Arrests, not deaths How many unarmed black men have to die at the hands of the police before

our nation insists something is done about what appears to be a lack of accountability?

It’s impossible to know how many unarmed citizens—or people in general—are killed by cops each year, since there’s no comprehensive database. What we do know is that we can think of several such deaths off the top of our heads, including two high-profile incidents involving black men and white officers.

First, in July, a man named Eric Garner was choked to death by a New York City police officer. His crime: selling individual cigarettes. Garner resisted arrest, but was in no way violent. He cried out that he couldn’t breathe, but the officer continued his chokehold, asphyxiating the 43-yearold father of six. A witness captured the incident on camera, sparking conversations across the nation about excessive force.

And then, in August, a Ferguson, Mo., policeman shot and killed 18-year-old Michael Brown, another unarmed black man who’s become a household name. These deaths and a few others in recent months, including that of a 12-year-old, are holding the attention of our fickle populace, and have brought us to what feels like a tipping point on issues of excessive force, race relations, due process and a lack of transparency when it comes to the investigations of officer-involved deaths.

Protests—some peaceful, others not—from New York to Berkeley have taken place in the absence of grand jury decisions to indict the officers responsible for these killings. And now in Chico, this Saturday, there are plans for demonstrations (see “Protests come to Chico,” Newslines, page 8). We’re glad to hear about this local protest and see it as an opportunity to bring awareness to an array of issues, including a lack of training in appropriate procedures.

Nothing can bring Garner or Brown back, but we can think of many things the police could have done differently that would have resulted in arrests rather than deaths. Ω

Ferguson whispering he phone rang. The emails came. The question was TChico appropriate, understandable and predictable. What is the Peace and Justice Center doing in response to the

“verdict” in Ferguson? When is the rally, the demonstration, the action? CPJC Coordinator Olivia Schmidt and I sat together, in the midst of our grief and outrage, and quietly, seriously considered the moment.

A familiar moment.

To whom exactly would we address our complaint? To which head of the hydra would we register our disgust?

The prospect of traditional protest rang more and more hollow to me. The impulse to respond hovered there, but it floated above a persistent, quiet doubt. What public action would suffice to signal the true need? The true wound to be healed? The true work to be undertaken?

I listened for an answer over the next few days. I followed the news. I read the best analysts. I discussed with friends. I thought. I digested. I reflected. I felt.

In answer?

Unknowing. Inadequacy.

So again, the self-inquiry: Keeping distant company with Ferguson (how many Fergusons have we had?), what would happen if I held still in this space of unknowing? What if I gave myself over to an experience of the full measure of my inadequacy? And what if, collectively, we who seek justice in our broken and vicious society and world waited here within the pain? Nothing like the waiting for “a more convenient season” that Martin Luther King Jr. ruthlessly and rightly decried. A waiting on our own untapped courage. Enough of it to swallow whole, and finally, the deepest meaning of our dilemma—and the strictest acceptance of our long-unfinished assignment.

What cry, I contemplated, would our collective heart give voice to from such a place?

Beneath moving pictures of fires and media glare, I heard Ferguson whispering: Something else. Something else. It’s something you can’t see from inside that box you’ve come to depend on. It’s something else.

Higher ed’s burden Recent news of the University of California system seeking tuition increases

of 5 percent per year over the next several years is sad, but hardly surprising.

Continued and chronic underfunding of our state’s public universities has decimated our once excellent system of higher education. Although some funding is slowly being restored, the ability to pay for college at California’s public universities is rapidly escaping the grasp of all but the state’s wealthiest.

More than half of California’s college graduates leave school with an average of over $20,000 in debt, which makes these suggested tuition increases excessively burdensome. Where once Californians could expect a high-quality and inexpensive education, we now have at least two generations of college graduates who are weighed down by educational debt.

To increase this burden is to continue the foolhardy practice of mortgaging the future.

The bottom line is that failure to increase our contributions to the education of youth will result in the sort of long-term economic crisis from which we will find it difficult to recover. If students can’t afford school, they won’t contribute enough to the economy to support a retired older generation. That also means they won’t be able to save enough for their own retirements, and the crisis therefore becomes cyclical.

It is way past time to stop kicking that can down the road. Those of us who are educated and working must be willing to shoulder the responsibility for supporting the generation ahead of us and for educating the generation behind us. That’s the only way we can have a sustainable economy and a humane society. Ω

SECOND & FLUME

Strategy Last week, I weighed in on the first Chico City Council meeting with a conservative majority. It was fairly uneventful as far as policy-making goes, if you weren’t paying attention to the nuances. I was, and especially when it came to the two new members of the panel—Reanette Fillmer and Andrew Coolidge. Here’s more on what I took away: Fillmer came out swinging. After Sean Morgan nominated Mark Sorensen for mayor, rather than seconding the motion, Fillmer attempted to close the nominations (and was told that’s something the panel must vote on).

Minutes later, she spoke over the city clerk to “move to elect” Morgan as vice mayor. (Council members can only make nominations.)

But those gaffes are understandable. There’s a steep learning curve at the dais. And that’s not what concerns me. What I’m worried about is the new majority catering to monied special interests.

That brings me to Coolidge. His first motion as a councilman was to agendize discussion of Chico Scrap Metal, whose owner, George Scott, was convicted of environmental crimes—namely polluting the East 20th Street property housing one of his four scrap-metal operations.

Back in 2007, the Department of Toxic Substances Control found contamination including chromium, lead and zinc, and polychlorinated biphenyl (or PCB). The business sits immediately adjacent to an elementary school and across the street from environmental leaders Sierra Nevada Brewing Co. Scott pleaded no contest and was fined $700,000 by a Butte County Superior Court judge, and has since made several unsuccessful appeals. He also waged a campaign against District Attorney Mike Ramsey, who’d filed the charges against him. In 2010, Scott and other ax-grinders recruited Sacramento-based DUI attorney Lance Daniel to run against Ramsey. They formed a political action committee called Citizens for Economic Balance—and hired none other than our new councilman, Mr. Coolidge, as its public relations consultant. The Scotts paid Coolidge thousands of dollars during that failed attempt to unseat Ramsey, according to disclosures filed with the county clerk. I don’t know exactly what kind of PR Coolidge did, but Ramsey trounced Daniel, a carpetbagger who immediately left Chico.

It’s no coincidence that Kim Scott, George’s daughter and Chico Scrap Metal CFO, asked for discussion of the scrap metal yard on the night Coolidge and the other conservatives were sworn into office. She and her father are seeking an extension on an order to discontinue its operations—action related to the East 20th Street property’s noncomforming uses in that part of the city. They came at the eleventh hour. Could it be because they now have a friend on the panel?

In 2006, the City Council gave Chico Scrap Metal five years to move. In 2011, it received an extension of three years that ends this month. Somehow the Scotts have had eight years to comply and have had the money to pay lawyers for appeals in the criminal case. But they haven’t moved their business. I guarantee they will say it’s too expensive. Give me a break. It’s time for their business to go, and anyone who disagrees is not fit for public office.

Two for the trees “A canopy imperiled” (Cover story, by Tom Gascoyne, Dec. 4): Your cover story on tree advocacy is much appreciated.

When I see a picture of Mark Herrera, I am reminded of his act of civil disobedience— chaining himself to a sycamore slated for destruction. It is a very rare person who invites arrest and prosecution on principle. I remain inspired by his action. (In the same issue, there is a story about Chris Nelson, another such hero.)

I notice that our new sound walls—on the fattened section of Highway 99—are decorated with about a hundred precast concrete oak trees.

I’m not sure how many real trees were destroyed during construction, but I was simply elated to see that the massacre had been tenderly memorialized in a thousand-foot-long bas-relief.

This sort of thing reminds me of the buffalo nickel—first minted in 1913. It honored the American bison—which had been reduced in number from 60,000,000 to 750—along with the American Indian, a population decimated during a 400-year reign of terror.

In the unlikely event that humans can survive the destruction of all other life on the planet, I suppose we will commemorate the achievement with a suitably nostalgic Earth nickel.

Three more of Chico’s beautiful trees, a trio of majestic, heritage trees near the corner of Oleander and Memorial Way, are in jeopardy.

Chico Unified School District has announced plans to cut down the trees to make way for a new science building at Chico Junior High.

Teachers at Chico Junior chose a design that would have put the new building in close proximity to the existing science classrooms at the northeast corner of the school, making the sharing of equipment and movement of teachers between classrooms more convenient and efficient.

To the surprise of the science teachers, district personnel chose a more expensive design and plan to place the building far from the science department, on the opposite corner of the campus, where the three trees currently reside.

The reason: exposure—so that taxpayers can see how the bond money is being spent.

The trees will be cut down not out of educational necessity, not because of fiscal responsibility, but simply for political posturing.

I hope the school board will step in to protect the trees, the teachers and the students from this misguided choice.

If you have the “truth,” you tell it. If your evidence supports the “law,” you show it. If you’re covering up a massacre, then attack the victim’s family. If he has nothing to hide, Ramsey will give us the evidence. It is public information.

Mr. Ramsey says we are looking for an external force to blame for our son’s death. Vic was in a closed room, minding his own business, threatening no one. The police created a scene of terror, broke in, and attacked and killed him. All the violence in that room was brought in by an external force, the police. They are the external force that is to blame and should face the consequences.

Re “Predictability and generosity” (Second & Flume, by Melissa Daugherty, Dec. 4) and “Battle lines being drawn” (Newslines, by Robert Speer, Dec. 4): For 16 months, only after the liberals damn near sank Chico’s financial ship, did the liberals work with the conservatives?

What about the remainder of the 12 years liberals held the power on the council? Did they work harmoniously and share power with the conservatives?

Hell no, they didn’t. Even when they went on their drunken spending spree and the conservatives warned and pleaded for them to get a grip, they told them (audience members) to shut up and sit down. Next to go is Ann Schwab and Randall Stone, the most worthless council members of them all.

Sixteen months ago, in the midst of severe city financial problems, the liberal-majority City Council reached across the aisle and appointed conservative Councilman Mark Sorensen as vice mayor. During the recent City Council meeting, liberal council members again extended a nonpartisan hand by supporting Sorensen for mayor.

These demonstrations of nonpartisan politics are welcomed by most citizens of Chico, regardless of their political affiliation. This display of petty, selfish politics is a great disservice to our community and won’t be tolerated for long. The new conservative council members need to keep in mind that the votes they received represent a small percentage of Chico’s total population. The election is 1 month old and already it’s time for a change.

More on the Middle East Re “Peace for Israelis and Palestinians” (Guest comment, by Michael Leitner, Nov. 20): Michael Leitner, someone who studies and promulgates ways to lessen tensions in the Middle East, has provoked the ire of the local “Boycott Israel” crowd by daring to say something positive about that country.

I suggest it is time to give up the Palestinian victimhood narrative, a leftover from the Cold War, and move on. Stop treating the Palestinian Arabs as children who cannot be called to account for their actions.

For almost a century, the significant barrier to a negotiated peace has been Arab intransigence, aggression and antipathy toward other religious traditions—including “heretical” Muslims. The Palestinian Arabs are still being used as pawns by the Arab states that have kept them hostage for all these years through the incitement and manipulation of hatred. This is an energetic and talented people who need to get free of the murderous ideology that is the official policy of their woeful leadership.

They do not need enablers.

The UN counts 200,000 killed in Syria and 2.5 million as refugees. Israel has nothing to do with this carnage, aside from transporting wounded refugees to Israeli hospitals—incidentally, where Hamas leaders also go for treatment.

Many, if not most, American Jews have a desperate and nearly absolute need to believe in a just and righteous Israel.

Facts show Israel to be a brutal oppressor of the indigenous Palestinians. Understandably, the Palestinians react with violence. Nonviolence by Palestinians is met with violence by Israelis. Remember American Rachel Corey? She was bulldozed to death while trying nonviolently to defend a Palestinian home.

Israel has a right to live in peace. But to live in peace Israel has to work with Palestinians to find a just solution to sharing land, water and Jerusalem. Israel wants it all, and wants to crush the Palestinians into submission.

Michael Leitner has devoted years to actually working for peace in the Holy Land through coexistence activities between Israeli Jews and Palestinians. He continued his work this summer while under fire from Hamas rockets.

As Leitner points out, Israel withdrew from Gaza in 2005, forcibly evacuating many settlers, in the hopes of furthering the stalled peace process. The result, rather than peace, was Hamas’ rise to power, killing of rival Palestinians, and shelling of Israel. This summer, Israel responded with military action to 4,500 rockets that Hamas fired on Israeli civilians. In such a case, any nation has not only the right, but the obligation to defend its citizens. Israel takes extraordinary care to avoid civilian deaths, but when war is deliberately waged from among civilians, as by Hamas, there will always be terrible casualties.

I am heartbroken for the parents and grandparents, children and spouses, who have been caught in this conflict over so many years. Heartbroken as well as for the seemingly forgotten Arab victims throughout the Middle East, in conflicts with no relationship to Israel. Rather than the scorn shown by opposing letters (some reasonable and some rambling), let’s all resolve, like Leitner, to work for peace.

Butte County District Attorney Mike Ramsey is warning citizens about a new debtcollection scam that’s being used here and throughout the country.

According to a press release, the DA’s office has received complaints that scammers posing as PG&E representatives are calling residences and demanding immediate payment for debts owed. But that’s only one version of the scam. In others, callers have identified themselves as members of the IRS or a local law enforcement agency— demanding money and threatening arrest.

The calls seem to be coming from local lines, but are actually from computergenerated numbers that falsely give that appearance. The scam has been reported as far away as New York and Texas. Ramsey encourages the public to be suspicious of callers seeking money—and even donations—by phone. Citizens should never provide the caller with personal information.

On Tuesday (Dec. 9), the Butte County Board of Supervisors unanimously authorized spending nearly a half-million dollars toward the added costs of code enforcement anticipated with the recent passage of Measure A, a stricter medical marijuana cultivation ordinance than the county formerly had in place.

Director of Development Services Tim Snellings explained that reduced sizes of grow areas and relaxed limitations on who can file complaints likely will lead to more calls for service. Snellings asked the board to allocate $446,500 from the general fund for contingencies, including money for additional personnel, vehicles and an educational campaign called “Stay in the Box” to inform growers of new regulations. Of the money allocated, $30,000 is budgeted toward instituting an online, cellphonefriendly complaint system.

About 60 percent of Butte County voters approved Measure A in November.

NOT THAT KIND OF BANKNOTE

Chico police are looking for a gray-haired man who robbed Umpqua Bank on Pillsbury Road Monday (Dec. 8).

The alleged thief (pictured) entered the bank just after noon and handed a clerk a note that demanded money and indicated he was armed, though no weapon was bared during the robbery, according to a Chico Police Department press release. The clerk complied and the robber ran away, taking with him an undisclosed amount of cash. A search of the area was fruitless.

The suspect is described as a mustachioed white man between the ages of 55 and 65, of thin build, and wearing spectacles at the time of the robbery. Anyone with information pertinent to the robbery is encouraged to call the Chico Police Detective Bureau at 897-5820.

“I got inspired about how things are going and then just seeing the reaction of the people,” he said. “So I just … started to recruit people and ask them to help pass the word.”

Davidson, who moved to Chico 12 years ago from Salt Lake City, is behind the small contingent of protesters who’ve carried signs downtown in recent weeks, receiving car-horn beeps from supporters and middle-finger flip-offs from detractors.

But while protests over the high-profile deaths of Michael Brown in Ferguson, Mo., and Eric Garner in New York City have turned violent in many U.S. cities, the reaction in Chico has been low-key. Brown was shot by Ferguson Police Officer Darren Wilson and Garner died after he was placed in a chokehold by New York City Police Officer Daniel Pantaleo.

Davidson said the cases, particularly Garner’s, are troubling.

“It just shows the lack of care for people of color,” he said. “I think the background story is

more of what people care about than the crime itself.”

Janiel Hardman, standing alongside Davidson recently with a sign in his hand, said he, too, felt a need to make a public statement.

“We’re not violent,” he said, “but we’re not being shy, either.”

Davidson said they’ve received positive responses from pedestrians.

“We’ve had a few people come up and just grab signs and say, ‘I’m inspired by what you are doing,’” he said. “It’s just about awareness. I want people to know that we are conscious of it and we want change and we are willing to do something.”

In addition to the small City Plaza protests, there are plans for a march along The Esplanade into downtown starting at 1 p.m. Saturday (Dec. 13), followed by a protest in the plaza at 4:30 p.m. Like Davidson’s efforts, both events are being promoted via social networking; as of Wednesday morning (Dec. 10), 134 people had posted that they would take part in the march and another 304 said they would attend the rally downtown.

Ulsh, 20, is a graphic designer who said he is of Indian descent and is a member of the LGBTQ community.

He said via email that he formed the march as a “much-needed response from everyone in Chico, and all across America, to the rampant racism and police brutality that exists in America.”

These things aren’t just happening in places like Ferguson, he said.

“Police brutality and racism are issues that people of color—especially the black community—face right here in Chico every day,” he said. “And that system can be brought down through awareness and accountability for our police force here in Chico. We are hoping to shut down The Esplanade with the march to make Chico realize that this change must happen.”

He emphasized, however, that the march would be peaceful. On the event’s Facebook page, he writes: “Please do not start any violence or disruption to the businesses/homes we will be passing.”

something like this,” said Ranalla, 19, who moved to Chico from Lake Tahoe with her family 10 years ago. “The Ferguson verdict came out and I was watching the news and just seeing everything that was going on—the anger and the sadness. I was just sitting there so upset that there was nothing I could do, and that the people in Chico couldn’t express their feelings.”

So she started a Facebook page, which has received considerable response.

“I only invited about 60 of my friends and it just took off from there,” she said.

That number jumped into the hundreds a few days later. The city has approved a permit to allow the gathering in the park.

“In my junior year of high school I was kind of taught that, despite what is said about the younger generation, we still have a voice,” she said. “We kind of have an obligation to speak up.”

At one point, Ranalla posted on her Rally for Justice Facebook page that she was planning on inviting Chico Police Chief Kirk Trostle to address the park protesters. But that resulted in a backlash of comments by some who said inviting the police was wrong.

“I refuse to participate in a protest to end the violence and racism at the hands of police officers that then provides a platform and microphone for police officers,” said one commenter.

“This is inappropriate and naïve.”

Chico Police Officer Peter Durfee, who is head of the Chico Police Officers’Association, said no matter the circumstances, loss of life is always a tragedy.

“It’s something a police officer has to live with the rest of their life,” he said. “We know this is something we might have to do in our job, which is to protect the general public.”

Durfee said he couldn’t comment on the cases that have sparked a national debate.

“I don’t know the specifics because I wasn’t there,” he said. “Those who want to comment don’t know the facts.

Was it justified or not? That is up to a grand jury to decide.”

He said he had spoken with some of the local street protesters, including a woman who told him he was “a pretty nice guy.”

“You know, 95 percent of us are pretty nice guys,” Durfee said.

Street protest organizer Davidson said he does not expect immediate results from the effort.

“Hopefully,” he said, “40 years from now, things will have changed.” Ω

Santa versus supervisors Home health workers stage protest over labor negotiations Mrs. Claus and about a half-dozen elves paid an unexpected S(Dec.anta, visit to the Butte County Board of Supervisors on Tuesday 9), not to spread good cheer, but rather to demand county

officials immediately open labor negotiations with home health care workers.

The costumed men and women, who stood and held up signs as the supervisors called for a five-minute recess at about 9:40 a.m., were not-so-jolly In-Home Supportive Services (IHSS) workers and the union that represents them, California United Health Care Workers.

IHSS is a state program that pays caregivers to help keep lowincome elderly, blind and disabled individuals who would otherwise need full-time care living at home. Butte county IHSS workers are currently paid minimum wage.

The union has charged the county will not meet with them to negotiate a new contract, while the county contends the 2012 implementation of the Coordinated Care Initiative transferred collective bargaining duties to the state (see “Caregivers’ conundrum,” Newslines, Nov. 20).

However, the Coordinated Care Initiative initially only affected eight California counties, did not include Butte and has never expanded to include more. The union filed a fair labor practice complaint with the state Public Employment Relations Board in October.

The board replied Dec. 2, informing all parties that the county must respond to the complaint within 20 days and meet union reps at an informal conference in Sacramento on Jan. 6.

“The compliant is like an indictment, in that [the county] can wait and they can stall and they can insist on a formal hearing, but why do they want to do that?” said Lois Kugelmass, a union negotiator who helped organize the demonstration.

Kugelmass said the union chose to stage Tuesday’s action because the board would be discussing how to proceed in dealing with the union and with the Public Employment Relations Board complaint in closed session that day. Public comment on items not listed on the meeting’s agenda is limited to the end of the public meeting, after most observers have left, and Kugelmass said the home health care workers would not have been heard at all unless they took such drastic measures.

“It’s up to them if they want to play naughty or nice,” Kuglemass continued, keeping with the theme of the theatrical protest. “They

have a choice of whether they want to continue on their course and keep wasting time and money on lawyers and legal fees, or meet us and bargain in good faith.”

Connie Graham, who dressed as Mrs. Claus for the demonstration, is

the union’s statewide second vice president and has been a home health care worker for the past 13 years. She explained that, though many people use the IHSS program to take care of their own family members, she and some other workers are assigned to other consumers.

“We are doing some of the same work as nurses and nurses’ assistants,” Graham said. “We go in every day and change diapers, give people meds, do wound care and perform lots of other duties. For them to treat us like ‘glorified babysitters,’ as we’ve heard some people in this county refer to us, is very hard.”

Graham explained the hours allocated for consumers’ care are generally insufficient and constantly being cut, with an 8 percent acrossthe-board decrease last year. This means IHSS workers perform the same amount of duties in fewer hours, and Graham said some caregivers continue to work, unpaid, to provide adequate care.

“We don’t get time off, or overtime, or paid holidays, and we’re paid poverty wages,” she said. “It’s time for [the county] to renegotiate.”

According to Supervisor Steve Lambert, the county is finally ready

to—as Kugelmass put it—“play nice.”

In a phone interview after Tuesday’s closed session, Lambert said the supervisors now realize the state has not and will not assume control of bargaining with the union, and said the county will open up negotiations after the beginning of the new year.

“In all honesty, this was never a matter of trying to be dismissive, we just wanted to do the fiscally responsible thing and make sure it was our responsibility,” he said. “Now it doesn’t look like the state will get involved, so we’re ready to work on some positive movement.”

Chico State, or at the Humboldt Avenue Skate Park. “When I was 16, I got arrested for riding at the skate park,� he recalls. “I went down to the jail, got fingerprinted, got put in a holding cell for a minute. ... I had to go to a gang violence class for eight hours on a Saturday. “I was like, ‘Dude, I’m not trying to be in a gang, I’m trying to ride my bike!’�

Now 22 and a professional mountain bike racer, Warner says that, for as long as he can remember, Chico’s needed a public place “for kids to dork around on their bikes.� As he is well aware, bikes aren’t allowed at the skate park, and while there are races at the Silver Dollar BMX track, many kids “don’t thrive in that competitive environment,� he said.

That’s why Warner is spearheading the construction of a pump track—a looping dirt course of banked turns and rollers that allows riders to carry their momentum without pedaling. Warner’s proposal for the 240by-180-foot track in the northernmost corner of Wildwood Park received final approval from the Chico Area Recreation and Park District on Nov. 20, and will be completed next spring.

Warner envisions the pump track becoming a hub for the mountain bike community at the doorstep of Upper Bidwell Park. “You’ll be able to take the bike path directly to the pump track and see if anyone wants to go for a ride in Upper Park, or just mess around until someone shows up,� he said. “It’s going to be special.�

The last time the CN&R caught up with Warner

(see “Jumping all in,� May 23, 2013), he was beginning his first professional season in an emerging mountain biking discipline that combines the speed and skill of downhill racing and the endurance of long-

distance, cross-country riding—enduro.

Warner said his top-10 finish in an Enduro World Series event at Winter Park in Colorado that year was a “big breakthrough.� Going into this season, his goal was to rank among the top three riders on the North American Enduro Tour. “I knew I had it in me, knew I could win if I did the right things,� he said.

Warner’s first-place finish in Aspen, Colo., in June made him the youngest rider to win a race on the North American circuit, and it was no fluke—he remained in first place overall through the last race of the season. “So, I was, like, a national champion this year,� he said with a laugh. “The ultimate goal is to win the In action: Enduro World Series, Catch the premiere of The Rise of Enduro , so this is a huge step featuring Kyle Warner, in the right direcat Sierra Nevada’s Big tion.�

S

tanding at the corner of Third and Main streets, Jon Scott pointed to dilapidated awnings and ugly signs in the windows while commenting on the number of times he’s had to step over people sleeping on the sidewalks there.

“There is a problem downtown and somebody needs to do something about it other than talk,” Scott said.

He’s ready to do just that. Scott has proposed to turn this dingylooking corner spot—most recently occupied, albeit briefly, by Jimmy Jack’s Rib Shack—into a card room with seven poker tables.

Adjacent to that spot, in the space where 33 Steaks, Booze & Jazz first set up shop, he wants to put in a restaurant, which would serve food and beverages to patrons of the card room as well as those in its own dining area.

Unfortunately for Scott, despite overcoming some large hurdles on the state licensing front, he’s encountered opposition locally. In October, the Planning Commission decided to recommend against changing the zoning for downtown to allow for a card room. That discussion will move to the City Council on Tuesday (Dec. 16).

“While we are in agreement that the 303 block of Main Street is in dire need of revitalization, we do not think that a Card Room is the right mix for our downtown core,” says Melanie Bassett, Downtown Chico Business Association executive director, in a letter addressing the project.

tor Mark Wolfe agreed—his department also recommended that the zoning not be changed. He noted that card rooms are allowed elsewhere in the city.

“What it comes down to is, what do we want, as a community, our downtown to be—one that includes card rooms or one that doesn’t include card rooms?” he said. “Historically, the community didn’t feel that that was an appropriate use in our downtown.”

For Scott, neither Bassett’s nor Wolfe’s reasoning is good enough to deny the potential revitalization of one of downtown Chico’s most vacant blocks. A few doors down sits the now chain-linked remains of The Underground and Towne Lounge. Catercorner from the proposed card room is the beautiful—but empty, at least on the ground floor—Grand View building.

Officials, including the Chico Police Department, also have expressed concerns about adding another alcohol-related business to the area. In response, Scott said his plans are for the restaurant to serve only beer and wine—no liquor— and that it will close by 11 p.m.

Scott charges that the real opposition isn’t about alcohol, however.

All the talk about a card room “not being the right fit” or “not being appropriate for downtown” comes down to one thing: intolerance.

“They think gamblers are lowclass—‘We don’t want those people around us,’” Scott said. “But poker playing has become a sport akin to pool—people who don’t

play think it’s done in the back of a smoky room, but really it’s analytical, it takes skill. People watch it on TV and they follow their favorite players.”

Wolfe acknowledged that gambling does have a negative reputation.

“Culturally it has some stigma attached to it,” he said. “That’s widely known.”

Local businessman Jon Scott has grand plans to open a card room on the derelict corner of Third and Main streets.

Scott is no stranger to running a

card room. In the 1990s, he opened Casino Chico in part of what’s now the DownLo. A few years later, he relocated to Nord Avenue, but the location, plus the relatively new popularity of tribal gaming, led him to close up shop in early 2000.

Not long afterward, the state imposed a moratorium on card room licenses, the only exception being if you held an active license on Jan. 1, 2000. In 2011, however, the law changed and Scott wasn’t properly notified.

With the help of legal counsel, Scott was able to reapply for his gaming license, and it was granted last summer. Since then, he’s been working on plans for the Main Street businesses, which he says will employ about 50 people. In his proposal to the city, he outlines some deal-sweeteners, as well: a self-imposed 8 percent gross revenue tax to be used toward public safety and a $7,000 table tax for the Chico general fund.

“I want to do something incredible for this city,” he said.

“If we’re going to do some management, we need to do some thinking about what wilderness means,” Logan said.

And in the end, with temperatures projected to rise beyond even worst-case scenarios, microrefugia and beetle resistance might prove temporary.

Polly Buotte, a graduate student at the University of Idaho, has modeled beetle outbreaks, whitebark pine mortality and projected temperatures. The warming signal, she said, is “pretty clear.”

“We as a society need to reduce emissions or these refugia are just going to become hospices for whitebark pine,” □ she said.

among a whitebark pine forest. And if you’ve hiked in the Rockies since 2009, you’ve likely hiked through a dead and dying forest, felled by a widespread outbreak of the mountain pine beetle.

At a recent scientific conference near the northern boundary of Yellowstone National Park—the world’s first national park—biologists cited climate change as a major driver. From the 1980s to today, temperatures have only gone one direction: Up. The death is a major concern for conservationists, biologists and public land managers, for the whitebark pine supports the entire ecosystem. Bears, jays and other forest creatures depend heavily on pine seeds for their diet.

Without the seeds, biologists fear what’s called a “trophic cascade,” in which the entire food chain shifts as a primary producer drops out.

Hit hard “The whitebark pine is both a foundation and a keystone species,” said Jesse Logan, a retired U.S. Forest Service entomologist. “The health of the whitebark pine is very closely related to the health of the entire ecosystem.”

area the size of South Carolina sprawling for 31,000 square miles across Montana, Wyoming and Idaho, has been hit particularly hard by the beetle outbreak. Since 2009, more than 95 percent of the large trees in the region have succumbed to pine beetles. Closer to home, in the Sierra Nevada, the whitebark pine have fallen victim to the mountain pine beetle.

The primary driver “We view this as the stage-setting event that has allowed more beetle events,” said David Thoma, a National Park Service ecologist studying factors behind the beetle outbreak. “Temperature is the primary driver.”

Warmer temperatures allow the beetles to overwinter. Until the late 1990s, winter temperatures in the high country were inhospitable. Thirty years of warming has left whitebark pines exposed to a threat they rarely saw.

Not all news is bad, however.

Some trees have proved resistant to outbreaks. Others grow in pockets, or “climate refuges,” that for various reasons have protected trees from the beetles.

Thoma sees such areas—also known as “microrefugia”—as essential for any management efforts going forward.

“The concept of microrefugia is reason for hope,” Thoma said. “This is particularly important for managing the landscape in the new beetle norm.”

And the prehistoric, or “paleo,” record offers some clues that the tree is hardier than researchers suspect. Charcoal and

ancient pollen records suggest the niche space needed by whitebark pine is much larger than models estimate.

An ancient record Assessing lake sediment cores from the region reaching 15,000 years into the past, a Montana State University team found whitebark pines more abundant despite higher summer temperatures and fire frequency than today.

“In the warmest periods, the whitebark pine was really pretty happy,” said Cathy Whitlock, MSU director of the Montana Institute on Ecosystems who led the research team.

“The paleo perspective gives you really good insight,” she added. “We look a lot at the present ... but it doesn’t give you perspective to look at climate change.”

Logan isn’t so confident. An entirely new temperature regime could impair the species’ ability to return as it has after past beetle outbreaks. “It’s hard to image that these forests are going to recover in any sort of a meaningful time frame,” he said.

A breeding program U.S. Forest Service researchers are breeding trees resistant to drought and blister rust, another affliction destroying stands. The agency planted almost 350 acres of rust-resistant whitebark pine in the greater Yellowstone ecosystem this year, part of an ongoing 15-year effort to help the species, said Mary Frances Mahalovich, a Forest Service geneticist.

Goodbye, palm trees

Burl master For the last 20 years, Albert De Silva has been on the hunt for good burls. A growth or anomaly that forms at the base of a tree, a burl’s interior is valued for its spectacular wooden patterns that, once veneered, are mainly used to design car dashboards, furniture and craft pieces. Although De Silva has traveled throughout the States in search of a good tree, he primarily does business around Northern California, and is drawn to Chico for the “variety of walnut orchards.”

Last Spring, he got his (first) 15 minutes of fame when he was featured on National Geographic’s reality show Filthy Riches, which spotlights people who make their living harvesting various natural resources. To find out more about De Silva’s work, visit burlboyz.com

How do you find burls?

Twenty years ago you could see burls sitting on the top of the ground. Now that’s more scarce because there are fewer orchards. You have to make an educated guess if a property has a good burl. When orchard trees are deteriorating, that’s a good candidate for buying a burl. When a farmer agrees to sell their tree, we take a pull truck or back hoe to get the tree out. Sometimes we use a helicopter.

How much can you make?

You can sell a medium- to lowgrade burl for a $1.50 a pound.

High-end burls can sometimes sell for $3 to $4 a pound. And the burls can weigh several thousand

pounds. With the costs involved, you sometimes break even. Sometimes you make money, but the burl business isn’t a glamorous job. You can make money if you work at it every day, but you have to do it every day.

Whom do you sell to?

I also work with Phil Aldridge and Ivan Hoath at Westgate Urban Hardwoods in Durham. I extract the burls and they turn the pieces into table slabs and walnut floorings to be sold elsewhere.

Typically, when a new business comes to town, you hear all about the great economic benefits it will bring—new jobs, increased tax revenue, the kinds of quantifiable outcomes that boost the local economy and meaningfully contribute to the city’s financial standing.

But how many new businesses come in and literally uproot a decadesold source of contention?

The building now occupied by Marie Callender’s at the Chico Mall parking lot on East 20th Street is slated for demolition, and a new building approved for that site is going to be home to two tenants—both new to Chico and both food-related, I’m told. I mentioned in a previous column that one is probably Panera Bread. The other is still under wraps.

I’m sure both businesses will bring jobs and money to the city. But I know there’s a strong Chico faction that will find one tidbit about the arrival of the businesses more compelling than the dollars and cents.

The building plans, which were approved last week by the Architectural Review Board, included removing existing trees.Yes, those trees.The palm trees.

When the Marie Callender’s building was first approved 25 years or so ago, plans indicated that sycamores were to be planted around the restaurant, but palm trees were planted instead. I chatted with Irv Schiffman last week, who was chair of the ARB at the time, for a quick history lesson on the matter. He said he felt intentionally misled by the applicant back then, and when the palms were planted instead of sycamores, he spearheaded efforts to try and block Marie Callender’s from receiving its business license. From there, a firestorm ignited.

The landscaping became the “infamous palm trees,” as city Associate Planner Greg Redeker referred to them last week, and the brouhaha has stayed in the midst of community conversations ever since.

Schiffman’s association with the palms has remained paramount too.

He said one friend sent him a picture of a Marie Callender’s location in Hawaii a few years back. Strangely enough, it was landscaped with sycamore trees. Another friend called during a massive wind storm in Chico years ago, saying they thought the palm trees were going to topple.

Schiffman’s daughter, by the way, is named Tamar, meaning palm tree in Hebrew.

Schiffman has never set foot in Marie Callender’s, but with new businesses coming in, and the old trees going out, it may just be time for him to turn over a new leaf on the matter. Schiffman did half-jokingly ask if Panera Bread was a fan of palm trees.

Since both tenants will be new to town, there are only two options when it comes to Marie Callender’s: The restaurant will either relocate or pull out of Chico. It was noted that with the ARB approval, building demolition is planned for early next year. Again, get those pies while you can.

Speaking of the New Year, Chico Mall representatives announced this week that rue21—a popular teen fashion retailer—is coming to the center in February.

I said, “Absolutely,” and the next day a film crew was there. I took them to Chico to scout out a potential burl. I didn’t think I was going to get that burl, but I did. We made $5,000 off that tree, and it ended up being one of our best episodes. We did eight shows, some in Napa, Utah and Oregon.

The show also had [segments] with people working with eels, ginseng, mushrooms and bloodworms, and I did the burls. After the show would air, my phone would ring off the hook ... I’d get people calling from all over the States telling me about their unique types of wood.

THE PULSE MEDI-CAL FOR IMMIGRANTS?

President Obama’s recent executive action on immigration has prompted Gov. Jerry Brown’s office to consider extending Medi-Cal to undocumented immigrants in California.

In November, Obama announced his plan to allow up to 4 million undocumented immigrants who have lived in the U.S. for more than five years and have no serious criminal record to apply to avoid deportation. But under federal law, those individuals are not eligible for health benefits through the Affordable Care Act, according to California Healthline.

While speaking at a recent Public Policy Institute of California event, Nancy McFadden, a policy aide to Brown, said the governor’s administration is considering expanding health coverage to immigrants affected by the executive action—potentially covering up to 1 million people—but noted that associated costs will factor into the decision.

California has experienced its largest outbreak of pertussis, or whooping cough, in about 70 years, according to a report from the Centers for Disease Control and Prevention.

As of Nov. 26, 9,935 cases of whooping cough had been reported in California—about 26 cases per 100,000 people—with the highest incidence among Hispanic infants, at 207 cases per 100,000, according to California Healthline. The high rate among infants was likely because they’re too young to be vaccinated; despite recommendations that pregnant women in their third trimester receive the pertussis booster shot, only 17 percent of mothers whose infants were later infected had received it.

Infants, along with the elderly, are most susceptible to complications due to whooping cough. Of the 347 hospitalizations related to pertussis in California this year, 275 involved children younger than 1 year old.

OF THINGS THAT SUCK

While proponents of the Affordable Care Act would have you believe that shopping for health insurance is a breeze, most Americans say it’s as pleasant as doing taxes or having a tooth filled, a survey finds.

In a Bankrate Health Insurance Pulse survey, about three-quarters of respondents said sorting through complex health plans is the same or worse than doing their own taxes or being stuffed into the middle seat of an airplane, while 64 percent said it’s worse than having a tooth filled. Furthermore, respondents were more likely to have a sour opinion of shopping for health care if they’d actually done it within the past three years.

The results are reflective of the general public-opinion issues Obamacare has faced since its implementation, despite gains made over the past year, such as extending health coverage to millions of Americans.

t’s not your grandma’s hospital “IThat’s anymore.” how John Harris, chairman of the

board at south Butte County’s medical center, encapsulates far-reaching changes over the past few years at his hometown’s venerable institution.

Most conspicuous is the name: BiggsGridley Memorial Hospital is now called Orchard Hospital.

The facilities have undergone facelifts, giving both the main hospital and rural health clinic a more contemporary look.

The most significant differences, though, may be less apparent. The board, foundation and administration agreed to invest heavily in updating particular pieces of equipment, most notably for diagnosing and monitoring patients, while following the government mandate of converting to electronic health records. In addition, the organization adopted a new operational philosophy, the Studer model, which emphasizes (among other things) customer service in health care.

So, when Harris thinks of the hospital whose board he joined 40 years ago, soon after setting up his law practice in Gridley, he says: “It really is brand new in an old building.”

Orchard Hospital just recently announced another major change: the hiring of a top administrator. Steve Stark, chief executive officer of a comparably

sized medical center in Iowa, will take the reins from Orchard interim CEO Jim Opdahl at the start of 2015.

Stark happens to be a “Studer Champion”—trained in implementing the system Orchard has chosen. He did so at his current hospital, Palmer Lutheran Health Center, where he also oversaw expansions in facilities and services.

Speaking by phone from Iowa, Stark said one of his first projects will be to expand Orchard’s emergency department.

Overall, he wants to ensure that the hospital doesn’t find itself in the same situation it faced around 2000, when it merged with the Rideout system in Marysville/Yuba City. Gridley regained control in 2009.

“My goal would be to keep it independent as long as possible,” Stark said. “I think we need to strengthen our financial position; we have to get physicians who

admit [specifically to the hospital], and we have to keep our skills at the highest possible level while maintaining [a positive] patient experience.

“Often hospitals our size affiliate when they have to…. Things would have to get really bad for that to be an option on the table for the board to approve again.”

Stark sees encouraging signs, such as the recent investment in diagnostic services and outpatient care—coming during a period of growth in demand for emergency services.

Tracy Atkins, Orchard’s chief nursing officer and chief operating officer, says the ER’s traffic has nearly doubled in three years, going from 500-550 patients a month in 2011 to 800-900 a month currently. Thus, the need for an expansion—and one of the reasons Stark said he’s “counting down the days” until he assumes his new role.

is considered a critical-access hospital, which affords it government support but also limits its size. It has 45 beds total (24 of which are in-patient).

Harris sees an opportunity for Orchard to serve as “a boutique hospital.” If, for instance, a patient needs to get more specialized treatment at a larger hospital, he or she then will come back for follow-up care. “I’d like this to be a place they feel is their medical home,” he said.

Atkins agrees. Orchard brings in specialists for weekly visits. Not all specialties are covered, though, and not all patients can match the schedule. By expanding the offerings for diagnostics—such as imaging and cardiac stress tests—community members can get tests locally even if they need to travel for other appointments.

The medical center now has a mobile MRI unit and mobile CT scanner. It added a new radiology table, plus ultrasound, mammography and DEXA (bone-density) equipment. All heart monitors and vital-sign monitors were replaced.

The list goes on.

“The community has invested a lot into our facility,” Atkins said.

“There’s been a lot of investment in equipment and upgrades and just making this a nice place for patients to want to come to have their care.”

idea for a new name, which the hospital unveiled in 2013. It met with some resistance—residents of Biggs and Gridley were (and are) instrumental in keeping their community-supported hospital alive, so why strip their towns from its title?

“We have a lot of competition around here,” Atkins explained.

“We provide a service to this community, but we didn’t want to shortchange ourselves if there was a niche service that we can offer here as far out in surrounding communities as we possibly could….

“For us, it was fresh, it was a clean slate, and it gave us the opportunity to feel like, with all the new changes that we made and all the upgrades we made, that we’re a new hospital. We had an opportunity to put on a new face and ask people to try us again—or try us for the first time again.” Ω

Our oceans are acidifying—even if the nightly news hasn’t told you yet.

As humanity continues to fill the atmosphere with harmful gases, the planet is becoming less hospitable to life as we know it. The vast oceans absorb much of the carbon dioxide we have produced, from the industrial revolution through the rise of global capitalism. Earth’s self-sacrifice spared the atmosphere nearly 25 percent of humanity’s CO2 emissions, slowing the onslaught of many severe weather consequences.

Although the news media have increasingly covered the climate weirding of global warming—hurricane superstorms, fierce tornado clusters, overwhelming snowstorms and record-setting global high temperatures—our oceans’ peril has largely stayed submerged below the biggest news stories.

The rising carbon dioxide in our oceans burns up and deforms the smallest, most abundant food at the bottom of the deep blue food chain. One vulnerable population is the tiny shelled swimmers known as the sea butterfly.

In only a few short decades, the death and deformation of this fragile and translucent species could endanger predators all along the oceanic food web, scientists warn.

This “butterfly effect,” once unleashed, potentially threatens fisheries that feed over 1 billion people worldwide.

The top 10 stories mainstream media overlooked in 2014 Since ancient times, humans fished the oceans for food. Now, we’re frying ocean life before we even catch it, starving future generations in the process. Largely left out of national news coverage, this dire report was brought to light by a handful of independent-minded journalists: Craig Welch from the Seattle Times, Julia Whitty of Mother Jones and Eli Kintisch of ScienceNOW. It is also the top story of Project Censored, an annual book and reporting project that features the year’s most underreported news stories, striving to unmask censorship, self-censorship and propaganda in corporate-controlled media outlets. The book was released in late October.

“Information is the currency of democracy,” Ralph Nader, the prominent consumer advocate and many-time presidential candidate, wrote in his foreword to this year’s Project Censored 2015. But with most mass media owned by narrow corporate interests, “the general public remains uninformed.”

Whereas the mainstream media poke and peck at noteworthy events at single points in time, often devoid of historical context or analysis, Project Censored seeks to clarify understanding of real world issues and focus on what’s important. Context is key, and many of its “top censored” stories highlight deeply entrenched policy issues that require more explanation than a simple sound bite can provide.

Campus and faculty from over two dozen colleges and universities join in this ongoing effort, headquartered at Sonoma State University. Some 260 students and 49 faculty vet thousands of news stories on select criteria: importance, timeliness, quality of sources, and the level of corporate news coverage.

The top 25 finalists are sent to Project Censored’s panel of judges, who then rank the entries, with ocean acidification topping this year’s list. (For the entire list, visit www.projectcensored.org/category/ top-25-censored-stories-of-2014.)

“There are outlets, regular daily papers, who are independent and they’re out there,” said Andy Lee Roth, associate director of Project Censored. Too many news outlets are beholden to corporate interests, but Welch of the Seattle Times bucked the trend, Roth said, by writing some of the deepest coverage yet on ocean acidification.

“There are reporters doing the highest quality of work, as evidenced by being included in our list,” Roth said. “But the challenge is reaching as big an audience as [the story] should.”

Indeed, though Welch’s story was reported in the Seattle Times, a mid-sized daily newspaper, this warning is relevant to the entire world. To understand the impact of ocean acidification, Welch asks readers to “imagine every person on earth tossing a hunk of CO2 as heavy as a bowling ball into the sea. That’s what we do to the oceans every day.”

Computer modeler Isaac Kaplan, at the National Oceanic and Atmospheric Administration office in Seattle, told Welch that his early work predicts significant declines in sharks, skates and rays, some types of flounder and sole, and Pacific whiting, the most frequently caught commercial fish off the coast of Washington, Oregon and California.

“It’s not as dramatic as, say, an asteroid is hitting us from outer space,” Roth said of this slowly unfolding disaster, which is likely why such a looming threat to our food chain escapes much mainstream news coverage.

Journalism tends to be more “action focused,” Roth said, looking to define conflict in everything it sees. A recently top-featured story on CNN focused on President Barack Obama’s “awkward coffee cup salute” to a Marine, which ranks only slightly below around-the-clock coverage of the president’s ugly tan suit as a low point in mainstream media’s focus on the trivial.

As Nader noted, “‘important stories’ are often viewed as dull by reporters and therefore unworthy of coverage.” But mainstream media do cover some serious topics with weight, as it did in the wake of the police officer shooting of Michael Brown in Ferguson, Mo. But the changes caused by ocean acidification are gradual. Sea butterflies are among the most abundant creatures in our oceans, and are increasingly born with shells that look like cauliflower or sandpaper, making this and similar species more susceptible to infection and predators.

“Ocean acidification is changing the chemistry of the world’s water faster than ever before, and faster than the world’s leading scientists predicted,” Welch said, but it’s not getting the attention is deserves.

“Combined nationwide spending on acidification research for eight federal agencies, including grants to university scientists by the National Science Foundation, totals about $30 million a year—less than the annual budget for the coastal Washington city of Hoquiam, population 10,000.”

Our oceans may slowly cook our food chain into new forms with potentially catastrophic consequences. Certainly 20 years from now, when communities around the world lose their main source of sustenance, the news will catch on. But will the problem make the front page tomorrow, while

there’s still time to act?

Probably not, and that’s why we have Project Censored and its annual list:

Top 10 U.S. aid recipients practice torture

Sexual abuse, children kept in cages, extra-judicial murder. While these sound like horrors the United States would stand against, the reverse is true: This country is funding these practices.

The U.S. is a signatory of the United Nations’ Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, but the top 10 international recipients of U.S. foreign assistance in 2014 all practice torture, according to human rights groups, as reported by Daniel Wickham of online outlet Left Foot Forward.

“During our visit, held during a fierce storm that hit the state, attorneys met detainees who described to them a shocking picture: In the middle of the night dozens of detainees were transferred to the external iron cages built outside the IPS [Israel Prison Service] transition facility in Ramla,” the Public Defender’s Office wrote, according to The Independent.

The next top recipients of U.S. foreign aid were Afghanistan, Egypt, Pakistan, Nigeria, Jordan, Iraq, Kenya, Tanzania and Uganda.

All countries were accused of torture by human rights groups such as Amnesty International and Human Rights Watch.

Kenyan police in Nairobi tortured, raped or otherwise abused more than 1,000 refugees from 2012 to 2013, Human Rights Watch found. The Kenyan government received $564 million from the United States in 2013-14.

Corporate Internet providers threaten net neutrality

This entry demonstrates the nuance in Project Censored’s media critique. Verizon v. FCC may weaken Internet regulation, which Electronic Frontier Foundation and other digital freedom advocates allege would create a two-tiered Internet system.

Under the FCC’s proposed new rules, corporate behemoths such as Comcast or Verizon could charge entities to use faster bandwidth, which advocates say would create financial barriers to free speech and encourage censorship.

Project Censored alleges corporate outlets such as The New York Times and Forbes “tend to highlight the business aspects of the case, skimming over vital particulars affecting the public and the Internet’s future.”

Yet this is a case where corporate media were circumvented by power of the viral Web. John Oliver, comedian and host of Last Week Tonight on HBO, recently gave a stirring 13-minute treatise on the importance of stopping the FCC’s new rules, resulting in a flood of comments to the FCC defending a more open Internet. The particulars of net neutrality have since been thoroughly reported in the corporate media.

But, as Project Censored notes, mass media coverage came only after the FCC’s rule change was proposed, giving activists little time to right any wrongs. It’s a subtle but important distinction.

Trans-Pacific Partnership, a secret deal to help corporations

The Trans-Pacific Partnership is like the Stop Online Piracy Act on steroids, yet few have heard of it, let alone enough people to start an Internet campaign to topple it.

Despite details revealed by Wikileaks, the nascent agreement has been largely ignored by the corporate media.

Even the world’s elite are out of the loop: Only three officials in each of the 12 signatory countries have access to this developing trade agreement that potentially impacts over 800 million people.

The agreement touches on intellectual property rights and the regulation of private enterprise between nations, and is open to negotiation and viewing by 600 “corporate advisors” from big oil, pharmaceutical and entertainment companies.

Meanwhile, more than 150 House Democrats signed a letter urging President Obama to halt his efforts to fast-track negotiations, and to allow Congress the ability to weigh in now on an agreement only the White House has seen.

Many criticized the secrecy surrounding the TPP, arguing the real world consequences may be grave. Doctors Without Borders wrote, “If harmful provisions in the U.S. proposals for the Trans-Pacific Partnership (TPP) agreement are not removed before it is finalized, this trade deal will have a real cost in human lives.”

FBI dismisses plot against Occupy as NSA cracks down on dissent

Nationally, law enforcement worked in the background to monitor and suppress the Occupy Wall Street movement, a story the mainstream press has shown little interest in covering.

A document obtained in a FOIA request by investigative reporter Dave Lindorff from the FBI office in Houston, Texas, revealed an alleged assassination plot targeting an Occupy group, which the FBI allegedly did not warn the movement about.

From the redacted document: “An identified [DELETED] as of October planned to engage in sniper attacks against protestors (sic) in Houston, Texas if deemed necessary. An identified [DELETED] had received intelligence that indicated the protesters in New York and Seattle planned similar protests in Houston, Dallas, San

Antonio and Austin, Texas. [DELETED] planned to gather intelligence against the leaders of the protest groups and obtain photographs, then formulate a plan to kill the leadership via suppressed sniper rifles.”

Lindorff confirmed the document’s veracity with the FBI. When contacted by Lindorff, Houston Police were uninterested, and seemingly (according to Lindorff) uninformed.

In Arizona, law enforcement exchanged information of possible Occupy efforts with JPMorgan Chase CEO James “Jamie” Dimon, according to a report by the Center for Media and Democracy titled Dissent on Terror. The CEO meant to evade possible protests, and local law enforcement was happy to help.

Law enforcement’s all-seeing eyes broadened through the national rise of “fusion centers” over the past decade, hubs through which state agencies exchange tracking data on groups exercising free speech. And as we share, “like” and “check-in” online with ever-more frequency, that data becomes more robust by the day.

Ignoring extreme weather connection to global warming In what can be responded to only with a resounding “duh,” news analyses have found mainstream media frequently report on severe weather changes without referring to global warming as the context or cause, even as a question.

which even mentioned climate change. National news outlets have fallen on the job as well, as The New York Times recently shuttered its environmental desk and its Green blog, reducing the number of reporters exclusively chasing down climate change stories.

Unlike many journalists, ordinary people often recognize the threat of our warming planet.

Back in September, over 400,000 protested in the People’s Climate March in New York City alone, while simultaneous protests erupted across the globe, calling for government, corporate and media leaders to address the problem.

“There is a huge mismatch between the magnitude of the challenge and the response we heard here today,” Graca Machel, the widow of former South African President Nelson Mandela, told the United Nations conference on climate change.

“The scale is much more than we have achieved.”

U.S. Media hypocrisy in covering Ukraine crisis

The U.S. battle with Russia over Ukraine’s independence is actually an energy pipeline squabble, a narrative lost by mainstream media coverage, Project Censored alleges.

Russian President Vladimir Putin has drawn fire from the media as a tyrant, without complex analyses of his country’s socio-economic interests, according to Project Censored.

As the media often do, they have turned the conflict into a cult of

personality, talking up Putin’s shirtless horseback riding and his hard-line style with deftness missing from their political analysis.

As The Guardian UK’s Nafeez Ahmed reported, a recent U.S. State Department-sponsored report noted “Ukraine’s strategic location between the main energy producers (Russia and the Caspian Sea area) and consumers in the Eurasian region, its large transit network, and its available underground gas storage capacities,” highlighting its economic importance to the U.S. and its allies.

“We chose David because he had intention. He knew how he wanted to use the tools here,” said IFL co-founder Jordan Layman. For Cedeño, the lab’s laser cutter was an attractive new device for perfecting the acetate stencils he uses to complete the application of his acrylic and spray-paint based pieces. “It’s been a dream come true to play around with that machine. I was using an X-Acto knife before,” he said.

Cedeño’s IFL residency will culminate with his Transpositions exhibit, which opens at the lab on Saturday, Dec. 13. “I’m hoping to have 30 completed paintings by then,” Cedeño said before a recent stencil-making workshop he conducted at IFL as he showed off the fruits of his residency—some completed, others awaiting finishing touches—scattered around the grounds of the lab. While some canvases stretch as high as 6 feet, even the small 5-by-7-inch paintings were easy to spot with their bright color palettes.

“I’ve had a long-running theme of using psychedelic colors and neons,” Cedeño said. “Even as a kid, I’d raid my dad’s farm spray cans and thought it was so cool [that] I could play with fluorescent.”

Heavily inspired by comic-book designs and “character-driven graffiti of the ’90s,” Cedeño said his style is “still evolving.” But music remains a recurring theme in most of his works, including

those making up Transpositions, which features vivid portraits of various musical instruments and DJs, mixed with “organic life forms,” such as one with neon green frogs sitting atop a trumpet.

“Music is inside us. That’s what artists and musicians tap into—that emotional vein that runs through us,” he said. “An ongoing obsession of mine is exploring what it is that makes a DJ’s sound unique to them, just like any other artist has their signature.”

It’s fitting, then, that most of his works were inspired by (and sometimes created during) live concerts, which Cedeño claims were conducive environments for making new work. “During my traditional training, the spray paint and comic-book styles were discouraged because galleries aren’t falling over themselves to get that kind of work, but the festival circuit was made for that.”

As Cedeño’s most recent workspace, IFL has been another invaluable place for growing his creative process. “It’s a learning club of art geeks who can get together and play with these toys and techniques.” Although he’s studied and worked professionally in places like San Francisco and Los Angeles, Cedeño noted the difficulty in finding collaborative opportunities in the big cities. “That’s one thing that’s missing in a lot of artistic communities—a meeting place to exchange ideas. Chico is fortunate enough to have an established maker-space with a creative energy.”

While harnessing that energy to finish his latest series, Cedeño also found extra time to teach two IFL workshops, both on basic stencil-making. “I think it’s our responsibility to impart what we’ve learned onto others, so they can take it and run with it,” he said.

Inspired by Layman and fellow IFL founder Erin Banwell’s lamps made using the laser cutter, Cedeño has also created his own collection of wooden lamps that will be shown alongside his paintings during Transpositions. Clearly, the Chico program’s worked out well for him. “They asked me how long I wanted to stay and I said, ‘Are you kidding? I could stay here forever if you let me.’” Ω

Heartwarming reading of classic Christmas tale

CIt’sChristmas story, rivaled only by Frank Capra’s a Wonderful Life and (perhaps) Jean Shepherd’s harles Dickens’ A Christmas Carol is the iconic

A Christmas Story on the list of holiday entertainments we’ve all seen roughly once a year on stage or the big or by little screens for as long as we can Carey remember. That being the case, Wilson presenting A Christmas Carol on stage becomes more a matter of REVIEW nuanced delivery than innovative A Christmas Carol: storytelling. We all know the basic Being a Ghost Story of story of miserly, bitterly selfish Christmas, now Ebenezer Scrooge’s ghost-guided showing at the Blue Room journey of transformation into a Thursday-Saturday, kindly and generous benefactor of 7:30 p.m., Sundays, the poor. And since no surprises 2 p.m., through can be imposed upon the basic plot Dec. 21.

The current Blue Room Theatre production wisely goes directly to Dickens’ original text for its version of the story, and has Dickens himself (played by Steve Swim) read it to us from his armchair as the 30-person cast—drawn from the Blue Room’s Young Company as well as some of the adults who regularly grace the main stage—re-create the actions and speeches of the characters. This third-person narrative style is quite effective at conveying Dickens’ storytelling skill, and enhances the simple stage setting with the richness and humor of his language. The small portion of the set holding only a doorway and a tiny bed where Scrooge (Nick Anderson) begins his journey to redemption becomes, via this narrative technique, “a gloomy suite of rooms, in a lowering pile of building … where it had so little business to be, that one could scarcely help fancying it must have run there when it was a young house, playing at hide-and-seek with other houses, and forgotten the way out again.”

It’s here where Scrooge encounters the ghost of his former partner, Marley (Tony Daum), bedecked in chains and mournfully intoning his lamentations and forebodings. And it is from here that this Ghost 32

of Christmas Past conveys to Scrooge a vision of his younger self (Jackson Indar) enjoying books as a solitary schoolchild who is rescued from solitude by the advent of his loving sister, Little Fan (Caitlen Comendant).

The scene of the holiday ball at the offices of Scrooge’s former employer, Fezziwig (John Davis), is a riot of costumes, music and dancing, populated by cheerful youngsters as well as the Santa-like Fezziwig and his cheery wife (Tasha Forks). Some of the youngsters’ speeches were blurred into inaudibility by the volume of the background music, but it didn’t detract from the sense of fun.

The fun grinds to a halt when Scrooge is guided through a vision of his young adult self (Travis Crowley) losing the love of his betrothed when she perceives that his priorities have changed from romance to avarice, and is then shown a vision of her fulfilled and wealthy life as a happy mother of several children.

Deposited back in his lonely room, Scrooge is joined next by the Ghost of Christmas Present (Elaina Dart), who guides him to the iconic scene of his impoverished employee, Bob Cratchit, at home with his wife and several children, including the crippled waif, Tiny Tim (Bliss Kozielski), as they cheerily prepare for their humble holiday feast. Cratchit’s heartfelt toast to his employer, and the astringent reply of his wife (Sharon DeMeyer) regarding Scrooge’s stinginess and mean-heartedness provide the flame that begins to melt the miserly heart before Scrooge is borne off to view his young nephew offering equally charitable views of his uncle.

A child in the audience next to me found the Ghost of Christmas Yet to Come (John Davis) frightening, and I couldn’t blame him, as (in Dickens’ words) “… it was shrouded in a deep black garment, which concealed its head, its face, its form, and left nothing of it visible save one outstretched [skeletal] hand.” The vision it points to—of the aftermath of his own unlamented death—provides the straw that heals the camel’s back, as it were, and from there the story surges to its inevitable, cathartically sentimental climax, leading Scrooge and the audience into a manic outburst of fellow-feeling as he showers generosity upon his formerly scorned social underlings. Ω It’s a feeling worth having, and sharing.

The American Plate: A Culinary History in 100 Bites Libby O’Connell, the History Channel’s chief historian and historic-food expert, traces America’s cuisine—and, by extension, much of the world’s modern culinary trends—by selecting individual ingredients and iconic dishes that have symbiotically shaped our nation.

Run the Jewels 2 Run the Jewels Mass Appeal RTJ2 turns a revolutionary spark into a fullblown inferno with a symphony of scuzzy post-industrial sounds and the Black Panther-like frustrated aggression of the apocalyptic anti-hero duo made up of Killer Mike and El-P. Dissonance is embraced on opening track “Jeopardy,” and sonic discord sets the tone as Killer Mike, who superbly embodies the societal fears of black men in America, growls: “I’m up at midnight/I’m dippin’ off in my Nizz-ikes/A gun and metal pizz-ipe/And knizz-ife is to my rizz-ight/I’m lurkin’/Servin’ on pussies who lack a purpose/I got ’em filled up with frizz-ight/Like Mizz-ike is you alrizz-ight?” Oversaturated with disdain for the oppressively racist, sexist and immoral messages endlessly pumped into every societal orifice by popular culture and hip-hop posers, RTJ2 is a brutal reaction to the brutality. RTJ is joined by Rage Against the Machine’s Zack de la Rocha on “Close Your Eyes (and Count to Fuck),” a song that gets to the heart of a growing anti-establishment sentiment permeating beneath the societal façade and paints a dark picture of life in America: “I can’t even relax without sirens out in the distance … With clips in the bottom/We dippin’ from Gotham/Yes, eclipsed by the shadows/A dark dance to the coffin.”

Sophisticated Lady Sophisticated Lady Yarlung Records Sophisticated Lady is four guys—J.J. Kirkpatrick, trumpet/flugelhorn; Misha Bigos, piano; Gary Wicks, bass, and Andrew Boyle, drums—who met at USC during their graduate studies. Their CVs include work with Manhattan Transfer, Stevie Wonder, Chick Corea, Diana Krall and Plas Johnson, to name just a few. The music is rich and very fresh sounding, thanks to Yarlung Records, an audiophile label that chose to record the CD in a specially constructed concert hall at USC. They open with a lively rendition of Jerome Kern’s “I’m Old Fashioned,” which could also serve as Yarlung’s motto, as its use of an “analog recorder with tube circuitry” epitomizes its “minimalist approach” to this album. Two Duke Ellington numbers, “Isfahan” and “Sophisticated Lady,” get terrific treatments from Kirkpatrick and Bigos. The rhythm section performs flawlessly throughout, especially on the two trio selections. Eight of the 12 tunes are written by the group and their music is more cerebral than foot-patting, especially “Fields of Kurdistan,” a ruminative solo featuring the pianist, whose composition it is. A production mix-up resulted in Bigos’ “Ropes of Sand” (a peppy Latinate number with its composer moving into high gear) having its title switched with “Strange Fruit” (which gets a very strange interpretation).

The show has featured everyone from Chuck D to Russell Simmons talking about their work, lives and hip-hop journeys, and one of the most recent episodes featured the story of producer/emcee/and hip-hop professor 9th Wonder (who has taught classes on hip-hop at Duke University and Harvard). Combat Jack’s interview is captivating as 9th Wonder chronicles his individual evolution as an artist, noting, among other things, how his original rap crew, Little Brother, accidentally provided a blueprint on how to build an online following that then-unknown emcees like Drake and Childish Gambino employed before exploding onto the mainstream stage. It’s not a stretch to say that 9th Wonder probably played a role in schooling your favorite emcee and, through his role in academia, is now schooling the next generation of hip-hop scholars.

Whether it’s in a nighttime bedNot rated. room, or in Amelia’s car in broad daylight, the Babadook is as creepy as creepy gets when he manifests himself. We see him a little bit here and there, but mostly, we hear him. His voice is something you won’t enjoy listening to. It’s akin to that awful, crushed-throat croaking from Ju-on (the Japanese horror franchise).

Kent gets most of her scares through the use of sound and things we aren’t seeing. I’m usually more of a “Show me the monster!” kind of horror geek, but I’m totally OK with how Kent crafts this film.

We do see the Babadook (including the chilling illustration of him in the children’s book), but he’s more of an off-screen thumper than an on-screen menace.

Still, there’s just enough of him to satisfy us “show the goods” critics.

Davis’Amelia is either a sympathetic victim of a monstrous force, or the worst movie mother since Piper Laurie’s religious fanatic in Carrie. It all depends on how you take in the movie. If the Babadook is real, then Samuel’s screaming tantrums are well-founded, and Amelia is blameless. If the Babadook is simply Amelia’s way of justifying a hatred toward her misbehaving son, well, that just makes things that much scarier.

Davis gives us a portrait of a mother under extreme stress, weakened by her state of mind and perhaps unable to cope with her child. The role requires a lot of screaming, and she has a scream that goes into the Horror Movie Hall of Fame. She also has a moment where she is simply looking through a window that I truly wish I wasn’t remembering right now.

Much credit goes to Wiseman, a 7-year-old with major chops making his screen debut. While Davis and Kent get a lot of credit for what works in the movie, this film wouldn’t be half of what it is without Wiseman. He’s a natural for sure, and he does “scared shitless” like a pro. He handles the more grounded scenes well, too, with much of the result being utterly heartbreaking.

When things really get rolling, Kent’s film has echoes of genre classics like The Exorcist, A Nightmare on Elm Street and Poltergeist without being derivative. She’s an extremely capable director, but I’m not sure I want her making any more horror movies, because the next one might kill me. I say this in the most complimentary way possible.

The Babadook currently has a limited theatrical release, but can already be streamed online through iTunes and at Amazon.com.

And horror fans, in case you are wondering if a Mister Babadook actually exists, preorders are under way at thebabadook.com ($60, plus $20 shipping).

Yes, the freaky pop-up book in the movie is soon to be a real thing. Give the gift of nightmare fuel this Christmas. Ω

The classic Frank Capra holiday flick, with Jimmy Stewart starring as George Bailey, a man whose life is saved thanks to a Christmastime miracle at the hands of a friendly angel. Two showings: Sunday, Dec. 14, 3 p.m. and Saturday, Dec. 20, 3 p.m. Pageant Theatre. Not rated.

Nightcrawler

The title may smack of some kind of slimy horror film, but Dan Gilroy’s Nightcrawler, with Jake Gyllenhaal in the title role, is mostly a nocturnal character study with a darkly satirical edge to it. And the slime in this case is metaphorical, while the chief horrors are moral and psychological.

The nightcrawlers of this tale are the freelance photojournalists who deal in sensationalistic video footage of crime scenes, traffic smash-ups, and any local calamity gory enough to grab the attention of TV broadcasters. Gilroy’s movie puts primary focus on one Louis Bloom (Gyllenhaal), a perversely adept newbie who finds a market for his lurid footage in Nina Romina (Rene Russo), the news director at a ratings-starved TV station. Gyllenhaal is superb with a character who seems nerdy and naive even when his actions have lethal consequences. Bloom is thoroughly enterprising and industrious as well as habitually indifferent to an ever-growing list of moral, ethical and legal distinctions, and ultimately he seems more like a satirical concept than a fully realized human character. But the concept and the satire have some very sharp and brilliant edges. Pageant Theatre.

of telekinetic powers in Keaton’s character—pass without comment or explanation.

But mixtures of realistic grit and occasional tremors of the supernatural are integral to the whole of Birdman, which soon takes spectacular flight in several forms—a bizarre and somewhat convulsive backstage comedy, a high-spirited psychodrama couched in terms of comic-book imagery, a fantasy within a fantasy that is both deadly serious and exuberantly playful. The voice of “Birdman” (a movie superhero he once played) is in Keaton’s head early on and we can hear it too. Eventually, he’s also present as a kind of ogre in a superhero costume. By then it seems fairly evident that he’s maybe the most tenacious and troubling of the several alter egos swirling around the protagonist. All of these elements are seemingly in play as the film reaches its mysterious and multifaceted climax. We’re left to make what sense of it we can, or will. But before you get to that, Birdman is an immensely entertaining film. Cinemark 14. Rated R —J.C.S.

The Hunger Games: Mocking jay, Part 1

While it takes a step back overall from the rousing prior chapter, this is still a sturdy installment. After being rescued at the end of Catching Fire, shortly after destroying the Hunger Games for good, Katniss Everdeen (Jennifer Lawrence) is taken underground to join the rebellion. Rebellion President Alma Coin (Julianne Moore) wants to use the reluctant Katniss as a propaganda tool to inspire the masses against the Capitol and its evil leader, President Snow (Donald Sutherland). Katniss is getting a little grouchy at this point, exacerbated by the fact that Snow has imprisoned Peeta (Josh Hutcherson) and is using him as a propaganda tool as well. In exchange for their help in rescuing Peeta, Katniss agrees to assist with the resistance and be their “Mocking jay.”

Part 1 is obviously the result of taking the final novel in the popular Suzanne Collins series and splitting it in half. Yes, more movies equal more dollars, but I certainly didn’t feel like the material was being stretched out in a detrimental way like, say, what’s happening with the Hobbit movies.

This film has plenty moving it forward, and I like where it ends. Cinemark 14, Feather River Cinemas and Paradise Cinema 7.

shortsighted jerks. Investing virtually no money in the arts—a mere $25,000 for community funding, which includes social-service groups—is dumb. It doesn’t take an economist to realize that someone coming to town to see Chico Performances’ Mavis Staples concert at Laxson Auditorium next month (Jan. 16) is going to drop some coin into our merchants’ pockets. And ask the Winchester Goose, Amigos de Acapulco, Chico Natural Foods and Leon Bistro if they would be better off with or without the five concerts and one art opening happening at the nolonger-city-funded 1078 Gallery over the next week? Do what’s right and smart. Spend a teeny-tiny percentage of the general fund budget on art. Make people happy, and make some money for the local economy while you are at it: win-win. Sincerely, Arts DEVO. P.S. And kick down some extra skrilla for parks and trees, too. The city’s logo is a freakin’ tree, for crying out loud.

OK, maybe it’s not a good idea for me to be the one writing a letter to the council about all this (but seriously, it really is just a drop in the bucket, and only a fool would choose not to see the benefits).

It’s probably better to look to the members of the Chico Arts Commission to compose a letter, which they are currently doing in anticipation of the council’s next meeting on Tuesday (Dec. 16). In addition to encouraging the city’s investment in the arts, the commission also is making a case for itself, since the previous council had suggested that its role be revised—perhaps including removal as an officially appointed organization—in light of the present lack of funding. Current Arts Commission Chair Muir Hughes (who is resigning next week after four years of service on the commission) sent me a rough draft of the letter to be read, and in it, the commissioners waste no time getting to the heart of why its role as city arts adviser should remain intact: “Keeping the commission linked to the city is critical to the opportunity for resident participation in a facet of city government that oversees one of our strongest economic drivers…. the arts!”

They also will go on to explain how investment in the arts during such tough times can be a key to economic recovery as it attracts artsgoers and tourists to spend money in our local businesses, and that other cities are recovering from the recession and counteracting blight by doing so. The draft letter ends with: “We are the guardians of a significant resource and our work is essential in ensuring its continued health and growth in our city. The arts provide countless and varied opportunities for positive community engagement for our residents. We encourage the council to consider their support of the arts as we move towards a brighter future.”

I support that. I encourage all arts lovers to show up for the meeting Tuesday and do the same.

CANCER (June 21-July 22): No other

structure on the planet is longer than the Great Wall of China. It’s not actually one unbroken span, though. LOVE’S REAL ESTATE Price Fix A little lady shot past me and down the hallway of my open house. She glared at me from time to time as she zoomed from room to room, muttering “heh!” and “bah!”

I caught up to the little lady in the backyard, where she stood with fists on hips, scowling as if she were surveying a landscape so foul it could be the county dump.

“Just a regular old house,” she said, “and you’re charging a king’s ransom for it!”

The truth is, the house was a tad over-priced, but that was the seller’s idea, not mine.

“You Realtors keep raising the prices on these houses to where a regular person can’t even buy one!”

I heard the front door slam. I excused myself from the angry little lady, and went back in the house, where I came upon my mentor, the wise and wily KDV.

I told him a lady accused me of raising home prices. I neglected to tell him she was still here at the house.

The little lady skittered in and stood behind KDV, unseen by him, with her fists on her hips, scowling.

I nodded toward her surreptitiously in an attempt to clue KDV in, but he raged on, unaware of her presence.

The little lady stomped around from behind KDV. Caught off-guard, he hopped a foot in the air. She stuck her finger in his face and screeched, “You’re a nincompoop!”

“The very one,” I said. His shoulders sagged.

“Rule number 4507, grasshopper: Never shoot your mouth off.”

“Anyway, babe,” he added, “that lady is wrong about fair market value. But she’s right about one thing.”
