death of Trayvon Martin, the 17-year-old African-American boy who died at the hands of an overzealous wannabe cop.

Sadly, one of the lessons is that—despite the progress America has seen in the years following the civil-rights movement—racial stereotypes persist even in relatively young demographics. George Zimmerman, who was acquitted on Saturday of all charges related to the teen’s death, was 28 years old when he shot Martin.

Zimmerman had seen the high-schooler—a black kid—walking through his neighborhood in a gated Florida townhouse community and wrongly assumed the teen didn’t belong in the neighborhood and that he was up to no good. So he followed Martin and phoned law enforcement.

Only Zimmerman had a gun and, in spite of a police-dispatcher’s advice to not follow the teen, he did so anyway and, ultimately, killed him.

A neighborhood-watch coordinator, Zimmerman made the mistake of stereotyping Trayvon Martin. Tragically, many in the nation, following the teen’s death, were eager to buy into those stereotypes.

Indeed, his death brought out the worst in some people, including fringe media that besmirched the dead boy’s name. Trayvon Martin was a good kid. A teacher described him as an A and B student “who majored in cheerfulness.” However, many outlets portrayed him as a dangerous thug and a druggie. Somebody dug up photos of him flipping off the camera. He was vilified for having trace amounts of marijuana in his system. Oh, and he wore a hoodie.

If those things are a condemnation of our youth, parents around the nation should have a lot more empathy for Martin’s family. If those things justified Zimmerman’s pursuit, almost any teen boy could have died in Trayvon Martin’s place. But Zimmerman didn’t follow Trayvon Martin just because he wore a hooded sweatshirt. He followed Trayvon Martin because he was black.

Anyone who says otherwise is delusional.

Trayvon Martin—armed only with the package of Skittles he’d purchased—likely feared for his life when he noticed he was being tailed by a man who greatly outweighed him. But we’ll never know exactly how the teenager felt because George Zimmerman silenced him.

Another lesson is that Florida’s “Stand Your Ground” law is fatally flawed and needs repealing.

U.S. Attorney General Eric Holder said as much during a speech this week. The law—passed in Florida in 2005 and placed on the books in more than 30 other states since then—allows citizens to use deadly force to defend themselves from the threat of serious harm or death, even outside of their homes. And, as the Martin case has shown, it extends to those who instigate a conflict, as Zimmerman did when he stalked his teenage victim through a neighborhood.

In Florida alone, cases of “justifiable homicide” have tripled since Stand Your Ground was enacted. Thankfully, there’s no such law in California.

Zimmerman’s attorneys did not expressly use the law as a defense. But police, familiar with the statute, initially refused to arrest him because of it.

There’s something very wrong with that.

The fact that an unarmed teenage boy was gunned down while on an outing to buy candy—while the man who shot him to death is free to live his life—is an outrage.

We can only hope that a Department of Justice investigation warrants the pursuit of civil-rights violations. Zimmerman should not get away with taking the life of an innocent child.

Trayvon Martin may not be here to give his side of what happened the night he was killed. But this certainly isn’t the end of his story. Ω

Laws and jobs I was happy to read that the local disabled community had shown up en masse to a recent public meeting about lawsuit abuse.

Congressman Doug LaMalfa and Sen. Jim Nielsen were there, lamenting how lawmakers have opened up a cottage industry for attorneys interested in exploiting laws, such as the federal Americans with Disabilities Act. And there’s definitely some truth to that. Certain attorneys have specialized in going after ADA violations, but with the goal of a payday, rather than actual compliance. They would send “demand for money” letters to businesses, asking for legal fees and a settlement amount without noting specific violations. Last fall, Gov. Jerry Brown signed a law (Senate Bill 1186) banning “demand for money” letters and also requiring that a list of alleged violations be sent to business owners 30 days in advance of filing a suit.

This reform may finally be curbing abuses, but the damage to the reputation of the ADA is done. That’s why it’s important to remember the intention of the landmark 1990 civil-rights law: to prohibit discrimination against the disabled. Among other things, the ADA requires that most public facilities be compliant with guidelines ensuring the disabled have access.

LaMalfa, speaking to those gathered at the forum, called the law vague. But he was out of his league.

As local civil-rights activist Karen Duncanwood stated articulately in a CN&R story this week, the law is complex, not vague. “The reality is that disabilities are complex, our local communities are complex,” she said. Duncanwood, whose son is disabled and who marched on Washington decades ago in support of the ADA, pointed out that most of the disabled public are interested in compliance, not lawsuits.

Another disabled-rights advocate echoed her. “We just want what we need as far as accessibility—being able to reach things, being able to get into [businesses], and also being treated fairly,” the woman said.

There’s nothing vague about that.

Speaking of Hardee, savvy readers will notice that he has a new title. In addition to continuing his good work leading certain special projects, Hardee’s been promoted to assistant news editor, lending his editing skills to Newslines, in addition to writing for the section.

Hardee came to the CN&R back in the summer of 2010 as an intern. He was a University of Alaska Fairbanks student finishing up a year-long exchange program at Chico State. The next summer, following graduation, he headed back down to Chico and into a job as the CN&R’s calendar editor.

Mallory Russell, a Chico State student finishing up her degree in fine arts, is picking up where Hardee left off on those calendar duties. Russell is plugged in to the local arts and music scenes, so she’s a great fit for the position.

An invented problem Re “Keep an open mind” (Editorial, July 11): I am still trying to figure out why there is a problem (with the Saturday-morning farmers’ market) that needs a solution.

The farmers’ market has been a wonderful and successful fixture in the community for more than 20 years.

After all that time, now a few businesses claim that their business is hurt because the customers of the farmers’ market take up parking spaces that could be used by potential customers of these few businesses.

Where is the evidence that their business is hurt at all by the farmers’ market?

More important, where is the evidence that their customers cannot find parking on Saturday morning? The estimated 3,500 customers of the farmers’ market can find parking just fine. Think of that.

Also, I wonder at the legal theory that says you can shut down a successful adjoining business just because presumably its customers are taking up a lot of public parking spaces that could be used by your customers.

Something is wrong with this picture.

Delta plan a bad one Re “Drop in the bucket?” (Newslines, by Ken Smith, July 11): I would like to share another point salient to the conversation regarding water transfers: The Bay Delta Conservation Plan will convert more than 140,000 acres of productive Delta farmland to “habitat.” Our vineyards, orchards and fields, which have been farmed for more than 150 years, will be condemned via eminent-domain proceedings. The remaining farms will be irrigated with saltier water, as the diversions from the Sacramento River will draw Bay salt water into Delta channels.

A saltier Delta will mean a changed fishery—another industry that will suffer mightily from the tunnel option.

The state has never run the current projects in a manner that protects Delta water quality or our fisheries. We cannot expect any future operation to benefit us, either.

The economic hit from the BDCP plan is nothing more than a government-endorsed transfer of wealth—from the Delta to points south.

Prop. 8, banning gay marriage in California, is unconstitutional. We agree with Justice Kennedy’s opinion that DOMA improperly undermined a state’s decision to extend “the recognition, dignity, and protection” of the marriage contract to same-sex couples.

We are extremely disappointed by the court’s gutting of the 1965 Voting Rights Act (VRA) by ruling that Section 5 is outdated. Section 5 was a very effective tool in eradicating voting discrimination because it required jurisdictions with a history of racial discrimination to have any change in its election laws or practices pre-cleared by the federal government.

Chief Justice Roberts’ decision was based on his opinion that “Our country has changed.” Not really.

Immediately upon announcement of the court’s recent decision, Texas and Mississippi vowed to implement voter-identification laws and other discriminatory procedures. How many state discriminatory laws will be passed before Congress acts to review and reinstate protections?

Injustice served So if someone is following you at night and he gets out of his car and he hassles you and he happens to outweigh you by 100 pounds and you try to “stand your ground” by trying to fight him off to protect yourself—and he shoots and kills you—then he stood his ground and you didn’t.

Nice so-called “justice” that George Zimmerman was able to buy from our legal system, and much of the money coming from donations. Doesn’t that give you a nice warm, safe feeling inside?

What is that quote that people always attribute to a Bob Dylan song? “Money doesn’t talk, it screams.”

And in this case, it screams injustice loud and clear. What we call this in East L.A. is: ¡Que gacho! (Translated: What a bunch of bullshit!)

Although there were protests against the George Zimmerman verdict across the United States, nothing in Chico. I am not surprised. Outside of the university and the city, Chico is a swampland of racism.

When I moved here five years ago, I had exhibitions of my work,

and a lecture and slideshow at one of the only galleries that was prepared to welcome an international artist. I found out later that it was a city not in tune to any black man who was out of their realm of perception.

Even when I had an interest in writing about art for this paper, I was told that, “Well, Bob Speer will be our art critic.” Looking at his first effort, I was not impressed. But this is Chico. The CN&R has their guy—a black dude—who seems to not accept that his wife died, like mine, and many others.

But back to my initial thought: Black people in this town simply do not go out at night. I did in the beginning, but when I am not in my studio in San Francisco, I stay away from the nightlife of Chico. I sure don’t want to be another Trayvon Martin.

Film-review addendum Re “Hi-yo, silly!” (Reel World, by Juan-Carlos Selznick, July 11): Conspicuously missing in your review of The Lone Ranger is any mention of the many references, direct and metaphorical, to real aspects of American history: Genocide, the repeated theft of land promised conquered peoples “in perpetuity,” the creating of excuses to go to war, the destruction of the living world putting “nature out of balance,” the greed causing the murderers and thieves to kill each other over their bloodstained booty.

It is often said of reality that “you couldn’t make this stuff up,” and this galloping circus, no matter how bizarre, is still only a pale reflection of our past. Disney is an odd source for revolutionary tracts, but if this is not rhetoric—propaganda, of sorts—then I must be hallucinating.

Hoffman used the same conceit in his performance. But the one glaring error in this otherwise amusing movie that stuck out was the music played at the promontory ceremony. John Philip Sousa penned “Stars and Stripes Forev-

er” in 1896. Now unless somebody injected time travel into this movie (given the crew that put this together, that wouldn’t have surprised me) that was almost four decades after the event depicted.

One final bit of trivia: The Lone Ranger and The Green Hornet were cousins, both sharing the last name Reid.

More discussion needed Re “Why so high?” and “Overhead overload” (Healthlines, by Evan Tuchinsky, June 20 and June 27): Our local hospital industry has about a 6 percent profit on $650 million in annual income. The U.S. health industry is the leading reason for personal bankruptcies, responsible for 40-60 percent of them all. The industry billing system is a labyrinth of misleading and unfair practices.

The discussion starts with a fantasy figure—that no can give a rational reason for—called the “charge master.” If you don’t have insurance, this is often when the negotiation ends; for Medicare and insured patients, this charge-master figure is “negotiated” down to 10 percent to 20 percent of the original bill.

In the U.S., we spend 20 percent of GDP on health care—twice that of most developed countries— for care that in most cases is not as good. Health-care lobbies, including big pharma, have spent $5.36 billion in the last 15 years. Compare that with $1.5 billion for the defense lobby and $1.3 billion by oil and gas.

This year, we look to spend $2.8 trillion on health care, 27 percent more per capita than other developed countries, and more than the next 10 countries combined.

Perhaps our local-hospital CEOs could address these issues?

FIRE STATION 3 CLOSES

On July 16, the Chico Fire Department closed Station 3, which is located at the Chico Municipal Airport, due to the city’s financial troubles.

According to a press release from the city’s Fire Prevention & Life Safety Bureau, one firefighter will still be assigned daily to the airport’s aircraft-rescue firefighting apparatus to provide Federal Aviation Administration-required fire protection, thus avoiding the stoppage of commercial flights into Chico.

However, as noted in the press release, the closing of the station “will cause a significant delay in the arrival of Fire-Rescue resources in the north Chico area presently served by Fire Station 3.”

LIBRARY HOURS INCREASED

While many local governments have slashed services because of bleeding budgets, the Butte County Board of Supervisors has increased some services with the adoption of the county’s 2013-14 fiscal-year budget.

Included in the extended services are increased Butte County Library hours, projected to go into effect this fall, when the Biggs branch will be open on Saturdays for six hours, and the Chico, Gridley, Oroville and Paradise branches will open on Sundays for four hours each. (To be fair, the city of Chico kicked down some of the funding to the county to keep the local library open.)

The county will also reinstitute its weedabatement program in which CalFire will respond to hazard-abatement calls and inspect properties as well. The county’s starting general fund balance, which won’t be known for sure until sometime in August or September, is expected to be around $15,250,000.

HOUSE ESCAPE

A Chico woman was convicted July 10 on charges of felony escape after she slipped off her GPS ankle monitor while on home incarceration at a local clean-and-sober-living house. According to a press release from the Butte Count District Attorney’s Office, Samantha Josephine Abernathy (pictured), 26, removed the monitor March 1 and then left the residence.

The device was discovered by a house manager and reported to the Butte County Sheriff’s Alternative Custody Supervision (ACS) program. Abernathy returned a few hours later, was greeted by sheriff’s deputies and charged with felony escape. She was serving a three-year sentence for possession of a controlled substance for sale.

Abernathy is scheduled for sentencing Aug. 6 and faces up to five years in state prison.

District Attorney Mike Ramsey said 30 inmates have escaped from the county’s ACS program since it was put in place in January 2012 to help comply with AB 109, the prisoner realignment bill. Twenty of those escapees are now serving time in state prison; the other 10 are awaiting sentencing.

Dead ends Homeless senior veteran decries difficulties in finding help

Grossman said he’d arrived in

Chico just over a week ago and has been intermittently homeless for the last two years (he didn’t want to burden his children, he explained). His last address was an apartment in Phoenix provided by HUD-VASH (the U.S. Department of Housing and Urban Development’s partnership with Veterans Affairs Supportive Housing), but he said the urban Arizona air was bad for his health.

He set out for California in May, with Chico—where he’d spent extended stays in the 1990s—as his ultimate goal, spending a few weeks in Bakersfield along the way.

It doesn’t take a doctor to realize Grossman is not physically well. He is gaunt and tired-looking—gray skin hanging from a walking skeleton—and has to excuse himself regularly to use the restroom. He suffers from a laundry list of ailments and feels he has more serious problems that go undiagnosed by what he feels is sub-par health care he receives from senior and veterans’ benefits.

Mentally, he’s quite astute, if excitable, but admits his faculties are presently slipping, which he blames on his current living conditions (or lack

thereof). He also acknowledges shortterm memory loss, but to compensate he keeps a pen and notebook on hand in which he meticulously records names, phone numbers and details of communications he’s had with the Butte County Veterans Service Office (BCVSO) and other agencies.

He said he sat through an hours-long intake session with a medical social worker at the VA Chico Outpatient Clinic that yielded no results. He claims he first called the BCVSO before leaving Arizona, and that many of his subsequent calls to various agencies have gone unanswered, without follow-up, or sent him on a circuitous goose chase.

“The VA sends you out to the social services who tell you to go back to the VA, and it keeps going on and on.

“The best the VA did here was direct me to the Torres Shelter, and they turned me away because I’m not taking my medications,” he said. He explained his rationale for non-compliance: “I quit taking them because they made me dizzy, drowsy, blurry and confused. But I saved them pending finding a doctor who will tell me what I should be taking with all of the conditions that exist.”

room or extended hospital stay before he has a place to stay could lead to his van being impounded, with costly fees being too large for him to reclaim it. He also fears being declared mentally incompetent and losing his independence. Other than the benefits he receives and is entitled to, Grossman said he hates handouts and, when they are offered, he always offers a check post-dated until his next Social Security deposit.

“I just want a bed, a shower in the morning, a place to keep my food fresh and some air conditioning to keep my body cool,” he said. “I know I may very well end up in assisted living and accept that, but hope I can at least be allowed to cook my own food.”

the BCVSO, said she couldn’t speak to Grossman’s case specifically, but explained that everyone applying for VA services must meet certain eligibility requirements and complete intake processes, which can take time.

She also said services are prioritized for applicants based on the nature of the veteran’s service (active duty, training or otherwise), and if they received an honorable discharge.

Williamson said sometimes services aren’t immediately available, with housing in particular requiring a waiting period, and in that case, vets are often referred to the Torrres Community Shelter. She also said the BCVSO works with shelter guests who are veterans to seek out other vets to help them obtain further help. If someone doesn’t immediately qualify for VA medical service, they are referred to Enloe Medical Center or, in the case of mental illness, Butte County Behavioral Health.

Grossman survived Monday, and did so more comfortably than he had since his arrival in Chico, due to the intervention of a Good Samaritan. As Grossman talked about his troubles, a man from a nearby table came over to say he’d just ordered him a hamburger, fries and a drink. Grossman’s eyes welled with tears as he expressed his gratitude, to which the man—named Nick—jovially said, “Ah, c’mon buddy, it’s just a sandwich.”

As overwhelmed as he was with the first substantial meal he’d had in days, Grossman was even more grateful when Nick returned later with the key to a motel room he’d reserved him for a week, as well as a $50 gift certificate for food.

When asked what moved him to help, Nick didn’t hesitate to answer: “Well, I’m a vet myself. And if that guy was my dad, I hope somebody would do the same exact thing.” Ω

About 30 neighbors have formed an association to protest the wedding events because the noise, they say, literally spills into their back yards, disrupting their home lives.

The Butte County Planning Commission is in the process of changing the land-use ordinance to allow for the weddings which, up to this point, have been conducted without a proper permit. The new zoning says that a property with an agricultural use—such as a winery, olive-oil producer or micro-brewery—may hold such events as a way to increase tourism and spending in the county.

Three years ago, the Medearises planted 800 vines of table grapes, which are just now producing grapes.

“It’s a very contentious issue in the neighborhood,” said Tim Snellings, director of the county’s Department of Developmental Services. “They want people to be able to come in and pick their own grapes. As we wrote the general plan over the last five years, we wanted to do something to support the agricultural base of the county and that includes allowing for accessory types of activities to occur on agricultural operations.”

But the neighbors don’t buy it and neither does Butte County Supervisor Maureen Kirk, who visited the neighbors during one of the weddings in May. “They’ve been scheduling weddings since February without permits,” Kirk said. “Tim Snellings let them go ahead with the weddings. We’re kind of doing this backwards.”

She said other venues in the county are doing the same thing without proper permits.

“It’s something that has escaped us,” she said. “It is very complicated. They are in the middle of a land-use lot adjustment. There are 11 immediate neighbors. You can hear the weddings from a fairly long distance. A neighbor named Jonathan Day said you can’t sit in the back yard for family get-togethers because of the thump-thumpthump of the music.”

Day’s property backs up to the Medearis’ property.

“The major complaint is that this is zoned agriculturally and all our little houses here were grandfathered in well be before the Greenline was approved,” Day said by phone this week.

SIFT|ER Fueling up The price of gas is at an all-time high, right? And President Obama is responsible. Well, not really—on either account.

The national average price for a gallon of regular actually peaked at $4.09 five years ago in July 2008 when a fellow named George W. Bush was president.

Presidential policies have little to do with the price of gas because, according to University of Chicago economics professor Richard Thaler, oil is a global market where America consumes 20 percent of what’s available but holds only 2 percent of the oil reserves. “The way they’ve decided to do it is sort of an end run around the ag-zoning ordinances that allow for special events,” he said.

The land sits in Supervisor Larry Wahl’s district.

“I attended a meeting in which the neighbors conveyed their concerns and the owner made their case,” Wahl said. “It’s working its way through our staff. If the Planning Commission approves it, then it goes into effect unless the neighbors appeal it. No matter how it goes, one side or the other will appeal it is how I see it.”

Snellings said he thinks the Medearises have a good case.

“The ag use has been there two years,” he said. “I don’t know their intent, but would have a hard time believing they could calculate this so far in advance. We just adopted out code last December.

Because our code doesn’t really have a wedding section, this is a very fortuitous set of circumstances for them to have planted the three acres of grapes so that they can use this section [of the property for weddings] and even make an application to do this.”

Flores Medearis said the weddings bring business to the county and provide a nice place for couples to tie the knot.

“The girls come here on Friday for rehearsal—they have the run of the place,” she said. “Saturday mornings are when there is a beehive of activity with their makeup and their hair. They spend the day enjoying their time. This is all about getting ready.”

She says weddings bring in people from out of town who stay in local motels, purchase gasoline and shop. The wedding events give business to local caterers, florists and photographers, she added.

The couple’s 4,000-square-foot house was built in the early 1990s.

“We really waited to get involved in the agriculture,” Flores Medearis said. “Mark’s family had farmed this land at one time back in the 1930s.”

She said one of the attendees at a May wedding was NFL star Aaron Rodgers. At that particular wedding, neighbors called the Butte County Sheriff’s Office at about 8:30 p.m., and deputies responded. She said they reasoned with the deputies and no noise-ordinance charges were filed.

“I have no clue why everybody gets so up in arms,” she said. “The county held a neighborhood meeting in May before the first wedding and the neighbors were very rude.”

suit Abuse (CALA), to a full conference room in north Chico on July 12. “We had 1.2 million civil lawsuits in the state of California last year. Not all of them were frivolous, but there’s got to be a better way.”

In what at times became a contentious public forum, Scott and guest speakers U.S. Rep. Doug LaMalfa (R-Richvale) and state Sen. Jim Nielsen (R-Gerber) outlined how they believe “lawsuit abuse” is crippling California’s small businesses and suppressing economic growth at a meeting held at the North Valley Property Owners Association office on East Avenue.

The meeting was sponsored by CALA, self-described as a grassroots movement, though critics have linked the groups (there are dozens of CALAs across the nation) to large corporations, including insurance, oil, gas and tobacco industries as well as the controversial American Tort Reform Association.

In addressing the audience— made up of small-business owners, members of the disabled community, and local media—Scott described how trial lawyers have made a “cottage industry” of litigating businesses not in compliance with laws like the federal Americans with Disabilities Act (ADA) and California’s Proposition 65.

The ADA requires business owners make building modifications to allow access for people with disabilities, remove barriers in existing facilities, and provide aids and services for people with hearing, vision or speech impairments.

Prop. 65, meanwhile, requires businesses to post warning signs if chemicals deemed harmful by the state are on site.

LaMalfa stressed repeatedly that both the ADA and Prop. 65 fail to clearly define what is required of business owners, making them easy targets for lawyers who make a living from “drive-by” lawsuits motivated by profit and not intended to increase accessibility for disabled individuals.

“When Congress and the legislature makes vague laws, you open the playground for lawsuits,” he said. “All this does is slow the economic recovery. It means less jobs,

[and] less money for police and fire protection, our roads, and our highways.”

An ADA-compliance lawsuit settlement typically costs a business owner $15,000 to $20,000, Scott said, while a Prop. 65 lawsuit settlement averages between $60,000 and $70,000. “Then you have to comply, which might make the [lawsuit] look like a tea party,” Scott said.

“Day after day in the legislature, provisions are inserted all the time to make us more litigious, to provide more opportunity for lawsuits,” Nielsen said.

The forum’s tone changed

markedly when Scott opened the floor for public comment.

Members of the disabled community—including a strong showing from representatives of Independent Living Services of Northern California (ILSNC) —shifted the discussion to issues specifically regarding ADA compliance and business accessibility, though Scott made several attempts to steer focus back to the broader issue of legal reform.

One woman, accompanied by a guide dog and wearing an ILSNC T-shirt, spoke of disabled individuals being unfairly characterized as quick to take legal action when confronted with a business not complying with ADA guidelines.

“Just because we have disabilities doesn’t mean we want lawsuits or we’re out for money,” she said.

“We just want what we need as far as accessibility—being able to reach things, being able to get into [businesses], and also being treated fairly.

“There’s a misconception that people with disabilities are out to get something, and I don’t believe that’s true.”

Longtime activist Karen Duncanwood of Paradise spoke on behalf of her disabled son, Brian, who was not in attendance. Duncanwood recalled how she and Brian marched from the White

House to the Capitol building “to help get ADA passed” in 1990.

“Businesses have had 23 years to comply,” she said. “If businesses and public entities had put aside a little of their money over those 23 years, they would have had the access changes done a long time ago. We are in favor of compliance, not suing. If people comply, they won’t get sued.

“It’s not a vague law—it’s a complex law,” Duncanwood continued, addressing LaMalfa directly. “But think about it: How could it be anything else? The reality is that disabilities are complex, our local communities are complex.”

Though the forum had divisive moments, both sides agreed that ADA lawsuits in which the goal is simply quick money are deplorable.

Over the phone after the meeting, Scott told the CN&R he was contacted by Forest Harlan, systems change coordinator for ILSNC, who proposed his agency work with CALA on solutions.

Scott said he believes the debate was successful in prompting a discussion of “legal reform and how lawsuit abuse affects job creation and our economy.

“If we’re going to get California back on track, legal reform is one area, among many, that should be seriously looked at.”

early three months after getting snubbed N in an effort to get the state involved in monitoring marijuana-growing operations in

the local foothills, Butte County officials continue to address the matter. Attention to the preparation of the pot gardens was triggered by the discovery of large-scale soil grading and the building of greenhouses on properties near Paradise, Magalia, Concow, Forbestown and Feather Falls.

The Butte County Board of Supervisors, after learning about the soil-grading operations, approved sending a letter to the Central Valley Regional Water Quality Control Board (RWQCB) expressing concern about the environmental damage involved in the pot gardens. The letter asked that the state step in and help enforce the federal Clean Water Act. “Butte County has its share of large marijuana grow sites,� the letter reads. “The development of these sites ha[s], in many cases, disturbed over one acre of soil and include[s] buildings and other improvements that support these large marijuana-growing operations without proper local and state permits.�

The letter pointed out that the state regulates mining, industrial and construction operations with strict guidelines, and that the same should be done for large marijuana gardens. But the state considers such operations agricultural, and thus exempt from some conditions.

Ken Landau, the assistant executive officer for the RWQCB, said in a May 24 phone interview that the board would not get directly involved in policing pot farms. “Yes, there is a real issue with these marijuana operations,� he said. “However, our staff are not armed peace officers, and we cannot be sending them into places where their lives will be at risk. He said the state Department of Fish and Wildlife has shown interest in getting involved in the investigations as well. “It’s not illegal in our county to grow medical marijuana,� Crump said, referring to a fairly restrictive county ordinance passed by the Board of Supervisors earlier this year in an attempt to appease both those in favor of legalized growing of medical marijuana and those against it.

Crump said at this point the county is still concerned about possible environmental damage associated with the grows and the chemicals often used. “We are aware of that, and are looking for and have found evidence of the use of rodenticide,� he said. “And we are looking at the impacts of the grading and the drilling of illegal wells.�

County counsel and District Attorney Mike Ramsey are looking into other possible violations of environmental law, Crump said, and will be filing complaints.

Ramsey also noted the problem of unpermitted wells getting dug and drawing down water levels for existing wells. “We’ve heard of neighbors’ wells getting drawn down and starting to dry up,� he said. “It’s hard to show that wells drilled in the foothills affect nearby wells. There is no specific aquifer you are drawing from like there is in the valley.�

A resident of the foothill community of Cherokee contacted the CN&R via email to report problems with his well. (He asked not to be identified.) “After keeping level records of my well over the last 17 years, I noticed they were much lower last year,� he wrote. “I called in a well driller to discuss a new well option, expressing my concern that our ‘local growers’ were depleting the water levels. EARTH WATCH COAL-BURNING KILLS

Heart and lung disease related to air pollution from burning coal is responsible for shortening the lives of residents of northern China by 5 1/2 years as compared to those living in the southern part of the country, new research reveals.

Severe pollution in the north is associated with the Chinese government’s policy from 1950 to 1980 of giving free coal to those living north of the Huai River, according to National Geographic. While the coal is no longer free, it is still subsidized.

“We can now say with more confidence that long-run exposure to pollution, especially particulates, has dramatic consequences for life expectancy,” said Michael Greenstone, MIT economics professor and collaborator on the study, which was published in the Proceedings of the National Academy of Sciences.

URBAN CHICKENS DUMPED

The downside of the growing trend of raising backyard hens in American cities is that hundreds of those chickens are being abandoned by owners who find raising fowl is more challenging than they thought.

Among the issues frustrating some urbanhen owners is the fact that hens lay eggs for only two years but live for 10 years or more, according to a recent NBC News story.

“Many areas with legalized hen-keeping are experiencing more and more of these birds coming in when they’re no longer wanted,” Humane Society of the United States spokesman Paul Shapiro was quoted as saying. “You get some chicks and they’re very cute, but it’s not as though you can throw them out in the yard and not care for them.”

STEERING CLEAR OF HELL’S KITCHEN

British singer Morrissey, former frontman for influential band The Smiths, recently donated £10,000 (almost $15,000) to People for the Ethical Treatment of Animals (PETA).

Morrissey (pictured) received the money from the UK’s Channel 4 after the TV station used the Smiths song “Please, Please, Please, Let Me Get What I Want” without permission to promote celebrity chef Gordon Ramsay’s Christmas Cookalong Live show in 2011, according to the UK’s Guardian newspaper.

PETA will use the money to help fund its advertising campaign against high-end London retailer Fortnum & Mason for continuing to sell foie gras—a French delicacy made of liver from ducks fattened by forcefeeding—despite requests from animal-rights groups to remove it from store shelves.

“Ramsay may very well stick his head in his microwave when he hears that the money I received from Channel 4 … is being donated to PETA to fight foie gras,” said Morrissey, a vegetarian.

Salisbury is part of a three-person team that is promoting a pilot study—called Composting Toilets and Graywater Systems for Camping—being conducted by the environmental-health division of the Butte County Public Health Department.

Her two partners are Amanda Pyle, a friend and fellow Concow property owner, and Butte County Public Health’s Environmental Health Director Brad Banner, who is overseeing the project.

The pilot study, which so far has only one participant—Chaffin Family Orchards in Oroville—is seeking rural property owners “who want to use their land for longterm camping and are interested in alternative sanitation,” as a recent press release described it (see column note for info).

Chaffin’s new Feather Down campsite, which offers farm-stay vacations, features

four well-appointed tents equipped with composting toilets and a gray-water system that distributes used kitchen and bathroom water into an outdoor “mulch basin,” from where it percolates into the ground.

“This pilot project will give Butte County Environmental Health the information needed to assess whether, in certain specific situations, ‘non-discharging’ toilets and simple gray-water systems will protect public health and result in user satisfaction,” the press release continued.

Outside of the study, composting toilets are illegal in Butte County, except for certain non-residential and non-commercial uses, “such as agricultural storage buildings and primitive-type picnic grounds, campsites, and recreation areas where onsite wastewater systems are not feasible,” according to item C-10 in section 19-7 of the Butte County Public Health Department’s Environmental Health Division’s On-Site Wastewater Ordinance.

“Here’s what it means for my neighbor in Concow: It means that while he builds a permanent structure to be on-site, he will be living in a trailer—a camping trailer, a fifth wheel, a school bus or whatever,” explained Salisbury. “He can live on-site, and he can take care of sanitation this way—with a composting toilet. Or maybe you’re working and saving for retirement, and you own property but you’re not ready to invest in a septic system at this time …”

Installation of septic systems can range from roughly several thousand dollars to $15,000 and higher. On the other hand, a decent composting toilet can run from less than $1,000 to around $2,500. Costs for installing a gray-water system range from $500 to $2,000, according to Brian Ladwig-Cooper, co-owner of local permaculture landscape company Gaia Creations, and the person in charge of installing the GREENWAYS continued on page 14

gray-water systems for pilot-study participants. Gray-water systems installed for study participants—unlike other gray-water systems in Butte County—are allowed to process kitchen-sink wastewater, in addition to the usual bathroom (shower, bathtub, sink) and washing-machine run-off.

Under the study’s terms, the toilets and gray-water systems may also be installed in an outbuilding, such as a workshop or shed, that exists on rural property.

In addition to paying for installation and all components, participants in the three-year study are required to purchase a permit that costs $265. If the study proves to be a success, as determined by the public-health department, participants will be allowed to keep their composting toilets and all-encompassing gray-water systems.

It “recycle[s] human excrement safely by containing it while microorganisms turn it to humus,” according to Chris McClellan, education director of the Portland, Ore.-based nonprofit Natural Building Network, writing in Mother Earth News. Composting toilets— many of which are indistinguishable in appearance from conventional toilets—also use very little or no water.

“By comparison,” McClellan wrote, “a ‘normal’ toilet adds up to five gallons of pure drinking water to an ounce or so of waste so it can be flushed into an expensive septic or sewer system, where it is treated.

The American Water Works Association Research Foundation finds that over 30 percent of household water use is just for flushing toilets.”

Among the increasing number of critics of potable-water-wasting flush toilets is Robert Glennon, whom Chicoans will remember as the author of last year’s local Book in Common, Unquenchable: America’s Water Crisis and What To Do About It. of human waste,” such as via waterless urinals and incinerating toilets.

Incidentally, Glennon’s home state of Arizona, as well as the parched country of Australia, are notably ahead of the curve as far the widespread use of water-conserving gray-water systems.

“So far, it’s worked pretty well,” said

“It’s been interesting introducing a lot of the public to [composting toilets],” she said.

“Every now and then, some people get daunted because it’s something they’ve never seen before.”

But, Maben insists, “they are simple to use” and do not smell, contrary to what some might imagine, thanks to the toilets’ solarpowered fans that both prevent odors and facilitate the composting process.

For her part, Maben is hoping that the three-year study works out well, so that the gray-water system and toilets can remain in place.

Composting toilets are “non-electric, non-water—they are more eco-friendly [than conventional toilets],” Maben said. “Since [the campsite] is not a permanent residence, it’s a cheaper and better solution for the tents than shelling out for a whole septic system.

That would be hard to justify when people aren’t there all the time.” Ω

issue of Wildfire Safe Neighbors News from the Butte County Fire Safe Council (aptly dated “Fire Season, 2013”). The newsletter goes into detail about the council’s Residents Assistance Program, for “residents in communities at risk of wildfire who need help with defensible-space clearance.” The nocost program is offered to disabled, elderly and low-income residents of Butte County.

Volunteers and/or staff of the fire-safe council will schedule a home visit with participants “to share wildfire-safety information and discuss and verify the concerns of the residents,” according to the newsletter.

Once the need for defensible-space work has been determined (100 feet of cleared, defensible space around a home is required according to California law), members of the Butte County Sheriff’s Office will come out to trim trees, thin brush and remove “ember hazards,” such as leaves and pine needles. Any necessary chipping of brush and tree limbs or hauling away of leaves will be done by a contractor hired by the fire-safe council.

ANTI-GMO GreenHouse reader Luisa Garza alerted me to a story at Political

BlindSpot.com about the early-June nighttime destruction of 40 tons of genetically modified sugar beets in two fields in Jackson County, Ore., leased and managed by giant agri-pesticide corporation Syngenta AG. “It was only reported locally live on KXL [in Portland, Ore.] and echoed by The Oregonian, where the only Web mention exists,” said the June 23 article.

(The story has since appeared on several alternative-news websites.)

“Here’s what happened,” it continued. “Forty tons of GMO sugar beets were set ablaze in Oregon. … Since the initial reports, the news said instead that 6,500 plants were destroyed by hand, one plant at a time. If the reports of the uprooting of this many plants are true, then we are talking about a movement, a kind of organized revolt. …

“If, however, the initial reports of uprooting along with arson are true, then this certainly makes more sense, both in terms of the direct action, and the logic behind how it could be pulled off on a practical level. This would also explain why the FBI is involved, as uprooting plants would not likely interest the Bureau as much as [the arson in] this case.”

Federal felony charges of economic sabotage and domestic terrorism could be brought against the perpetrators if they are caught.

SERVICES FOR NEEDY RESTORED

California has been ordered by a federal appeals court to restore key services for MediCal patients treated at health clinics serving the state’s neediest populations.

The state cut adult dental care, optometry, podiatry and chiropractic services for all Medi-Cal patients in 2009, as they were deemed optional for states under the federal Medicaid program, according to SFGate.com. On July 5, the Ninth U.S. Circuit Court of Appeals in San Francisco ruled that eliminating the services violated the Medicaid law’s provisions for a network of health clinics serving rural areas and federally funded health centers serving the homeless, migrant workers and residents of public housing.

The patients of such clinics represent nearly two-thirds of the state’s visits for Medi-Cal treatment each year.

Mexico has surpassed the United States as the most overweight industrialized nation in the world.

A recent United Nations Food and Agricultural Organization report finds that nearly a third of Mexican adults are obese, slightly edging out the U.S. adult-obesity rate of 31.8 percent, according to CNN Health. The report linked Mexico’s rise in obesity to an increasingly sedentary lifestyle as incomes go up and the population moves toward metropolitan areas, and increased consumption of low-cost, highcalorie processed foods.

The trend is particularly troubling for Mexican children, who can be simultaneously malnourished and overweight. “They are exposed to high-fat, high-sugar, high-salt, energy-dense … foods, which tend to be lower in cost but also lower in nutrient quality,” the World Health Organization reported.

SICKENING CAT SCAT?

Animal-disease experts are calling attention to a potentially harmful parasite present in a small portion of cat feces.

In a study published in the journal Trends in Parasitology, Maryland researchers warned of a dormant, feces-borne parasite called Toxoplasma gondii, which can infect humans and other warm-blooded animals, according to the Los Angeles Times. Such feces-borne parasites, called oocysts, have long been linked to serious birth defects, including deafness and mental retardation, and have recently been controversially associated with increased risk of brain cancer, schizophrenia and suicidal behavior. The authors urged cat owners to keep pets indoors, properly dispose of cat litter, and be wary of areas “favored by cats for defecation.”

“It should be assumed that the play areas of children, especially sandboxes, are highly infectious unless they have been covered at all times when not in use, or … are not accessible to cats,” the study’s authors wrote, adding that “it should also be assumed that gardens to which cats have access are infectious.”

Private doctors on the Ridge leave business side of practicing to Feather River Hospital by

I of medical training jumped at the opportunity to practice on their own. They’d find n decades past, doctors fresh out

a community, hang up a shingle and welcome new patients.

Over time, increased regulation, documentation and billing paperwork has made running an office a burdensome undertaking. Yet, medical schools devote little time to finances and management. As a result, few new doctors care to go into private practice, while many longtime doctors seek to avoid grappling with the logistical aspects of business ownership.

Paradise, like many communities, is feeling the pressure. The Ridge can be a challenging place to open an office, and it takes considerable effort to attract new physicians.

Feather River Hospital has found a solution by creating a series of hospital-based outpatient clinics (HBOCs) in which physicians still practice independently, but their medical offices are drawn under the hospital’s umbrella. Through the HBOC system, the hospital procures office space, equipment and supplies; handles billing and insurance hassles; and employs the staff.

“Our goal is to provide a venue where services are provided and the doctors have the support network they need to provide those services to people on the Ridge,” hospital CEO Kevin Erich said. “We provide the infrastructure, and that allows the physician to concentrate primarily on medicine and not be so concerned about the operational side.”

Currently, Feather River runs eight such

clinics, incorporating eight doctors as well as other mid-level providers such as physician’s assistants, nurse practitioners and midwives. Two of the clinics—Skyway Primary Care & Wellness Center (on Raley Boulevard) and Feather River Midwifery Services (on The Esplanade)—are in Chico.

Having the HBOC framework has helped Feather River bring in new practitioners and also kept a couple from retiring. Erich said several doctors have recently approached Feather River about joining the HBOC network.

“This is not a big money-maker for the hospital; in fact, we’re probably lucky if we break even on the deal,” Erich said.

“What’s more important about this is [the] alignment with the physicians, and continuing to serve the community the best way we can.”

Patients should notice little difference—apart from a new sign out front and the Feather River Hospital logo on their bills—because the hospital aims to keep established practices in their current loca-

tions and staffed by their current receptionists and nurses.

“We want the patients to feel comfortable,” said Maureen Wisener, assistant vice president for foundation and communications at Feather River. “We work with the physician and try to hire his or her existing staff, because the patients are used to seeing Sally at the front desk. There may be some new regulatory issues in effect [at the office] because the hospital owns it, but as far as the patient experience and the patient care, hopefully [the transition] is as seamless as possible.”

Feather River embarked on the

HBOC process about four years ago, before Erich succeeded Wayne Ferch as CEO. “We had a doctor come to us and say, ‘Hey, I just cannot continue to spend all my time administering my practice. I want to do something different. Can you help me?’”

That first physician, Dr. Ronald Ainsworth, continues to practice at his longtime office on Buschmann Road in Paradise, now called Feather River OB/GYN Associates. Feather River has since brought in two additional obstetrician/gynecologists for the Total Women’s Health clinic on Clark Road, as well as two OB/GYNs with wider scopes of practice for the Skyway Primary Care & Wellness Center.

Dr. Randal Sloop and Dr. Christine Sloop both practiced as OB/GYNs in Cincinnati, Ohio, before embarking on new training—Randal as a family medicine doctor, Christine as a registered dietician. Feather River established a clinic for them, where they were joined by physician’s assistant Bernadette Connolly and nurse practitioner Sally Vertolli. They opened their doors for business in October of last year.

Meanwhile, Feather River is negotiating with additional local doctors about converting their practices to HBOCs. “Ultimately, I think this will be to their advantage, to our advantage and to the community’s, because ultimately it will allow us to work through some of the challenges we have moving forward,” Erich said. “Our goal long-term is to make sure we’re still here providing care for our community.” Ω

t’s possible to stand at the bend in the road that marks the heart of downtown Cherokee throughout most of the year, even at midday, and count the cars that pass in an hour’s time on one hand, perhaps two hands on a Sunday. Traffic picks up for a few months in spring, when wildflowers blanketing the top of Table Mountain lure thousands of visitors south from Highway 70 along rural Cherokee Road.

More than a few who make the trip for the wildflowers are also struck by another spectacle—a small collection of very old buildings springing from the rugged, overgrown landscape near that bend. On one side of the street sits the crumbling stone ruins of a mine office, on the other a bright yellow, ramshackle building fronted by a large porch—the Cherokee Museum. Resting nearby is a railroad caboose, which is downright puzzling when one considers the nearest tracks are miles away. There are a few other less-descript buildings, including an old post office.

The place evokes the aura of a long-abandoned Western movie set.

But Cherokee is the real deal, the ghostly remains of a once-vibrant town that, during its heyday in the late 19th century, boasted 17 saloons, eight hotels, two churches, two schools, and a theater, racetrack and brewery to serve its population of more than 1,000 residents.

Most came to work in the world’s largest and most technologically advanced hydraulic mining operation of its time. With the benefit of electric lighting and water cannons that allegedly could blow a hole through a man, they pulled millions of dollars in gold from the rich “diggings” just out-

side of town at Cherokee Flat, beneath a peak that is today partly collapsed from the efforts.

Cherokee’s fantastical history includes visits by President Rutherford B. Hayes, Gen. William Tecumseh Sherman, inventor Thomas Edison, O.J. Simpson and maybe even ancient Chinese explorers who allegedly predated white settlers by thousands of years. It’s also a story full of firsts, from the first phone call made in Butte County to the first diamonds discovered in America.

This history is unknown to most, and may have been forgotten altogether if not for

the enduring efforts of one man: Jim Lenhoff, founder and president of the Cherokee Heritage and Museum Association. For more than 50 years, he has dedicated untold amounts of time, effort and personal finances toward preserving this piece of history for posterity.

Lenhoff is a well-respected historian.

He is a past president of the Butte County Historical Society and that organization’s only surviving charter member, and a current or past member of other historical organizations too numerous to list.

A dedicated preservationist, he spearheaded

successful BCHS campaigns to save local landmarks including Oroville’s Ehmann Home, the Oregon City Schoolhouse and the Bangor Community Church. For 21 years, he served as editor of the BCHS periodical, Diggin’s, which he also named (the word refers to any mineralrich lands where mining occurs).

In 1969, Lenhoff was personally tapped by Ronald Reagan to travel to Promontory Point, Utah, and read the then-governor-of-California’s official proclamation celebrating the centennial of the completion of the transcontinental railroad, an event during which he shared a stage and shook hands with actor John Wayne

and James Cash Penney, founder of the department-store chain J.C. Penney.

According to his own recollection in a 1991 Diggin’s piece about Cherokee’s nearest neighbor—the similarly boomed-then-busted mining town of Oregon City—he recalls falling in love with the area when he and his late wife, Donna, bought a cottage nearby in 1960.

The next year Lenhoff got word that Bank of America, which owned the property where the stone mine and assayer’s office sits, planned to tear the structure down.

“I asked them to please not tear it down,” Lenhoff recalled. “They said if I didn’t want

The commonly accepted account is that a Maine-born school teacher named Sol Potter—driven by news of the discovery of gold in California—left his teaching job at a reservation in Oklahoma and headed west, taking a group of his students with him. Though this story is often repeated in historical texts, most note it is unsubstantiated.

What is recorded is that, by 1853, Cherokee was the site of a burgeoning tent camp and several gold claims. More permanent structures were soon built, the earliest of which included a stamp mill to pound placer from quartz taken from the surrounding local mines, and a post office established in 1854. town boomed seasonally, as miners largely abandoned operations in the summertime due to lack of available water. News of fortunes found there spread and helped the population steadily grow, and gold wasn’t the only thing found in the hills—in June of 1961, the first of many diamonds was found in the area.

In the late 1860s, small mining operations began to merge to form Cherokee’s first mining companies, which grew and folded further into a few large, major players. With expanded capital enabled by these consolidations and the attraction of investors, the first of many ditches, flumes and pipes began carrying water into Cherokee from farther up in the Sierra Nevada mountains. This system was expanded over the next decade to include more than 100 miles of waterways conducting water from reservoirs, the largest of which was a 300-acre man-made lake at Concow.

As the hydraulic systems grew more sophisticated, so did the town of Cherokee.

The community was divided into three

parts—Upper, Middle and Lower town—all connected by miles of boardwalk.

Between 1870 and 1894, Cherokee’s hydraulic-mining operation, at its peak controlled by the Spring Valley Mining and Irrigation Company, was regarded as a technological marvel. Using gravity and a series of pipes that gradually grew smaller, the water was channeled through 18 huge water cannons—called monitors—that spewed water at pressures high enough to shoot 400 feet. These monitors blasted away at Cherokee’s proximate peak, washing tons of rock and gravel down shafts through the humongous Eureka Tunnel and over nine miles of industrial-sized sluice boxes. Dynamite helped rip loose more stubborn rock faces, and water-powered derricks moved boulders weighing several tons. Electric lighting enabled three shifts of 100 men to work around the clock, with hundreds more constructing and maintaining the water system.

Much of that rock, mud and water, known as “slickens,” washed down into the Mesilla Valley north of the mine and was carried out into the Sacramento Valley via Dry Creek, which flows west toward Richvale. The first of several lawsuits from valley farmers claiming crop damage was filed in 1872, but judges

determined that, with all the other debrisdumping going on, the Spring Valley company couldn’t be held accountable. To prevent further litigation, the company purchased 23,000 acres of land south of Durham—still known today as the Cherokee Strip—and built a series of levees and canals to strain the slickens and lessen damage.

Controversy still raged over hydraulic mining, but the Cherokee miners’ efforts at mitigation allowed the mine to continue as others were being closed by new anti-debris laws, until 1887. For a brief time, hydraulicking was replaced with drift mining, but large-scale mining at Cherokee ceased altogether in 1894. All told, according to mineral database mindat.org, more than $15 million in gold (at period prices), 400 diamonds and some platinum were taken from the mine during its boom years.

After the mine closed, Cherokee’s long, slow decline began. Smaller-scale efforts to mine Cherokee continued sporadically until the 1930s, with little success. In 1947, a fire burned the town’s last store to the ground. No new businesses have opened since. All that remains of Cherokee’s past are the buildings described earlier, an old schoolhouse now used as a private residence, and a pastoral cemetery where some of Cherokee’s pioneering spirits rest eternally.

As of the 2010 census, the population of Cherokee was 69. Modernday residents live mostly on more modern ranches and small farms spread throughout the rural area, built on the bones of the once-thriving mining mecca.

This remains true; the canon of Cherokee history has expanded since only by the occasional article written by Lenhoff for Diggin’s, and a few Internet articles penned by travelers who stumbled upon the ghost town.

Lenhoff can be credited with discovering, or at least re-discovering, the evidence of Thomas Edison’s presence in the North State.

Lenhoff explained the famed inventor also had a side venture designing and selling mining equipment, and for a time owned a store selling these in Oroville. He visited that city, and Cherokee, in 1878, striking up a friendship with the Cherokee mine’s manager, Louis Glass. He brought two telephones with him, enabling him to make the region’s first phone call—over existing telegraph lines—from Cherokee to Oroville.

Lenhoff also recalls, in more recent history, a number of film productions shot in the Cherokee and Oregon City areas, including parts of 1981’s On Golden Pond and principal shooting for 1974’s The Klansman, which starred Lee Marvin, Richard Burton and a young sports star making his crossover attempt into film—O.J. Simpson.

A more visceral and engaging glimpse of the storied mining town is best found through a visit with Lenhoff at the Cherokee Museum, which today is open only by special appointment or on Sundays during wildflower season.

The museum is housed in a building moved in 1878 to its current Middle Town location from the Upper Town section of Cherokee. The building, constructed many years earlier, has formerly served as a miners’ boarding house, a stagecoach stop and a private residence.

Its interior, behind a set of large double doors still opened by an old brass key, and the surrounding grounds are cluttered with relics illustrating the area’s past.

In the arena of natural history, these include many rocks, fossils and petrified wood, including fossilized mammoths’ bones which, Lenhoff gleefully points out, retain intact petrified flesh.

Some relics directly relate to Cherokee, while others—like old bottles and other paraphernalia—are merely meant to illustrate the era. Some include handcarved wooden replicas of old Cherokee storefronts lining the walls of one room, a replica miner’s kitchen crammed full of cutting-edge late-1800s cooking gadgetry, and a pioneer bedroom decorated in period-appropriate replica quilts, some of which were handmade by the late Mrs. Lenhoff.

Practically every available space inside in the building is covered in relics, photos, paintings and maps. Many of the objects were collected by Lenhoff and his wife from yard sales, flea markets and hiking trips to long-abandoned settlement sites, while others came courtesy of descendents of those who worked the mines or modern Cherokee residents who stumbled across them. In fact, as we stepped outside, Lenhoff pointed to a heavy, metal machinery wheel dropped in front of the museum by an anonymous donor a month earlier.

The museum’s yard is littered with rusted mine- and waterworks: small monitors, lengths of pipe, a huge metal bucket Lenhoff explained was used to haul ore (and workers) from deep shafts. The yard also holds one of the museum’s more mysterious holdings: Coffin Rock.

The oddly shaped rock was a landmark to local miners that Lenhoff decided to move from Cherokee Flat to the museum, using the services of a very confused tow-truck driver.

Once in its current resting place, the sun dried the thick layers of moss and lichen covering the stone so that they fell away, revealing the long-hidden carved graffiti of miners and juvenile taggers from Cherokee’s gilded age, as well as stranger, older symbols. Lenhoff said visiting experts over the years have been unable to fully solve the mystery, but some have conjectured they are ancient Phoenician or Chinese. He explained that evidence suggests the Chinese did visit North America 3,000 to 4,000 years ago, but wonders what the heck they were doing in Cherokee.

it’s been translated from an ancient language called Ogam to read, “I am striped and in pain from Bel’s poison arrows. I give an uproar at the smiting of my mindful body.”

“The rock attracts lots of interesting characters,” he said. “I came out and a woman was lying on it. She said she was a medium and was in a trance with who made this rock.

I said, ‘Oh really? Please tell me who it was.’

“So she said, ‘I’m being shot by arrows and I’m dying!’ I thought to myself, ‘Well, who is dying after getting shot full of arrows and finds the time to stop to carve a rock?’”

Also outside—near a large, flat rock formation pockmarked with holes used for grinding foodstuff by the area’s pre-Gold Rush inhabitants, the Maidu Indians—is a dilapidated old carriage house Lenhoff cheekily named Hayes Hall. He used the opportunity to convey the details of President Hayes’ Sept. 24, 1880, visit (along with his wife, Lucy, Gen. John Bidwell and then-U.S. war secretary Gen. Sherman). They were given diamonds and gold that are still on display at the Rutherford B. Hayes Presidential Center in Fremont, Ohio, and one of Lenhoff’s enduring quests is that of locating a picture reportedly taken of Gen. Sherman riding and firing one of the mine’s water cannons. Though not actually entertained in the museum’s Hayes Hall, the party did dine in a blacksmith’s shop, where they were treated to music played on anvils with different pitches.

Then there’s the train car, which prompted the question of how Lenhoff got it there. He said it was donated by the Western Pacific Railroad and transported from Idaho to Oroville by rail. From there, it was hauled up the mountain in pieces, the wheels separated from the main cabin.

Still more wonders abound. The museum property is adjacent to a house-sized hole lined with stones that Lenhoff explained was the basement of a general store, one of many stone basements found all over the remains of Cherokee. The town well sits on the other side of an overgrown field where a Catholic church

once stood before it was moved piece by piece to Durham, and eventually burned down.

Until the last few years, Lenhoff and

a group of present-day Cherokee residents held large celebrations twice annually to celebrate Cherokee’s history and the small community living there today. These functions— on the Fourth of July and Hayes Day, which would fall on the weekend closest to Sept.

24—were well-known locally, attracting hundreds of visitors and raising money for the Cherokee Volunteer Fire Department.

Though no large gathering is planned for Hayes Day this year, Lenhoff is preparing a special museum exhibit and the museum will be open the previous weekend, on Sept. 21 and 22.

“We haven’t had the celebrations in three or four years now, because some of the people who helped organize them have moved out of the area or simply wore themselves out,” Lenhoff said. “It takes a lot of organizing, and is hard to keep going.”

Lenhoff’s wife, and main ally in the ongoing struggle to preserve what’s left of Cherokee, passed away in 2008. He sidesteps discussion concerning who will carry Cherokee’s torch in the future, but said he believes that, when the time comes, someone will (“We cross these bridges as we come to them,” he said).

Lenhoff remains a dedicated steward of Cherokee’s history. He challenges claims that the mine had an adverse effect on the environment, noting the lack of contaminants

used in hydraulicking and pointing to the positive legacy it left.

“The quartz and gravel that went down through the Eureka Tunnel emptied out into the Mesilla Valley, where they’re still making millions of dollars today mining it for quartz sand and gravel,” he explained. “All the mud that was left over created 25,000 acres of fertilized land where it was once worthless hardpan, enabling all those beautiful orchards and rice fields south of Chico that are still employing and feeding people today.”

He further noted the water infrastructure and mountain reservoirs are also still in use, providing power and water for rural North State residents, as well as beautiful recreation areas.

“You have to put it all in perspective,” he continued. “Mother Nature has a way of balancing herself out, and of reclaiming these things very quickly. So you might say, ‘This or that happened over there,’ but you go to these places and they’re completely covered by vegetation.”

In Cherokee’s case, Lenhoff intends to preserve what remains as long as possible. When asked why he cares so deeply about history and preservation, he offered, “It broadens our own life view. If we didn’t know anything about the things around us and the past, then we’d have a very limited view of what life is all about.

“By preserving some of these things, it expands our own little lifetime into something much broader and more meaningful.” Ω July 18, 2013

“I watched my dad for a long time not knowing I was absorbing it,” said Finnigan. But once he committed himself to the music business, his dad said that he was “actually crazy enough to fuckin’ do this. Any creative job is like walking a tightrope.

But Dad is all for it. I’ve gotten tips from him and I ask questions.”

The Monophonics’ funky sound is reminiscent of a bad-ass score from an episode of Kojak or a cool, early-’70s Blaxploitation film, and there’s a psychedelic presence as well that makes the band stand out in both funk and jam-band circles. tom end; a funkified trumpet and saxophone add a stirring, Tower of Power vibe; and McDonald’s soulful guitar leads and Finnigan’s dynamic keyboard and vocals complete the picture.

Monophonics was actually a mostly instrumental group before Finnigan joined the fray.

“It was a very organic process,” Finnigan said. “I joined as a sub. I did some recording projects with some of the guys. They said, ‘We know this guy who plays keys and sings a little bit, and we need a sub.’

And we all hit it off and there was like an unspoken feeling that ‘He’s in.’And I wanted to be in.”

While the members of Monophonics have an obvious reverence for old-school funksters like Sly Stone, George Clinton and Dennis Coffey, they aren’t simply trying to recreate the past.

“We all play vintage instruments in the studio and live,” Finnigan said, “but we’re not a revue or throwback. I think our formula is familiar and comforting, but it’s not ‘older.’ It’s just music that was also popular at an older time.”

In addition to its originals, the band does take on some of that old, popular music as well, reconstituting classics from groups like Sly & the Family Stone (“There’s A Riot Goin’ On”) and War (“Slippin’ Into Darkness), as well as delivering a better-than-theoriginal take on Cher’s 1966 hit “Bang Bang (My Baby Shot Me Down).”

After three visits in three years to Chico’s Lost on Main, the band has built a devoted local following, and Finnigan says they’ve also gotten to know Chico a little bit. “It’s a good place. It’s got a good vibe and it shows a lot of love, and not just because of the college,” he said.

Playing at a bigger venue this time around, in what likely will be a sold-out Big Room, the band is sure to feel even more love than usual. “The crowd, when they are moving and dancing, we feel that,” Finnigan said. “If we give it and they take it and give it back, it’s like a circle of love.” Ω

ney lifted the lid off each one and explained what it was. Most side and vegetable dishes are $3-5. Entrees run around $10 and include a large side of rice with beans and/or vegetables. Drinks include iced tea, ginger beer, fresh vegetable and fruit juices, and smoothies.

On our first visit, they were offering a limited menu—just four or five side dishes—as Journey was working in Chico that day at the Wildflower Music Festival, a fundraiser for the Wildflower Open Classroom charter school. I had curry tofu with onions and quartered slices of corn on the cob, and sautéed cabbage, which came with corn, bell peppers, and peas. Colette had sautéed bok choy. We both got rice with beans. All of it was very good, especially with a bit of Jamaican hot sauce sprinkled over the top and stirred in. We also both got the Jamaican hibiscus iced tea, colored a deep, dark crimson that Colette said made it look almost too beautiful to drink. It was sweet and divine, perfect for the heat.

Back for lunch the very next day, we were surprised to see jerk chicken in one of the warming trays at the “vegetarian and seafood” restaurant. I couldn’t resist. And it was incredible, and also messy—the three pieces marinated instead of dry-rubbed (the two classic ways to prepare it)—earning a five-napkin rating. In fact, we both agreed that it was best we’d ever had, though not as hot as some. While jerk-recipe ingredients vary, the two consistent ones are allspice and either habanero or Scotch bonnet peppers, and some chefs tend to overdo the peppers. Not Journey.

This was perfect, especially with the hibiscus tea.

Colette had the vegetarian mock fish (made from wheat), which was surprisingly good—the two pieces, in a vegetable stew with broccoli, bell peppers, and green beans, actually looking very much like little salmon steaks.

We also both couldn’t resist ordering the delicious sautéed cabbage again. No question, we will be regulars. Ω Reggae festival Ifa Journey hosts a music festival celebrating the birthday of Rastafarian messiah Haile Selassie, Saturday, July 20, at River Reflections RV Park and Campground on the Feather River in Oroville. Smash the multiplex Finally, a summer blockbuster worth the price of a tub of popcorn

FILE NAME t’s a pretty rare event when I forget that RAPE CRISIS INTERV. & PREV.

II’m reviewing a movie as I watch it. Rare, as in almost never. Pacific Rim is that rarity, a summer

blockbuster that lives up to the hype.

The film grabbed my full attention and held it all the way to the end, from the opening montage detailing the by Craig onset and repercussions of the Kaiju Blamer War to the bonus feature a few minutes into the final credits. Considering I’ve never been much for the giant-robots shtick, that’s saying something. But give me giant flesh-and-blood monsters stomping their way through a

ber monster suits stomping through miniatures of Tokyo.” But here the critters are pretty well-designed and -realized CGI creations.

Personally, I would have been happy with just that, but the movie isn’t just for me. So writer/director and all-around genre junkie Guillermo del Toro (Pan’s Labyrinth, Hellboy) throws in the Jaeger Program, humankind’s first line of defense. The Jaegers are giant robots, each manned by a pair of co-pilots holding hands with their minds, or something like that. It doesn’t really matter. What matters is that once things get rolling—and they get rolling fast— we have giant robots beating up on giant monsters, and vice versa.

major metropolitan area as mankind’s erections collapse and the residents run shrieking “Aiiiiiiiiiieeeeee!” and I’m in popcorn heaven. When it comes to popcorn bait, I’m all for urban renewal in an apocalyptic sort of way.

And in this film, mankind is having a very apocalyptic case of existential erectile dysfunction, as a tunnel has opened up from the Earth’s core and is spitting out all sorts of giant Kaiju that have nothing better to do than pull the spitting high-tension wires down, with a purposeful grimace and a terrible sound, before wading through the buildings toward the center of the city.

There’s a story in there, too, which in itself is getting to be a rarity in the summer-blockbuster template that emphasizes CGI spectacle over narrative, or even visual coherency, for that matter. Not that Pacific Rim is completely blameless in that regard. Once metal fists start pounding on gooey skulls, del Toro defaults to the contemporary pixel stew and acoustic bombast, which for traditionalists like me is a little like sitting too close to the TV. But while it’s loud and noisy, it’s also clever, as a blockbuster ideally should be. It also has more than a few satirical touches, such as setting the world’s prime black market for the giant monsters’ organs in Hong Kong. (I wonder if the Chinese censors are going to catch that one.)

It’s also that rare bird where the 3-D, while not exactly justified, is at least composed with an affinity for the possibilities of the technology. In fact, in a lot of ways, it’s the best-looking 3-D film I’ve encountered. Ω

Super-villain Gru (Steve Carell) turned straight in the original Despicable Me, so what’s left for him to do in round two? Fall in love. He’s also trying to stop an evil-doer who has stolen a chemical that turns any living creature into a killing machine. But the romantic subplot, involving flirtations between Gru and his detective partner Lucy (Kristen Wiig), proves more entertaining than the mediocre storyline about the search for criminal suspect Eduardo (Benjamin Bratt, in exaggerated Latino-stereotype mode). Whatever magic is lost from the original film is recovered by Gru’s tiny minions: His helpers look like aliens but possess the charm of babbling babies—a weird combination that’s onscreen gold (as was proven by the booming laughs from every child in the theater). At the very least, this wildly erratic production deserves a measure of credit for maintaining some kind of oddball comic momentum over the long haul of its mockepic Western-movie action. The story is disposable and inconsequential. Most of the best stuff in the film is bizarre action, exuberant grotesquerie, cartoonish sight-gags and stunts, FX action involving vintage trains, etc. Johnny Depp plays Tonto here, and with his dead-bird headgear and assorted mystical and mythical trappings, his can seem like a rather Hunter S. Thompsonized version of the character. But in his most elaborate action scenes, he seems to be channeling the deadpan stunts and intrepid spirit of Buster Keaton. Revisionist farce shows a less pungent side with the film’s Lone Ranger (Armie Hammer), a neurotic and somewhat narcissistic do-gooder who is little more than a mock-heroic accessory for the action sequences. Monsters University

World War Z is a barely capable thriller in zombie drag, with shaky-cam and muddy editing to keep you confused when the shit hits the fan. Brad Pitt plays a retired UN spook who reluctantly re-ups to do something about all the damned zombies. He does so in a handful of noisy set-pieces loosely linked together to serve as story, but those pieces are just variations of “Shit!

Someone just made a noise and here come the zombies! Run!” And here the infected come a-runnin’, as director Marc Forster emphasizes the swarming aspect of insects or even the disease itself. It’s a neat approach, one that aims for adrenaline over dread. There’s not much in the way of suspense, because that would slow down the action. Cinemark 14 and Feather River Cinemas. A kid named Ellis (Tye Sheridan) and his pal Neckbone (Jacob Lofland) go prowling for a boat wedged in the treetops of a wilderness island and cross paths there

White House Down

The very least you can say about director Roland Emmerich’s latest is that no matter how goofy it gets (and it gets pretty goofy), it’s still remarkably coherent. It’s also remarkably entertaining. Channing Tatum plays a D.C. cop who shows up at the White House for an interview with the Secret Service. A job protecting the POTUS (Jamie Foxx) ostensibly will redeem him in his disappointed daughter’s eyes, but the interview doesn’t go that well. Soon enough, peckerwood terrorists blow up the Capitol as a diversion to storm the White House and grab the president, and Tatum’s character is suddenly given a second interview … this time with the president himself. The script is clever and the banter is witty. Sure, it’s big, dumb fun—but it’s clever big, dumb fun. Cinemark 14. Rated PG-13 —C.B.

David noted that his father had a passing interest in history even earlier. John was a third-generation resident of Butte County, and both of his grandparents had come to the area in the 1850s. Since childhood, he’d relished time spent at the family farm—the Bell Ranch west of Chico for which Bell Road is named— listening to family members’ recollections of the old days. But from the late 1940s until his death in 2006, John’s life’s mission was collecting history.

The elder Nopel invested in a good camera and a copy stand, and cultivated contacts who would bring him their family photo collections to be duplicated. As his efforts evolved, he further sought out original, card-mounted photos and other artifacts. By the early 1950s, he’d started transferring the copies and original photos to slides and sharing them publicly.

packing up his slides and a carousel projector and heading out,” his son recalled. “He’d go to a lot of schools, clubs, social organizations and various historical societies. The schools were always particularly important to him, because of his background as an educator working in public schools.”

Today the younger Nopel, a historian in his own right who has penned several articles on history and last year co-authored a book (with Marti Leicester) called The Humboldt Wagon Road—the text accompanied by pictures from his father’s collection—manages what is now known as the John Nopel Collection.

Several hundred photos—which David said represent a mere fraction of the entire collection—have been digitized at Chico State and are available online through the school’s Special Collections department in Meriam Library. Several dozen more have been prepared and installed at the Chico Museum for an exhibit titled Chico in Black and White: Historical Photos from the John Nopel Collection, which opens to the public this Saturday, July 20.

David worked with a team from the Far West Heritage Association—which operates the Chico Museum—to compile several dozen photographs representing a visual reflection of this area’s past. The photographs in the display were carefully restored by local photographer Gary Quiring.

Dianne Donoho, a steering-committee member at the museum who is co-curating the event with David, said the display marks a change of course for the museum.

“We used to do kind of random exhibits on different subjects but have decided to dedicate ourselves to focusing more on the history of the town,” she said, explaining that, moving forward, the bulk of the museum will be dedicated to a permanent historical exhibit with smaller, rotating displays that feed into it.

For his part, David said he couldn’t be happier with the opportunity to share his father’s life work: “It is very pleasing and satisfying to see the focus and spotlight and honor it will bring to my dad—and really my mom, too—because they were such a partnership [and] I don’t think he would have achieved what he did without her support.

“This is his legacy,” he said. “It’s a pretty nifty accomplishment for someone to have Ω their work outlive them.

From the first notes of the soul-drenched title track—you do know that you’re in good hands. Frank Bey, a powerhouse vocalist, hits you right between the eyes with a series of tough questions about being in love and smitten with one’s object of desire, and then answers his questions by affirming that “You don’t know nothing about love.” Tough! At 17, Bey joined the Otis Redding Revue where he worked as the opening act—and Redding’s influence is unmistakable. He’s backed on this 10-song CD (recorded last July at San Francisco’s Biscuits & Blues club) by guitarist Anthony Paule and a top-notch sextet composed of Bay Area blues veterans. Paule’s own “Can’t Get the Time of Day,” a bouncy blues, looks at the other end of the love spectrum: He can’t even get the time of day from her. Bey, who dropped out of music during the 1980s and ’90s, imbues Ray Charles’ “Hard Times” with an immense feeling obviously informed by his own hard times. Paule dazzles on every track, especially on the up-tempo “Get Your Money Where You Spend Your Time” (another love-gone-wrong song) and his solo feature, “Town Without Pity.” At eight minutes, Bey’s reading of John Lennon’s “Imagine” is the disc’s standout track. Highly recommended!

Alfred A. Knopf Several years ago, my brother sent me a copy of John Banville’s The Sea, which won the prestigious Man Booker prize in 2005. I was impressed by its richness of observation and Nabokovian prose, but the plot wasn’t strong enough to keep me reading. That’s no problem with this novel, Banville’s 16th, which offers several vivid plot lines, most prominently that of the narrator’s remembered affair with his best friend’s mother, when he was 15 and she was 35. Steve Swallow Quintet ECM Records Bass players generally draw less attention from audiences than that granted to lead guitarists. In the jazz realm, bassists seldom get the spotlight reserved for trumpet and sax guys. But Steve Swallow has been making jazz fans sit up and take notice of the bass since 1960, the year he first met Carla Bley. Bley, as jazz fans know, is an esteemed keyboardist who has recorded with Swallow since 1978. You can hear the benefits of their long association on Into the Woodwork, a 12-song set of Swallow compositions that features Bley on organ, Chris Cheek on tenor sax, Steve Cardenas on guitar and Jorge Rossy on drums. All the players shine here on songs that feature some fine post-bop grooves and evoke pathos, and even some humor. There’s a little experimentation going on, but with a bassist like Swallow at the helm, the ensemble never loses its groove. From his days with the legendary horn player Eric Dolphy right down to this current recording, Swallow continues to command the kind of attention often denied to those unsung heroes of the rhythm section.

Chicoans are in an uproar, understandably, over the city’s decision to shorten the hours at one of Bidwell Park’s most beloved spots, Caper Acres. A number of volunteer efforts are currently in the works, and kudos to local acoustic trio Rose O’Brien for organizing the first of what may be many benefits to come, slated for Thursday, July 18, at Cafe Flo. Rose O’Brien will play what they call an “eclectic repertoire of folk, rock, pop and jazz.”

The show is $3 and proceeds will be given to the Bidwell Park Foundation, earmarked for Caper Acres.

Arts DEVO. I know, I’m as surprised as anyone about my recent “hippiefication.” But ever since Mrs. DEVO and I bought a house a year ago and started taking care of the yard and planted our first-ever garden, I’ve been barefoot outside more than I ever had before. I think about plants and weeds and dirt and water and worms and bees nearly every day. Just standing in the garden gets my happy juices flowing as much as running, or playing music, or drinking happy juice. Now, a day without getting my hands dirty is an incomplete day.

The only negative with this whole new development is that it’s taken me so damn long to figure it out! It’s not too much of an exaggeration to say that, for nearly my entire life, I have never paid attention to things growing. Which is a really sad realization to come to. As a kid, That’s a foot-long rattlesnake … watermelon.

I never worked in the yard (unless I was being punished with weed-pulling), and as an adult I’ve always lived in rentals where I either contributed to the neglect of the property or watched with relief as the landlord’s landscapers did the sweating.

In the last year, though, I’ve sweated plenty—pulling weeds, destroying Japanese privet trees (with prejudice), and planting and then staying out of the way as my garden burst into the air and toward the sun.

The jasmine, daylilies, geraniums, hydrangeas and autumn sage have been blooming for a while, but it’s the fruit-and-vegetable garden with which I’ve been most engaged, and the much-anticipated heirloom tomatoes, melons, cucumbers and peppers are just coming to fruition.

Whatever gardening successes I’ve had have been thanks in large part to many helpful YouTubing gardeners and to the wonderful trio of Trish, Kerra and DeAndra at Magnolia Gift & Garden (1367 East Ave.).

This hip oasis on the east side of town has been my go-to shop for plants and advice, and the three chill nursery assistants have helped me choose what to grow and patiently schooled me on the basics of how to keep things alive. If you want friendly nononsense expert help (and rad stuff for your yard and garden), Magnolia is AD’s recommendation.

Now, if you’ll excuse me, I have some leaning and loafing to get to.

How did you get interested in bodybuilding?

I broke my hand, and I had to have surgery. I was riding my bicycle to class on campus, and I got hit by an SUV. It was a high-impact collision. I was unable to work out after that, and I had worked out my whole life. After getting my cast off, I saw how small my arm was, and how much it had atrophied, and I thought, “I’ve got to get back [in the gym].”

What are the challenges of being a bodybuilder?

Doing it naturally. I’m competing against guys who are on steroids, and I’ve made a conscious decision that I’m just not going to do that, so I have to work that much harder. I eat every two hours. My nutrition regimen is very precise. My workout routine has to be on point every day. It’s a lifestyle that I’ve embraced.

It was like a whirlwind. As soon as I won the competition, there were three magazine photo shoots the next day. I got offered sponsorships from different supplement companies, and I’ve really had to pick and choose what I wanted to make out of my professional status.

What are your goals now?

I’m developing some all-natural supplements.

I’ve already ordered the raw ingredients and the formula’s all established. I just have to put it all together and get the labels printed out and everything. The supplement line is called HPTech [health-power technology]. I’ll be competing [at a pro competition] in September. I’m going to win that show, and I’m going to qualify for [Olympia], and then I’m going to win the [Olympia]! I’ll keep at it until I win.
