Police Officers’Association play out now that the City Council has a conservative majority.

For years, the right-wing members of the panel have bleated about the liberals spending the city into oblivion. All along, though, throughout the Great Recession, they have approved the city budgets and employee contracts that have led to Chico being the 25th-highest-paying city in the state of California. Those are the decisions—not the plastic-bag ban or the mandated general plan process—that truly led to the city’s recent financial turmoil.

Now the cops’ union is seeking unsustainable salary increases. Since payroll eats up the majority of the city’s general fund, the only way to get control of it is to rein in salaries and benefits. The conservatives know this, but they received endorsements from the CPOA during the election. So how will their loyalties fall? Will they do what’s best for the public or will they cater to the special interests that helped elect them? Time will tell, and we’ll be watching. So will those who voted them in to make financially prudent decisions.

In the meantime, we want to give a hand to the watchdogs in the community who have stood up to the bullies leading the CPOA. Among them is Michael Jones, a local dentist who spends a lot of time researching not only the financials of Chico, but also of other cities. In doing so, he’s learned that Redding, the city the union’s leaders refer to when lamenting how underpaid local cops are, is the highest-paying city of its size in the nation. As a result, Redding’s police department is understaffed by 21 positions. Unsurprisingly, its crime rate greatly exceeds Chico’s (see Jones’ guest comment on this page).

Chico’s police officers received overly generous raises this past decade, including during the worst recession since the Great Depression. City data make this patently clear. These city employees never felt the strain they should have felt years ago had the city been properly managed. City officials must not cave to their unrealistic demands. Ω

Bad move, PG&E It’s hard to understand why Pacific Gas & Electric Co. would saw down four

of the heritage trees outside the Oroville Cemetery on Monday in the face of such opposition from the community, including protesters watching vigil over the more than 100-year-old sycamores and elms. Talk about a poor public relations move.

After all, just two days later, a hearing was scheduled at Butte County Superior Court in Chico to address both PG&E’s request for an injunction to keep protesters away from the trees and the protesters’ request to halt work pending environmental review.

The judge sided with PG&E, so work can now move forward. With only 13 of 242 trees left to fell, cutting down those trees ahead of the hearing makes PG&E look like a bully. Its haste in the matter only made the members of Save Oroville Trees more angry, and rightfully so.

PG&E’s Pipeline Pathways project moves next to Paradise, before heading to the Midway south of Chico. The CN&R will be watching, and we hope our readers will join us. We must ensure that the decision to cut down heritage trees is not rushed—as it seems to have been in Oroville— and that alternatives are considered. Ω

A decade later Over the past dozen years, there have been a handful of stories I’ve written that have really gotten to me. You know, straight to the heart. These almost always involve the death of a young person, a daughter or a son.

Parents aren’t supposed to outlive their children, and when they do, well, the void is pretty indescribable. Yet, that’s the challenge for a reporter; describing the loss and pain and, in many cases, anger.

That’s what I was tasked with doing 10 years ago, when I met the parents of Matthew Carrington, a Chico State fraternity pledge who died during an initiation rite gone wrong. Matt was 21 years old when he and a friend decided to join Chi Tau, a now-defunct frat that at the time was unrecognized by Chico State due to various violations of the code for student organizations. The rogue group’s secretive hazing period required pledges to partake in a bizarre water-drinking ritual that proved fatal for Matt. He passed away a decade ago this coming Monday, Feb. 2, from something called water intoxication.

At the time, I had no idea that water consumption could be lethal. In fact, few people knew about this rare medical condition—also called hyponatremia. It happens occasionally to athletes who overconsume in short stretches of time. That’s part of the reason the national media picked up the story. Reporters from around the country parachuted into Chico. Their coverage was spotty, because they lacked the accountability that local reporters have to the community, which was reeling from Matt’s death. But the hometown media got things right.

I met Michael Carrington, Matt’s father, at a vigil outside the Chi Tau house a few days after his son’s passing.

He snapped at me when I first approached him and I can’t blame him. But, to his credit, he overcame that knee-jerk reaction and let me—and thus the community—into his life, to share, in a small way, in his grief. I’ll never forget sitting with him in a downtown coffee shop and having to momentarily stop the interview to compose myself.

Matt’s mother, Debbie Smith, also opened up to me.

Anti-hazing advocacy became her passion in the wake of her eldest son’s death. To that end, she lobbied California lawmakers to create a state statute—Matt’s Law— making dangerous hazing activities criminal offenses. She also has spoken with countless producers for TV programs and, more recently, a documentary, and now she’s even created a nonprofit organization. She’ll be in Chico to honor the memory of her son on Monday (see Howard Hardee’s report on page 9).

To this day, other than covering city politics, the Carrington saga—from the day he died, through the sentencing of his would-be fraternity brothers in criminal court, to the passage of Matt’s Law—is the single subject I’ve spent the most time reporting on. Even though a decade has passed, it strikes a chord to this very day. I never knew Matthew Carrington, but I’ll never forget him.

And neither will Chico.

Inspiring equality Re “Digging deeper for equality” (Editorial, Jan. 22): In your editorial last week, you commented, “we need to have the conversations that will help move forward the work of Dr. King.” We couldn’t agree more! It has been deeply meaningful to work with MLK Unity. As collaborative creators of performance pieces designed to give voice to the issues of our day, we have experienced numerous authentic conversations.

This year’s piece will be presented again on Feb. 21 at the South Oroville Community Center as part of Black History Month. We hope that members of Doin’ It Justice Community Chorus and some of the other choirs and vocalists will be there, too. Thank you for your paper’s continued coverage of the local movement for equal treatment under the law for all Americans.

Re “The good in godlessness” (Guest comment,

by George Gold, Jan. 22): Mr. Gold’s comments before the Jan. 6 City Council meeting seemed reasonable and rational. He isn’t sectarian, so I don’t understand why some would be surprised that his words were of a secular nature. According to the Pew study of religion in America, the country is majority sectarian by somewhere over 80 percent. Other studies set that number higher or lower, but always within the neighborhood.

What seems to be ignored by the council is that, even among those claiming some religious affiliation, there are major divisions. Offering a secular invocation rather than a Christian prayer was the fair and neighborly thing to do. The council members giving Mr. Gold a cold shoulder need to read their own holy book. I sincerely don’t think Jesus would have approved of their behavior.

Donors are winners At the Sept. 16 Chico City Council meeting, Mardi Worley, myself and others spoke up against the council’s desire to change the process of selecting citizens who apply to serve on city boards and commissions.

Instead of selecting all applicants at a public hearing, in a 4-3 vote, they permitted themselves to directly choose their own favorites for the Planning Commission and the Bidwell Park and Playground Committee. That night, I said changing this city policy could result in applicants believing that they would have to be a friend and/or a donor to be considered for a board or commission position.

Sure enough, last week, two council members appointed campaign donors. Mayor Mark Sorensen received $150 from his and Councilwoman Reanette Fillmer received $50 from hers.

No public disclosure of the donations occurred before the appointees were seated.

These campaign dollars are petty amounts. But now, the perception of patronage is real. Now donors are winners. Now the door has been opened for future council members to follow this dubious example.

The issue at stake is about principles, and principles are not petty.

Tricked out of revenue A traveler who is looking for an overnight stay encounters a full hotel. What do they do? Stay elsewhere.

Does it financially matter to the city where the traveler stays? No, because the city collects a transient occupancy tax (TOT) from wherever the traveler stays.

This bit of obvious information seems to have been lost on our newly seated, fiscally prudent “conservative” City Council.

The Hotel Diamond wants to expand. But it wants to push city drivers—who paid taxes for the parking garage—to find parking spots elsewhere. It wants more parking for more guests in order to make more money.

But [this arrangement includes] not paying the city for the parking spaces and not helping the city create alternative parking elsewhere. The effort included tricking the City Council into believing that the TOT would more than make up for the lost parking meter revenue, and the displaced downtown Chico drivers. They conveniently neglected the fact that the 6

city would have collected the TOT from an alternative hotel, and did not have to give up revenue.

So a liberal council flushes money down the drain; a conservative council neglects to collect from downtown property owners.

Either way, the citizens get shortchanged.

Say no to fracking Last week I interviewed Jose Flores of Delano, in Kern County, where fracking is going on. He talked about the undrinkable water, how the teachers have to keep the kids in at recess and lunch due to the toxic odors, and about the high asthma rates because of the poor air quality.

He reminded me that Butte County has an opportunity that won’t come again. We can ban fracking now, but not after it starts.

The new state “regulations” don’t protect the air or water or residents from the risks of fracking chemicals or when an earthquake cracks a well casing.

People say we don’t have to worry about fracking here, because there are only pockets of natural gas. But if exports begin, prices will go back up and the oil and gas industry will want every little bit of profit. That’s why they have spent so much in Butte County to defeat the citizens’ initiative.

We must support the county ban. Protect our land values, water, agriculture and air quality. Urge the Butte County supervisors to do what they said they would do back in April. The vote is coming up Feb. 10 and they want to back down to the demands of big money and big influence. Make your voice heard!

Notes from a Fox junkie Re “Where’s that education?” (Guest comment, by Dean Carrier, Jan. 15): The picture of Dean Carrier in the CN&R has the appearance of a happy, retired government employee on a government pension.

I have a graduate degree and I am a Fox News junkie. By berating Fox News, Carrier happily amplifies the audience. Fox has fair-and-balanced debate over all current and important issues. I also like Glen Beck, although some of the programs are rather juvenile; however, when Beck is focused, he is unequaled.

I suspect Carrier gets his information and news from MSNBC, CNBC and the networks’ evening news.

If you can receive Fox News and/or Glen Beck, you will be educated on current events. Try them for a while, Mr. Carrier; you might learn something. Surely, in your spectacular education, you must have read 1984 or Animal Farm. Now read Agenda 21 for a revelation of the progressives’ agenda outcome. The book will open your eyes and other progressives to the endgame of President Obama’s transforming of America.

GANG FIGHT CAUGHT ON TAPE

Two men and a juvenile involved in a recent knife fight outside the Chico Mall were arrested following an investigation based on video footage of the altercation, the Chico Police Department announced via press release Tuesday (Jan. 27).

A witness reported a fight in progress on East 20th Street on Jan. 19. The suspects were gone when police arrived, but the reporting party captured the action— described as “a knife fight between two rival criminal street gangs that occurred after a brief vehicle chase”—with a dashboard camera.

The following investigation by the CPD Gang Unit identified Rodolfo Martinez, 24, of Gridley, and Brooke Delorme, 19, of Chico, who were arrested last Friday (Jan. 23). A 16-year-old male turned himself in Tuesday (Jan. 27). Both males were allegedly involved in the fight, and Delorme reportedly drove one of the vehicles. The investigation continues regarding occupants of the other vehicle.

ANOTHER HOUSING SCAMMER SENTENCED

A Sacramento man who was part of a mortgage fraud scheme based partly in Chico was sentenced Monday (Jan. 26) to seven years and three months in prison for conspiracy to commit mail and wire fraud and two counts of money laundering, according to a press release from the U.S. District Attorney’s Office.

Leonard E. Williams, 52, owned Diamond Hill Financial and Bay Area Real Estate Holdings, which issued more than $2 million in home loans for which most buyers defaulted. The scam included the sale between 2006 and 2008 of 62 new houses built in Chico by Tony Symmes, who at the time was a wellrespected and prolific home builder. He was sentenced to three years in prison in 2012.

Twelve others have been convicted in the scheme, including six from Chico and Paradise.

Bidwell Presbyterian has plans to conduct a nationwide search for Schibsted’s replacement.

I looked up where the trees were and I thought they were way far away, not this close to the city. I should have spoken up.”

As Tousley spoke, PG&E crews dropped branches on the other side of a barricade. Despite her and others’ efforts to hold them off, they were able to cordon off four of the 13 trees that remained Monday morning.

One protester, Alan Cartwright, jumped the fence as the crews were working. He paced among the four giant 127-year-old trees, trying to halt the cutting, until Oroville police arrived to escort him off the premises. He was arrested, then released on-site.

“We’re not going to pursue any complaints against him,” said Oroville Police Chief Bill LaGrone. “He’s a passionate supporter, and we respect that.”

Sara Harris was also among the tree lovers early that morning. She was the only one left on the sidewalk on the north end of the Oroville

Cemetery, on Feather River Boulevard.

Many of the protesters, who arrived before the sun had risen, left for work satisfied that they’d kept PG&E at bay for one more day. As soon as the crowd dissipated, Tousley said, the crews moved in.

“I got escorted off the sidewalk,” Harris recounted, barely taking her eyes off the men with chainsaws. “Two men in black came and said, ‘You need to leave. This is a work area.’ I’m disabled, and I said I needed to let my legs rest and that ‘this technically isn’t a work area until I leave.’ But they herded me off—they were intimidating.”

Monday’s cutting was a particularly painful blow, given that Save Oroville Trees had a court date just two days later, Wednesday morning, where Butte County Superior Court Judge Steve Benson weighed in on their petition to halt the cutting until environmental impact reports could be conducted.

“Of course they had to cut the trees before the court date,” said SOT member Linda Draper.

Ultimately, Benson denied SOT’s request, instead upholding PG&E’s injunction to keep protesters away from the trees so it can move forward with the project.

At the heart of this matter is PG&E’s

Pipeline Pathways project, designed to eliminate obstacles—such as structures

and trees—that could either damage their pipelines or impede workers’ ability to reach them in an emergency.

“We’re doing this throughout our entire service area,” explained Shaun Maccoun, PG&E spokesman for the project. “We’ve identified that trees that are located above and around our pipeline present a problem. Their roots can wrap around the pipe and damage the pipe’s protective coating, which exposes it to corrosion.”

The pipes running underneath Oroville are about 4 to 5 feet deep and date back to the 1970s. That has many protesters wondering why the pipeline was placed under these trees, which were there long before PG&E moved in.

“When the pipelines were installed and up until recently, the gas pipeline industry didn’t understand the potential relationship between the trees, roots and the pipes,” Maccoun said. “We take responsibility for not knowing.”

Some communities in the East Bay have come out strongly against the Pipeline Pathways project, and local governments there have not authorized permits for the utility company to start cutting. As for these roadblocks, Maccoun simply said, “We’re continuing to work with cities in the East Bay area.”

Protests began in Oroville only after PG&E’s plans had reached the City Council level. PG&E made a short presentation on the Pipeline Pathways proj-

ect in September and, with an offer of nearly $35,000 and promises to help offset the loss of the trees with alternative gardening, the council approved the plan unanimously in October. That’s when Save Oroville Trees started up—it now has more than 600 “likes” on Facebook.

“Those trees are historically integral to this cemetery and the city,” said SOT steering committee member Kent Fowler. “They’re beautiful, they’re majestic, and they haven’t proved that they pose any threat. They won’t even test the lines to be sure they are a threat.”

Pointing to recent studies regarding tree roots and how they can affect pipelines, Maccoun said they must be removed for public safety. The tree root study posted on PG&E’s website analyzes the effects of roots on pipelines. In addition to damaging the protective coating on the exterior of the pipes, “There is the potential for tree roots to structurally damage the pipeline, including inducing increased bending strains, if tree roots are uprooted by external forces.”

With no apparent imminent danger, advocates, including SOT attorney Richard Harriman, say they believe an environmental review should have been required before cutting down so many trees. That’s what Harriman called for in court—that PG&E stop the project until such a review was conducted—but each appearance led to postponement. Last week, Judge Benson upheld PG&E’s restraining order against the protesters, who’ve been blocking progress at the cemetery for a month. Monday, two days before they were due back in court, the utility began work on four of the trees there.

“We’ve had the legal authority to do this work since about mid-December,” Maccoun said. “Every time we’ve had a court appearance, the judge has upheld our right to do this safety work. It’s important to remember that this work is to ensure the safety of the entire Oroville community.”

Following the felling Monday of four trees—crews were out working till 3 a.m. Tuesday—SOT members set up tents on the sidewalk to protect the remaining nine. They had not yet formulated a plan for the future, as of press time, following Wednesday’s ruling.

The Pipeline Pathways project moves next to Paradise—with plans to cut about 258 trees, 180 of them city-owned, along Neal Road—before heading to the Midway just south of Chico. Those plans include 33 pistache trees planted within the past five years along the bike path, Maccoun said. Permits already have been granted in Paradise, he said, and the utility is currently working with land owners to negotiate the project. He anticipates work to begin soon and last a few months. They are not yet in the permitting phase for the Midway portion of the project. Ω

ext Monday (Feb. 2) will mark 10 years since 21-year-old Chico State student Matthew Carrington died of water intoxication after a hazing ritual in the basement of a local fraternity house. And just as she did on that day a decade ago, Carrington’s mother, Debbie Smith, is coming to Chico.

Smith’s new nonprofit organization, the AHA! Movement (Anti-Hazing Awareness), will show an hour-long documentary titled Campus Nightmares: Matt’s Story at Chico State to mark the anniversary of Carrington’s death. During spring semester of 2005, Carrington and friend Mike Quintana were pledging the since-disbanded Chi Tau fraternity. Beginning on Jan. 30, the pair successfully endured two nights of “hell week,” an initiation that included sleeping overnight in the fraternity house’s frigid basement and vigorous exercise.

On the third night, Feb. 1, Carrington and Quintana were made to stand on one foot on

a bench and answer difficult questions about the fraternity’s history into the early morning hours. Incorrect answers were punished by push-ups on the basement floor or drinking as much water as they could out of a fivegallon jug. (The jug reportedly was refilled five times.) They were also told to douse themselves with water while being blasted by cold air from fans.

At around 4 a.m., Carrington collapsed in the middle of a push-up and went into a seizure. Even then, fraternity members hesitated to call 911, and only did so about an hour later, once they realized Carrington wasn’t breathing. He died shortly after arriving at Enloe Medical Center. As was later determined, his death was caused by cardiac dysrhythmia and cerebral edema, or brainswelling, due to water intoxication.

Hypothermia was also a contributing factor.

The story of Carrington’s death was picked up by media outlets from Dateline NBC to Playboy magazine, and stayed in the national news cycle for months. Later that year, four of the fraternity members involved pleaded guilty to charges of involuntary manslaughter in Butte County Superior

change the hazing culture engrained on college campuses. The AHA! Movement focuses on early education—before high school and college—and making the distinction between hazing and bullying. For Smith, the Campus Nightmares documentary, which originally aired on A&E Network last August, is a valuable education tool because it succeeds in capturing her son’s personality.

“That’s important to me because people need to know who Matt was to care about him,” she said. “They did a good job showing he was kind, generous and smart.”

Connie Huyck currently serves as associate director of University Housing and Food Service at Chico State. But back in 2005 she was the adviser for Greek Life (now Fraternity and Sorority Affairs). When asked to reflect on Carrington’s legacy at Chico State, Huyck said his memory is still making a mark on the university.

“First of all, I was the sole person working with Greek Life at the time,” she said.

“Now, we have three full-time advisers working with Greeks. So, the university has put energy and resources into Fraternity and Sorority Affairs. We also have checks and balances. When a group veers off the path and does a minor hazing incident, we’re able to reel them back in, educate them and get them back on the path. Sometimes, that includes suspensions or probation. There’s more accountability.”

President Paul Zingg maintains that the student culture has since shifted as well. In an email, he cited an article in The Chronicle of Higher Education, published in December, which lists Chico State—along with Yale University, the University of Nebraska-Lincoln and Lehigh University—as campuses that are effectively addressing party-school reputations.

“Matt’s death compelled a necessary and powerful response on this campus,” Zingg said. “And his mother’s advocacy and support have helped ensure that we sustain that commitment.”

Smith agreed that there are signs the university has made progress in addressing student hazing.

“I get letters, emails and Facebook messages from young people who read an article or saw the documentary,” she said. “They’ll say, ‘I’m so grateful I saw this, I’m going to be pledging in the spring.’ That’s how I know.”

A full docket County supervisors fund extra help for courts to handle resentencing his past November, California voters Tsome passed Proposition 47, which redefined nonviolent felonies as misdemeanors,

and Butte County legal authorities braced themselves for a flood of petitions from those seeking resentencing for reduced charges.

Later that month, District Attorney Mike Ramsey told news sources he expected about 600 Butte County residents charged with eligible offenses—particularly drug possession and property crimes of less than $950—to take advantage of the new law, which supporters dubbed the Safe Neighborhoods and Schools Act. Ramsey’s projections proved to be an underestimation. As of Tuesday (Jan. 27), Butte County Superior Court has received 1,031 petitions for resentencing, according to figures provided by Sheriff Kory Honea. Of those, 746 already have been or are currently being adjudicated.

Honea said one of Prop. 47’s intended effects—to lessen jail overcrowding compounded by the 2011 passage of AB 109, commonly known as the prisoner realignment bill—were felt immediately, though he has concerns about the new law’s long-term implications.

The sheriff explained that the population of the Butte County Jail, which has an official capacity of 614 beds, dropped from an average of 600 prisoners per day to 540 shortly after Prop. 47 passed. However, he said that the population has been steadily rising since, with Tuesday’s number of inmates standing at 593.

“I still have some concerns [about Prop.

47],” Honea said. “I’m not confident that we know how it will impact some of the alternative custody and rehabilitation programs we’ve established. I’m afraid we could see an increase in drug crimes, petty thefts and offenses that affect the quality of life here in Butte County.

“It’s kind of like the wild west right now,” he continued. “We’re all trying to see how the implementation of Prop. 47 plays out and if we’ll see some unintended consequences.”

One of the results thus far has been the need for more staff on both sides of the courtroom. On Tuesday, the Butte County Board of Supervisors approved a consent agenda item for the District Attorney and the Public Defenders offices to get funding for extra help with these cases.

case requires investigative and legal workup by the prosecution, and a competent legal defense,” reads a staff report presented at the supervisor’s meeting. “The district attorney and public defender cannot absorb the temporary increase in the workload.”

The supervisors agreed to budget $54,030 from the county’s general fund contingencies to pay for an experienced retired “annuitant prosecutor” who has been helping the DA’s office deal with the extra work. They also authorized the Public Defenders Office to contract with Chico defense attorney Denver Latimer, using up to $24,000 from existing appropriations.

Latimer said he’s been handling all Prop. 47

cases in Butte County in which petitioners for resentencing don’t have money to hire a private lawyer, and offered his own take on the advantages of the new law, which he calls “a very effective piece of legislation.” He estimated up to 10 percent of his Prop. 47 clients have been released immediately, while others have received dramatic sentence reductions.

“These are not people committing violent crimes or sex crimes, they’re just people who haven’t been able to kick their addiction to drugs, or had similar problems,” Latimer said. “It’s great not only for the defendants who can get out of punitive, nonrehabilitative situations they’re stuck in for years, but it’s also good for the overcrowding of our jails and prisons.”

Latimer explained that some sentences for minor crimes are often doubled and tripled due to prior offenses now eligible for reduction under Prop. 47. He offered the story of one recent client, a father of two young children, who was eight months into a five-year sentence. His term was reduced to one year, he was granted time served, and then he was released and reunited with his wife and children that day.

Latimer also noted that those released early by Prop. 47 are automatically on parole for one year, countering Honea’s concern that drug users will not get adequate help.

“It’s not like they’re being released into no-treatment situations,” he said. “They’re actually going to have to be drug-tested and supervised by our parole officers. Parole also has the option to sentence them to treatment.”

studies by local scientists concerned about dioxins left over from the Pacific Oroville Power Inc. (POPI) facility there. Some of the samples show levels so high they would make the World Health Organization shudder.

Of five local samples tested, one was determined to have 1,000 parts per trillion (PPT), far beyond the WHO’s 40 PPT level of concern.

Another was found to have 170 PPT, while results for three others range from 4.4 to 32 PPT. Dioxins are a carcinogen that can cause reproductive problems and other human health problems.

The tests were triggered by the discovery of dioxins in the ash created by the operations of the POPI plant, which first fired up in the 1980s and created energy by burning timber waste—wood chips created by the downing of trees. But in the 1990s, as the timber industry died down in Northern California, the plant began burning urban waste—the remains of torn down buildings, which included asbestos, lead and other potentially environment-damaging materials.

When the Butte County District Attorney’s Office learned of the practice, it began testing the ash that resulted. High levels of dioxins were discovered. POPI was owned and operated by a New Jerseybased company called Covanta.

The company stopped its Oroville operations in 2012 and was named in a lawsuit by a number of communities where such plants operated, including Butte County. Last year, the suit was settled with the local DA’s office collecting $186,000 of an $825,000 overall

settlement.

Dioxins in the region may also have come from the nearby and now-closed Koppers wood treatment plant, which had major fires in 1963 and 1987 that resulted in dioxin-laden smoke and ash drifting across the area.

The soil tests are being paid for by both the DA’s office and the Butte Environmental Council (BEC) through a sub-group called the Oroville Dioxin Education Committee (ODEC). The soil samples and their location determinations are being organized by John Lane, the geologist who owns and operates Chico Environmental Science and Planning. Lane conducted the initial ash testing that revealed the presence of dioxins.

“The reason we were taking the samples initially was to investigate if anything was happening around the POPI facility,” Lane said.

“Working with the District Attorney’s Office, we sampled the ash coming out of the POPI facility and it was extremely high.”

That recent soil sample test that showed 1,000 PPT was taken from private property along Bagget Marysville Road about a mile south of the POPI plant. News of the high-level test was met with serious concern by the DA’s office.

“We’ve never seen numbers that high in soil,” said Hal Thomas, the county’s environmental prosecutor, who’s been working on the POPI case since it began. “We saw 2,200 PPT in the actual ash at the POPI plant and we’ve had speculation about what we might find. Now it appears we are getting direct evidence of the problem at hand.”

“Basically we made a grid of 30 locations in the South Oroville, Thermalito and Palermo areas,” he said. “We began the ODEC testing, which called for 30 samples that we’ve collected. We’ve spoken with Butte County Environmental Health and they are going to be putting some money up to collect some of the samples as well.”

BEC Executive Director Robyn DiFalco, whose organization has also tested chicken eggs in the area for dioxins, said she was not surprised by the test results.

“We’re glad it’s finally come through and now we can assess the risk to the county and help policy makers get more focused on how to respond,” she said.

DiFalco said the tests cost about $500 each and collecting the soil samples adds another $150. Thus far, BEC has received $4,000 from the Clif Bar Family Fund and another $3,000 from the Rose Foundation Grass Roots Fund, she said. “That is $7,000 so far, and we are hoping to get that much more for additional tests.”

Since dioxin doesn’t dissipate over time, continued testing for the presence of the carcinogen in other spots in the area are very much a necessity, she said.

“This is a multiyear process. In the past, the project felt daunting— it was so expensive that we were overwhelmed,” DiFalco said. “But the dioxin is not going anywhere.

We can test this year and a test next year will still be comparable.”

MEASLES ON THE MOVE

State health officials have confirmed 59 cases of measles since the end of December, and a majority of them have been traced to the “happiest place on earth,” Disneyland.

According to the California Department of Public Health, 42 of those with the highly contagious illness were exposed at the Magic Kingdom or Disney’s California Adventure Park in nearby Anaheim.

They include five employees of the theme parks.

Measles is an airborne disease. Early symptoms include cold-like ones, including a cough and runny nose. Fever, red eyes and a red rash, typically starting on the face, are additional symptoms. People experiencing such symptoms who have been in places frequented by international travelers, such as airports, theme parks and other tourist attractions, have a higher likelihood of exposure.

Health experts say vaccination is the best way to avoid contracting the illness. Of the 43 patients whose inoculation records have been located, 37 were unvaccinated.

BUTTE AIN’T KICKIN’ BUTTS

Local grades on tobacco policies released by the American Lung Association last week aren’t impressive.

According to the ALA’s State of Tobacco Control 2015 report, Oroville’s grade of C was the best for the region. Chico and Paradise received overall D grades and Biggs, Gridley and the unincorporated areas received F’s. Where Oroville seemed to shine was in the category of reducing tobacco sales—it got an A where the rest of the county got failing grades. Chico did best in offering smoke-free entryways and recreation areas, but still got only a C for overall smoke-free outdoor air. The rest of the county, again, got F’s.

Butte County wasn’t alone—statewide, efforts to curb tobacco use have stagnated, according to an ALA press release. “Once a proactive leader in tobacco control efforts, California now falls behind in protecting residents from tobacco,” it reads.

ANTI-VAXXERS DECLINE SLIGHTLY

After a dozen years of more and more parents opting their kindergarten-age children out of immunizations by citing personal beliefs, the number of so-called “anti-vaxxers” in California declined in 2014.

According to the Los Angeles Times, recent campaigns to reverse that trend have worked. Those efforts began amid a resurgence of deadly illnesses, including whooping cough, a major outbreak of which sickened more than 9,000 people in 2010.

Additionally, a new state law that requires parents of kindergarteners to get the signature of their health care provider as proof they discussed the risks of opting out has made it more cumbersome to refuse vaccinations. Waivers for this group went down from 3.1 percent in 2013 to 2.5 percent in 2014.

Still, health experts have their work cut out for them. In 1996, the exemption rate was just .46 percent.

Haynes was talking about Kiley Miller, a 14-year-old she’s been training for the last two years.

But Miller is not just any “client.” Two years ago, she was battling anorexia and had lost 20 pounds. That’s when Miller’s parents, Christi Miller-Fuchs and Justin Miller, sought help from Haynes, a registered dietician who specializes in eating disorders.

Haynes has worked with the teenager on developing healthy nutrition plans, while also beginning strength-training practices.

“Her recovery process was quite amazing,” she said.

Inspired in part by Miller’s progress, Haynes opened a class at Velocity dedicated to physical training for teenage girls called Strong Girlz. She noted that the class is not specifically centered on eating disorders; it has a wide array of participants, including athletes training between seasons.

“It’s about working on a healthy relationship with the body,” she said. “Improv-

ing body image is a big thing.”

Velocity does indeed employ a unique approach to fitness and nutrition. The 2,600-square-foot gym has no mirrors, and Haynes prefers to speak in terms of energy used, not calories burned.

“It’s about listening to their bodies.

People often come in here and fret over what they ate; they feel guilt. So you had a cookie? Did it feel good? That’s OK. Honestly, I’m probably going to get a hamburger and fries after this, because I want it. And I’m a dietician. But it’s OK.” The nutrition philosophy Haynes speaks of is referred to as “intuitive eating,” which is often used to help patients overcome eating disorders. Promoting the idea of becoming in tune with the body’s signals for nourishment, intuitive eating is used as an alternative method to traditional

diets, where the focus is based on numbers—portions, calories and fat grams—to dictate meal plans.

Evelyn Tribole and Elyse Resch coined the term intuitive eating in their 1995 book of the same name. However, the movement’s roots date back to the ’70s, when authors like Susie Orbach, who in 1978 published the book Fat Is a Feminist Issue, began speaking about the relationships between women’s bodies and food.

Miller is in good company when it comes to

HEALTHLINES ence one within their lifetime, and roughly half a million teenagers will have an eating disorder.

But as Ana Vicuna, program manager of Youth Services for the Butte County Department of Behavioral Health, pointed out, determining legitimate statistics isn’t so easy.

“The eating disorder is often not the primary diagnosis, so it doesn’t always get tracked,” she said, referring to patients registered within Butte County.

It was Haynes’ own lifelong battle with anorexia that influenced her to make a career shift to helping other women with the same struggles.

“I had dabbled in everything before,” said Haynes, who spent 20 years as a dietician, working in various settings, from hospital clinics to nutrition education fairs. “But I was still looking for something I could be super passionate about.”

After relapsing with anorexia in her 30s, Haynes re-evaluated her interests when therapist Lisa Welch suggested she work with other young women with disordered eating.

So began Haynes’ new focus as a dietician. Remembering the importance of her own recovery process through strength-training, she also developed the plans to open a gym with best friend Robin Sinclear, who’s trained individuals in Chico for the last seven years.

Since 2013, the women have run Velocity Fitness, initially using Haynes’ garage as their workout space.

“We’re fortunate to have an array of [fitness] options here in Chico. What sets us apart, though, is the experience each of us brings, from a fitness and nutrition stand-

point,” said Haynes, who is now a certified trainer as well. She and Sinclear are also Russian Kettlebell Challenge-certified and StrongFirst SFG Kettlebell-certified instructors.

And Strong Girlz has been running since the inception of Velocity, which relocated to a space along East Avenue last March.

“Even when we were operating out of the garage, I had five girls working with me when I started that class,” recalled Haynes.

While Haynes says her work with the girls has been one of the “most meaningful experiences” in DESIGNER her life, she recognizes the continuing prevalence of disorderedJEN_PU eating.

“There are triggers around every corner,” she said. “It’s hard to pinpoint what exactly causes it for any given individual.”

According to the Mayo Clinic, the most common factors include self-esteem issues and societal pressures. For those seeking counseling centers, Vicuna says four are offered through Butte County’s Department of Behavioral Health, including one in Chico.

For girls like Miller, the continued support from programs like Strong Girlz is invaluable for the recovery process. Last April, she competed in Chico’s StrongFirst Tactical Strength Challenge as the youngest girl in the competition. “I was surprised at how much strength I had,” said the 14-yearold.

That’s exactly the kind of realization Haynes is shooting for.

“I want the girls to see what their bodies are capable of, and continue to come because it’s fun and they want to, not because they have to lose weight for prom or look a certain way on Instagram,” she said. Ω

Chico couple live and teach sustainability through macrobiotics

Ferré had first attended the camp four years earlier; at the time, he was teaching classical guitar at a university in Texas, where he adopted the macrobiotic lifestyle he credits with freeing him from ear pain and allergies.

A friend who moved from north Texas to the North State connected him to GOMF—then based in Oroville—and Ferré began working for the organization soon after.

By that summer, he was the camp’s organizer, and one of that year’s attendees caught his eye. She was 13 years his junior: a college student from Wisconsin who, it turns out, found relief from allergy symptoms (plus quit smoking) with the help of an acupuncturist who introduced her to macrobiotics. Her teachers at a macrobiotics conference in Missouri also participated CAMP SESSION:

in the French Meadows Camp, so she decided to travel to California.

“First time I saw her, I knew instantly— you know that story,” Carl said. “She came to work for the foundation after the summer camp ended. We had the opportunity to get to know each other, and eventually decided to get married.”

In the ensuing decades, Julia Ferré, like her husband, has remained an adherent of macrobiotics. She’s studied other alternative disciplines—hypnotherapy, hypnobirthing, Reiki and intuitive readings—which she practices locally. The couple took the reins of the Ohsawa foundation in 1998 after the passing of its founder, Herman Aihara (who’s also known for co-founding the Chico-San food company).

Carl, 67, is the foundation’s president; Julia, 54, is secretary/treasurer. They moved the headquarters to Chico, where they reside, in 2001.

In macrobiotics, the Ferrés have found an overarching philosophy and specific tools for a great life. In fact, that’s the essence of the name, derived from the Greek words “macros” (great) and “bios” (life).

“A lot of people think ‘macrobiotics’ means diet,” Julia said, “that you eat a certain way. You’re vegetarian, you don’t eat sugar, you don’t drink alcohol, or [you don’t consume] excess meat.

“But there’s more to it than just a diet.

There’s also lifestyle recommendations about how to be a good person, how to

have self-growth, and most of all how to learn how to think ... to make clear decisions. Because of that, it reaches into all these other areas: sustainability, relationships, career, spirituality. There are lots of different applications.”

“To me,” Carl said, “macrobiotics is the study and practice of alignment with nature.

There’s a natural order to life, and the more we align ourselves with that natural order, then the greater health, happiness, peace, wisdom, love, understanding and freedom we can have.

It’s a matter of coming back to that alignment in all the choices people make, and there are principles that are used in order to do that.”

The principles behind macrobiotics stem from George

Ohsawa, a Japanese man who was born in 1893 and developed tuberculosis at age 15.

Given a poor prognosis by doctors, he sought out alternative medical practices and wound up living to 73, leaving a set of teachings on his macrobiotics philosophy as his legacy.

GOMF, established five years after his death in 1971, promotes the works of Ohsawa and Aihara, among others.

The foundation publishes a journal, Macrobiotics Today, along with maintaining online resources.

“Macrobiotics is a very individualistic approach to things,” Carl said, “so if you look around at several websites, you’ll see different people explain it different ways, which is more the way they’re using the principles, which may be different from the

way we’re using them.

“But the other side of it is the connectedness, where we realize we’re all connected—and connected to all of life. To quote the old song, ‘we’re in the same boat, brother.’ There’s a togetherness, in that what one of us does affects what everybody else does.

“There’s a cause-and-effect relationship within macrobiotics: What we do one day determines what we’re going to do, be and think in future days.”

This thought process has appeal to environmentally conscious individuals who see climate consequences from human activity.

The Ferrés see other links between sustainability and macrobiotics. Two key principles are ecology and economy.

The first is born out of respect for the land, a precept Carl referred to as “shin do fu ji” (which translates from Chinese to mean “our bodies and the soil are not separate—they are one”). This relates to the second principle as reflected in the core component of the macrobiotic diet.

“We prefer to eat whole foods that are locally produced,” Carl said, “thus avoiding transportation costs that affect the larger environment.”

“It’s really easy to do that in Chico,” Julia added. “The farmers’ market is just amazing; there’s just really good food here.

California provides all this produce and rice.”

Macrobiotics also embraces the goal of zero waste—even striving to give back more than consumed, based on the principle “from one grain, 10,000 grains” (referring to rice). Composting is one means; another, Julia suggests, is fostering acceptance and generosity.

That goes back to mindset and decision-making.

Carl cited another maxim of macrobiotics: “Every front has a back; the bigger the front, the bigger the back.” Nuclear energy, for instance, may offer tremendous potential for generating electricity but also carries tremendous potential for damage.

He sees the same duality with agribusiness.

Macrobiotics, then, is quintessentially green.

“Where we would help the most in sustainability is the adjustment of individuals’ lifestyles,” Carl added. “As people eat more unaltered foods, unchemicalized foods, and go more toward a Mediterranean diet …”

“They become healthier,” Julia interjected, “and when they become healthier they can become happier …”

“It helps the mind become more clear,” Carl continued, “and that leads to better decisions for ourselves and for the environment, and that can lead to greater success in fulfilling our purpose in life.” □

Military alternatives Joining the military is often seen by high school students as the only constructive option if they have low job prospects and no plans for college. But local activist Charles Withuhn has developed an alternative with his Career Builders CounterRecruitment (CBCR) project. With the help of volunteers, the busy Withuhn, a retired sign-maker who’s perhaps best known these days for his tree advocacy, sets up a booth during events at Butte County high schools when he knows the ROTC (Reserve Officers’ Training Corps) will be there. He provides information on the dangers of joining the military, and presents teens with nearly a dozen paid and volunteer career-training alternatives.

How did Career Builders get started?

We began in 2013 as part of the Chico Peace and Justice Center. It breaks my heart to see highschoolers join the military because it’s not the simple fouryear commitment they promise, and there are lots of dangers like mental problems and high unemployment afterward. I wanted kids to know their options are not just going to college, living under a bridge or joining the military.

What types of programs do you offer?

We have pamphlets on 11 programs. Some pay money right away, and some let you travel to

different states or countries. One of my favorites is the Worldwide Opportunities on Organic Farms, or WWOOF. It connects you to organic farmers in places like Hawaii or Costa Rica that show you the trade while paying your room, board and food. Plus, you only work half-time, so you have time to explore.

What do you believe are some of the dangers of joining the military?

Well, the PTSD (post-traumatic stress disorder) and suicide rates are just ridiculous. And unemployment among vets ages 18-24 is 21 percent, which is way higher than the 16.5 percent for nonvets the same age.

What kind of reactions do you get?

I have changed people’s lives and I get a lot of hugs. One girl saw our info and physically jumped off the ground, shouting, “This is what I’ve been looking for!” Another time at Fair View High an older lady was downcast because her son was considering joining the military. I gave her a pamphlet and she just

about cried, saying, “Thank you so much!”

You also have veterans help you out?

Yes, we have three veterans, such as my friend Bill Mash here, who tell kids their experiences and recruiters’ lies. For example, you can’t get the training you want, and it’s not the four-year commitment they tell you; it’s often really eight years. The contract says, and our vets tell kids, when you’re halfway through your four years, the higher-ups can say, “Sorry dude, we need you for another four-year gig.”

What are your future plans for Career Builders?

Our goal is to have an exhibit in every Butte County high school. So far we’ve been in three—Chico High, Fair View and Pleasant Valley.

We’ll be at Chico’s Inspire High on April 8. Plus, I really want people to call and volunteer. I’ve started up Chico Tree Activists, so I want others to take over Career Builders.

I’ve been thinking a lot about trees lately, what with covering the happenings outside the Oroville Cemetery, where PG&E is cutting down a good number of 127-year-old sycamores. Walking among the people there— those who were out protesting the chainsaws—I was taken by how much passion they have for nature and for their community.

Some of them sported T-shirts with the name of their organization, Save Oroville Trees. It seemed to create a unity that simply gathering together in the same place doesn’t quite evoke. And it made me think of another shirt I’d seen around town, one with the words “Love Trees” on it. So I decided to track down the makers of that shirt, Upper Park Clothing, and check out what their story is.

When I entered the Upper Park shop, I was immediately greeted by co-owner David Selkirk, who happily gave me a tour. The shop is modest in size, but these guys get a lot done there—from designing the shirts, hoodies and beanies, to actually printing them, to displaying them for sale. And one of the coolest things Selkirk mentioned was that damn near everything is local.

Let’s start with the owners—Selkirk (art director) and Jaime Wilhite (CEO) met while they were students, albeit four years apart, at Chico High School. They’re definitely inspired by Chico and its environs. I mean, the company name is Upper Park Clothing, and most of their designs have something to do with the park, Chico State, local landmarks and events (like the New Year’s Day Polar Bear Swim) and, of course, our love of trees.

The newest design, Selkirk told me, is based in Chico history. It’s a caricature of Fun World USA, the now-defunct water park, being taken over by monsters. Others in the works include some related to mountain biking and Bidwell Park trails— their very first shirt, Selkirk said, highlights local swimming holes and has been very successful.

Aside from printing on-site, they get leather beanie accessories cut right here in Chico and their popular tie-dye shirts are colored up in Red Bluff. It’s cool to find young people so dedicated to keeping their art and their business local. What’s more, they give back a small portion of each sale to the community.

How the FBI and local cops captured Chico kidnapper and rapist Lonnie Keith

t was a distinctive taillight that first gave away the sexual predator who— in methodical and chilling fashion— had been attacking and drugging young women in Chico.

On this night—the early hours of Saturday, Jan. 28, 2013—10 FBI agents and three Chico police personnel were positioned strategically throughout the student neighborhoods south of the Chico State campus. They were looking to catch a serial kidnapper and rapist who had been abducting college students from the streets and injecting them with sedatives. At the time, law enforcement officials were worried and community members increasingly fearful.

The stakeout that snared Lonnie Scott Keith took place two years ago this week, as a new semester’s first Friday night of reverie was stumbling to a close. An FBI agent noticed those unusual-looking taillights brighten from his vantage point near the hub of Chico’s south-campus nightlife: Fifth and Ivy. In just a few hours, the agent had seen them multiple times. His description was radioed out about 3 a.m.

The taillights stood out because they

were of the “racetrack” variety, stretching in a narrow band the full width of the car’s rear-end.

Investigators in two vehicles almost immediately began following those lights, which were attached to a charcoal gray 2013 Dodge Dart, as it made a U-turn and several other turns. Less than five minutes later, the Dart failed to heed a stop sign at Third and Orange streets and was pulled to the curb near Fourth and Orange. Driving that vehicle was Keith, and it was the beginning of the end of his secret life terrorizing women.

The investigative sting that caught Keith with startling swiftness—and the voluminous case that sent him to state prison for 26 years without his victims having to endure the trauma of a trial—was a joint operation of the Chico Police Department and the FBI. Law enforcement “basically went all out,” said Robert Marshall, Keith’s defense attorney, who described the case as “one of the most intensely investigated” he’s ever been involved with.

“When you’re dealing with a serial rapist,” said Mike Ramsey, Butte County district attorney, “everyone brings their A game. …

who headed up the investigation that caught Keith, had witnessed a lot in 30 years of law enforcement; however, “kidnapping and injecting victims and committing sexual assault is not something I’d ever seen.”

Following two violent abductions in fall 2012, it was clear to Duitsman that a dangerous predator was at large. Investigators feared the man was refining his techniques and that his attacks could escalate and become even more “diabolical.” And adding to law enforcement concerns was this: As a prelude to assaulting young women, the attacker had been presenting himself as a police officer.

As 2013 arrived, not only did investigators suspect that they could be hunting a medical professional with access to prescription drugs, but also that the perpetrator could be a member of law enforcement, Duitsman said.

Thus, the Chico PD sought the FBI’s help in solving the abduction cases, Duitsman said.

The bureau decided to open its own kidnapping inquiry and investigated the case jointly with Chico detectives, said Gina B. Swankie, a public affairs specialist for the FBI in Sacramento.

FBI personnel from field offices in Chico and Sacramento, as well as from the bureau’s headquarters in Washington, D.C., worked the Keith case.

“The FBI can and will assist local law enforcement agencies upon request,” Swankie said. “Such assistance is offered in tandem with the local agency and is not a ‘takeover’ of a matter, unlike TV.” The two law enforcement agencies came up with a surveillance plan for a south-campus area generally bordered by Chico State to the north, Little Chico Creek to the south, downtown Chico proper to the east, and Pomona Avenue to the west. Duitsman described the agents as specially trained for such observation.

According to Swankie, “Agents were looking for vehicles that may have been loitering in the area [or] making frequent, repeated passes in the vicinity of prior crimes or attempted crimes.”

Duitsman said four stakeouts had been scheduled for different dates in early 2013, but the last three weren’t needed because Keith was caught on their first night of surveillance.

Keith was 40 years old and had been married

15 years at the time of his arrest. The father of four was depicted in social media as involved with his children. His wife, Kari Keith, said in a CN&R cover story last fall that an FBI profiler

described her husband as a sociopath (see “Collateral damage,” Sept. 18).

Duitsman found that Keith, a physician assistant, was widely respected among his co-workers at the Enloe Occupational Health Department in Chico and at Oroville Hospital. “They all expressed shock,” Duitsman said. “They didn’t want to believe it at first: ‘No, not Lonnie!’”

Among statements that colleagues made about Keith were “his medicine was great” and “he should have been a doctor,” Duitsman recalls.

The drugs found both in Keith’s victims and in his vehicle included diphenhydramine, an antihistamine with the brand name of Benadryl, and haloperidol, an antipsychotic medication with the brand name of Haldol. After being injected, all of the victims became disoriented and lost gaps of time from their memories, said Stacy Edwards, the Butte County deputy district attorney who handled the prosecution. In large doses, diphenhydramine can cause hallucinations, and at least one victim, at Keith’s sentencing, reported “hallucinating around town for [an] hour or so after [Keith] left me in the street.”

Duitsman said Keith stole those drugs from one of his employers, declining to be more specific about where he obtained them.

Keith worked for Enloe from 1998 to 2005 as a clinic technician and from 2008 until his 2013 arrest as a physician assistant.

Physician assistants in the Enloe Occupational Health Department “do not have access to the type of drugs described by the Chico Police Department,” said Enloe Medical Center spokeswoman Christina Chavira.

Oroville Hospital officials neither acknowledged nor responded to multiple inquiries about whether Keith obtained the drugs he used to

inject his victims from that hospital.

Based on victims’ accounts, Duitsman said Keith’s method of operation was to troll the south-campus area in his vehicle, “then choose a location where he would sit.” In two abduction cases, he either jumped out of or emerged from behind his vehicle and confronted a lone female passerby.

Keith would then question the woman as if he were a cop and partially blind her by shining a flashlight in her eyes. He would ask her age and how much she’d had to drink, Duitsman said. Victims said Keith’s face was covered by a nylon stocking or a mask.

Keith, at 6-foot-3-inches tall and 215 pounds, was, in Duitsman’s estimation, “very physically fit.” He would force his victims into his vehicle, quickly restraining them with zip ties and putting tape over their eyes. He then injected them with sedatives that made them drowsy.

At least one victim had two needle marks and both diphenhydramine and haloperidol in her system, leading Edwards to presume she was injected with two different syringes. At least one woman was raped. It is believed the victims were released at or near the site of the attacks.

The defense attorney said Keith’s attitude helped him avoid a life sentence. “Lonnie was a very good client from a defense attorney’s standpoint,” Marshall said. “He’s an intelligent, likable guy, who was always respectful and grateful for my assistance.”

Duitsman, a 25-year veteran of Chico PD who is now semi-retired, has worked some big cases in his career, including the February 2000 shooting and killing of Louis O’Shea, who managed the Rio Lindo Motel on The Esplanade. The O’Shea murder took more than a year for detectives to solve and became somewhat racially charged after witnesses told police the killers were black and they turned out to be white.

Duitsman puts the Keith investigation in the “top three, if not the most significant case I’ve had because (of) the danger and the other scope of his activity.”

In the Keith case, Duitsman was dealing with young women who had been horribly traumatized.

The detective sees it as his “solemn responsibility” to not only work with victims to solve crimes, but to “help them along the path to become whole again” by referring them to other professionals.

The veteran detective said he tried to contact all three of Keith’s victims after the sentencing to have a final conversation, and two got back to him: “They wanted to move on with their lives and Ω were doing really well.”

Duitsman said there was no indication the sales were connected to Keith’s life of crime and no evidence was later found inside those vehicles.

The new Dodge Dart that would be his undoing was purchased just before Christmas, according to Kari Keith.

A fourth assault from 2012 was looked at closely as to Keith’s involvement, but no charges were ultimately brought forward, Duitsman said.

“We strongly suspected him in other cases,” Ramsey said.

Last August, Keith changed his plea from not guilty to guilty of four felony counts—three kidnappings and one rape. Marshall, his attorney, acknowledged that, given the strength of the evidence from multiple assaults, “there was just too much to explain away with coincidence.”

Marshall also said his client wanted to cut short a trial that would be traumatic for his family, his victims and the witnesses.

Keith is currently housed at the Deuel Vocational Institution in Tracy, a “reception center” for state Department of Corrections and Rehabilitation inmates. He will be evaluated there and then transferred to one of California’s 35 state prisons. According to Marshall’s calculation, the earliest Keith could be eligible for parole would be March 2035, when he will be 62 years old.

Associate Professor Jonathan Caudill, who serves as criminal justice coordinator for the Political Science Department at Chico State, said Keith faces an uncertain future in prison.

“It has been my experience that sex offenders aren’t seen as a con’s con and they risk disproportionate violence at the hands of other, more aggressive inmates,” Caudill said. “Of course, the system takes steps to protect these type offenders, but things still happen. For Mr. Keith, only time will tell as to what role he plays in prison.”

Edwards, the deputy DA, said that, upon Keith’s prison release, if he is found by a court to be a sexually violent predator, he could be committed indefinitely to Atascadero State Hospital, which houses mentally ill offenders.

Given Keith’s lying, given the villainous items inside his Dart, given that the drugs in his syringes were the same as those in the victims, given the DNA match to a rape, the prosecution had an “incredibly strong case,” Edwards said.

“You start piling those things on top of each other and it only points to one conclusion.”

The main weakness of the case was the victims’ “fragmented” memories as a result of the drugs Keith shot into them, Ramsey said.

Attorney Marshall said the Keith defense was challenging just given the quantity of evidence to evaluate.

“My DNA expert said it was the largest amount of scientific evidence that he’s ever seen outside of a death penalty case,” Marshall said. “They tested literally dozens of DNA samples.”

Keith appeared unruffled on the night he was arrested, waiving his Miranda rights to have an attorney present during questioning and consenting to a search of his vehicle, Duitsman said. Although his car had been observed passing through the Fifth and Ivy intersection numerous times over several hours, Keith claimed when stopped to be out looking for something to eat.

“He seemed very calm, very agreeable,” Duitsman said. “He seemed like he wanted to be very cooperative.”

Edwards said Keith “told lie after lie after lie” to detectives. He maintained that the blankets in the back-seat area of his car were for a family skiing trip the next day and that he was in the area that night because he had visited with a former colleague at Enloe Medical Center. Both claims were false.

What officers found was a car staged for another attack, including two syringes loaded with clear substances “and ready to go,” said Edwards. Inside the vehicle was the sort of bedding that Keith’s victims had reported—what DA Ramsey referred to as Keith’s “rape nest.”

Also found were adhesive tape cut into strips, latex gloves, several nylons, and a flashlight that doubled as a stun gun.

After a search warrant was obtained, state Department of Justice investigators located a hidden compartment under the front passenger seat. The box contained a startling arsenal of items, including zip ties, multiple syringes, vials of prescription drugs, metal handcuffs and metal leg restraints.

Duitsman said the compartment was not something Keith had rigged but rather came standard with the Dart. The detective said it would be a useful feature for, say, a Bidwell Park jogger to temporarily hold valuables. Keith used it to hide the instruments of his assaults.

Investigators looked into at least 11 similar crimes dating back to August 2011 to determine if Keith could be responsible. Ultimately, he was charged in three attacks on women, all in 2012.

Associate Professor Jonathan Caudill, who serves as criminal justice coordinator for the Political Science Department at Chico State, said Keith faces an uncertain future in prison.

“It has been my experience that sex offenders aren’t seen as a con’s con and they risk disproportionate violence at the hands of other, more aggressive inmates,” Caudill said. “Of course, the system takes steps to protect these type offenders, but things still happen. For Mr. Keith, only time will tell as to what role he plays in prison.”

Edwards, the deputy DA, said that, upon Keith’s prison release, if he is found by a court to be a sexually violent predator, he could be committed indefinitely to Atascadero State Hospital, which houses mentally ill offenders.

Given Keith’s lying, given the villainous items inside his Dart, given that the drugs in his syringes were the same as those in the victims, given the DNA match to a rape, the prosecution had an “incredibly strong case,” Edwards said.

“You start piling those things on top of each other and it only points to one conclusion.”

The main weakness of the case was the victims’ “fragmented” memories as a result of the drugs Keith shot into them, Ramsey said.

Attorney Marshall said the Keith defense was challenging just given the quantity of evidence to evaluate.

“My DNA expert said it was the largest amount of scientific evidence that he’s ever seen outside of a death penalty case,” Marshall said. “They tested literally dozens of DNA samples.”

The taillights stood out because they were of the “racetrack” variety, stretching in a narrow band the full width of the car’s rear-end ... a charcoal gray 2013 Dodge Dart. Less than five minutes later, the Dart failed to heed a stop sign at Third and Orange streets and was pulled to the curb.

Keith appeared unruffled on the night he was arrested, waiving his Miranda rights to have an attorney present during questioning and consenting to a search of his vehicle, Duitsman said. Although his car had been observed passing through the Fifth and Ivy intersection numerous times over several hours, Keith claimed when stopped to be out looking for something to eat.

“He seemed very calm, very agreeable,” Duitsman said. “He seemed like he wanted to be very cooperative.”

Edwards said Keith “told lie after lie after lie” to detectives. He maintained that the blankets in the back-seat area of his car were for a family skiing trip the next day and that he was in the area that night because he had visited with a former colleague at Enloe Medical Center. Both claims were false.

Also found were adhesive tape cut into strips, latex gloves, several nylons, and a flashlight that doubled as a stun gun.

After a search warrant was obtained, state Department of Justice investigators located a hidden compartment under the front passenger seat. The box contained a startling arsenal of items, including zip ties, multiple syringes, vials of prescription drugs, metal handcuffs and metal leg restraints.

Duitsman said the compartment was not something Keith had rigged but rather came standard with the Dart. The detective said it would be a useful feature for, say, a Bidwell Park jogger to temporarily hold valuables. Keith used it to hide the instruments of his assaults.

Investigators looked into at least 11 similar crimes dating back to August 2011 to determine if Keith could be responsible. Ultimately, he was charged in three attacks on women, all in 2012.

Though the two share songwriting duties, Brown wrote all five on this collection, and she said that at the time of their writing she’d just gone through a “horrible breakup,” and found that “It wasn’t so much about that person, but about the mood—I discovered it’s much

easier to be creative when you’re all [emotionally] fucked up.”

But, devastated as she may have been, Brown’s lyrics achieve a balance between acknowledging personal sadness and expressing the inner strength it takes to transform that sadness into public art. As she sings in her high, clear voice in “Simple Times,” over a sparse, slowly strummed banjo augmented by Hiatt’s interwoven guitar notes and soprano vocal harmonies, “There were simple times with simple folks/till it all got hard and we all went broken and bandaged/but somehow we managed to go on despite it all/and when we fell, how we did fall/but how we lived—oh, how we lived.”

Beginning in a more upbeat tone, “Daytime” plunks along like a walk on a sun-dappled road, buoyed by the women’s close as crossed-fingers vocal harmonies, but the sunniness of the tune is belied by the refrain, “Come to me in the dark/you can watch me fall apart.”

It’s this dichotomy of musical lightness and spaciousness coupled with intense emotional lyricism expressed by beautifully harmonizing voices (the word “ethereal” is commonly used by people reacting to their music) that gives the duo’s music an appeal that reaches out to those who appreciate its resonance with Appalachian laments and traditional country balladry. And the music’s slow-motion incorporation of ambient electric guitar tones intersecting with the clarity of the banjo’s chiming notes and intricate vocal interplay creates a very distinct and uniquely modern version of music rooted in very ancient and basic human emotions.

Asked about how they chose the name

Bunnymilk, Hiatt explained that once they became a performing duo (around the summer of 2012) they challenged several friends to a “name the band contest.” Friend, musician and CN&R staff writer Ken Smith offered “Bunnymilk,” which, as Hiatt said with a smile, “We thought sounded a little gross, kinda weird, and oddly cute. Just like us.”

As Brown said of the names that didn’t make the cut, “They were all like ‘Mountain something,’ or ‘Witchy this or that,’ and Bunnymilk kind of came out of left field and we appreciated that it wasn’t overly pretty sounding. So Ken won the contest … I guess we better give him a tape.”

And speaking of tape, one can’t help wondering why they chose to present their music on the somewhat retro media. Hiatt explained that Origami Recording Lounge owner/engineer and the recording’s producer Scott Barwick approached the duo and offered to have them become the first release on his new cassette-only label, Crystal Flower Cassettes, because “he really likes our sound and wanted to do a recording that really captures what we do live.” To that end, Barwick recorded the songs, including vocals, live in the studio with no additional musicians or overdubs.

The result is a lovely five-song set that will make finding a functioning cassette player worth any music lover’s while. And though it’s their first physical album, they have sporadically released a dozen songs and demo recordings online at bunnymilk.bandcamp.com over the last couple of years, and the new album will soon be available there as well. International man of absurdity Screwball spoof of screwball spoofs isn’t for everyone new Johnny Depp vehicle, a farcical Thasheandgotten relentlessly silly detective yarn, pretty rough treatment in the

national press. It’s certainly not must-see cinema, but Mortdecai is, to my way of thinking, by Juan-Carlos passable comic movie Selznick entertainment, at the very least, and a comic curiosity of more than passing interest as well.

Admittedly, I may have a higher tolerance than most for low-ball comedy, so let me frame it this way as well: Mortdecai Mortdecai belongs in the same Starring Johnny good/bad class as The Depp, Gwyneth Paltrow, Ewan Lone Ranger (2013 verMcGregor and sion, with Depp as Tonto), Paul Bettany. Mortecai/Depp is a ditzy British gent, a clueless aristocrat who fancies himself a world-class master detective and all-round connoisseur. He gets himself entangled in a cluster of mysteries involving the theft and disappearance of a classic painting, possible coded messages, a circuitous treasure hunt for a cache of Nazi gold, and the murder of an art restorer who also has a gift for forgery.

The extravagantly foppish title character seems a cross between Mike Myers’ Austin Powers and Peter Sellers’ Inspector Clouseau (with a deliberate dash of

Terry-Thomas, the mustachioed, gaptoothed British comedy star of yesteryear), but without the full comic spark of those illustrious predecessors. The film’s assorted caricatures of the kinds of Brits who seem to recur in English murder mysteries (caricatures of caricatures, really) prove mildly amusing but seem to have no real point apart from providing cast and crew with opportunities for flamboyant goofing off.

There is, of course, something to be said for flamboyant goofing off, especially when you have an appealing cast of actors who seem ready and willing. Mortdecai has Gwyneth Paltrow as the title character’s saucily adventurous wife, Paul Bettany as his multitalented and absurdly intrepid sidekick/ assistant, Ewan McGregor as the police commissioner who is Mordecai’s rival in romance and sleuthing alike, and Jeff Goldblum as a suavely menacing collector of art and automobiles.

Mortdecai is based on a series of comic novels by the late Kyril Bonfiglioli, and director David Koepp and screenwriter Eric Aronson make the on-screen version into a kind of liveaction cartoon. That aspect is particularly evident in the exaggerated performances of Depp and Bettany, and in the extravagant physical comedy of the latter. Gleeful cartoonishness of another sort also works well in the scenes involving an addled Duke (a droll Michael Byrne).

For me, the film finds its comic stride just often enough. Its off-handed homages to the movie comedies of earlier eras are part of its charm, but that, of course, might not be enough to win the interest of noncinephile audiences. Ω

Project Almanac

Found-footage-style sci-fi thriller about a group of friends who, after finding plans for a time machine, build one and soon find out that changing the past can have unforeseen consequences on the present. Cinemark 14, Feather River Cinemas and Paradise Cinema 7. Rated PG-13.

Foxcatcher

Nominated for several Academy Awards—including director (Bennett Miller), actor (Steve Carell) and supporting actor (Mark Ruffalo)—this biopic is loosely based on the events surrounding multimillionaire/ wrestling enthusiast John DuPont’s involvement with a pair of Olympic-champion brothers (played by Ruffalo and Channing Tatum). Paradise Cinema 7. Rated R.

A Most Violent Year

J.C. Chandor (Margin Call) wrote and directed this story of an immigrant man (Oscar Isaac) and his wife (Jessica Chastain) trying to make a go of it in crumbling, crime-ridden New York in 1981, one of the most violent years in the city’s history. Cinemark 14.

Into the Woods

Rob Marshall’s movie adaptation is nothing very special apart from it’s being a proficiently filmed record of the award-winning musical play written by James Lapine and Stephen Sondheim. The convergence of re-imagined versions of Cinderella, Little Red Riding Hood, Jack and the Beanstalk, Rapunzel, etc., might have been the occasion for a fresh approach to movie fantasy. It’s tempting to ponder what a director with more apposite skills and inclinations—Neil Jordan, Wes Anderson, Jane Campion—might have done with this material. What we do get includes a reasonably good cast: one true star (Meryl Streep) and a couple of others (Emily Blunt, Anna Kendrick) who may be truly on the rise, a couple of quirky juveniles (Lilla Crawford as Little Red Riding Hood, Daniel Huttlestone as Jack), some marquee names (Christine Baranski, Tracey Ullman) in smaller roles, ostensible male leads (James Corden, Chris Pine, Billy Magnussen) doing journeyman duty as unheroic, more-lunk-than-hunk princely types, and one bonkers, scene-stealing cameo (Johnny Depp’s Big Bad Wolf, a wolfish human disguised as a cat wearing hipster threads and a fox’s tail). Cinemark 14.

The Theory of Everything

At its best, this semi-saccharine biopic about theoretical physicist Stephen Hawking doles out some nicely understated combinations of misty-eyed romance and tough-minded drama. Eddie Redmayne gives a winning performance in the main role, but never really gets to push beyond the script’s studiously genteel comfort zone. The film is based on Jane Hawking’s book, Traveling to Infinity: My Life With Stephen, but even with Felicity Jones delivering a sweetly intelligent performance in the role, the overall characterization of Hawking’s first wife too often seems merely thin and decorative. The supporting cast (Emily Watson, David Thewlis, Simon McBurney, etc.) is very good, with Charlie Cox and Maxine Peake being especially effective as caregivers with extraordinary attachments to Stephen and Jane. The Wedding Ringer

Wild

Reese Witherspoon delivers a tough, smart performance in what for her is a somewhat atypical role.

Jean-Marc Vallée’s film version of Cheryl Strayed’s memoir of her transformative adventure in the wilderness holds her star power at something like arm’s length and builds a close-up sense of its protagonist through a combination of cinematic elements, including flashes of a kind of stream-ofconsciousness editing. Even in the occasional emotional eruption, Witherspoon maintains a calm intensity, and Vallée’s film matches that with the cool, rough beauty of its cinematography. Here the central characterization is a matter not only of what she says and does and sees, but also of the tentatively implied insights of those memory flashes and other fleeting associations. Much of the film is a straightahead account of the physical challenges of Cheryl’s arduous journey, with her spiritual revitalization portrayed partly through the cumulative effect of small, quietly telling moments and partly through deceptively casual gradations in Witherspoon’s performance.

enri was thrilled in early January when H he learned about the Snow Goose Festival to be held just last week. He imagined

how the different restaurants in town would participate. And B Street Public House would pair it with a special cocktail, developed just for the occasion. I could hardly wait.

Alas, none of this was to be. It turned out the Snow Goose Festival had nothing whatsoever to do with eating goose, but with looking at them. Alive. In “nature.”

Not only that, but you had to drive out into the cold and the wet and the wilderness to look at them!

Excusez-moi, but that is not Henri’s idea of a festival!

Festivals are for feasting!

Hellooo … ? Festival … feast. Can you say, “Same Latin root?”

So Henri headed down to the butcher shop and picked up a frozen 9-pounder and had his own private goose festival, merci beaucoups. Starting with a preheated oven and a delightful little pinot noir.

Cooking a goose is much like cooking any fowl, although with domestic goose, there’s one key difference: You have to poke holes in the skin and then precook it for 45 minutes to one hour to drain the fat.

Wild geese, on the other hand, aren’t as fatty and don’t need to be drained. They stay slim by getting all that exercise, flying hither and yon—as Dr. Epinards so savagely pointed out.

Henri’s cabbage-stuffed goose Ingredients: 1 goose, 9-11 lbs.

1 small head of green or red cabbage 1 apple (tart) 1 lemon 1 cinnamon stick 1/2 cup dried cranberries 1/2 cup vermouth Kosher salt Black pepper, fresh-ground

For the stuffing: Shred cabbage, steam to cook.

Dice the apple, zest the lemon, break the cinnamon stick in half and mix in large bowl with the cranberries and vermouth, keeping in mind Henri’s No. 1 rule of cooking: Feel free to be creative. The cinnamon stick

was a last-minute addition that occurred to me when I saw it in the cabinet beside the box of salt. Tres bon!

Preheat oven to 375. Remove giblets from cavity, and season generously inside and out with kosher salt and pepper. With carving fork (or wooden skewer, corn-cob holder, etc.), poke a couple of dozen holes in the skin, particularly at fatty areas (breasts and thighs), careful not to pierce the meat. Remove the wing tips.

Place the goose on rack in a roasting pan, and cook for 45 minutes to one hour, allowing fat to drain from holes in the skin. Remove from oven, pour fat into jar or tub, and allow goose to cool slightly.

Stuff cavity with cabbage mix and return to slightly cooler oven (350), tent with aluminum foil (which you will remove during the last half hour of cooking). Be sure goose is elevated from floor of pan on a rack as it will continue to drain fat. Cook about 20 minutes per pound (including the “precooking”), or until drumsticks separate easily. Remove from oven and allow to cool before carving.

Goose meat is robust and all dark and is delicious, plain or dressed with chutneys or fruit salsas. For side dishes, Henri likes mushrooms in rice (Lundberg Wild Blend), cooked with lots of butter, and a mixed-green salad with pine nuts and tangerine or mandarin sections. For a vegetable dish, try steamed asparagus and sliced yellow and orange bell peppers, dressed with a dash of balsamic vinegar.

The best wine to pair with goose is a pinot noir, although chardonnays, sauvignon blancs, gewürztraminers and rieslings also work well.

Note: Mon ami, Monsieur Deni, says the best part about cooking a goose is that you end up with all that excellent fat that can be used later for cooking.

It was a fitting scene, one that by not only marked the last exhibits of robert Speer the gallery after 11 years as one of Chico’s most exciting arts venues, r ober ts@ newsrev iew.c om but also served as a tribute to Maria Phillips, whose tireless enthusiasm was the driving force behind the review gallery. She succumbed to cancer on Final exhibits, Oct. 5, and her brilliant presence was Avenue 9 Gallery, now showing much missed, creating a bittersweet through Feb. 7. mood among many of the attendees.

Each was held in one of the gallery’s two rooms. As the titles suggest, they were fairly distinct group shows. I say “fairly” because several artists exhibited in both.

Group shows are like potluck dinners—you may not like everything on offer, but there’s usually plenty you will enjoy. That’s certainly the case here.

The wildlife show was juried by two artists and two nature lovers, so the overall quality is high. In the other room, longtime art lovers and collectors will recognize the names and work of Valerie Payne, Waif Mullins, Cynthia Sexton, Dolores Mitchell, David Mallory, Jim Woronow, Karma Ganzler, Candy Matthews, Lenn Goldmann and Doug Rathbun, all members of the Art Guild, the collective that put on most of Avenue 9’s exhibits.

Phillips was also a guild member, but that was the least of her commitments. She not only ran the gallery, she used it as a base for creating other art groups and events, such as ChiVAA, the Chico

Visual Arts Alliance, which sponsored the monthly ARTabouts (walking gallery tours) and the annual Springtime Art Fiesta at the Matador Motel. It was also her idea about eight years ago to hold an art exhibit in conjunction with the Snow Goose Festival.

Phillips was an immensely talented woman, an accomplished painter in her own right who also had a doctorate in art history. She gave up a tenured position at George State University, in Atlanta, Ga., to move to Chico to be closer to family. Here she became friends with Mitchell, another painter and art history teacher (at Chico State), and together they founded Avenue 9 in 2004. (Phillips later took over sole directorship.)

In all of this Phillips enjoyed the support of her husband, Bob Klang, the financial white knight behind his wife’s creative genius. Just as she worked without pay, he owned the building and donated it for use as a gallery—a contribution that he estimates cost him around $200,000 in lost rent over the years.

He sold the building soon after his wife died.

He did so, he tells me, because he didn’t want the responsibility for it and he didn’t see anyone in the guild who was able to replace her. Even if there were someone who wanted to do so, “I’m 81 years old,” he said. “I don’t want to be getting phone calls at night because there’s a problem at the building.”

His generosity continues, however. Several exhibits during the latter half of last year were financially successful, and he was able to donate the money earned—$20,000—to the campaign to name a room for Phillips at the Museum of Northern California Art (monca). Klang added another $5,000 from his own pocket, thereby raising half of the $50,000 needed to obtain the designation.

Reed Applegate, whose personal collection of Northern California art will form the initial permanent collection at monca, told me that about half of the $25,000 balance needed to match Klang’s donation has already been generated. Anyone who wants to contribute can send a check to monca, 900 Esplanade, Chico, Calif., 95926. There is nobody in Chico more worthy of having a museum room named after her than Maria Phillips. □

The Internet, GPS, DNA testing, and cities filled with security cameras are the new detective tools and perhaps that’s why the world’s greatest detective—no, not Batman, London’s own Sherlock Holmes—is enjoying a surge in pop culture. There’s a Sherlock for everyone—Robert Downey Jr.’s shirtless, slow-mo boxer; enough nerdy sexiness for all of BBC’s Cumberbitches; and Elementary’s female Watson. Yet none of these detectives carries the blessing of the estate of Sir Arthur Conan Doyle, the detective’s original scribe. That honor is reserved for Anthony Horowitz and his new novel, Moriarty. The story picks up following the events at Reichenbach Falls, where Holmes and his nemesis Moriarty disappear, and the book is filled with moody London alleys, colorful if not filthy characters, and plenty of references to the original Holmes canon. On its own, Moriarty is a clever mystery in a gentleman’s world. While the characters are shocked at the brutal methods of a new criminal gang fresh from the New World, the violent atrocities are tame compared to those of today’s 24-hour news cycle. Yet under Horowitz’s deerstalker hat, the understated violence—coupled with the reliance on simple clues, intelligence and perceptiveness over modern tech—seems all the more impactful for its simplicity.

The Last Southern Gentlemen Delfeayo Marsalis Troubadour Jass Records Trombonist Delfeayo Marsalis is the younger brother of trumpeter Wynton and son of New Orleans musical patriarch, the pianist Ellis Marsalis. He’s teamed up on The Last Southern Gentlemen with his father on a marvelously rendered collection of tunes that, as he writes in his copious liner notes, pay “tribute to the humanity and humility at the center of the Southern lifestyle that birthed America’s original music.” Accompanied by bassist John Clayton and drummer Marvin “Smitty” Smith, the foursome takes a mostly leisurely approach to the material. As Delfeayo writes, “our aim was to communicate a feeling of … relaxation and gentility.” “My Romance,” which opens with a very relaxed arco solo by Clayton, is an excellent example of the approach with yet another of Delfeayo’s magnificent muted theme statements. The lively trio version of “If I Were a Bell,” on the other hand, spotlights Ellis’ uptempo playing and shows that, at 79 (when this was recorded), he is still a force to be reckoned with. “I Cover the Waterfront” is a relaxed duet with his son that again evokes the care and feeling that make this CD the delight that it is. On the uptempo “Speak Low,” Delfeayo gives his mellifluous trombone a healthy workout with his dad in hot pursuit.

The return of Sleater-Kinney has been almost three years in the making. The trio’s not-so-distant memory was as fresh as wet paint to some and, for others, obscured slightly by the members’ other recent projects. But we knew it was coming. And the band—Corin Tucker, Carrie Brownstein and Janet Weiss—has done right by marking its return with an album of new material. No Cities to Love, the trio’s first record since 2005’s excellent The Woods, is less furrowed-brow angst and more apprehensive fun. The members are in different places in 2015, but that doesn’t mean there aren’t things on their minds. Tucker gets right to it on opener “Price Tag”: “It’s 9 a.m., we must clock in, the system waits for us,” she laments on America’s working-class struggle. Musically, Tucker and Brownstein’s wiry guitar work and Weiss’ busy drumming are sterilized by the John Goodmanson’s (who’s worked with S-K before) sparkling production. It’s immediately noticeable, but the band’s sneer and snarl remain— just more refined. If No Cities to Love seems a little less vicious than some of Sleater-Kinney’s earlier work, that’s because it is. But it’s an honest document. And that carries far more weight than mere raw power.

STOP WHAT YOU’RE DOING. This is important. The 1078 Gallery requires your immediate attention and assistance. We all know that the city of Chico is no longer investing in one of its most critical resources: art.

And for the 1078—the gallery that has been at the heart of Chico’s arts scene for 34 years—that means that if other forms of income aren’t generated, and soon, it will go away. Especially given the fact that Avenue 9 Gallery is already leaving us next month, it would be a crippling blow to Chico to lose such a vital, vibrant piece of its arts soul (go to www.1078.org and click on “history” then “past events” and get a load of what’s been produced there in the last three years alone).

Simply put, the gallery needs to host more events and needs to serve beer and wine at those events to make enough dough to keep the doors open. To facilitate this, they are applying for a permanent ABC license (the usual practice of getting temporary licenses on an event-by-event basis has become prohibitive), and since the City Council has to approve new filings, the 1078 will be asking council members at their Tuesday, Feb. 3, meeting to approve its application.

What can you do to help? Write a letter to the council telling them some version of what I’m telling them: The 1078 Gallery is critical to the health of Chico and recent cuts in funding have put the community resource in jeopardy. Since the city can no longer provide support, and since having beer or wine at art events is a reasonable thing for adults to do, approve their application and allow them to reasonably and responsibly raise money and thus be able to continue contributing to the health of Chico.

His “Workin’ Man Blues” comes through background speakers and drifts across the restaurant patio where a group of us are sitting and conversing about our jobs, working hard and our lives.

We are primarily a group of Realtors and we’re talking about the craziness of the real estate job, why we got into it, and what keeps us going.

The conversation evoked in me the memory of my old mentor KDV, when I first met him years ago, and I was considering a career in real estate.

“Real estate is a frog-kissing contest, babe,” he said back then. “Whoever kisses the most frogs wins.” He pantomimed holding a frog in his cupped hand, kissing long and passionately. “It’s not bad,” he said, “if you don’t mind the warts.”

KDV raised his finger in the air. “Real estate,” he said. “Where you work all the time, and sometimes you get paid!”

He pointed his cigarette at me. “But,” he said, “real estate is freedom! You get to choose which 16 hours a day you work.”

He told me the reason he was in real estate. “I lost my job as a psychic. I didn’t see that coming.”

This guy KDV was an encyclopedia of jokes.

“Listen,” he said, “you can work yourself to death in real estate.” He stopped, and just when I thought he was serious, he said, “But Realtors never die; they just grow ‘list-less.’”

“Seriously, babe,” he said, “As a Realtor, you meet incredible people, and you are in a unique position to help them in unbelievable ways.” I waited for the punch line, but there wasn’t one.

Back to this evening on the restaurant patio: A question is asked of the person among us who sells more real estate than the other five or six Realtors in the group combined. She works about 80 hours a week, and runs from appointment to appointment on a finely tuned schedule.

“What inspires you to keep working so hard?” she is asked.

“Today is a good example,” she says. “When I rang the doorbell of my new sellers, my third visit, and their 4-year-old daughter answered the door, she jumped up and down and screamed ‘She’s here! She’s here! It’s her!

It’s her!’ as if I were her very best friend in the whole world.”

She smiles and nods. “That’s what inspires me.”
