A time to give Community members have a window of opportunity to give

back to local nonprofit organizations and to make their contributions count.

Sept. 30 is the last day to make a donation through the Annie B’s Community Drive—the annual philanthropic campaign focusing on organizations in Butte, Glenn, Colusa and Tehama counties.

That fundraising drive—organized by the North Valley Community Foundation—is now in its seventh year. This year, there are more than 250 organizations signed up, waiting to take in donations.

What makes Annie B’s so special—and different than other local fundraising drives—is that each donation is bolstered by an additional pool of funds. That is, 100 percent of each contribution goes directly to a donor’s chosen nonprofit. However, the organization then receives an additional percentage of money from a grant. According to the foundation, last year’s percentage grant was 9 percent.

That’s a significant amount of money and an incentive to supporters to open their pocketbooks.

This is a great time to give, for a number of reasons. For starters, tax season will soon be upon us, and all of the contributions are tax-deductible.

Another reason to give is that many of these nonprofit organizations are struggling in the wake of many years of economic volatility, which has reduced the level of financial support not only from the public but also from public agencies. But perhaps the best reason to give to these worthy organizations is that they work so hard to help make our communities better places to live.

Moreover, giving makes us feel good. That’s been scientifically proven.

starters, bars may be demanded, at least in part, by criminals. Or perhaps police officers simply look for criminals in areas with a lot of bars. The point here is that your guess is as good as mine.

It’s an even larger stretch to argue that limiting the number of alcohol outlets will have any effect on alcohol consumption—let alone crime. Luckily, economists and criminologists have studied such things for decades. Here is what they have found: First, decreasing alcohol consumption likely decreases crime. Second, increasing the price of alcohol will decrease alcohol consumption—and thus indirectly lead to a decrease in crime. Third, and particularly relevant to the current debate taking place in Chico, limiting the number of alcohol establishments has no conclusive effect on either alcohol consumption or crime.

The answer to Chico’s drinking problem therefore appears to be an additional tax on alcohol. However, the state of California reserves the right to tax alcohol sales. What can we do then? One option is to lobby state representatives for a tax hike. While this may seem like a futile attempt to reduce crime, so does denying a local bar a license to operate—and it doesn’t keep me from enjoying a good beer at a new bar in Chico. Ω

Making a little room for art We applaud the Chico City Council for unanimously approving

the Chico Arts Commission’s revised work plan during its meeting on Tuesday (Sept. 17). We also commend the Arts Commission for its efforts to mitigate the amount of impact its work plan will have on city staff. (See photo caption in “On the chopping block,” Newslines, by Robert Speer, page 10).

Like the other volunteer-run commissions on hand at the meeting, the Arts Commission was to forced to revise its previous list of goals and priorities in response to the city’s recent budget cuts. For the Arts Commission, those cuts went especially deep, as the panel lost the city’s only artsdedicated staff member with the layoff of the arts-projects coordinator.

During Tuesday’s meeting, the council was very receptive to the changes and encouraged by the Arts Commission’s commitment to coming up with alternative ways of funding the arts (especially given the news of the growing budget deficit announced earlier in the meeting) through potential partnerships with other arts organizations and the transformation of the local-arts-supporting Chico Arts Foundation into a 501c3 nonprofit.

Of course, the benefits from any outside cooperation and potential grant opportunities are years away, at best, and the city’s financial situation is only getting worse. So, the degree to which arts will be supported in Chico over the next few years is still very much up in the air.

But, putting arts-funding concerns aside for a moment, it was refreshing to hear the City Council’s response to the Arts Commission and the vocal arts community that was on hand, and have public acknowledgement of the value of Chico being an arts town. Most of the council members expressed their support, pointing to both art and the Arts Commission as benefits to the economic development of Chico, and the value of art in making Chico such a desirable place to live and visit.

We hope that such clarity of art’s role in the vitality of the community and the expressions of good will carry over to the near future when some obviously tough budget decisions will be before the council.

It’s unfair and unhealthy to continue to make disproportionately deep cuts to a budget item that already receives such a minuscule portion of the pie. Times may be tough, but without art they’d be unbearable. Ω

Cats and contributions Shortly after my husband and I bought our first house a couple of years ago, we noticed an unexpected resident, a scrawny street cat we think is a Himalayan cross. We couldn’t get too close to him at first, but we could tell that he was, ahem, intact.

That is, he wasn’t neutered.

He ended up being a pretty friendly little guy, so we don’t know if he was dumped on our street or if he was the pet of an irresponsible owner. In any case, we ended up feeding him, and naming him, too. We already had an indoor cat named Charlie, so we started calling our new friend Linus. It stuck.

We didn’t think too much about Linus’ manhood at the time, but that changed when some female feral cats wandered into our neighbors’ yard. Linus started spraying everything in sight. For our sake, and the sake of not having kittens all over the place, we decided to have him fixed. But we knew we’d also need to get all of the lady cats fixed, too, since there were other tomcats roaming the ’hood.

Luckily, we have the nicest neighbors in Chico.

Between our family and theirs, we ended up trapping and fixing six cats last spring. One female feral—a little clubfoot calico—evaded us and ended up having two kittens.

She’s since been spayed. We have a little more work to do to keep those kittens from being able to have kittens. But all in all, it’s been a successful effort.

We could not have done it, however, without the help of Paws of Chico. This local nonprofit provides financial assistance to folks with cats and dogs who couldn’t otherwise afford spay-and-neuter services, and to other people who go out of their way to help control the populations of unwanted, feral or abandoned cats.

Paws is one of the many very worthy nonprofit organizations taking part in the North Valley Community Foundation’s seventh annual Annie B’s Community Drive.

Donations taken in through this fundraising campaign— named after Annie Bidwell, wife of Chico founder John Bidwell—are buoyed by a grant fund that adds an additional amount of money to each contribution.

The campaign started on Aug. 1 and ends at the end of this month. All of the donations made through Annie B’s are tax-deductible. Go to www.nvcf.org/donate to find links to organizations divided into 11 categories, such as animal welfare, education, environment, health care and the arts.

Under the heading of community services, for example, you’ll find familiar names such as KZFR Community Radio 90.1 FM, Chico’s amazing volunteer-run radio station. You’ll also find less familiar names, such as ChicoSol, the online bilingual news magazine run by journalist Leslie Layton, author of this week’s cover feature.

More than 250 nonprofits are participating in this year’s drive, so odds are there are multiple organizations that have touched your life or the lives of people close to you. In other words, you don’t have to be a catloving news junkie to donate. You’ve got options.

City manager remarks Re “Welcome to Chico” (Cover feature, by Tom Gascoyne, Sept. 12): That Brian Nakamura is not fit to manage the city of Chico is evidenced by his admission that “he came to town a few days before his interview and visited local business owners to get a grasp on what was happening here.”

One can no more “get a grasp on what is happening here” solely by giving ear to the “where is the money?” bleatings of business owners, than divine the whole of Chico from a seat in a police car, or a pew at the Neighborhood Church.

This is especially true when one regards the only businesses specifically named by Nakamura in the piece: BevMo!, Dick’s Sporting Goods and Krispy Kreme. None are native to Chico. All are chains. BevMo! is a shameless booze wallow. Dick’s pushes killing machines, enabling humans to efficiently slay one another. And Krispy Kreme oozes forth hideous fat-bombs that blow out aortas.

But perhaps that’s Nakamura’s “vision” for the city—a place where people get greased up on donuts, grab a couple of jugs, and search for shit to shoot. That sounds to me more like Squeal Like A Pig, Arkansas, or Icepick, Minnesota.

Maybe Mr. Nakamura can next offer his services to some such garden spot. Soon.

For the story about Brian Nakamura’s first year, I specifically said that Mr. Nakamura took a reduction in total compensation to come to Chico to clean up a mess. That’s a fact when you include all forms of compensation, including deferred compensation and benefits.

It is as easy as reading the Hemet contract versus the contract with the city of Chico. No deep investigative reporting is required.

Compared to past city managers, compensation is roughly 20 percent above Dave Burkland, 8.2 percent above Greg Jones, and 7 percent below Tom Lando. But a very large sum indeed.

While the Brown Act prevents disclosing closed-session discussions, I can say that I went into the city-manager selection process believing that we could hold the line on citymanager compensation. I was wrong. All of the serious contenders for the job were in the same level of compensation. At the same time, there was deep concern that the city was headed for serious trouble without professional intervention.

Mr. Nakamura, we wish you the best, but we’re not happy with how things are going. The budget is now the excuse for everything either done or undone. Eightmonth delays in access to public information are unacceptable.

Transparency is a requirement of democracy.

Apparent delayed police response unless there are weapons brandished or bodily harm creates fear in everyone. City services being privatized reminds us of what happened in Baghdad. Labeling unlivable, tiny housing “infill” or “casitas” is a developer’s game. Would you live in these shoeboxes that benefit only the developers building them? No, you would not.

Bureaucracy that requires permits to swap out existing toilets in private houses or face fines feels like a chapter from George Orwell’s 1984. Walking over human “piles” in downtown or facing harassment by aggressive panhandlers isn’t worth it—we’ll shop elsewhere.

Our park is a unique treasure.

We want it open and staffed, but fix the inept management. Be creative. Find different options. Utilize existing volunteer groups— they want to help. Look up from the numbers—those numbers represent humans. Look to cities that have figured these problems out.

You will be held accountable, as will those who hired you.

Look at the last two towns Mr. Nakamura has managed as places to live and work compared to Chico. They are not known for visual art or music, have low highschool graduation rates, a small number of parks and high use of public assistance.

These places did not become big job-attractors while he was there. Chico no longer qualifies as a “Tree City” now that we no longer have an arborist or the proper city tree-maintenance crew.

With no art commissioner, would we make the Top 100 Art Towns list again? Add in cuts to our park maintenance and you can expect Chico’s standing as a desirable place to live and visit to fall. Less tourism, less attraction for innovators: less money being circulated.

When you cut services and the employees that provide them, you cut the number of people who buy homes and locally made goods and services. Mr. Nakamura has struck at the heart of our tax base. Can you say “austerity”?

I have a great idea: Let’s sell Bidwell Park to developers, cut down our urban forest and sell it for lumber, and get rid of those hands by city hall. Then we can all move to Banning.

A vote for Jefferson Re “More than a state of mind” (Newslines, by Ken Smith, Sept. 12): I completely agree with the Siskiyou County Board of Supervisors approving a “declaration to withdraw from the state of California.” Tehama, Shasta, Del Norte and Humboldt counties should follow suit. The main reason is water!

There is no reason we in the North State should give our most precious resource to the corporaterun farms of the San Joaquin Valley.

Many years ago that area produced local produce according to seasonal weather and snowfall in the southern Sierra. Since then, we have seen many drought years yielding the major river sources such as the San Joaquin—among the most heavily dammed and diverted of California’s rivers—little water to divert to agricultural interests.

Despite this, the corporatefarming operations have continued to plant thousands of acres of water-intensive crops such as almonds and other nut crops on the west side. These depend on Sacramento River water.

Now our esteemed Gov. Jerry Brown wants to divert our water past the Delta via the tunnel project.

We need to send a clear message to Sacramento: Quit buying into the corporate-lobbyist interests.

A modest proposal Re “Clarity on the way” (Second & Flume, by Melissa Daugherty, Sept. 5) and “The time for answers” (Editorial, Sept. 5): I read with great interest the column Second & Flume and the related editorial that appeared in the Sept. 5 issue of the CN&R. Both suggested that until there is a full disclosure, including who is responsible for the city’s financial meltdown, this community will not move forward.

Unfortunately, the thorough

audit of the city’s financial state and answers to how we got here will not be complete for several more months. Perhaps in the interim the CN&R could invite our two seemingly most informed city council members, Mark Sorensen and Mayor Scott Gruendl, to pen a guest comment that could at least shed some light on what is known at this point in time. That would certainly help the community.

Sorensen and Gruendl are both respected council members who at times do not see eye to eye, but in this particular instance seem joined in the effort to confront the financial problems the city faces.

If asked, I’m sure they would respond.

Thanks for sharing Re “A paralyzing pain” (Healthlines, by Robyn Alana Engel, Sept. 12): I am writing in response to Robyn Alana Engel’s article about having severe depressive episodes.

Recently, I went through one of the worst episodes I’ve ever had.

Things were slowly falling apart, my thoughts consumed me, and I knew I was about to fall. I fell, and I fell hard.

Robyn’s article reminded me that I am not alone. For years, I thought what I was feeling and the way I was behaving was normal, but when I was diagnosed with bipolar and major depressive disorders a few years ago, finally it clicked. DOG KILLERS BEHIND BARS

Two people remain incarcerated in the Butte County Jail on felony charges of cruelty to animals in connection with two dog killings.

According to the District Attorney’s Office, Simonette Yvonne Ayala-Warr, 55, of Paradise is charged with stabbing to death her poodle-mix, Sasha, on Sept. 2 after Paradise police responded to a call about a barricaded residence. She reportedly told officers she had killed the dog, which was found in the bathroom shower. Ayala-Warr stabbed herself as well, a press release said. Her court date has been postponed to allow for a mental-health evaluation.

On Sept. 3, a resident of Natoma Court in Chico discovered a miniature dachshund named Shrek hanging by his neck from a shoestring tied to a shrub. Jose Luis Flores, 34, of Chico was charged with killing his mother’s dog following an argument. He’s pleaded not guilty and is due back in court Sept. 24.

The Medi-Cal mess

A bicyclist crossing the bike bridge over Lindo Channel reportedly noticed a dead person on the north side of the dry riverbed shortly before noon on Sept. 13. A call was made, and police, fire and ambulance responded, discovering the body of a deceased male who, based on advanced decomposition, had died some time ago.

Police have identified the man as 53-yearold Kevin Spangler of Chico.

A forensic pathologist from the Butte County Sheriff-Coroner’s office was called in, and an autopsy to determine the possible cause of death is to be scheduled.

E-R SILENCES ‘TELL IT’

The Chico Enterprise-Record has pulled the plug on its long-running reader-comment column “Tell it to the E-R.” Editor David Little announced the column’s pending death in his Sunday column on Sept.

15. The final shout-out was published the next day. Little said he’d never been comfortable with the anonymous nature of the comments in the 14 years he’s been running the show. The column itself, he said, had a 28-year run.

Perhaps the final straw was an Aug. 22 call-in titled “Put city officials’ heads on display,” in which the caller suggests decapitating the city manager, his assistant and all of the council members and placing their heads in the new roundabout at Second and Flume streets. Two days later, the paper chastised itself in the “Hits and misses” Saturday editorial for publishing the comment.

Replacing the column is a new section called “Start Your Day Here.”

Is Obamacare going to improve health-care access for low-income Californians?

“Right now, people need to know they’re eligible, and go sign up,” said Robert Phillips, director of health programs with the Sierra Health Foundation, a private Sacramento-based group working to improve health care.

He says many people receiving Medi-Cal coverage only learn by chance that they are eligible after becoming injured or ill and visiting a hospital, “where the eligibility worker tells them.”

But there is another problem with Medi-Cal: The enrollment process can be so laborious and time-consuming that people don’t even bother signing up, or can’t complete the process once they start.

“It’s so complicated,” said Kelly Bennett-Wofford, executive director of Sacramento Covered, an organization that provides direct assistance to people interested in getting screened and, if eligible, signed up for Medi-Cal. “There are so many determining factors that you need to process to figure out if you’re covered.”

Copies of bank statements, trust-fund records, properties owned, vehicle registration, a birth certificate and other forms must be handed over to the county in order to help determine if an individual qualifies.

“Generally, the more paperwork that you ask of people, the less likely they are to sign up for something,” said Vanessa Cajina, a legislative advocate with the Western Center on Law & Poverty.

Improvements to the existing system and relief for uninsured low-income Californians is on the way. The Patient Protection and Affordable Care Act—what has been called “Obamacare” for several years now—takes effect on Jan. 1, and will greatly simplify the Medi-Cal application process.

The criteria for determining if one is

eligible will be reduced—culled down to just age, family size and income, which must be less than 138 percent of the federal poverty level.

This means that a person between 19 and 65 years of age living alone and making less than roughly $15,900 per year will qualify for Medi-Cal. In all, the Affordable Care Act will increase the number of Californians eligible for Medi-Cal by more than a million people statewide.

When the Affordable Care Act kicks in, the state will see significant Medi-Cal uptake.

(D-Sacramento), a strong health-care advocate, is currently pushing outreach efforts to notify those eligible that they can sign up.

Although county governments have substantial financial incentives to sign up their residents for Medi-Cal, since the program brings them both state and federal reimbursement, many counties’ efforts to inform the public that the state could be paying their medical bills have been lacking to nil, according to Pan. Other problems in the Medi-Cal system may be too deeply ingrained to be eliminated. Most troubling, in many critics’ opinions, is the possibility that enrolled Medi-Cal members might not be receiving medical attention when they want it.

Cutting to prevent burning?

That’s because of the way that the state pays health-maintenance organizations, or HMOs, such as Health Net and Molina Healthcare. They receive money based on the estimated population of eligible Medi-Cal patients in their service area—whether or not those people ever visit a hospital.

“There is concern that this arrangement could cause an HMO to discourage someone from receiving care, since they get paid no matter what,” Pan said.

But exactly how HMOs, hospitals and other providers treat—or don’t treat— Medi-Cal patients based on payment quibbles is an entirely gray area, lacking in authority oversight.

“No one knows whether or not the level of access we’re paying for is on par with what we’re receiving,” said Phillips.

Pan recently authored legislation that could improve some of Medi-Cal’s shortcomings and increase public transparency. Assembly Bill 209 would require the state’s Department of Health Care Services to hold public meetings every few months to report on the quality of both health and dental care through Medi-Cal HMOs and providers. The state would also be required to appoint an advisory committee to improve health-care quality.

Beginning in 2014, Medi-Cal will serve single adults without children, who have previously not been eligible. This group of people, some have said, likely includes a disproportionate number of single men with drug and alcohol problems—expensive additions to the MediCal population. Federal reimbursements will be ramped up to help soften the expected blow for providers—but they will still take a hit.

Already, Medi-Cal has been a costly program to enact.

“We hear all the time how hospitals can’t even break even because they have a high number of Medi-Cal participants,” said Bennett-Wofford, at Sacramento Covered.

Providers, after all, receive only fractional compensation for each Medi-Cal patient they see. This system may have two opposite effects, according to analysts, either creating incentive for providers to not serve Medi-Cal patients at all, or actually driving stronger preventative efforts so that providers can avoid having to cover the cost of expensive treatment later.

Thus, Medi-Cal under the Affordable Care Act will put to the test whether social health care in America can work, and it remains to be seen whether enhanced Medi-Cal will drain hospitals of their resources—or if it helps to keep millions of Californians out of them in the first place. Ω

Assembly bill calls for increase in diameter of trees thinned in Northern California forests s wildfires continue to ravage CaliforAPark’s nia—most notably Yosemite National Rim Fire, the third largest to ever hit

the state—lawmakers rushed through legislation purportedly designed to reduce fuel for future conflagrations.

However, critics say the proposed law— Assembly Bill 744, which as of Wednesday (Sept. 18) awaited Gov. Jerry Brown’s signature—is the latest legislation meant to relax regulations on logging operations under the guise of thinning wildfire fuel. If enacted, AB 744’s main effect would be to increase the diameter of trees allowed to be cut down from 18 to 24 inches in the Sierra Nevada region, which includes sections of 22 counties including Butte, Tehama, Shasta and Yuba, for the next three years. It would also be enacted in all of Trinity, Modoc and Siskiyou counties.

The bill, sponsored by Assemblymen Brian Dahle (R-Bieber) and Rich Gordon (D-Menlo Park) and co-sponsored by the North State’s two senators, Jim Nielsen (RGerber) and Ted Gaines (R-Roseville), originally dealt with recycling beverage containers when it was introduced in February. It was reviewed by state Senate and Assembly committees and passed the Assembly (73-1) in that form.

On Sept. 10, Dahle announced he was introducing amendments to the bill to transform it into the “Forest Fire Prevention Pilot Project Act.” All language regarding recycling was stricken from the bill’s text, and the new version passed the Senate 26-5 on Sept. 12.

“In the past few months we have seen the catastrophic results of forests that are too loaded with forest fuels,” Dahle said in a Sept. 12 press release. “The people of my district have lived in a cloud of smoke, as

thousands of acres have burned, destroying lives, property [and] critical animal habitat, [and] ruining our watersheds and wasting valuable resources.

“I introduced AB 744 to address this crisis,” he continued. “It is my hope that this pilot program, to utilize the Forest Fire Prevention Exemption, will give communities the head start they need to avoid a repeat of the terrible fire season we are now suffering through.”

Logging is largely regulated by the

Z’berg-Nejedly Forest Practice Act of 1973, which prohibits any logging activity without a timber-harvesting plan prepared by a licensed forester and approved by the Department of Forestry and Fire Protection. In 2005, the Forest Fire Prevention Exemption established the standard of allowing trees 18 inches or less in diameter (measured eight inches from the ground) to be cut down without a harvesting plan to decrease fuel for fires.

AB 744 is a watered-down version of another bill—AB 350—which failed to pass muster with the Assembly’s Committee on Natural Resources in April. The previous bill sought to increase the size of trees allowed to be cut to those 28 inches in diameter.

According to a fact sheet provided by Dahle’s and Gordon’s offices, some organizations that support AB 744 include the California Fire Safe Council, the California Cattlemen’s Association and the Sustainable Forest Action Coalition. Those opposed include the Sierra Club, the Center for Biological Diversity and the California Native Plant Society.

On Sept. 10, before AB 744 passed the state Senate, the San Francisco Bay Chapter of the Sierra Club ran an article in its online newsletter, the Yodeler, criticizing the bill.

the removal of large trees changes the character of the forest and destroys wildlife habitat, and that large trees aren’t the problem when it comes to forest fires.

“Forest owners can already remove trees 18 inches or smaller in diameter,” it reads.

“Small trees and underbrush increase fire risk. Allowing the removal of larger trees will not make us safer.

“Larger trees are fire-resistant. Removing them modifies the forest climate by increasing sunlight, thus raising the temperature and encouraging flammable underbrush to grow.”

The Yodeler also points out that climate change is contributing to increased fire activity, and that logging—specifically clear-cutting—can exacerbate conditions that lead to burns.

Another similarly controversial

piece of legislation is currently being considered on the national level. HR 1526, billed as the Restoring Healthy Forests for Healthy Communities Act, would substantially increase the amount of timber harvested on federal lands. It would also require the federal government to give 25 percent of the money it earns from logging operations to the counties where such operations occur.

HR 1526 has the support of several North State lawmakers, including Rep. Doug LaMalfa (R-Richvale) and Rep. Tom McClintock (R-Granite Bay).

On Tuesday (Sept. 17), McClintock addressed the House of Representatives, extolling the positive impact of logging on fire prevention, and referencing the Rim Fire.

“For generations, we carried the excess timber out of our forests through sound forest management practices, leaving room for the remaining trees to grow healthy and strong,” he said. “We had far less frequent and less intense forest fires, healthy trees that were disease resistant and pest resistant, a healthier watershed and a thriving economy.

“Today, extremist environmental regulations have driven that harvest down by more than 80 percent in the Sierras over the past 30 years.”

On the chopping block City’s deficit gets worse, and so does the vitriol for more heads to roll at Ltheook City Hall in coming months, as city’s operating deficit contin-

ues to grow.

That was the message City Manager Brian Nakamura gave council members during a budget update at their Tuesday (Sept. 17) meeting. The update followed closure of the financial books for fiscal year 2012-13 showing a greater-than-anticipated deficit, particularly in the fund for capital projects, known as Fund 400 and one of several so-called “enterprise funds,” as distinct from the operational general fund.

“As we close the books, it is clear to me that further non-safety reductions will be needed to address current and future shortfalls,” Nakamura had written earlier that day in a memo to the council members.

In developing the FY 2013-14 budget, city staff had estimated that Fund 400 would end the year with a $2.5 million budget deficit, Administrative Services Director Chris Constantin wrote in a report to the council. Final reckoning increased that figure to $3.2 million.

The problem, he said, was that while the amount actually spent on capital projects—such as the city’s sewer upgrade—decreased greatly between 2008l and 2012, its expenses did not. Or, as Vice Mayor Mark Sorensen put it in business terms, “It’s as if sales went down by two-thirds, but we allowed our operating costs to increase simultaneously.”

That, added to the loss of redevelopment funds, led to the deficit.

Constantin estimated that an additional $1.2 million in cuts would be needed to begin to right the city’s structural imbalances.

Although city staff and the council members profess not to want to cast blame for this dire state of affairs, saying they prefer A couple dozen artists and arts lovers lined the back wall of City Council chambers Tuesday to show support for the city Arts Commission. They worried that the council might ax it to save money, or force it to merge with the Chico Arts Foundation; as it turned out, the council did neither.

Instead, it unanimously accepted the commission’s revised work plan, which, in a cost-saving measure, reduced meetings to bimonthly and changed them to 4 p.m. City Clerk Deborah Presson said she would be happy to be the staff liaison to the commission under the new schedule.

to look ahead, in past meetings they have blamed former Finance Director Jennifer Hennessy and former City Manager Dave Burkland, among others.

Sorensen pointedly asked Frank Fields, the city’s accounting manager, who was responsible for the deficit. “The [previous] budget team,” Fields replied.

And Nakamura’s memo to the council, mentioned above, included a copy of a Jan. 25 memo sent to him by then-Building and Development Services Director Fritz McKinley that Nakamura said suggested that the existence of $2.34 million in expenses may have been kept from the council.

Saying he too wanted to move forward, Nakamura noted nevertheless that the council’s policy decisions “are only as effective as the information available when making such decisions,” and that it was sometimes important for the council to “step back and see the big picture”—which in this case meant which city staffers screwed up.

Speaking to this issue were three former longtime city employees laid off earlier this year who have been waging a campaign against Nakamura and his administrative team as well as, lately, Mayor Scott Gruendl, attempting to posit a contrary view of past budget actions. They’ve created a blog, “Truth Matters, Chico” (www.truthmatterschico.com), and regularly speak at council meetings during the “Business from the Floor” segment.

One of them, Quené Hansen, who formerly worked in the Capital Project Services department, challenged Constantin’s reading of Fund 400 expenses, noting that “2009 was not a good reference

year” because that’s when the city had two very large projects, including a $45 million sewer-plant upgrade and sewer-line expansion as part of the Nitrate Action Plan.

Ultimately, the council voted unanimously to refer the budget issue to the Finance Committee for a more detailed analysis and discussion.

Later, during the Business from the Floor segment, Hansen and Mary Fitch, along with the third member of their group, Alicia Meyer, chided Gruendl for something he’d written in a post on his “Mayor Scott Gruendl” Facebook page. He’d called them “disgruntled employees,” said they’d “hijacked Business from the Floor,” and suggested their activism was encouraging “hateful individuals among us to act, and this includes personal attacks on family members, vandalism of property and hospitalization of city officials.”

We’re just exercising our right to speak in the manner provided by the city, the women insisted.

Interviewed after the meeting, the mayor was unapologetic, though he acknowledged he may have been “a little over the top.”

Obviously frustrated by what he called a “cover your ass” effort on the women’s part, he said they’d waived their right to employee confidentiality and threatened to reveal embarrassing things from their personnel files.

Wednesday morning, in a voicemail message left at the CN&R office, Gruendl said all three of the women, as employees, had played direct roles in creating the budget mess the city is in. In particular, he cited emails, referred to in Nakamura’s memo, indicating that Hansen had wrongly given copies of a draft user-fee study to developers, an act that ultimately cost the city millions of dollars.

Unease over location of Narcotics Anonymous meetings landlords and parents of Chico State Tof hestudents who reside near the intersection Cherry and Sixth streets are a bit up in

arms these days over a new neighbor who’s moved into the building that for years housed Ed’s Printing.

The new neighbor is technically the Unitarian Universalist Fellowship, a local church that hosts Narcotics Anonymous meetings in the building. The meetings began in May. The building, located at 550 Cherry St., is owned by the “Gordon G. Living Grier Trust.”

The concerns voiced by the landlords and parents are directed at the people who come to the 17 weekly NA meetings, stand outside the building and smoke cigarettes, and, according to some, spread needles on the sidewalks. They also allegedly go through trash receptacles and make unsavory remarks to the young women who live nearby or walk past on their way to school.

Robert Combs is the parent of a student currently attending Chico State. He says his daughter and roommate had to move out of a nearby house because of the presence of attendees at the NA meetings. Combs is a Chico State graduate and is president of the school’s Parent Advisory Council.

In an email titled “Has Chico Lost its Sense of Place?” Combs writes that his daughter “was very concerned to see those seeking counseling were loitering outside the facility prior to meetings, smoking, going through the students’ garbage and making lewd comments to our young adults, many of whom are on their own for the first time.”

Combs said in his email that while he is supportive of recovery programs, he is also concerned that the city is allowing such meetings to take place in a student neighborhood.

Greg Redeker, an associate planner for the city, said zoning allows for such activity.

The property is zoned residential/mixed-use, which allows professional offices in the location.

“We’ve heard many complaints, especially from property owners in the area who are understandably concerned about the ability to maintain rental rates, and the vacancy rates for their rental properties,” Redeker said.

“Generally speaking, we have things in the housing element and the public-facilities and services portion of the general plan that talk about making sure we have various services available for all demographics in the community,” Redeker explained.

He said there are code-enforcement investigations going on in connection to the NA meetings on Cherry Street.

“I believe we were going to send a letter to the organization and the property owner encouraging them to be better neighbors,” he said.

There are also NA meetings held at locations on Park Avenue, The Esplanade, Linden Avenue and Fourth Street, but they have not generated complaints, Redeker said.

One landlord, who owns a number of properties near the Cherry Street building, did not want to be identified and subsequently targeted as someone against a program to help drug addicts. But he said he is concerned about the potential problems of losing tenants and property values. There is also a parking impact when the meetings take place, he said.

A young woman walking past the building said she lived on Cherry Street a few blocks to the south. She said it can get “creepy” when she walks past, but that she’s never really felt threatened.

Two young women who do live close to the building said they are not students and that they moved into the neighborhood in January. They, too, asked for anonymity.

“Most of the time the college students around here are the most obnoxious,” one said.

“I did park in front of their building once and a guy told me I had parked in his spot,” she said. “It’s a public parking space and I only parked there because someone had parked in front of my house.”

The other woman said it was a strange combination to have NA meetings held in a student neighborhood.

“Sometimes it gets a bit nerve-wracking to go outside of the house and have a cigarette,” she said. She then nodded to a student residence across the street from the NA building.

“They have parties over there and sometimes the [meeting attendees] go over and join them. It’s kind of strange.”

The Unitarian Universalist Fellowship could not be reached for comment by press time.

PRISON CAP MOVES FORWARD

California lawmakers passed a compromise plan, Senate Bill 105, on Sept. 11 to comply with a federal court order to reduce the state-prison population by 9,600 inmates.

SB 105, developed by Gov. Jerry Brown and Democratic lawmakers, asks for an unspecified extension to comply with the population cap, and will devote $400 million toward prisonerrehabilitation efforts such as mental-health care, according to California Healthline. If federal judges reject the compromise, the state will automatically enforce Brown’s original plan, which would rely heavily on shifting inmates to privately owned facilities both in-state and outof-state, and reopening city-owned detention centers.

In June, federal judges ordered Brown to release about 8 percent of the inmate population to remedy unconstitutionally poor inmate care.

FDA: POISON IN RICE OK

Levels of arsenic in U.S. rice and rice products are too low to harm short-term health, though the effects of long-term consumption remain unclear, a federal report finds.

Separate studies have found concerning levels of inorganic arsenic—the kind produced by industrial burning or via pesticide use—in rice and rice products such as infant formula and cereal bars, according to CBS News. The U.S. Food and Drug Administration recently conducted its own research, analyzing 1,300 samples of rice and related products, finding levels of the chemical too low to pose an immediate health risk, though arsenic is a known human carcinogen.

The agency said further research is necessary to determine whether eating rice over a long period of time increases the risk of cancer or other health complications.

PORN INDUSTRY GOES VIRAL

Reports of four recent HIV infections among actors in California’s porn industry have raised fears of an outbreak.

Four actors have tested positive for HIV since Aug. 21, when a 29-year-old female actor who goes by the screen name Cameron Bay (pictured) publicly announced she was infected, according to the UK’s Guardian newspaper.

Bay’s announcement led to a week-long suspension of filming as other performers were tested; on Sept. 3, shortly after the moratorium was lifted, a male performer with the screen name Rod Daily also announced he was infected.

The moratorium was reinstated on Sept. 6, as a third performer tested positive. On Sept. 9, a fourth performer reportedly told the Los Angeles-based AIDS Healthcare Foundation he had contracted the virus.

The Free Speech Coalition, a porn-industry trade group, said the reports of a fourth infection were false and intended to further the foundation’s agenda of passing a statewide law that would require porn actors to use condoms while performing, according to ABC News.

Health professionals discuss the pros and cons of staying athletic later in life

Orthopedists and physical therapists have taken note. So has Enloe Medical Center, which is hosting an informational event on Sept. 26 called “Your Life …

Back in Action: Solutions for Injuries Related to an Active Life.” Scheduled presenters include Dr. Nicholas Komas, a local orthopedic surgeon, and Jeff Zelenski, a physical therapist who manages Enloe’s Outpatient Rehabilitation Services department. Both spoke with the CN&R over the phone about the prevention and treatment of sports-related ailments.

“What I see probably most in the area of preventable injuries is patients between their 40s and 60s who are getting more active and are probably going at it a little too quickly,” said Komas, who used the term “boomeritis” to refer to the phenomenon of later-in-life athletics.

“They get involved in programs that [take them] from being completely sedentary to trying to do high-level fitness without ramping up slowly, and then they get injuries—usually the shoulder or knee.

“As a sports physician who [also] takes care of high-school kids and college kids, really the majority of sports injuries I see

are in the older athletes,” he continued.

“We’re taking care of the mature athlete who is doing these things with a body that’s not designed to do them. Our natural history is not to be athletes at 50 years old; that’s not our evolution. But some people are doing it.”

Komas recommends a “reasonable” approach of gradually building up to improved conditioning, flexibility and core strength.

Zelenski agrees. He said there isn’t one set of exercises that works for everyone, but in general it’s best to maintain an optimum weight (to ease stress on the joints), and to stretch before demanding activities—sensible advice for people of all ages.

He also stressed the importance of consulting professionals.

“A lot of times, I think, [athletes] underutilize the medical field and/or physical therapy,” he said. “As [people] get older and they do sports for a while, they think it’s OK to hurt—‘I’m a weekend warrior—my back hurts, my shoulder

hurts. That’s normal.’

“That is not the case. If they get evaluated, they can be treated or set up on a prescriptive exercise program to really help prevent some of those wear-and-tear injuries down the road.”

Currently, physical therapy is almost exclusively for the rehabilitation of injuries diagnosed by a physician. Indeed, Zelenski doesn’t get much of an opportunity to work with people before they’re hurt. That may change, he said, noting that his profession is moving toward a more preventative model.

For now, he encourages active adults to work with doctors and trainers.

feel better—less pain, more strength—and feels inclined to push him- or herself. That feeling can be deceptive.

“A lot of the return to function from those injuries is really based on biology,” Komas said. “When you put a graft in there, it has to heal, and we know from studies that there’s a period of time when that graft is more vulnerable to rupture.

“A lot of it is letting nature take its course.”

Physical therapists like Zelenski take cues from doctors’ orders, and some procedures call for rehabilitation to begin within hours or days of surgery. That’s right, hours—for total joint replacements, physical therapists come to the hospital and may get patients on their feet the day of their operation.

Zelenski, like Komas, treats patients young and old. He’s found a lot of his adult patients get injured by pushing themselves too hard, such as entering too many competitive events.

Still, he doesn’t want to dissuade people from leading more active lives. Rather, he promotes preventative steps that can help reduce the odds of injury.

“Motion is lotion,” Zelenski said. Or, to put it another way: Stay young at heart by getting the old heart pumping. Ω

Aviation emissions from flights to and from Australia and New Zealand during the month of October result in levels of a significant globalwarming pollutant that are higher than those at any other time or place, a new study finds.

A team of researchers from the aeronautics department at MIT studied 83,000 worldwide flight routes, finding that the Solomon Islands (northeast of Australia) is the planet’s most sensitive area when it comes to the production of tropospheric ozone as a result of aircraft emissions, according to an article at ClimateCentral.org.

In related news, the International Civil Aviation Organization will meet in Montreal on Sept. 24 to discuss a proposal “for enforceable greenhouse-gas emissions-reduction measures,” as the article pointed out.

GERMAN GREEN TRANSITION PRICEY

Germany’s program of Energiewende—“energy transition”—which involves transitioning to more sustainable development, including using renewable sources of energy, is showing signs of stress as German consumers face rising energy prices.

Germans—who currently pay the highest electricity prices in Europe—are now looking at an upcoming rise in the renewable-energy surcharge tacked on to their bills, set to increase from today’s 5.3 cents per kilowatt hour to as much as 6.5 cents per kilowatt hour, according to Spiegel Online. German Chancellor Angela Merkel began phasing out nuclear power shortly after the March 2011 Fukushima nuclear-plant disaster.

While his predecessor, Jürgen Tritten, had predicted that changing over to renewable sources of energy, such as wind and solar, “wasn’t going to cost more than one scoop of ice cream,” current Environment Minister Peter Altmaier was quoted as saying that Germans are now paying enough to “eat everything on the ice cream menu.”

ELECTRIC CARS IN QUESTION

Doubts about the overall ecological benefit of electric cars have been raised in a recent article published online by the Institute of Electrical and Electronics Engineers.

Citing a 2010 study by the National Academies, the article—written by Ozzie Zehner, currently a visiting professor at UC Berkeley’s Science, Technology & Society Center—noted that when one considers “the effects of vehicle construction, fuel extraction, refining, emissions, and other factors,” the lifetime health and environmental damages of electric cars “are actually greater than those of gasoline-powered cars.” Some of those damages result from the intensive mining of rare-earth metals for use in electric-car motor-magnets, as well as the extraction and refining of copper, lithium and nickel for electric-car batteries.

istrative manager, has spent the better part of three years as the City Hall point person for the Chico Energy Pioneers, stemming from a $400,000 innovative pilot program from PG&E, aiming to make homes more energy-efficient.

The city collaborated with Chico State and Butte College to train inspectors and contractors on green techniques, then sent the sustainability-savvy professionals out into the field to inspect and repair homes.

Herman and her colleagues evaluated the proceedings and put their findings in a report they’re sharing with PG&E and the City Council.

“It’s been a long process and a good learning experience for us,” Herman said in a phone interview Sept. 4, during a break in finalizing the report. “One of the things we all came to find is it’s a bigger project than our team was, but all in all I think we’re really pleased with the outcome and how it went.”

The program led to the training of 30 contractors and subcontractors in the whole-building-analysis curriculum of New York-based Building Performance Institute, which sets standards nationally for energy-efficient home-retrofit work.

Ninety-one local homeowners received free inspections and an average of $1,350 to conduct repairs—though Herman and

Jon Stallman of Energy X-Change, another point person on the Energy Pioneers team, said more than a third of the homeowners made additional upgrades, either out of their own pockets or with additional funds from PG&E’s Energy Upgrade California program.

All told, 88 percent reported they received the kind of information they expected from the program.

“We had roughly 85 people extremely happy with what they learned, the education they got from this, and the changes in their houses are amazing to them—they’re blown away,” Stallman said. “The amount of comfort change, the amount of energy reduction they’ve received from this, is incredible.”

Each of the 91 homes in the program

had individual conditions, but Energy Pioneers inspectors found a handful of prevalent issues: • Air coming into the house through the building shell; • Lack of, or poor, insulation in the attic; • Ducts leaking at seams or joints, and sheet metal leaking air outside the home; • Oversized cooling systems with low air flow in the home; • Combustion emitting excessive carbon monoxide within the home (such as that indicated by a rusted heat exchanger on a furnace).

Most significantly, the inspections revealed the interconnectivity of various components. Some homeowners had previously made specific modifications to their homes, only to have those changes

not help the situation or even make the problem worse.

“Just putting in insulation isn’t going to help achieve energy savings if you have leaking ducts or air escaping through the attic,” Herman said. “And the construction sequence of how you do things makes a big difference.”

That’s why the holistic approach of a whole-house inspection proved so crucial.

“What we came to find out,” Stallman said, “is that we’re not just aiming at energy reduction. The energy use is often a result of comfort issues within the house.

We can throw technology at it, we can resolve different problems, but unless you address the house as a whole system, the comfort issue is still going to exist.”

In other words, a homeowner can install a higher-efficiency air conditioner, but if the cool air leaks out of ductwork into a poorly insulated attic, the family may still need to crank the cooler up to the “high” setting.

Interestingly, the Energy Pioneers team determined that modifying the home, rather than modifying behavior, will produce the quickest, deepest energy savings.

“Unbiased information is truly important to keep the confidence of the homeowners,” Stallman said.

“Data-based [auditing] also means they’re getting information directly about their home from instruments saying, ‘Your leakage is this much, relative to the calculation of where it’s supposed to be, which is this.’

It’s really hard to refute numbers.”

With the pilot program com-

plete, what’s next? Two possibilities: further education of construction-industry professionals, and potential changes to city regulations.

On the first front, Herman hopes to work with the Valley Contractors Exchange and/or Butte College to provide training in whole-house assessments and green-building techniques. “We definitely want to take the lessons we’ve learned and share them,” she said.

THE The second front involves Chico’s Residential Energy Conservation Ordinance, or RECO. Adopted in 1991, RECO established energy- and water-savings measures to be implemented upon the resale of residences built before 1983.

Real-world experiences during the Energy Pioneers process suggest possible revisions to specific aspects of the code.

“We were really adamant [in the program] about doing things in the proper construction sequence,” Stallman said, “like not putting insulation in before the ductwork was sealed. What we really learned from that is [that] the RECO ordinance is not correct; the sequence of priorities that you’re currently required to do when you sell your house is not in the right order.”

Rather than push for immediate changes, though, Herman would like to collect some numbers about energy savings in the 91 Energy Pioneers homes. She also plans to go over the program findings with Chico Building Official Nelson George.

“We just want to re-evaluate the RECO from the experiences we got from the project, but to do that we need more data,” she said.

What’s definitely come out of the Energy Pioneers program is a framework for whole-house assessments that are readily available to local homeowners, who no longer need to look to bigger cities such as Sacramento or San Francisco for that sort of expertise.

“It’s been a long process,” Herman said, “but in the end, I think people seem to be happy with what the program has done.” Ω

n a recent summer morning, Dave Garcia, the political chair of the Sierra Club’s Northern California Yahi chapter, occasionally interrupted a tour of gas wells in the Sutter Buttes to point out signs of wildlife: a scampering cottontail rabbit, a vigilant red-tailed hawk or whizzing western kingbirds.

Garcia had brought a pair of journalists here to witness fracking in the Northern Sacramento Valley, something that most Northern Californians probably have no idea is underway in this area.

The well sites appear almost deserted—there are no gas flares, no trucks moving huge tanks of water, no towering pump jacks. In fact, rarely were people even seen at these electronically monitored stations.

But according to an industry website, 15 of the dozens of Sutter County gas wells were fracked a couple of years ago by Venoco, a Denver-based oil-and-gas company. These are small frack jobs, but Garcia is nonetheless concerned about possible contamination of the Tuscan Aquifer that slopes from the Sierras to the west side of the Buttes.

Last Wednesday (Sept. 11), lawmakers at the state Capitol passed Senate Bill 4, which provides California with its first regulatory framework designed for fracking. But the bill itself has become the object of controversy and probably won’t resolve the debate any time soon.

Environmentalists like Garcia want to halt fracking—not regulate it—and argue that SB 4 may do more to harm than help their effort.

Anti-fracking activists say they don’t trust the oil-and-gas industry, which uses its vast resources and influence to fight regulation. They also don’t trust the state regulators who they say have failed to apply laws that are already in place, such as the California Environmental Quality Act (CEQA). The oil industry faces a citizen backlash in a number of communities across the state.

In Butte County, a group belonging to the Chico Citizen Action Network is pressing for a local ordinance to halt fracking.

Hydraulic fracturing, or “fracking”—

a procedure used to capture hard-to-reach pools of oil and gas—has fueled a debate nationwide.

Projects that involve a combination of fracking and new horizontal-drilling techniques have been linked to water and air pollution and increased seismic activity—and in West Texas, water shortages.

In California, most of the debate has focused on development of the Monterey Shale in the southern San Joaquin Valley. There, oil companies want to exploit the nation’s largest shale-oil reserve.

They’ve already begun—using fracking, horizontal drilling and a technique called “acidizing.”

California is on the brink of a great experiment in fracking regulation. SB 4, sponsored by Sen. Fran Pavley (D-Agoura Hills), has intensified debate on a fundamental issue—whether fracking can be successfully regulated and safely conducted. The bill, which Gov. Jerry Brown is expected to sign readily, will establish some of the nation’s most stringent regulations for fracking and acidizing.

In the bill, lawmakers attempt to carve out a middle ground between those who see fracking as a costly environmental ransacking; those who think it can be an engine for economic growth, with risks that can be reasonably managed; and the oil industry itself.

But many Californians in the first group see the compromise as suspect. Unlike other environmental causes—say, the northern spotted owl— this will have immediate consequences. A Central Valley oil boom will be transformative, affecting air quality and water supplies and increasing tax revenue and job growth.

In the Northern Sacramento Valley, gas-well fracking has been underway, quietly and without oversight, for years, underscoring the freedom the industry has had to innovate at will. California was late in regulating fracking; on her website, Pavley points out that 14 other oil-producing states already regulate the practice.

Local environmentalists like Garcia say they’re facing a tougher battle in the wake of SB 4’s passage, but they still plan to ask the Butte County Board of Supervisors to pass an ordinance that halts the practice. If that fails, they may take it to the voters directly next year.

Garcia’s view of SB 4 reflects that of most environmental organizations in the state. “It wasn’t a good law to begin with,” he said, “and then they amended it. It’s going to make this fight a lot worse.”

The Sierra Club opposed the bill even before it was amended Sept. 6, arguing that it didn’t require the full industry disclosure communities need to prevent water and air contamination. After last-minute revisions, the California League of

Conservation Voters and several more groups withdrew their support, saying the bill was no longer acceptable.

Hitting the information wall Fracking involves drilling thousands of feet into the earth, then blasting a sand-waterchemical mix into an encased well at high pressure to fracture rock and free trapped oil and gas reserves. It requires large volumes of water—a single operation might need 5 million gallons if the well is drilled horizontally.

By drilling horizontally, a well can be extended for thousands of feet. In some of these huge projects, chemicals have leaked or gas has seeped into aquifers in incidents that were linked to faulty well construction.

In California, fracking at the Inglewood Oil Field—the nation’s largest urban oil field in Los Angeles—produced “noxious fumes” in a 2006 blowout and has wrecked nearby houses, said Brenna Norton, Southern California organizer for Food & Water Watch.

In the fracking world, the word itself can mean different things.

Sometimes it means “acid fracking,” or acidizing a well. That involves injecting huge volumes of highly corrosive hydrofluoric acid, and other acids, into a well to dissolve the rock.

In the Northern Sacramento Valley, fracking means fracturing rock in vertical or slanted gas wells, said Chico State geology professor Todd Greene. Fracking here “is not anywhere close to the type of fracking you see in Pennsylvania, Wyoming and New York,” he explained.

Greene, who worked for the oil industry before launching a career in academia, notes that this part of the valley sits on sandstone— not shale rock. This area has gas, but little to no oil. Horizontal drilling that makes largescale projects feasible isn’t usually effective in sandstone formations, Greene said.

But fracking in the North Valley still raises troubling questions that reflect secrecy and questionable state monitoring. Greene agrees, for example, that it would be useful to know what’s being done with the contaminated wastewater. On well pads in the Sutter Buttes, green drums hold up to 3,500 gallons.

Many of the wells are accessible from Pass Road, which winds along the base of what is known as the world’s smallest mountain range.

The gas wells are behind gates that bear notrespassing and danger signs. If you approach the wells, you might catch the wafting smell of gas or chemicals, or hear a humming or pumping sound. Homes on domestic wells are occasionally sprinkled around the bluffs.

If you try to find out more—the direction of the drilling, where the wastewater goes— you run into a wall of recalcitrance. State regulators balked at the word “interview,” and an oil conglomerate provided what amounted to a “we-don’t-talk-to-the-media” statement.

A trail of fracked wells The Department of Conservation’s Division of Oil, Gas, & Geothermal Resources (DOGGR) regulates California well-drilling, but hasn’t yet begun requiring an additional permit for fracking. DOGGR’s administration has been widely criticized in the past for failing to even monitor fracking.

Officials declined to be interviewed for this story beyond an email exchange with a public-affairs staff person. Yet, in response to critics, DOGGR began compiling records on well-fracking last year, said Kyle Ferrar, state coordinator for the nonprofit FracTracker Alliance.

FracTracker has identified 237 fracked wells that haven’t been reported to DOGGR as fracked. One of those missing from the DOGGR database is a Sutter Buttes well.

Sometime after Venoco fracked wells in the Sutter Buttes in 2011, it sold its Northern

California holdings. DOGGR’s website indicates the wells are now under management of Vintage Production California.

An effort to reach someone in Vintage’s Bakersfield office was fruitless. Its parent company, Occidental Petroleum, has a media/communications number on its website. A recording instructs media representatives not to leave messages. Email communication only, the company says.

External Relations Manager Amy Fonzo responded to an inquiry, saying that due to “competitive and proprietary reasons,” Vintage doesn’t discuss its operations.

Property owners who lease land don’t always fare well with the oil giants, either. A Glenn County landowner contacted the Butte Environmental Council (BEC) earlier this year after an exchange with a company that drills for gas on her property. She was worried about fracking and had become reluctant to sign over mineral rights.

The company told her it wasn’t fracking, but if she didn’t renew the contract, it could access gas on her land from a neighboring parcel, according to BEC. Garcia first learned about horizontal fracking from the HBO film Gasland, which documented cases of groundwater contamination, and in the most extreme instance, tap water that caught fire. He then turned for information on this area to the website FracFocus, where oil and gas companies have been asked to report fracking.

FracFocus provides a rough and incomplete sketch of fracking in the state. Perhaps most alarming to many community activists is the fact that drilling companies don’t provide complete listings of the chemical concoctions they’re using, noting in some cases that an additive is a “trade secret.”

“Oil companies are way ahead of us in terms of what’s going on,” Garcia said.

In this regulatory vacuum, and in the months leading up to the Sept. 11 passage of SB 4, there was an urgency in groups hoping to influence the direction of the debate.

Where are the jobs?

On a July evening in a Marysville meeting hall, Bishop Ron Allen stood at the podium, discussing in his booming preacher’s voice unemployment, oil and untapped riches.

Allen, the founder of Sacramento’s International Faith Based Coalition, lent his oratory skill to promote a fracking boom at an “educational summit.” Allen told an audience that included Tea Party supporters and landowners that expanded oil and gas production would provide jobs and generate income in the “underserved community.”

“California has been standing on the sidelines despite having 60 percent of America’s shale [oil] reserves right beneath our feet,” Allen declared, and then added for effect, “Somebody help us, please.”

The summit was sponsored by Roseville’s nonprofit Coalition of Energy Users. It was one of several events this past summer, held by various groups, in which fracking was presented as a path out of poverty and economic stagnation.

Outside the summit meeting hall in Marysville, anti-fracking protesters held signs denouncing Big Oil and passed out fliers.

Some of the protesters had requested seats at the summit weeks in advance, but said that when they arrived, they found their names on a “Do not admit” list and were greeted by members of the Sons of Liberty motorcycle club.

Job creation is often trumpeted as a benefit of expanded production, but it’s hard to know whether fracking creates work on the valley’s northern gas fields.

gas—the gas that comes from fields without any oil in the mix. In July, the county’s unemployment was at 13.6 percent, while the Bureau of Labor Statistics reported the statewide average at 8.7 percent.

In any case, environmentalists argue that the hidden costs of fracking aren’t being considered.

“We’re going after the dirtiest fossil fuels that are left,” said Kassie Siegel, Climate Law Institute director for the Center for Biological Diversity, which has sued DOGGR on issues related to fracking and CEQA enforcement.

“We are going to have higher and higher health and environmental costs,” Siegel added. “People will get sick and the climate crisis will get worse.”

Regulating fracking Activists have been fighting for a moratorium that would stall fracking pending the outcome of scientific study. Not much is really known about how California’s fault lines might interact with fracking-produced fluids. In Ohio and other states, seismic activity has been linked to the practice of using injection wells for wastewater.

The oil industry fought off several bills that would have imposed a statewide moratorium on fracking in the 2013 legislative session. It also opposed Pavley’s compromise SB 4.

On its website, the Western States Petroleum Association, an industry lobbying group, says a law based on SB 4 should, at the least, end talk of fracking moratoriums.

“There is no longer a place in California for the emotion-fueled demands for a moratorium of hydraulic fracturing,” wrote Catherine Reheis-Boyd, president of the WSPA.

SB 4 directs DOGGR to establish regulations for fracking and acidizing. Oil and gas companies will be required to obtain a permit and must provide more disclosure of chemical additives. They will have to advise neighbors of plans to frack. The bill requires an independent scientific study.

Environmental organizations say they’re worried that DOGGR will rubber-stamp permit applications instead of requiring environmental review. They’re worried that the bill prevents imposition of a statewide moratorium at some future point, though Pavley has disputed this.

Organizations that support a ban or moratorium warn against reliance on regulation. They often note industry exemptions from the nation’s Safe Drinking Water Act through what’s popularly known as the “Halliburton Loophole.”

Food & Water Watch lists eight California communities where resolutions or stronger actions have been taken, including Berkeley, Culver City and Marin County.

A few days after passage of Pavley’s bill, several anti-fracking activists set up a table at the Saturday Chico farmers’ market, collecting signatures on a ban petition.

Activist Willow Dejesus said she’s worried about all the usual problems associated with fracking, and in particular threat to water supplies and aquifer contamination.

“Water doesn’t get any closer to the heart of our livelihood,” said Dejesus. “I don’t think regulation is an answer. There are tons of regulations in place, but there are always exemptions, always people who don’t follow regulations, always accidents.”

Though FracFocus doesn’t show fracked wells in Butte County, Garcia says he’s identified 10 active gas wells in the county. Once naturalgas prices start climbing back up, the wells could be subject to fracking, he said.

“These companies are going to be going to the old gas wells they have in Butte County and reworking them,” Garcia said. “That’s why it’s critical to get a moratorium.”

It would be a few years after that first

show before we’d all know her by her stage name, but looking back at that first song choice—tackling one of Mitchell’s emotionally honest tunes about the highs and lows of being in a relationship—we can see that Pope was already heading down the path of the barroom troubadour, singing into beers about love and love gone wrong. After spending a few years at open mics and honing her performance chops in the frenetic indie-punk crew Stars Upon Thars, Pope moved on 24 CN&R September 19, 2013

to what’s been a decade-long solo career, the first half filled with constant touring and the release of five albums (four solo, and one countrified slab with her old band The Puke Boots). The second half has been filled with many local shows, collaborations with friends, and a lot of songwriting leading up to the 25 songs recorded for, and 12 included on, the long-awaited

new album.

“I was playing the whole time,” Pope said of the downtime betweem albums. “It took me a long time to find people [to record with].”

Most of the people she found—the four members from the popular local quartet Bogg—sat down with Pope in an empty room in the back of the Origami warehouse as Bogg took a break from a recording session of its own to talk about the new album.

“We never thought that we’d be Aubrey Debauchery’s band,” said keyboardist Josh Hegg before being interrupted by bassist Gavin Fitzgerald’s gleeful, “We’re playing with Aubrey Debauchery!”

In between jokes and laughs, the band talked about how doing their weekly themed jazz shows at Café Coda—where they’ve interpreted everything from the band Nirvana to the music from Star Wars—has honed their arranging skills and been very helpful for working on arrangements with other musicians, including Pope and her songs.

“Arranging only takes you so far. They have to be good songs,” said Hegg about working on Pope’s material. Fitzgerald added an analogy about how some songwriters start with plain, wimpy little Christmas trees that you have to decorate from scratch, “but Aubrey had this huge Douglas fir, and had this beautiful baby Jesus on top.”

“I still want to continue playing with these dudes,” added Pope, between laughs. Joking aside, it’s easy to hear why. On the handful of tracks available to preview, it’s obvious that the players—which also include Bogg’s violinist Matthew Weiner and guitarist Michael Bone, as well as a trio of horn players on some tracks—are in tune with the emotional intent of the songs, especially on the slowtempoed bar-rocker “Out of My Mind,” which opens the album with a bluesy burst and gospel organ that complements Pope’s throaty vocals perfectly.

And after a quick reading of the titles on the new album—“Becoming Forgotten,” “Moonshine,” “Love Is,” “Stale Bar Rooms” and “Lover’s Last Kiss”—it’s apparent that Pope is still, as it says on her website, making “music for the heartbroken and the heartbreakers.”

“It’s still about horrible relationships,” Pope said. “But I think that [now I’m] being more reflective of the problems—these things happen and this is why.” Ω

Alldrin had been back at the marLaPadoket, after spending a good part of Breglia the summer fishing with his 15christinel@ newsreview.com year-old son, Luke, in Cook Inlet, off Alaska’s Kenai Peninsula, and market-goers were eager to purchase some of the delicious, wild-caught sockeye bounty they had brought back.

At $10.99 per pound for flash-frozen and $20 a pound for smoked, Alldrin’s sockeye—or red— salmon is a deal. Especially when one considers the care (and adventure!) that went into procuring and processing it.

“Our fish is caught with the intent of being processed within 24 hours of being caught,” the 50-year-old Alldrin said in a recent interview. “That includes butchering, vacuum-bagging and flashfreezing.” As soon as the fish come out of the net, he said, they are placed into hanging “brailer bags,” into which alternating layers of fish and ice are placed to keep the fish fresh. The fish are then processed at a plant in the borough of Kenai, where Alldrin keeps a couple of travel trailers in which to stay when he is not on his boat.

This past summer marked the ninth year that Alldrin has headed north to Alaska to fish from midJune to mid-August. In previous years, he (and his sons: all three have accompanied him in the past) worked the inlet’s shoreline. But 2013 marks the first time that Alldrin ventured out into the vast inlet to fish—in his new 40-foot boat, Night Hawk.

This year’s fishing adventure on the inlet was possible only after purchasing a fairly pricey “limited-entry permit” (which can range from $15,000 to $200,000, depending on the recent value of fish taken from the area), a feature of Alaska’s restrictive, sustainability-conscious system of salmon management. Such permits require the bearer to check in with the Alaska Department of Fish and Game before heading out to fish, as “Fish and Game counts the fish every day with a sonar [device],” Alldrin said. If numbers are too low on any given day, no fishing is allowed.

This was also the year that the fishing adventures of Alldrin; his two deckhands, Luke and Luke’s buddy Andrew Puser; and a longtime Alaska fisherman named Capt. Dino Sutherland were filmed for the upcoming second season of Alaska Fish Wars, which will appear on the cable/satellite TV channel Nat Geo Wild in February. Alldrin had hooked up with Capt. Sutherland—who, as it turned out, is a friend of the executive producer of Alaska Fish Wars—in an effort “to hire someone to show me the ropes” out in Cook Inlet.

“He had 35 years [experience fishing in the open water of the inlet] to my nothing,” offered Alldrin.

“We were out there in the middle of Cook Inlet, with 8- to 10-foot seas, and 900 feet of [20-foot-long gill] net trailing behind the boat. It was the first time I had been out in that water and fishing with that type of gear.”

He pointed out that despite the word “wars” in the title of the show, there was no ramming of boats or any other such aggression. “The ‘war’ part of it was simply the competition between which of the four show boats caught the most fish that day,” said Alldrin, who clearly loves the job of catching fish.

“What I love about it is it’s maybe one of the last professions that’s truly man against nature, you against the ocean,” said Alldrin, who works during the school year as a counselor at Centennial High School in Corning.

“The other thing is it’s addictive—probably the only other thing that was this addictive was gold mining [which he did in his college days]. … You know, ‘If I just lay my net out one more time, I’m gonna get that huge haul!’” Ω

That’s going to leave a mark Blue Room opens the season with a modern look at the pain of living

Pain is among the most significant aspects of the human condition, and the scars on by our skin and souls read like a Ken Smith roadmap of our journey through life. kens@ This truism is the basis of the Blue newsreview.com Room Theatre’s latest production, Gruesome Playground Injuries, by Rajiv Joseph.

REVIEW: Gruesome Playground Injuries Gruesome Playground tracks the lives of two friends and Injuries shows would-be lovers over the course of Thursday- 30 years, beginning with their first Saturday, playground meeting at age 8, in 7:30 p.m., through Sept. 28, which happy-go-lucky, accidentat the Blue Room prone Doug implores introspective Theatre. Tickets: $12-$15 Doug and Kayleen’s 30-year saga (Thursday, $10) is told through eight separate, nonlinear snapshots, each centered on the Blue Room Theatre pair’s varied periods of pain. First St. Doug’s suffering manifests in a series 895-3749 of sometimes bizarre and increasingly www.blueroom severe physical injuries, Kayleen’s theatre.com wounds are mostly emotional—and more deeply damaging than Doug’s bodily harm—and stem from parental neglect, sexual assault and other issues which contribute to her own self-destructive behavior. At each meeting, life’s circumstances and personal hangups keep them from connecting on the next level.

While it all sounds—and is, to some degree— rather sad, the play is not overwrought with sentimentality nor overwhelmingly maudlin. Quite the opposite: It’s endearing and often laugh-out-loud funny.

This is largely a credit to Joseph’s writing and how it’s handled by the cast of two—Brett Edwards and Delisa Freistadt.

Both Edwards’ and Freistadt’s portrayals make the characters completely relatable. We all know one or several Kayleens and Dougs, both as individuals and as pairs. Edwards’ Doug is everyone’s goofy friend or brother whose extroversion and apparent confidence mask a deeper sensitivity and longing, while Freistadt’s Kayleen is the sweet girl whose circumstances and lack of self-esteem render her blind to her own worth.

The play’s set is simple, with subtle, thoughtful inclusions, like a set of tire swings that—though never actually used—establish the playground setting and strengthen the impact of other scenes alluded to but never shown. Having the actors change at the back of the stage, in full view of the audience, helped convey how the characters changed in the years between scenes. Before walking back into the scene, Freistadt and Edwards would meet center-stage to correct each other’s wardrobes and share a moment, a rare glimpse into their craft that added to their onstage chemistry.

One of biggest strengths of director Martin Chavira and company’s production is the contemporary feeling of the play. Joseph is a contemporary writer (he moonlights in Nurse Jackie’s bullpen and has penned other successful works for stage and screen), and the actors are somewhere between the ages of 8 and 38 that they depict during the performance. Kudos to whomever chose the canned music played between scenes, a collection of excellent indie-rock songs that enhanced the ambience.

The music, acting, source material and easily palatable 90-minute running time combined to make the whole experience not dissimilar to watching a contemporary indie film. This makes the play a great entry point for people plagued with the standard misperceptions about theater—that it is too weird, too wordy, too old-fashioned or too cerebral. Anyone who’s enjoyed a film like, say, Garden State, should have no problem enjoying Gruesome Playground Injuries. In turn, it wouldn’t be at all surprising to see Ω a film version of the play in the near future.

That’s the premise of The Family, a “Mafia farce” in which a French director (Luc Besson) and two American stars by Juan-Carlos (Robert De Niro and Michelle Selznick Pfeiffer) try to have some fun juggling (and occasionally inverting) a scrappy assortment of stereotypes and clichés.

De Niro plays one Giovanni Manzoni, a New York mobster who has testified against fellow The Family Mafia and is now hiding out in Starring Robert France with his wife (Pfeiffer) and De Niro, Michelle their teenage children, Belle Pfeiffer and Tommy Lee (Dianna Agron) and Warren (John Jones. Directed D’Leo). The story, adapted by Besson and Michael Caleo from a comic novel by Tonino Benacquista, trades heavily in the comedy of Poor apparent contradictions. Giovanni is pretending to be an amiable American paterfamilias named Fair “Fred Blake,” and his wife and kids all have the air of wellscrubbed middle-class strivers who feel perfectly entitled to any Good and all name-brand creature comforts that have their interest. But all four, it seems, just can’t help Very Good but behave like Mafia thugs in certain situations.

The latter contradiction is central to The Family’s story and to its Excellent

muddled brand of comedy. Giovanni administers harsh beatings to merchants, public officials and a plumber who fail to deliver the service he expects.

Maggie (Pfeiffer) burns down grocery stores she finds unsatisfactory. Warren and Belle deal out violent retribution and revenge on schoolyard bullies and wanna-be sexual predators.

Besson (La Femme Nikita, The Fifth Element, The Professional) has shown no particular gift for comedy, and since he is very proficient with violent action and fast-track narrative, that proves especially problematic in this case. The Family is persistently amusing, but never really laugh-out-loud funny.

Even the absurdities of violence in this tale are pictured with an authority and an immediacy that leave the comic elements fizzling somewhere on the margins of the action.

One of the film’s better scenes has the De Niro character attending a meeting of French cinephiles for a screening and discussion of Martin Scorsese’s Goodfellas. It might be an important and revealing moment for the character, but it also brings some invidious comparisons into sharper focus. Giovanni’s story might well be taken as comic riffing on themes and characters from Goodfellas, but Besson’s film shows no real grasp of the dark humor residing in Scorsese’s perspectives on characters who haven’t quite come to terms with the violent contradictions and self-deceptions of their very bold lives.

Besson hedges his bets with the story’s violence.

The violence of the mobsters pursuing Giovanni is explicit and unfunny, and the violence of Belle and Warren is explicit and funny and plainly fanciful.

Giovanni’s fantasies of violence are explicit and played for laughs, but the details of the extended beatings he administers are mostly omitted.

De Niro has the most detailed role in the bunch, but neither he nor Pfeiffer gets much chance to do anything more than replay some old, familiar moves. The film’s best acting comes from Tommy Lee Jones in the thankless role of Giovanni’s chief FBI minder. Ω

This documentary on the life of the reclusive late author of Catcher in the Rye—featuring more than 150 interviews, archival footage and reenactments—has been in the making for eight years. Paradise Cinema 7. Rated PG-13.

Blue Jasmine

The new Woody Allen picture is a smartly written, briskly engaging ensemble piece with pungent roles for a half-dozen well-chosen supporting players and a complex one for its star, Cate Blanchett, who is superb. Blanchett plays the eponymous Jasmine, an East Coast upper-cruster who has fallen on calamitously hard times. At the outset of the story, she is just arriving in San Francisco, nearly destitute and hoping to find tenuous sanctuary with her semi-alienated sister Ginger (a delightfully rowdy Sally Hawkins), a mother of two who scrapes out a living as a grocery checker. Initially, Jasmine and Ginger appear as foils in a low-key comedy of contemporary manners, with both in various states of crisis. The contrasting tensions and mishaps in their respective stories soon become part of a larger story in which the shifting trajectories of their various relationships, familial and romantic alike, begin to mirror each other even as their differences become more aggravated. The Butler

Lee Daniels (Precious) directs this story based on the life of Eugene Allen, a White House butler who witnessed 34 years of U.S. history from his vantage point at 1600 Pennsylvania Ave. Starring Forest Whitaker, Oprah Winfrey and John Cusack. Cinemark 14 and Paradise Cinema 7. Rated PG-13.

Elysium

Writer/director Neill Blomkamp’s follow-up to District 9 takes place in the year 2154, when all

of Earth is a Third-World slum and one of its residents (Matt Damon) is trying to escape to Elysium—a utopian society on a nearby space station where the wealthy elite live—in order to save himself and the planet. Cinemark 14.

Cosmic Psychos Goner Records The punk-rock institution that is Cosmic Psychos tends to take a back seat to their Australian brethren—Radio Birdman, The Birthday Party and The Saints—but ask any band that came out of Seattle in the early 1990s, and they’ll swear by these blokes from Melbourne. Part of Cosmic Psychos’ charm comes from the fact they began playing punk rock in high school out of sheer boredom, and not much has changed three decades later. The band’s full story—the countries toured, the bands influenced, the beers demolished—is captured in the new rock doc Cosmic Psychos: Blokes You Can Trust (which includes testimonials from the likes of Mudhoney, Buzz Osborne and Eddie Vedder), and with that comes a U.S. tour and a reissue of the Psychos’ first three albums— Cosmic Psychos, Down on the Farm, Go the Hack—on venerable garage label Goner Records. Needless to say, this shit sounds like a rusty bulldozer (the topic of some of their songs) plowing its way from the Paleolithic Age into late-’70s punk. “You drove me up the wall, I ain’t no spider,” shouts bassist Ross Knight with a heavy Aussie accent on Down On the Farm’s anthemic noise-bomb “Custom Credit.” As you can tell, Cosmic Psychos are about as subtle as a boulder to the head. They’ll definitely get yer rawks off.

Moving Mountains Triple Crown It’s been seven years since New York’s Moving Mountains recorded their infectiously ambitious debut record, Pneuma, so it’s no surprise to find the quartet has grown into its own shoes a bit. What is pleasantly surprising, though: Despite abandoning some of the youthful vigor for a more subdued, palatable sound, Moving Mountains haven’t lost the visceral sincerity that has helped make Pneuma and its 2011 follow-up Waves cult classics in the spacey post-hardcore world. It thus seems only fitting that the band chose to self-title its third full-length; in a sense, the album marks the rebirth of the band, which has honed down its sound to a neatly precise brand of forlorn guitar-driven pop rock.

Moving Mountains is not exactly mainstream radio fodder, but there are moments on the album when the band unabashedly channels some of the better moments of ’90s radio rock—frontman Gregory Dunn does a pretty convincing Johnny Rzeznik impression on “Eastern Leaves,” and the strummed acoustic “Chords” is pretty textbook Travis-esque Brit-pop— which is by no means a bad thing. Growing up is hard to do. But Moving Mountains have done it better than most.

Like all good stories, Ken Grossman’s begins at the beginning when he describes how, as a little kid, he wondered how things worked—electrical outlets, toasters, etc.— and so immediately set about investigating and deconstructing them. His hands-on urge finally found an acceptable outlet in junior-high shop classes which, coupled with a kindly neighbor’s lessons in brewing beer, ultimately resulted in one of the craft-brewing industry’s greatest success stories. Reading about the struggles he and co-founder Paul Camusi faced—and eventually surmounted—was an eye-opener. In 1979, they started to acquire equipment that, thanks to numerous Butte College courses that Grossman took (e.g., refrigeration, welding), enabled them to build the brewery and produce their first beer the next year. Recounting the decades between that first 1,000-barrel year and their most recent (nearly 1 million barrels in 2012), Grossman pulls no punches, especially regarding the contentious negotiations that led to the 1998 split with Camusi. The amount of detail Grossman provides is staggering—starting with beer’s basic elements (hops, malted barley, yeast) and on to the lab processes that enable the brewers to analyze, monitor and improve the beers. A fascinating, well-told story that definitely makes one much more aware of the dedication and professionalism the brewery’s employees bring to their tasks.

SWAP IT Hey, Chico, if your band wasn’t chosen for Band Swap—the band-trading promotion that’s bringing the Fort Collins, Colo.-based Lindsey O’Brien Band to play with Chico’s Big Mo and the Full Moon Band at the Sierra Nevada Big Room on Saturday, Sept. 21 (and sending Big Mo and crew to O’Brien’s stomping grounds on Oct. 6)—don’t sweat it.

Arts DEVO checked it out, and it turns out that you don’t have to wait to be voted into a contest to play outside of our city; you can actually do your own show-trading!

I tried a little band-swapping of my own this week. I contacted a handful of Fort Collins clubs and bands (from both cities), as well as a few Chico venues and bands to see what opportunities for intercity exchange there might between the two state-college towns. I sent mini press releases for a handful of bands, and so far I’ve heard back from one Fort Collins venue: Road 34, a popular bar/bike shop (Fort Collins loves bikes!). Road 34 said that our own skifflin’ yokels Michelin Embers, and indie pop-stars Surrogate, would fit nicely on one of their bills.

In Chico, Fort Collins-area groups Smokestack Relics (swampy, footstompin’ two-piece), Otem Rellik (solo experimental rap/electronic), and lively country/alt-rockers Mosey West would be welcome at both Café Coda and 1078 Gallery, and Monstros would definitely book Smokestack Relics and bar-rockers Drag the River. There are, of course, the caveats that it’s expected that bands would be passing through more than once in an effort to build a following, and that hooking up with locals is crucial (in Chico, Bogg, Michelin Embers and Fera all said they’d be down with hooking up Smokestack Relics with Colorado crews), but if you have PHOTO BY JOSH BISHOP Internet access, a little energy, and some vacation time saved, you too can reach out and take the show on the road.

GOOD LUCK, MY FRIEND I overuse the word “righteous.” I realize this now as I sit down to write this little love note to my good friend Alec Binyon, the CN&R’s longtime general/sales manager who, as of last Friday, is no longer working at the paper. Alec is the person I’ve joked with, confided in and leaned on the most at work for the last four years or so, and to say I’m going to miss him is an understatement. He has been “my guy” at work, and regularly checking in with him to whine about clueless people or rave about art, or to laugh along as he passionately (and hilariously) railed against society’s empty devotion to the corporate and digital worlds and advocated for revolutions big and small, has been a huge part of why I have liked working at the paper. His deep, burning passion for print media and all things Chico (not to mention family, friends, mustaches and the Oakland A’s) has been a source of inspiration and motivation for many of us here, and in many ways he’s been the spiritual heart of the CN&R. Is your book selling well?

Yes, my publisher is ecstatic that it’s already in its second printing. I’ve received lots of great feedback and glowing reviews from sources like Publishers Weekly, a former U.S. Deputy Secretary of Interior and a former Shasta County DA. It has lots of exploits of me as a wildlife detective doing things people wouldn’t expect a game warden to do. The first chapter has a very interesting investigation that starts with a game warden finding a dead bald eagle dropped on his doorstep to taunt him. The FBI and San Francisco homicide department get involved and I help prosecute it.

Do you have a favorite story?

Yes, the last chapter where my partner, Warden Dave Szody, and I conduct a three-year undercover investigation into the illegal killing of black bears. The bile in their gall bladders has been used for centuries as a Chinese cure for dozens of ailments. Many bears are cruelly kept immobilized in super-small cages while

their gall bladders are drained and sold for thousands of dollars in Asian countries. We convicted 20 defendants of over 50 felonies and 100 misdemeanors. One person was fined $54,000, which was the largest game-related fine in U.S. history [at the time].

What motivated you to write a book?

My No. 1 reason was to inform the public about the plight of wildlife throughout the world. As a kid I used to go on ride-alongs with my dad, who was a game warden. I loved wild animals and wanted to do something tangible to save them. There are so few wildlife officers, especially in the oceans. If we want to have wildlife for our kids and grandkids, we must take action to protect them.

How severe is the problem of poaching?

It’s extremely bad. Wildlife trafficking is the fifth most lucrative criminal activity in the world, with billions of dollars being made yearly. In Africa, tens of thousands of elephants are killed each year for their ivory.

Tigers and rhinoceros are also being wiped out illegally. The public should be aware and demand that penalties be harsh enough to deter it.

Sobbing I was rolling along nicely, getting out and about, and staying dry-eyed for weeks. I was between “Should I be feeling this good so soon? Am I just an asshole?” and “I feel so good, I must be dealing with my bereavement much better than the average grieving asshole.” You notice that in both cases an asshole was the benchmark.

So I took a chance and went to the single most dangerous place in Chico in terms of likelihood of my getting out without sobbing. I don’t know what it is— how often we went there together, how I still look at all of the produce with Janice in mind, or that I see so many people I know. For a while I wouldn’t go to the Saturday farmers’ market at all—too many questions about Janice and too much sympathy for me, all of it out of love and much of it overwhelming. And I love the farmers’ market, so since I had spent hardly any time being sad recently, I thought I’d try it again.

I was doing nicely and I’d just gotten peaches when a guy says to another guy, “I’m just looking for my wife. She seems to’ve slipped away.” That’s all it took.

My eyes filled up and I couldn’t speak. I’ve found a silent sob that in most public places is too quiet to

attract attention, so—with big shades—I’m cool if I keep moving.

At the market, you can do a lot without saying much, and nobody hears the occasional sob; I got some apples without actually saying anything. I left anyway when an old fear came back, namely that I’d die sad and alone, finally more widower than anything else. His wife died, and then later he died, too, I think.

I also wanted to get where I could properly cry.

Some people can do it anywhere, especially small people. Semi-silent sobbing is all very well at the market, although semi-silent won’t cut it at the coop, another sensitive spot. As I started to tear up and choke up and feel a bit wild-eyed, I was also a bit glad. A good cry is a cleanse, and I guess I’d missed the renewal. I’ve been crying often since that Saturday, and I don’t mind if I’m not better than the average grieving asshole. Crying all day was tiring, then not crying any day was good for a while; now every day feels about right.

One year feels like a big deal, so it is. I can envision parts of the day, a walk and some music, and a friend has given us a fountain, so maybe we’ll dedicate it to Janice, or something equally sappy.
