However, there are signs of change. Predicated on the premise that “death deserves discourse,” the “Death Café” movement (www.deathcafe.org) is bringing people together to “talk about death, drink tea/coffee, and eat cake.”

Locally, Death Café is scheduled every first Thursday at a downtown venue. Another initiative recognizing that death and dying have a place in our lives as natural and fundamental as nourishment—“Talk About Death Over Dinner” (www.deathoverdinner.org)— was launched this August. Locally, 19 people came together over pizza for stimulating and moving conversation.

In the movement to reclaim dying as a human event, a variety of non-medical practices, both formal and informal, have arisen to augment hospice care. Locally, the Alliance for Support and Education in Dying and Death (alliancesedd@gmail.com) is developing as a network of such resources.

The annual fall event Befriending Death will be held this November at the Chico Women’s Club. The community is invited to celebrate “Days of the Dead” with traditional memorial altar-making, festive food, death rehearsals, eulogy writing, legacy book creation, and music, as well as Death Café all afternoon. Ω

Department officers should trigger further consideration of how local law-enforcement officials respond to vehicle thefts and also how officerinvolved shootings are investigated.

We cannot think of a single case in which Butte County District Attorney Mike Ramsey and the multiagency Critical Incident Protocol Team he leads have determined an officer-involved shooting death unjustified. That would mean that local police departments and the sheriff’s office have flawless records when it comes to using lethal force.

Ramsey, who has been the top lawman in the county for about 25 years, is an elected official, but that doesn’t mean the local law-enforcement agencies that report to him don’t hold influence. The police departments, in particular, have unions with a lot of members and community support.

One answer to resolve this conflict of interest—whether real or perceived—is to bring in members of outside agencies to conduct investigations. That protocol is being considered in Wisconsin by a Republican state representative—Garey Bies—who, concerned by three officer-involved deaths in the state, is sponsoring a bill with a number of key points to address any conflicts.

The bill would, for example, set up a three-person team of investigators (two of whom do not work for the agency associated with the death). Additionally, it would establish a five-person review board whose members— composed of a retired or reserve judge, various law-enforcement personnel, a former DA, and a criminaljustice professor—would be appointed by the attorney general.

Bies’ effort is a smart one. After all, the public’s trust is at stake.

Our local legislators should take a page from his book and introduce similar legislation in California.

This would do a lot to quell concerns about excessive force. Officers who follow proper protocol and have nothing to hide should have no concerns about an outside agency vetting cases of lethal force.

We would recommend outside review of the fatal shooting of Breanne Sharpe, the Magalia teen who died at the hands of a Chico Police officer on Sept. 22 after stealing a car and leading the police on a chase.

Ramsey’s review of her death left a couple of questions in our minds.

First, we wonder if the officer who fired the fatal shot had put himself in a dangerous position. Second, we cannot reconcile how Sharpe was shot in the head and immediately incapacitated while heading in reverse with how the car she was driving was moving forward when it finally came to a stop.

In other words, we question the assertion that she was attempting to run over police officers, and rather wonder whether she had backed up and then quickly gone into drive to evade arrest.

What’s also noteworthy is that, all together, the officers at the scene fired off 19 rounds in a residential area. Two of them struck Sharpe. Thirteen hit the car she was driving. The other four stray shots hit a number of things, including a bus stop and a garage. Thankfully, they didn’t strike someone in the nearby apartment complex, or passersby.

We’ll never know what would have happened if Chico police had simply stopped their pursuit. It’s unlikely—considering the incident occurred at 2 a.m.—that Sharpe would have injured other motorists. It stands to reason that her joyride very likely would have ended without anyone being hurt.

As it stands, one life is lost, a family is devastated, and a member of our local law-enforcement agency will for the rest of his days carry the burden of taking a life—a young life. If that outcome doesn’t call for some careful consideration, we don’t know what does. Ω

Downtown I get a lot of interesting—sometimes strange—mail, both email and snail mail, and lately much of the correspondence has come from folks who are extremely upset about the state of our fair city. One region in particular.

Last week, for example, I opened an envelope whose only contents was the cover of our most recent Discover Chico guide featuring a gorgeous photo of the tree-lined Esplanade with its backdrop of vibrant yellow and red fall hues. On it, the writer had circled the word jewel—as in Chico is the “jewel of the Sacramento Valley”—and scribbled in big black letters, “This is a joke—Chico is no longer a jewel!”

I’m assuming, of course, that the issues in downtown are what prompted the anonymous letter. I’ve received several emails of the same general tone over the past few months, and one letter-to-the-editor writer this week paints a pretty bleak picture of the area.

Jodi Drysdale (see Letters, page 6) said she doesn’t take her kids downtown very often because she feels the area is unsafe. She recalls witnessing two men shooting up, presumably heroin, in broad daylight in a public space recently. She goes on to describe Chico as an enabling city.

I’ve worked downtown for the past seven years, but I’ve spent time in the region on a near-daily basis since moving here 15 years ago. Unlike Ms. Drysdale, I don’t feel unsafe when walking around. Then again, now that I’m a mom, my after-dark outings in the area are infrequent.

Still, even during the day, the atmosphere is noticeably different than just three years ago. I use that as the benchmark because I, too, have noticed some stark changes compared to when I was the CN&R’s news editor and chief city reporter, when I regularly attended the various public meetings, such as the City Council and general-plan-update meetings.

Back then, I would head in and out of the council chambers anywhere between 8 a.m. and midnight, depending on the meeting, and often there would be a person or two hanging out nearby and maybe smoking pot. But never were there straight-up encampments outside of City Hall. Now there are. A lot of the people who set up there with their umbrellas and giant backpacks may split once the temperatures plummet and the rains begin. For now, though, they’re here.

One of the striking things to me is that these aren’t folks I recognize from my many years of being a downtowner. To me at least, they seem like they’re new to town. Like others, I wonder what brought them to Chico.

And what keeps them here.

Next week, at 6:30 p.m. on Tuesday, Oct. 22, the City Council indirectly will be discussing these folks during a special study session focusing on downtown issues. I suspect a lot of business owners are going to show up to vent about them, and I imagine they will share some pretty eye-opening stories. I just hope it’s a productive exercise that doesn’t devolve into a finger-pointing session. But I have my suspicions.

School work is scripted Re “Oligarchy? No, thanks” (Letters, by Bob Woods, Oct. 10): Mr. Woods knows as well as I that every minute of the school year is scripted by the educrats in Sacramento. Social engineering is rampant throughout our public school systems. Teachers are automatons enslaved to the will of the state—they are told what to teach, when to teach it, and how to teach it.

Students rebel at all this inculcation—by middle school, half of all American students hate school. The educational concept of “in loco parentis” determines that schools indoctrinate students with “moral imperatives” (whatever the pop culture says those currently are).

And there has been no “goal” of education for all children since our country’s inception—George Washington never went to school a day in his life, and compulsory education was not mandated for all the states until 1918.

Blame the public sector Re “Looking for buy-in” (Cover feature, by Daniel Weintraub, Oct. 3): Obamacare is not the solution to rising medical costs. My family will be expected to pay the premiums and then spend another $12,700 on services before we receive any benefits. We are no longer allowed to pay the rate the insurance companies pay for services—20 percent. Instead we’ll pay 40 percent of service charges mandated by hospital administrators.

Medical costs have grown out of control because of the healthcare packages given our public employees, packages that pay for anything they want at any charge the doctor comes up with, payment guaranteed by the taxpayers. They run up the cost of health care for everybody else. They’re the freeloaders—we pay more than 30 percent of their premiums, while they pay 9 percent to nothing.

Next time you encounter an overcrowded emergency room or can’t get in to see your doctor, ask yourself how many public employees got in ahead of you.

In Chico, the pensions alone cost us more than $10 million a year, and then we pay their health benefits. We also give them workman’s comp and social security.

If we could throw off these ridiculous benefits and pensions, we could afford Single Payer for every citizen in the state.

Response to rebuttal Re “Rebuttal from the trio” (Letters, by Mary Fitch, Oct. 10): I generally don’t like tit-for-tat letters, but feel clarification is needed.

I didn’t “sling mud,” just facts regarding [Mary Fitch, Quené Hansen and Alicia Meyer’s] pay/benefit package and the fact that they also enjoyed tuition reimbursement in addition to working flex time. I did not imply that they were the only employees that enjoyed these benefits but rather included it as additional information should the general public be unaware this was yet another taxpayer-paid benefit.

Nothing is “fed” to me by public officials. The information I have I obtain by purchase of the proposed fiscal budget, copies of Personnel Allocation Worksheets and the individual department detail that makes up the budget. In addition, I read and print reports for both the City Council and Finance Committee meetings and

have done so for the last five or six years in addition to actually attending the meetings. Time-consuming and expensive—but both worth it to have the facts.

As to revealing the entire history to our new city manager, that seems akin to telling the farmer the pigs have all been let out of the pen long after they are gone.

Downtown is a mess Other than going to work, I avoid downtown. I very rarely take my children down there, not because of the language, smell, vomit or need to literally step over people sleeping in front of businesses, but because it is not safe and our city doesn’t currently prioritize safety for citizens.

I left a downtown business a couple of weeks ago and walked past two guys sitting near a dumpster shooting up—needles in their arms—in broad daylight downtown in a visible, public place. It’s too much, folks.

I am all for supporting those who want support, but in my opinion, we have become a city that enables this type of behavior. I’m a big believer in the idea that if you’re not contributing, you’re taking away from. While I know we have a lot of givers, the takers are having a bigger impact and are draining our resources and killing our downtown. Our sense of community is fading away.

Our city leadership is compromising our safety and the safety of the first responders who protect us.

I cannot see my children living in this community if this is the direction we’re headed.

Ponder this Since July 1, I have been collecting articles about the homeless situation in Chico from the Chico Enterprise-Record and the Chico News & Review. These have been preserved in a scrapbook. This very unscientific survey has yielded 69 articles from the E-R newspapers and four from the CN&R. In my judgment, of the 69 appearing in the E-R, 44 (63.8 percent) were considered negative toward the homeless. Twenty-five (36.2 percent) were positive. Three were neutral, so not included in the calculations. The CN&R’s four articles are considered positive toward the homeless.

What do these calculations reflect? Possibly, the results indicate the opinion of the majority of

the community at large. Or, is it merely the position assumed by the two newspapers? Then, where does the City Council fit into this picture?

I leave it up to you to ponder the results.

Two-market solution?

Some downtown businesses don’t want the Saturday farmers’ market where it is now located because market parking competes with downtown customer parking and products on Saturday. Some downtown businesses want the market moved to Sunday because it competes with Saturday business downtown. Other downtown businesses believe the market draws customers to their businesses on Saturday. Some shoppers want to keep the Saturday market where it’s at because that’s what they like and are used to. Isn’t that basically the controversy?

Seems like a situation where not everyone can be accommodated. Or can they? Why not have a Sunday market in the City Hall lot while maintaining the Saturday market where it’s presently located? That would permit market vendors another day to sell local products, give shoppers an option when to shop, pacify some downtown businesses because it potentially frees up some parking and competition on Saturday.

It may turn out that future day or location changes aren’t as big a deal as we worry they are. If a Sunday market at a new location works out, it might transition the current market away from its present time and location in a less jarring way.

LEAF TRIMMERS FOR SALE

Those interested in purchasing a leaf trimmer as the harvest season arrives may want to contact the Butte County District Attorney. Earlier this month, two used trimmers were advertised on eBay with a seller going by the name of butteda.

DA Mike Ramsey said the trimmers were confiscated as asset forfeitures in recent years from those whose marijuana gardens were operating outside the bounds of Proposition 215. Two were taken by the Butte County Sheriff’s Office and one by Butte Interagency Narcotics Task Force.

At a starting price of $6,500, one has sold for $7,500, with the money going to the Sheriff’s Office, Ramsey said.

Anyone is invited to bid and buy, the DA said, including those who “are operating a legitimate [marijuana] collective that is within the legal guidelines.”

BROWN AFTER GUNS AND TREES

Gov. Jerry Brown last week signed laws that both angered and appeased local state representatives.

First, he signed Assembly Bill 744 by Assemblyman Brian Dahle (R-Bieber) and Sen. Jim Nielsen (R-Gerber) to expand tree removal as a means of reducing catastrophic forest fires and, in the words of Nielsen, restoring “forests to their natural and safe conditions.” The law increases the size of trees that can be legally removed from those with an 18-inch diameter to those 24 inches in diameter. Environmental-protection groups aren’t too happy with the law.

On the other hand, those same groups do support Brown’s signing of Assembly Bill 711, which bans the use of lead bullets.

Nielsen, however, wasn’t so pleased. He said in a press release, “This bill may effectively destroy time-honored family outdoor gatherings, and end a vital component of rural life in California.”

Overall, Brown signed eight bills aimed at gun restrictions, while vetoing four others—all penned by Democrats.

CONVICTS TO CLEAN PARK

The Chico City Council moved forward on Tuesday evening (Oct. 15) with a plan to use citizens in the Alternative Custody Supervision program to do cleanup work in Lower Bidwell Park to allow Caper Acres, the popular children’s park, to remain open during the city’s financial crisis.

As explained by Councilman Randall Stone (pictured), the program calls for low-level criminal offenders in the program (so-called non-violent, non-sexual, non-serious offenders serving their time outside of jail as part of the state’s Assembly Bill 109 realignment) to work there under the supervision of the Butte County Sheriff’s Office.

The council voted 6-0—with Councilwoman Ann Schwab recused because she lives near Lower Park—to have staff draft an agreement with ACS for the work, which will be conducted at no charge to the city.

Currently, local business ServPro has been volunteering cleanup services at the park to help keep Caper Acres open. However, the company’s commitment ends on Nov. 1.

Montgomery said those treatments included heat, various sprays and fumigation concentrated in particular areas where the bugs were spotted.

“It seemed like none of these things completely eradicated the problem,” he said. “So now we are taking a much more aggressive step because we want to be completely rid of them.”

The shelter’s guests were moved

to the First Baptist Church’s Fellowship Hall. That facility shares its restrooms with Rose Scott Open-Structure School, which occupies two classrooms at the rear of the church property. The move had some parents and teachers concerned that the bugs may accompany the shelterusers and invade the school. A letter to parents dated Oct. 14 from Cindy Carlson, the school’s curriculum director and lead teacher, addressed those concerns.

She wrote that the school was unaware of the bed-bug issue until told late Thursday (Oct. 10) evening by church Pastor Ted Sandberg, and that few details were initially provided.

“We have been assured, by both Pastor Ted and the Torres Shelter, that we would not have any problems due to

those in need,” the letter says. “They will arrive in the Fellowship Hall around 4:30 p.m. and will be gone before any of your children arrive in the morning. We do know that they will be screened before they are let in and all their bedding and bags will be left outside.”

In a press release, Montgomery, the shelter’s executive director, thanked Sandberg and the church for allowing use of its facilities. The problem the shelter faces is considerable in a number of ways, he said, including health and financial concerns.

Clark Pest Control is offering a reduced rate for its services, but the infestation is still a financial hardship, Montgomery said.

“We are getting a discount,” he said, “but it is costing $11,500, which, at the rate of $15 per person, is equal to 767 nights of stay for us. The expense will basically exhaust our reserve fund for any unforeseen problems having to do with building, maintenance or facility concerns.”

The pest-control company placed a tent over the building on Monday morning, Oct. 14, and then sprayed with Vikane, Dow Chemical Co.’s brand name for the fumigant insecticide sulfuryl fluoride. After the gas evaporated, the company was to go back into the building for tests. (Similarly, Rose Scott School and the First Baptist Church Fellowship Hall were to be inspected by Clark Pest Control after the homeless

guests leave.)

“They believe it’ll be safe to come back in around noon on Wednesday, but we’ve given ourselves a cushion just in case,” Montgomery said. “And we do have a backup plan of potentially staying [at the church] another night if there are still pockets of chemicals in the building.”

He said the shelter is adopting new procedures that are “both respectful and thorough” as far as checking for bugs that may be coming in on guests’ possessions or on the guests themselves. The new procedures will also increase costs, he added.

Darren Jones, an environmentalhealth specialist with the Butte County Health Department, said there has been an increase in the number of bed-bug sightings reported recently, but that may be misleading.

“It’s becoming more public now as it’s more often in the news,” he said. “Locally owned hotels and apartment complexes and multiple-unit living quarters are reporting bed bugs. And there are stories of people bringing the bugs into their homes in college areas where they buy second-hand furniture and other goods.”

According to the CDC, America is one of many countries now experiencing “an alarming resurgence” in bed-bug populations. The exact cause is not clear at this point, but scientists suspect it is associated with the bugs’ increased resistance to available pesticides, a jump in international travel, a general ignorance about the proper control of bed bugs these days because they seemed to be “gone” for so long, as well as the ongoing decline or elimination of pestcontrol programs at state and local public-health agencies.

For his part, Montgomery said he

appreciates the support received to this point.

“I’d like to thank the Red Cross for providing us with some cots so we wouldn’t have to move mattresses,” he said, “and the Salvation Army, which has given us mattresses in previous times.

And I want to thank the Jesus Center for allowing us to use their trucks for transport, and all the organizations and individuals that are stepping up to help us.”

Montgomery also encourages donations from the public to help the shelter weather this bed-bug storm by sending checks payable to the Torres Community Shelter at 101 Silver Dollar Way, Chico, CA, 95928, or by making an online donation at www.chicoshelter.org.

The shelter, he noted in his press release, “increases people’s chances of stabilizing their lives and improving their circumstances.

“In the past 12 months, we served 729 people, who were staying with us and not living on the streets, and we set a record of helping 301 people escape homelessness and move into a more stable situation.” Ω

hat, one might wonder, is the best way to W get Chico State students interested in Covered California, the state’s health-insurance

exchange under the Affordable Care Act? Hiring a DJ and offering free pizza from Woodstock’s Pizza was the approach taken at the Covered California information fair held last Thursday afternoon (Oct. 10) at Chico State’s Trinity Commons, where a series of booths offered the opportunity to enroll in the exchange, which opened nationwide on Oct. 1. Several speakers, including the exchange’s executive director, Peter V. Lee, emphasized the importance of health coverage to the few dozen students in attendance.

“Many of you are here because you know you need health care,” Lee said, while conceding that, “Some of you are here because of the pizza.”

Lee said the Affordable Care Act (ACA) “decided health insurance is a right, not a privilege. It’s a big deal for the nation, for the state. It’s a big deal for Chico, for many working Californians, for students.”

Joey Telitz, a 24-year-old senior businessadministration major, was admittedly one of those students interested exclusively in pizza, though he offered his take on Obamacare, as the ACA is commonly called.

“I feel like there are more pressing issues,” he said, citing national debt as a more relevant concern, and adding that as a business major, he naturally dislikes increased government intervention. “Obama wants to be remembered like [Franklin D. Roosevelt] with the New Deal stuff, like it’ll be his legacy.”

Telitz then proceeded to display a decidedly passive attitude toward the information fair and Obamacare in general. “I don’t know anything, really,” he shrugged. “I think Obamacare’s stupid. … I just want some pizza.”

heard of the Affordable Care Act, but don’t know anything about Covered California,” she said. “They don’t know what it is. I’ve done a lot of explaining the basics. All they know is that there’s a penalty [at tax time for those without insurance], but they aren’t seeing all the benefits.

“A lot of people will qualify for free health care—especially in the student population.”

Whether Telitz cares or not, members of his age group—who, in ACA lingo, are referred to as “young invincibles” because of their tendency to think they won’t get sick and need health care—are the primary target of Covered California’s outreach campaign.

In order for the exchange to work (as explained in CN&R cover story “Looking for buy-in,” Oct. 3) enough young, healthy people need to participate in the exchange to offset the cost of the older, sicker, more expensive enrollees.

But misinformation—or, in some cases, no information—seems to be Covered California’s biggest obstacle on the state’s college campuses. At the fair at Chico State, Natalia Butler, outreach and education coordinator at Women’s Health Specialists, used an iPad to give students a rough idea of what insurance through Covered California likely would cost, and allowed them to sort through available plans. She found that many of the students are unfamiliar with the exchange.

While the rift between Republican and Democratic lawmakers has grown so wide as to force a government shutdown, their constituents seem to agree on one thing—it’s time for a new party.

According to the results of a Gallup poll published Oct. 11, 52 percent of Republicans and 49 percent of Democrats support the idea of a third major political party. A total of 60 percent of people polled said both major parties are doing a poor job—the highest rate in 10 years. A mere 26 percent—an alltime low—said the two-party system adequately represents America.

The Student Health Center receives

about 30,000 visits a year, meaning each Chico State student averages about two annual visits, said Dr. Deborah Stewart, the health center’s medical chief of staff, when introducing Lee. About a third of those students are uninsured.

Stewart said that for Chico State students, relying on the health center alone is risky because students’ access to the center is limited to business hours—8 a.m. to 5 p.m., Monday through Friday—and that outside of those times, those in need of medical services are directed to an immediate-care clinic or an emergency room, which is a costly proposition for an uninsured student.

One such student is Cammi Carter, a 20-year-old junior communication-design major who was at the information fair due to a genuine interest in enrolling in Covered California. Though she’s not sold on the idea—she said she “would like to know everything” before signing up for the exchange—the prospect of subsidized health care is appealing to her.

“For me, it’s a positive because I don’t have enough to afford health care at the moment,” Carter said. “If I were to break an arm, it would cost me a lot of money … and I have to pay for my tuition.”

Carter expressed a sentiment likely shared by many of her peers—that informing oneself about the sweeping federal law is easier said than done.

“I think it’s that way for most of Americans,” she said. “Not a lot of people are willing to actually read a bill.”

Overall, Carter said she believes that providing college students with information about the health-insurance exchange is helpful. “I think it’s good they’re doing this and getting it out there, so kids on campus know what’s available to them,” she said.

but its gatherings there, which include breaking bread with members of the homeless and transient population, are now in jeopardy.

During the City Council’s regular meeting on Tuesday, Oct. 15, one of the items on the agenda was discussion about the Orchard Church and its Church on the Street ministry. More specifically, the agenda called for the panel to consider Councilman Sean Morgan’s request to agendize a review of the Bidwell Park and Playground Commission’s recent decision to approve a permit allowing the church to continue its Sundayevening get-togethers at the plaza.

By the time of the meeting, however, a community member had filed an appeal of the commission’s decision, so rather than discussing whether to agendize a review, Morgan expounded on “a disturbing chain of events,” as he put it, leading to his request. In short, he described being blindsided by the commission’s decision. He’d learned about it from reading a story in the Chico Enterprise-Record last week.

“I was surprised by that headline … given the transient issues we’re faced with downtown,” he said.

Morgan went on to express shock that the council hadn’t been consulted over what he considered a “lightning-rod issue.” His decision to bring the issue to the council was intended to explain what had happened to members of the public, a number of whom had emailed and called him expressing anger over the permit being granted.

The freshman councilman then explained how City Manager Brian Nakamura asked if he wanted to agendize the issue, but that he later learned through city staff that the council could neither place a review on the agenda nor appeal the commission’s decision.

sion,” he said. “So I just thought, so if the commission can usurp the power of the council, maybe we need to look at suspending all the commissions, because this isn’t democracy.”

Morgan said he subsequently found out that a private citizen could appeal the decision. He then decided to file an appeal himself, only to find out that doing so would mean he would have to recuse himself when the council discusses the issue.

“And I’m just going, OK, I [now] understand all of the jokes about government and how none of this process works—at all. And to be quite honest, I was appalled,” Morgan said.

Long story short, one of the

citizens upset about the church’s gatherings—local businessman Wayne Cook—filed an appeal.

That appeal, according to City Clerk Deborah Presson, likely will occur during the last meeting in November. (As it turns out, Morgan noted, the city manager has the authority to agendize any decision by a commission, which explains how the issue appeared on Tuesday’s agenda.)

Morgan went on to say that he’d met with some members of Orchard Church, including its pastor, Jim Culp, who explained that the church had been feeding the needy at City Plaza for more than five years, and that only recently did he learn that a permit is required.

Toward the end of his selfdescribed monologue, Morgan claimed that the church didn’t actually receive a permit, but rather its

application was approved with a recommendation that the permit be approved as well.

Because the council was taking no action on the item, Mayor Scott Gruendl decided to close the floor to public comment on the issue.

However, during a break in the meeting, Culp told the CN&R he’d jumped through a bunch of legal loopholes, including getting special certification from the Butte County Health Department. He said he believed the church had received a permit through the city.

Mark Herrera, a member of the Bidwell Park and Playground Commission, attended Tuesday’s meeting and confirmed that the commission had indeed given the church the requisite permit. That decision came out of a Sept. 30 meeting during which the panel’s seven members agreed by unanimous vote to allow the church’s events to continue for three months’ time.

Herrera said the commission routinely allows community groups to use parks for events. “We pass permits left and right,” he said.

He noted that all of the supporting documents related to the commission’s meeting, including the application from the church, were available for the City Council and the public to view prior to the commission’s meeting. Herrera said he’d attended one of the gatherings to gauge for himself what was happening there.

“It’s the most peaceful event I’ve seen at City Plaza,” he said.

On Wednesday, Oct. 9, Lake was perched on the southwest corner of First and Main streets holding a sign that read, “The right not to be Cen-Cerd! Spare-change?” when a Chico Police officer pulled up in an SUV. “He started writing a ticket and I asked him what it was for,” Lake later recalled.

“He said it was for panhandling, and I said, ‘So you’re saying I don’t have the right to say something?’ He said, ‘That’s right.’”

The officer was Peter Durfee, who serves as president of the Chico Police Officers’ Association. He was enforcing the city’s municipal code under Division VII, Consumer Protection, Chapter 9.54, “Aggressive and Deceptive Solicitation.”

The city’s panhandling law was adopted 10 years ago and written by former Assistant City Attorney Alicia Rock. Crafting such an ordinance is no easy task, in part because of something in the U.S. Constitution called the First Amendment, which guarantees the right to free speech.

At the time, then-City Attorney Dave Frank told the City Council it must “put together findings that justify this type of legislation.” Former City Manager Tom Lando said the ordinance would be aimed at “aggressive” panhandling.

“I don’t want us to deceive ourselves,” Lando said. “With non-aggressive [panhandling], there is nothing we can do about it.”

The adopted ordinance, as noted in its title, outlaws not only aggressive but deceptive panhandling as well, and designates areas where it is prohibited, including within 15 feet of an ATM, bus stop, outdoor vending machine “or any other device which accepts coins or paper currency, except parking meters or newspaper-vending machines.”

There is also a ban on begging within five feet of a public crosswalk or while “seated on or leaning against any public bench, planter, monument, or other public property.”

Lake said those latter two offenses are what officer Durfee accused him of violating. While he was sitting close to the trafficsignal pole on the corner, he said, with his attendant property including Spot, he was not leaning against the pole. Nor does he think he was within five feet of the crosswalk.

“I need to get a measuring tape out here to prove it,” he said.

Lake, who is 35, said he’s been in town for 15 years and has lived on the streets for the last 21. He was born in the Bay Area.

“I sit there and say ‘spare change,’ using the words as an idea,” he said, “I’m not specifically asking for money.”

Lake has a collection of signs including: “It’s not about money, I need change” and “Run for your lives I’m going to ask you for change.”

This is not Lake’s first ticket. He’s

had a few others in the past two weeks for illegal camping, and smoking a cigarette in City Plaza. In fact, over the years he’s been handed more than 40 tickets, mostly for camping in parklands. Last December, he had an altercation in Lost Park in which he said he was attacked by a man with a knife.

He took the knife and stabbed the man in self-defense. But he was arrested and spent five weeks in the Butte County Jail. The charges were dropped because the other man left the county, Lake said.

During his incarceration, his feline, Spot, was cared for by employees of the Shalom Free Clinic Thrift Store on First Street, where Lake often hangs out. The people who work there speak well of Lake, and he, obviously, has high praise for them.

In the meantime, Lake said, he will contest his panhandling ticket in court. Calls to the Chico Police Department were not returned by press time, and City Attorney Lori Barker, when asked about it, said she had not heard back from the police regarding the incident.

ABORTION BILL PASSES

Gov. Jerry Brown approved state legislation on Oct. 9 that expands the type of medical providers able to perform abortions.

Nurse practitioners, certified nurse-midwives and physician assistants will be allowed to perform first-trimester abortions using a method called aspiration under Assembly Bill 154, authored by Assemblywoman Toni Atkins (D-San Diego), according to The Sacramento Bee. Supporters of AB 154 say it will address a shortage of abortion providers in California and eliminate the need for traveling long distances for the procedure, while opponents argue patient safety will be compromised due to a lower standard of care.

OF GIRLS AND CONCUSSIONS

More girls than ever are playing high-school sports, but—excluding football—they’re receiving concussions at a higher rate than their male peers.

Nationally, an all-time high of 42 percent of high-school athletes are girls, and of highschool sports, girls’ soccer is second only to boys’ football in number of concussions during games, according to SFGate.com. Overall, football accounts for 47 percent of all high-schoolsports concussions, while girls’ soccer is next with more than 8 percent of concussions.

In team sports that both boys and girls play—such as basketball, soccer and baseball/softball— girls are nearly twice as likely to get concussions, though it’s unclear why. Complicating the issue, boys and girls commonly report different concussion symptoms—boys are more likely to report amnesia and confusion/disorientation, while girls are more likely to report drowsiness and sensitivity to noise.

“A big problem here is that when a girl reports milder symptoms to a male coach—and a lot of coaches in girls’ sports are male—her concussion could be missed if the coach isn’t alert to the differences in how boys and girls report symptoms,” said Dr. Paul Fisher, chief of pediatric neurology at Lucile Packard Children’s Hospital in Stanford.

End-of-life crossroads Local physicians discuss choices faced by terminally ill patients and their families by

hen faced with a diagnosis of

How should they proceed—treat the disease aggressively, or make the last days, weeks or months as comfortable as possible?

In California, many people choose the aggressive path. A recent study by the Dartmouth Atlas Project, prepared for the California Healthcare Foundation, found that compared with the nation as a whole, Californians with advanced-stage cancer are more likely to spend time in a hospital intensive-care unit, receive life support during their last month of life and receive chemotherapy during their last two weeks of life.

The report—titled “Measuring Up? Endof-Life Cancer Care in California”—also concluded that hospice referrals for terminally ill cancer patients are increasing, but still lag behind the U.S. average, and “in some California hospitals, referral to hospice care occurred so close to the day of death that it was unlikely to have provided much assistance or comfort to patients.”

Both in terms of aggressive treatment and hospice care, the study found wide variations by region. Researchers examined data from 2010 and compared it to 200307, and Enloe Medical Center was the only Butte County hospital included, though Feather River Hospital also has a cancer center.

So, what is the state of end-of-life cancer care locally?

Rather than push patients toward one path or the other, both Enloe and Feather River are focused on bolstering both options and helping patients make the choice that fits their wishes. Each hospital has a hospice program in addition to cancer centers. Moreover, the hospitals have ramped up efforts to get end-of-life decisions made before a person is given a terminal diagnosis.

“I’m all for choice,” said Toby Brandtman, a case manager at Feather River who helps facilitate patients’ advance planning.

“It is not my goal to make sure people get or don’t get aggressive treatment at the end of life. My goal would be that their wishes are honored.”

Articulating those wishes can be

difficult for a person with late-stage cancer.

He or she might be unable to speak or think clearly, in which case the decisions may fall on emotionally wrought relatives. Even patients who can state their preferences often

find themselves torn over the prognosis.

Dr. Michael Baird, executive director of the Enloe Regional Cancer Center, used the analogy of a passenger falling off a cruise ship and flailing in the water. Someone standing on the deck says, “Hey, I’ve got this life jacket; I don’t know if I can get it out there, but do you want me to throw it to you?”

“That’s kind of what we do with patients when they have advanced-stage cancer and we’ve got a treatment that works sometimes, but not all the time,” he said. “We say to them, ‘You tell us whether you want it or not.’ Of course they’re going to say ‘yes’—unless they have a better feel of the whys and wherefores.”

Dr. David Potter, an oncologist at Enloe who also oversees the medical center’s hospice service, noted: “There are very strong forces in our economy that may be driving the choice to do treatment over not doing treatment. … There’s the idea out there that I just need to go to the right

struggle with how to proceed. Pat Watters, director of hospice for Feather River, says her staff receives referrals for patients “who are not ready to forego aggressive treatments.” For those individuals, hospice may not be the right option, at least at that time.

“Here at Feather River we have a really good connection with our cancer center,” Watters said, “and our oncologists have really perfected the ability to know when to have that conversation and how to conduct that conversation.”

position to support patients in whichever decision they make. But both hospitals don’t limit their endof-life-planning initiatives to terminal cancer patients; they’re trying to reach more people early on.

“When we’re talking to people in the hospital,” Potter said, “the train has already left the station.”

One means of planning is completing an advance health-care directive—a comprehensive document that spells out a person’s wishes for a range of medical contingency. There’s also a shorter form known as a POLST (Physician Orders for Life-Sustaining Treatment), which at a glance can tell emergency-medical technicians and physicians what procedures the patient authorizes.

“One of our biggest challenges as a society is we’re not having these conversations,” Brandtman, the case manager, said. “We at Feather River are working very hard with our physicians to make advance decision-making almost an everyday thing.” Ω

“In cancer, sometimes we’re just not sure. So there’s both the uncertainty and the high expectation in our society that technology can solve anything—and maybe it can’t.”

The various decisions that constitute end-of-life planning may boil down to a single pivot point.

“There’s a difference between prolonging your life and quality of life,” said Dr. Samuel Brown, medical director of Enloe’s Supportive and Palliative Care Service. “That discussion has to be had. Some people are thinking, ‘How long can you keep me alive?’—and they don’t look at what price they’re going to pay for that extra week or two, or maybe a month, rather than a much better quality of life in hospice, where they may wind up living as long anyway.”

Grocery and drugstore chain Rite Aid agreed to a multimillion-dollar settlement for allegedly dumping toxic chemicals from hundreds of its California locations.

Dozens of attorneys representing California cities and counties joined the suit, filed in September, which claimed that about 600 of the chain’s stores illegally dumped pesticides, bleach, and other toxins into landfills over a nearly seven-year period, according to The Sacramento Bee. The settlement requires Rite Aid to pay $9.4 million in civil penalties, nearly $2 million for environmental projects and $950,000 in attorneys’ fees, in addition to hiring employees to ensure compliance with environmental and safety regulations.

“We want Rite Aid to train its employees,” said Heidi D’Agostino, a senior enforcement officer at the Yolo County District Attorney’s Office.

“Unfortunately, there’s nothing we can do to mitigate what’s clearly been disposed of, but they can rethink how they’re training people.”

RUSSIA’S CARBON SINK

Farmland abandoned in Russia following the collapse of the USSR is now likely the largest manmade carbon sink in the world, a study finds.

Research published in the journal Global Change Biology highlighted the enormous climate benefits of vegetation growing on about 110 million acres of land previously used for agriculture, according to Grist.org. The overgrowth has sucked up about 50 million tons of carbon—equivalent to 10 percent of Russia’s fossil-fuel carbon emissions—each year since 1990. The study’s authors projected that, provided the land remains uncultivated, a further 261 million tons of carbon will be sequestered over the next 30 years.

At that point, the land would reach equilibrium, where the same amount of carbon would escape into the atmosphere as is being absorbed.

FORECAST: PERMANENT CLIMATE CHANGE

Recent research on climate change has projected dates for when cities and ecosystems around the world will get permanently hotter.

In a study published in the journal Nature, researchers used weather observations, maps, simulations from dozens of computer models and data on hundreds of thousands of species to pinpoint when places will have “an environment like we have never seen before,” according to The Associated Press. With a fiveyear margin of error on their estimates, the researchers projected that cities in the tropics, like Kingston, Jamaica, will be the first to experience a permanent change in climate in about a decade. Of the 265 cities projected, Anchorage, Alaska, will be the last to change, in 2071.

Most disturbingly, the researchers estimate that every year after 2047, the average global temperature will exceed that of 2005— Earth’s overall hottest year on record.

O morning, a class of fourth-graders from Blue Oak School sat on the ground n a recent warm September

under the shade of pines and cedars at the Lake Concow Campground. They worked intently with their hands, hollowing out the soft inside of a small segment of a thin elderberry branch to fashion it into a tiny container.

Overseeing the kids’ progress were Jahnia Mitchell and Matthew Knight, two members of EarthBound Skills, a collective of young instructors who teach wilderness skills in and around Chico. The group has been teaching children on field trips and at school sites for a little over a year. The collective also offers weekend workshops that are open to both adults and children.

“Our main focus is … just connecting kids with nature, and if that just means getting kids outside of the classroom in the field outside, awesome,” said Knight.

Sometimes, he said, he and his fellow instructors will just go to a school and “build debris houses.”

After making the elderberry containers, Knight arranged the children in a semicircle. He used materials from the campsite to demonstrate how to make fire from friction by using a basic hand drill: a piece of cedar

board with a notch cut out at one side, with a stick used as a spindle that sits nicely above the notch, and a pile of fluffed-up cedar bark shavings for tinder.

He spun the spindle by rubbing his hands back and forth, applying downward pressure. The children started to gasp and yell, “Whoa! There’s smoke!” Soon after, Knight’s hard work produced a tiny coal, which he quickly picked up and dropped into the fluffed-up bark. After a few blows, and a lot of smoke, the bark burst into flames. The children whooped and hollered and clapped as Knight held the burning pile in his hand for all to see.

“Fire is … crucial in our sacred order of survival skills. … To create that from yourself and from nature is really powerful,” said Scott Grist, the third member of the EarthBound collective. He went on to explain the hierarchy of needs as being shelter, water, fire and, finally, food. Grist says that he came to Chico to study geology “because of my love of the Earth.”

had little to no connection to nature as children. “I remember being depressed, being like, ‘there’s no place to play,’” said Mitchell. “I think that’s why it struck such a chord within me to bring kids back to nature, because … I didn’t really have that as a kid, and I realized … how much that affected me, and how healing that [connection to the land] has been for me.”

Knight said he never camped until he moved away from home at age 17. “When I found out about the skills, it just resonated so deeply with me,” he said.

All three instructors, independent of each other, learned their wilderness survival skills at the world-famous Tom Brown Jr.’s Tracker School in the Pine Barrens of New Jersey. Each of them first heard of survivalist skills through Brown’s books, which detail his childhood in the Pine Barrens, where he was mentored by an Apache elder in survivalist skills and native philosophy. He also has a series of field guides on each aspect of nature survival—from nature observation and animal tracking, to edible and medicinal plants.

“When I read [Brown’s The Tracker], it totally hit a chord inside of me,” Mitchell said. “Right away, I was like, ‘Oh my gosh, I need to study from this guy.’”

discovering wilderness skills, and also by their resulting entrance into the subculture of wilderness survivalists: “I didn’t know there was anything like this out there,” explained Mitchell. Grist, in a separate interview, said, “It opened me [up] to a new world that I didn’t really know existed, of this Native American knowledge that’s almost lost.”

Attending Brown’s school, Mitchell said, was life-changing. “I recognize there’s a problem with the way our culture is right now, and so I’ve always had a desire … [to determine] what my role is in fixing that, or changing the direction our culture is going in. What I love about the skills is that [they] reconnect you at a really deep level to your surroundings.

“I believe once you’re connected to your surroundings, you won’t want to destroy them; you’ll want to preserve them. You develop that respect. You also develop respect for the natives who came before us who kept this place alive for tens of thousands of years.”

And some of those leaf blowers—the heavy duty, two-stroke, gas-powered ones—also bring the stench of major pollution. According to a study conducted by the auto site Edmunds.com, “the hydrocarbon emissions from a half-hour of yard work with the two-stroke leaf blower are about the same as a 3,900-mile drive from Texas to Alaska in a [Ford F-150] Raptor [full-size pickup].” So, please, use a rake, go electric (or drag your leaves across the yard with a giant pickup if you must), but dump the big gas blowers.

public charter school Sherwood Montessori’s ongoing community-service mission (à la Maria Montessori, creator of the Montessori method of education), the school’s cooking and gardening teacher, chef Richie Hirshen, and his “longtime assistant/super-volunteer” (as Hirshen put it in an email), chef Alex Cilensek, hosted a group from nearby Rose Scott Open-Structure School on Oct. 2 for a “kitchen-garden clinic.”

Nine Rose Scott students, and four adults, including school director Cindy Carlson, planted swiss chard seeds in the school garden, made a pizza from scratch with organic whole-wheat dough and fresh tomatobasil sauce, ate Massa Organics brown rice cooked in the school’s new solar oven, and drank strawberry-banana smoothies made with organic apple juice.

“The kids stretched the dough, spread the sauce, topped the pizza with mozzarella and Sherwood-made ricotta, cut the fruit, pushed the blender buttons and ate to their hearts’ delight,” said Hirshen. “A lovely time in the neighborhood.”

MORE CATCHING UP I would be remiss if I did not provide news of the recent Write Away: Postcards with a Purpose show that was held at 1078 Gallery Oct. 3-5. According to exhibition co-organizer Erin Wade, a total of 168 artfully decorated postcards, submitted by people of all ages, graced the gallery’s walls. Wade, a local artist who teaches at Butte College, also had her Introduction to Digital Photography students submit entries: a striking bunch of mini-artworks created in part by computergenerating random images onto the cards.

Every postcard, in fact, was a miniartwork. It was a delight to study each one, from the simple-yet-striking watercolor of a heart (pictured) by young Savannah Berg to the impressive, obviously time-consuming card created

by Claudia Dussault-Howell from tiny pieces of dyed eggshell, watercolor paint, and pen and ink (also pictured).

Local watercolorist Amber Palmer weighed in with a photographic card of a painting of a chili pepper; line-drawing artist extraordinaire John V. Some (myself included) entered a series of cards: Peter Hogue’s expressive series of five cards, Russ Burnham’s moody red-hued series, and local artist X13’s cool Chico-comic series.

The show was wonderful. I hope 1078 makes it an annual event.

Holy Relics

Laced with poison oak, pines lie like pick-up sticks round the new cabin.

Teen-age brothers come one weekend with a rusty two-man saw.

Three dear blackgrey hairs cling to an unwashed, folded white pillowcase, an ashes sandwich tucked into a ziploc medicine bag closed vicious tight against Forever.

Is he in its creases?

Opened, spread, will sweat Barbasol bike leather conjure him?

It lies hidden, not forgotten, in the inky part of the bedroom closet once brightened by a yellow plastic rain suit that squeaked and swished when he walked.

Outside, a cleaner white pillowcase lies centered atop a vast bed desert, subject only to blonde.

Much later in his life, while in an act of love, the younger will recall the sweaty push and pull, a pungent ooze of pitch, the both of them panting.

David Bell lives and helps with the upkeep on a ranch near Orland, and it would appear that his natural surroundings offer plenty of inspiration for his poetry, both with his winning entry here and with his honorable-mention selection that follows. Bell is no stranger to writing, having worked in arts publishing in New York City and as an art critic for various art journals while living in Santa Fe, N.M. These days, he writes poetry as it comes to him—“I did years of deadlines, and nobody is waiting for the poetry anyway.”

During her years working as a planner for PG&E, Elizabeth Nelms didn’t have much time to write. Now retired, she’s taking a writing class at Butte College with English teacher Molly Emmons, who suggested Nelms submit this poem—her first published work—which was actually taken from a writing exercise for a short story Nelms is working on.

Phone Call from Rehab The sky was numb, grey as a dial tone.

My husband, in rehab again, had just called.

“I don’t belong here,” he boasted, “everyone’s a loser.”

I relayed the message to my parents, and the same look from my father I got as an eight-year-old on my first hunt. I was standing over the goose I had just wounded.

My father said, “You have to do it.

It’ll end the suffering.”

Tears fell on its downy feathers, coarse and soft in my hands.

I held its neck, warm and supple, and twisted.

Lisa Anina Berman is teaching academic writing at Chico State University while she works on finishing up her master’s thesis on the subject of, appropriately enough, poetry. The project is called “Salty Wild,” and features writing influenced by the environment and her own personal history, from childhood to her transition into adult life. oly cow! So many people in this area are writing poetry! It is pretty inspiring. Thank you all for taking part in the Chico News & Review’s annual Poetry 99 contest. This year, we once again leaned on the 1078 Literary Committee to sort through the hundreds of submissions. The five-person committee is made up of Chico State, Butte College and local high-school English instructors, published writers, and editors, bringing an eclectic background of literary experience and expertise to the table when judging the various categories: kids (fifth grade and under), junior high school (grades sixth-eighth), high school (grades nine-12) and, of course, the wide range of adults.

Notes: In the junior-high and high-school honorable mentions, there are students from Table Mountain School in Butte County Juvenile Hall who made the cut. The students’ last names have been omitted to protect anonymity.

Also, in the high-school category, contest judge Pape’s daughter, Sylvia, received an honorable mention. To avoid any conflict of interest, the entries for the high-school category were handled by the other judges.

Additionally, author names were removed from poems before being given to the judges.

We Lost Everything

My arms shake from exhaustion, too limp for prolonged hugs, or heavy coffee cups to clutter my afternoon.

No to humid air.

What we lost had everything to do with the inevitable ocean, consuming stars, the ancient art of creating the simplest day from the immediate heaven.

Boxes of “food” color cupboards in molten, banal rainbows pulling migraines from the center of my skull. smell of green shag and old newsprint give my senses no place to rest.

A perfect day, we said, would be a day assembled of straw we gleaned in morning leisure.

We were caught by a seasonal eventuality, and Ursa rises there as if duty bound, as if the answer to misery were in a constellation.

At the edge of things there, we found that things pile up on the ground and that some time we will wade in things, wade in an ocean made of soft earth.

She’s actually already taking classes out at Butte College, and in addition to writing poetry and short stories, she’s studying ballet and taking prerequisite classes for the school’s nursing program.

Sherwood Montessori kids are on fire. With seventh-grader Lia Puser taking second place, they own the top two spots in the Junior High division.

Puser said she likes to write stories “out of my own little dreams in my head.” She also likes to draw and read fantasy-fiction, especially Marion Zimmer Bradley’s Avalon Series.

Lilly Ober is continuing her run in the Junior High division, adding to her first- and third-place finishes in 2012 with a top-three finish and an honorable mention in this year’s contest. The Chico Country Day School eighth-grader loves writing poetry and reading, and is focusing on the classics—like Uncle Tom’s Cabin—in her Book Club class.

She’s also a member of the school’s cross-country team.

This year’s top kid poet joins a long line of Sherwood Montessori students to win recognition for the works they create each year as part of literacy instructor Danielle Mennucci’s efforts to submit her students’ works to the CN&R’s Fiction 59 and Poetry 99 contests. Pope says he likes science as well as writing, and that he gets his inspiration to write from Chico’s natural environment, especially Bidwell Park.

Poetry runs in the Ingelson-Filpula family. This year Alden joins his sister Aline (who placed in last year’s contest) as a top finisher in Poetry 99. The CORE Butte Charter School student said that, after seeing his sister’s poem, he thought, “Wow, she’s really good,” and was inspired to write his own. In addition to writing, Alden said he likes to read, hang out with his family and build stuff with Legos.

Arts & Culture The stage is jam-packed in California Regional Theatre’s full-scale Les Misérables.

London in 1985, critics denounced it as a “lurid Victorian melodrama” and “a witless and synthetic entertainment.”

The play is operatic in form, meaning the music tells the story and what little dialogue is used is also sung. There’s a limit to what a string of songs can accomplish when it comes to transmitting the plot of a zillion-page novel, so if Les Miz the musical doesn’t quite do justice to Les Misérables the novel and some plot points are unclear—just who, for example, is the General Lamarque mentioned so prominently during the barricades scene?—it’s no fault of the actors and crew. They didn’t write the play (Alain Boublil and Claude-Michel Schönberg created the original French-language version).

All in all, it was an impressive staging, one that 26 CN&R October 17, 2013

was rewarded with a standing ovation when I saw it Sunday afternoon. All the major players—Vince Chambers as Valjean, Steven Oberlander as Javert, Kaelyn Hughes as the prostitute Fantine, Austen Strine as Marius, Nicole Thayer as Cosette, Makayla Thompson as Éponine, Dashiel Provost as the revolutionary Enjolras, and Megan Schwartz and Brandon Morgan as the greedy inkeepers Madame and Monsieur Thénardier—sang their parts robustly but with great sensitivity when required. They were fortunate to have the excellent local soprano Pam Thornton as their vocal coach.

I especially enjoyed Schwartz and Morgan, who brought colorful flair and rich physical playfulness to their comic-relief roles as the innkeepers. The stage lit up when they were on, and the big first-act scene in the inn (“The Innkeeper’s Song”) was one of the best in the show.

Credit choreographer Kate Reeves, costume designer Laura Thompson, set designer Christopher Burkhardt and lighting designer Kevin White for the quality of this scene and the half-dozen others with similarly strong production values, culminating in the amazing barricades scene that dominates the second half. It’s no mean feat to create a believable war scene on a sound stage, but this group brings it off.

A bit more about the costumes: As you can imagine, a production with 41 actors and many more roles—sailors, convicts, soldiers, factory workers, prostitutes, beggars, wedding guests and maids, not to mention the principal parts—places big demands on the costumers. I don’t know how many outfits Thompson and her crew had to create, but it had to be at least 60. Well done, folks.

Finally, the unsung heroes of the production were neither backstage nor onstage. They were the 13 musicians and conductor Ryan Heimlich located in the orchestra pit. Their job was to provide the instrumental music for some 30 songs performed one after another over nearly three hours, with only one break at intermission. It had to be grueling, truly a musical marathon, but it was evidence of the kind of dedication and spirit that make these community-theater productions so enjoyable. Ω

quiet but crucial perspective. From an ecological standpoint, annual agriculture (in both its conventional and organic by forms) has been an unqualified Jesse Mills disaster. Notwithstanding the petrochemical regime that has risen to dominance over the last two generations, the practice of annual tillage itself is problematic—severely impacting beneficial soil life, contributing to soil loss and releasing massive quantities of CO2 into the atmosphere.

Enter the humble acorn.

For as long as people and oak trees have coexisted, on every inhabited continent, we have sought nourishment and community under their canopies. Not too long ago in this area, acorns were a dietary staple. A natural stand of mature valley oak trees can yield several thousand pounds of acorns per acre in a good year (with some single trees found to produce more that 2,000 pounds), without soil amendments, tillage, or human labor of any kind. While by no means a silver bullet for all of society’s food-related ills, building a relationship with oak trees and their fruit can be one small lesson in a field of study that too often eludes our attention: how to be in a place.

I chose the valley oak for my recent experi-

ment in acorn cuisine. There is probably one—tall, majestic, of deeply lobed leaves and of weeping habit (or shape)—on your block. The trees’ acorns are larger than those of the blue oak, but both are suitable for eating. Production cycles of the acorn can be inscrutable; whole regions may go several years without a significant crop. This is a heavy production year, what is known in botanical circles as a “mast” year. On a short walk by the creek, I gathered several pounds in a few minutes.

The shells of young acorns can be difficult to crack. I soon determined that pliers were worse than useless and switched to a carpet knife with a sharp blade, scoring a line down the length of the acorn’s

shell; then I used my thumbnail to slip out the nuts. I discarded any obviously funky acorns, or those with a hole in the shell—the signature of the acorn weevil larva.

When I had a good pile of shelled acorns, I dropped them in multiple batches into a food processor with a little water, ending up with what looked like frothy chai. This I poured evenly into four one-quart Mason jars, which I then put in the fridge. This process, known as cold leaching, is paramount in making the acorn’s nutrition available. Bitter plant compounds known as tannins make unleached acorns indigestible. Soaking ground acorns draws out the tannins, freeing up the starch, fat and protein and eliminating the bitterness.

Every morning and night over the next five days I poured off the dark, acidic water, replaced it from the tap and gave each jar a vigorous shake. By the fifth day, the acorn meal had a bland taste, not bitter at all.

To dry the meal, I poured the jars’ contents through a mesh strainer lined with several layers of cheesecloth.

After squeezing out the remaining water, I ended up with something resembling brown sugar, which I then spread out onto two baking sheets. On my oven’s lowest setting (170 degrees), I baked the meal for about an hour, periodically pulling the baking sheets out to stir the meal around. Finally, I ran the dry acorn meal through an old coffee grinder I keep around for such things. The resulting flour was dark and aromatic, roughly the color of the discarded shells.

Far from bleak apocalypse fare, or pioneer-days anachronism, acorn flour has a deep and complex character and deserves a place at the modern foodie’s table. Having no gluten, it is best used in conjunction with wheat flour. For breakfast, I used the buckwheat pancake recipe in The Joy of Cooking. The pancakes were dark, with an incredible nutty, toasted flavor not unlike buckwheat; the texture was cake-like, with a mild crunch. Later my wife baked loaves of robust, delicious bread using the acorn flour.

If you’re up for an adventure in deep, tasty sustainability, grab a backpack and a friend and head to the park for some acorns. The universe will thank you for it. Ω

Fist-pumping clichés on full display at 1078 Gallery

was intrigued by The Deaf Pilots’ CD-release

that both local bands are made up of dudes in their mid-20s, have the distinction of not playing heavy metal (a welcome by Howard change), and seem to have earned Hardee decent local and online followings.

Furthering my interest was the howardh@ newsreview.com fact that The Deaf Pilots’ ReverbNation page described the band as an “energetic throwback to the times of psychedelic rock.”

So, a group of friends and I made REVIEW: a night of it. We stopped by the newly The Deaf Pilots and opened Winchester Goose for beers Strange Habits, Friday, Oct. 11, at (awesome on all counts), then popped 1078 Gallery. into the 1078, just up the sidewalk, to check out the show.

We arrived at 9 p.m., when the show was scheduled to start, but the gear was just getting set up. We killed some time and came back about 30 minutes later. Strange Habits was into their set when we returned, and it was readily apparent why they have made fans in Chico. Their college-party-friendly blend of ska, funk, punk and hip-hop (not unlike Sublime) seems tailor-made for Chico house parties. What’s more, vocalist and frontman Eric McGuire clearly draws inspiration from Brandon Boyd of Incubus, and the timbre of his voice is eerily similar, as well.

Guitarist Eric McCauley’s playing was a little lost in the mix, which was a shame because from the looks of it, he was tearing it up. Bassist Brett Sparrey and drummer Sheel Doshi played excellent supporting roles, avoiding attention-grabbing wankery. The same cannot be said of McGuire. At the conclusion of Strange Habits’ set, he leapt and grabbed hold of the lighting rig above the stage, and hung there as the mod-

est crowd of a few dozen politely looked on.

It came across as forced and unnatural, like he was going through the motions expected of a rock frontman by pandering to the end-of-set rule of going bat-shit crazy and throwing a guitar through a drum head or doing something equally edgy. There are crazy shows that call for genuine, over-the-top antics, but hanging from the light fixture, in this case, was out of place and fell flat inside the art gallery.

Prior to his band taking the stage, The Deaf Pilots’ vocalist and guitarist, Derek Julian, armed with an awesome Gibson Explorer, proceeded to soundcheck by shredding our faces off. It was clear the young guitarist was a disciple of Eddie Van Halen, and had the guitar chops and tone to match. In fact, the threepiece—bass (Andrew Watt), drums (Ryan Fairley) and guitar—seemed intent on matching Van Halen’s level of rock-cliché exploitation and farcically masculine guitar-wielding. A friend of mine summed it up nicely when he leaned over to quip, “This is what Tenacious D would sound like if they weren’t funny.”

It’s not that I’m opposed to bands that have no intention of reinventing the wheel. In fact, I like rolling with the wheel. I’ve drawn an immeasurable amount of pleasure from music—new and old—that follows basic rock formulas and has fun playing off clichés (and, to be fair, the band’s heavy-riffing “Where You Run”—a blues-based track in the vein of Australian band Wolfmother—did stick with me after the show).

But something more than formula is necessary to keep my attention; namely, the unique personality of the performers has to shine through to make the music stand out, and The Deaf Pilots’ cliché personality of cocksure swagger does little to separate them from the crowd. (Maybe I’m just disappointed that there was no hint of the promised psychedelia.) I will concede, though, that they do possess the kind of attitude that lends itself to a fist-pumping, college-party setting, which is exactly what they’re probably shooting for. Ω October 17, 2013

HAIM Polydor Records Gallons of virtual ink had already been spilled on three-piece sister-act HAIM before I’d heard a single note of their debut record, Days Are Gone. Some of it challenged their “indieness,� their trite lyrics, or how they sound too much like Fleetwood Mac and Phil Collins and Billy Ocean and Nu Shooz. Arguments can be (and, obviously, have been) made for all of that. But what caught my attention is not how Days Are Gone sounds like a 1985 episode of Casey Kasem’s American Top 40 radio show, but how quickly the sisters HAIM have gotten everyone—I mean everyone—talking, appealing to casual FM-radio listeners and stodgy music critics. That kind of shared experience speaks volumes in this zany, fragmented world we live in. Are HAIM worthy of all this attention? Yes, they are. “Falling� and “The Wire�— and the rest of the songs on the hit-single-loaded first half—sound like they were crafted out of pure platinum. Above all else, these gregarious young women have the chops and vox to back it up. So what if Days Are Gone is nothing new under the sun? Just follow HAIM’s lead—have fun, don’t over-think it, and enjoy the ride. —Mark Lore

Acceptance Speech Dance Gavin Dance Rise Records At first blush, Sacramento’s Dance Gavin Dance— with their grab bag of influences, abstruse song titles and seemingly endless membership drama— are easily dismissed as just another entry into the pack of melodic mallmetal bands. But if you pierce this unflattering facade, DGD has a lot to offer, not just in terms of chops—which the band exhibits in spades—but also with a penchant for hook-driven choruses and a surprising sincerity.

DGD may be weird, but at least they’re honest. The band’s sound exists somewhere between the unabashed prog metal of Coheed and Cambria, and the somewhat schlocky brocore of bands like Saosin and Chiodos. DGD isn’t afraid to get dirty, with co-vocalist Jon Mess’ tortured screams flying over the spasmic, overeager riffing featured on the album’s first four tracks. But the band’s real strength, and the yin to Mess’ aggressive yang, is the preternaturally high-register vocals of DGD’s other frontman, Tilian Pearson. Pearson’s soulful countertenor manages to redeem Acceptance Speech’s dull heavy passages with standout moments on “The Robot with Human Hair Pt. 4� and even the somewhat sophomoric “Honey Revenge.� However, whether DGD is simply a clever curiosity, or something more, remains to be seen.

Tom Kennedy Capri Records Tom Kennedy is a new name to me but the bassist has quite a history. He’s appeared on more than 200 recordings and performed or recorded with big names like Michael Brecker, David Sanborn and Al Di Meola, to name just three. Looking at his credits—which include guesting with the jazz/rock band Planet X—I thought, “Oh, no—more jazz fusion!� Big surprise! Here, with longtime bandmate/drummer Dave Weckl, he accompanies a group that includes tenor-sax man George Garzone, pianist Renee Rosnes, and guitarists Lee Ritenour and Mike Stern on a terrific selection of straight-ahead jazz tunes. Things get underway in a hurry with a highspeed rendition of Sonny Rollins’ “Airegin� (Nigeria spelled backward), on which both Rosnes—a stunning player whose CV includes lengthy stints with trombonist J.J. Johnson and tenorman James Moody—and Garzone display their command of the idiom, while Kennedy shows that he’s no slouch, either. “Moanin’,� the Bobby Timmons’ classic, is a nicely done feature for Ritenour. Trumpeter Lee Morgan’s ballad “Ceora� gets an appropriately dreamy treatment with magnificent solos by Garzone and Rosnes. Duke Ellington’s “In a Sentimental Mood� is dominated by Garzone’s muscular improvisation, and Stern takes control on his tricky “One Liners.� Cedar Walton’s “Bolivia� is another of the many highlights on this CD, which is definitely worth searching out.

of wits, male pride, and all-round know-how that develops between Phillips and the gaunt, rail-thin pirate called Muse (a haunting Barkhad Abdi). Ray’s screenplay works up a set of parallels and contrasts between Phillips’ crew and Muse’s tiny, desperate band of pirates, and part of the film’s special appeal is in the attention it pays, however briefly, to a small multitude of characters and their disparate points of view.

Much of the film plays as a kind of high-tech maritime/military procedural in international waters. Navy SEALs, a battleship, surveillance drones and other spy technology all play roles in the suspense elements, but the film rises to its most impressive levels when we begin to see that the simplistic good guys/bad guys outlook that usually prevails in such stories gets deflected here in some very interesting and even moving ways.

and incisive sensitivity to nuances of character.

Tom Hanks has the title role and he delivers a performance that is good throughout and perhaps great in the film’s brilliantly devised final sequence. Greengrass and screenwriter Billy Ray keep the central focus on Phillips, but never lose sight of what’s going on with the Maersk Alabama’s 20-man crew or with the scrawny quartet of Somali youths who first try to take over the ship and then later try to take flight with Phillips as hostage.

A key drama within the larger one comes from the keenly nuanced battle

The U.S. Navy wins its more or less inevitable victory here, but while that victory and the rescue that goes with it are more than welcome at the end of this tense drama, Greengrass and company steer clear of any formulaic triumphalism. The screenplay and direction combine with Hanks’ quietly multifaceted performance to portray Phillips as a genuine hero, but also as one deeply marked by the devastating cost of victory.

A recurring refrain in Ray’s screenplay has characters in the midst of a crisis telling others that everything is going to be OK. There’s a sense of foreboding that goes with that claim right from the first time we hear it. By the film’s final scenes, we have begun to see how much of that refrain is true and how much of it is not. Ω

Blue Jasmine

The new Woody Allen picture is a smartly written, briskly engaging ensemble piece with pungent roles for a half-dozen well-chosen supporting players and a complex one for its star, Cate Blanchett, who is superb. Blanchett plays the eponymous Jasmine, an East Coast upper-cruster who has fallen on calamitously hard times. At the outset of the story, she is just arriving in San Francisco, nearly destitute and hoping to find tenuous sanctuary with her semialienated sister Ginger (a delightfully rowdy Sally Hawkins), a mother of two who scrapes out a living as a grocery checker. Initially, Jasmine and Ginger appear as foils in a lowkey comedy of contemporary manners, with both in various states of crisis. The contrasting tensions and mishaps in their respective stories soon become part of a larger story in which the shifting trajectories of their various relationships, familial and romantic alike, begin to mirror each other even as their differences become more aggravated. Gravity

The new film by Alfonso Cuarón is a dazzling piece of artful entertainment. It’s a sci-fi adventure, with a pair of stranded astronauts played by George Clooney and Sandra Bullock trying to survive a spacestation calamity, and it packs a great deal of unexpected interest into what might sound like a relatively simple story. Scarcity of oxygen, suspension of the law of gravity, extreme physical isolation—they all heighten the stakes in the characters’ efforts to improvise self-rescue via the increasingly disabled remnants of their elaborate spacetravel technology. Cuarón and company make wonderfully expressive use of the 3-D format on behalf of all of its main concerns.

Both visually and dramatically, Gravity is about human beings struggling to get their bearings, in several senses of that word.

Spatial and psychological disorientation recurs, but the screenplay by Alfonso and his brother Jonás Cuarón also nudges us toward perspectives on the dimensions of human identity, of purpose and self, and locale. Cinemark 14, Feather River Cinemas and Paradise Cinema 7. Rated PG-13 —J.C.S.

Screenwriter Peter Morgan turns his talents to the politics of celebrity and the psychology of high-speed risk-takers, via the storied rivalry of world-class Formula One auto racers Niki Lauda from Austria and James Hunt from Great Britain on the 197677 Grand Prix circuit. Both men are extraordinarily gifted auto racers, both are from wealthy backgrounds, and both seem obsessed with defeating the other. Beyond that, they are two entirely different types of competitive males. Lauda (played by Daniel Brühl) is cold, intense, socially withdrawn, brilliantly analytical, mathematically precise; Hunt (played by Chris Hemsworth) is handsome, energetic, charming, relentlessly outgoing, and reckless in appetite and impulse. These contrasts are a little bit too pat, but director Ron Howard and his actors bring them out with an attractive zest that is made all the more interesting by hints of rueful regret and half-hidden desperation.

Though Arts DEVO tries hard to find a spot in the paper every week to highlight every interesting event on the calendar, the Artoberfest month is so overstuffed that it’s just not possible to do justice to all the worthy works of art, let alone take it all in.

I’m particularly disappointed to (most likely) not be able to attend the Chico State theater department’s production of Doctor Faustus (showing through Oct. 20, in Wismer Theatre). Ideally, I would have gone to a dress rehearsal in time to share how director Katie Whitlock reinvented Christopher Marlowe’s sin-filled tragedy. Whitlock can always be counted on to throw convention aside in favor of experimentation, and her approach always makes me eagerly anticipate any project she’s working on. But, even without my fanboy blathering, the advance details should inspire a visit to the university’s black-box theater.

“Some blues music in a coffin graveyard filled with voodoo-inspired sins and demons,” is one description offered by Whitlock via email for her adaptation, which includes gender-swapping the doctor (played by senior Wanted: your soul. theater major Brittany Siguenza) who makes a deal with the devil, and putting her in a Southern Gothic setting to a blues soundtrack. Add the frightening skull-headed demons created by costume designer Sandra Barton, and you have the promise of enough pre-Halloween darkness to satisfy all sinners.

HOP-BOMBS AWAY! In case hosting beer fests, pumping out a million barrels of beer, and building a second brewery wasn’t enough, Sierra Nevada Brewing Co. is also adding a Bay Area expansion to the brewery’s busiest year ever. According to a company press release, the Torpedo Room will begin pouring Sierra Nevada beers in Berkeley (at 2031 Fourth St.) in early November. Named for the hop-infusion machine that the brewery invented (and uses to great effect on the popular palate-tingling IPA bearing the magic machine’s name), the intimate Torpedo tasting room (capacity: 45) will feature 16 taps, taster flights, growlers to go, as well as six-packs, cases and big bottles of special releases.

This announcement comes on the heels of news that Sierra Nevada’s new East Coast facility in Mills River, N.C., is already brewing its first test batches, and will be brewing for production by early November.

And, in related news, Lucero Olive Oil is Chico Torpedoes Berkeley. branching out as well. The Corning olive-oil grower and seller opened a tasting room in Tigard, Ore. (outside Portland), in May of this year, and on Oct. 26 will cut the ribbon on a second room in downtown Napa. There’s just too much good stuff in the North Valley not to share. You’re welcome, world.

A pair of Chico natives and Chico State students just won a national competition for a new outdoor sport that you may not have heard of: spikeball. It’s sort of a mix between volleyball, foursquare and ping pong and it’s quickly gaining popularity. On Sept. 28, the Chico Spikeball team of Skyler Boles, 23 and Shaun Boyer, 21 (pictured at left and right, respectively), took first place in the Spike-A-Palooza national tournament in Nashville, Tenn. Boles, a self-described spikeball ambassador, sets up matches at Chico State, teaches the sport at local schools, sells the equipment and enters tournaments all over the U.S. Visit www.facebook.com/chicospikeball for more info, or call/text Boles at 519-3965.

How’d it feel to win Spike-A-Palooza?

It felt very cool. I wanted to make sure we were the best in the U.S. There were 62 teams.

We won $500—$250 each—and got engraved glass pitchers. We also won a tournament in New York last June that had 44 teams. We are sponsored with cool merchandise by SAVAGEultimate, but I really play for the love of the game.

How’s the game played?

It’s super easy and you can play anywhere. It’s two-on-two and you use a small net that looks like a mini-trampoline. Each team hits a ball by hand a maximum of three times before bouncing it off the net to the other team, [and they do] the same until one team messes up, giving the other team a point. The first to reach 21 wins.

How did you get into spikeball?

I saw a video of it on YouTube 1 1/2 years ago and fell in love. I said, “That’s the kind of sport for me.” I wanted to unite people and organize competitions. I now teach it at Chico State, Chico High, Chico Junior High and Marsh Elementary. I also sell the sets—the net and ball—for only $50.

What do you like best about the sport?

Going as hard as you can and getting the ball back on the net. It’s about hand-eye coordination, finesse, deception and not quitting on the ball. Playing in the sand is the most fun because you don’t have to think about landing.

What do you think the future holds for the sport?

It’s only going to grow, with bigger prize money. In my first tournament there were only 21 teams and at Nashville there were 62. We have open game days Wednesdays, 4 p.m., at Chico State’s Yolo Field by the tennis courts.

My family always said I should do something I love for work and now I’ve found it.

Storms Editors note: Anthony’s taking the week off, so were re-running this column from 2008.

I love storms, when Mother Nature is kicking ass and taking names. I was born in the Midwest and spent my first half-century there, and I’ve been in some fairly exciting weather. No Hurricanes, but I’ve been close to several tornadoes.

One of the things I miss most about living in the Midwest is the sudden appearance of a summer storm, with thunder and lightning and big wind. I lived for a while in a high-rise apartment in Chicago, and the best thing about it, other than the cuties by the pool, was being able to watch a thunderstorm coming in off the prairie, apparently lighting up cars and buildings as it moved across the city headed for me.

I especially like storms that knock out electric power. First, a lack of electricity tends to be accompanied by quiet, which is good. And when the power’s out, we pretty much have to listen to the storm, which can be as engaging as any music. The silence that follows a snowstorm is sublime.

In the blizzard of ’67 in Chicago, I spent the night on a bus headed home, and we never got more than a couple of miles from downtown. That was no fun, but the miles I walked the next day to complete my commute were quite pleasant, with no cars or buses, just walkers and the occasional child being towed on a

sled. The South Side wasn’t that quiet again until the blizzard of ’79.

A storm that interrupts electricity is also likely to disrupt street traffic, and the combination is good for air quality and my peace of mind, which is most of what I care about these days. After the initial annoyance of nothing happening when I flip a switch and having to do without electronic entertainment, I begin to notice and enjoy how my horizon shrinks back from halfway around the world on some Godforsaken website to maybe the back fence. Many, many blizzards in the Midwest eventually helped reveal to me the wisdom of attending to what’s right here on the bookshelf, thawing in the refrigerator, simmering on the stove, waiting in the next room.

Particularly sweet was the exquisite anticipation of being snowed in, when doing nothing would be all anyone expected of me. Making sure I had the necessities so I wouldn’t have to go out again, finding a treat to share with my family, picking a movie we could all stand and that we might actually like, wading through the snow from the garage and not caring about getting snow on my pants because I’d soon be taking them off anyway—all that was good, and I’m glad I did it.

But now I can’t imagine putting up with six months of winter in Minnesota for the sake of experiencing the maybe two snows per year that would promote coziness before the slush. It wasn’t that good. Reverie will do nicely.
