Not unpopular enough Donald Trump is less popular than head lice. And root canals. And traffic

jams, used-car salesmen and jury duty. But good news, Republicans, he’s more popular than cockroaches and hemorrhoids! (Among men, anyway.)

These aren’t jokes from late-night hosts, but rather actual results from a legitimate pollster. PPP (Public Policy Polling) asked voters about their preferences and their views on the remaining candidates; on Trump, the unfavorability is astounding.

Great news for Democrats and everyone else who’s #NeverTrump, right?

Not so fast. The GOP has a loathsome figurehead, seemingly destined to lose the White House and torpedo down-ticket races in November, yet he’s getting embraced more than shunned.

The same poll shows nearly three out of every four Republicans are comfortable with Trump as their nominee. Primary opponents who lambasted him as an irresponsible loose cannon now make the rounds touting him.

House Speaker Paul Ryan, slated to meet Trump today (May 12), drew fire for taking the oh-so-cautious stance of being “not ready” to endorse.

So much for a schism—if Nero is fiddling, Republicans don’t hear it; neither the leadership nor the rank-and-file voters see a party burning to the ground.

Obviously, we’re concerned about the ramifications for November. This presidential election already carried extra significance with the balance of the Supreme Court at stake. Now there’s the prospect of an erratic egomaniac making that and myriad other decisions with life-and-death consequences.

What’s just as disconcerting is the collective shrug of acquiescence from supposed people of conscience.

Trump hasn’t undergone a radical change. He may say he’ll become “more presidential” and that he’s been playing a character on the campaign trail; so far, there’s no evidence he’ll recant the xenophobia, sexism, etc.

Yes, Trump is unpopular—just not unpopular enough. □

With California being the largest state left to hold its primary election, it’s possible that our votes will help determine the winner. Here’s the catch: If you’re one of the more than 500,000 California voters registered in the American Independent Party, you’ll be left out.

California has what’s called closed primaries. What that means is, if you’re a registered Democrat, you’ll have no trouble at the polls if you want to vote for Sanders or Clinton. If you’d prefer to cast your vote for Donald Trump, however, you’re out of luck—only registered Republicans can vote for Republican presidential candidates. If you checked the box that says you decline to state your party, you’ll be able to vote, but only in Democratic, American Independent and Libertarian presidential races—you can choose at the polls or fill out a form sent to you if you vote by mail.

Here’s the rub: A survey by the Los Angeles Times recently found that three out of four voters registered as American Independents actually checked the wrong box when filling out their registration form. They mistakenly thought they were declaring themselves independent, as in someone who makes his or her own decisions. What they actually did was join the far-right American Independent Party. Those voters will receive AIP ballots come June 7 and will not be able to vote in the Democratic or Republican presidential race.

It’s actually very easy to check your registration status, and if you’re at all concerned, we urge you to do so soon. The final day to register before the June 7 primary is May 23. Same goes for changing party affiliation.

evangelist hold a rapt audience of about 400 local Protestants and curious onlookers at Chico City Plaza. Men and women in yellow and blue T-shirts walked among the crowd and combed the streets talking to anyone who would listen.

A 71-year-old with a strong accent enthused to me about how, after 27 years as a police officer in Sydney, Australia, he sold his house, moved to Redding and enrolled in a program to make him a follower of Jesus.

before God, and that his resurrection promised the hope of life after death.

I was confused. I always thought Christians were a sort of community glue, dutifully gathering each Sunday morning, unobtrusively putting in 40-hour weeks, being good neighbors working for the betterment of the city.

But didn’t Jesus himself visit towns throughout Galilee proclaiming, “It’s zero-hour—time to make a decision about where your life is going”? Didn’t people abandon their possessions to follow him?

Didn’t Jesus and his followers (intellectuals, business women, slaves, beggars) turn society on its head—all of them proclaiming: “Something new has happened”?

Now you know why I was troubled. Imagine that happening in Chico—not with people from Redding and Richardson Springs, but from the 60-plus Christian groups here. Imagine churches churning out teenagers, soccer moms and 71-year-olds ready at the drop of a hat to tell about new possibilities of living.

Why, I think I’d even cozy up to all the young-earthers, cyclopic literalists and holy rollers just to be part of something that big. Contact me at alf48.such@mail.com if you’re troubled as I was and let’s do something about it. □

by Robert Speer, May 5): Sitting before the Chico City Council Tuesday night (May 3), I suddenly felt like I had morphed into a rerun of Mr. Smith Goes to Washington, James Stewart’s great movie about a naïve rookie U.S. senator.

Sen. Smith’s loss of innocence very much matched mine when the Chico City Council voted 4-3 (along ideological lines) to essentially give the Chico Scrap Metal yard a free pass.

For the conservative majority, it was one of the easiest votes they have made since coming into office.

Re “Finding wholeness” (Cover story,

by Gabor Maté, May 5): Dr. Gabor Maté’s recent cover story suggesting that holistic and integrative medicine are the Holy Grail in preventing and treating illness may misdirect readers into the realm of magical thinking.

As unappealing as it may be to Maté, scientific findings, which are often tentative and suggestive in nature, are preferable to his absolutes grounded in the speculative relationship between emotional health and disease. Mainstream medical research has a long history of investigating such links and most, if not all, such studies have failed to confirm Maté’s hypothesis.

Victimblaming, which is one outcome of this line of thought, is not congruent with more recent medical research. I suggest that readers interested in a scientific perspective lacking in hyperbole consult such sources as the work of Robert Sapolsky and his highly readable Why Zebras Don’t Get Ulcers.

Supporting Bernie Sanders has been an exercise in intestinal fortitude during the past few months. For at least that length of time, the talking heads have been counting the Vermont senator out. I’ve read numerous reports claiming that it is impossible for him to catch Hillary Clinton. Impossible? No. Improbable? I’ll concede that.

But Sanders is on a roll again. Monday night, 16,000 supporters attended a rally in Sacramento. The next evening, he handily won the primary in West Virginia (by double digits). The win won’t come close to erasing his deficit of pledged delegates. However, it will give him momentum going into the other upcoming contests, including the biggie, the great state of California.

Sanders trails Clinton by fewer than 300 delegates. More than 450 are up for grabs in the Golden State alone. That’s not including those so-called superdelegates, of course (see Ken Smith’s write-up in this Primary Issue, starting on page 18).

Despite the Clinton campaign’s posturing, it’s clear that Sanders is not out of the game. For starters, she resumed spending money on ads this week in Kentucky. Moreover, the narrative on network and cable news programs following Sanders’ win has focused on him blocking Clinton’s path to the nomination.

Perhaps the interest in that story has ramped up because Donald Trump’s drama has died down. In other words, now that The Donald is the presumptive GOP nominee, and he’s no longer trading barbs with Sen. Ted Cruz, et. al., TV news has looked elsewhere for a good angle moving forward.

After all, everyone loves an underdog story.

But that’s not why this journalist is supporting Sanders. I’m going to vote for the white-haired senator because I think he’s the better of the candidates. I trust him more than Clinton on every issue, including gender equality. That’s because Sanders is authentic.

He’s been consistent in his progressive ideals, from civil rights and environmental justice to universal health care and ending corporate cronyism.

The messages Sanders has conveyed make him a remarkable candidate. And he has the résumé to back it all up. I mean, this is a guy who participated in the March on Washington, where Martin Luther King Jr. gave his “I Have a Dream” speech. This is a guy who was arrested for protesting segregation. This is a guy who has brought to the national stage critical issues that Clinton wouldn’t otherwise have had the courage to address (e.g., fracking, Wall Street reform, campaign finance, student loan debt).

That’s both beautiful and depressing.

The dreary part is that we’re never going to see a candidate like him again—not in our lifetimes. Because he’s 74 years old, Sanders is a now-or-never nominee.

Considering Sanders does better in the polls against Trump than Clinton, it wouldn’t be a leap of faith for the Democratic Party to support him. It would actually be the smart, pragmatic move. The question is whether the establishment has enough grit. If the popular vote miraculously goes to Sanders, the only way to preserve the party may be to start feelin’ the Bern.

And in the eternal words of the late Yogi Berra, “It ain’t over till it’s over.”

It was much easier for the advocates of The Esplanade when they addressed the council earlier in the evening. Those neighbors came away with at least a momentary victory.

Maybe the scrap metal yard does not pollute. Maybe Flint, Mich., has wonderful drinking water. And maybe someday Chico’s citizens will think twice about electing a City Council member who previously was a paid consultant for CSM’s owners.

Unlike Sen. Smith in Washington, our ending stinks.

The City Council’s conservative majority is a blight on the community. Those four members are unwilling to do what is right because of misguided cronyism or downright laziness. The Chico Scrap Metal facility needs to move.

It is the nature of the waste stream that they have polluted in the past and will pollute in the future.

A lead specialist writes: “Lead poisoning in children is especially pernicious, as symptoms are often disguised as cold or flu-like symptoms that don’t seem to go away, hyperactivity, inability to concentrate, and even no apparent symptoms. It doesn’t take much to lead poison children.”

And what about PCBs? Equipment and material manufactured before 1979 include: automobiles, automobile parts, transformer shells, hydraulic equipment, electrical equipment parts, greasefilled insulated electrical cable, ignition coil capacitors, drums and containers, major home appliance capacitors. Common items!

Where is the conscience of this community?

The conservative council had not one word of concern about the children living near the facility. It is a disgrace and amounts to criminal negligence. The issue remains that the business is polluting the environment of a residential neighborhood, and it is intolerable to let it remain, no matter how entrenched it has become.

Recalling a bright summer morning decades ago when first cycling the lovely Esplanade and being stunned at the realism of the Greek Doric pillars on Taylor Hall. We had to reach out and feel this alluring three-dimensional illusion to ascertain its authenticity.

It became tragic to witness this masterpiece disappear but even more enthralling to see it restored as one of the world’s greatest murals.

The Esplanade, too, has historically illuminated the town like a beacon of magnificence and beauty seemingly forever. Yet unlike the gifted creator of “Academe,” there exist no creatures alive—not even all the king’s horses—who are brilliant enough to bring back to life this precious and sacred promenade once it has crumbled into fragments forever. It is quite challenging to enjoy life while going around in circles. It also makes it more difficult to closely “follow the money.”

The picture in this week’s CN&R shows a dangerouslooking crosswalk with high school students trying to cross. To me, this looks more like a problem with drivers not obeying the law that states that when a pedestrian is waiting to cross or crossing in the crosswalk that the pedestrian has the right of way and not the driver.

The drivers are zooming by as if it is their right. It is not their right, and perhaps more cops should be on The Esplanade, especially during school hours, to ticket those who ignore the rules. Also, make them read the DMV driver’s manual.

Driving south on The Esplanade in the early morning, three out of five days there will be someone who jams through on a yellow or red light at First Avenue. And that’s just one light cycle during commuting hours.

We all have time, the same number of hours in a day. Being a little more generous with our time, willing to wait a minute or two at the intersection, would be an immediate simple solution to saving lives and making our community a little safer for us all—pedestrians, cyclists and drivers alike.

Props to the arts editor Re “A Chico mix” (Cover story, April 28): Jason Cassidy has reached some sort of pinnacle as a curator, historian, journalist, storyteller and town griot. It’s one thing to be the arts editor of a local newspaper, but Jason has turned it up a notch.

As evidence, I encourage local music fans to type “Best Chico Songs” into YouTube. There you’ll find the logical extension of a print publication into the digital world. This artifact of culture obviously took many of hours of work beyond his job description.

I’ve left that website on in the background all week, so I can randomly hear songs by Morris Taylor, Vomit Launch, MaMuse, Mother Hips and many others back to back to back.

It’s the soundtrack of our town’s narrative and a model of great entertainment news coverage that other communities should be encouraged to emulate. As I watched him gleefully and proudly hand out award after award at the CAMMIES this year, I couldn’t help but think Jason deserves the biggest award of all for his unwavering support of local music, arts and culture. Maybe a permanent statue out in front of Duffy’s Tavern? Bravo, Mr. Cassidy.

‘The big question ...’

Re “Love, not tough love” (Letters, by Patrick Newman) and “Bittersweet success” (Newslines,

by Ken Smith, May 5): In response to Mr. Newman’s decidedly predictable response to my letter. In my time on the streets, drug and alcohol addiction among the homeless population seemed the rule rather than the exception. The statement that 95 percent of people on the streets are there under different circumstances seems rather generous. No matter what the reason, the big question is what are they doing to remedy their situation?

The recent Project Homeless Connect is a big step in the right direction. These are the kinds of services the homeless need. They are a prime example of a “hand up” instead of a “hand out.” I’d be interested to see how many people follow up and further utilize the

services offered.

But it’s like the saying goes: “You can lead a horse to water but you can’t make him drink.”

We can offer all the services we want, but it’s up to the individual to put forth the effort to make the services work. If we make it easy to be homeless, then where is the incentive to seek services and change?

Hail to the chief Over the years, Chico State’s University Advisory Board has had a bird’s-eye view to observe President Paul Zingg as he deftly handled the challenges associated with his work. During his tenure, Chico State has thrived, achieving levels of student success and institutional excellence not seen before.

Vote yes on E The Sacramento River and Feather River basins together constitute a large portion of California’s water supply. Therefore it is especially important that we in Butte County avoid contaminating our aquifers by fracking—a method of fossil fuel extraction in which rock strata thousands of feet below the surface are fractured by injection of millions of gallons of water mixed with chemicals such as benzene, thereby allowing fossil fuels trapped within the strata to be released. Unfortunately, the

groundwater can be contaminated by both the chemicals and the fossil fuels. Therefore I request that you vote yes on Measure E, which will ban fracking in Butte County.

Various documentaries have filmed people who live near fracked wells actually lighting their tap water on fire due to contamination of their well water with fossil fuels. People living near fracked wells have reported serious health problems and wilted crops.

Fracking has been documented in Glenn, Colusa and Sutter counties, so it could also happen in Butte County. Climatologists tell us we should expect more intense draughts in the future. We cannot live without clean water.

Please vote yes on Measure E to ban fracking in Butte County.

Frack-Free Butte County (FFBC) came into being in the fall of 2013 because of the fracking in the neighboring counties of Glenn and Sutter. FFBC wanted to keep fracking out of Butte County, so they drafted an initiative to ban fracking and approached the Board of Supervisors to ask for their support.

The board was not only receptive to the idea, its members actually voted 4-1 to ban fracking and directed staff to come up with a draft proposal. Well, FFBC went on to collect over 8,000 valid signatures to qualify the initiative for the ballot, but it was delayed when the oil industry challenged it. FFBC eventually prevailed, but only after it was too late to get the initiative on the November 2014 general election ballot.

Then, in the fall of 2015, county staff finally came up with their own proposal to ban fracking, and it was terrific. Unfortunately, by then, the oil companies had politicked the board enough that its members reneged on their promise to ban fracking. Instead, they settled for a weak ban on fracking wastewater instead. Please help finish this worthy campaign by voting yes on Measure E! William Bynum Oroville

Kelly Meagher, a longtime political activist and financial benefactor of environmental issues, is being fined $14,500 for not filing campaign contribution reports in 2011 and 2012.

Seven violations, including improper advertising disclosures and failing to file contributions as a major donor—anyone who contributes more than $10,000 in a year—are outlined in a stipulated agreement between Meagher and the California Fair Political Practices Commission. In 2012, Meagher spent $14,669 on ads against Measure A, the county’s medical marijuana cultivation law, including 1,000 yard signs, 2,000 fliers, four billboards and a radio advertisement. None specified that they were paid for by Meagher.

Meagher cooperated and agreed to an early settlement. However, a separate case regarding his political activity in 2013 and 2014 is pending, the document notes.

MIDWay TO GeT TRIMMeD

PG&E will remove 32 more local trees, but the company has promised to plant twice as many in return. The county-owned trees are located on the Midway between Speedway Avenue and Oro-Chico Highway. The Board of Supervisors voted unanimously Tuesday (May 10) to approve a permit for their removal and to accept the replacements.

The utility company will pay the Butte County Resource Conservation District to plant and maintain the new trees for three years, after which time the county’s Public Works department will care for them.

The long-planned removals are part of a statewide project that the power giant claims is essential for pipeline safety.

DRUGGeD aND MOLeSTeD

On Tuesday (May 10), 52-year-old Kevin Fattal of Oroville pleaded no contest to six counts of sexual molestation involving two victims— a 15-year-old girl who attended a teenage party at his house and a 22-year-old woman who lived with him for years.

At the party in February, Fattal (pictured) gave the 15-year-old drugs to help with her hangover the next day, according to a press release from District Attorney Mike Ramsey.

The girl woke up in the night while being molested by Fattal, but was unable to move or speak, she reported to Oroville police. The 22-year-old later came forward with suspicions that she’d been molested as well; more than once, Fattal gave her “allergy medication” before bed and she woke up naked.

He followed up with Gasland Part II in 2013, and is now on a 100-date international tour to promote his new film, How to Let Go of the World and Love All the Things Climate Can’t Change. “When you realize how bad off things are, it’s extraordinarily upsetting,” he continued. “What saves us is love, but in order to feel that, you need to feel the pain of it. … This movie is about staying awake and emotionally engaged.”

He’s stopping in Chico because he considers it a “hot spot”—mostly because of Measure E, which, if approved by voters on June 7, would ban fracking in Butte County.

“We’re doing the tour to energize the movement against fossil fuels,” Fox said.

“We’re going places that are in the thick of the fight, whether it’s a fight against oil pipelines, bomb trains, offshore drilling, onshore drilling, fracking or mountaintop removal for coal.”

Bringing the film to Chico is also a way to tie local action—i.e., the efforts of Frack-Free Butte County, the grassroots group behind Measure E—into the broader, global movement, Fox said.

“Climate change is not one huge world-

wide battle, it’s thousands of local fights that have to be won,” he said. “When we ban fracking, we keep so much carbon and methane and other greenhouse gases in the ground.”

It’s been an uphill battle to ban fracking

locally. After introducing a ballot initiative to do just that, Frack-Free Butte County overcame a legal challenge in 2014 from the political action committee Californians for Energy Independence, Including Energy Producers, which spent $116,238 to stop it.

The challenge was based on technicalities such as phrasing, font size and bolding of certain passages. However, a county judge ruled the petition complied with the state electoral code and ordered the county to move forward with the process.

The County Clerk-Recorder’s Office validated almost 8,000 signatures on the petition, enough to take it to voters that November. The next day, however, the Board of Supervisors was confronted with opposition the fractivists believe was orchestrated by well-financed fossil fuel

interests. The panel voted 4-1 to take the initiative under study for 30 days, making it impossible to approve it in time to appear on the November ballot.

The supervisors later directed county counsel to draft a ban on fracking internally. “As far as we can tell, county counsel wrote a very good ordinance,” said Ken Fleming, a member of FrackFree Butte County. But the supervisors ultimately voted it down in February 2015, instead directing county staff to craft an ordinance calling for conditional-use permits so each proposed project would be considered on an individual basis. Months later, the board passed an ordinance that bans the storage or disposal of fracking waste, but not the practice itself.

Meanwhile, the fractivists moved forward with their own ordinance, which is back now as Measure E. Supervisor Doug Teeter, who is vying for re-election on June 7, opposes Measure E. During the District 5 candidates forum on May 2 hosted by the League of Women Voters of Butte County at Paradise Town Hall, he said the initiative may potentially expose the county to litigation from the oil and gas industry.

“I think it’s clear that it’s poorly written,” Teeter said over the phone. “If the county got sued, how much taxpayer money are we going to spend on that?”

Rather than an outright ban, Teeter favors considering each project on a case-by-case basis under the current permit system, which mandates public notice and disclosure.

“Quite frankly, the first case might uncover that it’s completely unsafe and a ban would be warranted,” he said, adding that the permitting system leaves the door open should an oil or gas extraction method be proven safe.

“Technology changes and, in the future, there probably will be alternate means.”

As for the chances of Measure E passing

on June 7, Fleming and Dave Garcia, a founding member of Frack-Free Butte County, are optimistic based on expressions of support across political parties.

“My wife has been out knocking on doors with a 91-year-old woman who says she’s voting for Donald Trump but supports Measure E,” Fleming said. Also, Frack-Free Butte County’s recent outreach efforts in Oroville— generally not considered a progressive burg—have been overwhelmingly wellreceived, Garcia said.

Regarding a potential lawsuit against the county if Measure E is passed, Fleming posed this question: “What’s the cost to taxpayers if, suddenly, our aquifers are polluted?” □

Sprints and smiles Hundreds of local students participate in Special Olympics event

s 14-year-old Emily Marjama grabbed her mom’s hand to run the 50-meter dash, she was confident. That’s not because she’d already shaken off her nerves during the 25-meter dash, an event in which she placed second earlier that morning, but rather because she took to the starting line with friends and hundreds of onlookers cheering them on at the 16th annual Special Olympics School Site Track & Field Meet in Oroville.

Emily’s cheering section in the stands at Harrison Stadium last Friday (May 6) included her brothers and grandparents.

The eighth-grader from Paradise Intermediate School started the race with a huge smile on her face, placed third and gave out high-fives after being awarded a green ribbon. Emily has been a part of the track and field meet for the past seven years, and her mother, Reina Duran-Marjama, says the excitement of participating keeps her daughter coming back year after year.

“It’s a chance to see people that have any kind of special need or any kind of disability just come and participate in a sport that they wouldn’t normally be able to participate in,” she said. “There are so many smiles; they’re so happy to be here. This is specifically for them; something that’s done just for them, and they know that and it makes them feel important.”

The event featured 25-, 50- and 100-meter dashes as well as field events like tennis ball and Frisbee throws, pool-noodle javelin tosses and jump pits. The stadium was filled with more than 600 students and their families, from 46 schools throughout Butte County as well as a few from Nevada City.

On the lead-up to the competition, Emily had been practicing with Gina McKellar, an adapted physical education specialist for Butte County Office of Education. McKellar visits schools in the county to introduce students with disabilities to physical activities and sports as a way to promote a healthy lifestyle, as well as to help coordinate events like the track and field meet.

“This is one of their favorite days of the entire year,” McKeller said. “They get to be with all of their peers and all these people cheering for them. They get to show off their skills we’ve been teaching them in P.E., and everyone’s a winner. It’s all positive, it’s all fun. They give you, as teacher or a volunteer, so much more than you give them. It’s so fulfilling; I think it’s the best job in the whole world.”

About 300 volunteers, including students from Chico State, Butte

College and a few from local high schools, helped the athletes throughout the meet. One of them, Gabriel Estrada, a graduate student at Chico State studying to be an adapted P.E. teacher, had worked as a coach at Little Chico Creek Elementary School for the past couple of months to train students in running, jumping and throwing.

“It’s different from anything else that I’ve done in my education,” he said. “It’s helped me grow as a coach and as an educator.”

Estrada has bonded with the children and their families. He said that Friday’s event, because it was the culmination of his students’ hard work and practice, was particularly touching.

“It’s interesting to read textbooks and do projects and write papers, but it’s a totally different thing to see it manifest itself,” he said. “It’s not just something you’re reading anymore; it’s happening right in front of your eyes.”

Referendum rising If the City Council won’t make Chico Scrap Metal relocate, Move the Junkyard group hopes voters will DiFalco was disappointed and a bit confused by the Chico RCityobyn Council’s 4-to-3 vote on

May 3 to allow Chico Scrap Metal to continue operations on East 20th Street, but she wasn’t surprised.

“I feared that would be the outcome of the vote, but it’s also what we expected,” said DiFalco, who’s been acting as the spokeswoman for the Move the Junkyard group since she stepped down as executive director of the Butte Environmental Council in March.

“I felt like the [members of the] public who spoke gave very compelling arguments about why it was important to uphold the Chapman-Mulberry Neighborhood Plan and move the junkyard,” she continued. “I don’t think [the conservative council members] clearly explained their reasoning why it should stay, and I don’t think they showed good leadership about how to solve the problem.”

Lacking confidence in the City Council’s decision-making,

DiFalco and her Move the Junkyard cohorts are now looking to the residents of Chico. The group has already started spreading the word about and fundraising for a referendum effort that would let citizens vote on the recycler’s fate in November.

The council’s recent vote was to approve a development agreement that includes aesthetic changes, operational guidelines and the removal of a 2006 order for the business to move. Chico Scrap Metal has been operating out of compliance with zoning laws established by the ChapmanMulberry Neighborhood Plan and the city’s general plan for more than a decade. In December 2014, just before the business’ last extension to move expired, Councilman Andrew Coolidge proposed—and the council approved—a plan to allow the business to keep operating as its owners prepared a pitch to stay permanently.

The road to getting the referendum

qualified in time for the November ballot is short. A second reading of the council’s decision will be done at the panel’s next regular meeting on Tuesday (May 17), after which the recycler’s opponents will have 30 days to gather thousands of signatures to qualify the referendum.

Complicating the petition process is the fact that signatures can’t be collected from those who live closest to Chico Scrap Metal, as the Chapman-Mulberry neighborhood lies in a pocket of unincorporated county. The city voted in 2015 to annex the area, but it will take several years to complete that process.

One of the things Move the Junkyard has going for it is that several of the group’s organizers were behind another referendum effort back in 2014 that sought to keep the Chico Certified Farmers’ Market in the parking lot at Second and Wall streets. At the time, the city, prompted by claims

from some downtown business owners that the Saturday event caused parking problems and negatively impacted their commerce, threatened not to extend the market’s franchise agreement.

Market supporters gathered the requisite signatures, but the issue never went to voters because the city conceded and signed a new agreement.

Move the Junkyard organizers used the emails they gathered during that effort to draw people to the May 3 council meeting, and they’ve already begun email blasts calling attention to the new referendum.

DiFalco is confident the group can rally the necessary support: “The residents of Chapman unfortunately don’t have a voice in this, but I’ve seen and heard many people in our community say that that isn’t right, and that they’ll come out to speak up for them.”

DiFalco said the campaign could cost upward of $20,000, and that the group has already raised about $2,500. Move the Junkyard has started a crowdfunding campaign at YouCaring.com (search “Move the Junkyard”).

The Los Angeles artist, activist and drummer for musician M.I.A. knew that if she were to wear a tampon or pad, it would cause uncomfortable chafing through the 26.2-mile run. And she wouldn’t have a private place to change it along the course.

She decided not to wear a tampon or pad that day. As she crossed the finish line in blood-soaked leggings, she became an icon in the growing movement to normalize a biological function to which society attaches a stigma and burden.

“I realized that had I chosen to wear a pad or a tampon, it really would have been for somebody else,” Gandhi said. “It wasn’t what I wanted to do. I was much happier just running the way I was comfortable, with no foreign object in my body.

“I knew that if I ended up showing a stain, it would embarrass other people, and that I was supposed to feel shame,” she added. “… If I run bleeding freely and letting my blood show … it was actually a very radical, feminist statement.”

Predictably, Internet commenters derided Gandhi for being “gross” and “disgusting.”

But, she said, “it really started a global menstrual conversation that was so enjoyable and so amazing to watch.”

The societal obstacles American women face surrounding periods range from a “tampon tax” to uproars over whether menstrual products should be advertised on New York City subways.

But movements in several American cities and states are looking to upend the status quo and achieve “menstrual equity.” Though National Public Radio called 2015 “The Year of the Period” and Cosmopolitan dubbed it “The Year the Period Went Public,” 2016 may become an even bigger year for period progress.

Of the 45 states that charge sales tax, only five do not tax menstrual products such as tampons and sanitary pads. Most states have exemptions for “necessities” such as food from the grocery store, medical purchases such as prescription drugs and prosthetics, and

sometimes even clothes. But products to keep women clean and sanitary during their periods do not rise to the level of a necessity in the tax codes of 40 states and the District of Columbia.

tion introduced in January to eliminate the state’s tampon tax, estimates women who menstruate spend $7 per month for 40 years of tampons and sanitary napkins, adding up to more than $3,000 during a lifetime.

In New York, five women who filed a class-action lawsuit in March claim the “tampon tax” violates the equal protection clause and that it discriminates against women. The suit points out that New York provides salestax exemptions for items such as Rogaine, foot powder, face wash, Viagra and incontinence pads—but not menstrual products. Ten states that tax tampons do not tax candy or soda.

“It is the vestige of another era and now it is time to end it,” the lawsuit says of the tax. “The Tampon Tax is irrational. It is discrimination. It is wrong.”

In April, two more lawsuits were filed in California and Ohio.

Even President Obama was unaware of the tax when it was put to him by YouTube vlogger Ingrid Nilsen.

“I have no idea why states would tax these as luxury items,” Obama said during the recent YouTube interview. “I suspect it’s because men were making the laws when those taxes were passed.”

When the issue came to the attention of

Jennifer Weiss-Wolf, vice president for development at the Brennan Center for Justice and a champion of the class-action lawsuit, it sparked a new avenue of activ-

ism for her.

“I think I had the same reaction most people do: Wow, how did I never think of that?” WeissWolf said.

Since then, she has written extensively about the issue for publications from The New York Times to Ms. Magazine and co-sponsored a national petition to state legislators calling for an end to the tampon tax.

The petition has amassed more than 58,000 signatures.

It also sparked action—to date, 14 states have introduced legislation to eliminate their tampon taxes. The first was California, introduced by Garcia, a Democrat, and Republican Ling Ling Chang.

Measures in Utah and Tennessee have since died. Tennessee lawmakers said they feared losing millions in state revenue should they stop taxing hygiene products.

Cities are taking their own initiative, too—Chicago passed an ordinance eliminating the city’s portion of sales tax on menstrual products,

and the District of Columbia is considering a similar measure.

Weiss-Wolf called it “the makings of a movement.”

It’s not just the fact that some states exempt Viagra and not tampons—it’s a health issue that affects women’s ability to be productive in their school, work and home lives, Weiss-Wolf said.

When women are deprived of access to menstrual products, “it actually debilitates them and their ability to be the most productive members of the citizenry as they can,” Weiss-Wolf said. “They are an absolute necessity for half the world. [But states] consider it a hand-out to get a tampon.”

A proposal to eliminate the tampon tax, introduced in March, has passed in both houses of the New York state legislature, with support from Gov. Andrew Cuomo.

The class-action lawsuit, led by Weiss-Wolf, would enable people who purchased menstrual products in the last two years to receive

a rebate—$14 million in sales tax divided among these buyers, admittedly amounting to a “couple of bucks” for each recipient.

Weiss-Wolf is helping establish a fund where, should the complainants win the lawsuit, people can donate their rebates to benefit homeless shelters.

Even if states repeal their tampon taxes, some people still won’t be able to afford menstrual supplies.

Through volunteering at homeless meal programs and reading about the challenges transient people face, Margo Seibert and Caroline Angell learned last year that tampons and pads ranked among the highest needs of women in poverty.

Homeless shelters aren’t always adequately stocked with menstrual products, and women on the street often don’t have easy access to bathrooms. So they use T-shirts or ripped cloths to soak up their blood or they’ll stain what few clothes they have, women told Cosmopolitan.

Learning of those hardships prompted Seibert and Angell to start Racket, a New York Citybased organization that collects tampons, pads and sanitary wipes for people in need.

“We feel it’s our duty to make a racket about the issue,” said Seibert, an actress and a plaintiff on the New York tampon-tax lawsuit.

“We believe every woman is entitled to have a shame-free period.”

The women collaborated with members of the Broadway community for their first drive in October 2015 and collected 10,000 products in 10 days, Seibert said.

They have since launched a #periodswithoutshame hashtag on social media and organized several more drives. Through their efforts, Seibert said, women and men alike have grown aware of how crucial menstrual products are to lowincome people.

“Some people might say it’s not a big deal,” Seibert said. “I feel like it’s the tip of the iceberg in terms of women’s rights.” □

years ago—long before terms such as “sustainable living” Tandwenty-seven “tiny-house villages” had entered

the American lexicon—a small group of Chicoans coalesced around a novel residential plan.

They embraced the vision of cohousing, defined as an intentional community of private houses clustered around shared space.

Residents make decisions collectively, by consensus, and pool resources. Everyone has access to common areas and common tools; everyone contributes time and effort to maintaining the community.

The group, including spouses-to-be Jay Goldberg and Penny Paulus, met with resistance from people who dismissed their development as a hippie commune.

Even after they purchased a 4.75-acre parcel near Bidwell Park and received unanimous approval from the city’s Planning Commission, their project passed the City Council 5-2 with a less-than-resounding endorsement from one of the aye voters.

As Goldberg recalls, Councilwoman Mary Andrews said: “They can build it if they want, but it’s going to fail.”

Valley Oaks Village opened in 1996 with 28 homes.

All 28 remain, as do the common house, swimming pool and other amenities that the residents—60 percent of them founding members—showed to the public April 30.

That day’s commemoration coincided with a broader event, the National Cohousing Open House, comprising fellow members of the Cohousing Association of the United States.

“It’s to show an alternate type of neighborhood,” Goldberg said, contrasting alternate with alternative, since he doesn’t see his community as radical.

Jill Lacefield, one of the initial homebuyers after moving from Seattle, called cohousing “an idea whose time has come, a good idea for a lot of people, so anybody who invests in it wants to share that idea.”

Goldberg said several other groups in Chico started similar projects but “didn’t quite make it.” Start-up challenges abound, particularly acquiring land and securing requisite approvals. Valley Oaks Village’s founders took four years and multiple failed transactions before landing their property.

“There’s a lot of effort you have to put in,” he said. “It takes gumption.”

Physically, Valley Oaks Village is roughly

rectangular with parking along one side and a fenced dirt trail surrounding much of the rest of the perimeter.

Houses, clustered at each end and connected in different configurations, face inward toward tree-lined walking trails that lead to the central core—site of the common house, pool, grassy area, jungle gym and main garden. The common house includes a kitchen, multipurpose room, living room, classrooom/recroom, laundry and two guest rooms.

The homes vary in size and floor plan, with six options total. Over the years, some residents have moved within the community to upsize or downsize as per their family needs.

Valley Oaks Village currently houses many empty-nest seniors. This community has literally (to borrow another trendy term) aged in place. Parents raised their children together and sent them off to college together. Youngsters still live there, just not as many.

Goldberg, 67, and Paulus, 65, have space to spare in their two-story house with their son grown.

“I did go the fantasy route of living somewhere else,” Paulus said. “My husband and I own a nice rental, a lot of land around.

But it just took a little trip down that street to know I did not want to be anywhere else; I could not imagine living in a regular neighborhood. It just feels so isolated to me.”

She’s accustomed to camaraderie and support forged from years of dinners, events, chores and just passing people on the path.

This is why Paulus, who’s retired, and Lacefield, who’s 63 and teaches at Butte College, see cohousing as a great option for seniors seeking to live independently but not in an independent living facility.

“I would come here for a retirement place, because it’s just got easy living,” Lacefield said.

“It’s very attractive for all ages,” Paulus injected.

Though Valley Oaks Village has no homes available, the community receives and welcomes membership inquiries (see info box).

Overall, the plan has penciled out.

Goldberg points to the pool, which scoffing neighbors could not fathom so many families sharing. In drought conditions, a community pool offers scale efficiency—as does a communal lawn.

The houses aren’t as “green” as some built today with modern materials and new technology.

They’re also larger and more appointed than than first-time visitors may expect of an eco-focused community.

Yet, Valley Oaks Village has no plans

for an update.

“In these years we look at what more can we do together, because there’s a little bit of a restlessness,” Lacefield said. “But then we remind ourselves how we’ve done…. Every time people turn into our driveway, they say it feels like a sanctuary here, because it really has worked to that degree.” □

Despite the challenges, Janice kept talking in therapy week after week. Together, we would sit in her home and discuss her fears related to cancer, the impact and consequences of her husband passing and her concerns for her own future. I remember sitting in amazement at her courage as she wrestled to come to terms with her present struggles and find the strength to move forward day by day. Sometimes it was just hour by hour.

We sat together on a day after chemo had ended and surgery had been completed. She reported that the doctors had a lot of hope that she would make a full recovery. Her finances are still tight but she has set up resources so she can manage. Janice continues to miss her husband every day and admits that in a way, she knows he is there with her. When I asked her what gives her the strength to carry on and work through the physical, financial and mental health stresses she faced, Janice replied, “It is what my husband would want me to do.” But after some thought, she added, “It is what I have to do.”

Eventually, Janice had only a baseball cap to cover her head because all her hair had fallen out, and her lack of energy prevented getting dressed in much more than pajamas. She kept close contact with her friends and received “lots of support,” but admitted that she was lonely and scared “even when other people are around” because they were not her husband. She shared that she often felt nauseous but she didn’t know if that was because of the chemo treatments, ongoing financial stress, missing her husband or all three.

Here’s to youth Brewing a dream A few steps east of the intersection of Montgomery and Myers streets in downtown Oroville is Miner’s Alley Brewing Co., a brewhouse and restaurant owned by engaged couple Steve Vandervort and Connie Parks. Parks, who also owns Papacito’s Mexican Grill & Cantina, and Vandervort, who also owns Voodoo Tattoo, purchased the building about two years ago because they both wanted to be a part of the revitalization of historic downtown Oroville. Recently, the two purchased the corner lot, which housed a bus stop, next to the restaurant and have expanded and created an outdoor dining area with plans to have live music and a beer garden to be open during community events. All of the brewery’s beers—there are seven so far—are brewed in-house by Vandervort, and the food menu includes Americana fare like gourmet burgers and sandwiches. Why a brewing company?

Vandervort: Originally, it was supposed to be a coffee shop. We have multiple businesses; one of them is Voodoo Tattoo and we were thinking of moving it here and possibly marrying a cafe next to it. We thought about doing Voodoo Tattoo and Brew, but the brew being coffee, not beer. When we found this building, we thought it’d be better to drop the tattoo shop [part]. There’s a coffee shop across the street, so brew became beer instead of coffee.

Parks: Things morphed into what they needed to be.

How did you two meet?

Parks: He owned Voodoo Tattoo, which was next door to Papacito’s.

We met in the alley behind our businesses and now we own the Alley together.

What’s it like being a business owner in downtown Oroville?

Vandervort: Because of the current economic situation, starting any business is a leap of faith,

but to go into an area that isn’t booming, that’s an even bigger leap of faith. We love the downtown historical district. We both grew up here in Oroville, so it’s what we really wanted. We wanted something with character and a sense of community.

What’s changed downtown in the past few years?

Parks: There’s definitely a positive vibe and an electricity because of the people, the business owners who have taken the leap of faith and want to see the historical district of Oroville be the shinning star of this town.

Vandervort: I think, economically, things are little better, but people in Oroville need to know places in Oroville for them to go. Chico’s always been a draw because it seems to have it all, but the more we have, the more people will stay. The stars are aligning with people willing to invest, and that’s giving it momentum. Now the trick is to keep that momentum going.

Oh, to be young again. I just celebrated a birthday, so I’ve been feeling a little old. But instead of boring everyone with stories about being around before cellphones (“back in my day ...”), I’m going to write instead about a couple of awesome young people whose entrepreneurial spirits give me hope for the future.

Evalyn Jones is a senior at Live Oak High School. Her company, EJ’s Romneys, was born eight years ago (you do the math) out of a Future Farmers of America and 4-H project in which she sought to breed Romney sheep, which are known for their wool. “I started out with two bottle lambs I purchased from a local sheep breeder,” she told me via Facebook chat. “As soon as the lambs were old enough, I started showing them at local fairs.”

Today, Jones has four mature ewes that she cares for and shears. She then sells the wool or sends it out to be cleaned and spun, at which point she dyes it and sells it or uses it to make cool products. Check out her Etsy shop at www.etsy.com/shop/EjsRomneys.

I learned about Jones because she’s the recent recipient of a $2,000 scholarship from the National Federation of Independent Business’ Young Entrepreneur Foundation. She’s one of 100 young people from the United States, and just one of three in California, to win such an award. That’s pretty darn cool.

“I plan to use the scholarship to help me with my education as I attend Montana State University in Bozeman next year,” she said. Right on.

Chicoan Allie Boyer also became impassioned at a young age. I first met Boyer when she was just 10 years old and she’d already launched her campaign against palm oil, the production of which has wiped out huge swaths of orangutan habitat. Last year, she won an international entrepreneurship competition for her Purses 4 Primates nonprofit, which to date has raised over $27,000 for orangutan outreach programs. And just last month, Boyer, now 18, was featured on Nickelodeon’s The HALO Effect, which recognizes teens who inspire their communities. Go to www.tinyurl.com/haloepisode to see her full episode.

market move The Saturday Oroville Farmers’ Market, which returns for the season May 14, will be in a new location. And yes, the rumors are true: The downtown lot where it’s historically been held (at the corner of Huntoon and Montgomery streets) is slated for cleanup by PG&E, which is currently testing the site to determine a plan of action. Utility spokesman Paul Moreno told me, however, that the site is not currently a health hazard. It was the location of a manufactured gas plant that closed in 1926. A public comment period on the remediation plan will be held in the fall.

Riverbend Park will be the market’s new home, and it sounds perfect to me.

Angel Gomez, market manager for Chico Certified Farmers’ Market, which oversees the event, agrees. She told me in an email: “A park, the river and a farmers’ market—I can’t think of a better way to spend a Saturday morning.”

In 2015 Butte County spent $1.4m pursuing cannabis farmers. Meanwhile, roads degrade, schools and libraries are underfunded, and rural communities go without adequate police response.

In March 2014, Colorado cannabis farming contributed $1.9m to public schools.

Crime rates were down over 10%, teen use of cannabis declined, and taxpayers got a rebate.

Restriction creates crime. Regulation creates revenue.

residential election years are always exciting, but this one is for the record books. The Democratic establishment and Hillary Clinton just can’t shake Bernie Sanders and his legions of devoted followers.

The outcome of that race likely will hinge on the whims of about 700 power brokers, the superdelegates.

Meanwhile, the GOP has basically imploded. And Donald Trump is the “presumptive” nominee.

The CN&R is trying to keep up with it all, and this week we’re presenting our Primary Issue. Included in the package is a look at the showdown between Clinton and Sanders. For that, we sought input from Bob Mulholland, Chico’s own superdelegate and longtime state Democratic Party adviser. We also shed some light on the 1st District Congressional race, a seven-way contest that includes several Republicans, two of whom run in the same circles. The three Butte County supervisorial districts outside of Chico are all up for grabs, so we check in with those races.

POLITICAL SUPER POWERS The North State’s sole superdelegate offers a peek inside the elections machine

or the past several months, Bob Mulholland’s inbox has been filled with emails from Bernie Sanders supporters, imploring him to change his stated support for Hillary Clinton to their candidate when he casts his vote at the Democratic National Convention in Philadelphia in July.

Mulholland, who lives in Chico, is a superdelegate, a title that has risen from obscure political jargon to casual American conversation in the past few months, its insertion into everyday lexicon aided by Internet memes featuring pictures of everyone from presidential hopeful Bernie Sanders to Kermit the Frog decrying superdelegates as a threat to direct democracy.

Superdelegates have long been part of the Democratic Party election process, unbeknownst to most casual vot-

ers until their role in the current presidential election became clear around February.

That’s when number-crunching politicos began positing that Sanders’ presidential campaign couldn’t succeed without the support of these pseudo-mysterious power brokers, the majority of whom—even at that early date—had already acknowledged their support for Clinton.

The recent attention to superdelegates is well-deserved; mathematically speaking, barring Clinton running away with the remaining state contests, their votes ultimately will determine the Democratic candidate for president.

So, who are these delegates, and what makes them so super?

At the national convention, there will be a total of 4,765 delegates whose votes will determine who will face “presumptive” Republican nominee Donald Trump in November. The vast majority of these delegates—4,046 of them—are “pledged,” meaning they are obligated to cast their ballot based on the popular vote in the state they represent during primary or caucus contests. For example, in last week’s Indiana primary (May 3), Sanders won with 52.7 percent of the popular vote, earning the same percentage of that state’s Democratic delegates—44 to Clinton’s 38.

Superdelegates—there are 719 of them, with 71 hailing from California—are “unpledged,” meaning they can cast their vote for whomever they choose.

Thus far, a substantial majority of superdelegates have publicly announced their support for Clinton. According to numbers reported by The Washington Post last week, 520 superdelegates support Clinton, 39 support Sanders and 160 have not publicly announced their choice.

Following the West Virginia primary held Tuesday (May 10), Clinton has thus far won 1,716 pledged delegates compared with 1,430 secured by Sanders, according to The Associated Press. A Democratic candidate needs 2,383 total delegates to clinch the party’s nomination. Sanders would need

66 percent (594) of the remaining 900 pledged delegates up for grabs in remaining state contests, plus half of the superdelegates (360) to secure the nomination.

Superdelegates are unique to the Democratic

Party. The most comparable counterparts in the Republican camp are three members of each state’s Republican National Committee sent to their party’s convention in addition to those determined by popular vote (for a total of 2,472). Unlike the Democratic Party’s superdelegates, though, these Republicans are obligated to cast their ballot in line with their state’s popular vote.

The superdelegate system was adopted in 1982, after the landslide defeats of Democratic candidates George McGovern in 1972 and Jimmy Carter in 1980. It was seen as a way to allow party leaders a system of checks and balances if an unelectable candidate was nominated by popular vote.

Some superdelegates are behind-thescenes movers and shakers, like Mulholland, the only one in the state who lives north of Sacramento. A 19-year employee of the California Democratic Party before his retirement in 2009, Mulholland remains a member of the Democratic National Committee and was elected by that committee as a superdelegate in 2012. He is a vocal, longtime supporter of Hillary Clinton.

Other superdelegates are not obscure figures. “They are the democratic governors like Jerry Brown, the U.S. senators, like Dianne Feinstein and Barbara Boxer, the Democratic members of the House of Representatives and some members of the Democratic

National Party, either elected or appointed,” Mulholland explained during a recent interview. “They are people who were in most cases elected to their positions, and people who have been in the party for a long time doing all the work, raising all the money and holding public office.”

In addition to all of the Democratic members of Congress and governors, superdelegates also include distinguished party members, such as former Presidents Bill Clinton and Jimmy Carter.

The increased focus on the superdelegates this election cycle has led to deeper scrutiny and some criticism, primarily from those who believe their unpledged status gives them too much power. Mulholland was quick to defend the system.

“Most of the criticism of superdelegates comes from people who are not Democrats, people who are excited about one candidate this year but don’t even vote in most elections,” he said. “I know there’s some people out there that think Nancy Pelosi, our minority leader of the House, or Sens. Boxer and Feinstein shouldn’t be delegates to our national convention. I tell those people, ‘Get in line and run for Senate.’”

Mulholland, who is known for not pulling punches, said some of the letter-writers flooding his and other superdelegates’ email inboxes lack political savvy and can be downright abusive when it comes to the idea of Clinton as the country’s first female president.

“The women [superdelegates] are the ones that get the verbally and sexually abusive emails, while the men tend to get these illogi-

cal arguments and statements ... they come mainly from people who aren’t Democrats, rarely vote, and in November they can smoke it legally in California.”

Mulholland first met Bill Clinton in 1978 and has spent significant time “watching both of the Clintons work very hard for candidates and causes all over America.” He said that he doesn’t believe that many superdelegates will back Sanders. His reasoning is, ironically, the same reason that many voters are drawn to Sanders, and even Donald Trump—that he is viewed as an establishment outsider.

“I’ve spent a lot of time with both Clintons, but I’ve never even met Sanders,” he said.

Mulholland said that the Clintons have a good track record of campaigning for other party members, noting Bill spent time in Sacramento in 2012 and 2014 to stump for Congressmen John Garamendi, Jerry McNerney and others.

Sanders? Not so much.

“How can this guy who [through his devotees] harasses with all these emails, says bad things about us, and now, in the last month of the primary, he’s saying, ‘I’m the nicest guy, I want all the superdelegates to overturn the will of the voters and make me the candidate.’ It’s just not going to happen.”

However, not all Democrats are such staunch supporters of the superdelegate system, or as resolute in their backing of Clinton. Troy Jackson, the former state Senate majority leader in Maine and a superdelegate, recently told The Washington Post, “If Sen. Sanders is close or is actually leading by the time we get to the convention, I think he definitely has a case to make that, in at least the states that he won, those superdelegates should be backing his campaign.”

And state Rep. Diane Russell, another Democrat from Maine, recently introduced a rule she hopes will be supported by other party members that would require superdelegates to vote along with the popular vote.

Measure H aims to alter controversial voter-backed medical marijuana cultivation law

hen it passed two years ago by popular vote, Measure A was already controversial. In that November election, the medical marijuana cultivation ordinance ran alongside the almost identical Measure B. A was backed by law enforcement and the antipot contingent, while B was written and supported by growers. A passed, B didn’t, and now we have H. Measure H, on the June 7 ballot, is an amended Measure A. Essentially, the county had a hard time collecting fines for outof-compliance grows and dismissed more nuisance abatement hearings than it held, so staff recommended some changes intended to streamline the enforcement process, which the Board of Supervisors approved in January. Many growers, already miffed by what they considered abuses of power under Measure A, got behind a referendum that put the amended ordinance up for popular vote.

Jessica MacKenzie, who heads the Inland Cannabis Farmers’ Association, has been the loudest voice behind the No on H campaign.

Her group backed the referendum and has the support of a large number of medical marijuana growers, patients and advocates.

MacKenzie’s biggest problem with the changes to Measure A aren’t the changes themselves, but rather the fact that they came only from the side of enforcement.

“It is our firm belief that unless and until the county solicits and considers input from all the stakeholders affected by this ordinance—farmers, law enforcement, patients, business owners, landlords—and addresses the unequal and inconsistent application and claims of abuse, we should all have to live with the voter-backed version currently in place,” reads the official argument against H, submitted by MacKenzie.

Beyond that, she says, Measure A was flawed to begin with.

“Under the 2015 program, in order to get a matter to a hearing officer was a very laborious process,” said Tim Snellings, director of Development Services for the county, during a recent phone interview. It often required county staff make four visits to each alleged offending property. “We wanted to streamline the process.” Under Measure H, those visits would be cut in half, reducing staff time and paperwork. In addition, the county would be able to place a lien on a property to recover unpaid fines.

“They’re saying they’re amending Measure A to make it better,” MacKenzie said during a recent interview. “But they couldn’t handle it; they didn’t enforce it properly.”

She and others in the pro-cannabis camp have argued that the county has overstepped its bounds in enforcing Measure A, which limits garden sizes based on acreage and also sets forth various code requirements in order to grow marijuana legally. Noncompliance is met with visits from code enforcement, alongside armed deputies, as well as posted notices, fines and hearings. Measure A was intended to be complaint-based, but county staff has admitted publicly that those complaints often come from sheriff’s deputies flying in helicopters, not from neighbors legitimately bothered by a nearby garden.

On the other side, Measure H proponents say that growers have found loopholes in the law to get away with growing more plants than allowed, and that they use stall tactics to avoid penalties and hearings until after har-

vest time. The amendments, they argue, will “stop the scofflaws.”

Any way you look at it, Measure A had its successes and its failures, as shown in a staff report given to the Board of Supervisors in January. Among the findings for 2015: Code Enforcement received 1,489 complaints, of which 67 percent were closed due to compliance or becoming compliant; 894 citations were issued, equaling $2.9 million in fines, of which $171,175 was collected; 105 nuisance abatement cases were set for hearing, of which 25 were closed before hearing, 19 were heard and 61 were dismissed “because staff anticipated a judgment would not be made in time to abate the nuisance.”

Based on those numbers, it’s clear the county had difficulty collecting fines and holding hearings. Some of that was due to lack of clarity and inefficiencies in the law, staff told supervisors. And so they proposed changes to improve the outcome, the most significant being to combine the civil penalties for violations with the nuisance abate-

The impetus behind this change is state law that went into effect in January that qualifies marijuana as an agricultural commodity. The Board of Supervisors approved the amendment and it was blocked by petition.

“The Right to Farm ordinance exempts farming operations from complaints against smell, noise and other factors. We had to decide whether those exemptions for nuisance complaints should apply to marijuana,” Snellings explained. “Staff decided that they should not apply because ... marijuana is different.”

MacKenzie filed the official opposition paperwork with the county, arguing that “It is unnecessary because cannabis is already excluded from these protections and will remain so until it becomes federally legal.”

Snellings agreed that the wording of the Right to Farm ordinance does exclude marijuana based on its federal status, but added: “Whenever possible, we want to be as clear as we can.” □ More

he Butte County Board of Supervisors could undergo a significant change June 7 with three of the five members facing re-election challenges.

Could, but likely won’t.

In District 1, representing the Oroville area, Bill Connelly is seeking his fourth term, and his opponents are two political newcomers: county employee Thomas Warner (who’s also an officer in the employees’ union) and recent retiree Ron Stoker.

In District 4, serving the south county, Steve Lambert is vying for his third term against one challenger, Mark Jensen, who ran in the three-way race in which Lambert won his first term with nearly 80 percent of the vote. He ran unopposed in 2012.

The tightest contest in the upcoming primary is in District 5, on and around the Ridge, if for nothing else than by sheer numbers. To secure a second term, Doug Teeter must best three challengers: business owner/ musician Maurice Huffman, flooring contractor Dwight Grumbles and business owner Diana Wright.

Teeter was among four candidates four years ago who sought to clinch the seat of retiring longtime Ridge Supervisor Kim Yamaguchi. The first-place finisher, Town Councilman Joe DiDuca, did not receive the required majority of votes in the June election, so Teeter, by placing second (13 percent behind), advanced to a November run-off that he won easily (by 25 percent).

Coincidentally, Huffman’s wife, Robin, was among Teeter’s 2012 rivals—and she faced Grumbles in the 2008 campaign they waged (unsuccessfully) to unseat Yamaguchi.

As if that’s not enough interconnection, 2016 foes Grumbles and Wright are cousins.

So, while his fellow incumbents seem relatively safe, Teeter may well have to sweat out his future through the fall.

Huffman—aka Big Mo—not only has name recognition but also support of the Butte County Democratic Party. Wright has been a prominent opponent to commercial cultivation of marijuana, advocating for Measure A (which passed in 2014) and now Measures G and H (on the current ballot). Grumbles, akin to Connelly, has deep roots in the district.

That’s not to say Teeter is teetering. He

touts endorsements by current and former sheriffs and fire chiefs, as well as the Butte County Farm Bureau. Plus, at the District 5 candidates forum May 2, hosted by the League of Women Voters of Butte County at Paradise Town Hall, he demonstrated a key perk of incumbency: inside knowledge.

To a question about the Sustainable Groundwater Management Act, the three challengers spoke in varying degrees of generalities before Teeter delved into specifics about the county’s responsibilities and costs.

On the future of the Cal Fire contract, Huffman was asked to field the question first; he looked across the dais and, drawing laughs from the crowd, said, “You’ll have to ask Doug.”

As in the other candidates forums, the

District 5 aspirants addressed public safety, salaries—most notably the supervisors’ vote regarding their own raises—and marijuana.

Discussed, too, was what role the board should play in the State of Jefferson movement for North State sovereignty, since Teeter sided with Lambert and Supervisor Maureen Kirk against a declaration of support. Connelly and Larry Wahl wanted the board to make the declaration. (Kirk and Wahl, Chico’s supervisors, have two more years before their seats are up for grabs).

The Ridge race is outwardly civil, but strong differences divide the candidates.

Wright said she has “the most skin in the game” because she’s fighting for her way of life. “I want to see Butte County thrive, see businesses relocate [here] and see this as a place for stable families,” she continued, which will happen “only if we hold the line against commercial marijuana growers.”

Huffman, who said he is deathly allergic to marijuana and so sober a musician that he “always had to be the one to drive the bus,” responded that he’s “learned over the years that [the cannabis business] is not going to go away” so he proposes working with grow-

ers to restrict cultivation to nonresidential areas and assess taxes to generate revenue for enforcement.

Of more concern to him: protecting water from fracking, expanding access to mental health services and improving Ridge fire escapes—the latter being long overdue, he said, since the 2008 Humboldt Fire.

Grumbles’ key concern is supervisors’ salaries; he pledged to return half the base pay to the district in the form of scholarships.

Teeter, twice elected board chair, deflected criticism and extolled the experience that comes with incumbency. He, like Connelly and Lambert, knows that Butte County government is a $500 million arm of the state with mandates to fulfill; in many cases, “you can’t tell the state to take a hike.” He also knows the tightrope supervisors walk balancing district interests with those of the county.

In the big picture, Teeter said, “if one wins, all win.”

Just not on June 7. Ω

In a crowded race for Congress, Joe Montes is a longshot to unseat Doug LaMalfa

oe Montes is everywhere right now.

His campaign signs, calling on voters to “Stand and be counted,” seem to sprout from every other lawn, and his TV and radio commercials are in heavy rotation.

But the Army and California Air National Guard veteran, former administrative law judge and Chico-based businessman needs more than local exposure heading into the June 7 primary election if he’s going to take Doug LaMalfa’s seat and represent the vast, mostly rural 1st Congressional District.

(It covers Butte, Lassen, Modoc, Plumas, Shasta, Sierra, Siskiyou and Tehama counties, as well as portions of Glenn, Nevada and Placer counties.)

So Montes, a Republican, has been on the road seven days a week to participate in candidates forums, speaking engagements and TV spots throughout northeastern California.

Along the way, he’s spreading his message of finding common ground with political and ideological opposites to pry free the U.S. Legislature’s gridlock.

“The message is that the establishment is broken,” he said during a recent interview.

“There’s a reason for the very low approval ratings Congress has.”

Voters nationwide are fed up with obstructionist politics and the glacial pace of change, Montes said, and he hopes the political winds behind presidential candidates Bernie Sanders and Donald Trump will work in his favor. “You look at those two and they seem, at first glance, to have nothing in common,” he said. “But they’re both perceived to be outsiders from the D.C. mess. … I think they’re giving voice to why people have been agitated for a long time: Why aren’t we being represented?”

In the North State, there is a voting bloc in the highly influential farming community that does, in fact, prefer the status quo, Montes said. However, invitations to debates hosted by farming groups are encouraging.

“There’s a very real chance of me winning, though, of course, it will be very difficult because [LaMalfa] is the incumbent,” Montes said.

The top two vote-getters in

the primary election will run against each other in the general election in November.

It’s possible, then, that members of the same party will square off, but the results of the District 1 election in 2012, when Democrat Jim Reed drew 42.6 percent of votes suggest that’s unlikely.

Reed is once again challenging LaMalfa’s seat and figures to receive significant support from Democratic voters.

Five of the seven candidates squared off at Chico State’s Harlen Adams Theatre during the League of Women Voters of Butte County’s congressional forum on May 3. Democratic candidate David Peterson couldn’t be contacted ahead of the forum, while LaMalfa declined the league’s invitation.

The candidates answered questions from the league, the press and the sparse audience (about 30 people in a 468-seat auditorium), providing glimpses of each candidate’s political and social leanings. Take Gregory

Cheadle (R), who decries government overreach, big banks, the pharmaceutical industry and the criminal justice system. When prompted on the subject of climate change, he condemned the Obama family for flying on Air Force One. “These are the people who are telling me to feel bad because I don’t drive a Prius? I don’t think so,” he said.

Jeff Gerlach, a longtime information technology analyst, emphasized cyber-security and disturbing trends in government surveillance. He says the two-party system is broken—he’s running as an independent—and likened partisanship to “a family feud.” Gary Allen Oxley (R), on the other hand, believes Democrats and Republicans are “working together really well” in Congress, but the problem is public transparency and densely written legislation most people can’t digest.

As the only Democrat, Reed said he’d work to upgrade the North State’s aging infrastructure to boost the economy and take action on climate change. He believes that Democrats and independents will turn out in droves to vote against Donald Trump in the presidential election and increase his chances.

From Montes’ viewpoint, a vote for Reed is a vote for LaMalfa. In the blood-red District 1, he believes it’s nearly impossible Chicoan Joe Montes says a vote for Democrat Jim Reed is a vote for incumbent Doug LaMalfa.

for Reed or any other democrat to take the election.

“If people vote for a Democrat, they should understand it’s just a principled vote,” he said.

“One that makes you feel good, but it’s going to guarantee that LaMalfa is the winner.”

Montes needs every swing vote he can get, but liberals likely won’t identify with some of his stances on hot-button issues.

Though he acknowledges humanity’s role in climate change and believes the North State should move away from fossil fuels and invest in solar, hydro-electric and nuclear energy, he takes a more traditionally conservative stance on issues like women’s reproductive rights—specifically, abortion.

During the forum on May 3, the CN&R asked the candidates whether they would support legislation to defund Planned Parenthood.

“I am a conservative and I am a prolife advocate; I would not fund Planned Parenthood,” Montes responded. “It’s unconscionable for someone like me—my wife and I were never able to have children, although we wanted to—that babies are lost in that way. … I would do everything in my power to defund Planned Parenthood.”

The odds are long, but Montes’ sights are set on Washington, D.C. “I intend to win,” he said. □ M ay 1 2 , 2 0 1 6

What elements of performing do you find most challenging and satisfying?

When I first began touring completely on my own, my tendency was to aim for the same intensity as I would with a band. If there was 5-inch-deep pool of sweat on the stage when I hit the last note, that was the marker of a good show.

What I have discovered is that there is a whole ride that I can take the listener on given the variety of songs I can pull from now. But a lot of it has to do with drawing them inward rather than lunging at them. I’m enjoying the whole process of exploring what I can do with very little these days. If anything, the presentation is often more dramatic when I’m on my own. There’s nothing to hide behind.

Do you work from a strict set list or improvise the song order according to the crowd and vibe?

Typically, I have a notion of the first few songs before I walk onstage, but that’s about it in terms of a set list. I’ve found that the energy in the room, my own gut is the best compass. I’ve been working without a set list for most of my career. Naturally, some songs get played more than others in my catalogue but there’s always a chance that I’ll go off-roading.

For this tour, will you be presenting a retrospective of your work or focusing mainly on songs from the new album?

I’m happy to find that I can drift in and out of some of my earlier work very naturally. I tend to pull from The Narrows, from my other solo albums and I even venture into Grant Lee Buffalo material.

Current tour mate Steve Poltz and former tour mate Robyn Hitchcock are both known for their impromptu stage patter and eccentric humor. What is it about storytellers that attracts you to them as touring partners/ collaborators?

Every so often I’m coupled with a touring partner like Steve Poltz, Robyn Hitchcock or Howe Gelb [of Giant Sand].

All of these guys live in the moment when they perform. We’ve all been in bands, and yet something compels us down a solitary path. So when we enter the same orbit for a spell, we tend to relish the rare nature of it all. It’s like pitching curveballs to one another. I always come away with a sense that I’ve gained so much and grown from these creative relationships. Other dudes go fishing and hunting. Maybe this is my version. tries to see what’s just outside the TV set, which is in a very disorderly room, and he doesn’t see the man in that room, who’s not by Juan-Carlos really listening anyway, and maybe Selznick he’s looking for us, the audience watching High-Rise, the movie in which this moment is happening.

That’s one of the more memorable of the many off-handed oddball moments in Ben Wheatley’s suavely chaotic film version J.G. Ballard’s High-Rise 1975 dystopian novel of the same Opens Friday, name. As such, it’s also one of the May 13. Starring Tom sidelong high points in a farcical satHiddleston, Jeremy ire that is more inventive in passing Irons, Luke Evans, moments than in its overall narrative.

Elisabeth Moss and The central tale regards the lives Sienna Miller. Directed

by Ben Wheatley. of the residents of the eponymous Pageant Theatre. skyscraper, an ostensibly futuristic Rated R. structure in which the wealthiest and most privileged live in the splendor of the uppermost stories while those in abject poverty are relegated to the squalor of the lowest stories. The sardonic take on the British class system is obvious, but the main emphasis in this case is on the indifference of the privileged to the gross depredations and grotesqueries that occur at every level of “The Building.”

Wheatley tweaks the story here and there in order to link up with 21st century globalism and the income equality that goes with it. The film preserves a sense of something that might be happening in both “the future” and in 1975. But even with the excerpt of a Margaret Thatcher manifesto on the soundtrack, Wheatley’s

High-Rise plays more as a comedy of decadence than as a barbed neo-Swiftian satire.

Tom Hiddleston and Jeremy Irons have top billing, the former as a blandly respectable-looking physician who is also an upward-bound resident of the 25th floor and the latter as the flimsily messianic architect who designed The Building and presumes to be its ruler.

The most interestingly conflicted character is one Richard Wilder (Luke Evans), a former TV star who makes a series of self-defeating attempts at rebellion against the systematic injustices within The Building.

Elisabeth Moss is both angelic and feral as a knifewielding woman who is also bulgingly pregnant. Reece Shearsmith has a couple of superbly farcical moments as a jut-jawed orthodontist named Steele. □

Louder Than Bombs Opens Friday, May 13. Pageant Theatre. Rated R.

This English-language drama from Norwegian director

Joachim Trier stocks its 109-minute running time with enough multicharacter family drama to support a longrunning miniseries. It feels a little as if someone had tried to compress a very big and intricate novel into a dense, intensely evocative short story.

Trier and co-writer Eskil Vogt have the benefit of an excellent cast and crew, and the script for Louder Than Bombs weaves a wealth of intriguing issues (social, political, aesthetic, etc.) into the psychological

fireworks of its central story. The first half of the film impresses and disturbs with its multileveled barrage of mysteries, and the second half retreats (perhaps unavoidably) to safer and more pedestrian territory in order to provide, perhaps, at least some semblance of emotional closure for the main characters.

Jesse Eisenberg plays the older of two sons, Jonah, a newlywed who has just become a father for the first time as the film begins.

The younger brother, Conrad (Devin Druid), is an awkward and

unhappy teenager, a sensitive misfit who’s desperate for some kind of emotional connection. The father (Gabriel Byrne), a former actor turned schoolteacher and housedad, is a model of parental flexibility, which perhaps makes him a less substantial fixture in the family’s emotional life.

Amy Ryan and David Strathairn make strong contributions in the key supporting roles. The richly atmospheric cinematography of Jakob Ihre is an important part of the film’s appeal. □

Chuck, while sitting down for a solitary lunch at The Broken Plate in Oroville. I really wasn’t kidding.

The baked pasta (I chose spaghetti noodles, but could alternatively have picked penne) was served in a small, disposable aluminum dish, with a layer of perfectly melted and browned mozzarella on top.

There wasn’t just one thing that qualified the spaghetti dish ($8.95) as the best I’ve ever had.

It had a perfect layer of cheese, with a simply amazing tomato mint sauce, which was used quite sparingly but packed a wallop story and of flavor. And there were those photo by Mediterranean meatballs, with Meredith J. spices that were bold but not Cooper overpowering. m e re d i t h c @ I’d discovered The Broken new srev i ew. c o m Plate via Yelp while searching for a good place for lunch in Oroville. The reviews were overwhelmingly positive (4 1/2 stars out of 5) and, after visiting the restaurant’s website and perusing ★★★★ the menu, I decided it was worth The Broken Plate trying. The website boasts the 1836 Feather River Blvd., Oroville accolades of chef/owner Michael 282-4422 Athanasopoulos, who was born Call for hours. and raised in Greece and has won a couple of International Pizza Challenge awards. Last year, he opened his restaurant in Oroville, ★★★★★ where the menu ranges from pizza EPIC to pasta to Greek staples like gyros, ★★★★ hummus and spanakopita.

AUTHORITATIVE I was craving pasta during my ★★★ first visit, but after reading all about APPEALING Athanasopoulos’ affinity for pizza, ★★ I returned to try that, too. I ordered HAS MOMENTS the carbonara ($12), with cheese, ham, bacon and a creamy white ★ FLAWED sauce. All pizzas are 10 inches and

thin-crust, so they serve one to two people. One bite in, I was sold. The crust had a perfect cracker-thin finish, and the garlicky white sauce brought the rest of the ingredients together while once again not being overwhelming. And while it didn’t quite steal my heart and taste buds the same way that spaghetti did, it was some damn fine pizza. My companion, however, ordered a salad and said while it was passable, it was generic and overall underwhelming. My guess is their efforts are focused elsewhere.

For my third trip, I decided I’d quit teasing Chuck with pictures of the fabulous food I’d found at The Broken Plate and actually bring some home. I ordered him the original gyro, which comes with lettuce, tomato, red onion and tzatziki. Having enjoyed the carbonara pizza, I opted for that flavor combo on a gyro. As the menu indicates, the meat is a blend of lamb and beef, and gyros are offered as wraps ($8.45$9.45, with fries) or as platters ($11.45, with fries, salad and dipping sauce).

We’d ordered the wraps and both were fantastic.

Unfortunately, the drive from O-town to Chico was long enough to make the pitas a bit soggy, but honestly it didn’t really matter. The gyro meat was so tender and flavorful—sliced into little strips so it blended with all the other ingredients just right. Even the fries, not my usual side dish of choice, were good, crispy and with just the right amount of salt.

Aside from the salad, my only real complaints about this place are the cramped dining space—the outside patio is nice, but inside is quite small—and the lack of real servingware. Maybe they really do break a lot of plates, because even when I ordered for sit-down, I was brought styrofoam.

One huge bonus, and something those outside Oroville should take note of, is that The Broken Plate recently opened a food truck, called The Lamb & The Wolf. I haven’t tried it yet, but it has been posted up at the Fork in the Road and other events countywide.

Its menu is focused on Greek items, so you’ll have to go to the restaurant for pizza and pastas. But if the food’s any bit as good as The Broken Plate’s, you’re in for a treat. □

Andrew Bird Loma Vista Records Across 13 albums, songwriter Andrew Bird has developed a sound altogether his own using now-familiar signature elements—pitch-perfect whistling, delicately layered string instrumentation, flashes of violin virtuosity and almost-too-clever lyricism—and pretty much stuck with it. One might wonder whether the schtick will wear thin. Based on Bird’s new record, Are You Serious, the answer is: not yet. It helps that Bird is weird, that his folk and chamber-pop songs feel like they couldn’t be written by anyone else. Also, from the start, the ear detects that Are You Serious has a highly produced sheen atypical of Bird’s catalogue.

Whereas previous Bird albums have sounded haphazard, like they were recorded midconception, the melodies here seem as if they were cut out with an X-Acto knife. (See the sparse, bluesy and finger-snapping lead single, “Capsized.”) Further highlights include “Roma Fade” and its driving kick-drum, melodic swells and tip-toeing pizzicato violin, and “The New Saint Jude,” which sounds like Bird’s lost guest feature on Paul Simon’s Graceland.

In response, the countries of the European Union have authorized Russia to initiate a velvet-glove takeover of Norway’s energy sector. This sets in motion a series of events—various political murders, the emergence of a resistance movement—that threaten all-out war. As tension mounts, we see its effects on a range of characters, each of them richly drawn, beginning with the prime minister, who believes armed resistance would be suicidal—and thus is dubbed a traitor. Conceived by best-selling crime novelist Jo Nesbø, Occupied is the most expensive television series in Norwegian history, and it shows. As international thrillers go, this is one of the best ever, not least because it is so relevant.

Golden State-Lone Star Blues Revue Mark Hummel

Electro-Fi Records Capitalizing on the 25th year of hosting his successful harmonica get-togethers that feature a who’s who of the nation’s harp fiends, Hummel—a workmanlike harmonicist—has come up with a winning idea of teaming players from California and Texas for this Blues Revue. Backed by guitarists Little Charlie Baty and Anson Funderburgh, Hummel et al. go to town on the disc’s 14 tracks. With bassist R.W. Grigsby and drummer Wes Starr, this is the core group that played Sierra Nevada’s Big Room last February.

Little Charlie gets things underway with his intro (and subsequent solo) on a compelling version of Gatemouth Brown’s “Midnight Hour,” with solid vocals by Hummel, before Funderburgh kicks in. Baty and Hummel conspire to effect on “Prove It to You” (with Jim Pugh guesting on organ), while Funderburgh shines on “Pepper Mama,” another Hummel original. “Dim Lights” features both guitarists—Baty first, then Funderburgh with a typical raging slide guitar solo. Hummel blows some evocative harp on his mournful “End of the World” (“I want to be by your side”) that closes the album.

and-off-again rains have kept things green, in bloom and smelling sweet (the air is thick with star jasmine in Arts DEVO’s hood). And with nothing but sunshine in the forecast, there’s a good chance things are going to start drying out fast, so get out and enjoy those May flowers now, maybe while walking or biking to one of this week’s many art openings.

Two receptions on Saturday, May 14: Salvatore Casa Paintings is now showing at the Upper Crust Bakery & Eatery, featuring new works by the local master. Reception is 4-6 p.m. And Abracadabra, at Idea Fabrication Labs, will kick off with “Last Pioneer Day Parade,” Sal Casa a Gallery Soirée (6-9 p.m., all-ages; 9 p.m.-2 a.m., 21-over), featuring treats, live music by Sisterhoods and sets by a bunch of DJs. The show is the culmination of Rosemary Widmann’s residency in a tech-art incubator program at IFL’s sister site in Santa Cruz. … AND EXPLODING Explosions in the Sky is one of my favorite bands in the world, but as much as I dig the recorded output of the Texas instrumentalists, listening to the albums vs. experiencing the band live is akin to looking at a picture of Mount Shasta vs. hiking to its summit, or listening to one of those sounds-of-the-ocean machines vs. standing on the rocks at the shore while waves crash around you.

Thankfully, this past Saturday (May 7) at the Fox Theater in Oakland, Mrs. DEVO and I got to experience EITS in its natural state (thank you, Stromo, for the tickets … and for introducing me to the band … and for introducing me to my wife!), and in an effort to avoid my usual hyperbole, I’ll just say it was “awesome” in the truest sense of the word.

The dynamic sound of the guitar-forward four-piece (three guitars and drums, plus a guest bassist for live shows) is often described as cinematic.

For this performance, the players lingered less on the quiet scenes, staying with gracefully interconnected melodies just long enough for us take in the pastoral before shaking us free with unnatural sonic disasters. A couple of the huge, slow-building crescendos of screaming guitars and sustained feedback somehow found a whole other level of volume to launch into, threatening to punch through the high ceilings of the repurposed 1928 movie house. It was as huge as, you know, an ocean or, like, a mountain.

OK, just awesome.

The external factors that appraisers deal with most frequently have to do with proximity to infrastructure — power lines, commuter rails, highways.

When calculating the value of a property, an appraiser factors in surrounding neighborhood conditions.

Neighborhood nuisances may potentially be solved with help from the local authorities. If those rusty cars aren’t registered, or if chickens and horses are a zoning violation, a phone call might end the problem.

What you call a bad neighbor, the appraisal industry calls “external obsolescence.”

The obvious stuff, like a yard full of rusty cars next door, or the old motorhome parked across the street with weeds growing around the flat tires might be enough to bring down your appraisal value.

Of course, the perception of what’s unsightly varies by neighborhood. The rusty cars are more likely to be considered a problem in residential neighborhoods than out in the country where we consider rusty cars part of the landscape.

The question of how to deal with confrontation can only be answered case by case. A code enforcement officer gives this advice: “Some people aren’t worth starting a fight with. If you start it, they’ll never let it die. Sometimes it’s better if we don’t go out, and neighbors can work things out in a friendly way.”

My grandmother would say, “Make ‘em a pie, and go visit ‘em. That’s how you get a good neighbor.”
