses it to feed livestock. The school’s trash get on board:

dumpster went from five pickups a week to four, and the hope is to, through further recycling efforts, bring it down to three days a week once the new school year begins.

Because of their efforts, Blue Oak was the

first local school to gain the attention of Recology’s new sustainable schools program, which recognizes sustainability efforts by local K-12 schools, said Jill Ortega, an account manager with Recology. Operating under the belief that 70 percent to 80 percent of a school’s waste can be diverted, Recology works closely with local campuses to develop good recycling habits and programs.

“We want to encourage the schools to do something positive and encourage other schools and show them it’s doable,” Ortega said. “We’re hoping other schools will catch on to that once we bring attention to it and show that it is possible for schools to be sustainable and doesn’t take a lot of extra work.”

While having a teacher or staff member guide them is important, Ortega said, having students manage recycling programs themselves at local schools like Blue Oak, Notre Dame and Stanford Avenue Elementary School in Oroville has been an important learning process for the students in terms of building responsibility for their waste.

“If the students are doing it, they hold themselves more accountable and that in turn makes the program more successful because they take ownership of it,” Ortega said. “They are the people that are ultimately

creating the waste so they should be responsible and accountable, not just with where does it go or how we get rid of it, but what actions can we take to reduce the amount that we recreate.”

Entering the recycling-challenge contest, creating the green team and educating students about best practices have all been instrumental in changing the culture at Blue Oak and instilling values of sustainability throughout the campus and at home, Lang said.

“I’m just really proud of the kids and their efforts,” Lang said.

“Especially their efforts without recognition; they’re not doing it for a reward. They’re continuing their efforts despite no prize. I really think it’s because they believe in recycling, I’m hoping we’re ingraining that in them. It really is a part of our culture here, not only at Blue Oak, but here in Chico, and I would like to see that carry on in our students and in their daily lives.” □

ROlling On thE RivER Since March, the Butte Environmental Council has hosted a series of citizen science outings exploring the Feather River watershed. The first event was a hike focused on Native American tribes of the area and the second an exploration of the river’s many dams. The final installment is a lower Feather River salmon float.

However, the sometimes transcendental experience can be completely dimmed and downright dangerous with aged and/ or foggy headlights. That’s where Peggy McConnaughy, who recently returned to Chico from the L.A. area, comes in. In addition to her day job selling car parts at AutoZone, she is the owner of Restore N Renew, a local mobile headlight restoration service. In an hour or less and for under $50, the former car saleswoman can visit your home or place of work to reinvigorate your set of lamps.

How did you start doing headlight restoration?

My nephew suggested it to me a few years ago. He knows I’ve

always done arts and crafts and suggested this might be something I’d be interested in learning how to do. Then, I decided it might be a good way to make a little extra income, so I contacted the owner of the auction yard in Orland [Orland Public Auto Auction] and he let me come practice on all the cars he has in his yard so I could get good at it.

How is the business going?

Pretty good. In the past year since I started, three different automotive services have let me come do headlights for them. Daniel Oliveras at Guido’s Auto Precision sends me the most business. He does BMWs and Mercedes and runs a high-end auto repair shop, which is neat because I end up doing some nice cars ... Lexus, Mercedes, and I did a Porsche Cayenne. It had a cracked lens, and the clear acrylic spray I use actually gets inside the cracks and seals them. People are ecstatic because of the cost savings and because of the difference it makes.

New lenses are very pricey; they

can cost around $1,500 each.

How exactly do you do it?

First, I cleanse the lens completely.

Then, I tape it off and make sure I protect the car so that overspray doesn’t get on anything. After scrubbing it, taping it, prepping it and getting it completely dry, I spray it with a solution that allows the clear acrylic spray to do its job and stay on there. I also do another service using a Rain-X product, which is a little less expensive and only takes about 35 minutes, but doesn’t last quite as long.

Why is having clean headlights so important?

It’s a matter of safety. Having foggy headlights is no good, especially at night, it diminishes your ability to see. I did an insurance agent’s car recently, and she even commented about how so many cars drive around with bad headlights and how dangerous that is.

One of the first things I check whenever I walk into a grocery store is the cheese display. Some are better than others, of course, but the inventory is ever-changing, so I never know what new gem might pop up at my neighborhood Safeway. Every once in a while they really hit it home, but if I want the real good stuff, I generally have to head to The Galley or Zucchini & Vine. (I recently discovered the triple-cream Mt. Tam from Nor Cal’s Cowgirl Creamery at Z&V. Try it!)

So, when I made my first trip over to the newly opened New Earth Market at East Avenue and Cohasset, I made a beeline for the fromage. Not a bad selection—I actually found some fairly gourmet choices: P’tit Basque, one of my favorite sheep’s-milk cheeses; and Délice de Bourgogne, a buttery triple cream brie.

So, New Earth Market has a nice little cheese selection. It would be amazing if there were a counter nearby where they could offer samples and even slice it for you (the P’tit Basque comes in a large round that’s typically cut at least in half, because it’s $25.99/pound). But, the store’s still working out kinks, so maybe they’ll take this to the suggestion box!

As for the rest of the market, the layout is quite nice. Think Holiday up in Paradise. The aisles are wide, the decorations warm and inviting rather than sterile white. What impressed me most was the large selection of prominently displayed local foods, from Orland Farmstead Creamery cheeses to Tin Roof Bakery breads to wines from all over the region. I also like the fact that they advertise the use of organic chicken in their butcher area.

This is clearly a store for the organic- and sustainability-minded shopper—don’t expect discount or most corporate brands; the focus is on organic, natural, local, healthy.

So, how is New Earth different from, say, S&S Organic Produce and Natural Foods? Well, it’s a lot bigger, for one, so the selection of items is larger. It’s also got a pizza parlor inside, and people are raving on Facebook about the ability to drink beer there. I admittedly don’t shop at S&S much—but I do love their Butcher Shop, which easily blows New Earth’s away—so I can’t offer much in the price-comparison arena. One item I do buy at S&S, Uncle Matt’s Organic Orange Juice, however, is $6.69 at New Earth, $7.99 at S&S and $6.99 at Chico Natural Foods.

I look forward to seeing how New Earth Market fits into the Chico food scene. I have a feeling there will be some growing pains, both for it and existing grocers, but I bet they all settle into their niches before we know it.

aria Del Rocio Silva, Rocio to those who know her, received a phone call on the evening of Sept. 14, 2014, alerting her that her son was being flown by helicopter from Willows to Enloe Medical Center. He had wounds on both inner forearms. Without hesitation, she got into her car and drove to the hospital. When she was finally allowed in to see him, her second youngest of 11 children, he was unconscious and covered in dirt and blood.

The next morning, Silva drove to Willows, having heard from family that her daughter-in-law was missing.

“I wanted to know where she was, to talk to her, to see her,” said Silva, a petite woman with curly white hair, as she fought back tears. “There were a lot of people looking for her, so I helped. I was in disbelief, but I wanted to find her. I went from door to door looking for her, asking people if they had seen her.”

No one had.

Later that day, Silva returned to Enloe.

Her son was still unconscious. “I was wondering why he was still dirty. His face, there was dirt all over. I tried to clean him up and it wouldn’t come off.” She scrubbed him, avoiding his arms, where there were “big holes,” trying to remove the dirt from his face, his hands, even his fingernails.

Eventually he stirred.

“He was hurting. He said something like, ‘She doesn’t want me anymore.’”

And so begins the story of Angelica Weems.

At least, it provides a point in time from which to look backward at her life and forward at her death. In fact, while her husband, Zir Weems, was lying in that hospital bed, Angelica was already dead, strangled, buried in a shallow grave marked by a Dr. Pepper can a few dozen feet from the Sacramento River. Three weeks would pass before her body was discovered there.

Zir was found guilty of first-degree murder in Angelica’s death. He was sentenced last Friday (May 13), following a two-week trial in March. Those two weeks were particularly emotional for both families, as parents and siblings were called upon to share intimate and often painful memories on the stand.

Complicating matters, those families are heavily intertwined—both of Angelica’s elder sisters are romantically linked to two of Zir’s

brothers. In an unusual twist toward the end of the trial, Zir, against his attorney’s advice, waived his Fifth Amendment rights and took the witness stand.

The events of Sept. 14—the day Zir was taken to the hospital and Angelica was deemed missing—and the day before were heavily scrutinized during the investigation into Angelica’s disappearance and described at length during the trial. Those events are pieced together here based on testimony from numerous investigators, a few witnesses and Zir himself.

On Sept. 12, 2014, a Friday, Zir and Angelica drove with their four children in their blue Chevy Astro van to his grandmother’s house in Willows. She often stayed with her boyfriend in town and let the family have the house on weekends—it was a nice escape for them, as they were living out of their van.

Zir had plans to retile the kitchen floor that weekend and his father, Tom, came by on Saturday the 13th to help. Surveillance video at Ace Hardware showed Zir, Angelica and the kids buying supplies. Angelica was wearing a black tank top and black shorts.

That afternoon, Tom made two trips to Walmart—the first receipt is time-stamped 5:43 p.m., and the second 7:52. Sometime between those two trips, while Tom was working on the kitchen floor, Zir and Angelica stepped outside. When Zir came back in alone, he told his father that Angelica had gone for a walk.

After working all day, Tom, an older man with a long, white-tinged beard that matches his hair, decided to go pick up dinner for the family. He chose a roasted chicken and potato wedges from Walmart, came back, ate, and went to bed while Zir fed the kids. This

is where Zir said his memory lapsed, sometime during the night. He doesn’t remember anything for a full week, until after he was released from Enloe.

When Tom awoke the next day, neither Angelica nor Zir were anywhere to be found.

Tom took care of the kids and eventually called Angelica’s mother, Lorena Hernandez, to come pick them up. By the time she arrived a little after 5 p.m., police were there, as were paramedics. She had no idea what had happened.

Apparently, a neighbor had called 911 after seeing a man—Zir—on the ground bleeding. Behind his grandmother’s main house is a workshop. Zir was lying near the building, where a large, nearly floor-toceiling window appeared to have been broken from the inside. He had big gashes in both arms below the elbow crease. Inside

the shop, investigators located multiple large pools of blood. Two utensils, a box cutter and a knife, were found with blood on them. The door to the workshop had been locked, via padlock, from the outside— Tom testified that he’d forgotten to put the padlock back after grabbing a shop vac the day before to clean up the kitchen floor. He remembered the next day and locked the workshop, not realizing Zir was inside.

Once on the scene, Hernandez began to ask officers about her daughter. It was the first they’d heard that Angelica was missing.

A search of the property began and yielded nothing.

Over the next few weeks, officers from the Willows Police Department, Glenn County Sheriff’s Office and the FBI mounted a massive search effort. They brought out K-9 units, had divers search the canal and

flew overhead in helicopters. About two weeks into the search, Sgt. Troy McIntyre of the Willows PD received a phone call from Aev Weems, Zir’s brother. He suggested they search the area around Ord Bend Park.

It was a favorite place for their family—it crossed his mind Angelica might be buried there. Meanwhile, both families, with the help of friends and community members, mounted their own search for Angelica.

Around 8 a.m. on Oct. 5, a group of family

members, including Angelica’s mother and stepfather, grandmother and uncle, parked on the side of the road on a gravel pullout near Ord Bend Park, on the Butte County side of the Sacramento River. Aev was leading the group. He’d gone there with his family as a child, and they’d held parties there as adults.

Sgt. McIntyre had searched the area but

hadn’t made it this far south.

On this particular day, the larger group split into three teams. They took the long, somewhat difficult walk from the pullout to the shore of the Sacramento River and set out on their search.

“After 45 minutes, I saw a sign,” recalled Victor Miramontes, a relative of Angelica’s—her father’s cousin. “There was a can hanging from a branch. I moved to my left and there was a hole. Then I moved to my right about 12 feet, and there she was.”

Aev wasn’t far away when he heard Miramontes shout that he’d found Angelica.

He ran to the group to investigate. “I had a stick or something and there was a small hill,” he said. “I moved the stick back and forth to move the sand and then I found a foot. I froze.”

tion and defense acknowledged that there was no physical evidence to convict Zir. In her opening statements, Deputy District Attorney Stacy Edwards laid out her plan to bring forth witnesses who would show that Angelica had long been abused by her husband, both emotionally and physically, which would prove he did it based on past behavior.

“This is a circumstantial evidence case,” she said. “There is no eyewitness. There is no smoking gun, so to speak; no weapon that can be tied to the defendant. There’s no confession. But at the end of this case, there is going to be proof beyond a reasonable doubt of a few things: 1. The defendant murdered his wife; 2. When the defendant murdered his wife, he intended to do so; and 3. It wouldn’t have been intended without premeditation and deliberation.”

Zir’s attorney, public defender Eric “Ric” Ortner, kept his statement brief—as defense attorney, it’s his job merely to prove reasonable doubt his client committed the crime.

He did, however, foreshadow testimony by a doctor who would shed light on Zir’s mental state and history of mental health issues.

that investigators surmised was where the sand that covered the body was taken from—and of the body, which was clad in a black tank top and shorts. Personnel from the Human ID Lab at Chico State were called to assist in moving the body—an autopsy was scheduled for a few days later.

“I ultimately was able to do an internal examination of the body and I identified what I characterize as a fractured hyoid bone,” Thomas Resk, the pathologist who performed the autopsy, told the jury. “It’s a horseshoe-shaped bone that sits up high in your throat. It’s compressible.”

He determined Angelica’s cause of death to be asphyxiation due to manual strangulation. In order to fracture the hyoid bone in such a manner, Resk said, one would have to apply pressure for a matter of minutes; exactly how many he wasn’t sure. This was a contentious issue for Ortner, who questioned Resk at length on the time element. Resk stayed firm with his conclusion, however, that her death took minutes—not seconds.

That was the bulk of the physical evidence found. The only other item of interest was a Dr. Thunder can in the family van (Dr. Thunder is Walmart’s version of Dr. Pepper) indicating, in addition to testimony, that Zir’s favorite soft drink was Dr. Pepper.

Investigators also obtained paperwork from April 2014, when Angelica went to Catalyst Domestic Violence Services. On her intake form, where it asks what types of abuse a victim is reporting, she checked almost every single box: emotional, physical, threat of physical, sexual, threat of sexual, stalking and strangulation. The only one left unmarked was “unknown/unspecified.”

In lieu of physical evidence, Edwards focused on bringing up witnesses who could attest to Zir’s general treatment of Angelica.

Several TJ Maxx employees who worked with Angelica testified that they’d seen her with bruises. Many also remembered Zir sitting in the family van behind the store while Angelica worked. If he wasn’t there, he often called numerous times during her shift.

One co-worker testified that “She never

introduced me to him [Zir], but I saw him waiting out behind the store for her—a lot, like I couldn’t even count how many times.

Almost every shift.” Did she ever answer the phone while working at TJ Maxx, Edwards asked. “Yes. He would call—sometimes multiple times within a four-hour shift.”

Another said she’d noticed bruises around Angelica’s neck. “It looked similar to a handprint, purple bruising,” she said. “They looked like fingerprints.”

Zir denied many of these claims. “I never hit my wife,” he said when he took the stand as the case’s final witness. His dark brown hair was shoulder-length—short in comparison to his father and brothers—and his face clean-shaven. He mumbled when he spoke, possibly an indication of partial hearing loss.

While he admitted he may have left bruises on Angelica’s arms from grabbing her too hard, he said he never hit her. The lower back bruise a few people mentioned, which Angelica had told them was from Zir kicking her: It was a sledding accident, he insisted.

The day in January 2014 that many of Angelica’s co-workers remembered because she arrived with two black eyes: A woman had punched her in the parking lot of the Optimo Club in Paradise, he claimed. The couple never pressed charges and Angelica did not seek medical attention.

By the end of summer 2014, Angelica was on the verge of being fired from TJ Maxx for showing up late or being absent from work too many times, her managers told the jury. Just a few weeks before she

went missing, she quit her job. This, despite being the sole moneymaker for the family.

One night during the summer of 2014, a few

months before Angelica’s disappearance, she went to the home of a friend, Vanessa Granados, a co-worker of hers at TJ Maxx.

She had the four kids in tow and she was scared.

“She said she came because she was afraid for her life and her children’s lives,” recalled Esperanza Granados, who was living with her daughter, Vanessa, at the time.

Vanessa had gone to bed, she said, and Angelica opened up to her. “She was crying. She said she was afraid of her husband because he was mistreating the children and her. She said very often he would hit her.

He’d also try to choke her—he did that more than one time.”

Angelica described to Granados a recent incident when she and Zir were lying in bed and one of the children started to cry.

“She told me that she tried to get up [to tend to the child] and her husband wouldn’t let her get up from the bed. He used a lot of pressure—she was very close to where she couldn’t breathe.”

That night, talking in whispers in the living room while the children slept, Angelica foreshadowed her own death. “She asked me that if anything ever happened to her, if

I would take care of her children for her,” Granados said. “And I said, ‘Yes.’ “She said she feared for her life and she felt that death was very close to her.”

That was the last time she ever saw Angelica.

When it came to family, nothing was ever

simple for Angelica and Zir, both of whom grew up in homes with abusive fathers. But, aside from a few instances in which Angelica reached out for help and admitted problems with Zir, she preferred not to speak up.

“Angelica always wanted peace,” Cynthia, Angelica’s eldest sister, said during an interview after the trial. “She never wanted to make ripples, even if there was a reason to.

Peace was more valuable to her than arguing.”

She smiled, tears rolling down her cheeks, as she remembered her sister, whom she regretted not having a chance to get to know well as an adult. “She was really pretty,” she said. “And she was wickedly funny, although not a lot of people got to see that side of her.

If you didn’t know her well, you saw a shy, quiet, pretty girl. She hated compliments— she’d get so red, she did not like that.”

Cynthia started dating Aev, who’s a year and a half older than Zir, when they were in high school. She was attracted to his unique name—all of the Weemses have unusual, hippie-type names, and most of the men wear

their hair long, like their father. They had fun together, hiking in Bidwell Park, having picnics. Sometimes Cristina (the middle sister) and Angelica would come along, and so did some of Aev’s siblings. Cristina and Tov, the youngest Weems brother, hit it off. But from the beginning, Cynthia said, she noticed something “off” about Zir. She recalled one incident, shortly after she met him, in which she mistook something Zir had said for a joke, returning his comment with a quip. “Zir pulled a kitchen knife out,” she said. “I was like, ‘Are you kidding me?

Who does that?’ But Aev really softly intervened. So, I realized something was way off with Zir just a few months in.”

Cynthia also didn’t like the way Zir seemed to objectify women. “He would say the nastiest things about women who’d shown him a good time.” So, when she first noticed Zir and Angelica getting close, she vehemently opposed the relationship. She admits she’s not the peacekeeper Angelica was, never afraid to speak her mind.

“I immediately said, ‘This is not OK. You cannot be with my sister,’” she said. Aside from his disturbing behavior, he was five years older than Angelica, who was just 14.

Their mother also disapproved. “I saw that he was very—I don’t know the word—very dominant with her,” Hernandez said during testimony. “He did not want her to be around me.” Zir did not speak Spanish and he forbade Angelica from speaking it with her mother when he was around.

When Angelica was 16 and pregnant with her first child, she asked her mother 10 times to sign a document allowing her to marry Zir. Finally, about a month before the baby was due, Hernandez relented. After they married, she said—it was a quickie ceremony in Reno and she was not invited—he whispered in her ear one day, “Now she’s mine.”

Over the ensuing years, Angelica made several attempts to leave Zir, many with the help of her family and sometimes his. He always went out searching for her, driving as far as a family member’s house in Gerber to track her down. And she always went back.

In 2011, after one of these incidents, Zir and Aev were talking while their families were at the park. Zir told Aev, “If she ever leaves me again, heads will roll, starting with Cynthia and Lorena.” After that, and other threats, Aev and Cynthia took a stand: They would no longer attend family events if Zir would be there.

He was no longer welcome in their home.

Because he rarely allowed Angelica to socialize without him, that put a wedge between the sisters. But it was also difficult for the whole family, which had to accommodate.

Zir acknowledged a rift among siblings, but denied ever threatening their lives.

The longest period of separation between Angelica and Zir occurred in April 2014. She first approached two of Zir’s sisters for help; other siblings brought her to Catalyst and then to Oroville so she could

file paperwork for a restraining order. She even got help to move her things into storage.

“She told me [then] that she wanted to rent an apartment for her and her children and she wanted to go to college to be a nurse,” Hernandez told the court, in tears.

“She wanted to get a divorce and have custody of her children.”

What some of Angelica’s family may not have known was that after launching an initial search for his wife and children, Zir checked himself into Butte County Behavioral Health with what he characterized as severe depression. He ultimately was sent to a mental health facility in Sacramento, where he stayed for about a week. He was put on medication, which he told the jury he didn’t like taking, but it helped.

Shortly thereafter, Angelica and Zir got back together again.

One night about a year before Angelica’s

murder, Zir showed up at the home of Hernandez and her husband, Jaime. He banged on the door. Jaime answered, with Hernandez just behind him.

“He said to me that I should not go

around my daughter or the children anymore,” Hernandez said in Spanish, which was translated for the court. “I asked, ‘Where is my daughter? I want to speak to my daughter!’ He said he did not want me to see her anymore.”

It turned out Angelica was in the couple’s truck—sometimes they drove a truck, other times the van—with the kids, who were sleeping. Hernandez ran to her, looked at her through the window.

“I said, ‘Angelica, say something to me so I can help you.’ He was at the window on the driver’s side, at the window looking at her. He told me to leave her alone and that she did not want to know anything about me.

“She only said to me, in English, ‘I don’t have nothing to say, Mom.’ That’s it. She had a face that showed a lot of fear and she could not say anything else.”

Hernandez and Angelica worked together at TJ Maxx, and they attended family functions together, but Zir was always pushing to keep them apart.

After the prosecution rested, Zir’s attorney,

Ortner, called in Dr. Kevin Dugan, a forensic psychologist who had examined Zir while in Butte County Jail. In order to create a full psychological picture, he said, he looked at old medical records and records regarding the case.

He noted that Zir suffers from paranoia, shows a lack of impulse control, as well as an inability to learn from experiences, and displays difficulties in cognitive functioning. He has a history of mental health problems dating to childhood—his mother indicated early developmental mental health issues—and within the past several years, 2014 in particular, had been hospitalized and placed on psychotropic medications, possibly indicating paranoid schizophrenia or a general personality disorder.

Zir had two significant head injuries—the first was a shotgun blast that Zir reported as accidental but some say was a suicide attempt.

It took off part of his ear and left him partially deaf. The second was a work-related injury during which a piece of machinery exploded nearby, leaving him permanently dizzy, requiring medication for balance and rendering him disabled. (Cynthia pointed to this injury—in 2011—as a significant time-marker. He was never the same afterward, she said; that’s when everything got worse.)

Dugan described Zir’s reactions during their visits as knee-jerk and paranoid. “He had poor self-control, emotionally and behaviorally,” he said. “Of all the criminal defendants I’ve evaluated over the years, I was very thankful I was behind the glass at times.”

when she died—and filled with little tragedies, but also great joys. First and most important, she had four children she adored.

And while arguably the two most important men in her life, her father and husband, were

abusive and negative forces, the women were sparks of light.

Based on Zir’s trial, it was clear that Angelica had a large and supportive group of family and friends. They were concerned for her and deeply saddened by her death.

When she sought help, she found it. But, as many women in abusive relationships do, she continually returned to Zir, a man who hit her, belittled her in public, stalked her and isolated her from the people she loved. And eventually killed her.

The jury deliberated for less than a full day on the case. And in the end, they had three choices: not guilty, guilty of second-degree murder and guilty in the first degree. They chose the latter, meaning they’d determined that not only had Zir killed Angelica, but he’d done it intentionally. Edwards’ closing argument put that last part into particular focus. She set a timer for one minute and asked everyone to be silent. A minute is a very long time when put in the perspective of strangulation, an extremely intimate way to kill a person.

Zir was sentenced to 25 years in prison before possibility of parole. Many family members attended the hearing, most of them wearing purple—the color assigned to domestic violence awareness. Some of them, including Silva, Zir’s mother, cried. Some looked relieved; others just tired.

Zir will serve his time for his crime, but the repercussions will be felt forever, Cynthia said. Angelica’s four children lost not one but both parents. She and her siblings lost a loving sister; Hernandez a daughter. For her part, Cynthia said, she’s committed to not being silent and instead educating people— especially young people, starting with her own children—about domestic violence and when to speak up.

“I feel like it’s now my duty to share Angelica’s story,” she said. “Her life was robbed, and nobody can do anything about that. But I want to tell Angelica’s story so that other people can take from it our mistakes, our experiences, and change something in their lives.” Ω

In 2015, the band—rounded out by drummer Nick Yacyshyn and bassist Brian Cook (also of Botch)—released its debut LP The Deal, which boiled all of the aggression and noise inside Turner’s head into one streamlined steamroller.

“I wanted to maximize a small set of tools to create texture and feeling; having this world that people—and us, too—can be consumed by,” Turner said during a recent telephone interview. “Just made in a simple way.”

That philosophy continues on the band’s forthcoming album, What One Becomes, out June 10 on the dependably eclectic and out-there Thrill Jockey Records. The record is fantastically intense and soothing. Songs like “Clutch of Oblivion” and the sprawling 17-minute “Blackout” will indeed engulf listeners, sometimes taking them on journeys without resolutions.

Turner says that while the material he writes for Sumac consists of more calculated pieces, most of it springs up out of improvisation. He recalls his father listening to jazz when Turner was a kid growing up in Santa Fe, N.M. The music seemed foreign at the time, but the influence of jazz and modern composition has crept into Sumac’s music as much as metal or post-punk. Turner says he likes the uncertainty of it all.

“Jazz introduces a theme before it dissolves and comes back into focus,” he explained. “There are anchor parts to grab onto, but sometimes they’re just out of reach. It’s a good analog of what life can be like.”

A lot of the spatial elements in Sumac’s music can be traced to Turner’s formative years in Santa Fe. There was an arts scene there, for sure, but he says a lot of it was aimed at tourism and maximum commerciality. More important to him was the city’s connection to Spanish and Native American history.

“I had a tangible connection to history

that deeply played into a sense of place,” said Turner, who added that the spacious landscapes of New Mexico play into his songwriting. “I carried that with me the rest of my life.”

Sense of place and environment are recurring themes—Turner has seen the world at its most serene, and also at its most insane. He spent his last couple of years of high school in Boston, where he formed Hydra Head and then Isis. He moved operations to the bustle of Los Angeles soon after, where he lived for years. Turner even spent some time in Japan, where he notes that as stimulusgorged as the country might be, the people there still know how to find refuge in a temple or even at a restaurant.

Turner and his wife, Faith Coloccia (whom he plays with in Mamiffer), have taken up residence on Vashon-Maury Island, in Washington’s Puget Sound, where he writes and records ideas for Sumac at their home. Turner says he’s been more creative there than he was during his many years in L.A. Ironically, his need to be working on something at all times doesn’t translate to the more deliberate pace of Sumac. It’s his escape; and likely that of those who listen.

“My hope is that people will hear some, and then want to hear some more,” said Turner. “I hope our music will offer a point of departure from their otherwise EXV\ OLYHV ³ Ɛ

Joshua Kosman, writing in the San Francisco Chronicle, said of the 39-year-old Bates that he “writes music that is simultaneously oldfashioned in its outlook and bracingly new in its demeanor, and it satisfies the same urge for accessible novelty that people find in the other arts.”

Mothership, Bates himself has written, “shares a formal connection with the symphonic scherzo but is brought to life by thrilling sounds of the 20th century—the rhythms of modern-day techno in place of waltz rhythms, for example.”

As I say, it was wild, full of

almost violent drumming and pulsing electronica. Conductor Scott Seaton and the musicians seemed thrilled to be playing such an innovative piece, and the audience responded with passionate applause.

This was followed by Giacomo Puccini’s early orchestral work, the Preludio Sinfonico, written when the great Italian opera composer was just 17 years old. It’s a lush and soothing work, and as such a fitting change from the intensity of Mothership and a bridge to the next piece, Beethoven’s “Leonore Overture, No. 3.”

This is one of four overtures the composer wrote for his only opera, Fidelio, and is considered too powerful and dramatic to be anything but self-sufficient. It’s performed often, however, because it’s also considered one of Beethoven’s greatest works, like a compressed version of some of his magnificent symphonies.

The opera is about a woman, Leonore, who disguises herself as a man named Fidelio in order to rescue her unjustly imprisoned husband, Florestan, from a Spanish dungeon. It is notable especially for its use of an offstage trumpet call to signal his liberation and ending in a joyful celebration of freedom and conjugal love that is as “heroic” as anything Beethoven wrote. Seaton and the orchestra didn’t hold back, and the audience responded enthusiastically.

Rachmaninoff’s “epic” and “fiery”

(Seaton’s words) Symphonic Dances, which followed intermission, was the last work he composed before his death in 1943, in Beverly Hills.

Best known perhaps for his astonishing piano concertos, with their virtuosic demands and soaring melodies, Rachmaninoff in his later years began infusing his symphonic compositions with greater rhythmic complexity.

This is especially true of Dances, which, as many commentators have pointed out, includes a modernist rhythmic element reminiscent of Stravinsky’s The Rite of Spring while retaining Rachmaninoff’s typically lush harmonies and serving as a review of his life and career.

Its performance concluded a remarkable concert, one in which Seaton and the orchestra succeeded in meeting huge challenges, beginning with Mothership and ending with Rachmaninoff’s greatest symphonic creation.

It was also a fitting end to Keith Herritt’s tenure as executive director of the North State Symphony. Clooney gets plenty of half-ironic physical action within much the same restricted circumstances, but nothing to match the precision and conviction Foster shows in fine-tuned reaction shots and rapid-fire decision-making.

O’Connell (Starred Up, ’71, Unbroken), who is English/Irish, manages a credible East Coast workingclass accent. Esposito’s Capt. Powell has the calm authority of a kind of exotic royalty.

Dominic West and Dennis Boutsikaris are good as two different kinds of scoundrel financiers, but neither is a match for Caitriona Balfe’s gently stinging rendering of the publicity assistant who gets the satisfaction of exposing them both.

Christopher Denham is good in spite of a role (as Gates’ overworked assistant) that overindulges the slapstick comedy elements in ostensibly satirical moments. Emily Meade, as Budwell’s estranged lover, is a terror in her moment as a reality-TV femme fatale.

Lenny Venito gets the maximum out of a tiny part as a doggedly devoted cameraman named Lenny.

Overall, Money Monster alludes to a laundry list of political and economic controversies, but ends up backing away from its own potential for a more scathing kind of satire. □

Times have changed. Avocados are now a $300 by to $400 million Alastair crop in California Bland (the drought and Mexico’s surging exports have caused fluctuations in recent years), and the fruit is so coveted that San Diego County keeps a district attorney on the payroll who specializes in prosecuting avocado thieves.

The industry is also dramatically homogenized. Though hundreds of varieties of this New World jungle native exist, the ubiquitous Hass rules the groves and the retail market.

Some of us have heard of Bacon, Lula, Pinkerton, Reed, Fuerte and Zutano avocados, but these avocados are much harder to find.

The first Hass avocado sprouted randomly and namelessly from a seed in a yard in Whittier in 1926. A man named Rudolph Hass eventually purchased the seedling tree from its owner and planted it in his own yard. Its fruits became popular among neighbors and friends. Grafts were made, and in

following years and decades the Hass avocado would be cloned millions of times and become the leading commercial variety around the world. Among farmers and packers, the fruit is favored for its tough skins, which allow for long-distance shipping. Hass avocado trees also bear consistent crops year to year, whereas some competing varieties tend to produce a large crop only every other year, and for most farmers in the business of making money, Hass is the avocado of choice.

But some avocado enthusiasts assure that, in the wide world of avocados, the Hass is among the inferior kinds. On the Kona Coast of Hawaii’s Big Island, farmer Ken Love, who has collaborated with UC Davis and the U.S. Department of Agriculture in experimental cultivation of many fruits, has closely studied and evaluated at least 15 varieties of avocado.

Some are endemic to Hawaii, several are fantastic, and California avocado growers, as Love says, “need to get out more.” Love jokes that he doesn’t let his horses eat Hass. He much prefers varieties like the soccer ball-sized Ohata avocado, the faintly sweet Serpa,

and the Yamagata—which first appeared as a feral seedling not far from Love’s farm. Love once ran a blind taste test of locally grown and imported avocados on a group of Hawaiian chefs. Winning varieties included the rich and buttery Kahalu’u and the islands’ favorite, Sharwil. Californian Hass flunked.

While Hass avocados from Chile and Mexico regularly arrive in California—and even in Hawaii—in great numbers, until recently, Hawaii-grown avocados were forbidden entry into the U.S. mainland. In 2013, the USDA approved the popular Sharwil for import, but all other varieties are still banned.

But even in Chico, a variety of flavorful avocados can be found.

Chico Natural Foods frequently carries several types from small organic farms in Southern and Central California. The Reed avocado, says the store’s produce buyer, Kevin Durkin, is a large, creamy-fleshed variety; the Zutano is sweet with a very light, silky texture; the Gwen avocado is fairly oily; while the Bacon avocado has a smoky taste. And if none of those kindle your appetite, almost every store in the world carries Hass. □

IN THE MIX A Moon Shaped Pool Radiohead XL Recordings The exhilaration of Radioheadâ&#x20AC;&#x2122;s latest release, A Moon Shaped Pool, is in the albumâ&#x20AC;&#x2122;s intimate confidence in the listener. It captures the band in its most arresting, even delicate form, and as a result ranks as one of Radioheadâ&#x20AC;&#x2122;s best recordings. If the albumâ&#x20AC;&#x2122;s title contrasts the ordinary with the ethereal, the same can be said of the music reflecting back. Fans of the band will hear moments that have been performed live as far back as 2001. The bandâ&#x20AC;&#x2122;s patience in finding these songsâ&#x20AC;&#x2122; most suitable arrangements and recorded form is admirable and pays off. In turn, the albumâ&#x20AC;&#x2122;s languid warmth offers much for the listener to discover and ruminate on. Its orchestral leanings and thoughtful pace transcend the oft-traveled rock-music tropes. Thom Yorkeâ&#x20AC;&#x2122;s plaintive vocals over electronic flourishes and piercing string sections vividly color the vast sweep of sound. Yet itâ&#x20AC;&#x2122;s the minimalist â&#x20AC;&#x153;True Love Waits,â&#x20AC;? closing the album with piano and Yorkeâ&#x20AC;&#x2122;s agonizing, poignant voice that makes each listen of A Moon Shaped Pool impossible to shake.

The German duo Mantar made quite a ruckus with 2014â&#x20AC;&#x2122;s Death by Burning, which combined classic American thrash with slower, noisier bits of shrapnel and debris. The band got snatched up

by Nuclear Blastâ&#x20AC;&#x201D;the label responsible for classic bands like Carcass, Immortal and Slayerâ&#x20AC;&#x201D;and with Ode to the Flame, Mantar has picked up right where it left off. Like Mantarâ&#x20AC;&#x2122;s debut, Ode is loaded with memorable riffs and dirge-y interludes, but this time the bandâ&#x20AC;&#x201D;guitaristvocalist Hanno and drummer-vocalist Erincâ&#x20AC;&#x201D;mixes up the tempos and dynamics better, especially on â&#x20AC;&#x153;Praise the Plague.â&#x20AC;? And the duoâ&#x20AC;&#x2122;s not afraid to touch on rock â&#x20AC;&#x2122;nâ&#x20AC;&#x2122; roll on songs like â&#x20AC;&#x153;Era Borealisâ&#x20AC;? and album-closer â&#x20AC;&#x153;Sundowning.â&#x20AC;? Monolith of Phobos The Claypool Lennon Delirium aTO Records In one of the more surprising partnerships in recent rock history, omnipresent freak-funk bassist Les Claypool (of Primus) and songwriter Sean Lennon have joined forces, and the results on Monolith of Phobos are quite good. There are similarities with some of Claypoolâ&#x20AC;&#x2122;s previous atmospheric, bass-led sound collages, such as on the albumâ&#x20AC;&#x2122;s title track, but this is also a more mature Claypool and presumably a more experimental Lennon. Both have locked into a maelstrom of musical strangeness that hits on psychedelic otherness.

And on tunes like the Lennon-sung â&#x20AC;&#x153;Cricket and the Genie (Movement I, The Delirium),â&#x20AC;? a song about a patron saint of prescription drugs that explores the dark side of dependency in progressive strokes of musical mayhem, the duo is a match made in outsider heaven. utes into a workout on a warm day I look like someone is pouring a bucket of water over my head while another person simultaneously blasts me with a garden hose. You can watch the sweat flow right in front of your eyes. And this past weekend, on an insanely gorgeous spring day in San Francisco, I worked up a worrisome amount of sweat as I ran all over aT&T Park with several thousand weekend warriors for a recent installment in the spartan Race series. This was a Spartan Sprint, one of the company’s shorter races (there are also 8-, 13- and 26-mile versions, many including mud and fire obstacles).

It featured 3-plus miles of running around the stadium, much of it up stairs, with 20 stops at different obstacles along the way—scaling 7-foot walls, running with 30-pound sandbags, jumping rope with a giant, heavy-ass rope, etc. Just another day at the ballpark! (There’s actually a documentary coming out in September, Rise of the sufferfests, that attempts to answer why obstacle-course races have become a worldwide phenomenon.)

The truth is—despite my almost passing out from dizziness while doing box jumps in left field (unleashing a bonus wave of cold sweat from every pore)—the workout wasn’t too bad thanks to my preparations with Taylor Wakefield, trainer of the Obstacle Course Racing class at in Motion Fitness.

There was a whole 10-person inMo oCR team (which included Mrs. dEVo) that ran together (and added all together, the other nine didn’t sweat as much as I did) and most of us agreed that some of our workouts in Chico were harder than the AT&T race.

It was actually pretty damn fun. So thanks, Taylor, for helping me keep the gut to a minimum, and thanks for helping all of us have a day that was more “funfest” than “sufferfest.”
