to the attacks in Paris with knee-jerk xenophobia, pandering to their base by calling for the United States to close its doors to the tiny number of refugees President Obama has agreed can resettle here.

Perhaps the most egregious example is Sen. Ted Cruz’s idea of allowing only Christian refugees to enter the country. It’s almost unfathomable that a presidential candidate would eschew the First Amendment’s guarantee of freedom of religion.

The ostensible concern is that accepting Muslim refugees would put Americans at risk; that terrorists would be let into the country. It’s an emotional, fear-based reaction that perpetuates an ignorant stereotype that all Muslims are terrorists. It must not be allowed to persist.

All of this is not to mention that there’s an extensive screening process required for asylum seekers. It first involves vetting by the United Nations before the United States Department of Homeland Security takes over, with background checks and interviews. It’s not exactly a simple process. In fact, it takes some 18 months or longer to complete. Moreover, the president has committed to taking in just 10,000 refugees next year, a largely symbolic gesture considering that millions of refugees are in need and that the bulk of them will be absorbed by European nations.

The shameful and ignorant displays by Cruz and company to score political points with their supporters come at the expense of people who have been displaced and terrorized and have given up everything in search of a better life for themselves and their families. The Syrian people in particular have seen unspeakable atrocities since the Arab Spring in 2011; more than 250,000 have died.

This is a humanitarian crisis of epic proportions.

Americans must think about the message it would send should the United States turn its back on these people. Are we a nation of good will or one that gives into fear? Back in September, we wrote that America must not look away from this crisis. What has happened in Paris doesn’t change that. Ω

A position worth filling The Chico City Council made the right call this week when it scrapped a

proposal by a Washington, D.C.-based consulting firm to manage the Chico Municipal Airport.

As Robert Speer points out in his report on the meeting (see page 10), the proposal was expensive (more than $120,000 a year) and the city would still have to hire additional personnel to carry out the firm’s plan. Moreover, an additional annual fee of $25,000 to search for a new airline service would very likely be fruitless given that there simply aren’t enough people to fill the seats—the reason SkyWest pulled out of Chico last December. Business travelers in Chico must head to Sacramento for air service, but there’s no immediate fix. And there’s no use throwing money at a problem that will resolve in time as the business community grows and there’s a clear demand for an airline.

In the meantime, however, we believe that the city should entertain the idea of hiring a full-time economic development director. Chico hasn’t had this position since Martha Westcoat-Andes departed from the city in 2010, the year before the massive organizational restructuring and layoffs took place at City Hall.

Now that the economy has improved and the city is rehiring staff and even giving raises to certain employees, its leadership and the City Council should think of the long-term advantages of getting someone in to work daily on attracting new business, especially in the technology sector. The city could hire someone for a designated time frame and measure the results of his or her work, and it would cost taxpayers far less than the airport proposal. From our standpoint, it would be money well-spent. Ω

Letters for paris As I write this, just days after the attacks in Paris that left nearly 130 dead and hundreds more seriously wounded, some believe the United States and its allies are on the brink of World War III. The 24-hour news cycle likely will focus on Paris for weeks, maybe months, as governments prepare for further inevitable attacks around the world. Let us hope that the forthcoming United Nations climate talks in the City of Light do not get overshadowed by the cries for war. That would be yet another travesty considering the role climate change has played in the Middle East’s refugee crisis and the rise of ISIS. Global warming has destabilized the war-torn region, causing extreme drought, destroying farms and displacing millions of people. And while the resulting abject poverty and violence have driven millions to seek safety and security in Europe, those conditions have also driven many to join the extremists.

More than any terror group—be it al-Qaida, ISIS, Boko Haram, et. al.—climate change is the greatest threat to the planet and its inhabitants. And yet year after year the nations of the world kick the can down the road.

That’s the reason this newspaper, along with dozens of others around the country, is participating in a national letter-writing campaign called Letters to the Future in advance of the 21st annual climate conference, which begins Nov. 30. Sacramento News & Review Editor-at-Large Melinda Welsh spearheaded this project, recruiting such luminaries as Bill McKibben, Michael Pollan and Jim Hightower to join the conversation.

The letters are written to each author’s descendants, a few generations from now, predicting the outcome of the talks. The point is to urge world leaders to make substantive commitments to curb the greenhouse gas emissions that are wreaking havoc on the planet and jeopardizing its ability to sustain future generations. None of the 20 preceding talks has led to a legally binding agreement to do that.

For this week’s cover story, we compiled several of the essays.

Their authors include two Pulitzer Prize winners, an astronaut and a national environmental advocate, along with a trio of local letter-writers. There are more than 100 additional essays at LettersToTheFuture.org. Please read them. They vary in tone, from cautiously optimistic to comical to what some, based on our history of indifference, would assume is realistic—an apocalyptic vision of the future.

It’s not too late to make your voice heard by penning a letter to the future. Those received before Nov. 25 will be sent to delegates and citizens who are convening in Paris for the talks. And it’s not too late to get involved locally with a group trying to shed light on the planet’s plight (see Meredith J. Cooper’s report on page 8).

Climate change is an issue requiring leadership at the highest level, but that doesn’t mean the rest of us have to sit on our hands. Now is the time for action, not only in Paris but also right here in our backyards.

Credit to anti-frackers Re “The drought’s silver lining” (Guest comment, by Robert Speer, Nov. 12): Thank you, Robert Speer, for asking, “Who ... is working to protect our groundwater?”

Please don’t forget to also mention that Frack-Free Butte County is protecting our groundwater. No, fracking in Butte won’t drain North State water south. It would leave it right here, but only after that pure water was turned into a highly toxic witches’ brew.

Frackers typically pump their poisonous wastewater back into the ground where it threatens the groundwater quality. They can leave it on the surface in huge, vile open pits or in sealed steel tanks that require regular safety monitoring. The industry would like to recycle their fracking fluid to use in another frack-attack, but it is too hard to handle it safely and economically. It’s cheaper and easier to use more freshwater (on average about a million gallons) for each new frack-attack.

North State water sent south may be used for fracking there. Fracking is active in the south state where aquifers are documented as threatened by waste fracking fluid. Do we want to export our water to help support groundwater-destructive activities, particularly during a major drought?

There are gas and oil alternatives.

There are no water alternatives.

A stinky proposition Re “Preparing for pot legalization” (Editorial, Nov. 12): Last week the CN&R once again stunk up its pages with pro-pot propaganda. That is, with arguments that since people are going to smoke recreational marijuana whether it’s legal or not, it might as well be legal so it’s “safe” and so government can tax it.

This author and the CN&R will have blood on their hands if recreational marijuana’s legalized in California. That is, for minimizing the seriousness of the drug’s effect on human health, the environment and public safety.

Alcohol already destroys marriages, families and careers.

In so doing it swells everyone’s insurance premiums and causes many to incur astronomical legal fees. Do we really want to throw marijuana into this mix?

Like alcohol, tobacco and other drugs, marijuana’s harmful and isn’t necessary for either pleasure or pain relief. Rather, these substances are traps for those with more money than awareness, compassion and self-respect.

Not worth warring for Re “Commentary criticism” (Letters, by Maurice Picard, Nov. 12): I would like to thank Maurice Picard for his enlistment, coming to the aid of our nation under attack in 1941. That was nearly 74 years ago and situations have escalated to a far more offensive role.

Today’s complexities and invasions and encroachments into sovereign nations, to secure governance favorable to our best interests, translate, more than not, to exclusive access to resources and cheap labor. Economic coercion to struggling nations usually is sufficient to meet this goal, but if necessary the backing of a coup or assassination plot to overthrow any resistance is the trump card backed by covert CIA actions or military force.

The military-industrial complex is a for-profit business and moneylaundering endeavor consuming over half of tax revenue collected, proliferating the world’s weaponry and allowing private contractors to have virtually unregulated

opportunity to [inflate the costs of] security and services, all at the taxpayers’ expense. The recruitment of a steady flow of personnel to enforce this scenario is necessary and banners lining the streets of Chico near schools are promoting that goal.

Wars of profiteering and resource acquisition have nothing to do with anyone’s freedom and are surely not worthy of sacrificing our children for them.

No Hillary, please I’m a life-long Democrat, and it hurts to write this letter. I don’t think Hillary Clinton should be the Democratic choice for president in 2016.

As secretary of state between 2009-13, Clinton had a heavy hand in the destruction of Libya and Syria, bringing on today’s misery and tragic deaths of Libyan and Syrian refugees forced to leave their ruined homelands. Clinton’s shown no signs of regret for this. News sources in 2013 revealed that, against Obama’s stated position, Clinton’s hand was strangely heavy, too, in the 2009 Honduran military coup that replaced the elected, leftist President Manuel Zelaya with a right-wing military Junta. Do you remember when newspapers reported that the spell of large numbers of desperate children in terrible circumstances being smuggled not long ago across Mexican borders were actually from Honduras? No regrets about Honduras from Clinton then or since.

Wolf delisting anti- science Oregon Department of Fish and Wildlife (ODFW) voted to remove gray wolves from the endangered species list on Nov. 9. In so doing, the agency just added the right to kill to the state’s right-to-die law. What a mistake. Why are we allowing humans to take out their vengeance on this animal?

There are only 81 gray wolves in the state. By ignoring the input from over a dozen scientists and scores of concerned conservationists, ODFW has diminished its credibility as a wildlife manager and broken the trust of the citizenry.

Knuckling under to the moneyed interests of the bloodthirsty hunting and livestock industries showed a lack of concern for ecological balance. Has there been any measurable threat to humans or livestock by the gray wolf? If so, wildlife conservationists should be willing to provide compensation. That is, if these claims are to be trusted.

NEWSLINES DOWNSTROKE BODY FOUND IN OROVILLE

The Butte County Sheriff’s Office has opened a homicide investigation following the discovery of a woman’s body in Oroville last week.

A 911 call on Saturday, Nov. 14, reported the deceased woman was found near the 600 block of Dunstone Drive, according to a BCSO press release. The release states the woman appeared to be the victim of a homicide, but offered no further details pending investigation.

The victim, who remains unidentified, is a white female between 5-feet-5 and 5-feet-8 inches tall and weighing 160 to 200 pounds.

The body appears to have been at the site for several days before it was discovered. The BCSO is encouraging anyone who knows a missing person matching this description to contact them at 538-7671.

Jake Davis is a cofounder of the local chapter of 350.org, whose mission is ending climate change.

Safe Space, a seasonal, cold-weather program offering shelter at rotating local churches to local homeless people, will open its doors for the third year on Nov. 29, and volunteers say services will be greatly expanded this year.

“So far, we’ll be able to provide shelter and meals for 90 nights, and we have one church that will be the intake site the whole time,” said Cynthia Gailey, who coordinates the shelters on behalf of the Chico Housing Action Team. Last year, the shelters were open for 51 nights, and in 2013 for 15 nights. This year, nine churches have committed to act as venues, allowing the shelters to operate until at least Feb. 28.

Gailey said a volunteer orientation was held Nov. 11, but more volunteers are needed. Interested parties can sign up at chat.ivolunteer.com.

FEED METERS, FEED PEOPLE

A half dozen new “donation station” smart parking meters in downtown Chico will enable users to donate to organizations that provide resources for homeless people, according to a city of Chico press release.

The red-topped meters are scheduled to be installed Friday (Nov. 20), at six locations between First and Fourth streets and Salem and Broadway. The meters, which were donated by parking-meter vendor IPS Group, are part of an effort by local organizations including the

Downtown Chico Business Association and the Clean and Safe Action Group, “to create awareness

about the negative impacts of panhandling and provide an alternative,” the release reads.

Donations gathered through the meters will be distributed by the North Valley Community Foundation, and will benefit service groups to be determined at a later date.

Two local environmentalists bring Chico into the global movement against climate change

“I signed a lot of 350.org’s petitions online, and they put out a call [recently] and asked me if I would like to help get a local group together,” said Davis, who works by day as a groundskeeper and community gardener for the Sky Creek Dharma Center. Claire Hutkins Seda, a longtime champion of the environment (and sometimes contributor to this newspaper), heard about Davis’ desire to get involved and offered to co-create a local chapter of 350.org, dubbed Chico 350.

That was about 2 1/2 months ago, and since the first meeting, the group has grown from six to 25 at the most recent get-together. “It’s blossoming,” Davis said. With more than 85 followers on the group’s Facebook page, he’s optimistic for further growth.

“I’ve been really impressed by the

response of the community,” Seda said by phone.

Environmental guru Bill McKibben cofounded 350.org in 2008 with the hopes of getting past the politics that seemed to be holding the world back from accepting climate change as a reality. It organized global events, including the People’s Climate March last September that amassed more than 300,000 people in the streets of New York City, in addition to smaller marches all over the world.

This year’s main event will be the Global Climate March, whose goal is to bring awareness to the U.N. Climate Change Conference. The Chico group, and those around the United States and all over the world, will hold local marches and rallies to highlight the importance of the international talks. Chico’s will be Nov. 28 starting at 11 a.m. at the Chico Certified Farmers’ Market and winding through the streets of downtown before landing at the City Plaza.

“One of the reasons we started the local group was to join all the other communities in the world that will simultaneously be holding marches,” Seda said. “At the same time we’re marching, there will be hundreds of thousands of people also

marching all over the planet. That’s a really beautiful thing.”

There is concern that the recent terrorist attacks in Paris will put a halt to the massive march and demonstration planned there leading up to the talks.

“It will greatly take away from the movement’s visibility,” Davis said. “It’s really unfortunate.”

The 350.org website says the group is working with French authorities and is awaiting word regarding whether their planned activities in Paris will be allowed to go forward from a public safety standpoint. Regardless of whether the Paris demonstrations will occur, 350.org’s message is this: “The Global Climate March—a worldwide day of action scheduled for Nov. 28 and 29— will ... proceed, no matter what. We can think of few better responses to violence and terror than this movement’s push for peace and hope.”

is about giving a voice to locals who are passionate about the environment and how the world deals with climate change. Many people care, Davis said, they just need direction.

“A lot of folks see that there’s an issue, but they don’t know what they can do beyond recycling and conserving water,” he said. “I don’t know how much an individual can do—real change takes money. We need our governments to invest in science, clean energy and leaving our fossil fuels in the ground.

The most effective way to make change is by joining the movement, by adding your voice.

“This movement is about building this thing to a critical mass so that governments have to listen,” he added.

Seda agreed. From her viewpoint, the Chico community includes close to 90,000 people, all of whom have seen the effects of climate change first-hand in drops in air quality and an extended drought. Other communities of similar size have added their voice to the conversation, so why not Chico?

“Locally, I don’t think we’ve really come out to show our community and leaders how important climate change is. We’re the first people on the planet to see these changes first-hand, and we’re also the last generation to be able to do something about it effectively,” said Seda, who works as a writer and editor for the Migrant Clinicians’ Network. “People are craving a chance to do something meaningful. I’m happy we’re able to provide that chance.” Ω

events on their Monday night show, Say Hey! On the most recent episode (Nov. 16), a discussion of nominees for the Sports Illustrated Sportsman of the Year Award led to digressions about such wide-ranging competitions as tennis, ultimate fighting and horse racing.

The duo have vowed, however, to not discuss the biggest sport of the season, NFL football. The one exception is Dallas Cowboys defensive end Greg Hardy, who is the fuel for a fundraising campaign called Screw Greg Hardy, which the duo launched to benefit local victims of domestic violence.

“I’ve always loved the game, and still do,” Sprecher, a life-long football fan who grew up in a family of San Francisco 49ers season ticket holders, explained during a preshow interview Monday. “But it’s become really hard to balance that love with all of the B.S.” Sprecher was speaking of the league’s handling of domestic abuse cases involving players, and specifically about a recent debacle surrounding Hardy. In July 2014, Hardy—then playing for the Baltimore Ravens—was convicted of assault and other charges after he brutally attacked his thengirlfriend, throwing her against walls and choking her on a couch covered in assault rifles. He was given a 60-day suspended jail sentence and probation, but the punishments were overturned when the victim didn’t

show to an appeal hearing.

While on paid leave from the NFL, Hardy signed a bigger contract with Dallas, and a 10-game suspension this season was reduced to four games after the NFL Players Association lobbied on his behalf. On Nov. 5, the domestic violence charges were expunged from his record, prompting sports news site Deadspin to publish photos of the woman’s injuries and details of the attack.

The Deadspin article reignited controversy over how the NFL deals with players who commit domestic abuse. Arguably the most notable previous case was that of Ray Rice, another former Raven who was caught on surveillance camera knocking his thengirlfriend (now wife) out in an elevator and dragging her through a casino lobby.

City Council rejects management proposal, will go DIY at airport

he idea that Chico will regain passenger air service anytime soon flew out the window Tuesday evening, when the City Council Tvoted not to contract with a professional airport management group,

Earlier this year the city authorized paying Washington, D.C.based AvPORTS $200,000 to examine the airport and develop a strategic plan for improving it and attracting regular airline service. Last month the company presented its proposal to the Airport Commission, which scrutinized it for three hours before voting, 3-1, not to recommend adoption.

Initially AvPORTS had sought $180,000 annually to manage the airport, a 10-year commitment and a $50,000 “success fee” if it landed commercial air service. Its revised proposal Tuesday night (Nov. 17) was for $120,000 a year for five years and an additional $25,000 annually if the city wanted it to look for an airline, a dramatic reduction in cost, risk and ambition.

airport manager and two other staff members. As several council members and speakers noted, this would put AvPORTS in the position of managing the manager. As former Councilman (and current county Supervisor) Larry Wahl put it, “There is no reason to have an expensive middle man.”

The airport has been without professional management for many years, with the job falling to the city manager. As a result of this benign neglect, the airport has been operating at an annual loss, due in part, according to AvPORTS’ report, to a failure to adjust lease holdings to modern market values and attract new tenants.

A total of 13 people spoke to the issue, and nearly all recommended rejecting the AvPORTS proposal.

They believed the city could hire a professional manager and use local real-estate agents to handle its leases.

“AvPORTS is excellent when it comes to making presentations,” said former Airport Commissioner Norm Rosene, “but there’s nothing really new in this proposal. … Its strategies are no different than ones we’ve been talking about for many years.”

Not everyone was ready to give up on commercial air service, however.

Katie Simmons, president and CEO of the Chico Chamber of Commerce, said an unmet need for local air service would remain, and local businesses would suffer as a result.

“I hope this is not the end of the discussion,” she said. “We’re operating from a position of scarcity, but other airports’ success is based on investment,” she argued.

Former Mayor and Airport Commissioner Karl Ory proposed that a bond measure be put on the ballot targeting airport improvements, but to be used only if airline service is restored. “I’m disheartened that we’re so easily giving up on that airfield,” he said.

Mayor Mark Sorensen noted, however, that the airline industry is pulling out of small markets everywhere. “Either we can fill the seats or we can’t fill the seats,” he said. “We need to provide strong, compelling general-aviation services” before we can attract an airline.

People are defecating in doorways, she said, creating “a public health nuisance, if not a public health hazard. … We can’t cite people for going to the bathroom if we don’t provide bathrooms for them to use,” she said.

The council directed staff to come up with options and bring them to the Internal Affairs Committee.

Finally, the council voted unanimously to move toward forming a groundwater sustainability agency in tandem with Butte County and the other cities in the county, pursuant to passage of the state’s Sustainable Groundwater Management Act. Doing so will give the city more clout when it comes to protecting its groundwater, said Erik Gustafson, Public Works director for Operations and Maintenance.

“Some people are like, ‘Duh,’ but others are really enlightened by this,” Blankenship said. “No matter what you do as an adult, the research is showing that a lot of these conditions that you may suffer from are dictated by your exposure to trauma as a child.

“Trauma doesn’t have to mean you were molested. It could mean that; but it also has lots of other [meanings]. It could be neglect.

It could be a parent was incarcerated. It could be a parent had a mental illness.”

The 10 ACEs are common denominators researchers found to be connected to risk factors for myriad conditions during a 1997 study of 17,000 Californians conducted

by Kaiser Permanente in conjunction with the federal Centers for Disease Control and Prevention.

Mitch Brown, director of training for the Drug Endangered Children Training and Advocacy Center (or DECTAC), compares

ACE problem, a host of North State agencies, including the California Health Collaborative and DECTAC, have joined forces.

After training public health providers in Shasta County on ACEs—helping them become “trauma-informed”—Blankenship and several colleagues decided to organize similar sessions here. Their first planning meeting yielded the revelation that “this subject crosses all segments of the population,” she said. “Now we’re looking beyond health care-provider training.”

The second meeting drew 30 attendees working in law enforcement, social services, education and health. The group hopes to attract clergy as well during the next meeting on Dec. 4.

a specific topic,” Blankenship explained, such as domestic abuse and substance abuse. But linking them all together, she said, would be a significant step.

Blankenship added that, for adults, it’s never too late to understand how childhood affects adulthood. “It’s educational [to know] there are things that have shaped me as a person, that I have some resilience—but I might also have some risk factors, some things that I want to take a look at so I make sure I’m modeling proper behavior for my children.”

The consequences of ACEs are significant. Brown surveyed drug offenders in Butte County Jail for a pilot program called Perils of Drug Use—Walk with Me stemming from state corrections legisla-

tion AB 109. He found that 51 percent were exposed to at least four ACEs, compared to 12 percent of the general population in the original ACEs study from 1997, and the incidence of each ACE was much higher among the offenders (see chart).

“All the various disciplines have a piece of the puzzle to make children and families better off by providing them early services and not waiting for catastrophes to happen,” Brown said, adding, “We can’t really think we’re helping people if we’re only addressing one of the 10 issues, and we know they have more than that.

“We’re putting a frigging BandAid on it with no chance of success, as far as I’m concerned, without having a holistic approach.” Ω

WEEKLY DOSE Women’s sexuality Researchers from the University of Essex in England are positing that no woman is “totally straight.” The study, published by the Journal of Personality and Social Psychology, asked 345 women about their sexual preferences and measured their physiological sexual responses when shown videos of attractive men and women, finding that only 28 percent of straight women were mostly aroused by their preferred sex, compared with 68 percent of women who identified as gay. Such sexual arousal patterns from gay women is similar to those of men, whose physiological responses are typically consistent with stated preferences. Dr. Gerulf Rieger, the study’s lead author, suggested that women’s sexuality is far more complex than men’s. “When it comes to straight women and sexual arousal, there is such a disconnect between what a woman tells me and what her body does,” he said. “It suggests it’s a different world for women when it comes to their sexualities.”

ing about biology and ecosystems and caring for the planet. And thanks to a whole lot of planning on the part of a relatively new educational group, that’s exactly what they were doing.

Students in kindergarten through second grade formed half a dozen groups spread out in the school’s expansive outdoor area. Each was assigned a station, manned by local educators from the Stream Team, Chico State, Butte Environmental Council and California State Parks, among other organizations.

Their presentations included everything from the importance of recycling and keeping creeks clean to the wonders of ecology and native wildlife.

Laura Marciniak, resource teacher at Ophir Elementary, summed up her reaction with: “Wow. I could never get this done on my own.”

That’s where Outdoor Education for All fits in. Formed in 2013, OEFA is a partnership of 170 local educators—teachers, principals, professors, field guides—and organizations ranging from the Chico Creek Nature

Center and Lake Oroville State Recreation Area to Earthbound Skills and FISHBIO. “We all had a vision in common, of getting kids outside more,” said Nate Millard, supervisor of the First Year Experience Program at Chico State and a member of the OEFA steering committee. “And we realized that if we all get together, we will be way stronger.”

Turns out they were right. They approached individuals and organizations that fit their mission—to expose more local children, particularly those from low-income households, to outdoor education—and were met with enthusiasm. In the first two years, they were able to serve more than 2,000 local students at four schools, including charter schools.

“What I see [at the college level] is that many students have learned to hate school,” Millard said during a recent interview. “So if we can get them out with a bird expert, learning about birds, that could change their perspective of what science can do.”

In fact, many of OEFA’s partners already were working toward the same goal, only on their own. The Stream Team offers lessons in testing local creek water, for instance, and rangers at Lake Oroville State Recreation Learn more about OEFA:

Area and Lassen Volcanic National Park lead hikes and teach visitors about the land at their respective visitor centers. Jon Aull, a local naturalist, leads educational hikes in his capacity as outdoor education coordinator at Chico State’s Big Chico Creek Ecological Reserve. And now all that knowledge, which until this point was independently dispensed, can be presented to local schoolchildren in one neat package.

“Our goal is to offer local kids two to three outdoor science days a year,” said Tony Catalano, a former principal in the Thermalito Unified School District who now works at the Forebay Aquatic Center, organizing special events and school trips.

Thus far, OEFA has been embraced by not only local organizations that focus on science, the Earth and nature, but also by the kids. With the additional support of local school teachers and administrators, Catalano and Millard say they feel primed for a bright future.

OEFA’s steering committee, of which Millard and Catalano are both a part, has conducted surveys and assessments in order to put together a strategic plan through 2020.

That plan includes a number of goals, from expanding the network of providers as well as training for educators to supporting providers in an attempt to offer more outdoor education opportunities.

healthier communities and support a deepened and expanded land stewardship ethic,” the plan reads. “Our future depends on people who respect and protect the earth.”

One of the biggest challenges the group has faced thus far, Catalano said, is funding. Naturally, OEFA hopes to someday raise enough money in grants—it’s already received two—and donations to pay for a small administrative staff. An example of how funding might expand access to field trips to places like the Forebay Aquatic Center or Lassen Volcanic National Park is the need for transportation.

“We’ve met with some of the principals from south county schools and we’re shocked to find out they have a $200 budget,” Millard said. “So even if we can get a great field trip organized, we can’t get [the students] there.”

Catalano, having worked in the Thermalito Unified School District, understands the area’s unique challenges. “South county is a place where we can make the biggest difference,” he said. Thus far, the majority of field trips and on-site programs have focused on the Oroville area. OEFA’s target audience, however, spans all the schools in Butte County.

“I feel like we’ve just gotten started,” Millard said. Ω

So long to a Chico institution

Planetfriendly home improvement Until recently, 33-year-old Monica Smith was a stay-at-home mom who raised animals and tended “massive vegetable gardens.” But over the last six years, as she learned more about the toxicity of common household goods and the burgeoning market for eco-friendly building supplies, Smith’s toyed with the idea of opening up a green home-improvement store. In May, the first-time business owner took the leap and opened Earthliving in south Chico. There she offers mostly regionally produced countertops, flooring, insulation and bedding and more—all nontoxic and environmentally friendly. people used to open businesses with hard-earned money and their blood, sweat and tears. They didn’t just go, “Give me a $50,000 loan and if it doesn’t work out, whatever.”

Everything in here is hand-built, all the cabinetry. This building was a gas station, then it was Tom Berry’s Tires for like, 60 years, so this place was nasty and needed a facelift—a little sweat equity.

So, it’s about having products that make people think, “Wait, what am I using in my home, and what is the impact it’s making elsewhere?”

Why open a green building store?

I’ll reclaim wood, go strip barns or old fences and reuse it to make barn doors and cabinetry and such. I fill the back of my shop with it.

We live in such a toxic society; everything is toxic, when you really look into it. Your paint, your flooring, your insulation, your bed, your bedding—it’s pretty incredible, the toxic substances our homes contain. And I found it funny that we live in a city that kind of touts itself as being healthy and green and sustainable and there is not a single place that you can buy green home goods. You can buy that kind of food all day long.

Do you make anything yourself?

You’re handy?

I’m really learning. I’ve taken over the power tool situation; it’s not as hard as it looks. And because it’s old wood, if it’s a little bit off, people kind of assume that’s how it should be. It’s like, “That’s cool, right there.”

First it was the increase in employee health insurance costs. Then came the bump in California’s minimum wage. Add in a seemingly nonsensical citation from the state’s Department of Consumer Affairs and it became clear that the challenges were just too overwhelming for Woof & Poof, a 40-year-old Chico institution, to continue.

CEO and owner Roger Hart, his wife, Sabrina, and sister Linda Gonzalez took over ownership of Woof & Poof, which currently employs 15, 2 1/2 years ago after the passing of founder Jacki Headley in 2012. Headley started the business in 1975, and since then, Woof & Poof’s stuffed Santas, decorative pillows and household décor have developed a fan-following with nationwide distribution in 600 stores.

But the popularity of the Chico-made items are no match for what Hart said are “insurmountable” obstacles. Without mincing words, Hart said although there are a variety of factors pressing down on the Chico manufacturer, the largest hardship is being based in California.

“It’s virtually impossible for us to compete. The high cost of doing business in California puts us at a distinct disadvantage competitively,” Hart said.

Hart continued, saying the rising costs of doing business in the state would require him to raise product prices by 40 percent, and as a wholesaler, Woof & Poof sells to gift stores, which are struggling themselves to bring in customers.

The last straw was a state citation over the font size and type on the company’s decorative pillows to conform with requirements for pillows made for sleeping. Hart said the fine was eventually waived, but the Department of Consumer Affairs said the changes—which Hart said would be expensive—still needed to be made, with the looming threat that the state could seize the company’s inventory if they weren’t.

Though Hart said some advised him of taking Woof & Poof production offshore to increase profit margins, he felt that the option wasn’t right.

Instead, the family is closing up shop. Manufacturing has ceased and the remaining inventory will continue to be sold in retail outlets, locally at downtown’s Made in Chico.

Hart said he doesn’t know what the next move is for him professionally, but one thing is for certain in his mind: if he stays doing business in California, he’s going to be facing an uphill battle.

Scientists, authors, artists and activists predict the outcome of the upcoming U.N. climate talks in Paris

I just flushed my toilet with drinking water. I know, you don’t believe me: “Nobody could ever have been that stupid, that wasteful.” But we are. We use air conditioners all the time, even in mild climates where they aren’t a bit necessary. We cool our homes so we need to wear sweaters indoors in summer, and heat them so we have to wear T-shirts in mid-winter. We let one person drive around all alone in a huge thing called an SUV. We make perfectly good things—plates, cups, knives— then we use them just once, and throw them away. They’re still there, in your time. Dig them up. They’ll still be useable.

Maybe you have dug them up. Maybe you’re making use of them now. Maybe you’re frugal and ingenious in ways we in the wealthy world have not yet chosen to be. There’s an old teaching from a rabbi called Nachman who lived in a town called Bratslav centuries ago: “If you believe it is possible to destroy, believe it is possible to repair.”

Some of us believe that. We’re trying to spread the message.

Friends are working on genetic editing that will bring back the heath hen, a bird that went extinct almost 80 years ago. The last member of the species died in the woods just a few miles from my home. Did we succeed? Do you have heath hens, booming their mating calls across the sand plains that sustain them? If you do, it means that this idea of repair caught on in time, and that their habitat was restored, instead of being sold for yet more beachside mansions. It means that enough great minds turned away from the easy temptations of a career moving money from one rich person’s account to another’s, and instead became engineers and scientists dedicated to repairing and preserving this small blue marble, spinning in the velvet void.

We send out probes, looking for signs of life on other worlds. A possible spec of mold is exciting—press conference! News flash! Imagine if they found, say, a sparrow.

I Am Sorry I Have Been Sorry

I am sorry.

As I sit here early in the morning and think about my great, greatgranddaughter, living in a climatechanged world, I am sorry is the main thought that keeps coming to mind.

I am writing this letter to you for a newspaper project, but it is not remarkable for me to think so far ahead in time because, as a historian, I have made a life of thinking far into the past. My grandmother often told me of her grandmother . I was always struck at how diff erent my life is from hers, and I won der how different your life will be from mine. My great, great-grand mother came to this country with great hope and confidence in the future. That is where we part. I kno w too much about the devastating effe cts of climate change.

I am sorry.

I am writing in advance of the Pari s climate talks, round 21 to be exact. The hope of the talks is to produce binding CO reduction com mitments between countries, but I know that those “co2mmitments” are really between people, and I don ’t see the people around me com mitting to reducing their CO emissio ns. The city of Chico, where I live 2 , committed to reducing their gree nhouse gas production in 2008 and in the time since residents have incr eased their energy use by 20 perc ent.

I know you don’t want to hear abo ut all the petty issues like plastic bag bans that kept us from making meaningful change. You don’t care that the city was broke and didn’t have the staff to see that we met our “commitments.” You can see from your vantage point that we did nothing to avert your futu re simply because it was easier for us to not think about it, to not thin k about you. That you won’t care about any of my excuses makes it hard to write this letter.

Realizing that I am glad that I do not have to see this happen to you mak es me feel even worse, but thinking abo ut you has changed me in one way, and maybe that was the point of this exercis e. I am going to stop acting in ways that make me feel sorry. I am going to act and speak in ways that matter, no matter whom I have to apologize to, and maybe some of my great-grandmother’s hope will return.

I Am Sorry I Have Been Sorry

I am sorry.

As I sit here early in the morning and think about my great, greatgranddaughter, living in a climatechanged world, I am sorry is the main thought that keeps coming to mind.

I am writing this letter to you for a newspaper project, but it is not remarkable for me to think so far ahead in time because, as a historian, I have made a life of thinking far into the past. My grandmother often told me of her grandmother . I was always struck at how diff erent my life is from hers, and I won der how different your life will be from mine. My great, great-grand mother came to this country with great hope and confidence in the future. That is where we part. I kno w too much about the devastating effe cts of climate change.

I am sorry.

I am writing in advance of the Pari s climate talks, round 21 to be exact. The hope of the talks is to produce binding CO reduction com mitments between countries, but I know that those “co2mmitments” are really between people, and I don ’t see the people around me com mitting to reducing their CO emissio ns. The city of Chico, where I live 2 , committed to reducing their gree nhouse gas production in 2008 and in the time since residents have incr eased their energy use by 20 perc ent.

I know you don’t want to hear abo ut all the petty issues like plastic bag bans that kept us from making meaningful change. You don’t care that the city was broke and didn’t have the staff to see that we met our “commitments.” You can see from your vantage point that we did nothing to avert your futu re simply because it was easier for us to not think about it, to not thin k about you. That you won’t care about any of my excuses makes it hard to write this letter.

Realizing that I am glad that I do not have to see this happen to you mak es me feel even worse, but thinking abo ut you has changed me in one way, and maybe that was the point of this exercis e. I am going to stop acting in ways that make me feel sorry. I am going to act and speak in ways that matter, no matter whom I have to apologize to, and maybe some of my great-grandmother’s hope will return.

Dear Grandchildren, I can only imagine the wonderful world you are growing up in. I think of that world— your future—almost every day. I think about how to make sure it is a place where all your hopes and dreams can come true.

A long time ago, my parents traveled across the world from Korea to the United States in search of a brighter future for me and my sisters. Today, I am writing you from Paris, a city that I have traveled across the world to get to, in order to make sure the world does the same for you. I’m fighting for you, for everyone in your generation across the world, to ensure that you have more than a fighting chance at that bright future. A world without the dangers of global climate change is the world that you will inherit.

What is climate change? Never heard of it? I’m so very glad if you haven’t.

Let me try to explain. I warn you, though, this can be kind of scary.

When we first started building up our cities, roads and towns in what was called the Industrial Revolution, we burned all sorts of fuels—coal, oil and natural gas.

While these things helped us heat our homes, drive our cars and expand our cities, we didn’t realize that they also clouded our air, dirtied our water and made us sick. More than that, the burning of all those fuels made our planet sick. All the other animals and plants that we share this world with were getting sick too. The planet became warmer, which created a mixed-u p chaos of terrible hurricanes, tornadoes, raging wildfires, drought and increased hunger, growing rates of asthma and lung disease, and the extinction of animals at an unprecedented rate.

So my dear grandchildren, we faced a choice. We could keep doing what we had been doing, or we could make the choice to take a stand for our future—your future and the planet’s future—by creating the framework to begin to move away from this scary legacy.

The wind turbines and solar panels that power your world, electric cars, high-spe ed trains and solar airplanes weren’t so commonplace in my time. They required a revolution in how we think about energy, about our relationship to the world, about our faith in our own capacity to innovate and change.

What took us so long? Sigh. It’s a long story, but like many of the children ’s books you grew up with, it was a story of greed, short-sightedness and wizards with too much gold.

But against these challenges, sometimes with great bravery, people—young and old from every nation—stood up and demanded that we take the steps to curb this terrible scourge.

I hope you will know this to be true. I hope you will remember that many years ago, your grandma and many others across the world stood up and demanded that we make the world a better place. I hope you know that it was a difficult path, just like that of my parents so many years ago. And I hope you know we did it thinking of you and the future you now inherit.

The play is based on the 1936 antimarijuana propaganda film, Reefer Madness, which lured audiences using such sensationalistic slogans as, “Women cry for it—men die for it!” The original, church-sponsored film was revived as an unintentionally campy satire by pro-pot movie fans in the 1970s, and became a cult favorite and midnight movie staple.

This musical adaptation by collaborators Kevin Murphy and Dan Studney takes that satirical element to heights never intended by the original producers of the film, but does so by sticking

with the basic story and melodramatic approach to the topic. Clean-cut, allAmerican teenager Jimmy Harper (Eric Gateno) and his saddle-shoed, sausagecurled blonde sweetheart Mary Lane (Michelle Moore), are lured into the downward spiral of the reefer-smoking life by the nefarious and abusive Jack (Eric Dobson), proprietor of the Reefer Den. His abused, addicted and degraded moll, Mae (Lara Tenckhoff), presides over the smoky Den, inhabited by the fidgety, hysterically giggling college dropout Ralph (Michael Bram) and negligent, stoned-out teen mother/prostitute Sally (Lacy Stephens).

Introducing the characters from a mobile podium, the Lecturer (brilliantly done by quick-change artist Tyler Campbell, who shape-shifts into a satanic satyr, a soda jerk and a wheelchair-bound FDR, as narrative action demands) initially presents their story as a documentary illustrating his lecture. The opening production number, “Reefer Madness,” brings out the dance ensemble and vocal chorus in zombie regalia, and Wismer Theatre’s in-the-round staging is fully exploited by Sheree Henning’s choreography as dancers emerge seemingly from the theater’s seating to take over the central stage.

Studney’s music—which morphs seamlessly between swinging jazz, show-tune smarminess and heavy rock in a manner reminiscent of soundtrack composer Danny Elfman’s days as Oingo Boingo frontman—is played live by an excellent band above the main stage.

The cleverly paced episodic narrative is punctuated by a Placard Girl (Cassandra Gutierrez), whose job is to present the audience with such moralistic cues as “Reefer gets you raped, and you won’t care!” in reference to Mae and the abusive Jack, and “Taking a hit of reefer makes you sell your babies—for drug money!” in reference to wayward pothead mother Sally’s doing just that.

Reefer Madness presents many scenes and laughs, but highlights include appearances by a self-righteous, singing and dancing Jesus (a wigged and bearded Dobson), who appears after Jimmy has stolen money from church to support his habit, and Mary Lane’s transformation from school-girl innocent to raging dominatrix after puffing her first joint. Her transformation and subsequent domination of would-be seducer Ralph hilariously turns the tables on an ill-intentioned creeper in a manner that many a young woman can, if not relate to from personal experience, at least appreciate.

The grand finale offers satirical glimpses of American patriotism, Christian heaven and the U.S. penal system, with cast and supporting ensemble bedecked in Sandy Barton’s costume designs, which reflect the 1930s-era aesthetic of the original black-and-white movie brought into sparkling color.

With its cast packed with excellent singers and dancers, its beautifully crafted staging and its comical presentation of themes and scenes that any university student can relate to and laugh at, it’s no wonder that Reefer Madness (which ends tonight, Nov. 19) has been selling out each night. It sets a literal and figurative high bar for all future productions. Ω

We got a taste of his eclecticism in r ober t speer@ newsrev iew.c om the September concert, the first of the season, which ranged from Review: Smetana’s lively, joyful “Overture North state to The Bartered Bride” and symphony, maestro in the spotlight, Tchaikovsky’s Piano Concerto No. saturday, Nov. 14, at 1 (with the dazzling soloist Alpin Laxson auditorium. Hong) to that popular workhorse of the classical repertory, Beethoven’s Symphony No. 5.

Tucked into that medley of the old and the not-soold was a 10-minute work by the modern American composer Michael Slayton called “Fifth Prelude for Orchestra.” It’s kind of a trick piece, one designed to serve as a prelude to any of several big symphonies such as Beethoven’s Fifth. So, although it’s almost brand-new (it had its world premiere in 2012), it sounds rather 19th century.

That’s not the case with Lollapalooza, modern American composer John Adams’ 1995 composition that opened the symphony’s second concert of the season—dubbed Maestro in the Spotlight—on Saturday, Nov. 14, in Laxson Auditorium. As its title suggests, it’s a rhythmic, jazzy tour de force that is unmistakeably modern. Only six minutes long, it felt much longer—in a good way, like a rollercoaster ride that you don’t want to end.

That was followed by the “Third Movement” of Russian composer Dmitri Kabalevsky’s 1948 composition Violin Concerto in C major, performed by 18-yearold Redding resident Brianna Ruiz, the 2015 Young Artist Auditions winner. Ruiz has been playing violin since she was 5 years old and has played with several

This was followed by Franz Joseph Haydn’s Symphony No. 90 in C major. This was standard-issue Haydn, precise as clockwork, until the trick ending, which had Seaton holding his pose two or three times to make us applaud because we thought the piece was over when it wasn’t. “Fooled you,” he said, smiling slyly.

Afterward, he admitted he had hated Haydn (“he’s boring”) until he heard and saw this symphony being performed, complete with trick ending.

The second half of the program began with the most famous of all waltzes, Johann Strauss Jr.’s “By the Beautiful Blue Danube.” For me, the piece mostly dredged up memories of being forced to attend the Severance School of Dance when I was a teenager, so I was eager to get on to the final work of the night, Leonard Bernstein’s Symphonic Dances from West Side Story.

In 1961, four years after the stage version of the groundbreaking musical premiered, Bernstein created a single composition based on the play’s songs and dances, something clearly from the theater piece but independent of it.

The result is 22 minutes of amazing music, all of it recognizably derived from the play but at the same time fresh and complete in its own right. Jazz rhythms predominate, and the orchestra’s percussionists got a workout Friday night, let me tell you. It was one of the most exhilarating performances I’ve seen from the symphony.

Following a boisterous standing ovation, Seaton led the orchestra in a reprise of the vibrant, exuberant “Mambo” section of the piece. The result: another standing ovation.

Keep on mixing it up, maestro. You’re on a roll. Ω

Maud’s circuitous route toward radicalization puts her in the vicinity, however briefly, of some historical figures, including the soon-to-be-martyred Emily Wilding Davison (Natalie Press) and the great suffragette figurehead, Emmeline Pankhurst (Meryl Streep). King George V (Simon Gifford) and politician David Lloyd George (Adrian Schiller) also make brief, notable appearances.

The other key player in Morgan’s scenario is the

fictional Arthur Steed (a gruffly avuncular Brendan Gleeson), a police inspector who dutifully oversees the government’s attempts at surveillance and disruption of the suffrage militants. In this telling, he is also a sensitive pragmatist who is capable of seeing the merits of the women’s cause and respecting the embattled courage of Maud and her militant friends.

Suffragette pays its respects to the women of the British suffrage movement, particularly in its portrayal of the heavy human cost paid by the militant women.

But much of it plays like a set of big-budget illustrations for a semi-familiar story full of stock sentiments.

As the story of Maud’s radicalization, the film stacks the deck in ways that, ultimately, seem counterproductive. The steadily escalating array of injustices visited upon Maud verges on melodramatic excess and parody. That Maud is reluctant to take radical action until those ever-mounting repressions leave her no other option is one of the film’s most plangent ironies, but those same ironies also give credence to Steed’s pragmatism and caution.

After watching the film this past weekend, someone asked me why Gleeson/Steed had such a prominent role in the story. My answer then was that he is both an agent of cultural and legal oppression and an intelligent official who is starting to respect the feminist cause. And now I’d add that he is central to a film that, intentionally or not, cautions against both radicalism and oppression. Ω

Surprisingly, Bridge of Spies doesn’t overplay the twists that you more or less expect in a cinematic history lesson directed

by Steven Spielberg and starring Tom Hanks.

James Donovan (Hanks) is an insurance lawyer recruited by U.S. government agents to act as defense lawyer for Rudolf Abel (Mark Rylance), a man accused (circa 1957) of spying for the U.S.S.R. During the sentencing phase, Donovan raises the possibility of an exchange between the two countries of condemned spies. The film has already begun to follow the case of Francis Gary Powers, pilot of a U-2 spy plane shot down over Soviet territory, and Donovan serves as the key intermediary in an exchange of Abel for Pow-

ers. Donovan’s heroic combination of ethical integrity and shrewdly political maneuvering is played with characteristically understated dignity by Hanks, and Rylance’s wonderfully minimalist rendering of Abel’s own courage and integrity gets even more out of the deadpan understatement that seems central to the whole production. The Martian

Botanist/astronaut Mark Watney (Matt Damon) is stranded on Mars after a hurricane of space debris forces his fellow crew members, who believe he’s been killed, to return to Earth without him. That sets up a kind of space-age Robinson Crusoe story for Watney, who must find ways to survive in a place where nothing grows, while also trying to cobble together the means of communication and travel from the scavenged remnants of technology. And the realization that Watney is still alive pushes Mission Control (and, eventually, the crew on the ship headed back to Earth) into some rapidly evolving scenarios of high-pressure risk-taking in science and technology. If that sounds overly technical, rest assured that The Martian frequently pairs its scientific seriousness with the rambunctiousness of some of its characters. The stranded Watney’s early declaration—“I’m gonna science the shit out of this!”—is emblematic of the film and its determination to put an audience-friendly spin on its science and its fiction. The only other food for which story and photo by that might be true is doughnuts. The Donut Nook is Chico’s longest-running doughnuteer, with “Big” Joe Del Carlo frying up the first batch of doughy treats there in 1977. Big Joe passed on in 1996 and his son, Little Joe, now owns and operates the store.

This information and a good deal more was provided by Megan Stiles, who was working the counter during my most recent visit, and seemed to be happy to share her expansive knowledge about the Nook and her doughnut expertise. She helped select a balanced boxful of doughy delights, covering all the basics (cakes and raised) and some of the shop’s atypical offerings and customer favorites. During my half-hour visit, at least 10 single or small groups of customers came in, most of whom Stiles knew by name, regular order or both.

Stiles said fritters rank among the shop’s best sellers, noting they offer blueberry fritters in addition to the more common apple variety (all fritters and rolls are $1.45).

They also have blueberry old-fashioned doughnuts, and the shop’s most unique offerings, the peanut butter chocolate chip squares (also $1.45)—light, doughy raised squares similar to bars, but with a gooey, creamy peanutbutter-and-chocolate-chip center. (They also have a plain chocolate chip variety without the peanut butter.)

Tempted as I was to dig in to the box post-haste, I brought the baker’s dozen into work and carved off samples of each. As I settled into my plate of mangled

doughnut parts, I contemplated the physics of doughnutry. There are many factors and formulas involved, such as circumference of the hole in relation to the whole, but in my opinion it all comes down to density.

Different doughnut types require different densities, and proper densities are the best indicator of doughnut quality. The Donut Nook nailed ’em all.

The fritters were crispy on the outside (especially in the nooks and crannies) and perfectly doughy in the middle, while the raised bars were light and airy on the inside. The cake doughnuts are naturally more dense than the raised, with the old fashioned having their own even heavier density balanced by crispy ridges. The blueberry offerings were indeed a unique treat, while the Nook’s chocolate, maple and other icings were of the solid and sugary variety rather than the straight cake frosting unceremoniously slathered all over many a lesser doughnut.

I saved the peanut-butter-chocolate-chip square for last, and was glad I did. The second my tongue met peanut butter I thought, Why, oh why, is this not a common thing? Bacon on maple bars has become a fad in recent years, but how has modern civilization survived this long without slathering peanut butter on all of our doughnuts? It’s divine.

All told, my trip to the Donut Nook did indeed brighten my day, and got me some points around the office. Stiles and some other regulars imparted some other expert advice for my next visit. The Donut Nook is open all night, every night. Wednesday through Saturday, it’s open 24 hours, and Sunday-Tuesday, it’s only closed between 1 and 8:30 p.m. As one of the few places to congregate and grab a bite late at night in that part of town, the Donut Nook is often hopping in the early morning when fresh selections are coming out of the friers. Wildcide Hard cider Aurum Cider Co. Gordon Biersch Brewing Co. co-founder Dan Gordon’s inspiration for the first hard cider offering from his new Aurum Cider Co. came when he saw bears and elk munching on fermented apples in the wild.

Wildcide uses only juice from fresh-pressed apples—four varieties: Fuji, Granny Smith, Red and Golden Delicious—no concentrates. The result is a dry, well-blended cider distinctly rooted in the orchards. Lead Belly’s Gold Eric Bibb and JJ Milteau Stony Plain records If you’re a folk singer—and Eric Bibb certainly qualifies, both by birth (his father was Leon Bibb, a folk singer popular in the 1960s) and inclination (now 64, he’s recorded almost 40 albums)—you’ll want to come to grips with the musical career of Huddie Ledbetter, America’s most iconic folk singer. Joined on Lead Belly’s Gold by JJ Milteau, a French harmonica player, the pair explores a baker’s dozen of songs either written or sung by the imposing black man who was discovered 82 years ago on a Louisiana prison farm where he was doing time for stabbing a white man, not the first example of his violent behavior. But the more restrained Bibb and Milteau are no match for a lot of Lead Belly’s music. The wheezy harmonica seems out of place, and where’s the 12-string guitar? However, they don’t pull any punches on “Bourgeois Blues,” a scathing indictment of segregation that effectively uses the N-word. And yes, “Goodnight, Irene” is also here.

Love’s Real estate Carbon Compliance The Carbon Monoxide Poisoning Prevention Act requires carbon monoxide detectors to be installed in every “dwelling unit intended for human occupancy.” Every owner must install an approved carbon monoxide device in each dwelling that has a fossil fuel burning appliance, fireplace, or an attached garage.

Q. Are there any penalties for noncompliance with this law regarding installation of carbon monoxide detector devices?

A. Yes. A violation is an infraction punishable by a maximum fine of $200 for each offense. However, a property owner must receive a 30-day notice to correct first. If an owner who receives such a notice fails to correct the problem within the 30-day period, then the owner may be assessed the fine.

A. No. However, the buyer may be entitled to an award of actual damages not to exceed $100 plus court costs and attorney’s fees.

Q. Do landlords have any special obligations regarding carbon monoxide detectors?

A. Yes. All landlords of dwelling units must install carbon monoxide detectors. The carbon monoxide device must be operable at the time that a tenant takes possession. However, the tenant has the responsibility of notifying the owner or owner’s agent if the tenant becomes aware of an inoperable or deficient carbon monoxide device. The landlord is not in violation of the law for a deficient or inoperable carbon monoxide device if he or she has not received notice of the problem from the tenant.
