That’s because overconsumption of municipal water now comes with a slap on the wrist in the form of a so-called drought surcharge, as outlined by Cal Water Services Co., at the direction of the California Water Resources Control Board, whose goal is sustaining current water supplies amid the dearth of rainfall in the parched state.

Here in Chico, we’re being asked to reduce our water usage by 32 percent, based on what we used in 2013. That’s a tall order, one that will require considerable effort. Some folks are already savvy to the ways of reducing their consumption; little things like turning the faucet off while brushing their teeth, flushing the toilet less often, taking quick showers, etc.

Others are heading outdoors to the yard, making a larger dent in their annual usage by pulling out water-intensive greenery and old-school sprinklers. According the state water board, between 50 percent and 80 percent of the average household’s water consumption is used outdoors. And half of that total is used to water lawns and gardens.

As is noted in CN&R intern Ernesto Rivera’s Newsline in this issue (see “Hasta la vista, lawns,” page 11), professional landscapers and irrigation specialists say locals are increasingly wondering what to do about their landscaping. They’re telling them about water-saving outdoor plumbing and something referred to as the “new California aesthetic,” which, when done well, is actually quite lovely.

That new look is composed of drought-tolerant plants fed by efficient drip irrigation. It eliminates the lawn—the longtime popular feature in front- and backyards the nation over. For some folks, the thought of ripping up turf is hard to swallow. But this historic drought requires a new way of thinking. Just remember: We’re all in this together. Ω

Hail to the chief After a national search for a new Chico police chief, City Manager Mark

Orme went with an internal candidate, Capt. Mike O’Brien, a longtime and well-respected member of the Chico Police Department. Time will tell whether O’Brien will provide the leadership the job requires, and whether he’ll stick around for more than three years.

What we do know is that there’s a track record of internal promotions to that post and then quick exits after only a few years of lackluster leadership. The last two police chiefs spent too much time and effort playing politics, allowing their employees to ramp up the rhetoric about police understaffing.

The posturing from the top of the department on down to the rank and file always seemed to coincide with the contract negotiations between the city and the police union, the Chico Police Officers’Association. The union’s leadership in recent years has a habit of holding the public hostage—or at least attempting to—in an effort to make citizens sympathetic to their plight. From what we heard during the negotiations, you’d think they were working in East Oakland, not Chico.

During these times, the chiefs did little to ensure Chico’s residents that public safety was the department’s No. 1 priority. And then, poof, they were outta there, taking advantage of the California Public Employees Retirement System that allows longtime public safety employees to retire at 50 years old on an extremely generous taxpayer-funded cushion (90 percent of their highest salary).

We’re skeptical that O’Brien will stay beyond the time—three years from now—when he reaches his max-retirement payout, and who could blame him? But we’ll keep an open mind about his intentions. And we wish him well. Ω

Prove me wrong

Re “Vets helping vets” (Cover story sidebar,

by Tom Gascoyne, May 28): Being project manager for the Veterans’ Garden Project (VGP), located in the BEC Humboldt Community Garden, has been an eyeopener for me. Having a brother who survived Vietnam and not speaking of it for over 30 years, then hearing some of his stories, I am amazed at how well his life turned out. But not so for many other veterans.

I want to encourage veterans to come out to the group recently formed by a Yuba City clinic veteran, Ray Pursley. He collaborated with the Chico VA Behavioral Health Clinic and started a group called Get Out of the House. This group meets every Thursday and our organization (VGP) has jumped in to organize activities like gardening, bocce, golf and barbecues.

Some members of the group had been homeless at one time, others merely socially isolated.

When they get together, whatever arm of the military they served, it is like running into an old friend. It is heartwarming to listen to, and gratifying to be a part of, their healing process. Of course, our main goal is to get more veterans involved in the gardening experience, and there have been great strides in healing many through this.

Whose friends are they?

Re “Disc-ology” (Newslines, by Howard Hardee, May 28): Woody Elliott isn’t really a member of Friends of Bidwell Park because the group is not a membership organization, according to its website. It is just seven board members made up of environmental consultants and their friends.

They have no ‘likes’ on Facebook.

They obtain access to Bidwell Park for members of their board to pursue little projects of their own, and work to shut out other groups.

City Park and Natural Resources Manager Dan Efseaff’s previous job as an environmental consultant existed because of the work of Friends President John Merz. These people have been working to reduce the recreation aspect of Bidwell Park, and would like to see it as an ecological reserve for which they have the keys to the locked gate for their personal use, while the rest of us fund various duplicative studies to keep them occupied.

I suspect they would like to add Bidwell Ranch to the park in order justify even more expensive studies, while leaving the property locked up and accessible only by guided tours—led by them. Every now and then, on the date we go to print (or shortly thereafter), somebody makes a big announcement. Or, the you-know-what hits the fan. In this particular case, I’m referring to the recent appointment of Chico Police Capt. Mike O’Brien to the position of police chief. That announcement came last Thursday morning, less than 24 hours after this ink-stained wretch had put CN&R’s latest issue to bed.

If you read this space last week, you know that embattled former San Luis Obispo Police Chief Steve Gesell was rumored to be one of the finalists for the post of Chico’s top cop. The rumors were true. Gesell confirmed as much in a TV interview. He also said he pulled his name from the cast of candidates, giving this nebulous reason: “Chico has a lot of similarities to San Luis Obispo, and the last thing that I would want to put my family through again was some of the same scenarios that I have been through here.”

I have family in San Luis Obispo, and have visited that area on numerous occasions. But other than both places being college towns, the similarities are lost on me. Chico is about twice the size of SLO, population-wise. And, well, what I wouldn’t give for some of that coastal weather. I don’t know what Gesell is talking about, and I’m not sure I buy that he pulled his name out of the race at the eleventh hour. My guess is the guy is trying to save face after finding out he wasn’t getting the Chico gig. If he truly did back out last minute, it’s his loss. In either case, it sounds to me like Chico dodged the proverbial bullet.

We’ll probably never know what happened. Chico City Manager Mark Orme has been on lockdown about the hiring process, even hours before announcing that O’Brien was the chosen one. In fact, members of the Chico Police Department were sweating it right up until the time of the announcement. One of them called our office while we were on deadline to voice concerns about Gesell’s candidacy. Minutes later, another caller, this one anonymous, related the same info.

Which is to say, I’m pretty sure CPD’s staff let out a collective sigh of relief when O’Brien got the job.

So, what’s our new chief’s deal? Will he stabilize the department? Will he step up proactive enforcement? Will he rid the department of its bad apples? Time will tell, I suppose. Lucky for him, the cops’ union just agreed to a new contract with the city. That means he won’t have to deal with his employees and his bosses wrangling over wages, at least not for the next three years. Of course, that’s about the amount of time it will take for O’Brien to reach that threshold where he can retire at 90 percent of his highest salary for the rest of his life. That’s what happened with our last two chiefs, Mike Maloney and Kirk Trostle. Will O’Brien stay beyond that point? I doubt it.

But I’d love for him to prove me wrong.

Re “The downside to unearned fortunes” (Guest comment, by Nathan Esplanade, May 28): My head is still spinning days after reading Nathan Esplanade’s guest comment. The Social Security Act was signed into law by President Roosevelt on Aug. 14, 1935, for the very purpose of providing financial security for those very same “ordinary Americans” (according to Esplanade) whose liberty, wealth and security is being threatened by Social Security!

Esplanade lumps Social Security benefits into the same category as “unearned fortunes” and “abuses” such as spouses who kill to receive life insurance pay-outs. I earned every penny I paid into the Social Security system over 40 years in the workforce and the pittance I now receive barely covers my monthly expenses, let along allows me to roll in “unearned” wealth.

Re “In defense of militarization” (Letters, by Allan Clark, May 28): Mr. Clark, sir, I must say you are correct about the rarity of harmful usage and the fallacy of grenade launchers. I intended to write about Marine veteran Scott Olsen, who was at a peaceful protest during Occupy Oakland when he was shot in the head by a police projectile. I thought it had been fired through a grenade launcher, but it was only a pellet bag fired through a shotgun barrel and it was the protesters trying to rescue him who dealt with a flashbang grenade, which may have simply been hand tossed, not launched. My mistake; I got my facts twisted, but it’s a pity that a combat vet remained relatively unscathed through two Iraq tours, only to have his skull fractured at home.

It might be wise to mention that there appear to be more restrictions on these weapons in military engagement than there are here at home. But you’re right, Mr. Clark, why should we worry when police are doing a fine job of harming unarmed civilians with standard issue firearms and chokeholds?

Response, part two Re “The point actually was” (Letters, by Patrick Newman, May 21) Patrick Newman believes that gluttonous consumption is made possible by the exploitation of people, animals and ecosystems. I agree. But what really is at the root of this phenomenon? My assertion has been that human “value systems” have been cultivated by the patriarchal-influenced societies that created them.

These patriarchal “value systems” have assured men for many centuries that they are the superior sex and the masters of their domain, which apparently means the planet and all life on it, including women.

From ancient times, women have been associated with either evil temptresses who must be subdued and controlled, or the mythical Eve, who facilitated to the fall of man.

Not great reputations to bear.

Misogyny is the oldest and most pervasive prejudice known to mankind. Its effects still deeply permeate the very foundations of human societies. Because women have always been equated with “Mother” nature, this prejudice carries over in how patriarchal societies view the planet as just another thing to dominate and exploit. I believe it is patriarchy that has led to the “ruthless exploitation of people, animals and ecosystems,” perpetrated to appease humanity’s unquenchable desire to often mindlessly consume and waste, ravaging the planet for future generations.

Another birthday wish Re “Happy b-day, Medicare” (Letters, by Tom Reed, May 28): In July, our country celebrates the 50th anniversary of the enactment of Medicare. As Tom Reed said in his letter, before the passage of Medicare, a third of older Americans fell below the poverty line and now it’s just 10 percent.

Besides Medicare, I am very pleased that Obamacare was enacted. With the exception of the enactment of Medicare 50 years ago, President Obama did more to get health care access to Americans than any of his predecessors.

Nevertheless, this is not enough. Medicare needs to be improved and extended to all Americans, and must include dental, vision, medicines and the encouragement of such alternatives as chiropractic, acupuncture and naturopathic care. Those alternative treatments are often more

effective than traditional care, and they are far less expensive.

We also need a system in which doctors strongly encourage their patients to take better care of themselves, like having proper diets, exercising, and not smoking and drinking. All of this must be part of the package. It does absolutely no good for doctors to treat those patients who do very little or nothing to take better care of themselves after they leave the doctor’s office.

Why did FIFA officials choose Qatar for 2022 World Cup soccer?

Temperatures of 120 degrees in the summer. Can players from all over the world survive in these conditions? Sepp Blatter, current president of FIFA, suggests the World Cup move to November.

But that disrupts every league in Europe and throughout the world.

League games are usually played between September and May. And again, why Qatar, where crowds will be subject to the country’s Qatari (Sharia) law? Can you imagine soccer crowds restricting themselves? Can we expect women to dress “modestly” in 120 degree heat? “Qatar does not permit dressing in a revealing or provocative manner, including wearing of sleeveless shirts and blouses, halter tops and shorts.”

And let’s not forget that those who drink or use foul language are subject to “zero tolerance.” To drink, you need a permit. For a permit, you need “a letter from your employer, stating your position, basic pay, occupation, religious affiliation, marital status, etc.” No intimacy between men and women; imprisonment and lengthy court trials. And no homosexuality; it’s illegal, and violators may be subjected to lashings. Wow! And FIFA has chosen Qatar to host the 2022 soccer World Cup?!

SHUTTLE SERVICE SCUTTLED

The city-funded shuttle service that transports people from the Torres Community Shelter to the Jesus Center for meals in the morning will end on July 31. After that, vouchers for bus passes will be provided to the shelter’s guests.

The Chico City Council decided as much during its meeting on Tuesday, June 2, after discovering it costs $72,000 of the city’s Transportation Development Act funding to run the shuttle year-round. Paying for bus passes will cost about $30,000 annually, estimated Assistant City Manager Chris Constantin, but the council agreed to provide $35,000 for the first year of transition.

Brad Montgomery, the Torres Shelter’s executive director, said about 40 to 50 people—many of whom are elderly or “medically fragile”—depend on the shuttle service, but spoke in support of the bus pass system.

A fireworks celebration in Oroville is a certainty this July 4, and the town has resident Deliah Robison to thank for it.

Robison entered the City of Gold into a national competition—the third annual Red, White and You contest—sponsored by newspaper USA Today and TV network Destination America. The city, along with the other winner, Waveland, Miss., was chosen from among more than 2,600 entries, according to USA Today.

Waveland reportedly has not had a fireworks display since the town was struck by Hurricane Katrina a decade ago. Oroville has had a hard time organizing and paying for a display, and the once-annual event over the dam has been canceled a few times in recent years.

The Fourth of July celebration for each town is valued at approximately $50,000.

NO CONTEST IN BRUTAL KILLING

A Paradise man facing a murder charge in Butte County Superior Court pleaded no contest Monday, June 1.

According to a press release from the Butte County District Attorney’s Office, on March 31 last year, 42-year-old Charles Blalock (pictured) beat his landlord to death.

The 6-foot, 7-inch, 230-pound Blalock reportedly “sucker punched” the much smaller and disabled Brian Clouser, 54, over a so-called “peeping incident.”

After an hour of getting beaten, Clouser reportedly asked Blalock, “What are you going to do, kill me, Charlie?” Witnesses said Blalock intensified the beating, eventually breaking Clouser’s eye sockets, nose and ribs, stabbing him in the back with a pocket knife, then burning and burying his body in Concow.

Of the four co-defendants who witnessed the beating, two received prison time and two were placed on probation. The press release says “Blalock is an active white supremacist gang member and used that to intimidate and manipulate his codefendants.” He’s facing 25 years to life in prison when sentenced Aug. 13.

started a nonprofit organization called the Loch Lomond Glen Foundation to oversee the site when the park idea first emerged more than two decades ago.

Nikolauson is a jolly fellow until topics

like building permits, use fees and governmental bodies come up, at which point the twinkle in his eye turns into more of an angry gleam. “Just look around at this place,” he said. “It’s a great example of what you can do without the government’s help.”

His ire comes from the fact that many of the improvements made to the park in recent years, including concrete foundations for yet-to-be-finished bathrooms, light poles and other facilities, were built without a conditional-use permit or building permits and without paying development impact fees, and the county is demanding he pay nearly $10,000 to comply. Nikolauson additionally owes nearly $2,500 to noncounty agencies like the California Department of Fish and Wildlife. On May 19, he appeared before the Butte County Board of Supervisors, asking that the county waive fees in the interest of keeping Loch Lomond Glen open. It’s the only park in Magalia.

The supervisors decided it was in the public interest to waive $3,990 for the conditional-use permit, but will hold Nikolauson and his foundation accountable for the rest.

“I’m still having a hard time figuring out what I’m forgiven for and what I’m still responsible for,” he said, explaining some of the fees are related to his living on the property in a donated motor home, which he hopes to sell to help cover costs, even though it may leave him without a roof over his head. “All I know is it’s a heckuva lot more money than I have.”

This is not the first time Nikolauson has tangled with detractors over Loch Lomond Glen. Butte County Superior Court records include a litany of conflicts with neighbors, county and state officials over the last several decades.

Nikolauson said his life-long dream has

been to start a Christian-oriented kids’ camp, and he pursued an uncompleted recreation degree in his younger days.

Few can deny that what Nikolauson has built at Loch Lomond Glen is impressive, though his sensibilities obviously lean toward a long-gone, less-litigious era. He scoffs at modern playgrounds and the mollycoddled children he believes such sterile environments create, and a sign near the Nimshew Road entrance to the park warns visitors to enter and play at their own risk.

“None of this equipment is rubberized like it is at most playgrounds tody; anyone can get hurt on anything here,” Nikolauson proclaimed with pride.

“Kids naturally look for challenges and it helps build up their self-esteem. That’s what my whole park is designed to do; challenge them and help them have fun and learn to believe in themselves.”

Nikolauson’s ideas on that matter may be more progressive than some people realize. As reported in April on National Public Radio, there are a growing number of “adventure playgrounds” in Europe—and at least a few in the United States—that encourage “wild, risky play.” Some even supply kids with matches, hammers and nails. Erin Davis, who directed a documentary called The Land about such a park in Wales, told NPR that the park she filmed at length (also called The Land) is “a play space rooted in the belief that kids are empowered when they learn to manage risks on their own.”

Still, liability issues likely are the biggest hurdle that Nikolauson will have to deal with moving forward, according to Mike Trinca, district manager for the Paradise Recreation and Park District.

Trinca said he visited the man and his park four years ago to discuss the possibility of the public organization partnering with Nikolauson for stewardship of Loch Lomond Glen.

“It’s not something we could get involved with because, as a public entity, the safety standards and regulations we have to adhere to are a lot more strict,” Trinca said. “He’s managed to do a lot with a little, much more than we could get done, but Mr. Nikolauson would need to upgrade his building standards if it was a public facility.”

However, Trinca said it’s not unprecedented for a private citizen to build a private park for public use, citing Stirling City’s Clotilde Merlo Park as an example.

In the meantime, Nikolauson said he’s uncomfortable with organized fundraising, though he’s happy to accept donations. He also regrets that any money he raises in the near future likely will go toward paying fees and fines rather than back into the park. He has plenty of plans for improvements, which include developing the remaining 4 acres; installing a high-dive, water slides and a trampoline at the swimming hole; a sound system to host regular music events; an outdoor kitchen; and a miniature train, complete with trestles and tunnels, running around the whole property.

“I keep hoping that someday someone will come along and bless me so I can get [the county] off my back and get this all done,” he said. “If I got $2 million tomorrow, I’d put every penny left back into this park.” Ω

homeless and transient community seems to be expanding and some are questioning why in recent years Chico police chiefs have tended to serve for three years max before retiring.

Capt. Mike O’Brien was sworn into office Tuesday, June 2, before a packed City Council chambers that included dozens of current and retired officers, Butte County District Attorney Mike Ramsey and former Chief Mike Maloney. It was clear from the standing ovation that O’Brien enjoys a large amount of support from the council, community and police department. In his acceptance speech, he said he was humbled to be given the opportunity, honored to serve and felt blessed to be Chico’s new police chief.

O’Brien first came to Chico in 1984 to attend Chico State, having grown up in the Bay Area city of Dublin before his family moved to Red Bluff during his junior year of high school. He worked for the Los Angeles County Sheriff’s Department for four years before getting hired by then-Chico Police Chief Mike Dunbaugh. He has reared four children, all of whom were at the swearingin ceremony, along with his wife, parents and in-laws.

O’Brien said he enters office at a critical juncture as the news of police shootings has taken on a high profile nationwide. He said it is important for the police department to build relationships with every segment of the community.

“That means the police chief and the police department should never be isolated from any part of the community,” he said in an interview with CN&R. “When that isolation occurs, I think some things can break down. I’m not here to excuse the rioting, the criminal behavior, because that is unacceptable. But if there is breakdown in relationships between police departments and certain segments of the community, I think there is a loss for both.”

He said the ongoing problem of homeless people and transients is complex and must be addressed by the entire community.

“There are two components to it: compassion and accountability,” he said. “If either one gets out of balance, you have issues. You need to have compassion for our fellow human beings, but there also has to be accountability on their part. If you allow one of those to supersede the other, you end up with issues. I want to be someone in this community that helps strike that balance.”

In every year since 2002, a majority of respondents have said the country’s morals are deteriorating. The outlook has improved slightly from a year ago, when 74 percent believed values were “getting worse.” The height of pessimism (82 percent) came in 2007, during the peak of disagreement over the Iraq War, when liberals’ views took a drastic negative turn. O’Brien, who agreed to a salary of $140,000, down from Trostle’s $154,000, said he recognizes the importance of serving a substantial term as chief.

“I understand loud and clear that this department and this community really want to see a chief with some longevity,” he said.

“I’m thinking five to six years. That is what I will certainly do my best to serve. I can’t predict the future, but I can tell you honestly I have no intent in leaving after two or three years.”

The two most recent chiefs—Trostle and Maloney—retired once they became eligible to receive 90 percent of their highest pay because they had worked for a police department in the state for 30 years and were 50 years old. The 53-year-old O’Brien, including his four years with the L.A. County Sheriff’s Department, has three years to hit the 30-year mark.

City Manager Mark Orme, who’s been on the job for a year following a two-year stint as assistant city manager, said he also understands the significance of keeping a chief for longer than a few years.

“You have to make the best decision you can and put the right leader in the position,” he said. “And you hope that they stay longterm. It’s funny, when you look at any at-will position there’s always an expectation that that person will be dedicated to being longterm, but on the flip side, there is no guarantee that they can stay long-term.”

clearly expressed during the panel’s regular meeting on Tuesday (June 2).

The council was presented with an informational report on park access by Dan Efseaff, Chico’s parks and natural resources manager, but was not expected to take action. Here’s the general picture: Due to 2013’s sweeping cuts to budget and staff, the city closed several of the park’s gates, blocking vehicular access and parking Monday through Thursday, and most have remained on that schedule ever since.

Efseaff explained that the closures were intended to be temporary and that he expected staff would be rehired “and we’d go back to normal,” he said. “Well, normal hasn’t returned in two years.”

At a council meeting in March, Mayor Mark Sorensen spoke of his irritation over the matter: “It drives me stark-raving nuts to ride my bike through One-Mile and see people fighting for street parking.” After that, the city opened the gate at the parking lot near Sycamore Pool at One-Mile Recreation Area seven days a week.

But a handful of gates remain open only on weekends—like the gate to the parking lot at Five-Mile Recreation Area. Councilman Andrew Coolidge said he’s heard plenty of complaints from homeowners living along Centennial Avenue.

“People come to us and [ask] these very simple things: ‘Hey, why can’t you just leave the gates open? There are 15 cars parked outside the gates all day long. What’s the big deal?’And I don’t have an answer for them.”

To open a particular area to vehicle traffic, Efseff said he’d prefer to have park rangers available to patrol regularly for safety reasons. But Sorensen interjected that “it’s already open, you’ve already got pedestrians and bike riders going through there, so that doesn’t sound like a good reason to keep it locked.”

Sorensen then suggested enlisting volunteers—even council members—to open the gates. Efseaff maintained it would be a logistical mess to coordinate volunteers to unlock each individual gate, but said he’d be all ears if a local organization were willing to open all of them.

That option may be appealing, given how strained the city’s resources have become.

house 25 restroom stalls, 10 porta-potties, three shower facilities, numerous lighting systems, 10 miles of roadways and bike paths, many more miles of trails, and Sycamore Pool. And that doesn’t account for maintenance of greenways outside of the park such as Lindo Channel, Little Chico Creek and Comanche Creek.

“We hope you can find room in your hearts and the budget to give us more permanent people for the park,” Henry said.

Later in the meeting, following those discus-

sions on the struggle to maintain the city’s existing green spaces, several members of the public spoke in favor of expanding them by adding 759-acre Bidwell Ranch—the city-owned grassy, wide-open space—to neighboring Bidwell Park.

The property was purchased by the city 18 years ago and has remained fenced off ever since. The city has long been studying the feasibility of turning the site, home to vernal pools and other environmentally sensitive habitat, into a mitigation and/or conservation bank. It’s open to the public for occasional docent-led tours and is otherwise used only for grazing cattle.

John Merz, the board president of Friends of Bidwell Park, said the environmental community—including the Altacal Audubon Society, the Yahi Group of the Sierra Club, Butte Environmental Council, and the Mount Lassen Chapter of the California Native Plant Society—unanimously supports of the formal addition of Bidwell Ranch to the park.

“Every one of those groups has taken that position in the last month,” he said. “We believe the conversation about mitigation can be ongoing. Whether it will ever see the light of day is unknown, but we do know that this is an incredibly valuable public resource.”

hen landscaper Thomas Foster visits clients these days, the first thing they talk about is drought-tolerant landscaping, including what to do in place of grass.

“It’s the drought that’s driving this return to something besides lawns,” said Foster, owner of Aqua-Terra Landscapes. “Returning to something that we should’ve been doing all along, which is sustainable landscapes.”

Foster said he expects more people to start asking how to conserve water, especially with the new restrictions from California Water Service Co. that began on Monday, June 1. These new rules, for both residential and commercial customers of Cal Water, come after the State Water Resources Control Board mandated a steep reduction of water use for the Chico district.

The policy was detailed at a May 27 question-and-answer session at Chico State’s Bell Memorial Union. There, Cal Water officials explained how customers would have a monthly budget that calls for a 32 percent reduction from their monthly water usage in 2013.

Those who exceed that budget will be charged a fee of $3.13 for every additional 100 cubic feet used. The measurement, marked as CCF (century cubic feet) on the water bill, is equivalent to 748 gallons.

A bright spot among talks about increased fees is that customers will be able to “bank” unused water from one month to the next, meaning they may exceed their usage by that amount of water without facing the extra charge.

The forum also cleared up a lot of confusion. For example, those who

were not Cal Water customers in 2013 were informed that their monthly budget will be based on the average monthly consumption by households in the district. Officials also noted that customers can file an appeal with Cal Water to have their allotments increased.

Cal Water also went over the implementation of restrictions on specific uses: Watering that causes runoff is prohibited, as is washing driveways and sidewalks, watering landscapes within 48 hours of significant rainfall and using nozzles that don’t shut off while washing vehicles.

And then there’s the restriction on lawns. Chicoans can water them only three days a week. But based on the method by which many water customers are currently irrigating landscaping, there’s a lot of room to meet the conservation restrictions.

“This is what we’ve needed to do for some time,” said Gary Wheeler, a branch manager at Ewing Irrigation in Chico. “People haven’t been taking water seriously. Now there’s a lot more awareness and people are more conscious of what’s going on and how they are using their water.”

Wheeler said many existing sprinkler systems were installed 20 to 30 years ago and include water-guzzling spray nozzles that often cause overwatering. Steps people can take to reduce lawn irrigation, he said, include using highefficiency nozzles, drip irrigation and smart controllers.

“We’ve got people’s attention because they’re going to get hit in the pocketbook,” Wheeler said.

“They’re really going to have an eye opener when July rolls around and

they see their bill for June and they have to pay that drought surcharge.”

Cal Water has a number of pro-

grams in place to help customers conserve, including free sprinkler nozzles and rebates on smart irrigation controllers and high-efficiency toilets and washers. A new program, announced alongside the water restrictions, is a turf replacement rebate that will provide a $1 refund per square foot of lawn removed and replaced with lowwater-use landscaping.

Because of the drought and water-use restrictions, AquaTerra’s Foster sees a shift from the common practice of covering property with grass to what is being called the “new California aesthetic.”

“People can’t imagine a property without some sort of lawn,” he said. “The idea with the new California aesthetic would be to break that paradigm and do things that are more sustainable and droughttolerant. And they’re quite beautiful; in fact they’re way more interesting than a lawn.”

The look, Foster said, does not have to sacrifice beauty. People can still have well-designed landscapes that include pathways, dry creeks, rock work, butterfly and bird gardens, vegetable gardens and garden art.

Foster said he believes the new water restrictions are necessary and people need to rethink how much water they pour onto their landscapes.

“We can’t all have these giant lawns anymore,” he said. “We just can’t afford it. We don’t have the water. It’s not there.”

ACCESS DENIED

Health care is difficult to attain for many residents of Butte County, including those with mental health challenges, a recently released report finds.

In the Butte County Community Health Assessment for 2015-17, compiled by multiagency partnership Together We Can: Healthy Living in Butte County, 28 percent of respondents who accessed health care outside of their home reported that they couldn’t find a provider for their health needs in their home city. Furthermore, about 9 percent said they couldn’t find doctors who accept Medi-Cal or Medicaid, while about 8 percent said their insurance covered only providers outside the area.

Of respondents who reported mental health needs, 29 percent said they couldn’t find the appropriate services in Butte County, while 17 percent said they could obtain only some of the services they need.

VACCINES, IMMIGRANTS AND RIGHT-TO-DIE

California lawmakers advanced several major health-related bills on May 28, including measures related to childhood vaccine requirements, granting health care coverage to more than 1 million undocumented immigrants, and physician-assisted suicide.

Senate Bill 277, which would end the personal belief exemption allowing parents to opt their children out of immunization and require that all schoolchildren in the state be fully vaccinated, now goes before the Assembly Committee on Health following approval by the Senate in May, according to The Sacramento Bee. If it clears the committee, SB 277 would still require approval by the full Assembly and Gov. Jerry Brown to become law. (Brown hasn’t taken a stance on the bill, though he has touted the benefits of vaccination.)

The Senate also revived Senate Bill 128, which would allow some terminally ill patients—those who have six or fewer months to live—to end their lives with lethal doses of medication. The bill is being fought by various religious and medical organizations, though the California Medical Association recently dropped its opposition. It now heads for a Senate vote.

“We are one step closer to ensuring Californians have access to all options when they are facing the end of life,” said Sen. Lois Wolk (D-Davis), who co-authored the bill.

Meanwhile, the measure that would offer state-subsidized health care coverage to undocumented immigrants, Senate Bill 4, passed the Senate Appropriations Committee, albeit in an altered state, according to the Los Angeles Times. Rather than extend Medi-Cal to all undocumented immigrants, the amended legislation would offer the same coverage but the number of people who could sign up would depend on the state State Sen. Lois Wolk budget and could vary by year.

Dogs and diagnosis Trainer brings cancer-detection dogs, future clinic to Chico story and photo by

So much so, it’s difficult us humans to grasp how feeble our dog’s nose is an incredibly sensitive

sniffers are in comparison.

For instance, dogs can detect odors in parts per trillion, according to Inside of a Dog, by Alexandra Horowitz, a dog-cognition researcher at Barnard College. That means a dog can detect a teaspoon of sugar in 1 million gallons of water, or two Olympic-size pools— while a human nose might not pick up a teaspoon of sugar in a cup of coffee.

That dogs have such pinpoint sense with their snouts has long fascinated Dina Zaphiris, a native of Chico who recently moved back to town with her husband, Todd LaBrie, after living in Los Angeles for the past 23 years. More specifically, her interest lies in how a dog’s nose can help humans in medical settings.

Zaphiris is the CEO and founder of InSitu Foundation, a nonprofit dedicated to training dogs to detect cancer in humans. The foundation is focused on catching cancer in its earliest stages, which is hit-and-miss even for researchers at the nation’s top universities. And as Zaphiris explained during a recent interview, detecting disease by scent isn’t so far-fetched.

“Diseases have smell; sick people smell bad,” she said. “We can smell cancer at latter stages. Stage 4? Oh, my goodness. And it smells different in someone who has undergone chemotherapy versus someone who has never had treatment.

“Today, doctors have cut out their sense of smell,” she continued. “They use three senses to examine a patient—they use vision to look at a patient or use an MRI and look at the scan; they use hearing to listen to your heart and lungs; and they use palpation, feeling for tumors and muscle quality.

“Dogs add a fourth sense to diagnosis, which we’ve kind of lost.”

InSitu Foundation is currently working with Duke University and UC Davis in studies using canine cancer-sniffers to find a blood-based biomarker for breast cancer and using saliva samples to detect upper respiratory cancer, respectively. The Duke

study is currently in progress, while the UC Davis study will begin after Zaphiris finds a family in Chico to raise a puppy that will be trained to sniff out cancer in a yet-to-be-established clinic.

UC Davis initially envisioned that clinic, now just a proposal, being established in Davis. But Zaphiris balked at living there when she was asked to become the center’s director.

“I don’t want to live in Davis,” she said. “I’m 46, I’ve worked really hard my whole life; I want to choose where I live.

Then they said we could have the center in Chico. When we got that news, my husband and I immediately started looking for a house, and we just moved here two weeks ago.

When a loved one or friend goes to the hospital, it can seem like everyone stops by to visit. Zaphiris graduated from Chico

High School in 1988, and then from UC Davis in 1992 with a bachelor of science in psychology.

She then moved to Los Angeles, though she didn’t have a specific career plan.

She did have an interest in dogs. She began a mentorship in dog training with Richard Vye, the only protégé of Rudd Weatherwax, trainer of the original Lassie. By chance, she became a dog trainer for Hollywood stars—first for directors Tony and Ridley Scott and then for big-name actors.

“Somehow, I got in with the right people from the beginning,” she said. “When you’re training dogs for Bruce Willis, next thing you know you’re at Nicolas Cage’s house. I was at the right place at the right time.”

With her career wellestablished, Zaphiris began training scent-detection dogs for finding drugs, bombs and missing people in 2000. That work eventually led Zaphiris into the medical field. In 2003, she was approached by a group of doctors at the Pine Street Foundation in San Anselmo who wanted to explore whether it was possible to train dogs to identify cancer, because they’d seen their own dogs do it.

“These poodles that went to work with them every day kept going up to people and smelling the sites of their tumors; it was uncanny,” she said. “The doctors couldn’t believe it.”

Zaphiris agreed to train dogs for a double-blind clinical study, and the results were stunning.

Using human breath samples, the dogs were able to detect lung cancer with 99 percent sensitivity—more accurately than a needle biopsy, she said. When the results were published in the Journal of Integrative Cancer Therapies in 2006, it was among the first studies on the subject.

Zaphiris was recruited again in 2012 for a federally funded study using breath samples to identify ovarian cancer; those results are still undergoing peer review, though she says “unofficially, we know the dogs did really well.” The next year, Zaphiris worked with Assistance Dogs of Hawaii, training 10 service dogs to detect urinary tract infections in the urine of disabled people, for which clinical trials are still underway.

That same year, Dr. Jeffrey Marks

of Duke University contacted Zaphiris in an attempt to solve a decades-old research problem— finding a blood-based biomarker for breast cancer.

“We still can’t find early-stage cancer worth a darn,” she said.

“If we can get the dogs to tell the difference in blood from cancer patients and noncancer patients, that shows that we should keep looking.”

All of the blood plasma samples in the study will be taken from women with breast tumors—some benign and some cancerous. Zaphiris is currently training dogs for the task.

When she deems them ready for research, Duke will provide plasma samples and the doubleblind clinical trial will begin.

Amid training dogs for the Duke study, Zaphiris was contacted by a team of surgeons and oncologists from UC Davis interested in her diagnostic method (she’s developed a 371-step process for training cancer-detection dogs). Last year, they flew out to Los Angeles to see her dogs at work.

“They were blown away, almost in tears,” she said. “Here you have doctors who’ve worked their whole lives to find cancer, and these dogs are just going ‘boom’ and identifying cancerous tumors.”

With the support of UC Davis’ Internal Review Board, the research team has engaged Zaphiris in a two-year study in which dogs will detect upper respiratory cancer in humans with spit samples. The work is intriguing because it might offer an inexpensive and noninvasive means of sample collection, from the patient’s perspective “It’s easy—you spit, a dog sniffs,” she said.

If all goes to plan, that screening service will be offered at the proposed clinic in Chico, which will train dogs to detect every form of cancer, refine protocols for trainers, offer certifications for trainers, and conduct further clinical studies. □

Well-known environmental activist brings his optimism about the movement to Chico

can turn even the most ardent optimist into a pessimist. Meanwhile, headlines continue to convey troubling news about the environment.

Sustainability-minded Chicoans have heard this topic addressed by visiting experts—notably Guy McPherson, described in a CN&R headline as “Bad-news bearer” for his stark views on Earth’s future, which he shared in November.

KZFR and the Butte Environmental Council hope to shine a ray of light into the dark picture with the appearance of Bill McKibben. An acclaimed author and environmental activist, McKibben will speak tomorrow night (June 5) at the Chico Masonic Family Center.

Stephen Tchudi, who co-hosts the KZFR radio program “Ecotopia” with wife Susan, has talked with both speakers. On McPherson, Tchudi quipped: “We were depressed for a week after finishing the interview.” On McKibben, he said: “I think Bill has probably a more balanced view on the science of climate change.

“McPherson has been accused of cherry-picking a little bit and working up the worst possible scenario,” Tchudi continued. “I think Bill still has high hopes that if enough people care about it—march, demonstrate—that we really can make a

change, reverse the trend.”

That ability to turn the tide is central to “Ecotopia” and other KZFR shows, as well as BEC and other local organizations that will greet attendees when doors open at 6 p.m. (McKibben speaks at 7:30.) Those dozen groups include the Sacramento River Preservation Trust and the CSU Student Sustainability Coalition.

“People really do say, ‘Look at the changes that have taken place,’” Tchudi relayed. “It may not be enough, but it’s clear that there’s a global movement of people concerned about solar, about nuclear, about everything from local foods to transportation and oil issues. There’s just a lot more awareness than there used to be.

“There’s still the question of whether it will be soon enough, quick enough. But I think he [McKibben] is among the hardworking optimists.”

He’s definitely well-traveled. Reached via email, McKibben wrote that the Chico talk is sandwiched by “a big religious environmental conference in Pomona” tonight (June 4) and “a huge rally opposing tar sands pipelines in Minneapolis” Saturday afternoon (June 6).

His presentation here will be distinct from the others—“less religious, less Midwestern”—but with the action orientation to which Tchudi alluded. McKibben will offer some specific solutions while motivating participants to seek their own paths.

“I want to bring people up to date on where we are in the fight against climate change, and hopefully inspire them to get involved—or, more likely, stay involved,” he said. “California’s drought provides, I fear, a backdrop.”

McKibben’s appearance began with KZFR

general manager Rick Anderson, who according to Tchudi “has had that on his agenda for a long time” and made a series of inquiries before he “got a bite” in November. The community radio station booked him, then formed a partnership with BEC to co-sponsor the event, which will serve as a fundraiser for both.

KZFR and BEC agreed to pay a $1,000 honorarium to 350.org, the international climate campaign co-founded by McKibben.

“He can command big speaker fees, but he’s not being enriched in any way by this,” Tchudi said.

So, why did he accept the Chico invitation?

McKibben answered with three reasons: 1) “I am a huge public radio fan, and have been writing about it forever—it’s kind of a sideline of mine.” (He co-created Transom, a site dedicated to developing new public radio.)

2) “I also write about beer for fun—I was in Chico probably 30 years ago doing one of the very first big pieces about microbreweries, and I visited a little place called Sierra Nevada in an industrial park on the edge of town. I hear it’s gotten a little bigger.”

3) “Chico State divested from fossil fuels, and I wanted to say thank you.”

The organizers are thrilled to have him, and while they would like to raise funds, they’re more concerned about raising awareness.

“Rick Anderson decided from the get-go that we would price our tickets low [$15] to get as many people to come as possible,” Tchudi said. “It’s not a big money-making event for us, either.

“He’s really the biggest name in the environmental movement. He’s got just great skill in getting out the word…. He’s just out there; everybody knows his work.

And he’s not only been successful with his own writing, but also organizing international demonstrations and protest days.”

An environmentalist affiliated with Middlebury College in Vermont, McKibben has authored a dozen books and myriad articles; his best-known work is The End of Nature, his 1989 book that has been translated into 24 languages. Honors include the Right Livelihood Prize (aka “the alternative Nobel”), the Gandhi Prize and the Thomas Merton Prize.

Asked what he wants people to take away from his talk, McKibben simply said: “An understanding that if they’re in this fight they have lots of brothers and sisters around the world.” □

Kate Bailess is her own woman and artist. While growing up in Salt Lake City, she never quite fit in with the conservative majority there, she says, and her experience as an outsider helped her focus on making art. Since moving to Chico three years ago, Bailess, 26, launched a screen-printing business, Love Life Be Free Art, using hand-built equipment. When she’s not studying psychology at Butte College, she custom designs colorful geometric patterns for shoes, reusable grocery bags, skateboards, or really whatever is requested. She recently copyrighted the image on her best-selling T-shirt, a stencil-style graphic of a bicycle with the words, “Drinking town with a biking problem,” which she created in reaction to the deaths of two local bicyclists in 2013. This month her work is featured in the window at Ellis Art & Engineering Supplies (122 Broadway). For years I’ve heard word of a fabulous butcher shop in Oroville called the Wagon Wheel. The first time I learned about the store, a friend was talking about his hunting trip and bringing the carcass—it was a deer, I think—to the Wagon Wheel for butchering and packaging. What a cool service, I thought. (I later learned about Chico Locker & Sausage, which also will process wild game.)

What I had yet to do, however, was step foot in the Wagon Wheel. And, while doing a little online research on the place, I learned that they’re opening up a second location—in Bloomington, Ind.—later this summer.

Now was the time to go.

So I headed down the Olive Highway, well past Gold Country Casino, and paid a visit to Tom and Pat Butler, brothers and owners of the venerable butcher shop, which also features an impressive deli counter and market.

“We want to see if our business model could be successfully packaged for—potentially in the future—franchising,” explained Tom before having to sign off to help a customer.

“We’re small and homey,” continued Pat, who’d just finished grinding beef. “We’re an old-fashioned meat market and deli. We think the country is trending back to liking that feel, that hometown feel.”

I have to agree with Pat that there is something nice about not only knowing my butcher but knowing that he’s picking out the best cuts of meat—that he’s more invested in the quality of his product than making a quick buck. He acknowledged that as well and lamented the fact that some people don’t understand why Wagon Wheel meat is more expensive than Walmart’s.

“You get what you pay for,” Pat said. “In a perfect world, that’s the case, anyway.”

The Butlers, who bought the Wagon Wheel from their parents in 2012, found some willing partners in Indiana and have been working toward duplicating their business there. There will be no wild game processing, Pat said, but there will be a full butcher shop, deli, market and sausage kitchen.

“The sausage kitchen is a huge part of our business,” he said. The family has worked for 35 years to develop specialty flavors for its smoked and raw sausages, which are a huge hit. They also do very well with marinated meats—mostly chicken and tri-tip.

Setting up the second location has been a learning experience for the Butlers as well. It’s helped them to streamline their own business, Pat said, by forcing them to take a closer look at how everything works. At the end of the day, he said, the Oroville location has improved during the process and he’s confident that their Indiana partners will represent them well.

When did you start making art?

When I was a little kid I started scribbling. I’ve always done lettering; that’s what I was drawn to do.

I took a calligraphy class and then got really into graffiti-type stuff. It never looked cool, I guess, but now I’ve practiced a lot more, focused more, looked at a lot of examples.

Calligraphy helped because it’s a flowing style. Not a lot of people even know how to write in cursive anymore. So, that’s pretty

rad—calligraphy is something I’ve got that not a lot of people do, and there’s a new term called calligraffiti.

Is that what you practice?

Not really. Most of my stuff is super colorful. Calligraphy is more black and white, to me. When I’m not thinking about it, I just draw something colorful, like this [holds up skateboard deck].

How did growing up in Utah shape your development as an artist?

I definitely was mistreated, in a way, because I wasn’t Mormon and was looked at differently. I was uninvited to birthday parties when I was a kid, so I had to be more independent and create my own world. You have to do you.

Have you ever gotten in trouble for making graffiti?

I’ve never vandalized; I’d rather put it on canvas or a skateboard. I don’t deface somebody else’s property. That’s not my thing. I’d rather get paid to do it and be known for it, because I’m trying to uplift that

generation of art.

What sets you apart from other screen printers?

I am 100 percent homemade, so my process is a little different from somebody who bought a printing machine for $8,000. I’m drawing my designs, turning them into a graphic on the computer and making a shirt out of a machine I built. It’s more genuine, I guess, and there’s more room for error, but people don’t know that unless they see what I’ve done with my studio.

Is that the impetus for your future open houses?

I had a friend in Utah who would do screen-printing parties every other month, and he would have an underwear night, a T-shirt night, or whatever. He would have a bunch of prints made before[hand] and would be screen-printing while the party was going on, so people could interact and talk to him, see how the process works. I want to do that.

How the beverage industry spends millions to crush laws warning consumers about the dangers of sugar

T

he metal tab pulls back with a familiar click-click-hissssss as bubbles rush to the top of the can. The alluring scent of faux orange or grape or berries wafts through the air, a familiar smell that hints at what’s to come.

What’s to come tastes good. It’s a reminder of summer, or of a childhood treat, of a sporting event or a beach day with friends. It’s OK to indulge yourself, the advertising says. You’ve earned it.

If you’re drinking a 20-ounce Mountain Dew, you’re earning the equivalent of 18 teaspoons of sugar.

A same-sized Pepsi equals 16 teaspoons and a Coke comes out to 15. A 16-ounce Rockstar Energy Drink slams more than 15 teaspoons of its own.

Here’s the problem with what you’re drinking, some scientists say: Humans are not biologically designed to deal with that much liquid sugar at once. Since there’s no digestion involved, it enters the bloodstream and is absorbed more quickly than food.

As it does, the sugar overwhelms the pancreas, the organ tasked with regulating blood sugar, and over time wears it out. Welcome to Type 2 diabetes. That much sugar hits the liver like a freight train—the liver doesn’t know what to do with it all, other than convert it into fat, leading to higher rates of fatty liver disease. That’s a condition that used to be seen mostly in alcoholics.

Davis-based doctor of public health Harold Goldstein offers up the statistics on the amount of sugar in the most popular drinks off the top of his head—and then he sends a chart. Goldstein is the founding executive director of the California Center for Public Health Advocacy in Davis and whose mission is to look for solutions to what scientists say is an alarming increase in diabetes and obesity in California.

About five years ago, the CCPHA commissioned a study by the UC Berkeley Center for Weight and Health to see if there was a correlation between obesity and sugary beverage consumption.

The study found that between 1977 and 2001,

Americans on average were consuming 278 more calories a day than before, with 43 percent of those calories defined as new beverage calories.

“I had no idea what the answer was going to be, but what they came up with was simple and compelling,” Goldstein said. “I was stunned. It was twice as much as I guessed.”

We weren’t just eating more. We were drinking more.

And mostly, we were drinking more sugar, a phenomenon that coincided with the “soda wars” of the ’70s and ’80s, where Coca-Cola and Pepsi went head-to-head on television advertising campaigns to win the hearts, tastebuds and dollars of consumers. It also coincided with an increase in portion sizes: In the ’70s and ’80s, a 12-ounce can was the norm. Now fastfood restaurants offer 32-ounce cups with free refills, and thirsty consumers can find sugar-sweetened drinks everywhere, from corner markets to vending machines in airport parking garages.

Another surprising statistic, this from the National Institutes of Health via Goldstein: A quarter of teenagers, or 23 percent, have prediabetes, an increase from 9 percent just 10 years ago.

“These beverages are tricking the body,” Goldstein said. “The pancreas goes wild and the liver says, ‘Look at all this. I better save it for a rainy day and turn it into fat.’

There is a cohort of teens that will be entering the health care system with higher rates of diabetes than ever.”

The grim statistics are why state Sen. Bill Monning

(D-Carmel), backed by CCPHA and the Sacramentobased Health Officers Association of California, has been at battle with the beverage industry. Earlier this year, Monning introduced Senate Bill 203, which would have required a warning label to be placed on the packaging of sugar-sweetened beverages including sodas, sweet teas, sports drinks and energy drinks.

The label would have been required on drinks with 75 or more calories per 12 ounces and would read as follows: “STATE OF CALIFORNIA SAFETY WARNING—Drinking beverages with added sugar(s) contributes to obesity, diabetes and tooth decay.” State Sen. Richard Pan (D-Sacramento), a pediatrician, supported the bill and is also listed as a co-author.

Monning introduced a similar bill last year, but it didn’t make it to the governor’s desk. And, once again, just a few weeks ago, this year’s bill died, this time in the Senate Health Committee, an outcome showing that the beverage industry is willing not only to put a lot of muscle and money behind the effort to stop Monning, but also to try to stop information they deem harmful to their industry from reaching the public in the first place.

The ‘S’ word

But the soda industry has bigger problems besides one California legislator: More and more studies are being released every year on sugarsweetened beverages, and how they’re not so good for you.

For instance, a Monterey County Health Department study, which was delayed for more than two years because someone higher up the food chain brought down pressure, finally was released this past March. Which adds even more fizz to the pop drama.

The report was based on research conducted between 2011-2012 by a tri-county organization—San Benito, Santa Cruz and Monterey counties—called the Nutrition & Fitness Collaborative of the Central Coast, as part of the nationwide initiative called “Rethink Your Drink.” The aim is straightforward: getting people to reduce their consumption of sugary drinks.

Christine Moss is a staffer to the collaborative and knows what she’s talking about. She also knows about pressure from the American Beverage Association, a representative of whom called her while the collaborative was gathering its data.

“He wanted to make sure we weren’t doing anything silly like pushing for a soda tax,” she said.

“I explained to him we couldn’t work on something like that, because our funders wouldn’t allow it.”

Epidemiologists began the survey in 2011, seeking to track the sugary-beverage-consumption habits of 250 people in each of the three counties. They found participants at health clinics and in laundromats waiting for their clothes to dry. In the end, they collected 1,053 surveys and completed the work by late 2012.

“Any place we could get a group together, we did a survey,” Moss said. “That way we could get a nice representative group of people. That was important to us.” The aim was to release the survey a few months into 2013.

Yes, that means it is a full two years late. What happened?

Americans now drink an average of 44 gallons of soda a year, a 17 percent drop from the peak in 1998, he says. But the percentage of adolescents drinking sports, energy or sweetened fruit drinks is on the rise, from 31 percent in 2009 to 38 percent in 2012.

What’s in a label?

The ultimate question might be, “Will a warning label work?” The fact that the industry fought so hard against it indicates it might.

His center’s polling research shows that 74 percent of California voters support labeling, and that includes 63 percent of Republican voters, 86 percent of Latino voters and 80 percent of African-American voters.

“In some ways, labeling is the most Libertarian of all public policies,” Goldstein said. “It says consumers have the right to know and should be able to decide for themselves on the truth. The beverage industry wants to continue hiding behind a marketing message.”

A different kind of persistence, Moss thinks, proves the very power of a warning label.

“The statistic I hear about getting people’s attention is that you need to hear a message 11 to 13 times before it sinks in,” she said. “If you have to look at it every time, maybe that’s the loading dose. Maybe it will lead to the question, ‘Is this the best Ω choice I can make?’”

The PAC donated $4,100 to Alejo for Assembly, and the same to the Senate campaign of Ben Hueso, the San Diego Democrat who is vice chair of the Latino Legislative Caucus.

It put $27,200 into Gov. Jerry Brown’s campaign and $3,000 into Attorney General Kamala Harris’ too. It gave $46,000 to the Democratic State Central Committee of California and $10,000 to the California Republican Party. (For more information, see box at left.)

Fast forward to this year. The PAC started 2015 with $504,000 in the bank.

The spokesman for the Latino Legislative Caucus PAC and foundation, local political strategist Roger Salazar, is now the spokesman for CalBev, also known as the California-Nevada Beverage Association, the trade association representing the nonalcoholic beverage industry in California and Nevada.

The Cal-Nev Soft Drink Association PAC spent $37,371 on various campaigns in 2014, mostly as $1,000 contributions to individual legislators.

In the hours and days that followed Monning’s announcement of his latest labeling bill, SB 203, CalBev went on the offensive.

In a written statement, CalBev Executive Director Bob Achermann says obesity and diabetes are more complicated than a warning label. Monning’s bill is “misguided,” singles out soft drinks while ignoring sugar-rich cupcakes, donuts and processed foods, and is riddled with loopholes that will confuse consumers, according to the statement.

For example, the release says, fountain sodas purchased at restaurants with table service will be exempt from labeling. The release also calls out milk-based products like Frappuccinos and lattes, which contain as much sugar and more calories than soft drinks.

Salazar says the industry has taken on an initiative to reduce sugar-sweetened beverage consumption 20 percent by 2025.

“There are ways you can have a collaborative effort, but bills like this seek to demonize an industry with a shocking label when there are other, broader causes to obesity and diabetes we should be looking at,” Salazar said. “It’s about balancing calories, and there’s no question we support

She says she would send in surveys and the Department of Public Health would send them back asking for very precise changes. “I wasn’t quite sure of the intent, but the approvals each step took a lot of time. It pushed back our timeline a long way,” she said.

Examples of that pushback: Moss says she was not allowed to use imagery people might think of as a specific soda can—no red backgrounds with silver swirls, or blue backgrounds with red and white imagery.

And she was actually discouraged from using the word “soda” in the report (it may have slipped in, she says, in at least one instance, but the report mostly references sugar-sweetened beverages).

“I expect it’s a trigger word for certain special interests,” Moss said, “but we found it’s much broader than soda.”

Moss says the research revealed what she calls “two big shockers.” First, as soda sales have started to plateau, companies have ramped up their advertising for energy and sports drinks, specifically targeting 11- to 17-year-olds.

“The numbers will knock your socks off. For every second-grade teacher wondering why kids are so hopped up, caffeinated drinks are big,” Moss said.

The other big shocker: Nobody’s drinking much water.

Devastation Sounds serves as a prime example.

Host Sanjay Dev has been part of KZFR for 23 of the station’s 25 years, ever since a friend suggested that Dev—a math professor at Chico State and Butte College—put his enormous collection of rare reggae vinyl to use by hosting a show. Although reluctant at first, Dev soon found that he had something of an affinity for radio.

“I feel so proud to be there every Friday,” said Dev over coffee before a recent installment of Devastation Sounds. “I feel like I give my heart and soul 22

to the radio station and to the radio show. I’m a teacher already, so I feel like here’s another way to educate people. And getting that reciprocal support from listeners makes me want to be there even more and more.”

Community support has been the driving force behind KZFR from day one, said Anderson, a 35-year radio industry veteran who worked at San Francisco’s KFOG before taking what he calls “the best job I’ve ever had” at KZFR six years ago. In the early days, when the station was only able to maintain a spotty broadcast schedule, things were sometimes dicey: funds raised through yard sales with kegs of beer donated by Sierra Nevada Brewing Co. would keep the station on air for another month.

These days, however, both the station and its fundraising efforts have become more sophisticated.

The station broadcasts 24 hours a day, seven days a week from its studios in downtown Chico over a recently beefed-up transmission chain, while also offering both streaming and archived programming on its website and mobile app. These improvements have been made possible in large part by pledges of individual listeners. The station’s recently completed spring pledge drive raised more than $57,000, breaking the previous record. And the KZFR live-event fundraising calendar—mostly concerts at Chico Women’s Club featuring an impressive roster of both local and visiting dance-friendly bands (everyone from GravyBrain to Dengue Fever)—has increased dramatically as well.

“Over the last 25 years KZFR has changed but remained the same,” said Anderson. “Location, equipment, transmitters, offices have all changed and been improved but the commitment from volunteers and supporters has never changed. They remain constant and are the backbone of our radio station.”

KZFR is hosting its 25th Anniversary Concert on June 13 at The End of Normal “to celebrate our past and look forward to the future,” said Anderson.

Count Dev—who recently celebrated his own 25th anniversary as a math teacher—among those who plan on making KZFR a part of their future for many years to come. “I have a slogan: math is my passion, and music is my salvation,” says Dev. “I tell my students I want to teach for another 25 years, because I’m so passionate about it. And I want to be there for the 50th anniversary of KZFR.” Ω

Chico beer bars: Burgers and Brew, The Handle Bar and, of course, the Goose. Since opening in 2013 at the corner of Eighth Street and Broadway (in the building that housed the one-time Chico Brewery, which is pictured on the label of Sierra Nevada’s Old Chico Crystal Wheat), the Winchester Goose has offered Chicoans the opportunity to explore the mind-boggling variety of flavor profiles that brewers, real craftspeople, are producing across the country.

And they do it right. The Goose orders beer mostly in five-gallon cylinders, allowing them to rotate their 22 tap handles regularly, often throughout the day. The chalkboard hanging over the bar lends a sense of excitement, as the very knowledgeable and somewhat old-timey-looking barkeeps (who all share a, shall we say, vintage fashion taste and affinity for facial hair) will erase what’s tapped out and post what’s come on. ★★★★★ I’m no beer geek and have EPIC neither the ability nor desire to ★★★★ grow unique facial hair, but that AUTHORITATIVE doesn’t matter. I love the Goose ★★★ for its expertise, its commitment APPEALING to the craft and that it brings new ★★ tastes to Chico. I can count on HAS MOMENTS looking up at the chalkboard and ★ seeing beers and breweries I don’t FLAWED recognize, and that draws me in

on a regular basis.

I guess I’d be called a hop-head. My preferred beer styles are bitter, smack-me-in-the-face hop explosions—IPAs usually—that taste like liquid pine cones. So, on my most recent visit, I decided to punish my palate by trying the Denogginizer from San Leandro’s Drake’s Brewing Company ($6 for a 13 ounce glass), an imperial IPA perhaps so titled because of the rather stiff alcohol content, 9.75 percent ABV. It was dank, pungent and so overloaded with hops it was borderline offensive. I was pleased.

Next, I ordered the HiFi+LoFi Mixtape ($5 for 9 ounces) from San Diego’s Stone Brewing Co., which was added to the board as my friends and I drank our first round. Upon later investtigation, I learned that the concoction is a stock ale barrelaged for more than three months and mixed with a fresh version of the same beer to “create a perfect harmony spanning end to end on the taste spectrum,” according to Stone’s website.

At the time, I was able to tell my friends only that it was damn tasty. So I passed it around, and they did the same with their selections, which included the Panty Peeler ($7 for 9 ounces), a Belgian-style tripel from Midnight Sun Brewing co. in Anchorage, Alaska, that proved a bit funky for my preferences (though my cohort was in Belgian-yeast heaven); Ninkasi Brewing Company’s deliciously herbal and complex Dawn of the Red India red ale ($6 for 16 ounces); and Ballast Point Brewing Company’s Sea Monster imperial stout ($5 for 9 ounces), a beer that demands you either have chest hair or procure some immediately.

Throughout this sampling, we also munched on a couple of cheese and cured-meat planks—the Stiletto ($13) and the Slow Aged ($15)—a salty/fatty pairing that works with most styles of beers. I’ll have to save a food review for another day, but I will say that the Goose offers a full menu of tapas, vinaigrettes (salads), hot presses (sandwiches), planks (platters) and sweets. It also features rich and deliciouslooking daily specials, including Winchester Goose Steamers (steam-cooked burgers) and, on Tuesdays, the popular Harvest Mac and Cheese.

It all adds up to an atmosphere distinctly outside what’s offered by the college-oriented bar scene. It’s a place to spend a little more to enjoy something new. A place without TVs on every wall or pitcher specials. A place with character. □

Folksinger John McCutcheon pays tribute to activist-songwriter Joe Hill

Big Room regular John McCutcheon returns with songs and stories from his new album, Joe Hill’s Last Will.

Unfortunately, the only people who quote Joe Hill nowadays are folksingers and fans who’ve worked their way through Pete Seeger, Woody Guthrie and others back to Hill (whose best-known songs include “The Preacher and the Slave” and “There is Power in a Union”). McCutcheon, a Sierra Nevada Big Room regular and prolific musician himself who’s released more than three-dozen albums since the 1970s and who’s been praised by the likes of Johnny Cash

and Seeger himself, is doing his part to change that.

McCutcheon recently released an album of work written or inspired by Hill called Joe Hill’s Last Will, and he will be performing the songs and a one-man play of the same name during a national tour that will bring him to the Big Room on Monday, June 8. “[The album and the play] started with the awareness that 2015 is 100 years after Joe Hill’s death, and most people don’t know who he is,” McCutcheon said. “He’s the fella who pioneered writing songs about contemporary issues, which is interesting because it made a lot of his work obsolete almost immediately after he wrote and performed it.”

McCutcheon explained that, despite the ephemeral nature of some of Hill’s topics, the themes of much of Hill’s work—like people struggling to make ends meet while the rich get richer—are timeless.

He also related how Hill’s sense of humor was what hooked him nearly five decades ago.

“When I started playing in the 1960s, we had Vietnam, the civil rights movement, all these things going on that were so deadly serious,” he said.

“Then I listened to 50-year-old Joe Hill songs and the things he was singing about were also deadly serious, but he went at them with a sense of humor, that really appealed to people.”

On the album, McCutcheon concreted his bond with his predecessor with the titular song, featuring lyrics penned by Hill during his final days set to music of McCutcheon’s making. The lyrics show Hill as not just a wisecracking radical, but also a true poet: “My body? Ah, if I could choose/I would to ashes it reduce/And let the merry breezes blow/ My dust to where some fading flowers grow/Perhaps some fading flowers then/Would come to life and bloom again/This is my last and final will/Good luck to you.” □

Fluidity & Live at Nighttown John Fedchock & Jiggs Whigham Trombonists John Fedchock and Jiggs Whigham have careers going back decades. Fedchock got his start in 1980 in the Woody Herman Orchestra and for the last two decades has led his own 16-piece New York Big Band.

Whigham’s career began in 1961 when, at the age of 17, he joined the Glenn Miller/Ray McKinley Orchestra then left after two years to join Stan Kenton’s band. He’s currently the leader of Britain’s BBC Big Band.

Fedchock’s quartet consists of pianist John Toomey (a real delight), bassist Jimmy Masters and drummer Dave Ratajczak, and on Fluidity they work out on several standards—e.g., a rather agitated “East of the Sun,” a too mournful “Make Someone Happy”—plus two originals, one of them his lilting “Havana.” A rousing version of Joe Henderson’s “Homestretch” closes this live club recording. Whigham’s Live at Nighttown—subtitled “Not So Standards”—is a real challenge. Accompanied by the German pianist Florian Weber and the Romanian electric (ugh) bassist Decebal Badila, “Days of Wine and Roses” features Whigham’s stop-and-start solo style. That and his occasional braying require some listener adjustment. Weber is in top form throughout—his lovely intro to “Autumn Leaves” is just one example.

Jim Henson’s The Storyteller: Witches Multiple authors & artists Archaia In the spirit of Jim Henson’s late–1980s television series The Storyteller, this collection of the recent four-issue comic series brings together writers and artists telling tales of witches from around the world.

Matthew Dow Smith’s “The Phantom Isle” is the most literal inspiration from the TV series (which used actors and Henson’s special brand of puppetry to tell European folk tales). The show’s narrators, The Storyteller (the wonderful John Hurt) and his dog, have a strong presence in the story.

It satisfies the nostalgia craving—as does artist Jeff Stokely’s adaptation of an unproduced The Storyteller teleplay (included as bonus material) about the dreaded Baba Yaga. “The Magic Swan Goose & the Lord of the Forest,” by S.M. Vidaurri, honors Henson’s respect for a storyteller’s signature skills with beautiful visuals that drive the narrative. Kyla Vanderklugt’s “The Snow Witch” falls just short of building a connection with the characters, though the panels’ backgrounds and landscapes are exceptional. One panel, of a sick man sleeping against the backdrop of his snow-covered village, deserves a frame and a spot on your wall. Altogether, a good collection worthy of a master storyteller and a roaring fire.

Frank Black and the Catholics Cooking Vinyl As the Kim Deal-less Pixies grind on (for better or for worse)—releasing new songs and touring as the legacy act they never wanted to be—it’s easy to forget about that other chapter in guitarist-vocalist Black Francis/Frank Black’s life.

After a couple of excellent post-Pixies solo albums, Black formed the Catholics in 1997, and the band released six albums before calling it a day when the Pixies reformed in 2003. The just-released The Complete Recordings is just that, featuring every Frank Black and the Catholics album in addition to B-sides and previously unreleased demos. As he’s done on previous releases and even with set lists, Black brashly arranged every song in the collection alphabetically. As he said to me in a recent interview, “It’s kind of a way to show loyalty to the material. It’s like, ‘You know what? It’s all good.

It’s all valid.’” And while the material varies in quality, there’s no denying how consistent the man has been. Songs like “Billy Radcliffe” (from 1997’s excellent Pistolero) sidles up seamlessly next to “Black Letter Day” (Black Letter Days, 2002), and every song in the collection shows Black relenting to his appreciation for classic rock while still maintaining his punk-rock bark. It’s quality stuff … just ask Frank Black.

Movie disaster The Rock flies, skyscrapers fall and dialogue sinks f you love Dwayne “The Rock” Johnson and you think Igoing California sucks balls from top to bottom, you are to love San Andreas.

In this movie, you not only get two hours of The Rock’s admittedly winning smile, you also get to see Los Angeles and San Francisco smacked down with a fury matched only by The by Bob Grimm Rock in the ring during his fakewrestling heyday. Seriously, if you hate bobg@ newsreview.com the San Francisco Giants, the Hollywood sign and that white triangle skyscraper thingy in “The City,” this will be total action-movie porn for you.

There’s plenty of other glorious visual mayhem in the film as well, including tsunamis and Johnson’s totally out of control upper-body art. But, sadly, it also contains something nearly as devastating as an earthquake on the San Andreas San Andreas Fault—dialogue so vapid, so shitty, it Starring Dwayne crushes the viewer and the film alike.

and just happens to have a world-renowned scientist (Paul Giamatti) standing next to it when it goes. He heads back to his lab, where he sets out to warn the world of impending, bigger quakes via the worst dialogue of Giamatti’s career, and this guy was in Lady in the Water.

Turns out, the next ones are the really big ones, with catastrophic quakes starting in Los Angeles and leading up to San Francisco. Johnson commandeers a helicopter and sets out to rescue the wife in L.A. and then his daughter in the Bay Area because, you know, millions of people are dying, but he just has this little inkling that he can still put his family back together.

Now, I don’t go to a movie like this expecting dialogue compatible with the latest Paul Thomas Anderson movie. I know films like this are meant to kill a few brain cells, and I’m willing to sacrifice them to see The Rock race a boat straight up a tsunami’s ass.

But when the dialogue becomes so bad that it makes dialogue from a Michael Bay film sound like the latest Paul Thomas Anderson movie, I cry uncle. Or, I just cry in general.

As disaster movies go, San Andreas certainly provides plenty of impressive visual carnage. The special effects are good enough to keep you fighting through, even when the film devolves into the worst of soap operas.

Personally, I was on the fence until the final scene, where the survivors are rather happy and smiley for people who have just witnessed the death of millions. But I suppose I could’ve forgiven a moment of insensitivity in exchange for the several admittedly awesome action-packed moments. But then there’s the ending’s pandering and highly implausible patriotic gesture, and The Rock’s final lame line, which brings the Jenga tower crashing down in one final aftershock. Ω

Slow West

In this stylishly sardonic western, a young Scottish greenhorn (Kodi SmitMcPhee) plunges into the American West circa 1870 in search of Rose Ross, the love of his life. He teams up with a lone gunman (Michael Fassbender) but does not learn until much later that his newfound protector is a bounty hunter hoping to collect rewards on Rose and her father. A sad, sudden death awaits many of the film’s characters, but the trail of doom in this brusquely ironic Wild West adventure is lined with offbeat characters and episodes that are both casual and startling: a desperate settler trying to rob a trading post; a genial anthropologist musing on Christianity’s destructive effects on Native Americans; three stranded Congolese musicians speaking French with the greenhorn; the bounty hunter facing challenges from a swaggering rival (Ben Mendelsohn); a final showdown that is by turns epic, tragic, lyrical, absurd.

Writer-director John Maclean’s feature film debut—which picked up the World Grand Jury Prize for drama at Sundance—is quick (84 minutes) and quick-witted. The film’s spectacular versions of Western landscapes were filmed on location in New Zealand.

Director Paul Feig (Bridesmaids, The Heat) is teamed up with Melissa McCarthy again, this time to for a spy-film spoof about a CIA analyst (McCarthy) who volunteers to go into the field on an undercover mission to save the world from a dangerous arms dealer. Avengers: Age of Ultron

Age of Ultron is just flat. We get a bunch of scenes teasing future Marvel movies and, with the exception of an interesting smackdown between Iron Man and the Hulk, the cluttered action sequences feel repetitive. The Ultron of the movie’s title is a series of robots inhabited by an artificial-intelligence program initiated by Tony Stark/Iron Man (Robert Downey Jr.).

Stark, thinking he can create a security force that can protect the world and achieve “peace in our time,” gets a little ahead of himself and starts the program, only to discover that A.I. can sometimes mean Absolute Insanity. The program goes AWOL and produces the anti-human Ultron.

Voiced by James Spader, Ultron is a onenote villain out to destroy humanity who

lacks the personality of other recent comicbook villains—e.g., Tom Hiddleston’s Loki from the first Avengers. Perhaps director Joss Whedon was the wrong man for the gig.

The sequel begs for a darker tonal shift, a sort of The Empire Strikes Back for the Avengers series. Instead, the film is one of the year’s cinematic letdowns. Cinemark 14.

Far From the Madding Crowd

Director Thomas Vinterberg’s adaptation of Thomas Hardy’s novel succeeds richly as social drama and period piece. The setting is 19th century England, with commoners and gentry intermingling in the rugged rural landscapes that meant so much to Hardy. Vinterberg and company make all that a living part of the human dramas that unfold, and the episodes of spectacular dramatic action—a barnyard fire, a catastrophic panic among a herd of sheep, recurring bits of pursuit on horseback, an emergency in a thunderstorm—are rendered forth with brisk, evocative intensity.

The heart of the matter, however, is the strange, convoluted romantic drama that plays out among the main characters—the fiercely independent heiress Bathsheba Everdene (Carey Mulligan) and her three suitors (a shepherd, a landowner and a young cavalry officer). The basic power of Hardy’s story comes through rather well, despite some unevenness in performances and casting. Cinemark 14. Rated PG-13 —J.C.S.

Mad Max: Fury Road

Tom Hardy is a perfectly good choice to play George Miller’s heroically desperate antihero Mad Max, but the real star of this fourth installment of the franchise is the desperate and gallant Furiosa (Charlize Theron), who is trying to rescue the pregnant, bikini-clad trophy wives of the grotesquely masked archvillain Immortan Joe (Hugh Keays-Byrne). And Furiosa and at least a couple of the brides are fully capable of defending themselves, as are the wizened lady bikers who turn up late in the action.

The film’s macho feminism is dramatized via the brief, fugitive partnership of Furiosa and Max. As such, it stands as the latest of the thematic crosscurrents that mark the continuing evolution of the series’ testosterone-fueled fantasies. Max plays a key role in the lady warriors’ survival, but he must walk away from the community he has helped preserve. That said, Fury Road is every bit as brutal and rambunctious as its predecessors. While it uses more CGI than some early reviews might lead you to believe, it has fierce, muscular intensity to its stunt-heavy action sequences, and a strikingly visceral sense of human flesh in its portraiture. Something new … Something Blue The Blue Room Theatre just announced its 2015-16 schedule, and Arts DEVO has to say that he is eagerly anticipating the new season. It’s an impressive mix of contemporary selections, and it’s noteworthy that directors already have been attached to each production, especially given the fact that many of them were members of the now-defunct Rogue Theatre (the roaming rebel crew that broke away from the Blue Room in 2007 when then-Artistic Director Joe Hilsee was let go). it’s rush hour in Tokyo, unwieldy crowds of commuters board the trains and subways. They often need help at squeezing in. Railway workers known as oshiya, or pushers, provide the necessary force.

Wearing crisp uniforms, white gloves and neat hats, they cram the last stragglers into each car. I foresee the possibility of you being called on to perform a metaphorical version of the service these pushers provide. Is there a polite and respectful way for you to be indelicate in a worthy cause? Could you bring lighthearted tact to bear as you seek an outcome that encourages everyone to compromise?

GEMINI (May 21-June 20): Nobel

Prize-winning physicists Wolfgang Pauli and Niels Bohr were both amused at how counterintuitive their innovative theories seemed. Once Pauli was lecturing a group of eminent scientists about a radical new hypothesis. Bohr got out of his seat in the audience and walked up to the front to interrupt his colleague. “We all agree that your theory is crazy,” Bohr told Pauli.

“The question that divides us is whether it is crazy enough to have a chance of being correct. My own feeling is that it is not crazy enough.” Pauli defended himself.

was a popular video game that young people played in video arcades during the 1980s. Fifteen-year-old Steve Juraszek was profiled in Time magazine after he racked up a record-breaking 16 million points while playing the game for 16 hours straight. But when his high school principal found out that Juraszek had skipped classes to be at the arcade, he was suspended. I’m wondering if there may soon be a similar development in your own life, Virgo. meet are sometimes taken aback by the probing questions I ask them. Recently an acquaintance said to me, “Why don’t you feel driven to talk about yourself all the time, like everyone else?” I told him the truth: “Being curious is just the way I was made. Maybe it’s because of my Mercury in Gemini, or my seventh-house sun or my three planets in Libra.” I suspect that you are due to go through a phase similar to the mode I’m so familiar with. If it doesn’t happen naturally, I suggest you coax it out. You need to be extra inquisitive. You’ll benefit from digging as deeply as you dare. I spotted a guy driving a pickup truck weaving through traffic, sticking his head out the window, looking up.

The pickup truck looked like it had been splattered randomly with buckets of black tar and dented by hammers and other blunt objects, which it had, because it was a roofing truck. The guy driving was John James Miskella, and he was looking up because he was looking at roofs. Half of the roofs around town had been installed by John James or his father before him, and he kept his eye on them like a dad watching over his kids.

I had called John James on behalf of my first-time buyers, Dion and Alma Sarafino, to provide a roof report for the house they were buying.

“A report?” he said on the phone. “I can tell you right now the doggone place needs a new roof. When they built that subdivision they hired out-of-towners who slapped those roofs on with cheap materials and hit the road. The ridge shingles are warped and cracked, and the valley flashings are rusted through. Those roofs are dying prematurely.”

I now stood in front of the house when John James pulled up. He slid the ladder out of the truck, leaned it against the rafters

and lunged up to the roof like a panther. I lumbered up behind him.

He knelt at the peak of the roof and moved his hands lightly along the shingles as if he were gauging the health of a sick beast.

“What a shame,” he said. “Like I said, it needs a new roof. And I would feel better about the whole doggone thing if that separate patio roof got replaced, too. They used cheap roll roofing on it instead of hot tar.”

I wrote up a repair request. The seller agreed to replace the main roof but not the separate patio roof. Dion and Alma were disappointed.

“The patio roof will cost as much as three house payments,” said Dion,” but let’s move ahead.”

A week later I met at the house with Dion and Alma as John James was finishing up his job.

“Now that’s a good roof,” said John James.

“Wait a minute,” said Alma, “isn’t that a new patio roof?”

John James nodded.

“But that’s not being paid for,” she said.

“I know,” said John James Miskella, “but now I feel better about the whole doggone thing.”
