This isn’t Ferguson The so-called “offense/incident report” released this week by the police

department in Ferguson, Mo., following the officer-involved shooting death of an unarmed teenager earlier this month only serves to further the community’s doubt that lethal force was justifiable.

That report should provide the public a window into the circumstances surrounding Officer Darren Wilson’s decision to repeatedly fire at Michael Brown, the 18-year-old would-be college student who was laid to rest earlier this week. The department released the report only under threat of a lawsuit, and aside from a time and location of the incident, it contains little else.

What it should hold is a narrative of the incident as it unfolded, through witness accounts as well as a statement by Wilson. The document demonstrates the department’s willful lack of transparency and raises suspicions, whether real or imagined, of a cover-up scenario.

This, of course, follows law enforcement’s overkill approach to dealing with the demonstrations in this small, mostly black Midwestern town with a police force composed mostly of whites. Unfortunately for those who asserted their First Amendment right to assemble, criminals took advantage of the situation, looting area stores and assaulting police. Most of the protests remained peaceful, however, and did not warrant dispersing tactics that included tear gas, rubber bullets and armored vehicles.

We were troubled by the militaristic response to the unrest in Ferguson, and we’re troubled now by the increasingly militarized law enforcement we’re seeing the nation over, including right here in Butte County. A recent New York Times tool mapping the distribution of surplus military gear underscores how heavily armed our local law enforcement agencies have become (see staff writer Ken Smith’s story on page 8).

Aside from the obvious, another of the disconcerting points to this giveaway of government gear is that it happened under the radar. The Times learned of the data only through a Freedom of Information Act request.

The CN&R was not aware local agencies had received such donations that, among other things, have equipped every Chico Police Department squad car with an M-16.

Ferguson and its neighboring communities have been the recipients of the military largesse, too. There, in the case of the recent protests, the result wasn’t pretty. In addition to the tear-gassing and other heavy-handed tactics, we watched a particularly disturbing video of an officer from a St. Louis suburb pointing an assault rifle at nonviolent demonstrators and other citizens, including journalists. That officer, now identified as police Lt. Ray Albers of St. Ann Police Department, also threatened to kill the protesters, and when asked his name, responded with an expletive.

Cops like him are a liability to their departments and pose a danger to the public. Albers lost sight of the duties of his job: to protect and serve the public, not to intimidate and endanger the citizenry. He’s been suspended and ought to lose his badge.

On the run-up to deadline Tuesday afternoon, the CN&R learned about a Butte County Sheriff deputy’s alleged use of excessive force in Oroville.

Video of the incident shows only part of an altercation between the deputy and an African-American man named Terry Collins. In the footage, which does not have audio, Collins appears to be complying with an order to sit down on the ground. However, Deputy Sam Burnett proceeds to kick Collins in the side of his neck or face.

A press release from the Butte County Sheriff’s Office says Collins was refusing Burnett’s order to lie on the ground. We don’t buy it. There are only a few seconds between the time Collins sits to the impact of the deputy’s foot. An investigation is in the works, and we expect it to be rigorous. Butte County isn’t Ferguson, and it’s incumbent upon our law enforcement leaders to keep it that way. Ω

Don’t forget him I can’t stop thinking about James Foley, the freelance journalist killed by ISIS. It’s been about a week since the extremist group released footage of his beheading. I’ve struggled for days to wrap my mind around his tragic and brutal death. I’m still at a loss.

Most newspapers and TV outlets around the country have run stories accompanied by photographs or video of Foley and his executioner in the minutes before the murder—the journalist clothed in some sort of orange frock and his hooded captor draped in black. CNN made a big to-do about how it was not showing any of the video on TV or online. The network did, however, air still photos from the video taken several minutes before the execution, as well as audio of his captor’s voice.

The New York Post, though, has been roundly criticized for running on its front page a picture of the jihadist holding a blade to Foley’s throat. The headline: SAVAGES! A description I agree with entirely. While I’m unnerved by all of the photos and the video, and I’m probably in the minority here, I don’t disagree with the Post’s decision to run the photo.

Foley died in a most horrific manner and I think showing the knife touching his neck drives that point home. In this day and age, his murder would otherwise be quickly forgotten. A few days ago, I tried to bring myself to watch the full video. I’d read that Foley’s parents had seen it, and I reasoned that, as a journalist, getting a full scope of what happened there required me to see it, too. I couldn’t do it. What I’ve imagined is bad enough. That’s my rationalization at this point.

Foley is survived by a loving family, his parents and four siblings. Then there’s a whole world of reporters, myself included, who admire the grit it took to be a correspondent in one of the most dangerous regions on the planet. We won’t forget him.

Speaking of stand-out reporters, Kjerstin Wood, a former CN&R intern, is about to graduate from Northwestern University’s Medill School of Journalism, Foley’s alma mater. Wood applied for our internship back in 2012, and what impressed me most about her wasn’t her newspaper experience but rather her life experience, which includes putting herself through Chico State’s undergraduate program in 3 1/2 years.

Wood’s a smart and eager journalist. I look forward to watching her career develop in the coming years.

Two views on banners Re “Military banner issue punted” (Downstroke, Aug. 21): I support the intent of Chico Military Heroes to create a sense of pride and comfort for the friends and families of men and women active in military service. But is spending $80,000 to display 500 banners with a photograph of each Chico service member the best means of recognition?

I suggest another way to spend the money.

Nearly 50,000 Iraq and Afghanistan veterans were either homeless or in a federal program aimed at keeping them off the streets during 2013. If the $80,000 were spent on helping returning service members adjust to civilian life, so they would not fall into the despair and hardships brought on by the trauma of war, I believe such a program would do far more to bring comfort to family members and instill a sense of pride to their returning love ones than distracting banners fluttering from light posts.

Setting aside the issue of creeping militarization—an argument already well-articulated— there are other sound reasons for opposing the 500-banner Chico Military Heroes project.

Whether conservative or progressive or member of the National Knitting Society, we all appreciate the beauty of nature. We look at the sky and the trees and we feel some kind of deep peace—no doubt this is embedded in our DNA. As we walk or bike or drive down The Esplanade, we see a little slice of sky through the branches of trees. This is mostly experienced subliminally and we mostly take it for granted. Those things we take for granted can be very easily lost.

One way to lose the natural aesthetic, which is available to the eye in any welldesigned city, is to clutter the skyline with billboards, wires, towers and, you guessed it, banners. If this sounds unpatriotic, consider our long history of appreciation for nature: as Ken Burns said, “Americans invented the ‘national park.’”

The best “banners” are clouds, autumn leaves, birds, squirrels and puzzles of Sycamore bark. If caring people want to spend $80,000 honoring soldiers, they might consider buying a condo for a homeless combat veteran.

Hit the road, Mr. Mayor Re “Candidate considerations” (Newslines, by Tom Gascoyne, Aug. 21): Chico Mayor Scott Gruendl has apologized and taken responsibility for the mismanagement of the city under his 12 years on the council as mayor, vice mayor and chair of the Finance Committee.

Now he states he is committed to correcting the situation he has put the city in. He states his institutional knowledge and experience are needed on the council.

To me, this is like hiring a contractor to build your dream home.

You question some of his work and are told that you don’t know what you are talking about. Shortly after you move in to your dream home it burns to the ground. Cause of the fire is found to be faulty wiring and workmanship. The contractor then asks to be re-hired to rebuild the house. I now know where I’ve made mistakes and I am committed to correct the situation.

Chico, it is time to change the majority of the council. It would be nice to see our City Council use common sense and not the political correctness/political nonsense we’ve had over the past 12 years.

Scott, you are a nice guy, but common sense tells me you should not be on the council.

‘Grossly unfair images’ Re “Billboard-buyer speaks out” (Letters, by LJ Cooke, Aug. 21): War is tragic and the loss of human life horrible. Even my brother-in-law in Israel, in between rocket fire, told me that the solution to the Israeli-Palestinian conflict must be found around the negotiating table.

Adding more fuel to the fire here in Chico helps no one and harms relations in our own community. Sadly, that is what the billboard purchased by LJ Cooke does. The billboard accuses Israel of killing children, accompanied by a picture of a bloodied child.

This inflammatory sign has caused pain and alarm in our community.

The truth is that Hamas targets civilians while basing its operations among children and families with cruel disregard for their lives and safety.

My relatives in Israel have been running for bomb shelters daily because Hamas—recognized as a terrorist organization by the United States, the European Union, Egypt and other countries—has continually launched rockets at Israeli civilians. Hamas built miles of sophisticated underground cement tunnels with the goal of kidnapping and murdering Israelis. It is not just Israel’s right but also its obligation to defend its citizens. No billboard can capture the full story. This one not only oversimplifies; its grossly unfair images are deeply offensive to our community.

Open the lanes already!

Re “Behind closed doors” (Newslines, by Howard Hardee, Aug. 21): It’s most often the persistent ability of concerned citizens that achieves positive change in a hostile political climate. I don’t have to agree with all of Jessica Allen’s tactics to admire her productive navigation of the political wrestling ring in bringing accountability to a maligned and often disrespectful Chico City Council governance process.

It takes a keen will of character being the voice of action that few in the room want to hear, let alone

Someone needs to do some thinking “outside the box” about those two new, unused lanes on Highway 99 over Bidwell Park. Some of us older folks who were young when the project started are wondering if we will be around to see them open.

I’m no civil engineer, but I’ve given this a bit of thought anyway.

How about doubling the number of hard hats with DayGlo vests who stand around gawking at those sound walls for hours on end? I don’t know why they do it, but the gawking must be needed.

Otherwise, why would they be

paid to do it? So, if a few gawkers are good, wouldn’t more be better?

Or, how about cutting the number of DayGlo vests in half and doubling the number of people who actually work on the walls?

Nah, that probably just shows how little I understand about engineering management.

I’m sure there’s a perfectly bureaucratic explanation for why the sound walls seem to have taken longer to construct than the new bridging and paving. But really? I don’t want an explanation. I just want to drive on those pristine lanes once before I mosey off to my great reward.

Who is going to be fined when the city itself wastes water? It is important for all of us to conserve. That includes the city!

FRACKING STILL UP IN THE AIR

The Butte County Board of Supervisors voted unanimously Tuesday (Aug. 26) to place an anti-fracking initiative on the June 2016 ballot. If passed, it would ban the form of gas and oil extraction known as hydraulic fracturing—aka fracking—within county limits.

Earlier this year, grassroots group FrackFree Butte County gathered enough signatures to place the initiative on the ballot. However, a Big Oil-funded complaint questioned its wording, including the size of type, and its verification process was held up by County Clerk Candace Grubbs.

Butte County Superior Court Judge Robert Glusman subsequently ruled the initiative’s structure as valid and the process went forward. But County Council Bruce Alpert expressed reservations about the wording and a natural-gas extraction company called Wild Goose voiced concerns that its operations could be barred, even though it does not practice hydraulic fracturing.

The board voted back in July for a 30-day extension to allow counsel to come back with a report. That delay eclipsed any chance of the initiative making it onto this year’s general election ballot. At the Aug. 26 meeting, the board could have voted to simply adopt the ordinance without changes. It didn’t.

Chief Administrative Officer Paul Hahn told the supervisors the initiative as written was difficult to interpret. “The bottom line is that it’s unclear and its definitions are not very good,” he said. “There is some difficulty in answering as to whether it would affect Wild Goose’s operations. It’s just not clean and not clear and it could cost the county $500,000 in property taxes if they shut down operations and relocate.”

In the meantime, however, a counselwritten ordinance to ban fracking is expected to be made public Oct. 1 and then sent to a Planning Commission meeting on Oct. 23. It should be received for consideration by the supervisors in either December or January.

ATHEISTS’ SIGN DEFACED

An Adopt-a-Highway sign along Highway 99 near Nelson Road that recognizes a group of nonbelievers for its efforts to clear trash along a stretch of the highway was vandalized in recent days, according to George Gold, the group’s president.

The words “God loves” were placed above “Atheists of Butte County.”

“This shows loud and clear just how necessary our group is,” Gold said. “Whenever an atheist is public about her or his identity, there are others who will seek to impose and proselytize their opposing views. This is why our group works to offer a safe space for freedom of conscience.”

Last year, someone pasted the word “pray” on the pole holding up the sign. The group made the required 12 trash pickups last year, Gold said, and is expected to exceed that number this year.

Butte County law enforcement agencies account for military surplus acquired through federal programs

Bob Trausch, a board member of the local chapter of the American Civil Liberties Union, spoke about police militarization at a Michael Brown vigil in Chico’s City Plaza last Sunday (Aug. 24). He said he believes police militarization has led to a breakdown in law enforcement’s relationship with the public.

“It’s no longer Officer Friendly like when I was a kid,” he said in a recent interview. “You have a military presence that creates fear, anger, resentment and an ‘us-and-them’ situation. Police are now being trained to think everyone is a terrorist or a criminal. The police need to focus training on reducing and de-escalating conflict.”

Though careful not to criticize Ferguson’s

police response to what reportedly began as peaceful protests, Butte County Sheriff Kory Honea said his department intends to use any surplus military gear for less forceful activities.

“I don’t believe we would utilize these assets to deal with that particular problem, because the problem with that is it you tend to ramp things up, and in those situations you want to deescalate,” Honea said in an Aug. 26 interview. “Driving an armored vehicle in there with people decked out in SWAT gear, I don’t know if that’s the right approach.

“But, there are circumstances we encounter in civilian law enforcement where equipment that also has a military application is appropriate for us to use,

as long as it’s used in the appropriate circumstances with the appropriate kind of training.”

Accounting for the equipment listed, Honea and Sgt. Derek Bell—a patrol administrator—explained the helicopters were actually acquired in the 1990s and not, as the federal data reports, in 2008.

Honea said two of the choppers—Vietnam-era Bell Kiowas—are flight-ready, while the other two are used for spare parts. Likewise, some of the other gear, including rifles and night-vision equipment—mostly infrared laser scopes—is unusable or in need of repair.

Traditionally used to seek out illegal marijuana grows, the helicopters are now primarily used in search-and-rescue missions, Honea said, and can respond quicker than ground crews and access remote areas people can’t. BCSO’s air unit also assists other counties, and has the only law enforcement helicopters in the North State besides California Highway Patrol choppers stationed near Sacramento.

The MRAP, a 15-ton M1220 Caiman that Honea insists is not a “tank,” was acquired in February and has been officially dubbed the Sheriff’s Rescue Vehicle (SRV). Honea said it will be reserved for “very limited” SWAT activities and to assist the county’s Inter-Agency Bomb Squad.

“From the beginning, we were less about using it for offense and more about using it as a rescue vehicle,” Honea said, noting the vehicle has yet to be deployed, and will be outfitted with emergency medical equipment. “We can drive it into a situation where people are being shot at, shelter people in place, use it as a bar-

rier, or render immediate medical care.”

As for the weapons, Honea said the BCSO can account for 105 of the assault rifles (AR-15s) and all 20 of the handguns (.45 caliber M1911s), explaining the arms were essential to equip his officers. All officers, from patrol to SWAT, are issued rifles, which Honea explained is common practice since the advent of live shooter scenarios like Columbine.

In a separate interview, Chico Police Capt. Ford Porter said his department has accepted 20 rifles, including some “M-16-type” guns and larger-caliber sniper rifles. Porter said the guns have enabled his department to equip every patrol car with a rifle, similar to the BCSO policy. The rifles came to his department fully automatic, but were altered to be semi-automatic for patrol units, while some reserved for the CPD SWAT Unit remain unaltered. All of the sniper rifles are used by SWAT. Honea said Butte County has used the program judiciously—BCSO declined the chance to get a second MRAP—and that it’s helped the department acquire assets in the face of limited finances. He estimated the MRAP’s value alone at about $700,000.

He also said the 1033 program is not just for weaponry, but also offers useful nonmartial items. The BCSO has acquired cooking equipment for the county jail, and is currently on the lookout for gardening tools for alternative custody work crews.

Trausch and other critics believe gear

acquired through the 1033 program is just the tip of the iceberg, and that other, similar programs—such as the Department of Homeland Security’s 1122 program—further contribute to militarization. That program also has been used in Butte County, most notably for the Chico Police Department’s 2011 purchase of a Bearcat armored personnel carrier, which was also labeled a “tank” by detractors.

Porter and Honea both said the Bearcat has already likely saved lives, particularly in September 2012 when it was deployed to a Tara Terrace apartment where a man named Wayne Renner reportedly fired at police before being shot and killed.

Types of gear not being supplied to local police by the feds include lapel and dashboard cameras, which Trausch said are essential to protect people on both sides of the badge from bad behavior. He said he believes the CPD could be outfitted with lapel units for about $80,000, but police officials have thus far balked at the cost.

“We would like to go to [lapel cameras] immediately, but the problem is they’re a big-ticket item,” Porter said.

“The city is having significant budget issues, so we don’t have a lot of money to do that. But it’s an excellent proposition and we have no problem with using them.” Ω

residential streets multiple times a day.

That repetition is due, at least in part, to the city of Chico’s current arrangement with two waste-hauling companies— Recology and Waste Management—that compete in an open market for residential and commercial accounts. As a result, any given street in Chico is lined with customers of both companies, their trucks collecting trash along the same routes.

Overall, it’s an inefficient system that wears down roads and doesn’t align with the city’s goal of reducing vehicle emissions, as outlined in the Climate Action Plan. That’s why the Chico City Council is exploring the possibility of a franchise agreement that would evenly divide the residential accounts between Recology and Waste Management into two exclusive zones. (The two companies would still compete for commercial customers.)

For the revenue-starved city, there’s another consideration: A franchise agreement could have a positive financial impact of $1.5 million to $2 million annually, city officials have estimated. As much as $800,000 of that could come from franchise fees, which would go into the general fund, Assistant City Manager Chris Constantin explained during a recent interview.

“The city streets are an asset of the public,” he said. “Therefore, if somebody wants to use them and make money off of it, they’re going to pay us, just like you would pay McDonald’s to use their name. A franchise fee pays for the pleasure of having exclusive rights to use our streets.”

The rest would be money saved by contracting out the current city duties of street sweeping and leaf pickup to the haulers, he said, though final figures depend on negotiations.

With such clear-cut benefits for street infrastructure, the environment and the city’s coffers, deciding whether to adopt a franchise agreement for waste-hauling might appear equally straightforward.

But not so fast.

As many community members have noted, saddling the wastehaulers with extra business costs would almost certainly trickle down to customers in the form of rate increases. Steve Depa, president of the North Valley Property Owners’ Association, made this point during a council meeting back in December.

“Let’s be up front and call it what it is—a fee that will be imposed on every person in the city who has trash collection.”

City officials have kicked around the possibility of adopting a waste-

hauling franchise agreement for years, but former City Manager Brian Nakamura—who oversaw the implementation of such a system in Hemet, where he’d previously served as city manager—really got the ball rolling.

During that Dec. 17 council meeting, the panel authorized Nakamura’s request for $99,000 of supplemental funding for R3 Consulting Group to evaluate a franchise agreement. In April, R3 presented various options to the Finance Committee, which in turn recommended a plan Know the proposal: to the council.

Those duties demand about 6,000 hours of city staff time each year, he said, and contracting out to the haulers would allow the city to direct resources to other priorities, such as parks and street maintenance. “I don’t expect city employees to be negatively impacted in the form of layoffs,” he said. “Those 6,000 hours will go elsewhere.”

However, under the arrangement, the city wouldn’t pay the companies for those services, so the costs incurred would get passed along to ratepayers. Joe Matz, vice president and general manager of Recology, said as much during a council meeting last November, during initial discussions about a franchise agreement.

“Nothing’s for free anymore,” he said. “It’s going to show up somewhere in the rates.”

Matz added that leaf pickup and street sweeping are services Recology and Waste Management already provide in other cities, and both are “very capable” of handling the tasks.

Constantin said the waste-haulers are supportive of partnering with the city.

“I believe their desire is to have a fair opportunity to negotiate and discuss the options,” he said. “Ultimately, it will be the City Council that decides what kind of services we’ll offer the public.”

The council is set to consider the waste-hauling franchising option during its next regular meeting on Tuesday (Sept. 2).

The shooting death of 18-year-old Michael Brown by police and the resulting civil unrest in Ferguson, Mo., has once again pushed into the limelight differences in how Americans view the criminal justice system based on race. On Aug. 20, pollster Gallup released data revealing the drastic differences in how people view these issues. While 59 percent of whites said they were confident in the police, only 37 percent of blacks echoed that sentiment. The same percentage of whites said they were confident in the honesty and ethics of police officers, compared to only 40 percent of blacks. When asked why a disproportionately high percentage of black males are incarcerated, only 19 percent of whites said they believe it was mostly due to discrimination in the justice system, compared to 50 percent of blacks.

first being built, the Trinity Journal ran a story on the subject. The manager of the Westlands Water District, a newly founded coalition of farmers in the desert-dry San Joaquin Valley, was quoted as promising that his region’s farmers would use only surplus water from the Trinity and Sacramento rivers if the federal government went ahead with plans to dam the watersheds and build an 11-mile tunnel connecting the Trinity River to the Central Valley.

But six decades later, with the dams and reservoirs long in place, Westlands Water District seems to have forgotten its promise. On Monday, the powerful group of farmers, along with the San Luis & Delta-Mendota Water Authority, filed a temporary restraining order and preliminary injunction to stop the U.S. Bureau of Reclamation from releasing a small pulse of water from Trinity Lake reservoir into the river below in an effort to assist thousands of native salmon and steelhead.

The migrating fish had become stranded in low waters that, heated by the sun to bathtub temperatures, were liable to kill them—possibly by the tens of thousands, as happened in 2002 in the Klamath River. After outcry from local tribal groups, the bureau reluctantly agreed to increase the flows from Trinity Lake into the Trinity River, a major Klamath tributary, from about 430 cubic feet per second to more than 2,500.

The Water Authority’s executive director, Dan Nelson, said in a statement released Friday (Aug. 22) that the bureau’s actions were “wrong—both scientifically and morally.” He said the bureau had chosen to “dump precious Central Valley Project water while the people of our valley suffer from” the social and economic effects of drought.

In an interview with CN&R, Nelson said the risk of a salmon Fish species such as spring-run chinook salmon (pictured) rely on cold water flows to complete their migration.

die-off in the Klamath is currently negligible and that the state of “emergency” in the Klamath has been exaggerated. When questioned, he could not name a source for this information.

But biologists and tribal groups in

the Klamath basin say otherwise.

Mike Belchik, senior biologist with the Yurok Tribe who has been monitoring the condition of the river and its fish, says that, until last week, the Klamath River was even lower than it was in the summer of 2002. That year as many as 70,000 salmon and steelhead died from a disease commonly called gillrot, which thrives in warm water. Belchik says salmon tend to gather near stream mouths when water in the main stem of a river becomes too warm.

“For the first time since 2002, we’ve seen salmon clustering by the thousands near river tributaries,” Belchik said.

Tom Stokely, a Mount Shastabased water activist with the California Water Impact Network, points out the amount being released to save the Klamath’s incoming salmon run is relatively small—between 25,000 and 30,000 acre-feet from a reservoir currently containing more than 700,000 acre-feet. Stokely says the

Bureau of Reclamation has diverted about a half million acre-feet of Trinity River water to the Central Valley since October.

Nelson said his district’s members—mostly farmers—want more water available from Trinity Lake for release into the Central Valley primarily to protect threatened and endangered chinook salmon in the Sacramento River.

But John McManus, with the Golden Gate Salmon Association, says these salmon have mostly spawned upstream of where Trinity basin water enters the Sacramento— meaning the diversions wouldn’t help the fish. Anyway, McManus believes one river should not be supported with water taken from another.

“The water needed to keep the Sacramento River cold enough for salmon to reproduce should be coming from Lake Shasta, not coastal rivers,” he said.

At the Butte Environmental Council, water policy advocate Carol Perkins suspects agriculture groups who say their main objective is to help salmon in the Sacramento River are being disingenuous.

“We’re not tunneling water from the Trinity to the Sacramento to help fish,” Perkins said. “The Shasta Dam system wasn’t built to save fish. It was built for Big Ag.” In spite of the legal filing, water flows from Trinity Lake into the Trinity River remain flowing at full force, and the Klamath River salmon, according to sources, are moving upstream.

Shelter from the storm Local group looks to provide winter refuge for the homeless nonprofit known as the Chico HousAoncelocal ing Action Team (CHAT) is looking to again provide winter shelter for the

homeless who, for one reason or another, do not find refuge in the 120-bed Torres Community Shelter in south Chico.

The effort began last October when the group was meeting at the Chico Peace & Justice Center (CPJC) on Broadway in efforts to create either a tent city or a more ambitious tiny-house community.

Attorney Leslie Johnson, her husband and activist Bob Trausch, and retired Enloe nurse Cynthia Gailey are all members of CHAT. The three recently told the CN&R of their efforts to shelter homeless individuals who fall through the cracks at Torres because of canine companions or not complying with other shelter requirements.

“We were working on the tiny-homes idea, of doing something about the problem in our community and our country with the number of homeless and unemployed,” Trausch said.

“We were meeting at the [CPJC] and the weather turned cold and so the meetings became dual-purpose. We thought we really need to house some people now.”

Their plan involves bringing in local churches to provide shelter to the homeless on a rotating basis, an approach that has succeeded in the past. From 1998 to 2003, when the Torres Shelter was built, as many as 18 local churches shared the burden of housing the homeless.

CHAT currently has three churches willing to provide shelter for two weeks each, but they’ll need to find more to cover the last nine weeks of winter.

Last year, the CPJC itself served as the winter shelter, with as many as 30 people sleeping on the facility’s floor at a time.

“It was tight, but it was shelter,” Trausch said. “We had people who were coming in to help prepare the food, hand it out and wash the dishes. It became kind of a nighttime community.”

They also went out into the community to put the word out and handed out tents, blankets, sleeping bags and shoes.

“It was more than just providing people a place to sleep,” Trausch said. “We learned a lot about the illnesses and the reasons people weren’t going to the Torres Shelter.”

Those reasons included an inability to house pets, strict check-in and check-out times and an alcohol ban. They are looking

to shelter as many as 50 per night and they’re hoping churches are willing to accept pets as well as their human companions. If not, other accommodations will be made for homeless animals. Butte County surveys suggest there are between 600 and 700 homeless people in the Chico area.

“This is just a Band-Aid, but it’s a muchneeded Band-Aid,” Trausch said.

Gailey said she got involved after starting a neighborhood watch program whose efforts included cleanups in Lindo Channel.

“I became so aware of how many people were living outdoors and when that cold snap hit, my focus started changing from, ‘How are we going to get that trash out of the channel?’ to ‘Oh my God, how are these people going to survive this?’”

Trausch said he suspects there is some resistance by churches to get involved because of the bedbug infestation reported at the Torres Shelter last year.

“There’s been a real knee-jerk fear of bedbugs or lice, and we’re saying that was an isolated incident,” he said. “But we are also working on it. We are training people, making sure we have paid staff.”

Johnson said they have measures in place to guard against such problems. Those staying in the winter shelter will be handed pads and given blankets—they can’t use their own sleeping bags.

“They come in and have a face-to-face interview and we make sure they are going to be safe for themselves and others,” she said. “Their belongings will get put into a thick plastic bag and tied off. We are taking all the measures we can to prevent and allay fears because the thing of it is, if it does happen, it’s very expensive.”

ABORTIONS COVERED

Elective abortions are now covered by all group health insurance plans in California, as per mandate from the state Department of Managed Health Care (DMHC).

Last fall, Santa Clara and Loyola Marymount universities notified employees they would stop covering abortion in their health plans and offer supplemental coverage provided through a third party, according to The Associated Press.

The move was cleared by the state.

In reaction, objecting employees and abortion-rights groups lobbied the women’s caucus of the State Legislature, which asked Gov. Jerry Brown to reverse the decision. The DMHC did so on Aug. 22. In a letter to insurers explaining the policy, which is effective immediately, Director Michelle Rouillard said “abortion is a basic health care service.”

Two groups opposing abortion, the Life Legal Defense Foundation and Alliance Defending Freedom, threatened to file a federal civil rights complaint unless the state’s previous determination is reinstated.

HACKERS STEAL PATIENT DATA

Hackers recently stole the nonmedical data of 4.5 million Community Health Systems patients, prompting the FBI to issue a flash warning to health care organizations representing likely targets for cyber attacks.

The incident is the second-largest breach of Health Insurance Portability and Accountability Act (HIPAA) protections ever reported, according to California Healthline. CHS is based out of Tennessee and operates 206 hospitals across 29 states, including four in Southern California.

The FBI notice said multiple health companies have been targeted by cyber attacks, typically for “valuable intellectual information,” such as equipment development and medical device data, as well as “health information and/or personally identifiable information.”

In April, the FBI warned that health care systems were lax compared to other industries and vulnerable to hackers attempting to access bank accounts or prescriptions.

OPIOID CONTROLS TIGHTEN

Regulation of some of the most widely abused narcotic painkillers tightened on Aug. 21, as the U.S. Drug Enforcement Agency moved opioids from Schedule III to Schedule II. The DEA categorizes drugs into one of five schedules based on accepted medical use, relative abuse potential and likelihood of dependence. Pure hydrocodone is already a Schedule II drug; pills like Vicodin, however, are a combination of hydrocodone and less-potent painkillers like acetaminophen. Starting in October, patients will need a written prescription—not one submitted by phone—from a doctor to get such combination pills, according to CNN. Further limiting easy access, patients will have to see a doctor to refill their prescription.

The reclassification also puts manufacturing quotas in place for hydrocodone products.

In the U.S. alone, someone dies from prescription drug overdose every 19 minutes.

Big stress on campus Chico State counselors discuss mental health issues facing today’s Wildcats story and photos by

ith each passing semester, a trend has W become anecdotally apparent to the counselors at Chico State’s Counseling and

Wellness Center—more students are seeking mental health services than ever before.

That doesn’t necessarily reflect a growing prevalence of mental distress in the student population, counselor Juni BanerjeeStevens said during an interview in her office in the Student Services Center. She’s bolstered on-campus mentorship and outreach efforts aimed at preventing suicide since joining the counseling center in 2009.

Since she’s helped spread the word around, Banerjee-Stevens offered one possible explanation: More students know that counseling services are available.

“Our main mission in doing the outreach is to demystify what happens here,” she said. “We just talk; there’s no magical process. The more students experience that, the more word gets out that therapy is accessible and friendly and you don’t have to be severely depressed or struggling to the point where you can’t function to get something out of the process.”

It’s also possible that the increased number of students using the counseling center is a sign that the stigma associated with receiving mental health treatment is diminishing.

“I think it is breaking down, and across ethnicities,” said Mimi Bommersbach, who retired last spring after 13 years of counseling Chico State students. “Over the last few years, I’ve noticed more Latino students, who traditionally wouldn’t come in. That’s great; we’re not just serving one population of students.”

But both Bommersbach and BanerjeeStevens believe there is more to the phenomenon—that students actually are more stressed out.

“We saw this happening after the economic downturn,” Bommersbach said.

“There’s this level of stress around finances that wasn’t really in the picture before 2008. And it continues—the stress of taking as many units as possible in order to graduate quickly, and working as many jobs as possible to avoid accruing too much debt.

“That was a real shift from ‘I’m going to go to college, it might take me five or six years.’”

Banerjee-Stevens started training to be a counselor just as the recession got into full swing; since then, she’s noticed symptoms of anxiety in more of the students she meets.

“I think a lot of our students are legitimately worried if going to college is a sound investment,” she said, “‘I’m investing all this time and money, my parents are making a huge sacrifice, and then I probably can’t find a job when I’m done.’”

After all, for students, these financial stressors coincide with worries as old as the university—living independently for the first time, making friends, choosing a career path, attracting members of the opposite sex, defining and developing an adult identity, and toeing the line between cutting loose and chemical dependence.

“It’s a lot of challenges all at once,” Bommersbach said. “We work with students to really put a balance in their lives. Maybe you need to drop a class, work less, or get some support, because it’s hard going to college and being away from home.”

In addition to a higher volume of clients, the counseling center staff has encountered more acute cases of anxiety or depression in recent semesters, Bommersbach said.

Banerjee-Stevens concurred, although with the caveat that she doesn’t have the same long-term perspective as Bommersbach.

“We all feel the same thing,” Banerjee-Stevens said. “Not just my colleagues here at Chico State, but counselors across the country are seeing more students struggling with thoughts of suicide, more students suffering abuse and trauma in their families, more students having traumatic experiences while they’re in college.”

subjects? Or is severe mental distress is becoming more common?

“I can’t answer that,” BanerjeeStevens said. “But I will say we’re doing more crisis-management than we were a few years ago.”

In any case, there’s no doubt that

mental illness is already widespread among college-age adults.

According to the National Alliance on Mental Illness, 1 in 4 adults ages 18 to 24 has a diagnosable mental condition. A separate NAMI survey found that, over the last year, more than 11 percent of college students were diagnosed or treated for anxiety, and more than 10 percent reported being diagnosed or treated for depression.

Even so, most students with such a condition feel very much alone in their struggle, Bommersbach said.

“There’s a misperception that everyone is having a good time but them,” she said. “We do this mental filtering where we look only at the students who are doing great and compare ourselves.

“But college is a stressful time; it’s normal for the wheels to come off at some point,” she continued.

“We just want to be sure that, when people start to feel that way, that’s when they come talk to us.” Ω

Weighing in on the water bond Environmentalists debate the good and bad of California’s water bond

he water bond approved earlier this month Tapplause for the November ballot has drawn from Democrats and Republicans

as just what California needs in a time of persistent drought.

But the $7.5 billion package contains subtle language that environmental groups warn could be a handout to water-hungry farmers, facilitate the construction of dams, and even grease the way for Gov. Jerry Brown’s twin tunnels in the Delta.

The bond—a downsized rendition of a previous $11 billion version—will divert money from education, health care and other social services to fund what some critics say should be projects subsidized by ratepayers.

“People getting the water should be paying for it, not the general public,” said Bill Jennings, with the environmental group California Sportfishing Protection Alliance, whose work is primarily focused on maintaining water flows through the SacramentoSan Joaquin Delta.

Jeff Michael, the director of the Business Forecasting Center at the University of the Pacific in Stockton, says he favors some of the projects this bond supports. “But I think

it could be paid for in another way,” he said.

“This bond takes money from things that are paid for from the state’s general fund.”

The bond’s authors, including state Sens.

Lois Wolk and Darrell Steinberg, have said it is “tunnels neutral,” with no money allowed for directly or indirectly supporting the Bay Delta Conservation Plan.

But the bond, which blew through the Assembly at a vote of 77-2 and the Senate with a clean 37-0 sweep, includes $485 million that can be used to buy water from farmers upstream of the Delta and use it for environmental benefits within the Delta.

The concern among critics who have analyzed the bond’s language is that this water could serve a second purpose, too—that of feeding the proposed water tunnels, should they be built.

“It’s subtle, but the purchasing of that upstream water facilitates the tunnels,” said Jennings. Gov. Jerry Brown’s plan to dig two tunnels beneath the Delta to facilitate the southbound transfer of Sacramento River water has been controversial on its own.

But even the bond’s firmest critics agree it has its virtues. The package includes $900 million for improving groundwater quality in the Los Angeles region, on the Central Coast, and other parts of the state; $725 million for water recycling; $200 million

for stormwater-capture projects; and more than $500 million to help provide clean drinking water for communities where the tap water is currently not potable.

Brian Stranko, the Nature Conservancy’s water program director for California, says the bond is a well-balanced compromise.

“Everyone wanted the whole pie,” he said.

“We had to divide it up to satisfy many, many people, and we feel the environment got a good slice.”

The Natural Resources Defense Council also supports the bond measure, according to the organization’s staff attorney Doug Obegi.

He says more than a million Californians currently cannot drink the water from their faucets. These communities, he says, could benefit tremendously if voters agree to the package.

Barbara Barrigan-Parrilla, executive director of the group Restore the Delta, also likes parts of the bond package but thinks it includes too much attached “pork” that will benefit San Joaquin Valley farmers.

“This should have been a smaller bond focusing on clean drinking water and drought-emergency supplies,” she said.

“What’s sad is that the people who will be getting clean drinking water out of this will be paraded about as reason to pass this bond, which is overall going to harm the environ-

ment and communities in the Delta, and enrich a few special interests.”

One component of the bond that its critics are watching cautiously is the $2.7 billion in funding for surface-water storage infrastructure. The money is not earmarked for any specific projects but could be used to build two new Central Valley dams. Water from these projects, according to planners, could be released at critical times of the year to support migrating salmon and steelhead.

Environmentalists warn that such water, before it flows to the sea, could be pumped out of the Delta and into the San Joaquin Valley’s farmlands, making them question the real motives behind building the dams.

Chico’s water-protection group, AquAlliance, has chosen not to present an opinion at this time.

Jennings says agricultural interests have lobbied for the projects.

Both bond opponents and supporters recognize its potential to cause harm—especially if farmers who sell their water for bond money aren’t carefully watched: They might simply turn on their pumps and pull water from underground reservoirs to continue watering their crops, a tactic called groundwater substitution, which hydrologists say is depleting subterranean reservoirs in places and causing surface water to sink underground.

“We need to be very careful that we don’t gain one water source but just lose another,” Stranko said. Ω

Burning for his art As this story goes to press, tens of thousands of desert-loving partiers are reveling in the heat and art at Burning Man in Nevada’s Black Rock Desert. Erin Banwell, an accomplished Chico artist, has been creating and bringing his elaborate, often pyrotechnic, pieces there for over a decade. Banwell is cofounder of Chico’s Idea Fab Labs (IFL), a cutting-edge artist community, school and laboratory. Ten of its members used IFL to create Burning Man artworks this year.

How many years have you been to Burning Man? For the last 16 years straight, since 1998. I can’t go this year because my wife, Kristina, and I have a new baby boy, but I’m helping build Burning Man art pieces for three groups who are going.

What did you work on for Burning Man this year?

The most elaborate is a 24-footwide, 8-foot-tall electric sign with 1,500 LED pixels. It plays videos and colored patterns called “algorithmic rainbow orgasms.” Another is a caravan of six four-wheeled carts shaped like giant teapots called the “Lost Tea Party,” featured in the Huffington Post. The largest cart is 25 feet tall, and each has a big, cut-out wooden entrance on one side, and a 3-foot-diameter lattice window on the other.

I hear your most elaborate Burning Man piece was a giant, fire-spewing globe?

Yes, that was a 38-foot-tall, flaming, geodesic sphere called the “Pyrosphere” that I displayed there in 2010, 2011 and 2013. It had 91 flame spouts, the most of any Burning Man art piece at that time. It was also the most technologically advanced fire piece there, with animations and flame-shooting speeds controlled by selected audience members using an iPad. Before the festival, we allowed 470 ticket-holders to program the animations for it.

What got you into all of this art?

How is Idea Fab Labs doing?

Great. It’s a 6,900-square-foot space for the art community to connect. I helped found it with four others in May of 2013. Jordan Layman and I run it daily. We teach members to make art using our wood shop, jewelry zone and high-

My dad was an artist and I studied sculpture at Cabrillo College. But I really got inspired by the art of Burning Man. It had the most cutting-edge art scene in the world, where you could create large-scale, interactive pieces not possible at any other venue.

What do you have planned for the future?

We’re teaming up with MONCA [the Museum of Northern California Art] for an opening of three artists, yet to be named, at IFL Oct. 18, which will run for a month.

I’m also going back to Burning Man next year. My wife insists on it, and she’s been going with me since 2008.

Last week, under the shade of a large olive tree, I sat with Olivia and Darro Grieco, discussing their farm and the oils they’ve produced over the 10 years they’ve owned Berkeley Olive Grove 1913.

“When we bought this place, it was bank-owned,” Darro explained. “It had been 20 years since the trees had been pruned properly—they were 40- to 50-feet high.”

He pointed to the Mission olive trees—there are 23,500 total on their 400-acre property—and talked about how they’ve cleared out the inner branches and trimmed the tops. It’s easier to harvest, Darro said, when the branches are closer to the ground. Plus, fewer branches means less competition for nutrients and, especially important right now, water.

(Their grove is dry-farmed, meaning the trees rely on seasonal rains rather than an irrigation system.)

Berkeley Olive Grove 1913, named after the group of Cal professors that planted the olive trees more than 100 years ago, is nestled on the western slope of Table Mountain. In tasting some of their certifiedorganic and kosher oils, which range from mild to full-bodied and include varieties made with lemons and blood oranges, it’s apparent that the Griecos have reason to be proud. Olivia demonstrated an olive-oil tasting, pouring a small amount into a tiny plastic cup and rubbing it in circles against her palm to warm it. After a few seconds, she said, place your other palm on top to trap the aromas. Then smell and drink.

My first taste yielded some unexpected flavors. They started me with their Reserve, the mildest of the traditional oils. Smooth on the palate, and slightly bitter, it hit me with an intense peppery sensation in the back of my throat. That, Olivia explained (and I later confirmed on foodchannel.com), is a sign that the oil is chock-full of antioxidants. The others packed a little less pepper punch—my favorite was the lemon flavor.

The Griecos have worked hard to determine the health benefits of their oils. They’ve sent batches off for testing to the University of Athens in Greece and received positive results, including a report that their oils are particularly high in a polyphenol that has been proven to protect the nervous system from the effects of Alzheimer’s disease.

HAPPY Experts share five ways to lead a better life by

ith a wild grin and orange cowboy hat, flanked by women friends (her de facto bodyguards) in Johnny Cash black and dark shades, the rail-thin blonde with the contagious laugh rolled up to the microphone and launched into her one-woman show, Die Laughing With Cathy Speck.

“Was it Tom Sawyer or Huck Finn who faked his death so he could go to his own funeral?” Speck began her performance. “Right now, I feel like I’m at my own funeral!

So here we go!”

Over the next hours Speck—known by some in her hometown of Davis as the “queen of happiness”—sang, laughed, joked, blew bubbles and told stories about life, death and love so as to raise money last summer for her cause. Diagnosed in 2009 with a familial form of amyotrophic lateral sclerosis, more commonly called ALS, Speck has dedicated her life to raising awareness and funds for the fatal malady (also known as Lou Gehrig’s disease).

I

t wasn’t the first time this woman had taken center stage as a local advocate for carpe diem. Since her diagnosis, Speck has hosted annual Specktacular Skydiving for ALS fundraisers (yes, she’s jumped); led boisterous teams of supporters on annual Sacramento ALS walks; participated in the Ice Bucket Challenge; and told her story to anybody who will listen, including multiple college and junior-high classes in the region.

Last month, when doctors told Speck they had found a new medical issue with her lower intestines—a rare cancer had taken up lodging there—her response was classic.

“This [the cancer] is just a wake-up call for me to get back on top of my game,” said Speck. “To be with the sweetness of the moment, to be happy to the core and extend that out.”

Given the unfathomable challenges of her primary disease, the additional arrival of cancer, the suffering she and her family have been through (Speck has already lost her mother and two brothers to ALS), and the anguish that must accompany any terminal diagnosis, two questions come to mind: 1. Why is this woman so happy?

2. If Speck can exemplify happiness despite the severity of her circumstance, why can’t we all?

Seven years ago, the Chico News & Review published a story that examined the relatively new field of positive psychology (see “Are we happy yet?” CN&R feature story, Aug. 9, 2007). Instead of obsessing on human failings and flaws as psychologists had previously done (think Freud), a new group of professionals suggested a shift in emphasis to what makes humans strong, gritty, resilient … happy. Thanks to pioneers like Martin Seligman, the renowned psychologist who wrote Authentic Happiness in 2002, an industry was born with its best-selling books, national summits and contentment gurus.

Well, developments in the field have only accelerated since then. In fact, science has discovered that we humans actually can be taught many (sometimes unexpected) things about happiness.

And who better than Speck to serve as teacher?

‘Because I’m happy’ Search “Pharrell Williams” and “Happy” on YouTube, and before you can say “room without a roof,” millions of results pop up, including variations from Russia, France, Iran, Vietnam—you name it. Each features groups of people, singing along with, and getting their happy-feet boogie on, to the Grammy Award winner’s mega pop anthem.

The “Happy” flash mobs (don’t miss the one from Azerbaijan) will particularly wash you in hope for humanity. “Clap along if you know what happiness is to you. … Clap along if you feel like that’s what you wanna do.”

Turns out, this outpouring of feel-good euphoria may hold a lesson for us all. Yes, we can actually benefit from accepting Williams’ invitation to embrace the notion that “happiness is the truth.”

Today, the science of well-being is boom-

ing and involves academics and scientists in disciplines beyond psychology—we’re talking neuroscience, sociology, medicine, economics and evolutionary biology. It’s no longer just intuitive that happiness and a positive outlook is good for one’s mental and physical health—now science also heralds the many benefits that can be accrued from looking on the bright side.

Not surprisingly, technology has entered the mix with new positive-psychology tools.

Happify is a digital app tool with “scientifically designed games and activities” that lets people regulate and monitor their emotions and behaviors. Another example: The Gratitude App for Google Glass encourages optimism and the expression of gratitude.

“It’s exploding,” said Sacramento psychotherapist Stephen Walker of the happiness field. “The neuroplasticity part [the ability of the brain to develop new connections] is the cutting-edge piece.”

Indeed, our scientific understanding of the brain (including acknowledgment that the brain actually can change) has doubled in the last decades. Neuroscientists have discovered, for example, that greater activity in the left side of the frontal cortex is associated with positive emotions and increased happiness.

“The science of happiness has blossomed,” concurred Emiliana SimonThomas, UC Berkeley’s neuroscientist who works as science director at the Greater Good Science Center. Simon-Thomas is one of a pair of GGSC instructors offering an upcoming free massive open online course, or MOOC, on the edX platform called The Science of Happiness. The class, which is still open for enrollment, launches on Sept. 9, and has so far signed up more than 76,000 students.

Simon-Thomas and others seem to largely embrace the idea, based on a meta-analysis of hundreds of studies from across the globe, that insights into happiness can be derived from a pie chart that’s divided into a 50-10-40 split.

Though some consider the chart’s simplicity to be misleading, the schema breaks it down that 50 percent of happiness is determined by genetics, with findings based primarily on studies that track identical twins separated as infants and raised by unconnected families in different environments.

Another 10 percent of our happiness quotient is due to life circumstance, which includes health and wealth. On the latter, multiple studies, including one by Nobel Prize winner and Thinking, Fast and Slow author Daniel Kahneman, have found that once people reach a modicum of financial security, pecuniary gains don’t increase happiness.

Importantly, the remaining 40 percent of what makes up happiness seems to be determined by day-to-day habits, attitudes, activities, work and social relations.

And that’s a sizable chunk.

In the case of Cathy Speck, that 40 percent can be deconstructed, more or less, into five realms that coincide with much of what is being discovered about happiness: 1. Speck has a committed, loving and laugh-

ing network of friends and family members with whom she stays connected, physically and virtually; 2. She expresses gratitude naturally and constantly for what she calls “the whirled” and her spot in it; 3. She embraces a live-in-the-moment philosophy, practices mindfulness and turns to books about Buddhism if ever she feels blue; 4. She’s generous with her time and energies, especially as a fundraiser for her causes; and 5. She is passionately devoted to those causes and is fueled by the sense of purpose it gives her.

Though thinking and behaving in a way that promotes well-being comes naturally to Speck, it seems “happiness benefits” can be amassed by any who choose to follow the science in these same five realms.

Relationships To be a friend of Speck’s on Facebook is to belong to a far-reaching social network that seems keenly connected to this one woman’s irreverent sense of humor, passion-

ate belief in speaking openly about “the life and death cycle,” and her particular diagnosis—ALS, which causes the body to slowly become paralyzed, with one muscle group after another ceasing to function.

Speck, who spent a week in late July at Sutter General Hospital after surgery for her newly diagnosed neuroendocrine cancer, took her virtual community along for the ride as she endured what constituted risky surgery, given her unfolding ALS, to remove tumors in her lower intestine, as well as take out her appendix and gall bladder. Myriad posts proclaiming love and support flowed through social media toward Speck. Friends at the hospital— who decorated her room in a Hawaiian motif—shared photos of Speck at various stages of recovery. One friend advised Speck: “[T]he amount of love being sent through the Internet to you may cause your iPad to blow!”

Now, this kind of share-everything transparency related to an illness or medical procedure may not be for everyone. But it’s endemic of Speck, who has chosen to live— and ultimately to die—in full view of her extended community of family and friends.

“People tend to be happiest when they are with other people or with a community of trusted friends and family,” said SimonThomas. Multiple studies reveal that having close relationships, including romantic ones, are particularly beneficial. “Having people to confide in, who’ll lend support in times of trouble, cannot be overrated,” she added.

It often surprises people from industrialized countries when they travel and find that developing countries are full of happy people, she said. That’s because, in some Third World regions, the poor live in interdependent communities with tight-knit families and close social connections. Research in evolutionary history indicates that the American standard of rugged individualism may not actually offer the best path to achieving wellbeing, she said.

Gratitude UC Davis professor Robert Emmons, a psychologist and national expert on the benefits of gratitude, gets hyped up quickly about the “new generation of researchers” that has entered the gratitude field.

“Some of the findings are really amazing,” he said. According to Emmons, clinical trials show that the practice of gratitude can lower blood pressure, improve immune function and facilitate more efficient sleep. Additionally, it can reduce lifetime risk for depression, anxiety and substance-abuse disorders.

“Gratitude is good medicine!” says Emmons.

This author of four books (including Thanks!: How the New Science of Gratitude Can Make You Happier) and editor of The Journal of Positive Psychology makes a case that the expression of gratitude has a deeper power than ubiquitous smiley-face emoticons might convey. In addition to improved health, he says, feeling and communicating gratitude results in closer relationships and increased optimism—both of which are keys to happiness.

We tend to get used to things so that good things become predictable and invisible, he said. The act of expressing gratitude helps overcome that adaptation and can be a watch guard against taking life for granted.

From the social evolutionary perspective, said Emmons, research is demonstrating “that gratitude takes us outside ourselves where we see ourselves as part of a larger, intricate network of sustaining relationships.

“Gratitude helps regulate relationships, solidifying and strengthening them,” he suggested in an email. “It is not only a response to kindnesses received, but also a motivator Cathy Speck suffers from ALS (aka Lou Gehrig’s disease) as well as a just-discovered rare cancer. Despite this, she thinks and behaves in a way that promotes laughter, gratitude, love and happiness.

of future benevolent actions.”

Also it “enables us to face the bad stuff with hope and confidence that ultimately the future will bring more joy than suffering.”

Both Emmons and Simon-Thomas, who oversees UC Berkeley’s Greater Good Science Center’s Expanding Gratitude Project, suggest individuals keep a gratitude journal, i.e., write down what one is grateful for and look back on it on occasions when inspiration and reflection is warranted.

Mindfulness The history of mindfulness goes back to Buddhism, with its teachings that draw attention to the moment and advocate meditation, serenity, balance and effortlessness. It was 1979 when University of Massachusetts molecular biologist Jon Kabat-Zinn first brought Buddhist principles (if not its religious connotation) together with medical findings with his Mindfulness-Based Stress Reduction program. More recently, a pile of research has continued to document the psychological and emotional health benefits of practicing mindfulness.

Health care organizations like Kaiser Permanente and Sutter Health now offer programs and podcasts that promote mindful-

ness exercises to patients since these have been found to reduce stress and anxiety, ease chronic pain, reduce blood pressure and improve immune systems.

What is mindfulness?

“It’s being awake and paying attention,” said Stephen Walker, a licensed psychotherapist working in Sacramento. “It’s an awareness and acceptance of the present moment.”

“It’s about the here and now,” he said.

Walker traveled to India and became a Tibetan Buddhist monk at an earlier point in his life. So his experience in this realm is substantial. “Mindfulness is about cutting back on the striving and judgment. It’s more on being than doing,” he said, “accepting rather than rejecting.”

According to Walker, you don’t have to sit in the lotus position and think higher thoughts in a formal meditation practice to derive benefits from mindfulness. The simple act of getting comfortable, focusing your mind on the present while gently pushing away distractions (perhaps while silently repeating a positive mantra or phrase) causes the body to relax, the breath to slow and the heart rate to drop.

Interestingly, the practice of mindfulness also tends to makes people more altruistic.

A 2013 study published in Psychological

Science found that people who took an eightweek mindfulness course were far more likely than a control group to give up a crowded waiting-room seat for a person on crutches.

Another study in the same publication revealed that meditating showed changes in brain activity, “including in networks linked to understanding the suffering of others.”

For some, the quest for happiness can seem selfish in a world overcome with the suffering of others due to poverty, war and violence.

“Life has its sadness, its anger, its pain,” said Simon-Thomas, “and experiencing these are really important.”

She admitted, “The heaviness of other people’s suffering can be overwhelming.”

The best you can do, she said, is take on a mindset that “when you can do something, you will.

“Acknowledge that you are concerned about the welfare of others and will make good choices,” she said, such as acting with compassion toward the people in your life, making sustainable choices for the environment, working for social change, etc.

Generosity A long-ago episode of Friends featured Joey, set to volunteer at a telethon for PBS, arguing with Phoebe about the existence (or not) of selfless good deeds. Phoebe claimed his act of volunteering was not selfless because he’d benefit from the television exposure. She challenged herself thusly: “I’m gonna find a selfless good deed!”

By the end of the show, she hadn’t. As Phoebe learned, it’s hard for generous acts to be selfless because accomplishing them makes you feel good. Indeed, this can be tracked because research reveals that our brains light up in areas associated with pleasure when we are kind to others.

Could it be, for example, that spending money on others makes us happier than spending on ourselves?

Elizabeth Dunn, an associate psychology professor at the University of British Columbia and co-author of Happy Money: The Science of Smarter Spending, conducted a study that answers with a resounding “yes.” In it, participants who were randomly assigned to spend money on others experienced greater happiness than those assigned to spend it on themselves.

In another study, published in the Journal of Personality and Social Psychology, scientists looked at data from more than 200,000 people from all around the world and found that donating to charity boosted happiness.

Unpredictably, the finding was even true in countries where people had to struggle to put food on their own table for their own families.

Purpose It’s surprising when Speck, the queen of happiness, describes her 25-year-old self (pre-ALS diagnosis) as severely depressed, with lots of problems. But it’s true. In her “HAPPY” continued on page 25

mid-20s, Speck was “alcoholic, anorexic and bulimic and suicidal … everything you can think of,” she said. Indeed, she spent her adolescence “funny and smart on the outside” but grieving on the inside after her mother died. Speck was 13 when that happened.

When Speck came out as gay in the late ’70s (“when it was not OK,” she said), the young woman struggled to make her way. “That’s when all the sadness and anger and depression came that I had been hiding away,” she said.

But a turning point arrived. At the height of her angst and “feeling shameful and humiliated,” she somehow came across a kindergarten picture of herself, “one of those cute little things, me with the twinkling eyes.”

“I looked in [that girl’s] eyes and realized, ‘Oh my God, that little girl is still in me!’ … I realized that’s who I can be, that’s who I am.”

Speck suddenly felt her life had purpose: “I realized I had to do right by her. I saw that I couldn’t force her to drink or starve her or hurt her anymore in any way.”

The awakening led Speck on a new life path aimed at being good to “little Cathy.” She enrolled in college classes, rededicated herself to playing music, performing and writing. Eventually, the darkness lifted. Years later, post-diagnosis, Speck’s life filled with a larger life purpose—to “help with ALS … and to help spread laughter and love.”

Woodland therapist Huyen Friedlander-Brannan, who knows Speck and works with UC Davis counseling services, explains it this way: “Oftentimes, looking at the really hard stuff—like death and dying or addiction or chronic illness—actually makes room for the happiness,” she said. “For Cathy, it’s all about loving people and relationships and inspiring people.”

Speck’s sense of purpose is authentic and no doubt part of what’s kept her going despite it all.

Indeed, research from Cornell University in Chicago found that purpose protects people against stress, a fact that likely explains why people with purpose live longer.

What constitutes purpose is different for everyone.

It can be self-focused, like achieving a goal you set for yourself at work. Or it might be simply making ends meet for your family or staying healthy so as to one day meet your wished-for grandchildren. Often, as with Speck, it means committing to a larger purpose or social cause that benefits the less fortunate or future generations.

Science has recently distinguished between how “happy” and “meaningful” lives differ when it comes to physical health and a longer life. But for Simon-Thomas, the truth includes both words.

“The best way to pursue happiness is through pursuing a meaningful life by committing yourself to a greater purpose beyond your own self-interest,” she said.

Speck, now back at home recovering from her recent surgery, couldn’t agree more.

“I do the best I can from right here,” she said. “If I’m able to help other people feel happy or joyous or laugh, and keep extending that out, then that makes me happy.” Ω

During a recent phone interview with the CN&R, Slug reflected on Atmosphere’s formative years. The duo’s arc began in the early 1990s, when a mutual 26

friend introduced Slug to Anthony Davis, or Ant, the producer with whom he formed the group.

What was your relationship with Ant like at first?

His first impression of me was like, “Who’s this skinny white dude coming over here to rap?” And my impression of him was like, “Who’s this skinny white dude making these beats?” But I was kind of floored. I could see the work ethic in this guy—he was making 30 beats a week. I really didn’t have any aspirations to be a career emcee; I was a hobbyist.

But I was so attracted to how much work this guy did, I just wanted to be around that. As I spent time around him, I became that way, too.

How has that relationship developed?

Now that music has become authoritative in my life, as well as something I love, it’s almost like a marriage. I don’t feel like I’m married to Anthony; what I’m married to is the relationship with Anthony. I depend on him to give me beats, so I can make songs and afford to purchase organic milk.

When you started out, was it more about proving your rap chops?

In any art, validation from your peer group, your contemporaries, is one of the first validations that you seek. Then you move on to seeking validation from an audience, from members of the opposite sex, and then even from your parents. You couldn’t have told 22-year-old me that, one day, which record my mother likes would matter to me. It would have been, “Yo, mom, this ain’t for you!”

Do you use metaphor and symbolism to write about personal subjects?

Yeah, it’s insecurity. Sometimes you’re afraid to just tell it, because it might show you’re vulnerable. The record When Life Gives You Lemons, You Paint That Shit Gold, that was 95 percent fictitious, just a bunch of stories. But in the end, those songs were about me. Even though I might change the names or the gender of the character, it’s all secretly first-person.

Do those literary tools help make the songs more universal?

If you want people to relate, you have to keep it broad—or keep it dark. Everyone relates to dirt colors, to struggle. Not everybody wants to relate to yellow. Pharrell’s song—that “Happy” shit? That was fucking amazing. I’ll never listen to it again, but there was nothing dark about it and I still related. That’s so difficult. It’s not like Anthony and I haven’t tried—we have a song called “Sunshine.” That’s probably as close to happy as we’ve gotten, and even then, I couldn’t help putting a couple of little clouds in it.

If Atmosphere was starting in today’s hip-hop scene, would you make it?

Timing was a huge part of what enabled us to create the voice we have. I was 30 years old when God Loves Ugly came out. We were suddenly propelled into a situation where money was floating around, there was notoriety, girls liked me. What would have happened if that came out when I was 22? We were very lucky with our timing. That’s the word I want on my rap tombstone— “Timing.” Ω

However, as with O’Malley’s Scott Pilgrim series, the exaggerated animé-esque art, colorful character outbursts and supernatural sorcery that’s a step beyond reality’s limit all feels like an extension of the characters’ emotional intensity. The artistic flourishes add to our empathy for the flawed characters so that when Katie’s world-altering decisions devolve into terror, we not only buy the increasingly supernatural world, we’re also wrapped up in the dangers it poses—concerned for Katie’s happiness and our own hope for a better world. A good story with great storytelling woven into the art, Seconds will have you coming back for thirds.

Forty Below Records A few days before his 80th birthday last November, the iconic English bluesman John Mayall— whose groundbreaking 1965 album with his band, The Bluesbreakers (with Eric Clapton on guitar), served notice that the blues was very much alive on the other side of the Atlantic—rejoined Rocky Athas, guitar; Greg Rzab, bass; and Jay Davenport, drums for his first studio album since 2009’s Tough. With accordionist C.J. Chenier on board, A Special Life opens with a relaxed version of his dad’s “Why Did You Go Last Night,” on which Mayall’s piano provides a welcome accompaniment. Multi-instrumentalist Mayall, who was here last January in the Sierra Nevada Big Room as part of Mark Hummel’s Blues Harmonica Blowout tribute to Sonny Boy Williamson, digs out his harmonica on several songs, most notably the title track that celebrates his freedom (“I got no plan to guide me, never plan to fade away”). His sunny keyboard playing on the lilting “Heartache” belies the pain he feels being apart from a new love.

Another original, “World Gone Crazy,” addresses the global conflicts that surround us—“It’s so amazing, that guns are blazing/there’s gotta be a price to pay.” Among the covers, Albert King’s “Floodin’ in California” also features Mayall’s guitar playing. Fans of this “blues-a-genarian” are going to love his latest offering.

An Old Betrayal Charles Finch Minotaur Books/Macmillan An Old Betrayal is Charles Finch’s seventh mystery featuring the British gentleman detective Charles Lenox. Set in the 1860s and ’70s, the books in the series are cleverly plotted, rich in historical detail, and written with wit and clarity. The author is an American who attended Oxford and has lived off and on in England for many years.

In an interview, he said he was fascinated by the contrast between the staidness of the Victorian era, during which no gentleman would dare walk through Hyde Park without a hat on, and the dangers of the streets, where gin mills could be found just blocks from Parliament and crime was rampant. As this story begins, Lenox has recently become a member of Parliament, but he continues to hanker for the excitement of detective work. When a case of mistaken identity seems to lead to murder, and a former colleague asks for his assistance in solving the case, he jumps back in. His two sides, politician and detective, are brought together when he determines that the ultimate target of the nefarious scheme is the queen herself. Full of lively subplots, interesting characters and richly detailed scenes, this is an entertaining novel that will whet your appetite for the rest of the series.

Orchard fresh Slow Theatre takes the reins of the Butcher Shop outdoor festival enver Latimer remembers the backyard theater D performances of his Chico youth as “summertime adventures” for him, his brother, Dylan, and their high

school friends. And this weekend (Aug. 29-31), 24 years after the Butcher Shop’s debut out behind the family home, by the Latimers and their friends are Rachel Bush once again getting their theater gang together and inviting the rest of Chico to join them in another performance adventure.

After five seasons (1990-94), the Preview The Butcher Shop: Butcher Shop actually went dark for Crack in the 15 years as its founders moved from Climate happens the backyard to downtown, turning Aug. 29-31. With a goal of bringing a new measured approach to the local scene, Slow Theatre is based on principles of creating locally relevant works and developing them slowly and deliberately.

Featuring one-act plays interspersed with music and

dance performances, the Butcher Shop events rely on dozens of Chico theater people—past and present—to write, direct and perform what can be counted on to be an eclectic program. “It’s always been a place for world-premieres of original work,” Latimer said.

“That also means the work is raw and not ready for paying audiences. I think of it as an incubator for work that might later be staged elsewhere or turned into full-length plays.”

This year, the playbill features pieces shaped around a theme, “A Crack in the Climate,” with subjects ranging from global warming and drought to GMOs and fracking. “The Place Where You Go to 32

Listen,” by Chico State English professor (and Slow Theatre co-founder) Rob Davidson, is a one-act centered around a Butte County farmer who loses his water allotment and can’t continue planting crops. He is faced with a moral dilemma when approached by an oil company offering to solve all of his problems.

“I wanted to ask the question, ‘What if the oil companies do come calling [in Butte County]?’” Davidson said. “Fracking is something that’s been on a lot of people’s minds. I’m hoping the play can take the issue seriously, without being preachy.”

Other one-acts on the bill include “Valley Fever,” by Troy Jollimore; “Transformation,” by Forrest Gillespie; “The North vs. the South,” by Johnny Lancaster, Michael Gannon and Roger Montalbano; and “The Leopard,” by Jesse Karch, which the author explained in a promo video is written in a newly invented “neoanimist” style and features an “eco-terrorist cell looking for this notorious leopard poacher out in the forest.”

This year’s eco-conscious theme has attracted the support of community partners that were “interested in telling the story with us,” Latimer said. Those include Butte Environmental Council and Chico Natural Foods Cooperative, both of which will host booths at this year’s festivities.

Members from Slow Food Shasta Cascade also will be on hand, offering cooking demonstrations using local foods. “I like the metaphor of cooking something from scratch while Butcher Shop makes plays from scratch,” Latimer said.

More than aligning with this year’s green theme, the presence of the slow food movement also fits neatly with the ideals of Slow Theatre. “With slow food, you don’t buy food beyond 100 miles of your home.

You keep it local,” Latimer said. “Similarly, we can’t pick plays that are New York hits and expect people in Chico to find them relevant. So we’re producing our own work, and looking to adapt from local writers, to keep everything in our area.”

Though many of the returning Butcher Shop artists and performers are no longer Chico residents, they were all once part of the local theater scene, and every Labor Day weekend they fly in from Los Angeles, Portland and New York City to replant their roots in the orchard. And this year, the growing Butcher Shop family—both former and current Chicoans—will meet under the stars and attempt to keep local theater fresh and, hopefully, Ω entertaining.

You say tomato …

Sampling more than 40 varieties at GRUB’s tomato festival hat do a pork chop, Abraham Lincoln and Berkeley W tie dye have in common? All are the namesakes of tomato varieties, three of the more than 40 grown in and

around Chico, and sampled Sunday (Aug. 24) by an eager crowd at the Tomato Fest. After a by one-year hiatus, Sherri Scott and her Claire GRUB Education Program crew Hutkins-Seda were back in action for the fifth edition of the normally annual event, which is a fundraiser for the program and, more importantly, said Scott, a great community-builder.

“Ones with different colors have specific profiles: The blacks are more smoky and meaty, the yellow is more fruity, and the green can be more complex.”

Smoky and meaty tomatoes?

Yes, in fact, Scott claimed one of 2012’s most popular tomatoes, Moskvich, a small red heirloom variety, had “a hint of bacon” that year, but it lacked that meatiness this time around, she said. Nonetheless, it came out on top again, scoring more points than the beautiful hybrid called indigo apple. The indigo is a mostly red, small tomato with black

shoulders, and it’s actually considered a blue tomato thanks to its heightened levels of the anthocyanin pigment, which also is present in blueberries. It was a favorite of participant and Chapmantown resident Patti Garron, who grabbed another toothpick to sample it again, in order to describe the flavor correctly: “It’s heavy. It’s got a really rich flavor and it isn’t watery,” she said, standing in the shade of the huge walnut tree at the GRUB Cooperative on Dayton Road. “It’s full-bodied, and I think it would cook down and make a good sauce,” she added.

At the other end of the tables, participant Bryce Ruff ordered a watermelon-mint smoothie and, not surprisingly, a tomato pizza from GRUB Cooperative’s cob oven, and sang praises on the striped Berkeley tie dye, his vote for best tomato. “It seemed like it had the most flavor—a tangy, sweet flavor.”

Participant Syb Blythe voted for the yellow-andgreen-striped green zebra, the first green tomato she’d ever tried. “It has a lively, zingy tomato flavor. You wouldn’t think it would taste as tomatoey as it did.”

When asked if she had learned anything from the event, she responded confidently: “Don’t be afraid of the weird green and yellow tomatoes!” Blythe entered the concurrent salsa contest, where participants were gobbling up her offering—an old recipe from her days as proprietor of Juanita’s, the long gone, but not forgotten, downtown Chico restaurant/nightclub. Her cilantro-laden entry nabbed second place.

The varieties this year were grown by Scott and other local farms—Farmelot/ Riparia, GRUB CSA Farm and Heartseed Community Farm. And the winners? “Tomato votes [were] all over the place with a few clear winners, but heaviest for sun gold and Moskvich,” Scott reported at the end of the day. Interestingly, both were the heaviest producers in her garden, she noted. Sun gold, the “gateway tomato for kids,” as Scott calls it, is a hyper-sweet almost candy-like cherry tomato, that “is always a winner.” Ω

week reception it’s been given, both at the box office and in the reviews.

In 2005, Sin City was both a commercial by Juan-Carlos success and a kind of cult favorite. Nine years later, Frank Miller’s Sin City: A Dame to Kill Selznick For is off to a very slow start on ticket sales, and even the cult status seems in doubt. But both films, it seems to me, are pretty much equals in terms of movie entertainment, with Dame perhaps having a slight edge in a couple of key respects.

With both movies, there are several elements of strong appeal and interest—a large Sin City: and striking array of strange and variously A Dame to twisted characters, a sultry and freewheeling Kill For set of generic crime-in-the-city stories to tell, Starring Josh the savagely comical pastiche of film noir and Brolin, Jessica Alba, Mickey genre heroes, the spectacular visuals (part carRourke, Rosario toon, part live-action, mostly black and white, Dawson and with occasional dashes of red, green, yellow, Joseph Gordon- etc.).

Most of that counts more in the film’s favor Rated R. than not. But in the matter of pros and cons, those strong points get hefty challenges from some built-in weaknesses and limitations. Both films are in a sense more interested in costume and cosmetics than in character. Dame seems less insistently violent than its predecessor and, as perhaps signaled by its spoofy subtitle, there’s more respectful attention for the female characters, especially those played by Eva Green, Jessica Alba and Rosario Dawson.

Neither film, however, is able to get beyond the fetishistic eroticism of its basic premises. And neither brings much conviction to the emotional and spiritual darknesses in which they are trafficking.

fatale of this tale, is a particular standout.

Alba’s Nancy Callahan, strip-club dancer and angel of life/death, and Dawson’s Gail, dominatrix and house mother, are captivatingly deadly as well. John Hartigan (Bruce Willis) is a ghost of himself, literally. Senator Roark (an understated Powers Boothe) and hulking Marv (Mickey Rourke) continue as before.

Josh Brolin is a welcome presence as avenger Dwight McCarthy, but not so great that you don’t miss Clive Owen, who had the role in 2005. Whiz-kid gambler Johnny (Joseph Gordon-Levitt) deserved to be a bigger part of the story. The wheeler-dealer power broker Wallenquist (Stacy Keach) is a grotesque human carbuncle, Humpty Dumpty in a business suit. Bodyguard/chauffeur Manute (Dennis Haysbert channeling Shaquille O’Neal) is also the man with the golden eye. Ω

Boyhood

Boyhood is such a beguiling array of time-capsule moments—12 years in the life of a boy growing up in the vicinity of Houston, Texas. Part of what’s intriguing, of course, is the project’s central concept: its bits-and-pieces story proceeds year by year, through scenes filmed year by year as Ellar Coltrane, the young actor who plays the central character (whose name is Mason), grows up. He’s 6 at the start and 18 at the finish. And part of it is also that writerdirector Richard Linklater’s approach to story and drama is so casual and easygoing, even though resolutely unsentimental. The movement through these fragments of time is both seamless and unhurried. The passage of time in this story is always in motion, as is the film’s sense of “boyhood.” Linklater evokes the recent past, but his time-capsule movie has no frozen moments, and it reminds us more than once that even the most significant moments never really stand separate from the flux of all existence.

Chef

There’s much else on his film’s menu, but writer/director/star John Favreau is unmistakably the presiding spirit at the heart of this rollicking crowd-pleaser.

Favreau plays Carl Casper, a Florida-based chef and gourmand given to robust tastes and adventurous cuisine. He’s also trying to be more of a father to young Percy (Emjay Anthony), who lives mostly with Carl’s exwife, Inez (Sofía Vergara). Renewed attention to family responsibilities becomes even more complicated when Carl has a falling out with the restaurant owner (Dustin Hoffman) who bankrolls his culinary endeavors. With a little help from a friendly assortment of old pals and former associates, Carl rebounds from these setbacks by setting up business in a refurbished food truck and taking it on the road, heading west from Florida, with Percy and longtime sidekick Martin (John Leguizamo) on board as his crew. There’s an amiable sort of predictability to most of this, and it may be only the prevailing spirit of rambunctious camaraderie that holds the story and its characters together. Pageant Theatre. Guardians of the Galaxy

If someone was gonna make a swell comic-book movie despite the aggressively calculating influence of both Disney and Marvel it would be writer/director James Gunn. And yep, he did it. Gunn was writer of the better-than-the-original remake of Dawn of the Dead and he’s been a filmmaker to keep an eye on since graduating the Troma School of low-budget filmmaking, and writing, producing and starring in The Specials, one of the first deconstructionist swipes at superheroes. The story here: Charming half-human/half-alien rogue Peter Quill (Chris Pratt) steals a MacGuffin and teams up with a band of misfits—including a foul-tempered talking raccoon and a sentient tree (voiced by Bradley Cooper and Vin Diesel, respectively)—to avert the destruction of the galaxy from some intergalactic dude. It’s kind of shambolic, but in a good way, and easily the most entertaining movie of the year, a delirious romp through the CGI cosmos. Gunn isn’t shy about wearing his influences on his sleeve, evoking the best aspects of the original Star Wars, Joss Whe-

The Hundred-Foot Journey

The cinematic meal served here is tasty but not very filling. There is some real appeal, however, in the basic setup here. A refugee family of Indian restaurateurs, the Kadams, moves into a picturesque French village and opens up Maison Mumbai, a grand-looking Indian restaurant, just across the road from a Michelin-rated French restaurant, Le Saule Pleureur, run by the snooty Mme. Mallory (Helen Mirren). A mildly impassioned rivalry develops between the two establishments, and between the two proprietors, the widowed Papa Kadam (an ebullient Om Puri) and Mme. Mallory, herself a widow. And there are other complications of note. Hassan (Manish Dayal), the eldest of the Kadam sons and a chef of special gifts, gets involved—romantically, professionally and otherwise—with Marguerite (Charlotte Le Bon), a comely sous chef working for Mme. Mallory. But The Hundred-Foot Journey means above all to offer up a pleasant array of good feelings. It does that often enough that the presold audience for which it was made is not going to worry too much about the childish simplicity of the characterizations or the dull predictability of emotional scenes. Magic in the Moonlight

The new Woody Allen picture offers up a number of characteristic enticements—a mixture of romantic comedy and philosophical reflection, a period setting (Europe in the 1920s), and a frisky and attractive cast. The basic plot has a sardonic master magician (Colin Firth) setting out to expose a young American spiritualist (Emma Stone) as a fraud. Romantic complications ensue (both characters are engaged to marry others, but second thoughts begin to rise) and the quasi-ruminations (“scientific” rationalism vs. “magical” intuition) impinge on much of that. Allen’s script seems uncharacteristically labored. The familiar themes and moves are there, but the inspiration is too often lacking, especially with Firth’s debunker/illusionist, a doggedly sour sort only partly salvaged by the actor’s charm.

the DEVO compound this weekend, as Art and Mrs. DEVO would be enjoying (which we have) the “Every Simpsons ever” marathon on FXX—wherein the network celebrates acquiring The Simpsons’ syndication rights by airing all 522 episodes of the show in a row between Aug. 21 and Labor Day. It’s not a stretch to say that The Simpsons has been a major part of our married life. It’s one of the shows we both enjoy, it started about the same time we did, and it’s provided a hilarious commentary on life as we lived it together and with the endearing Simpsons. We even recorded more than 300 of the episodes onto 40 or so VHS tapes (that we gave away a few years ago), and we quoted it to the point Aaaaay! It’s Homer. of weaving the show’s dialogue into our vernacular over the years: “I don’t know, was I drunk?” “It tastes like burning.” “You don’t make friends with salad!” “Remember when I took that home-winemaking course and forgot how to drive?”

However, despite the nice little nostalgic high we’ve been enjoying, my buzz has been kind of killed by ads for the new season of Family Guy, which have been promoting a (sigh) crossover with The Simpsons for its season opener. Even though I’ll admit to not digging the last several years of The Simpsons, I’ve never liked Family Guy—but not for the reasons given by its more uptight detractors. It doesn’t bother me that it’s insensitive, crude and lowbrow—many of my favorites (Jackass, South Park) peddle in the puerile. I just don’t enjoy the show’s modus operandi of stacking mismatched pop-culture references on top of strained nonsequiturs until it’s padded out its 20 minutes of air time. It’s like those gross-out junk-food experiments where Skittles are sprinkled on a Big Mac that’s wrapped in a family-size pizza before being deep-fried in one dense wad of nothing.

(But only the food in this comparison will actually bust your gut.)

It wouldn’t really bother me (and yeah, I realize I’m spending precious moments of my life being bothered by something created by Seth MacFarlane) if the random bits and references were funny. I admit that I’ve seen only maybe a dozen partial Family Guys, but I’ve never laughed at a single bit while watching it. I’d seriously rather watch almost anything—dumb reality shows, Fox News, Mama’s Family, even hockey!

Sadly, much of the latter half of The Simpsons lifespan—with the exception of 2007’s The Simpsons Movie and a random episode here and there—has resided very close to the eye-rolling Family Guy dead zone that makes me groan and talk out loud to the TV. But this really is the end. Even though there have already been many sightings (and more than one episode depicting actual shark-jumping), on Sept. 28, The Simpsons will officially be dead.

LOVE’S REAL ESTATE Tracking the Billions “Where do all the billions go?” is a popular question from callers and e-mailers. The billions they are referring to are the billions of dollars in settlements and fines from banks prosecuted for mortgage fraud and the accompanying crimes that brought down the U.S. economy in the recent past.

The next question is usually, “Do regular people ever see any of it?”

Here’s one place that received some of the billions: Keep Your Home California, a state-run program paid for by the U.S. Treasury Department’s Hardest Hit Fund, which has a multibillion-dollar program to help people suffering from mortgage crises.

They’ve received a big response from people with questions about the program, and they have lots of success stories of people they’ve helped.

Keep Your Home California has four parts: • Mortgage help for the unemployed, up to $3,000 per month.

•

Mortgage help for people with “documented financial hardship,” up to $25,000.

•

Relocation help for people in the midst of a short sale, up to $5,000.

•

Reduction of principal balance on mortgages, up to $100,000.

Keep Your Home California says they have helped 43,479 Californians through their four programs and saved households that are behind on loan payments or close to default.

The program has recently made changes in eligibility guidelines, opening up help to more people.

“This expanded eligibility will allow more families to qualify and receive greater assistance,” said California Housing Finance Agency Executive Director Claudia Cappio. “We are continually evaluating our experience, and making adjustments like these based on the initial results of the Keep Your Home California program.”

The new changes include: • Allowing homeowners who completed “cashout” mortgage refinancing to take part in the four programs.

•

Allowing borrowers who own more than one property to apply. Program officials said this will be particularly helpful to those who co-signed on properties for family members.

•

Offering mortgage aid to unemployed borrowers for 12 months, instead of six. Such homeowners can get up to $3,000 a month.

To qualify, you must receive unemployment benefits.

•

Reinstating up to $25,000 in past-due mortgage payments instead of the previous $15,000 cap.
