Environmental problems in Northern California are worsened by top-down governmental attempts to shift water to other locations. The recent removal of groundwater to support water diversion that already overuses surface water is even more inappropriate. more water from Northern California. The demand that all Californians finance this highly expensive movement of water from Northern California to support inappropriate agriculture in dry environments at the expense of native environments is unacceptable.

Organisms from the High Sierra to San Francisco Bay are linked together by water in multiple ways. The Delta and the San Francisco Bay are intimately connected, and a water bypass of the Delta will reduce water quality and change essential living conditions of the plants and animals that live in and move between both areas.

Our plants and animals are adapted to survive under annual wet and dry seasons as well as a successive number of very dry or very wet years. As Northern Californians define and discover their place in the Sacramento River Basin, we realize much of our happiness comes from these marvelous natural ecosystems that are more valuable than the water sent south.

An increasing number of individuals and institutions are banding together to block actions challenging the California we love. I support AquAlliance, an organization legally qualified to defend Northern California waters. Also, if you have a well, join the AquAlliance well-monitoring program to further help the protection of your water rights. Ω

The budget calls for a 10.8 percent increase in funding for higher education. That translates to an additional $142.2 million, an increase that is designed to avoid further student tuition and fee increases in the University of California and California State University systems.

Brown also proposes to eliminate the California Community Colleges’ outstanding deferral debt, some $592.4 million the colleges borrowed from the state during the recession.

The increased funding is available because California’s economy is improving, and also because in November 2012 voters approved Proposition 30’s temporary tax hikes. Brown has said his goal for the UC and CSU is to give them “steady and predictable” funding through the next three budgeting cycles.

In return, he wants them to meet certain expectations: that student fees and tuition will stabilize; that students will complete their degrees in four years, not six; that the number of students completing programs will increase; and that more community-college students will transfer to fouryear institutions.

If the higher-ed budget has a shortcoming, it’s that it doesn’t create more room for students, especially low-income students. Many will be turned away. It’s a problem that can be solved, at least in part, if the colleges and universities work harder to move students through more speedily and foster increased community-college transfers.

In the meantime, students and their families will now have the comfort of knowing they won’t be blindsided by surprise tuition hikes, and college and university staffs—which have been in crisis mode since the recession began—can begin to relax. And local economies like Chico’s that rely heavily on the money their universities and colleges generate can begin to breathe easier as well. Ω

No more ‘trust us’ In his recent speech outlining the changes he plans to make in

the National Security Agency, President Obama walked a tightrope between the recommendations of his own blue-ribbon panel and the wishes of the government’s intelligence community.

He was unwilling to go as far in limiting the powers of the NSA as his panel had recommended, but he also made it clear that he accepted the critique being made of the NSA and pledged to rein in its most troubling program, the bulk collection of telephone metadata.

As the president said, “Given the unique power of the state, it is not enough for leaders to say, ‘Trust us, we won’t abuse the data we collect. …

Our system of government is built on the premise that our liberty cannot depend on the good intentions of those in power; it depends on the law to constrain those in power.”

Specifically, he said, telephone bulk collection “could … open the door to more intrusive bulk-collection programs in the future” and, while it was authorized by Congress, “it has never been subject to vigorous public debate.”

Obama wasn’t ready to abandon the program altogether, however.

Some entity, private or public, will continue collecting and storing the data, but the NSA will have to get court approval to search the collection. That won’t entirely please the civil libertarians, but it’s certainly a step in the right direction.

Most important, the president has set the stage for Congress to act. By underlining the importance of privacy protections and admitting that “trust us” is no longer valid, if it ever was, he has issued a challenge to lawmakers and the public alike: Keep moving in this direction.

It’s the kind of positive change Edward Snowden was hoping would occur when he began revealing the truth about the NSA. Ω

Change of mind About two months ago, the Chico City Council was supposed to hear an appeal of the Bidwell Park and Playground Commission’s decision to issue Orchard Church a permit to use City Plaza for its homeless-outreach program—the Sunday-evening gathering the group had held at that location for more than five years.

But that appeal never happened. The night before the meeting, Jim Culp, pastor of the church, made a deal with the city to hold the gatherings elsewhere—near the “Our Hands” sculptures on the east side of the Chico Municipal Center. He could do so without a permit and the related fees, which would have amounted to about $3,000 per year.

Of course, that decision made the appeal moot. The public never had a chance to weigh in on the issue. Those who showed up to speak about it watched, along with me, the whole flap come to an anticlimactic conclusion. We heard the city manager give a brief summation of how the church had withdrawn its application. We listened as Culp gave a diplomatic speech about how the church was still committed to helping people get a second chance. We heard nary a word from the dais.

I wrote about that decision in a news story, and in an editorial I said that Culp had taken the high road by accepting the compromise. I pointed out that the church had been operating without any complaints from the public and had been unfairly singled out. But, like most other people, I moved on to other things in the news cycle.

One person who didn’t move on was CN&R reader Patrick Newman. See, Newman had been in the gallery during that meeting, with a prepared statement in hand.

He wanted to point out that the program had done great good. He wanted to tell the council how unfair it was to further marginalize a group of vulnerable folks at the behest of a few deep-pocketed residents.

And Newman is on a crusade to make that known. You can read about his journey from that council meeting to his activism at the corner of Fifth and Main streets in this week’s CN&R cover feature, “Out of sight, out of mind.”

Between his letters to the editor and some email correspondence, I asked Newman, whom I’d never met, if he had any interest in writing an essay on the subject. He’d gotten my attention. Moreover, he’d changed my mind: The compromise was not a win-win; it mostly benefited a small interest group of wealthy property owners.

I understand why Jim Culp made a deal to move his church’s outreach program. He had a lot to lose. Still, I wish he would’ve let it all play out in the City Council chambers. I think that could have been a turning point for Chico—and for our elected officials—on where we want to go as a city when it comes to the destitute among us.

The only watershed moment, it seems, happened for Patrick Newman.

What about the birds?

Re “Don’t delay on flu vaccine” (Editorial, Jan. 16): Butte County Health Department, pharmacies and hospitals are doing a great job getting people vaccinated against the flu. However, I was disappointed to learn that our county and state are not testing dead birds for the flu virus.

My wife found a dead bird in the gutter on Ceres Avenue. I called the county and they aren’t testing dead birds and referred me to the state. The state also isn’t testing dead birds and referred me back to the county mosquito department in public health; this year, they are not funded by the federal government, nor is the state funded, to test dead birds.

That night, my wife reported this on the Internet. She was informed there have been 42 reported dead birds in Butte County (we don’t know the time period). Our case is ID#598740.

My college degree is in public health so perhaps I have more interest than most.

No sympathy for students Re “Give us a (longer) break, Chico State” (Guest comment, by Michael Fitzpatrick, Jan. 16): In his plea for a longer winter break, Mr. Fitzpatrick rebuts Chico State’s rationale for shortening the break “from the traditional five weeks to four weeks.” This is a telling position to take, not in reference to the university’s budget standpoint, but from that of the student!

How well-funded must a university student be that he can afford to live for five weeks without his ostensible raison d’etre to be “in gear”? As a graduate of Chico State, I personally could never have financially borne such a period of “time off to recharge.”

Most of the students of my acquaint—back in the ’60s—were in the same boat, which is to say that their budgets were largely or entirely dependent upon summer jobs.

In my own case, without my working a long, arduous summer each year—I was a forest firefighter, and eventually a USFS crew boss with a fire station of my own to manage (highest wage: $2.85/hour) for five summers—college would have been impossible, and Vietnam my destination courtesy of the draft, in short order.

It is beyond my experience to understand how a student can survive such a prolonged school year, however stringent his budget.

Ah, but there is a sliver of hope.

Next month, I may be able to put an electric motor on Lady Sapphire. If that is successful, then maybe I can challenge the Tesla to a race. It wouldn’t be the first impossible dream I’ve tried and failed.

I recently learned that City Attorney Lori Barker is retiring.

I am happy for her, but worried for the city she served so well.

Barker’s great sense of fairness and what is right will be missed.

The city was her only client.

We were better council members, a better council and a better city thanks to her professionalism.

What worries me is that the position of an in-house city attorney may be contracted out to a private firm. That would be a costly mistake. The cost of an outside firm providing the same level of service and accessibility to it would be more.

The value of day-to-day legal advice to staff may not be quantifiable, but it is huge. An even greater loss if attorney services are contracted out is the intrinsic value

of the city attorney position. The city attorney is one of only two city positions hired by the council.

The other is the city manager.

The city attorney reports directly to council as an independent legal voice responsible to council on behalf of Chico, its client. The position is an important balance and buffer to the city manager. The in-house city attorney position has a significant procedural and substantive role in the running of our city. Whatever budget balancing may be desired, we cannot afford to lose the systematic checks and balances of a city well-run.

Two on drought designation Gov. Jerry Brown has suspended the environmental laws that keep Southern California from draining North State water resources. Those laws set tough standards for transferring water south in consecutive years—and this year will be the second consecutive year. Now, there will be no consideration of the impact on the local environment or on local groundwater supplies, which are already trending downward.

But there is a last line of defense. Butte and Tehama Counties have protected their groundwater from unsafe transfers to other parts of the state. Butte County has transfer requirements that probably can’t be met during a drought, and Tehama County substantially prohibits it.

However, Glenn and Colusa counties—dominated by agricultural interests hoping to profit from selling water south—have implemented no protection at all.

Groundwater aquifers cross county boundaries and it is possible to suck water out from under neighboring counties as groundwater pumping is increased to profit from the demands of the San Joaquin Valley.

So the big questions are these: Will Glenn and Colusa counties summon the political courage to join Tehama and Butte counties in protecting North State groundwater against unrelenting pressure from influential locals who want to profit from selling water south? And if they can’t, is there anything neighboring counties can do about it?

wet. Had 20th-century agencies and entrepreneurs been aware of California’s arid average, it is unlikely they would have invested so much treasure in building dams and canals to develop desert agriculture and grassy municipalities.

A balanced Central Valley aquifer system buffered the impacts of the mega-droughts, allowing valley oak groves to thrive, chinook salmon to migrate, and wetlands to endure the dry decades. The charged aquifer allowed Tulare Lake to persist and held Delta salinity at bay.

Surface reservoirs will not fill during multiyear droughts and will be operationally challenged when the wet conditions that California has come to expect recede into memory. “Groundwater substitution” water sales/transfers are irresponsible. Bailing out unsustainable desert agriculture by transferring Sacramento Valley groundwater to growers south of the Delta will only expand desertification north.

Conservative groundwater management is the key to California’s economic future. Aggressive conversion of Sacramento Valley aquifers into empty underground “reservoir” space only repeats the unrealistic expectations of illinformed investors and water planners.

Duh, it’s climate change A headline in the Chico Enterprise-Record on Jan. 19 read “Extreme drought continues in California.” Wow, that is breaking news! Duh, really? I didn’t notice that we in Northern California have not had any significant rain in almost 15 months!

Well, actually I have in that I seeded 35 acres of oat hay (the stuff that cows eat so they can give us milk, butter, sour cream, etc.) and none of it came up. I am new to farming, but if you can’t grow a weed in the winter here, there is something wrong.

I know it takes conservatives a long time to figure out there is a problem out there, but at least let’s admit there is a problem (I know it takes a while to finish saying, “Bad science ... maybe uh sunspots?”) and work together for a solution [to climate change]. By the way, I can see Mount Lassen from my farm, and believe me, it’s bald!

MEDI-POT CANDIDATE GETS SERIOUS

Medical-cannabis advocate Andrew Merkel has resigned as leader of the political action group Butte County Citizens Against Irresponsible Government (BCCAIG) to fully pursue a seat on the Butte County Board of Supervisors.

BCCAIG is pushing an initiative that would prohibit the supervisors from making further changes to the county’s existing medical-marijuana ordinance. Merkel, a Chico-based real estate agent and pot grower, contacted the CN&R by phone to announce fellow medi-pot advocate Denice Lessard will lead BCCAIG moving forward.

Merkel says he’s turning his full attention to vying for Supervisor Larry Wahl’s seat, which is up for grabs in the June primary election.

On Wednesday (Jan. 22), BCCAIG launched a radio campaign made up of six different 15-second ads urging medicalmarijuana supporters to show up to the supervisors’ Jan. 28 meeting. Meanwhile, the group’s referendum—intended for November’s general election ballot— remains in the drafting process and has yet to begin the signature-gathering process.

RECEPTIONISTS FOIL ROBBERY ATTEMPT

A man walked into Immediate Care Medical Center in Chico on Sunday (Jan. 19) apparently not in search of medical attention, but rather cash. According to a Chico Police Department press release, at about 7 p.m., Daniel Ruggiero, 37, entered the outpatient clinic on the 300 block of Vallombrosa Avenue and asked the receptionists to call him a cab.

He then asked how many employees were working and how many patients they had. Ruggiero reportedly told the receptionists to get a little girl who was in the lobby out of there, because something bad was about to happen.

“That’s probably what saved us,” said receptionist Michelle Genoba, “because it gave me the opportunity to go down the hallway and call 911.”

As soon as Genoba left, Ruggiero allegedly began demanding money while pretending to hold a gun under a sweater.

“If you scream and don’t give me the money, I’m going to shoot you,” the man reportedly said to receptionist Rebecca Ruiz (pictured).

Ruggiero grabbed Ruiz, and receptionist Ana Salamanca got up, pushed Ruiz aside, handed him the cash box and said, “If you want the money, just take it and leave us.”

At that point, unaware of the supposed gun, Genoba said she came back and began wrestling with Ruggiero.

When Ruggiero dropped the sweater, Salamanca said she noticed that he didn’t have a gun and began wrestling with him as well and helped force him to the ground. Upon hearing the commotion, X-ray technician Kent Rankin and medical assistant Juan Sanchez came out and helped hold Ruggiero down until police arrived.

“What really might have helped us is that we’re best friends,” said Genoba. “I was scared he was going to hurt [Salamanca] and she was scared he was going to hurt me.”

Hantelman said her neighbors and friends in the cattle trade report similar numbers, and their problems are just beginning.

“The reality is, we’ll all have to destock,” she said. “I’m looking at reducing my flock by 30 percent now. If we get no rain at all this spring, I might have to sell the entire herd.

“We’ve spent the last 10 years increasing our operation to make it financially successful,” she continued. “If we have fewer animals to sell or have to liquidate, it will have financial impacts that could carry over for years to come.”

Hantelman said fellow ranchers have also reported problems with securing drinking water for their animals, as features like stock ponds have already run dry at the height of winter, making it necessary to truck water pumped from wells or other sources to places it usually flows naturally for much of the year.

scientist with the Butte County Department of Water and Resource Conservation, said that some others are already feeling the drought’s pinch. She noted that water levels at monitoring wells recorded last fall were already at or near historic lows, and some people have already found that wells that have worked fine for years are now not deep enough to access groundwater.

“There’s definitely some vulnerabili-

ty, especially in areas that use water for both household and agricultural uses,” Buck said, citing the Durham-Dayton and Vina areas as examples.

“We’re in uncharted territory,” she said.

Buck explained that Butte County does have an emergency drought plan. A task force composed of representatives from her office and other entities, such as Cal Fire and agricultural stakeholders, usually meets once a year to discuss current water conditions and concerns. The group met in November, submitted a report to the Butte County Board of Supervisors earlier this month, and will meet more regularly throughout the drought crisis. Buck said a February meeting is in the works.

Those with shallow wells (under 200 feet) are the most likely to experience problems, she said, recommending wellusers be mindful.

“We want to make sure people know how deep their wells are, and that they’re prepared, in case they need to get water another way or dig their wells deeper.”

Vickie Newlin, the county’s assistant director of the Department of Water and Resource Conservation, said her department is also emphasizing the importance of neighborly cooperation to conserve water.

“We really recommend people work together,” Newlin said, explaining that pumping groundwater creates a temporary “cone of depression” in the underground aquifer, and for nearby neighbors pulling water from the same source, it becomes more expensive, less efficient

and places greater strain on limited resources.

“If you irrigate one day, maybe your neighbor could irrigate a few days later so there’s not as great a pull on the aquifer at the same time,” she said.

“Cooperation and communication between neighbors, especially in the farming community, is essential to helping us get through this.”

Some water-rights advocates

have criticized aspects of Gov. Brown’s emergency declaration, particularly as it calls for the expediting of water transfers to areas south of the Sacramento-San Joaquin River Delta. It also suspends some oversight regarding the environmental impacts of these transfers.

“Water transfers north to south have gone without any sort of comprehensive analysis for well over a dozen years,” said Barbara Vlamis, executive director for local water watchdog group AquAlliance. “Expediting these transfers, as well as eliminating analysis from the California Environmental Quality Act, compounds the problem.

“Nobody can deny that we’re having critically dry conditions, which certainly plays into what’s happening here, but gross mismanagement and lack of planning is at least 80 percent of the problem,” she said.

Newlin acknowledged water transfers can affect the hydrological health of the North State, but said she’s more concerned about the possibility of more austere measures that might be taken down the road if inflow to Northern California’s large reservoirs remains low.

She explained that, because of agreements made during the building of Shasta and Oroville dams, some water districts with pre-1914 water rights may be forced to give up more water if drought conditions reach certain levels and certain agencies call for the cutbacks.

Some of the water districts along the Sacramento River have agreements with the U.S. Bureau of Reclamation, while others along the Feather River have similar arrangements with the California Department of Water Resources. The former organization could cut back 25 percent of the water it shares with some users along the Sacramento, allowing only 75 percent of surface water from the river to be used on farms in those areas.

The latter organization can claim 50 percent of the Feather River’s surface water in any single year, and once every seven years can claim 100 percent of the water.

“Even if it’s cut back 50 percent, water districts with surface-water supplies will have to pump groundwater to meet their needs,” Newlin said. “There’s the potential for this to happen in Butte County and the Sacramento Valley.

“Everything is dependent on the balance of groundwater and surface water that gets used, and it’s a very delicate balance.” Ω

Lost in transmission KZFR Community Radio turns to listeners for help egular listeners of KZFR Community R Radio 90.1 FM may have noticed the station’s signal has been weak of late, particu-

larly in Butte County’s eastern foothills. On some radios, the station’s programs have been marred by static, while others lose the signal entirely.

“If you’re traveling south on Highway 99, the signal gets a little funky around Live Oak,” said Rick Anderson, KZFR’s general manager, during a recent interview. “Orland is still OK. Going east, the signal loses [clarity] around Stirling City. People are calling, wondering what’s going on; they’re upset they can’t hear us anymore.”

The fuzzy signal is due to the station’s transmitter, located in a remote and heavily wooded ridge near Magalia, which has been on the fritz since Thanksgiving Day. Anderson explained that a faulty temperature gauge has been falsely sensing that the transmitter is overheating, which prompts an automatic shutdown. After determining that the heatsensing unit must be replaced at a cost of roughly $2,000—in addition to the $10,000 KZFR has spent maintaining the transmitter since purchasing it for $40,000 in 1999— Anderson decided it was time to “stop throwing good money after bad” and install an entirely new transmitter. “[The transmitter] is the mechanical heart of the radio station,” he said. “The radio station is the transmitter. “Not having a healthy transmitter severely impedes our ability to be a part of the community, to reflect the community.”

As Anderson discovered, much has changed in the electronics industry since 1999. At $30,000, the new transmitter will actually be less expensive than the old one, but $10,000 more in improvements to the site’s air-conditioning and air-filtration system are needed to ensure the longevity of the new equipment, bumping the total cost to an estimated $40,000.

About $5,000 of that will be offset by selling the old transmitter, but KZFR will depend heavily on the community to bridge the gap.

On Tuesday (Jan. 28), the station will launch a crowdfunding campaign via Indiegogo.com that will run between a month and 40 days with a goal of raising $25,000. Additionally, KZFR will host a series of “Power to the Tower” benefit concerts at Chico Women’s Club, beginning Feb. 1.

The success of similar campaigns last year by the Pageant Theatre and The Bookstore, both of which were able stay open through crowdfunding, is a good omen for KZFR’s

prospects of staying afloat, Anderson said.

“I’m confident our community will come out and help us out. Our listeners want us to sound the best we possibly can, and this new transmitter is going to sound really good—it’s going to make our sound a lot fuller,” Anderson said. “I think the community will come to our aid and help protect the valuable resource KZFR has become over the last 24 years.”

For Anderson and the volunteer DJs

at KZFR, addressing the issue of the failing transmitter is just the latest challenge in their ongoing crusade to preserve community radio as a relevant medium.

In KZFR’s early days of broadcasting, for instance, the challenges were great. Programmers recorded their shows on a reel-to-reel tape machine, made the one-hour drive to the transmitting station and waited in real time as the shows were broadcasted. And while technology has made conducting some aspects of the operation much easier—such as the studio’s rooftop dish, which eliminated the need to drive to the transmitting station—it also represents traditional radio’s greatest threat.

“The industry is suffering in a lot of ways; radio in general has experienced decreased listenership because of all the different options,” Anderson said, referring to online music-streaming services. “New cars are coming out with Pandora [Internet Radio] in them, Wi-Fi Internet on the dashboard, or without radios at all.” Since about two-thirds of KZFR listeners tune in from their cars, Anderson said, that trend is particularly alarming.

But for KZFR specifically, the outlook is not all doom and gloom. In fact, the station’s annual pledge drive raised an all-time high of $50,000 last year. “I think it’s a positive reflection of our health as community radio,” Anderson said of the continual support KZFR has received from its listeners. “It’s obviously important to people—they find a place in their budget to help us. I’m convinced our audience is there for us.”

Court rules on fight between DA and local business n ongoing legal battle between AChico George Scott Sr., owner of Scrap Metal Inc., and the

Butte County District Attorney’s Office took a turn in federal court Jan. 17 that may signal the fight is over.

The matter goes back to 2008, when District Attorney Mike Ramsey filed charges against Scott for disposal of waste at an unauthorized facility and knowingly violating environmental safety laws.

Chico Scrap Metal owns four scrap-metal sites in Butte County, including the one in Chico on East 20th Street where soil tests on the site conducted by the Department of Toxic Substances Control (DTSC) in 2007 revealed contamination in the form of chromium, lead and zinc, as well as polychlorinated biphenyl (PCB).

Ramsey filed criminal charges against the company for failing to adhere to the DTSC’s order to clean up the site. The company’s owners, which include Scott’s grown children, pled no contest in Butte County Superior Court to two of the charges and were fined $700,000 by Judge Sandra McLean—$500,000 of which was to be used for cleanup—placed on five years probation, and ordered to comply with the cleanup directive.

The owners argued they had received inadequate legal representation and appealed their case to the U.S. District Court for the Eastern District of California, where they were represented by Bay Area attorney Therese Cannata.

Cannata, according to court

documents, argued the real motivation behind DTSC and the DA’s office in this case was financial gain, not public safety.

“Plaintiffs allege that the investigation was not intended to enforce California hazardouswaste laws, but that the investigation was instead intended to produce revenue for DTSC and Defendants,” the court documents say.

In November 2011, that court upheld the ruling against Chico Scrap Metal, which then appealed the decision to the Ninth Circuit Court of Appeals, where it remained dormant until it was assigned to a three-judge panel last week. The appeal was dismissed on Friday, Jan. 17.

DA Ramsey said Scott had a five-year extension to clean up the sites, but that the extension expired last year.

“Now it is up to the state Department of Toxic Substances Control to monitor the cleanup,” he said. “The DTSC, I believe, was a little reticent when they were being sued, but now that this is done, they can move forward.”

But Ramsey remains a bit pessimistic.

“Sometimes pushing a state bureaucracy can be a bit like Sisyphus pushing the rock up the hill,” he said. “But it’s important for the safety of the community, and from our standpoint, it’s back to DTSC and saying, ‘What are you folks doing?’”

Ramsey argues that if Scott had spent the money on the cleanup of his properties rather than legal

costs, he and the community would be better off today.

“Quite frankly, the law was fairly clear in this area,” he said, “but if you’ve got enough money and passion, you can keep it going for a long time.”

In a statement sent to the

Chico News & Review by Cannata’s legal office just before press time, the Scott family vowed to continue the fight.

“What’s important is that everything we have been saying is now backed by science, and the DTSC supervised investigation of our scrap-metal recycling yards,” Scott’s daughter Kim is quoted as saying in the statement. “There was never and is not now hazardous waste on our property.”

The cleanup is slated for all four sites—the one in Chico, one in Durham and two in Oroville, including one at the Highway 70 Industrial Park, which has a history of environmental problems dating back to the 1980s and includes three federal Superfund sites.

In October 2011, the Chico City Council gave Chico Scrap Metal a three-year extension to remain at its East 20th Street location. That decision came five years after the owners were told the business would have to move by the end of 2011 because of the Chapman/ Mulberry Neighborhood Plan rezone to change the area from light industrial manufacturing to a neighborhood/commercial district.

Letter raises a stink Council balks at LAFCo’s annexation demands threat to sue the city contained in what Afromveiled Councilman Mark Sorensen called a “harsh” letter the chairman of the Local Agency Formation

Commission (LAFCo) had some Chico City Council members in high dudgeon at their meeting Tuesday (Jan. 21).

“When I read the letter, to say I had a negative reaction is a massive understatement,” Sorensen said.

LAFCo is the über-agency that oversees crossjurisdictional development in the county, including annexation. It has seven members: two representing the cities, two representing special districts, two county supervisors and one public member, Chairman Carl Leverenz, author of the aforementioned letter, which was dated Dec. 19.

LAFCo and the city have been butting heads for several years because of the city’s practice of allowing sewer hookups in the Chapman/Mulberry neighborhood without requiring that the properties be annexed to the city, without obtaining authorization from LAFCo, and without paying LAFCo’s fees. Some 62 homes have been connected in that way.

Leverenz called these hookups “illegal.” He gave the city two options: Either “enter into a binding master annexation agreement to include a comprehensive extension of services authorization” or submit an application for the 62 unincorporated parcels, pay back fees in the amount of $37,200, annex the 26 parcels that are contiguous to the city and pay the

appropriate fees, and reimburse LAFCo $17,606 for staff time spent working on the matter. He gave the council only until Jan. 3 to decide, a deadline that fell before the council’s next scheduled meeting. Failure to do so, he said, would lead LAFCo “to consider legal action to compel compliance.”

Neither option was palatable to the council members, who didn’t take kindly to Leverenz’s hectoring.

For years, the city has been annexing county islands as LAFCo wishes, but now it no longer can afford to provide them with city services. In a few years, perhaps, but not now.

Councilwoman Ann Schwab, who is an alternate member of LAFCo, explained that the issue had its origins more than 20 years ago, when the state determined that septic tanks in Chico were polluting the shallow groundwater with nitrates. The city and county got together and created a Nitrate Action Plan, which called for the extension of city sewer lines along with annexation. That enabled the city to obtain funding and put in the lines. Thousands of homes, especially in north Chico, hooked up and were annexed.

LAFCo didn’t become involved until 2011, perhaps because the city was doing such a good job of annexation.

By then, Schwab continued, the city, which had recently extended sewer lines into Chapman/Mulberry, not only couldn’t afford to provide city services, it also didn’t insist on annexation. Most residents didn’t want it, and they had the backing of their county supervisor, Jane Dolan. Using a section of the government code that allows sewer hook-ups without annexation for health and safety reasons, the city continued to allow connections, but without LAFCo’s authorization.

“We did make some mistakes,” acknowledged Mark Wolfe, the city’s community development director. The city now refers sewer hookup applicants directly to LAFCo to obtain authorization, he said.

Steve Lucas, LAFCo’s executive officer, reminded the council that annexation doesn’t mandate additional services. Besides, having an annexation plan would “put the city back in the driver’s seat” on annexation, inasmuch as state law allows cities to annex unincorporated islands without the approval of their residents.

Council members, who know how insistent constituents can be when they want services, weren’t convinced. Ultimately, they voted unanimously to direct city staff to come up with a third option—a “win-win-win solution” for the city, county and LAFCo, as Schwab put it—and to pursue negotiations with LAFCo. In other council news: The panel unanimously approved an update of the Sanitary Sewer Master Plan to conform with the 2030 General Plan.

The sewer plan, prepared by Carollo Engineers Inc., predicts total flow into the city’s sewer plant will double by 2030, from 6.9 million gallons per day to 13.9 mgd. System upgrades will cost $63 million, with all but $9 million of that going to meet the needs of future users.

The council also approved four memoranda of understanding regarding pay and benefits for four employee bargaining groups, including firefighters. Assistant City Manager Mark Orme praised the employees for making benefits concessions— paying more for health insurance and pensions, in particular—to save money. The firefighters’ concessions alone will save $1.8 million, he said.

The average cost of transport in a ground ambulance in Butte County is $3,000, while annual individual or family membership plans— which provide medically necessary ambulance transportation for no or lower cost—are both available for $100, according to a Butte County EMS press release. The family plan covers the primary member, the member’s spouse or domestic partner, and other family members listed on the same income-tax return.

The membership program covers ambulance services provided by Butte County EMS, Willows Ambulance and Colusa Ambulance.

EMERGENCY ROOMS TOO SLOW

For the second time, an advocacy group has given California’s hospitals an “F” for speedy emergency-room treatments.

An updated report card from the American College of Emergency Physicians rated how well states support prompt emergency care, noting that California has the fewest ERs per capita in the nation at 6.7 per 1 million residents, according to the Los Angeles Times. The report’s authors called overcrowding in the state’s ERs a “critical problem,” finding that, on average, people admitted to a hospital after visiting the emergency room left more than 5 1/2 hours after arriving.

The authors said ER overcrowding is due in part to a lack of primary-care access for Californians newly insured through the Affordable Care Act who go to ERs for routine care.

The Golden State also received a failing grade in 2009, the last time the group produced its rankings.

DON’T JUST BLAME FAST FOOD

Even if eating at fast-food restaurants wasn’t an option, many children would continue eating poorly enough for them to remain overweight or obese, a study finds.

Researchers from The University of North Carolina at Chapel Hill looked at health and nutrition data on 4,466 American children ages 2 to 18, grouping them according to what they ate outside of fast-food restaurants, according to the Los Angeles Times. They found that the children whose consumption of non-fastfood items included relatively high amounts of saturated fats and added sugars—even among those who were considered “nonconsumers” of fast food—were the most likely to be overweight or obese.

The authors wrote that “the effect of publichealth efforts targeted at fast-food restaurants may … be overestimated, such that these efforts may be necessary but not sufficient to reduce child[hood] obesity if the remainder of the diet is not addressed.”

A view to a killer Tobacco still taking lives 50 years after landmark surgeon general’s report

A a widespread, widely accepted habit—so much so that tobacco companies half-century ago, smoking was

put doctors in cigarette ads and no one batted an eye.

We’ve come a long way, baby.

Today, tobacco marketing and packaging receive careful scrutiny. Anti-smoking campaigns are mainstays of mass media.

State governments levy taxes to discourage tobacco use and devote the proceeds to health and education efforts.

The turning point traces to a particular date: Jan. 11, 1964. That’s when Dr. Luther Terry, the U.S. surgeon general at the time, publicly tied tobacco to illness. The Surgeon General’s Office refers to his Report on Smoking and Health as “the first federal government report linking smoking and ill health, including lung cancer and heart disease”—adding, “This scientifically rigorous report laid the foundation for tobaccocontrol efforts in the United States.”

Bruce Baldwin clearly recalls that watershed moment. He was 10, living in Quincy, with a mother and father who smoked. Two years later, he’d pick up and puff his first cigarette, increasing over time to three packs a day before finally quitting more than two decades later. He now teaches smoking-cessation classes locally, including a program through Skyway House and his employer, the Butte County Office of Education.

“I really remember how much controversy [the report] generated,” Baldwin said in a recent phone interview, “and my dad’s response: ‘Oh, that’s BS!’ Basically they

both kept smoking and they both ended up dying from it. I ended up smoking for 25 years—you would think that watching my mother have her right lung removed when I was 8 or 9 years old would’ve kept me from wanting to. …

“As big as it was, and the impacts that have come from the report, 50 years later we’re still here fighting tobacco as the No. 1 public-health threat in America. Still one out of five Americans dies from using tobacco. You have lot of people who think we’ve won this war because kids get that smoking’s bad … but one out of three people who try it get addicted, so if the industry can get just one kid in every sixth-grade class in America, they’re set for life.”

Statistics underscore the concern.

Though the rate of smoking in America has more than halved since 1964, dropping from 42 percent to 19 percent, the U.S. still has around 44 million smokers. They include more than 3.5 million Californians—200,000 of whom are under age 18.

The state’s smoking rate is 13 percent, the

secondlowest in the nation, but like many rural areas, Butte County is significantly above the average, at almost 21 percent.

“We’ve got to do better in rural America,” Baldwin said.

The American Cancer Society estimates tobacco use contributes to 443,000 premature deaths a year, plus 3,400 nonsmokers exposed to secondhand smoke, and costs the country $193 billion a year when adding lost productivity to healthcare expenditures.

“Tobacco is still the leading preventable cause of death in the United States,” said Jim Knox, vice president of advocacy for the Cancer Action Network, when reached by phone at his office in Sacramento. “I don’t think people realize the continued toll—from a health perspective and a financial perspective—that tobacco takes. Smoking kills more people than AIDS, alcohol, murders, car accidents, suicides and fires combined.

e-cigs, represent a fresh wrinkle.

The U.S. Food and Drug Administration does not regulate e-cigs— handheld devices that resemble tobacco cigarettes but emit nicotineladen vapor instead of smoke.

“We don’t have data on the health impacts at this point,” Knox said. “There are definitely carcinogens in a lot of the e-cigarette liquids that are vaporized, but we still don’t know more than we know about electronic cigarettes at this point.”

Particularly worrisome to tobacco-control experts, Knox added, are a rapid rise in the use of e-cigs by teens and “the prospect that electronic cigarettes may help to renormalize smoking.”

As Baldwin knows firsthand, the average smoker tries his/her first cigarette at age 12. Those who successfully shake the habit will have attempted to do so an average of seven times—though Baldwin said he tried hundreds of times over 25 years.

“It is kind of like the perfect storm of addiction with nicotine— the fact that it’s legal, it’s readily available, there are cues and triggers everywhere, and it clearly helps people deal with stress, so HEALTHLINES continued on page 14

the stress of addiction becomes a reason they pick up a cigarette,” he said. “Scientists and researchers say [nicotine] is harder to quit than heroin or cocaine.”

Karen Vollman, a respiratory therapist at Feather River Hospital, also helps North State smokers quit. She says smoking can be “one of the only forms of pleasure for some people” and affirms that many people use nicotine—“a brain stimulant and muscle relaxant”—to “self-medicate to reduce stress.” As a result, “for someone interested in quitting smoking, the hard part is finding the alternatives that work and that satisfy them.”

She continued: “Quitting takes practice. When someone’s smoked hundreds of times—every day, ever since they were 12 years old—it’s hard to learn new behaviors. It can take several methods and techniques.” Ω

CALIFORNIA’S DROUGHT OFFICIAL

On Jan. 17, Gov. Jerry Brown declared a drought emergency for the Golden State, and asked Californians to voluntarily cut their water use by 20 percent.

Just prior to Brown’s declaration, some cities had already implemented water-use restrictions, according to Al Jazeera America. Residents of Folsom must limit lawn-watering to twice weekly and use a shutoff valve on hoses while washing cars. Folsom Lake’s water level is currently so low that the remains of a 19th-century town submerged in 1955 have reappeared.

The city of Santa Cruz, whose primary water source is Folsom Lake, is telling residents they cannot wash paved surfaces and may be cited for watering their yards between the hours of 10 a.m. and 5 p.m.; additionally, restaurants there are allowed to serve water only upon request, and swimming pools cannot be drained and refilled.

The Sacramento City Council had also recently voted to require a reduction in water use of 20 percent to 30 percent, and a drought emergency was declared for Mendocino County.

BEARS FORCED TO EAT TRASH

In more drought-related news, black bears in the Lake Tahoe area are roaming around in search of garbage to eat instead of hibernating.

“We have had black bears in the Tahoe Basin that have actually either not hibernated, or in most cases hibernate just a little bit, and then wake up on garbage night,” said Chris Healy, Nevada Department of Wildlife public-information officer, in a California News Service article.

“Basically, [they] follow the garbage truck around, eat for a couple of days, and then go back into hibernation.”

The bears’ normal food—berries and nuts—are in short supply due to the drought.

TAR-SANDS AND THE DAMAGE DONE

Rock musician Neil Young kicked off a recent four-stop Canadian tour with some strong words about tar-sands oil production in the province of Alberta.

Just prior to the start of his “Honor the Treaties” tour, Young (pictured)—a Canadian expat who lives in Northern California—held a press conference in Toronto denouncing the rapidly expanding tar-sands industry in Alberta, according to an article in the Toronto Star. He called the controversial tar-sands project a “devastating environmental catastrophe” and accused Canadian Prime Minister Stephen Harper and his Conservative party of “selling out their grandchildren’s future for the sake of short-term financial gain,” the article said.

Young’s Canadian tour is a fundraiser to help the Athabasca Chipewyan First Nation’s legal battle to stop “reckless development” by the petrochemical industry and have the tribe’s constitutional right to be consulted about such development be honored.

Seed-saving savvy Workshop series focused on growing vegetable plants to save their seeds story and photos by

classroom—not in their backyards. But for Redwood Seeds co-owner and seed grower Kalan Redwood, the use of Latin is essential for seed saving.

“The basic rule of thumb is that anything that [is in] the same species will cross-pollinate,” she explained recently by phone. Broccoli, which is categorized as a Brassica oleracea, is a prime example.

“Things that will cross-pollinate with broccoli include kale, cabbage, Brussels sprouts, kohlrabi, cauliflower,” because all of those plants are also categorized as Brassica oleracea, noted Redwood, “so we can plant only one of them” for seed saving.

A cross-pollinated plant will still produce seeds, but it’s anyone’s guess what type of confused plant will grow from those seeds. Redwood, therefore, pays attention to the scientific names of plants— the genus and species—to assure herself that, at the end of the growing season, she has no unwanted cross-pollination and will have reliable seeds for the next year.

At Cultivating Community North Valley’s upcoming workshop for seeding coolseason plants, Redwood will guide participants in planting a hardy spring garden from start to finish, with seed saving in

mind. At the workshop, “we’re going to plant broccoli. It’s one of the only Brassica oleracea that will go to seed in one season—it doesn’t have to go through a winter; it’s not a biennial [(like carrots or onions)],” making it a good candidate for beginning seed savers, as the wait time for seeds is abbreviated.

Gardeners can grow all the varieties of Brassica oleracea they wish—but in order to save seed, only one may be allowed to flower (which is unlike other plants, such as squashes—their flowers are needed to produce the vegetables).

CCNV’s Jan. 25 workshop is the first in a six-part series. The focus for part two (Feb. 22) will be on “transplanting the cool-season things,” Redwood said. “In March, we’ll seed the warm-season things, and then transplant the warm-season things

in April. In June, we’ll be harvesting the seeds from the things that we’re seeding in this workshop.

“By June, all the lettuces and the broccoli will have gone to seed and will be dry … so we’ll harvest those seeds, and clean and process them. In August, we’ll have the last workshop, where we’ll harvest and clean and process the warm-season [seeds], like tomatoes and cucumbers.”

Participants who attend all the workshops will gain a “very comprehensive idea of how to save seed,” in addition to all the basics of cool- and warm-season vegetable planting and care. They’ll go home from the first workshop with six-packs of planted seeds such as arugula, Green Wave mustard (which is Brassica juncea, not Brassica oleracea), and cilantro, for their own gardens. Redwood notes that a greenhouse is not required to grow cool-season plants; participants may choose to grow their starts from seed in a sunny window, or bring the six-packs inside on colder nights.

As with other CCNV workshops, signups are first open to low-income gardeners, after which the general public may register.

CCNV’s gardening workshops are funded by the California Department for Food and Agriculture Specialty Crop Block Grant.

SQUIRRELS & BIRDS! The next two Saturdays, Jan. 25 and Feb. 1, Chico Creek Nature Center (1968 E. Eighth St.) is hosting two events: The Secret Life of Squirrels Preschool Program and Birding in Bidwell Park, respectively. The squirrelcentric program, for kids ages 3 to 5, runs from 11 a.m. to noon and costs $12; the birding event is open to all ages (binoculars and field guides are provided) and a $10 donation is suggested. Plants that participants grow from seed at that workshop will be transplanted into the seed-saving garden at the Chico Grange Hall during the February workshop. Seed collected from those plants will be used by the GRUB Education Program in community gardens across town.

The six workshops will also cover basic seeding technique and flower anatomy, pollination, and the many “quirks” of seed saving, like “isolation distances”: how far away plants must be from one another to prevent cross-pollination.

The distance varies greatly, said Redwood: “For lettuce it could be 10 feet, but for these Brassicas, it can be up to a quarter mile. It definitely can be a concern,” she said.

Redwood recommends collaborating with neighbors to prevent cross-pollination with plants on the other side of one’s fence.

“Once you learn these basics of

not letting things cross-pollinate ... it is easy to incorporate saving seeds,” Redwood said. “An obvious benefit is that it’s a real money saver,” compared to buying plant starts. Another benefit is that gardeners can also attempt to avoid GMO contamination in plants like corn and beets, Redwood said. “In some places it is getting harder and harder to find non-GMO corn,” she noted, “so I think it important that as many people as possible are saving non-GMO seed, because once it is contaminated, it is very hard to clean it up.”

The shockingly dry months of December and January, and the uncertainty in the garden that comes with climate change, point to another reason to save seed: resiliency.

“When you have a lot of different seed-producers producing the same variety, you end up with more genetic diversity within that variety. If you have more genetic diversity within a population of plants, and if drought strikes, maybe you’ll have [enough] genetic diversity within your plant population that 10 percent will survive,” Redwood said.

“You save seed from that 10 percent and replant it, and the next generation is going to be more drought tolerant, whereas if we’re all just sourcing our seed from the same corporate source, then we’re not going to have that genetic diversity that is specific to that location.

“It ultimately comes down to more food security,” she said.

“We’re not dependent on larger corporations for our food” when gardeners save their seed. Ω

FAREWELL, DR. MEL Widely known animal advocate, longtime veterinarian and former Paradise resident Dr. Mel Richardson passed away of heart failure on Jan. 2 at age 63 in the state of Georgia. His close friend, local avian ecologist Dawn Garcia (who I have written about more than once in these Greenways pages) asked if she could share her thoughts on this good man: “Family and friends mourn the loss of our dear friend and animal advocate Dr. Mel Richardson, known to many simply as ‘Dr. Mel.’ Mel had a way of making you feel safe with a warm hug and generous smile, and he loved a good joke. His calm demeanor and confidence made people and animals at ease. …

“In Chico, many knew Mel as their local veterinarian working for various clinics including Mangrove Veterinary Hospital and … Valley Oak Veterinary Center.

“But Dr. Mel’s passion was for the wild ones. Mel had a longtime career with the zoo and captive-wildlife business, [but later] realized the wrongs of industries that use animals as commodities. This increasing awareness sparked the momentum for Mel to change his focus: In the late 1990s, he began to shift his career using his veterinary skills and exotic-animal experience to defend animal welfare, particularly … the well-being of captive wild animals.

“Mel found his partners in kindred organizations including In Defense of Animals, People for the Ethical Treatment of Animals, Animal Defenders International (ADI), Chimp Sanctuary Northwest, Animal Legal Defense Fund, The Humane Society of the United States, the Performing Animal Welfare Society (PAWS), and others.

Mel preferred to support organizations that do not believe in breeding animals for profit … often in inhumane conditions.

“In 2007, he was hired as the veterinarian for PAWS in San Andreas, Calif., working with founders Ed Stewart and Pat Derby. had a box of bread for the homeless, a few picket signs and some leaflets: a stack of one-page summaries describing why I was standing on the corner of Fifth and Main.

I’d parked in one of those diagonal spaces, up against the mostly concrete Chico City Plaza.

It was a still, blue-sky day and traffic was light—perfect conditions for a first-time activist. I was determined to stand on the corner from 3 to 5, on that mid-December Sunday afternoon. I did—and it was a long two hours.

I was on the same corner of the plaza where Orchard Church had served food and given comfort to the homeless—every Sunday evening for more than five years. It was the church’s removal from the plaza that got me out there—standing alone and with no small

degree of discomfort. My sign read, “APARTHEID HAPPENED HERE.” Nelson Mandela had died 10 days earlier and we had just sent our homeless out of the town square—a case of discrimination, if ever there was one. My sign made sense to me, but probably not to any of the passing motorists— most of whom were merciful enough to look straight ahead. A few people on foot or bikes took notice—so I at least had a chance to explain: “Well, see, Orchard Church got moved behind the municipal building, out of the heart of town. Hidden! Apart-hide, get it?

And that was wrong, wrong, wrong.”

It was wrong.

You see, I had fallen in love with this little weekly gathering—mostly on summer

evenings. I watched the way middle-classlooking “church” people would walk up to men and women, many of whom were clearly destitute, and engage them in conversation. I watched people following the Gospel I learned as a Catholic boy—the Gospel of love for the stranger, the Gospel of love for the person who is sometimes the hardest to love. It was inspiring, in a world where inspiration is often hard to come by.

I’d never joined them in prayer or the work they did. Never thought I’d fit in and, frankly, I was not particularly motivated to work with homeless people. I rationalized that I’d done my bit of social work, throughout my life: about a decade working with developmentally disabled adults and people with various mental-health challenges. I was down in the plaza for an evening stroll—not

to go out of my way to meet street people.

The story turned one day last summer when Jim Culp, the pastor of Orchard Church, was put on notice: His program needed a permit from the city to stay at the plaza.

Culp spent months jumping through hoops, and the Bidwell Park and Playground Commission ultimately voted 6-0 to issue a three-month permit. But, while pondering a future of endless public hearings and yearly fees of nearly $3,000, Orchard Church was next faced with a challenge by conservative Councilman Sean Morgan and mega-property owner Wayne Cook. Cook filed an appeal against the permit, since Morgan, as a politician, could not do so himself.

Various homeless issues had gotten my attention in the summer and fall of 2013, but it was when I read that Morgan and Cook were attempting to torpedo the church’s hard-won permit that I finally became engaged. I prepared—for the first time in about 20 years—a statement to the

City Council. It read, in part: “The services of Orchard Church have caused no harm and done great good and it is a travesty that this discussion is even taking place.

Mr. Cook, who has made this appeal, owns a large aggregation of income-generating property, along with a tower overlooking the same plaza where street people are fed and made welcome in our community. This tower stands above his Hotel Diamond and Johnnie’s Restaurant and Lounge—which were, incidentally, built with the financial assistance of the city of Chico. It strikes me as a medieval spectacle: The rich man in the tower looking down on the destitute, and demanding they be removed.

“But this issue is bigger than Wayne Cook and Orchard Church. This is about our city government being heavily influenced by a few well-organized people with a lot of income property. It’s time, now, to send a message back: You, the financially elite, don’t get to decide who wanders the streets, or how

they dress, or whether they are worthy to eat a meal in a city park.

“Orchard Church represents the generous side of Chico. I hope this council will put an end to the bullying and set a new course toward fairness, decency and hope.”

I never delivered this public comment, nor did the public or council ever weigh in on the subject of the appeal. City Manager Brian Nakamura and Pastor Culp brokered a compromise that relocated the church program to behind the Chico Municipal Center. The eleventh-hour deal came just before the City Council meeting, circumventing the public process that was to unfold on the night of Nov. 19. Instead of a contentious public hearing and a vote on the appeal, Culp went to the podium and graciously accepted the arrangement. There was some light applause. But, for me, there was a sick feeling in the pit of my stomach—something was very wrong.

had written a “letter to the editor” to both local newspapers. I condemned the deal as a compromise that served the interests of Wayne Cook and the financial elite, at the expense of a model program—a program which I saw no good reason to punish.

This view was not commonly held.

Everywhere I turned, the deal was hailed as a sensible compromise. This made the issue even more interesting. Was I wrong to be so rigid in my thinking? Was there really that big a difference between locations?

On Nov. 20, I went to the corner of the plaza, where the church had been working, and I took the walk to the east side of the municipal building. As I stood in the new location, it was obvious why this move was significant. The new location is hidden from the thoroughfares of downtown—the municipal building stands like a Berlin Wall between the homeless and the plaza.

It occurred to me that this new location was like the back of the bus in any Southern city 50 years ago. People would be fed, but because they are viewed as second-class citizens, they would get fed where we—the general public—were far less likely to see them.

Indeed, the homeless were sent a message that is painful to contemplate, even as I write this now: You, the inferior and undesirable ones, are not worthy to be seen and embraced in the public square of our town.

We are hiding you. We are marginalizing you.

But we want to feel good about ourselves, so we will feed you over there—in the shadows.

Anyone who doubts this should ask one simple question: Why else were they moved?

The more I pondered this issue, the angrier I got. This led to a public-records request, and correspondence and conversations with Pastor Culp, park commissioners, City Council members, the park manager, people from the Chico Peace and Justice Center, heroic and amazing homeless people, friends, the Downtown Ambassadors, private security guards, people from Food Not Bombs, insightful and affirming members of the Quaker community, baby boomers, downtown merchants,

and random people on the street.

My first step was to request whatever city documents I could obtain: everything from when the park ranger first warned the church, to the council meeting of Nov. 19.

Walking up the stairs of the municipal building—and even parking my truck in the city lot—was a bit unnerving. What the hell was I doing there? I was bothering people, and I had no clue how to approach anyone for any of this. I was relieved when I found City Clerk Deborah Presson to be a kind, intelligent and helpful public servant.

Ultimately, on reading the documents, I was impressed with the diplomatic language that Culp used in the face of a painful episode of scapegoating. It was evident that the new location was offered at the end of a brutal bureaucratic marathon. The Morgan/Cook appeal hearing was imminent—which would have provided the least empathetic and most backward voices in the community another chance to pound on the podium and demand more social cleansing.

In my own conversations with Pastor Culp, it was clear that he did not want to leave the plaza, but the complexity and expense associated with the permit process made the new location appealing enough to justify accepting the change. One sentence from an email summarized his position: “I agree that we have been unfairly targeted and I would have loved to continue to meet in the plaza, but not with the restrictions that the BPPC [Bidwell Park and Playground Commission] would require of us.”

But, it was evident that regardless of whether Culp held the removal to be right or wrong, or desirable or undesirable, it was always a matter of conscience for me. I did, though, seek the opinions of others, as I questioned the validity of my own response.

This led to taking the pulse of Chico on the homelessness “problem” in general, along with the issue of the relocation.

In talking with members of the ’60s generation, I found many who told me how difficult it had become to coexist with the homeless. There was a distinct lack of outrage

regarding the recent raft of anti-homeless initiatives—the sit/lie ordinance, private guards, etc. It seemed a little like some of my peers had an imaginary contract guaranteeing them a retirement in Pleasantville, USA. This made little sense to me. I don’t see my generation as having done anything that remotely qualifies us to live out our years in utopia. If anything, we have embraced a culture of competition and consumerism unlike any before us—and that, it seems to me, is more likely to lead to a dystopian future.

I got some insight into the thinking of the landlord class, as I toured the town with the salaried leader of a downtown volunteer group—a service that does a lot of good work on the streets of Chico. We encountered an owner of a swath of downtown property, who appeared to be on intimate terms with my guide. He gazed into the plaza and pointedly said, “What’s happening? It looks like there are a lot more of the undesirable element in the plaza today.” The weather was nice and homeless people were basking in the sun. It appeared to be a message for my guide: He was possibly failing to do his job. Though, how exactly he was supposed to do this job, I’m not sure—since there is a mountain of case law upholding the right of law-abiding street people to occupy the public space.

Among merchants, there seemed to be a wide diversity of opinion—some of it very empathetic. However, one young woman, working at the Saturday farmers’ market, summed up the position of more than a few when she said, “Ever been to Yosemite?

It was interesting to sound-out eight or 10 homeless folks on the subject of Orchard Church’s removal. The symbolic significance of the move was not lost on them—and many expressed appreciation that anyone cared enough to ask the question.

It came to my attention, after a couple of weeks of trying to grasp how the Orchard Church could have been coerced into its move, that Food Not Bombs had been bumped from the plaza as well. A passionate young activist, carrying dirty dishes from the Saturday food-service program—which is now serving food on the front lawn of the municipal building—described wanting to “get arrested” in protest of having been forced from the plaza. I later learned that a board member of the Chico Peace and Justice Center offered to join him. Ultimately, no consensus was reached and no act of civil disobedience was undertaken. I was heartened that it was seriously considered.

In the final analysis, there was nothing in any conversation that led me to see these relocations as anything other than morally repugnant acts of discrimination.

This realization led me to the corner of Fifth and Main streets.

My fifth Sunday there was very different than the first. For starters, I had settled on a new sign: “Orchard Church, Food Not Bombs, BRING THEM BACK.” I also wasn’t alone. My daughter was in town and she brought a friend—along with a basket of food for the homeless. The usual street characters stopped by to chat, and a friend from the Quaker meeting was there, too. I felt grateful to friends who had dropped by, for many hours, over the previous weeks. Notes from the corner Sunday, Dec. 22: Four or five homeless people came up to us and said some version of: “I’m glad you are here doing this.” One homeless woman: “They’ll never be back!” As if to say: “Can’t you see what a fool you are?” But there was no malice in it. It made me laugh, and, yes, I can see what a fool I am— when I’m thinking straight.

Saturday Dec. 28: More time sitting on the curb at the market, with two homeless guys. One, a peaceful Vietnam-era vet, got all his stuff—guitar, wheelchair, cane, cart—impounded by the Chico Police Department. Something to put on the police blotter, I suppose. Tears my heart out—total bullshit.

Sunday, Dec. 29: My neighbor came back with a sign and chair. She said it was funny breaking the sit/lie ordinance. A roller-derby homeless girl came by. She told us about dressing up as an angel and handing out candy on Christmas Eve. Monday, Dec. 30: Met a man while walking my dog near Children’s Playground.

One of many—the pack, the unwashed clothes, the fifty-something years of hard life written on his face. He said he was looking for his parents, then said they were dead, and then said he was looking for them. I gave him some bus money. Who knows what he did with it? Who cares? I hugged him and walked away with tears in my eyes. That’s a new thing, but a welcome thing.

Saturday, Jan. 4: I noticed a homeless man go over and listen to a young woman playing a guitar. I saw him put a bill in her tip jar and thought to myself, “Oh, my! How extraordinary.” Then my stupid brain was awakened by my less stupid brain and I thought, “You dumbass, these people are probably more generous than anyone, if you look at what they actually own and how they share, just to survive.” Thoughts such as that filled my mind, which reminded me that I am full of preconceptions and bullshit. Try. Fail. Rejoice. Repeat.

Sunday, Jan. 5: Two 17- or 18-year-old women came up to me as I was putting up my signs. They asked how to get to Highway 99. One had been on the streets since she was 10. Both had been in foster care. They were in Chico for only a few hours and I said I hoped they found it to be a good place. They said they had experienced generosity. Off they went. I vividly remember this encounter, because of the joy in them … in the face of obvious adversity, and because of a feeling of deep gratitude to the many people of Chico who make this a soft place rather than a hard place.

ful in getting an outsider’s perspective, but having a few affirming companions is much better for the long haul.

Leafleting at the Saturday farmers’ market has been almost as interesting as my time at the plaza and far more conversational—especially sitting on the curb, with two homeless friends. People often stop to discuss issues. It’s important to have the conversation—it means that things are being noticed.

In a very recent exchange with Pastor Culp, it was clear that Orchard Church has accepted its new location as a permanent home. I was disappointed to hear this. But I can hardly be the judge of that decision. Nevertheless, I insist it should never have been made necessary, being a consequence of the “madness of crowds”—irrationality that often

results in the brutalization of people.

I ran into that same activist from Food Not Bombs the other day. The group may return to the plaza with food service that requires no equipment set-up. I love his spirit.

Ultimately, compassion in the governance of our city will turn on small details. The seeming subtlety of this issue makes it all the more important. Regimes of social cleansing and genocide develop incrementally. No one asks us a question one day that neatly encapsulates the moral dilemma: Shall we implement the “final solution” today? Yes or no?

Do you approve of ethnic cleansing, eugenics? These things happen by inches. How we respond to the more challenging problems of the future will be determined by whether the needle of our moral compass is allowed to guide us, right here and right now. Ω

Even after Forbes recovered, Large was invited to stay on to share vocal duties. Today, she’s still glad to have accepted the offer.

“I love them as people; we’d been friends a long time, so it’s kind of like hanging out with my friends and going cool places,” Large said. “Having performed with them the last three years has been so educational—stylistically and linguistically. I sing in 15 different languages and now I speak some 24 CN&R January 23, 2014

French, so it’s been so good for my brain.”

Pink Martini was the brainchild of bandleader Thomas Lauderdale who, as an aspiring politico in 1994, grew bored with the music commonly played at political actions, fundraisers and other events. He also happened to be a Harvard-trained classical pianist, and enlisted the help of college pal Forbes to start what would become Pink Martini. Since then, the band—which usually numbers 10 to 12 musicians—has performed around the world, sometimes joined by larger symphonies in various locales.

The band’s repertoire includes international jazz, classical and pop standards from a more gilded age and original compositions in the same spirit, prompting Lauderdale to sometimes liken the band to “the United Nations’ house band, circa 1962.”

Pink Martini is also known for its live and recorded collaborations with other artists. For example, the band’s most recent album, 2013’s Get Happy, includes guest stars ranging from melancholic crooner Rufus Wainwright to National Public Radio White House Correspondent Ari Shapiro. It also contains the last known work of Hollywood legend Phyllis Diller—a cover of Charlie Chaplin’s “Smile” that the actress and Lauderdale recorded in her Los Angeles living room six months before her death in 2012. The next album, scheduled for release in March, is a collaboration with The von Trapps (as in the descendants of Captain and Maria von Trapp, immortalized in The Sound of Music) called Dream a Little Dream.

Large said the band’s connections are another interesting facet of performing with Pink Martini, noting she especially liked singing with Wainwright and Australian-born cabaret artist Meow Meow.

“Thomas has really great taste in artists, and also in characters,” she said, “people who are incredibly talented and also absolutely lovely human beings.” Ω

Under the sea In 1850, a ship named the Frolic left China laden with household goods and tools to be sold in San Francisco at the height of the Gold Rush. It never made it. At the Chico Home Brew Bland Shop, owner Dawn Letner says that for several years she has received more and more inquiries from customers interested in making their own hard alcohol.

“There are some people who really don’t know it’s illegal,” Letner said. “They’ll ask me how many gallons they can legally make per year at home, and I’ll say, ‘Well, you can’t make any.’”

Which is generally true—making booze at home with a still for home consumption is illegal in the eyes of federal law. A permit, however, can be acquired from the Alcohol and Tobacco Tax and Trade Bureau for making ethanol for fuel use, and those who wish to go into the business of selling spirits can get a commercial permit from the same agency.

Distillation does not actually produce alcohol. Fermentation, via yeasts, is what turns sugars into ethanol, the type of alcohol on which people have gotten buzzed for millennia, whether via sake, wine, beer or cider. Distillation, on the other hand, is a method of separating the alcohol from the rest of the liquid (beer, wine or any already fermented drink). To do this, a distiller heats a still to at least 173 degrees, at which point alcohol begins to boil and then condense on the ceiling of the still and emerge from the spigot tube in clear-liquid form. Like so, one can turn a 5 percent cider into fiery hot applejack, a gentle wine into brandy, and fermented potato mash into vodka.

As in the United States, home distilling is generally illegal in Europe, yet traditions of making booze— including brandy, chacha, rakia, cognac and tsipouro—thrive in most nations. Forest Ranch winemaker Phil LaRocca’s family brought brandy- and grappa-making traditions with them when they moved to San Francisco from Sicily.

“My dad made wine, and he would give the grape must to my uncle, who had a still,” LaRocca said.

Grappa is distilled from the gunk left at the bottom of

a wine-fermenting tank, while brandy is made from straight wine.

Several years ago, LaRocca shipped a thousand gallons of zinfandel to a custom distillery in Ashland, Ore. “That got me 50 gallons of 190-proof brandy,” he said. At 95 percent alcohol, such a formidable liquor must be watered down to be made palatable.

A quick Google search reveals that distilling equipment can be purchased at many brewing shops and specialty stores throughout the country. Hillbilly Stills in Kentucky is one of the more reputed of the suppliers.

The equipment, after all, is not illegal to own or sell.

Moreover, even people who haven’t acquired a fuel permit or a commercial distiller’s license may be undertaking perfectly legal business with their gear, which looks something like a beer keg with a tube exiting the top.

They may be distilling water or—like Bayliss Ranch in Biggs—making scented distillates from aromatic herbs for use in foods, drinks, lotions and oils.

The reason home hooch-making is federally prohibited may be because it’s potentially dangerous. Distilling can produce methanol, the sort of alcohol that can kill a person. Methanol and ethanol are extremely flammable, too, and home distillers can be injured or killed in explosions.

Money may also be a factor in the federal prohibition on home moonshining. That is, the federal liquor tax of $13.50 per gallon is bypassed by those who engage in their own booze-making.

The distillation boom is not just occurring at home.

Hundreds of commercial craft distilleries have opened in the past decade, and small-batch brands of whiskey, gin, rum, vodka and other spirits have taken to retail shelves. Many bear familiar names—those of breweries like Rogue, Anchor and Ballast Point which are distilling beer into the hard stuff. Some breweries have even sold off batches of tainted beer to distilleries, since the process of removing the alcohol from a wine or beer tends to leave behind flaws in the original product.

Then again, a common saying among distillers goes, “Garbage in, garbage out.” LaRocca attests to the same: “The best brandy is made from the best wine.”

Making a good home hooch, in fact, can be very difficult—so difficult that it may not even be worth it.

And anyway, it’s illegal. Ω January 23, 2014

Not only is she two hours late for an appointment she apparently never had, she’s also the very embodiment of everything Thomas has been complaining about in his auditionees: ignorant, unsophisticated, unfeminine as he sees femininity.

But as she begins performing scenes with him, Vanda’s command of the material takes Thomas aback, and what ensues is a high-momentum, enjoyably disorienting, twisting, multilayered, 90-minute real-time test of wills full of sexuality, power dynamics, literary wit and real surprises.

It came as no shock to me to learn, later, that Venus 28 CN&R January 23, 2014

in Fur is currently the most produced nonShakespearean, non-holiday-themed play in America.

Sounds good, right? And it was good. Pretty good.

The thing is, with a two-person play like this one, which is not emotionally profound as much as it is exhilaratingly clever, the experience for the audience really hinges on the acting and the dynamic between the two actors on stage—in this case, Jeremy Votava and Suzanne Papini. Votava and Papini are full of charisma and, it must be said, are really easy on the eyes, especially as Papini almost immediately began disrobing down to lingerie, vivid tattoos and a dog collar. But, though there were occasional specialeffect strobe flashes of lightning and recordings of thunder, there just wasn’t—at least on opening night—any electricity in the air between these two actors. In particular, I found Papini’s performance, which included some flubbed lines, to be somewhat scene-chewing and disconnected. The result was like a low dose of an SSRI antidepressant: I was entertained, but I just couldn’t quite feel it.

This brings me back to my great respect for actors and the theme (present in the play) of gender and power roles in the entertainment industry. As with directors and playwrights, the great preponderance of theater and film critics are men—which is to say, positions of influence and control in the entertainment industry are largely “dominated” by men. Women, for instance, write only one of eight plays performed on Broadway and represent just 5 percent of directors in Hollywood. (Although it should be noted that for the 2013-14 season, half of the most-produced plays in the country were written by women—which is the best percentage in the past nine seasons).

And a recent San Diego State University study found that, at least when it comes to film, men write 82 percent of reviews (a percentage that holds roughly true here at the Chico News & Review, too).

I feel shitty, is my point, about being yet another mansplaining critic who finds an actor’s (and especially an actress’) performance too this or too that, or lacking in x or in y—especially since the two actors in this case obviously worked their asses off for this complex and demanding play. I couldn’t do what Papini does if I rehearsed for two millennia. In fact, I’m not even Ω worthy to lick Papini’s boot. I’m sorry, mistress!

INDIAN Relapse There are a lot of bands mucking around in the sludge, but Chicago doom nihilists INDIAN come from fathoms uncharted.

From All Purity is—simply put—vile. The band bludgeons you with sphincter-quivering riffs while vocalists Dylan O’Toole and Will Lindsay scream from what sounds like three inches from your face. Sound fun?

INDIAN uses both noise and repetition to give a sense of unease and impending doom, especially on opener “Rape.” “Clarify” is a post-apocalyptic-worthy wall of noise that ends up being more frightening than an Alien/The Exorcist double feature. Drummer Bill Bumgardner breaks free of the swinging-sticksthrough-water style that brings some doom metal almost to a halt. His playing is lively, but not overdone, especially on “Rhetoric of No.” INDIAN wisely keeps From All Purity taut—at just six songs—easily enough to get their point across. If it were any longer, they’d just be overkilling overkill.

Sebastian Squid: Lost!

Casey Fay East Bay PD Chicoan-turned-Oaklander Casey Fay is a talented artist (and a pea pod, if you believe the bio on his website, Faydirgle.com). His artistic obsession with creating very cute drawings of cephalopods resulted in a self-published 2008 book called Wonders of the Sea: Cephalopods. Recently, Fay added another cephalopod-centric book to his bibliography: the delightful Sebastian Squid: Lost!, the first in his fledgling Determine Your Own Destiny series. Aimed at kids, Sebastian Squid transforms the reader into a squid—Sebastian—who goes on an adventure that has the possibility of seven different outcomes, depending on choices the reader makes throughout the course of reading this wonderfully illustrated page-turner. Fay includes scientific information (black holes, decapods) as well as nutritional and environmental information (a plastic bag “after one use has one of two probable fates: Either sit in a landfill for a million years or end up as part of a gigantic plastic mass in the ocean”) in such an entertaining way that young readers will almost certainly get his timely, constructive messages. Fay’s book is so appealing that one can easily forgive a couple of misspellings (“suprisingly” instead of “surprisingly,” for one), though, for the sake of kid readers, one hopes that they will be corrected in a second edition.

Knock Madness Hopsin Empire Distribution Corp.

L.A. rapper Hopsin has a history of offering blistering denouncements of the tired and overproduced stereotypical hip-hop that is often single-mindedly concerned with the trifecta of fame, money and bitches. On his fourth album, Knock Madness, Hopsin takes control of the conversation away from producers— and their checklists of buzzwords to be repeated ad nauseum—but he refuses to change the topic. The chest-thumping ego of “Hop Is Back,” the money moochers in “Gimmie That Money,” and the unfettered hate toward an unfaithful woman in “Good Guys Get Left Behind” all seem born from Hopsin’s personal life, with his pain and rage balanced by moments of self-doubt and vulnerability.

The depth of feeling is most evident on “Old Friend,” a poignant tale of losing a childhood friend to a meth addiction. Hopsin’s depiction of an expressionless, aimless addict is haunting and his sense of loss is palpable. Knock Madness earns its “explicit lyrics” advisory label, but, here, the raw vulgarity is an effective tool for expressing difficult issues for the artist and for the rest of us.

Ultimately, the prime example of that brilliance comes via Solomon Northup himself (Chiwetel Ejiofor). The movie, which portrays Solomon as refusing to be defined by his own victimhood, finds its most powerful and incisive dramatics in the tragic ironies of the man’s struggle not just to survive but to preserve a sense of dignity and self in the midst of soul-crushing cruelties. Reboot with Tom Clancy’s signature character is by-the-numbers actioner

J credentialed intelligence agent/cold warrior/ soldier/intellect of Tom Clancy’s novels—has been ack Ryan—the multitalented, highly

played by Alec Baldwin, Harrison Ford and Ben Affleck in the various movie versions. Now, screenwriters Adam Cozad and David Koepp have by Juan-Carlos devised their own Jack Ryan tale, with baby-faced Chris Pine playing Selznick the Clancy hero at the outset of a career in all-purpose international intrigue.

Jack Ryan: Shadow Recruit might be termed a prequel, except that the franchise chronology has been flipped. This Ryan is indeed younger than the others, but the Jack Ryan: events of Shadow Recruit are all Shadow post-9/11. That leaves the film as a Recruit kind of speculative hybrid—a ClanStarring Chris cy-like adventure tale that plays Pine, Kevin around with notions of what ClanCostner and Keira Knightley. cy’s hero might have been like if he Directed by had been born circa 1980.

Rated PG-13. pie with nascent action-hero chops, and Pine serves ably in the role’s various aspects—the athletic action exploits, the bantering expository dialogue, the whimsical digressions Poor into romantic comedy.

Pine/Ryan is the one who gets the spectacular tasks here, but CIA agent Fair Thomas Harper (Kevin Costner)— Pine’s mentor/minder/father figure/ enabler—has the slightly more central, pivotal and deeply heroic role.

Good Costner’s Harper seems a wry, middle-aged version of what Ryan will become, but he’s so deeply involved in every aspect of young Ryan’s Very Good formative adventures and so miraculously present for each key twist that his guardian-angel status seems more Excellent than merely metaphorical.

Nevertheless, much of the rest of Shadow Recruit is taken up with oddball variations on the routine stuff of genre entertainment. There’s a gratuitous love story that has Ryan’s fiancée (Keira Knightley) following him to Europe and getting caught up in the dangers of a supposedly secret mission. And there’s Viktor Cherevin (Kenneth Branagh, who also directed), a Russian megalomaniac who’s plotting a terrorist attack on Wall Street as well as a catastrophic devaluation of U.S. currency.

Dr. Cathy Muller (Knightley), who falls for Ryan while he’s recovering from drastic war wounds, is a curiously absurd and discordant piece of the story—she’s heroic in a silly B-movie way, and she’s also a pawn of the plot and a barely noticeable fly in the psychosexual ointment of the super-male spy genre.

Branagh, meanwhile, is something of an embarrassment—a character actor and occasional Shakespearian playing a cartoon Russian despot with no psychological credibility and no “character” apart from the dictates of plot mechanics. And his direction of this project is functional and adequate, at best. Ω

American Hustle

American Hustle is a sardonically comical caper movie, a semipicaresque period piece set among con artists, influence peddlers, political fixers, etc., in the late 1970s. Banking scams, FBI stings, Mafia politics, governmental corruption, fashion excesses, and elaborate double-crosses all have roles to play. It’s a beguiling tale, with a nicely timed set of surprise twists laid out along the way. But what makes this one of the best films of the year is mostly a matter of superb, beautifully directed performances from a fine cast, including especially its four leading players. The key figures here are a sleazy entrepreneur/con man (Christian Bale), a frenetically ambitious young FBI agent (Bradley Cooper), a gifted quick-change artist (Amy Adams), and the Bale character’s hilariously erratic wife (Jennifer Lawrence). Bale is especially brilliant—giving unexpected shades of emotion and intelligence to a character who at first seems merely a mild comic grotesque. The new film by Alfonso Cuarón is a dazzling piece of artful entertainment. It’s a sci-fi adventure, with a pair of stranded astronauts played by George Clooney and Sandra Bullock trying to survive a space-station calamity, and it packs a great deal of unexpected interest into what might sound like a relatively simple story.

Scarcity of oxygen, suspension of the law of gravity, extreme physical isolation—they all heighten the stakes in the characters’ efforts to improvise self-rescue via the increasingly disabled remnants of their elaborate space-travel technology. Cuarón and company make wonderfully expressive use of the 3D format on behalf of all of its main concerns. Both visually and dramatically, Gravity is about human beings struggling to get their bearings, in several senses of that word. Spatial and psychological disorientation recurs, but the screenplay by Alfonso and his brother Jonás Cuarón also nudges us toward perspectives on the dimensions of human identity, of purpose and self, and locale.

Director Steve McQueen’s new film recounts the agonizing ordeal of a prosperous and well-educated African-American, a freed man named Solomon Northup, who was shanghaied back into slavery for more than a decade in pre-Civil War U.S. As such, 12 Years a Slave is a sometimes a grueling history lesson that pays graphic attention to the physical cruelties as well as the legal and moral injustices of the slavery system. As a play, August: Osage County won a Pulitzer Prize in 2008. Now it’s out in a film version featuring Meryl Streep and a big-name supporting cast, and it seems to have lost what I’m assuming was the combination of luster and grit that made it so impressive onstage. Streep dominates the story in the role of Violet Weston, a foul-mouthed, drug-addicted, cancerplagued Oklahoma matriarch whose weary, alcoholic, literary husband (Sam Shepard) has suddenly disappeared. Violet dominates her daughters and the other relatives who gather in the aftermath of that disappearance, and all sorts of family secrets, semisubmerged resentments and half-hidden scandals are dragged out to center stage. Director John Wells hasn’t really found a coherent form of overall presentation here, and the performances as well as the script suffer as a result. The low-key performances—Chris Cooper as Violet’s brotherin-law, Julianne Nicholson as the youngest of her daughters, Misty Upham as an in-house caregiver, Shepard—come as welcome relief.

Theodore Twombly (Joaquin Phoenix) is a techie whose literary skills are highly prized at the computerized letter-writing service where he works. He’s also a rather lonely romantic who can’t quite bring himself to sign the final papers on his divorce from Catherine (Rooney Mara). Theodore lives in a world of gesture- and voice-activated digital technology, and special things begin to happen when he gets connected to an operating system that provides him with a virtual companion/assistant/confidante who can think and talk and, up to a point, share emotions. This virtual aide has a female voice (provided, with much sly skill, by Scarlett Johansson) and Theodore names her Samantha.

A unique and surprisingly complex set of reflections on romantic relationships arise from director/screenwriter Spike Jonze’s blatantly peculiar premise, and the offbeat dramas that ensue from it are far richer than one might expect. Cinemark 14. Rated R —J.C.S.

The Wolf of Wall Street

This film has a lot going for it—a lot to like, and a lot to see. But most of its lively virtues and strengths are in the details and on the margins. At its heart, this three-hour extravaganza rings rather hollow. The sources of its greatest appeal include a supercharged lead performance from Leonardo DiCaprio; stylishly frenzied direction by Martin Scorsese; a penchant for bravura scenes and eccentric set pieces; a distinctly contemporary topicality (Wall Street scammers); and a large and quirky supporting cast, with particularly pungent contributions from Matthew McConaughey, Jonah Hill and Joanna Lumley. But some of the film’s most striking aspects are allied, in the long run, with its abiding weaknesses. McConaughey’s early “tutorial” scene with DiCaprio is a darkly comical tour de force that just might be the single best moment in the entire film, but the intense articulation of character and theme of this scene goes unmatched through the film’s final two-thirds. learned about music in Chico during his decades of paying attention: Good bands that play music of the party-ready dance genres—funk, jam, reggae, hip-hop, etc.—will always be popular in Chico. Punk, indie, metal and jazz might all feature acts that are well regarded by many discerning observers, but it is unusual for them to extend their reach across Chico’s funky spectrum—from the groovy hippie elite to the booty-shaking youngsters.

With that truism in mind, there looks to be reason for Chico’s party people to rejoice as Lost on Main—the downtown nightclub with the at times unpredictable schedule—is going through some potentially stabilizing changes that hold the promise of providing a regular calendar of the kind of live music to which Chico likes to get down. First, new booker Jonas Beeler (who Dumpstaphunk to Chico. used to work with one-time Chico promoter Azariah “Z” Reynolds of Bobolink Productions) has started curating an impressive schedule of dance-floor-filling acts for the semester—Dead Winter Carpenters (Feb. 1), Pimps of Joytime (Feb. 13), Dumpstaphunk (March 1), among others.

Second, Beeler has been working with the club to revamp the inside of the space, with new paint and lights going up this week and the stage returning to the opposite side of the building (where it was when the late Matt Hogan’s Mr. Lucky club was in the space).

Time will tell whether or not the fresh vision for the ever-changing club will stick, but the first steps toward new club life will happen at back-to-back “Grand Rebirth” shows next week: the Dead Winter Carpenters show (Feb. 1) and a more low-key local-band event the night before (Jan. 31), featuring The Rugs, The LoLos and Broken Rodeo.

HIRE A MURALIST I got a note from Chicoan Judy Fox the other day saying that she had some walls around the patio of her house that she wanted to brighten up, but that she didn’t want to just brush on a fresh coat of paint.

So, she said that she posted an offer on Craigslist to trade studio space to an artist who would come paint a mural on her walls instead. Local musician and painter Daniel Vera answered the ad and he is in the middle of making Fox’s home a work of jungle-inspired art. Wonderful!

A

certain word associated with country property should never be forgotten. Hard lessons are learned when it is.

The lesson for me began with a phone message from one of my clients, Jill: “We have a problem. Would you give us a call, please?” Her voice was shaky. “Freddy won’t go away!”

Jill and her husband, Jack, had closed escrow and moved into their new country home just a week prior. “Freddy” was Mr. Johnson, the seller, an old mountain man who didn’t say much. Jill dubbed him Freddy after a character in a horror movie.

“He just creeps me out,” she would say. “He stares at us. And he wears that black felt hat and plaid jacket.”

I first met Freddy, that is, Mr. Johnson, at the side of the road. He held a rumbling chainsaw and stared at me. He made it clear I had inconvenienced him by interrupting his work.

“I’m looking for the owner of the property up the road, the two-story house with the pond in back,” I said.

He stared.

I explained I had buyers for country property and I was scouting for them. Did he know who owned the property?

“Yep.” Did he know their name?

“Yep.”

I finally determined he was, in fact, the owner in question. I eventually listed Mr. Johnson’s property, and Jill and Jack bought it.

I returned Jill’s call.

“Freddy’s up there right now,” she said. “At our pond!”

Forty minutes later, I stood next to Mr. Johnson.

“Pretty, ain’t it?” he said. The pond was the best feature of the property; clear, fresh and private, surrounded by sycamores, maples and oaks.

As tactfully as I could, I told Mr. Johnson that Jill and Jack were uncomfortable with his unannounced visits. “It is their property now,” I said.

“Pond ain’t on the property,” he said, “this here’s BLM land.”

“But the fence line …”

“Old cow fence,” he said.

I flinched and recalled a vision of my old mentor, KDV. “A certain word associated with country property should never be forgotten, babe,” he’d said. “The only way country buyers will know what they’re buying, is if they get a ...”

“Survey,” I said out loud. “We should have gotten a survey!”

Mr. Johnson stared at me. “Yep.”

About 15 years ago, Jessica Souder succumbed to her sister’s repeated requests to check out a pottery studio near their mother’s home in San Francisco. She thought, “Why don’t we have this in Chico?” The married mother of two was so moved by the experience that, soon after, she opened Glazed Creations, a paint-your-own pottery studio in downtown Chico in 2000. Both business and owner have seen big changes since the opening: Glazed Creations is no longer a brick-and-mortar enterprise, and recently Souder added a new career in “philanthropic team-building” at Odyssey Teams to her pottery work, and is busy helping to make dreams come true on a much larger scale.

SCORPIO (Oct. 23-Nov. 21): Manufacturing a jelly bean is not a quick, slam-bam process. It’s a five-step procedure that takes a week. How has Glazed Creations changed over the years?

I’ve been in three different locations in Chico.

The first was next to the Senator Theatre on Main Street, then I moved to a location across from Beatniks [Coffee House & Breakfast Joint]. Then I wanted to be downtown again, but I didn’t want the big space, so I found this great place on Second Street above the Beach Hut Deli. Now, I’m fully mobile. I do field trips at schools, birthday parties and the CARD summer camps. I’ve even thought about getting an RV and being like a food truck.

What impact does art-making have on people?

It feels so good to paint pottery. Everything goes away. For a little while, you can feel like you’re away from everything. It took my sister to drag me into the studio to realize that.

What’s your new job all about?

I also work for Odyssey Teams, a global philan-

thropic team-building company. We build bicycles and give them to deserving youths. A corporation will call us to facilitate a program for them. If they pick the bike program, we bring in bikes to be built by their participants. At the end of the program, once they build these bikes, they discover their customer is actually a child who’s going to walk in the room. The kids walk in and they realize they’re getting a new bike. Most of the kids have never had a bike, and probably never [would] if it wasn’t for this. The participants don’t know they’re building the bikes for the kids, and the kids don’t know they’re getting the bikes. It’s a very impactful program. We also put together prosthetic hands to be used for people in developing countries, like India, Cambodia or Thailand, for example.

Is there a connection for you between facilitating creativity and philanthropy?

With Glazed Creations, for me to be happy, I needed to help others in some way, even if I’m helping them paint a pot. I think that’s where that comes in. The opportunity to help people is just necessary in my life. And working with Odyssey also fills me up with that.

The darnedest thing I was paying for something online, and I got to the part where the numbers of my card’s expiration date are Janice’s birthday. Every time I have to enter that date, I’m reminded of my late wife. I don’t mind being reminded of her—fortunately, since it happens many times every day—though the distraction tends to slow me down.

This time, after I put in the card number and expiration date, in the box for my first name I absently keyed in J-a-n- . . . and stopped for a long time, unable to do anything. I didn’t weep. It was something different this time, a kind of meditation, acknowledging Janice obviously being a part of me because I miss her. If I were whole, I wouldn’t miss that part of me.

That’s what I figure, except I know I’m whole anyway. I just don’t feel it.

You may remember reading here about my being in a Relationship and how I wasn’t gonna discuss any of our intimate details, no matter how salacious, and what a character she was and some more thickly veiled allusions to what I once referred to as a special friend. Well, it’s the darnedest thing. It turns out that

those seeming references and apparent mentions were actually typos. I didn’t mean to mislead you, and I promise to pay closer attention in the future.

I used to wonder if another Relationship would somehow distract me from my grief over, for, about and around Janice. I’m tired of being a widower. I expect to have only so much room for a woman in what’s left of my life, so maybe a new one would nudge Janice aside in my mind, leaving my head at least no more jam-packed than before. Not exactly.

Women take up as much space in my mind as I allow, like the rest of Creation, I suppose. Admittedly, some women spend more time in my mind’s eye than others, and you don’t have to be present to participate.

Some of missing Janice is missing a permanent ally, a partner. I’ve compared losing her to losing a leg, implying pain and slow recuperation and adjustment. Nowadays it’s more like not having most of the fingers on my left hand. I can do most things easily and often don’t feel crippled at all, except if I have to carry something heavy or turn a doorknob or open a stuck jar or any of the several tasks that require more left-hand fingers than I can supply. Then I have a hard time.
