Civil rights for all This week, the U.S. Supreme Court heard oral arguments on

meaningful reforms that will create real jobs and real opportunities in our local communities. My No. 1 priority as a legislator is to find a way to get people back to work.

One of the simplest ways to encourage business activity and investment is for the Legislature to act on the governor’s recent call to reform the California Environmental Quality Act. CEQA is a state law that requires state and local agencies, including counties, cities and by schools, to identify and reduce the enviBrian Dahle ronmental impact of building projects.

blocking transportation and public infrastructure projects and shutting down development.

In addition to CEQA reform, we must also address the way our state agencies manage and implement regulations. Our agencies are disorganized, ineffective, and frustrating for business owners and private citizens alike.

In recent weeks, some of California’s public employee unions have joined environmental groups in a coalition that has voiced opposition to real CEQA reform. I believe those labor unions should be at the table, looking for ways to get more projects permitted and more people on the job. The environmental community should insist on integrity in the CEQA process in order to maintain credibility when they advocate for real environmental protection.

Public employee unions need to understand that their salaries and retirement benefits are funded by private-sector enterprise, and the private sector in California is still overregulated, overtaxed, and burdened by abuses of the CEQA process.

In Sacramento, I will support any and all efforts to make state and local agencies more responsible and responsive to the people they serve. I hope the governor and the majority party will follow through and bring CEQA reform to the forefront in this session of the Legislature. Ω

two of the most significant civil-rights cases in years. One is focused on whether California’s law banning same-sex marriages is constitutional, while the other asks the same question of the federal Defense of Marriage Act, passed in 1996.

This comes at a time when attitudes toward marriage equality are liberalizing dramatically. A recent ABC News poll shows that 58 percent of Americans now support the freedom of same-sex couples to marry. The poll also shows that, by 64 percent to 33 percent, Americans believe the issue should be decided nationwide under the Constitution, not in the patchwork, state-by-state form that confronts couples today.

The California case, Hollingsworth vs. Perry, is a review of a 9th Circuit Court of Appeals ruling overturning Proposition 8, the 2008 initiative prohibiting same-sex marriage, on the basis that it is unconstitutional. The DOMA case, U.S. vs. Windsor, challenges a law that prohibits myriad federal benefits from going to gay couples, even if they’re legally married.

Kristin Perry is the name of a lesbian woman who lives with her partner in Berkeley, where they have reared four children. They were denied a marriage license in 2009 because of Proposition 8. Edith Windsor is a computer programmer who moved in with her partner in 1967 and finally married her in 2007, in Canada. When her wife died in 2009, the DOMA prohibited Windsor from receiving married estate-tax advantages, and she had to pay $363,053 in estate taxes.

Early indications are that Justice Anthony Kennedy will make the swing vote. Although he’s generally conservative, he’s written several notable opinions upholding gay rights. It’s easy to picture him supporting the appeals court’s determination that Proposition 8 is unconstitutional.

The bigger issue is whether the justices will take the more expansive view and consider these cases in terms of the U.S. Constitution, as most Americans prefer. By deciding this issue once and for all and voting that discrimination against homosexuals is unconstitutional, the court could claim a place in history as the final guarantor of equality under the law to all Americans. Ω

California’s oily deal Alaska produces a lot of oil—and is well paid for doing so, as it

charges a fee of 24 percent on all oil and natural gas extracted from the state. Other oil-producing states charge comparable extraction fees. But not California. It’s the only state in the nation that gives away its oil and natural gas for free.

And it does this at a time when its schools are ranked near the bottom in per-pupil funding, its infrastructure is in shambles, its colleges and universities are absorbing huge funding cuts, and tuition is skyrocketing.

Enter students at UC Berkeley, who, functioning as Californians for Responsible Economic Development, have drafted the California Modernization and Economic Development Act, or CMED. They will be attempting to raise $1.3 million in order to collect the 505,000 valid signatures to qualify it by July.

The act will generate between $2 billion and $2.5 billion annually from the implementation of a 9.5 percent extraction fee on oil and natural gas.

About half—$1.2 billion—will go to education, from K-12 through the UC system. The rest will go for a variety of good purposes, from helping small businesses to go green to bolstering counties’ general funds so they can build more bike lanes, pave over potholes and conserve regional park lands.

One of CMED’s many backers is Robert Reich, Berkeley professor and former U.S. secretary of labor. “Using a tax on oil extracted from under California to help finance the education of Californians should be a nobrainer,” he has said. “It won’t affect fuel prices. It will only improve our schools. The real question is why California hasn’t done this long before now.” Ω

Cover story: two views Re: “Searching for snipes� (Cover story, by Don Regis-Bilar, March 21): About one month ago, I met Don as he was palling around with CN&R News Editor Tom Gascoyne. Introductions were made, greetings exchanged and the two of them went on their way. My initial impression of Don was that he was an at-ease fellow, intelligent, soft spoken and casually dressed. Yet, I suspected there was more to know about him than what I was able to initially perceive.

Last Thursday I picked up your latest edition and, like most people, immediately scanned the front page to see the lead story.

To my surprise there was Don. I got into my car and immediately read the article. And when I finished I read it again.

I knew I had missed something upon my first encounter with Don. He is a very talented writer. The piece he authored is insightful, moving and compelling. I had no idea Don has struggled as he has described. But I have no doubt he will recover. Maybe his writing abilities will be a key component of his recovery. Don entrusted me with a draft of this article back in January. He wanted my feedback, which I gave. He thanked me. An hour later he said, “You were trying to tell me it was a little timid.� “Indeed, Don, timid is an excellent oneword description.�

Don went on to describe his abuse at the hands of both parents and his personal difficulties as a child, young man and into adulthood. It was wrenching. I interjected, “That’s not timid, Don; that’s the honesty that will make the piece shine.�

I ran into Don at the City Plaza the day “Searching for snipes� hit the streets. He was so happy to see me and have a true friend to talk to. “I’m surprised how stressed out I am about the article,� he said.

We had lunch, and we talked and shared our friendship. I asked Don how many of the homeless in Chico have serious mental illness. “Oh gosh, at least 50 percent.� I concurred.

As we went our separate ways, Don said, “I’m so glad I met you today, Bill. Talking to you was exactly what I needed. I feel so much better now.� I replied, “I’m proud of you Don.�

It was heartening to see Butte County supervisors’ unanimous support, following a public hearing Tuesday (March 26), of the Museum of Northern California Art’s (monca’s) proposal to locate in the former Veterans Memorial Hall on The Esplanade.

Granted, it was a no-brainer—the building is an expensive white elephant, and nobody else wanted to use it— but the recent push-back from some neighbors created at least a little uncertainty about the final vote.

The neighbors were worried about traffic and congestion and the further degradation of the area (and their property values), and I understand that. An influx of student renters, traffic around Chico High (try dropping off a kid there at 8 a.m.) and more cars on the roads generally add up to greater stress on these older neighborhoods.

And it’s true that the vets’ hall lacks parking of its own, which means monca visitors will park on neighboring streets. But, again, if the hall is to be used for anything, what better use than an art museum? The traffic it will generate will be minor compared with that generated by, say, the high school or, just down the road, Enloe Hospital.

I like what Lee Laney, who lives on Lincoln Avenue across from Chico High, says in a letter to the editor that unfortunately arrived at the CN&R too late to publish. “I love living in downtown Chico‌,â€? he writes. “One of the trade-offs of being close to downtown is living with the hustle and bustle of daily life in the midst of community institutions. At times there are parking and congestion problems. We also hear noisy ball games, marching band practice, and late-night busloads of students returning from out-of-town events. “These are the sounds of my fellow community members utilizing and enjoying a very important community institution. As a citizen, I accept this burden willingly. ‌ Communities and neighborhoods thrive when community institutions are an integral part of the fabric of daily life.

What more benign use could be made of the veterans’ hall? Would [the opponents] have the building torn down to save themselves the burden of living in close proximity to a community institution?�

What makes this decision so important is that monca, although lacking a facility, already has the makings of a rich permanent collection, in the form of the more than 400 pieces by Northern California artists donated by Chico collector Reed Applegate.

Now the real work begins. Under the terms of the 20-year lease agreement, monca will have six relatively rent-free years to design, construct and implement the project. It won’t be cheap, and it won’t be easy. Monca’s directors will need all the help they can get, financial and otherwise.

Chico has never had an art museum, so it may be hard for some people to foresee the benefits monca will bring. I’m confident, though, that 10 years from now, when we’ve become accustomed to the museum’s many offerings, we’ll look back on this moment and realize the Board of Supervisors made an invaluable and historic decision.

Grand jury challenged Re “Rogues’ gallery” (From This Corner, by Robert Speer, March 21): Sharing Robert Speer’s ongoing frustration with state Sen. Jim Nielsen’s misrepresentation of his actual permanent residence, I submitted a formal Butte County Grand Jury complaint on this issue on Oct. 10, 2012.

My intent was to suggest that Butte County Clerk-Recorder Candace Grubbs may have been complicit with Tehama County officials in rubber-stamping Nielsen’s misleading residency in his run for the 12-county 4th Senate District (which includes portions of Butte County).

Ms. Grubbs is on record as having said (when Nielsen was a state assemblyman) that, as long as Nielsen owned property in the 2nd Assembly District, he could register to vote and run for office there even if he slept outside the district on most nights. This statement clearly runs counter to California Government Code Section 24001.

My contention to the grand jury stated that there should clearly be some sort of inter-county oversight in place to ensure that a candidate who intends to run for office in a 12-county district does, indeed, permanently reside within one of the counties in that district.

I sincerely hope the grand jury acts on this concern. We’ll see when its final report sees the light of day on July 1.

The story’s other side Re “It’s union vs. union” (Newslines, by Ken Smith, March 14): BCEA represents the largest group of employees working for Butte County. While we are preparing for negotiations on a new contract, and others are still negotiating on last year’s contract, you have attempted to show management that their employees are divided and leaderless. You are wrong.

Butte County claims to have money problems and puts the blame and the cure on its employees. The county did not want to have a two-way conversation about their labor costs and benefits. However, BCEA continues to meet and confer and was able to make a rotten deal less rotten.

Getting a bad deal is not due to employee representation, as UPEC signed off on the same deal for one of its groups and refused to accept it for another. Thus the county forced the deal on them, as allowed by law.

This stinks too Re “Sewage smells” (Newslines,

by Tom Gascoyne, March 21): Sewage is not the only problem with this building. I have contacted the owners of the DownLo on multiple occasions and spoken to their managers regarding their broken lift for persons with disabilities. The DownLo has participated in [the Halloween festivity] Treat Street with no way for persons with disabilities to gain access to their establishment.

The signage on the lift says to use the call button to contact them, but the call button does not work.

The phone numbers the city Finance Department and Downtown Chico Business Association has for them do not work, and they do not have a listed telephone number that is easily obtainable.

Calls to the phone number listed for Lost on Main go unreturned.

If the DownLo is actually as responsible as the city says it is, they will get their lift fixed and stop offering to carry disabled persons down the stairs to their facility. And as far as the University Bar goes, they may have an operational elevator, but they have no way to contact anyone to use it.

The current average nominal interest rate paid on savings is 0.2 percent per year, while the most recent inflation rate (CPI-U) is 2.0 percent. Thus the inflation rate is 10 times as high as the relevant interest rate, meaning that money held in savings accounts increasingly loses value. The real interest rate is -1.8 percent per year.

Also, banks and credit unions lend the br money to those who want to spend more than they have, whichice puts it into the economy. So the money CN gets used until the saver needs it to spend himself or herfo self. ART MUSEUM GETS APPROVAL

Veterans and art lovers trumped neighbors’ concerns at the Butte County Board of Supervisors meeting Tuesday (March 26), when the board voted unanimously to lease space inside Chico’s Veterans Memorial Hall as an art museum. The Museum of Northern California Art (monca) has been a traveling road show of pop-up temporary galleries. The vets’ hall is owned by the county and was vacated in 2005.

Some neighbors fear monca’s presence will impact traffic and parking. The museum will occupy 4,000 square feet of the 18,000square-foot building, and its nine parking spaces meet Chico Municipal Code requirements. The museum has agreed to display and maintain veterans’ memorabilia that is not currently available for public view.

Supervisor Larry Wahl, a Navy vet, made the motion to allow the use. “I think the parking and traffic problems are really overstated,” he said.

For the second time this year, the Butte County District Attorney’s Office has dropped charges against a medical-marijuana dispensary owner.

On March 26 the DA vacated charges against Jeff Sanford, who operated a dispensary in San Diego. He was arrested in October 2011 after testifying on behalf of dispensary member Timothy Skytte, who’d been arrested locally for marijuana cultivation.

Last month the DA dropped charges against Rick Tognoli, who operated a Butte County dispensary that was raided in 2010.

That decision was made after the 4th District Court of Appeals reversed the conviction of Jovan Jackson, whose San Diego dispensary was raided in 2008.

Butte County District Attorney Mike Ramsey has said the ruling “makes it almost impossible to prosecute dispensaries that are disguised as collectives and making supposedly no profit.”

FORMER CHICO STATE PRESIDENT DIES

Stanford Cazier, who was president of Chico State during one of the most turbulent eras in its history, 1971-79, died March 19 in his Logan, Utah, home. He was 82.

As president, Cazier (pictured) had the dubious distinction of hosting the last major campus sit-in in the country, in 1975-76, when around 200 students occupied Kendall Hall, including his office, protesting the arming of campus police.

The sit-in lasted about three weeks, but the start of winter break thinned its ranks and Cazier, who was sympathetic to the protesters, reclaimed his office.

He also was president when Chico State College became a university, and when the student newspaper, the Wildcat, went off campus and became the Chico News & Review, a move he supported. “I won’t have little old ladies calling me to complain about the dirty words in the paper,” he said gratefully.

Cazier, a Mormon born in Utah, left Chico to become president at Utah State University, where he previously had served as assistant provost.

After Chico State President Paul Zingg temporarily suspended all Greek activity last fall in the aftermath of Sigma Pi pledge Mason Sumnicht’s alcohol-related death (see Mark Lore’s cover story on page 18), Bommersbach wrote a letter to the Chico Enterprise-Record. In it she blasted the university administration for “the careless way they address student health and safety” and taking “the easy way out by blaming Greeks.”

Bommersbach also pointed out the irony of moving the Campus Alcohol and Drug Education (CADEC) program into a smaller office over Labor Day weekend in 2012, just as thousands of possibly intoxicated students took to the Sacramento River for the annual float.

During an interview at her office in the Student Services Center on campus, Bommersbach agreed her decision to publicly criticize her employers was a bold one, but asserted she was motivated by an increasingly stressful situation for her and her colleagues at the Counseling Center. In the summer of 2011, both the center and CADEC were placed under the umbrella of Student Health Services, which runs the Student

Health Center, and stripped of state funding support. Now, all three programs largely rely on money generated by student health fees to stay afloat.

The Counseling Center has been short a counseling position and a true director since the merger, forcing the staff to “get creative” in making time for students, she said. Counselors often will schedule group sessions to ensure they meet with students at least once a week, while the department’s associate director will stay through the lunch hour to serve walk-in patients. Bommersbach maintains the strain has begun to decrease the quality of student mental-health services.

“People have had to pick up more and more work,” she said. “You can’t see too many patients in a day if you want to have quality care. We keep expanding what these six counselors are able to do, and at some point it’s too much.”

Bommersbach said the demand for mental-health services is only increasing on campus, and it’s unclear how much longer student health fees will sustain all three programs.

“Our center has not been supported,” she said.

Chico State has had its state

appropriation budget reduced by $40 million over the past five years, said Drew Calandrella, vice president for student affairs, in an email. Over that same period, the Division of Student Affairs— including the Counseling Center, the

Student Health Center, CADEC and other programs like athletics, the Career Center and Student Judicial Affairs—has had its state funding cut by $2.1 million, a reduction of 25 percent.

Calandrella agreed that in facing such funding cuts, staff across campus have “rightly felt stretched at times to provide the level of service they had in the past.”

At the Student Health Center—the busiest health clinic between Sacramento and Oregon, serving students through roughly 30,000 visits a year—the story has been strikingly similar to that of the Counseling Center. A former health center employee who spoke with the CN&R on condition of anonymity said staff reductions have resulted in physicians and nurses working through their lunch hours, staying well after their shifts have ended and assuming responsibilities not detailed in their job descriptions.

“The result is that waiting times average an hour and can be up to three hours,” the source said. “I would say patient care and quality have declined as a result of our short staffing.”

Like the Counseling Center, the Student Health Center has lacked a chief nursing officer since Denise Fleming resigned from her position in July of last year. (Fleming is the wife of CN&R Editor Robert Speer.)

“When Denise left, [the university] didn’t replace her,” the health center source said. “The job is still open. A lot of qualified people have applied and

been turned down. It gives the impression there isn’t a will to hire a replacement.

“Every time somebody retires from the center, we’re told there’s a hiring freeze, they can’t hire a replacement, or they will replace them but it won’t be for a semester or two.”

Since the retirement of the laboratory director about three years ago, the source said, lab technicians have been administering the service.

And it’s been nearly two years since the Student Health Center’s last director, Kathy Felix, resigned, and her position still has not been filled. In the meantime, Dr. Deborah Stewart—who was hired as medical director to supervise physicians and nurse practitioners—has assumed the role of executive director. The health center source described Stewart as “very qualified and highly trained,” but said she is able to see only “10 or 12 patients a week because of all the administrative duties that have been heaped on her. She is technically the chief of medicine, but she is really serving as director.”

Calandrella said his office is actively in the process of recruiting a replacement for Fleming and is considering several strategies regarding securing long-term revenue sources for the programs under his supervision. Possibilities include implementing a mental-health fee, as several CSU campuses already have done; raising the student health fee from $129 per semester, which would require a student vote; or returning staff and services to state funding as more money is made available.

In the meantime, he insists the current student health fees will provide “sufficient funding for the next two to three years” and that “while mindful of the funding issues, I am not concerned about sustaining these necessary services.”

OSHA gives OK Tests of Butte Hall air show no asbestos

state health report on the environmental health of Chico State’s Butte Hall shows no asbestos fibers were detected during an inspection performed last month. However, there are skeptics on campus who question the conclusions of the one-page report.

The inspection by the California Occupational Safety and Health Administration was conducted as a result of concerns raised last summer about health conditions inside the seven-story building following the lung-cancer-related deaths of two people who had worked in the building. The OSHA case was launched last October based on a complaint.

The agency’s inspection took place on Feb. 5, was completed on March 11, and the case was closed on March 15. During that time OSHA inspector James Craighead took six air samples from different locations in the building, looking for the presence of asbestos.

His single-page report says: “An inspection was done to determine if university employees were being exposed to asbestos fibers in Butte Hall while daily working in the building.”

It goes on to say, “It has been determined that no violations of any standard, rule, order or regulation set forth in Title 8, California Code of Regulations, and Division 5 of the California Labor Code has been found as a result of this inspection.”

It concludes: “This notice relates solely and exclusively to the inspection on the above date, which was not necessarily a comprehensive inspection of the worksite.

Due to the transitory nature of worksite conditions, violations can occur occasionally or routinely and may be undetected by any

given inspection. This notice does not preclude the issuance of citations or any future inspection.”

During his Feb. 5 inspection, Craighead said he was initially instructed to take only one sample from the seventh floor, which is where one of the deceased worked. He was talking to Chico State geography professor Mark Stemen, who works on the fifth floor of Butte Hall. Craighead instead took a total of six samples from multiple floors of the building. He also told Stemen that he wanted to use a leaf blower to stir up the ambient air a bit, but was told by his bosses not to do so.

When Butte Hall was constructed in

1972, asbestos fireproofing was sprayed on the building’s steel framework. The following year, the federal government banned asbestos spray for fireproofing. Some who work in Butte Hall have pointed out the many places where holes in ceiling panels have been patched with duct tape, and wondered how well that shields the space below.

The tests by Craighead did not include areas above the ceiling panels. However, in January 2011 that space was tested by a pri-

“The number of students with really elevated anxiety and panic disorders is through the roof,” Bommersbach said.

“Students are feeling the pressure to graduate faster, take more units and save their parents money.”

The health center source agreed that, for many students, the challenges college presents can be overwhelming and that “20 years ago, I didn’t see nearly this much anxiety and depression.

“You detach from the parental home, get used to doing your own laundry, cooking and shopping,” the source said.

“You decide who you’re going to be and who your life partner is. You manage your finances and take on a heavy debt burden. This is a hugely stressful time in a person’s life, and we’re not supporting them with health resources.” Ω

vate company and asbestos was not detected.

The outspoken Stemen remains skeptical about the building’s safety based on the OSHA testing.

“They put those air monitors out into locked rooms for four hours and did not encounter an asbestos particle,” he said. “[Craighead] wanted to stir up the dust with a leaf blower to see if anything had settled, and he was told not to by his boss.”

Stemen also questions how well the ceiling tiles screen out possible asbestos fibers from the office spaces below. He says the fireproofing is breaking off, but concerned employees were told not to worry because the material is not breaking down into fibers that could be inhaled.

He said he thinks the administration is, in the cliché of the day, kicking the can down the road by not fully and aggressively addressing the situation. He has a large “Danger Asbestos” sign on his office door.

“The university wants to use this report to say, ‘Everything is fine. Go back to sleep.’

What they have to do is come clean and admit they have a problem. In two or three years, when the tape falls off and the tiles crack, no one’s going to think to look and have them replaced. The building should be monitored, but [the administration] won’t admit it has a problem.”

Joe Wills, the university’s director of public affairs, said while there’s not much to the final report, he did find it “reassuring to get the results from OSHA.” “We had dust samples tested in the fall and then another test looking for allergens and other things that can make air quality low,” he said. “There is naturally occurring asbestos, and it can be detected in any building or outside because it is in the environment.”

Wills referred further questions to Marvin Pratt, the university’s director of environmental health and safety. Pratt said there is no more monitoring planned other than during construction projects that may disturb asbestos. And in fact one of Butte Hall’s elevators is slated for replacement this summer.

Pratt said the fireproofing is falling off but not breaking down into fibers and that the duct-tape-repaired ceiling tiles provide adequate protection.

“Even before the ceiling tiles were repaired, the air testing we did in there showed there were no airborne asbestos fibers,” he said. “The sealing was done just as a precautionary measure to assure that we are being as safe and diligent as possible for the employees.”

Sobering up the holiday Campus leads effort to honor César Chávez respectfully ésar Chávez Day in Chico has Calcohol-soaked been co-opted for some time by college students

donning sombreros, serapes and fake mustaches while bar hopping and walking to house parties. This year Chico State and community residents are working to counter such antics they say dishonors the man who fought for farm workers’ rights.

To combat such behavior, an “Action Rally” was held at Chico State March 26 in advance of the March 31 holiday. Organized by the university’s Cross-Cultural Leadership Center, the three-hour event in the Trinity Commons area featured about a dozen organizers and student speakers, Latino music, and educational booths.

Students wore custom T-shirts and held signs that said, “César Chávez never wore a mustache or a sombrero” and “César Chávez Day is not Halloween.”

“Chico State is one of the few campuses that disrespects César Chávez Day,” said speaker Juan Guzman, 21, president of Chico State’s Chicano club, Movimiento Estudiantil Chicano de Aztlán (MEChA).

Chávez is honored for his role as a union organizer and advocate for farm workers, and is celebrated in California, Colorado and Texas with a state holiday. Before Chávez co-founded the United Farm Workers (UFW) union in the early 1960s, laborers worked long, grueling days in the sun without breaks, access to clean drinking water, or hand-washing stations.

Chávez used fasting, nonviolent demonstrations, and UFW strikes to help gain improved conditions and health benefits for the farm workers and their families. He died 20 years ago next month at the age of 66. The following year, in 1994, he was awarded posthumously with the Presidential Medal of Freedom by President Bill Clinton.

event, Associated Students President Jaypinderpal Virdee spoke to the students watching and passing by.

“Stop disrespecting the holiday,” said Virdee, a senior communications major. “Californians don’t get drunk on Presidents’ Day or Martin Luther King Day, so why is it OK on César Chávez Day?” Virdee said he couldn’t remember when the celebration began getting out of hand, but recalled how the now-closed Normal St. Bar would put up colorful posters and run full-page ads in The Synthesis advertising César Chávez costume contests and drink specials for those wearing a sombrero.

Virdee said students should instead take part in the annual Cats in the Community day of service and celebrate the holiday by volunteering their labor at places such as Bidwell Park, the Jesus Center, and the Newman Center. That event will be held Monday, April 1, from 9 a.m. to 2 p.m., when the university is closed in honor of Chávez.

Chico State President Paul Zingg said he strongly supports Cats in the Community.

“I am very proud of these students and impressed with their energy and commitment,” he wrote in an email. “I look forward to joining them on Monday for this day of service.”

Guzman, a senior studying criminal justice, said on Sunday, March 31, MEChA will help organize the annual César Chávez Day march through town to raise public awareness. That event will start at 3 p.m. on campus at the Student Services Center plaza and head through the intersection at Fifth and Ivy streets, ending up at the Chico City Plaza. There, speakers will talk about Chávez’s work and the importance of celebrating the holiday in appropriate ways.

Guzman said earlier in the month MEChA conducted its annual “Teach-Outs” to educate local K-12 students on the achievements of Chávez and the UFW. —VIC CANTU

Cleaning up Chico Council addresses homeless transiency

D

espite some frustration on the part of community members who filled Chico City Council chambers to overflowing, the council’s special workshop Tuesday (March 26) on the problems associated with homeless transients was remarkably successful.

Some of the success is due to the ad-hoc group Clean and Safe Chico, which has been working for six months to come up with new programs to tackle the problems. As outlined

by Chamber of Commerce President and CEO Katie Simmons, these include a “generosity campaign” urging people not to give to panhandlers, but rather to the service agencies that help the homeless; a “goodwill ambassadors” program that posts trained volunteers downtown to provide information and help when needed; and a “Street Pastors” program sponsored by the Jesus Center that has local pastors ministering—but not preaching—to downtown denizens during latenight hours.

Another active group is the Greater Chico Homeless Task Force, whose chairwoman is Jennifer Haffner, managing attorney at Legal Services of Northern California. Haffner listed her group’s goals, which included creating an alternative shelter with as few barriers as possible; creating day centers for the homeless, so they have somewhere to go other than City Plaza; fostering greater collaboration between law enforcement, Behavioral Health and social-service providers; and supporting the development of transitional housing.

But it was discussion of the public safety aspects of the problem that were most telling. As Police Chief Kirk Trostle told the council, there are many ordinances on the books that, if enforced, could be effective in controlling some of the worst behavior of homeless transients. Enforcement, he added, “is entirely dependent on staffing.”

One suggestion from Clean and Safe Chico was that at least three officers on foot or bicycle be posted downtown. Should we pull in three school-resource officers? Trostle asked. They’re the only ones available without pulling officers from their patrol beats.

Contributing to the problem is the fact that the south campus area requires a much larger response than other areas of town. On Thursday through Friday night, a single

police beat there needs up to seven officers, while other beats in town have only one officer patrolling them.

“If we didn’t have to commit seven officers to Beat 2,” Trostle said, “we’d have the resources we need.”

Trostle also mentioned that adoption of a “sit/lie” or “move-along” ordinance would be helpful, and Councilmen Sean Morgan and Mark Sorensen both wanted to authorize City Attorney Lori Barker to look into it.

But Councilman Randall Stone and Councilwoman Tami Ritter were dubious. “I find it very hard to subrogate a citizen’s right to sit down in a park,” Stone said. And Ritter argued that “laws that punish homeless people are not going to be effective.”

Noting that a “sit/lie” ordinance would target people “who have no other place to sit or lie,” she said it likely would draw a lawsuit.

Ultimately, the council voted, 4-2, with Ritter and Stone dissenting and Scott Gruendl absent, to have Barker gather background information on such an ordinance. It also voted, 6-0, to direct Barker to prepare a “social hosting” ordinance that would hold sponsors of parties responsible for partygoers’ behavior. And it voted, 4-2, with Stone and Sorensen dissenting, to have her look into exacting fees from bars and liquor stores.

Some discord developed about an hour into the workshop when Mayor Mary Goloff announced that members of the public would be limited to one minute speaking instead of the usual three. It was necessary, she said, in order to complete the workshop in time.

Some people booed. Others didn’t like it when Goloff told them, several times, not to applaud speakers’ comments. “If you want the homeless to follow the rules,” she said, “you need to follow the rules, too.”

Drastically cutting automobile emissions and fuel use in the next 40 years will be “extremely challenging,” a federal report finds.

In 2010, Congress commissioned the National Research Council to compile a report analyzing the practicality of reducing gasoline use and greenhouse-gas emissions in cars and light trucks by 80 percent by 2050, according to The Daily Climate. The council found that even meeting the goal halfway—cutting fuel use in half by 2030—would be “very difficult.”

Of particular concern was the cost of transitioning from conventional vehicles—the report noted that while manufacturing hybrid electric and fuel-cell vehicles will be less expensive by 2050, battery electric and plug-in hybrids will still be more expensive than conventional automobiles.

“Such a transition will be costly and require several decades,” said Douglas M. Chapin, chairman of the committee that produced the report.

DELTA PLAN LACKS SPECIFICS

The recently released draft for the Bay Delta Conservation Plan proposal underscores that much is uncertain about the $23 billion project.

The 1,000-page draft does not include guarantees for future water-supply deliveries or estimates for how much water the SacramentoSan Joaquin Delta can spare, according to the Los Angeles Times.

Whether restoring roughly 100,000 acres of the delta’s habitat—which would cost $4 billion—will effectively boost fish and wildlife populations is also unclear. However, proponents argue inaction will guarantee the continued deterioration of the delta. The project would involve two 35-mile tunnels, each about four stories tall, running 150 feet beneath the delta.

State officials released the draft for the project on March 14; compiling a final draft is expected to take more than a year.

BIG MONEY IN FRACKING CALIFORNIA

Development of central California’s oil-rich Monterey shale formation through hydraulic fracturing could boost the state’s economy by 14 percent, a study finds.

The University of Southern California study concluded that tapping the 1,750-square-mile formation would create hundreds of thousands of jobs and generate $4.5 billion in 2015 and $24.6 billion by 2020 in tax revenue, according to the Los Angeles Times.

The U.S. Energy Information Administration estimates the formation contains 15 billion barrels of oil, or 64 percent of the country’s deep-rock oil deposits.

However, the oil can be extracted only through fracking, which involves injecting water laced with hundreds of chemicals and sand into rock formations at high pressure. Environmentalists warn of the possibility of drinking-water contamination and unnatural seismic activity.

Cooking in the classroom Chico schoolchildren benefit from all-volunteer food-and-nutrition program story and photos by

School, all piled into one colorful classroom, squirmed in their seats while Alexander Cilensek—affectionately called Chef Alex—dropped some popcorn kernels into an air popper.

“Did anyone have anything fabulous to eat over the weekend?” asked Kathryn Jackson—“Miss Kathy”—Cilensek’s assistant and the academic coordinator of the cooking duo. Hands flew up; kids were eager to share details of the apples, carrots, oranges, rice and salad they ate at home. “I had salad with pineapple and cucumbers!” announced one enthusiastic girl.

Jackson and Cilensek have been coming every Tuesday to Chapman Elementary since the fall of 2011. Although Cilensek is a participant in First Lady Michelle Obama’s Chefs Move to Schools program, he is not working with school staff to improve cafeteria nutrition. He and Jackson are instead taking their knowledge and enthusiasm directly into the classroom, where they hope to make a big difference

in the children’s lifelong food habits, as well as make the road easier for future chefs to volunteer their time.

“We’re trying to create the concepts of local, organic, sustainable and seasonal,” in addition to teaching about basic nutrition in a way that is accessible to young students, explained Jackson. “It’s a comprehensive ‘food-is-awesome-and-sharingis-awesome’ [program], and [the students] are very receptive to it.”

Children in the classroom that morning waited patiently with bowls of piping-hot popcorn—topped with olive oil and nutritional yeast—until all the students were served. Then they wrote descriptions of the popcorn, using all their senses: how it looked, how it smelled, how it melted in their mouths.

Cilensek and Jackson have developed their curriculum together from scratch, and they pay for virtually all the costs of the program, such as food and supplies, themselves. This includes all the equipment Cilensek allows the children to use to, for example, shake the cream to make butter.

The kids have made “rainbow salads,” veggie wraps, hummus, salsa—small snacks that are manageable to make in the classroom, but are in season and healthful.

The school year culminates every year

in a field trip to Cilensek’s workplace, Tin Roof Bakery, where he is a chef. While there, the children learn food safety, see a pastry chef at work, and check out the industrial-kitchen appliances and the flour, sourdough starters and other ingredients.

“They’ve been very generous [with] donating all kinds of stuff,” said Cilensek of Tin Roof’s owner, Lloyd Stephenson, and General Manager Lisa Whitsett. The cooking duo are hoping that other members of the community will contribute as well, both donation-wise and time-wise.

Cilensek and Jackson got their

start volunteering with Chef Richie Hirshen in Sherwood Montessori school’s wildly successful Garden to Table program. Previously, Hirshen and Cilensek worked together in Sierra Nevada Brewing Co.’s restaurant kitchen, where Hirshen was executive chef and Cilensek was chef de cuisine.

“I just wanted to share my passion of cooking with kids. And to learn about working with kids,” Cilensek said of his original motivation to volunteer. As a young apprentice chef, he had hands-on experiences with cooking and with a chef mentor: “I wanted to take the time for others—someone had taken the time for me.”

Jackson, who has a background in education, began volunteering with Cilensek because she had extra time during a period of unemployment; she now is studying early child development at Butte College, adjusting her school schedule to ensure it won’t interfere with her volunteerism.

“Serendipity was the word of the day,” said Jackson, when a mutual friend brought Hirshen and Cilensek to her home one day in 2011 because she thought they should meet. Inspired, Jackson joined Sherwood Montessori’s program the following week. That spring, the trio attended a community meeting to explore ways to reach kids via nutrition. At the meeting Jeanette Colbert, then a volunteer gardener at Chapman Elementary, invited Cilensek and Jackson to create their own program for Chapman. Colbert knew that to make growing the school’s

own food more relevant, the students needed a companion cooking class.

That summer, Cilensek and Jackson volunteered with Laura Manning’s kindergarten class. By the fall, they expanded their program into several second-grade classes.

In the fall of 2012, “Cooking with Chef Alex & Miss Kathy” returned to Chapman as well as expanded to include Rose Scott School, a private K-12 open-structure school.

UNCOMMON SENSE Beer’s carbon footprint We’re all familiar with the potential negative health effects of drinking beer—but what about beer’s impact on the environment?

As with any product that requires shipping, buying your beer from local sources can make a significant difference. The carbon footprint of beer varies based on whether it’s bottled or draught, where it’s produced and where it’s consumed. Taking into account such factors as ingredients, electricity, equipment, packaging and transport, here is an average pint of beer’s carbon footprint, according to The Guardian’s Green Living Blog: • Locally brewed cask ale at the pub: 300 grams carbon dioxide equivalent (CO2e).

• Extensively transported bottled beer purchased from a shop: 900g CO2e.

For comparison, the average can of Coca-Cola soda has a carbon footprint of 170g CO2e.

Here in Chico, of course, we have the Sierra Nevada Brewing Co., which places a strong emphasis on reducing its carbon footprint through efforts such as solar panels and hydrogen fuel cells, among other inventive sustainable efforts.

Cilensek and Jackson’s work

is part of a growing national trend to combat the seemingly paradoxical combination of a rise in childhood obesity and diabetes and a high incidence of food insecurity among our community’s poorest families. Nearly one in three children or adolescents are now overweight or obese, according to the National Institutes of Health. Yet, many of those same children may be part of a family living below the federal poverty rate; almost one out of two American children live in poverty or in a low-income family.

Feeding America estimates that 16.7 million children in the United States live in food-insecure households. Food insecurity does not necessarily mean no food; the U.S. Department of Agriculture defines a household with low food security as a household that has “reduced the quality, variety and desirability of their diets, but the quantity of food intake and normal eating patterns were not substantially disrupted.”

At Chapman, teacher Laura Fitzpatrick, whose second-grade class participates in the program, notes that many of the children receive breakfast, lunch and possibly a post-school snack at school, as part of the school’s Title I designation because it has a high proportion of low-income students.

For their part, Cilensek and Jackson are excited to be a part of the children’s lives and providing education on such a vital topic.

And they think it’s fun. “I’ve been cooking for 34 years. I’ve cooked in many countries around the world,” said Cilensek, “but this is the greatest work I’ve ever done.

[The teachers and the students] are always thanking us, and we’re always thanking them.” Ω

GREEN EGGS AND PANCAKES! “No, it’s not Dr. Seuss,” says Chico Peace &

Justice Center spokesman Sheldon Praiser. “It’s the Chico Peace & Justice Center’s annual Easter fundraiser, Pancakes for Peace,” which will take place on Easter Sunday, March 31, from 8 a.m. until 1 p.m. at the CARD Community Center (545 Vallombrosa Ave.).

Pancakes for Peace, now in its 32nd year, is a popular community event featuring an all-you-can-eat pancake feed with pancakes made from freshly ground whole-wheat flour and organic maple syrup from Vermont (and fruit salad, juice, coffee and tea), as well as an Easter-egg hunt, puppet parade, face-painting booth, hula hoops, live music and a silent auction.

This year’s event—which Praiser describes as “wonderfully festive and family-oriented”—“has made a few changes to its popular Easter-egg hunt. While it has always had real dyed eggs—none of the plastic stuff— there is a stronger effort this year to move away from factory-farmed eggs while promoting organic, free-range practices.” Along these lines, Praiser advises those volunteering to bring dyed eggs for the Easter-egg hunt to keep these guidelines in mind.

“Another creative change this year is that participants in the egg hunt will have the opportunity to donate back any number of their eggs and these will go to the Jesus Center.”

CALI GETS BAD GRADE

California scored low on a national report grading each state for its transparency on pricing for hospital and health-clinic services.

The report, compiled by Catalyst for Payment Reform and the Health Care Incentives Improvement Institute, gave California a “D” grade based on how easily laws allow patients to access healthcare pricing information, whether laws required disclosure of prices or discounts paid by health insurers, and how many health-care providers and procedures were included in the pricing data, according to Modern Healthcare.

The report’s authors noted California does not provide a publicly available report on health-care pricing and the state lacks transparency regarding amounts actually paid for health services.

The only states to earn an “A” grade were Massachusetts and New Hampshire, while 29 states received an “F” for being virtually without any transparency requirements.

Suicide was the second-leading cause of death among college-age Americans in 2009, according to new data.

Statistics released by the Centers for Disease Control and Prevention show that more than 4,300 Americans under 25 years old took their own lives in 2009, making suicide the second-leading cause of death for that age group behind accidents like drug and alcohol overdoses and vehicle collisions, according to an American Counseling Association press release. Many experts have noted college students are extremely hesitant to seek mental-health counseling.

Further, a 2012 study conducted by the American College Counseling Association found that, of students seeking counseling services, more than 37 percent suffered from severe psychological problems, double the rate recorded in 2000.

Bray is a volunteer for Enloe Medical Center’s Care-Line service. Every Friday, he and his installations partner, 95-year-old Joseph Bates, pay service calls on people who need emergency-alert technology and prefer the provider be local.

You’re probably familiar with the TV commercial in which an elderly woman presses a button and declares, “I’ve fallen and I can’t get up!” That’s the service Care-Line provides locally, for $35 a month but with a sliding scale down to $5 for low-income customers.

Twenty-four hours a day, seven days a week, someone will answer Care-Line calls for help made in and around the client’s home through a beeper medallion. It’s

Bray’s job to set up the base unit attached to a phone line and get the whole apparatus working.

It’s something he’s been doing for almost 35 years—just about the whole time Enloe has offered the service.

“This is right up his alley,” said Bob Kiuttu, Enloe’s emergency-services manager.

“It’s a good job; it’s a highly respected job,” Bray said. “Enloe Hospital really appreciates us. They use us as a sounding board for what we hear about new pro-

grams, the nurses, the doctors, the food, things like that.”

That’s because many clients began as patients in the hospital, and the patients feel comfortable talking to Bray and the half-dozen other volunteers who install Care-Line equipment.

“When we get out there talking to someone who’s ill or just released from the hospital, they are glad to see us.” Bray said. “First, because they know we are HEALTHLINES continued on page 17

HEALTHLINES going to install a set for them for their own protection, and also that we’re veterans of World War II. They open up and talk to us about their experience in the hospital and how things went.

“We meet a lot of nice people out there. Sometimes it’s difficult for us to finish our installation and leave; they don’t want us to leave.

They want us to talk to them.

We’ve been offered lunches and coffee and donuts and everything else, but we have to tell them, ‘We’ve got more installations we’ve got to do!’”

The fact that Bray and the other volunteers are seniors—sometimes decades older than the customers—makes a difference, Kiuttu said. Bray agrees: “They think maybe because we’re older fellows, we’re not going to hurt them and everything is going to be all right.”

Kiuttu says Care-Line currently has around 325 customers. That’s not a lot when compared to national services, but Enloe isn’t seeking to compete with the big boys.

“We don’t widely promote [Care-Line],” Kiuttu said. “We see it as a community service—part of the comprehensive mission of Enloe. It’s still around in a few hospitals, but not many. We just

feel like ours is a little more hometown the way we’re set up.”

Both Bray and Kiuttu

remember the infancy of the CareLine technology. Back in the 1970s, before home computers and cell phones, pioneers in the emergency-alert arena needed to piece together technology of the time to get working models.

Early Care-Line customers wore medallions that included a button and a battery. “It was far from waterproof,” Kiuttu said, “and it was about the same size and double the thickness of a matchbook.” When the button was pressed, a radio signal got transmitted to the main device—essentially a circuit board and a tape player—attached to the phone line.

“This remote unit would play this eight-track tape that would automatically dial into the response center and play a prerecorded message like, ‘micro alert No. 8, micro alert No. 8.’ We would have an index card file [in the emergency room] that had all the data on that subscriber, and we would send out responders.”

The technology is more advanced these days. The medallion is a lot smaller and acts like a tiny cell phone, using its home

Bray started volunteering toward the end of his 37-year tenure with AT&T. He’d begun his career as a lineman, then moved up the ranks to the position of senior engineer. He and three other supervisors decided on volunteer work, and installing emergency-alert equipment was, as Kiuttu said, right up their alley.

“I knew that I was going to be retiring,” Bray explained, “and I wanted to do something to pay back the community effort for all the things that go on in Chico.

There are lots of volunteers in Chico, and I wanted to be part of that group.

“The technical aspects, all those things went down with my line of business. I had a pretty good background with the different systems and how things worked. So everything in terms of installing units in the home, the work and the problems that could occur, it worked out for me that that would be a good volunteering job, and the reason I’ve been doing it for so many years.”

He plans to continue doing so.

Enloe has contracted with a new provider that will monitor calls at a centralized location, but the volunteers like Bray will continue to make house calls every Friday, making sure each Care-Line unit is set up for whenever it might be needed. (Enloe staff members respond to service calls on other days.)

he intersection of Fifth and Ivy appeared pretty normal for a Saturday night at 1 a.m.: A young man stumbling toward his next destination, women wearing outfits defying the chill of late-January in Chico, cars full of 20-somethings carrying on conversations with people in the crosswalk. It was almost a caricature.

Something seemed out of place though—a Butte County Emergency Medical Services vehicle parked outside of Fifth & Ivy Liquor. It turns out the two paramedics inside camp out here sometimes in the wee hours to finish up paperwork and to keep an eye on things. Between 2 and 3 a.m. is their busy time. And they’ve seen it all.

Students, visibly intoxicated, separated from their friends and walking alone. Fights.

The drug dealers who descend on the area to prey on its drunken residents.

These days there’s a heightened sense of alert around here.

Chico State student Mason Sumnicht had his final drinks at a bar on this very corner. For the university, it was the death of the 21-year-old—the last in a spate of alcohol-related deaths in late 2012—that sparked a community-wide discussion about what some already knew, and what many have been in denial about for years: Chico has a drinking problem.

The university—the lifeblood of the city—is just steps from this student neighborhood. It’s also steps from downtown, where drinks are cheap. Most of the students who attend Chico State come from hundreds of miles away and are living on their own for the first time. Some, like Sumnicht, join fraternities, which over the past decade have earned a reputation more for being drinking clubs than the community leaders they claim to be.

It adds up to a perfect storm. Some have even called it a public-health crisis. The bottom line is that young people are dying.

And problems associated with binge drinking—sexual assault, property damage, violence—remain ever-present in Chico.

“The party-school reputation lingers,” said university President Paul Zingg. “Chico is a place where taverns and bars are plenty. Nobody’s going to be surprised that we’re addressing these issues—but we have to address this more effectively.”

As Chico State toils with the same issues it’s been dealing with for years, university officials are looking to the community and even other institutions for answers. And, as the CN&R found, among other schools tagged with similar reputations, some have adopted more-aggressive measures at drug and alcohol intervention than Chico State, and they are getting results.

But the first step, as they say, is admitting you have problem.

On a recent Wednesday night at Riley’s Bar & Grill a

handful of mostly women were putting down shots in quick succession. As more women trickled in, the shots came even faster. It could have been any bar, or any night in Chico for that matter, save for the members of the Alpha Delta Pi sorority guest bartending.

One of the women at the bar, who spoke to the CN&R on the condition of anonymity, says the idea of personal responsibility has gotten lost in the discussion.

“Take ownership. Stop blaming bars and drink specials,” she said curtly, although she did agree that alcohol is much cheaper in Chico. In fact, all drinks were half off on this particular night. One man across the bar said he and a friend paid Party season is about to go into full bloom as red-cup revelers greet the sun at day-long parties in the student neighborhoods.

Will enough be done to curb Chico’s culture of binge drinking?

The young woman also mentioned something else that’s been repeated a lot in this community: “Chico is just like any other college town.”

But that doesn’t hold true.

A scientific survey taken in early 2012 called the Healthy Minds Study—which examined mental-health issues of more than 25,000 students on 29 campuses across the country— shows that Chico State ranks higher than the average in all 13 categories relating to substance use, and much higher in cocaine, marijuana and prescription drug use (Chico has also seen several deaths from drug overdoses in recent years; some included alcohol). However, the most eye-opening statistic in the study shows that Chico State students “are almost double the national average when it comes to binge drinking more than three times in a two-week span.”

Boozing in Chico goes back generations. A study traced the relationship between alcohol and Pioneer Week (later Pioneer Days)—the long-running annual celebration of the area’s heritage—to before the Great Depression. Anthropologist Matthew Meyer says that throughout the event’s existence it “involved drunken debauchery and reckless neglect of safety, private property, and individual rights (not to mention school work).”

Things came to a head in January 1987 when Playboy named Chico State the No. 1 party school in the nation, a distinction that is far from scientific but also has been difficult to shake. The infamous Pioneer Days riots came just a few months later, which led then-university President Robin Wilson to cancel the event. The ’90s saw holidays like St. Patrick’s Day, Halloween and Labor Day turn increasingly unruly, and by 2002 law enforcement had all but put the kibosh on the notorious drinking events by ramping up police presence and DUI checkpoints. In recent years even the fairly innocuous César Chávez Day in Chico has to some become more a celebration of margarita specials than the human-rights activist.

That sounds familiar to Jackie Kurta, director of

UC Santa Barbara’s Alcohol and Drug Program.

Santa Barbara has also gained notoriety as a party school.

Isla Vista, the rowdy student community in Santa Barbara, is one square mile of apartments, bars and restaurants—similar to Chico’s downtown and student neighborhoods. There, Santa Barbara County Sheriff’s Office foot patrols are employed.

Students who are found in violation of drug and alcohol offenses in the area are required to attend a five-week intervention session through UCSB’s College Alcohol and Substance Abuse program (CASE) at the student’s expense—$120 (it’s free to students who seek it out on their own). Through the program, which started in 2005, the university also notifies students’ parents on the first offense (in Chico parents are notified only when alcohol violations occur in student housing).

Day of reckoning, again, for Chico State’s Greek community, as President Paul Zingg announced the suspension of all fraternities and sororities on Nov. 15, 2012, in the wake of the alcohol-overdose death of 21-year-old Chico State student Mason Sumnicht.

Kurta says it’s been effective, noting that the university doesn’t push for abstinence, but rather encourages safer behavior from those who choose to drink.

“Students are initially annoyed by it, or see it as an intrusion,” she said of CASE, “but they come away with a better understanding of the resources available to them.”

In addition, UCSB provides the Skills, Awareness and Motivation program, where students share their experiences with counselors and peers. There’s also mandatory peer counseling for freshmen, which Kurta says has proven more effective with students than online resources.

At the University at Albany, State University of New York, another school that has dealt with its own party-school reputation over the years, administrators implemented Project Healthy STEPS back in 2005.

“Students were suffering academically,” said Dr. M. Dolores Cimini, a licensed psychologist and assistant director for prevention and program evaluation at Albany. “We felt a duty to provide a safe environment for students, and for those who deal with the secondhand consequences—right down to the person who has to clean up the puke.”

The STEPS program has its roots in what Cimini calls a landmark report by the National Institute on Alcohol Abuse and Alcoholism, which examined the causes and effects of alcohol abuse and found which solutions work and which don’t. It focuses on high-risk groups, including Greeks and first-year students, and targets intervention counseling accordingly, going as far as interviewing them at chapter houses.

Cimini says a decade ago her university was in a similar place as Chico State. It had made Princeton Review’s list of top party schools twice in five years. Around that time it also had a couple of alcohol-related deaths.

Chico State is in many ways in the same situation it

was in 13 years ago, when Adrian Heideman, who was pledging the Pi Kappa Phi fraternity in October 2000, died after drinking large quantities of brandy. He would have turned 31 this July.

Since her son’s death more than a dozen years ago, Edie Heideman has spoken at several colleges on the dangers of hazing and binge drinking.

Zingg wasn’t at Chico State back then, but he was a year into his presidency in February 2005 when Matthew Carrington died. Carrington succumbed to water intoxication as part of a bizarre hazing tradition that required pledges to consume large amounts of water. While alcohol didn’t directly contribute to the 21-year-old’s death, the fraternity members orchestrating the rite had been drinking.

Most damaging, perhaps, was that the case made headlines around the nation. The shock reverberated throughout the community as a family was left to deal with the loss of a child. “You never expect anything to happen to your kid,” said Heideman, who has remained in contact with Carrington’s mother, Debbie Smith, since his death. “People have no idea what Debbie or myself are going through.”

After Carrington’s death Zingg lambasted members of the Greek community twice in as many months at on-campus gatherings, suspending them and calling for sweeping changes (including raising individual GPA requirements to its current 2.5).

He did so again just a few months ago, on Nov. 15—the day Sumnicht died—at an eerily similar gathering of the current crop of Greeks, suspending all chapters.

The final months of 2012 were not good ones for Chico.

22-year-old Carly Callaghan is found dead on the floor of her room. A toxicology report later shows she had alcohol, Prozac and a high level of morphine in her system.

Aug. 19 and Nov. 15 (compared to six from 1996 to 2005). Sumnicht and one other student attended Chico State, another was about to start Butte College, and a 20-year-old Cal Poly-San Luis Obispo student visiting friends in Chico died on the river during the Labor Day float.

Sumnicht, a communication-design major from Jamul, Calif., was pledging Sigma Pi at the time of his death, although a Chico police investigation ruled out hazing. Sgt. Scott Franssen also says that despite earlier reports, there is no evidence supporting the idea that Sumnicht was trying to consume 21 shots for his 21st birthday. But police say the 6-foot, 140-pound senior did drink enough between the hours of 7:30 and 11:30 p.m. to send his blood-alcohol level beyond five times the legal limit.

Sumnicht was admitted to Enloe Medical Center later that night after he choked on his own vomit, which cut the flow of oxygen to his brain. He was removed from life support 12 days later.

Investigations by police and the Department of Alcoholic Beverage Control were unable to establish negligence on the part of those who were with Sumnicht that night, or Madison Bear Garden and Riley’s, where he reportedly was drinking. “It’s difficult to prove those cases unless an ABC officer is there,” said John Carr, a spokesman for the agency.

It was the last straw. As it turns out, 10 of Chico’s 26 Greek organizations were tied up in the university’s Student Judicial Affairs in 2012 for violating alcohol and hazing policies, in addition to allegations of assault. Some organizations simply went around the university’s zero-tolerance drug and alcohol policies for chapter houses by taking their parties elsewhere, to annexed houses where two or more Greek members resided.

The university doesn’t vigilantly enforce these policies—students are told to self-report any issues. This hasn’t always proven effective. But it’s not likely to change, either.

“We need to really trust them, and trust them to make the right decisions,” said Malcolm McLemore, a Greek Life coordinator at Chico State. “But the bottom line is that nothing usually comes across our desk until something goes wrong.”

Nationally, Greeks are more likely to binge than the rest of the student population, according to the U.S. Department of Education. But many in the local Greek community feel they’ve been vilified.

When asked to be interviewed for this story, several Greek members (even at the national level) refused to talk. Others answered only certain questions.

“If we’re saying we don’t have a problem, then there’s no solution,” said Phi Delta Theta President Michael Barrett. The 21-year-old philosophy major, and executive vice president of the Associated Students, has been very clear about being part of the Greek community’s transformation. “If you’re honest

about it, you’ll come up with more meaningful solutions.”

For reinstatement all Greek organizations submitted self-evaluations approved by the university, in addition to completing a Safe Place Violence Prevention Education program. New guidelines are also in place for parties, and there are clear sanctions for violations.

As it stands, all but two organizations are back in good standing with the university. Both Kappa Sigma and Phi Beta Sigma were found in violation of hazing, and their suspensions will carry through until at least the end of the school year.

While the highest-profile deaths

have taken place in Chico’s Greek community, that population still makes up only about 6 percent of the student body.

It’s convenient to drink in Chico. For everyone. Downtown bars are a short walking distance from the student neighborhoods, as well as the university. Drink specials have hardly budged in almost two decades. The Oasis still runs its 25cent kamikaze-shots special every Tuesday from 7 p.m. to midnight, in addition to domestic pitchers for $4. University Bar’s famous Buck Night—$1 wells and pints of Sierra Nevada—is a Wednesdaynight institution. And a stiff 20-ounce tea at Panama’s will still run you just three bucks any night of the week.

This came to light at Chico State’s Community Action Summit on Feb. 22, which brought some 400 students and community members together to discuss possible solutions to the city’s drinking problem. Leading up to the summit, the Bear—which almost sits on campus— got rid of its longstanding Thursday Buck Night tradition.

Michael Wear—a partner in the ownership of four local eating and drinking establishments in Chico, including Riley’s and Franky’s Pizza, both located at Fifth and Ivy—attended the summit along with several other bar owners.

at the summit, adding: “But I’m responsible for what I’m doing. We’ve always promoted a good time; it gets scary when you have to ask if it’s still a good time.”

One thing local bar owners agree on: Young people are drinking more hard alcohol than they used to. A lot more.

Wear says that 20 years ago alcohol sales at his establishments were 60 percent beer; these days hard alcohol makes up about 80 percent of the sales.

One study brought up at the summit shows that a 10 percent increase in the cost of alcohol will reduce the risk of intoxication by 30 percent.

Wear’s not buying it.

“The culture of the individuals will find a way to get the cheapest drink wherever possible,” he later wrote by email. “And by pricing up the bars, we will be promoting more house parties, unregulated drinking and potentially more situations in the streets.”

It’s not just the allure of drink

specials—a lot of boozing happens outside of Chico’s bar scene. A recent walk through an outlying student neighborhood was pretty typical: A beer-pong table (otherwise known as a ping-pong table) made up the centerpiece of a living room at one house party. Just two doors down a group of 20-somethings sat around a kitchen cluttered with bottles of liquor and shot glasses.

And there are indications that many students are coming to Chico State solely for its party-school reputation. More than 30 percent of Chico’s incoming freshmen report having binged in the past two weeks, compared to 22 percent nationally, according to Chico State officials. And, as with the bars, many underage drinkers are “STORM” continued on page 25

bypassing the gradual buzz of beer for the quick blast of liquor. A 1.75-liter bottle of Burnett’s Vodka—known as “Chico Water” around these parts—goes for as little as $5.18 at WinCo. One bottle will get you about 35 shots, and the brand includes easy-drinking flavors like Pineapple, Mango and Fruit Punch.

Weekends, and especially holidays, are busy for local law enforcement and the emergency room. Enloe receives on average two to four alcohol-overdose patients on Fridays and Saturdays throughout the school year. The ages of those patients range from 17 to 22. On holidays like Halloween and Memorial Day, the number of student ER visits increases tenfold. And Chico Police Department Det. Abigail Madden says if you take alcohol out of the equation, calls for service would decrease significantly for the department.

Chico’s reputation is something students still have to deal with. Ask any graduate. Or in the case of Chico State senior Ian Gilbert—who’s also president of the recently reinstated Sigma Pi fraternity that Mason Sumnicht was pledging—the school’s reputation lingered before he even stepped foot on campus in 2010.

“I had heard plenty about Chico State’s party reputation. Every adult I told about Chico immediately looked at me funny,” Gilbert said. “But that didn’t really bother me.

I came with a group of friends and fell in love with the campus. That’s what mattered.”

Three Chico State presidents—going

back more than three decades—have had to deal with, and act on, the effects of binge drinking in the campus community. Some of it was as simple as pulling alcohol ads from Chico State’s student newspaper, The Orion, or banning alcohol promotions and sponsorship for university and Greek events. Years later the university purposely scheduled its spring break to coincide with St. Patrick’s Day, effectively clamping down on that popular drinking holiday.

There are resources available to students on campus. Chico State’s Campus Alcohol and Drug Education Program (CADEC) was created in 1988 in response to the Pioneer Days riots, although it takes a more passive approach. Aside from the online Alcohol-

EDU courses—which became mandatory in 2005 for all incoming freshmen—alcoholand-drug counseling is voluntary.

Students found in violation of minor alcohol offenses downtown are reported to the university’s Student Judicial Affairs office and, as Zingg points out, are “watched more carefully.” Parents are not notified.

Those measures clearly haven’t been enough. The February Community Action Summit yielded more ideas. On March 12, the university examined those further, and says it plans to implement some of them in the coming weeks.

One program mentioned at the summit was the University at Albany’s Project Healthy STEPS. Cimini, the director for prevention and program evaluation and also a national expert on high-risk drinking and drug-abuse prevention for college students, says the program works. Albany has seen significant reduction in binge drinking among students over the

past eight years, in addition to improved grades and fewer cases of vandalism, fighting and sexual assault.

“The students like it because it’s really non-confrontational,” Cimini said, adding that the program provides valuable personal feedback to students. “They even recommend it to their friends.”

As with UC Santa Barbara and Albany, Chico State officials have made it clear they don’t want to take the college experience from students. Young people are going to drink. The goal is to curb it to responsible levels.

“It comes down ultimately to personal responsibility,” said Zingg. “As an individual, are you going to do the right thing when you find a friend or yourself impaired?”

But the university has to do more. The community is optimistic—cautiously optimistic, depending on whom you ask. For Chico State, it sees this as a chance to make a different name for itself—as part of the solution instead of the problem.

“We’re helping people grow up, quite frankly,” Zingg said. “It goes deeper than education.” Ω

And this spring’s line-up is one of the performances.com strongest yet, with Chico Performances hosting four quality dance programs over the span of two months, starting with two earlier this month—Lula Washington Dance Theatre (March 14) and Rhythm of the Dance (Ireland’s national dance troupe, on March 16)—and continuing with Chico’s annual multi-discipline program, Keeping Dance Alive! (April 5 & 6) and a visit from the legendary Paul Taylor Dance Company (May 9).

ing crowd during its visit to Laxson a couple of weeks ago. Most of the dances presented were narratives about the African-American experience, many of them dealing with heavy topics such as slavery, segregation and racism. The dancers themselves were delightful and nearly perfect. They executed even the most famil-

iar moves with precision and deft fearlessness. Although, I wish Washington’s choreography utilized the dancers’ fine-tuned physical instruments in more inventive ways and relied less on pantomime and theatrics.

While I may not have been impressed by her choreography, I am brought to my knees by Washington’s teaching. Her greatness comes not only from her contributing great dancers to the world, but also from her contributions to the world itself. Her Los Angeles-based dance school’s motto is, “I do dance, not drugs.” Most of the stunning dance gods in the Chico show were kids in her neighborhood, whom she chiseled into glorious dancers. In addition to the evening concert, Laxson also hosted a master class for Chico State dancers and a field-trip performance in which the visiting troupe taught elementary-school students about black history, from slavery through the civil-rights movement.

Chico Performances understands that dance has the power to educate, communicate and inspire, and works hard to make it available through workshops and field trips in conjunction with concerts by these world-famous performers. The university also gives regional talent a chance to shine at the annual Keeping Dance Alive! concert, featuring local dancers and choreographers showcasing ballet, jazz, belly dance, musical theater, modern and contemporary dance. It provides a great opportunity for a beginner dance fan to sample a wide range of styles all in one program, and over the years the show has secured its position as a Chico staple.

For the 2011-12 season, our studio was aflutter over Pilobolus, and this year the buzz is all about Paul Taylor. Seeing a Taylorchoreographed program is like seeing a Rolling Stones concert.

He is a legend. He’s been doing choreography for 60 years, and is one of the last living members of the second generation of dance legends, sharing ranks with the likes of Cunningham, Ailey and Graham. His work is witty, somewhat abstract, esoteric and varied. Attendees may see anything from a moving piece inspired by Walt Whitman to a comedic take on waiting in line to an intellectual investigation of human emotion.

Though Taylor’s works are considered high art, his dances are watchable, digestible and enjoyable. Our community is fortunate to be host to such a master. Ω

Like a fine wine, ghee becomes better with age.” Ghee also contains many essential fatty acids, said Gage, “that when aged become more potent.” Gage ages Mama Sattva Ghee for a minimum of 30 days, in glass containers kept in a dark place at 75 degrees. She says she will be offering a one-year-aged batch of ghee in late summer (at her farmers’ market booth only).

Gage—a former massage therapist who has studied Chinese medicine and Ayurveda—began making ghee in 2002 as a meditation practice.

“I read that it was a purifying practice for the mind to make ghee and it was also really good for you to eat. Once I started making it, I realized how good it was for benefiting the mind and increasing digestion.

“I got a lot clearer in my mind. My memory got better,” said Gage of her early experiences eating ghee, which combines the culinary uses of both butter and cooking oil, due to its flavorfulness and high flash point (485° F). “I was doing desk work at the time, where I proofread 200 pages of manuscripts—really boring insurance manuscripts—every day,” a task that she says became easier to do after eating ghee regularly, “and I got a lot healthier and happier,” she said. In addition to having better digestion, Gage says she felt more energized in general.

Gage began selling her Mama Sattva brand of ghee—which is made from organic, cultured butter from Sierra Nevada Cheese Co. in Willows—at the farmers’ market in June 2012, and shortly afterward her products went onto the shelves of local stores.

“My goal is to have [Mama Sattva Ghee] in 21 stores by the end of the year,” she offered.

Gage recounted a recent conversation she had at her market booth with one of her many regular customers: “One little old guy came up and said, ‘Do you have people report miraculous healings after eating your ghee?’And I said, ‘Well, that’s what I hope for, but not really, not yet.’And he said, ‘Well, I have had a lot of medical problems and health issues,’ and he said, ‘But since I’ve been eating your ghee, it seems like most of them have gone away.’” Ω

Girls gone wilding Art house meets spring break for a twisted rite of passage

music videos and youth-market reality TV. There’s plenty of R-rated sex, drugs, and nudity in play here, but the tale of the foursome’s week of acting out is plainly headed toward misadventure before Candy, Faith, Brit and Cotty have even arrived in Florida.

Faith (Selena Gomez) and to a lesser degree Cotty (Rachel Korine) are the characters who show some moral compunction, however belated, in all this. But Candy (Vanessa Hudgens) and Brit (Ashley Benson), the prime instigators of outlaw behavior in this bunch, are the only ones implicated in all the action, right through to the amusingly perverse but not-so-surprising violent ending.

college-age girls “go wild” on spring break in Florida. They finance the trip via a restaurant hold-up, and once in Florida they become entangled with an unctuously lubricious gangster/rapper (James Franco, decked out in cornrows and gold teeth).

Right from the start, Korine is dealing in clichés but churning them out with an exuberance that is at times almost rhapsodic. All the characters and the female foursome in particular are walking, jiving, voguing clichés themselves, and Korine’s indulgent, excessive presentation of them as such not only insists on that point but also provokes by way of redundancy.

Spring Breakers makes its show of pandering to an audience already wellattuned to the fantasies and hype of

That ending, climactic but not particularly satisfying, seems to me to be the final instance of the film’s basic pattern of action: the indulgent playing out of callow fantasies followed by a desolating obliviousness to consequences, real or imagined. Korine indulges the film’s characters and its presumed audience as well, but mixes things up in ways that deny final satisfaction to both.

When Candy and Brit are gearing up for the hold-up at the beginning, they urge each other to “act like you’re in a movie or something.” It’s an emblematic line for Spring Breakers, which is itself “a movie or something” about (and perhaps for) people whose sense of themselves has not yet risen above the feeblest imaginings of contemporary pop culture.

All in all, Korine’s film has an amusing satirical snap to it, and there’s a nifty brio to the cinematography, editing and sound design. It’s minor, but not without its own offbeat charm. Ω

The Incredible Burt Wonderstone

Burt Wonderstone (Steve Carell) is a glitzy Vegas magician whose career runs aground on a double whammy—he has a sudden and disastrous break-up with his longtime stage partner, Anton Marvelton (Steve Buscemi), and the X-treme gonzo newcomer Steve Gray (Jim Carrey at his most demonic) is stealing all of his thunder in face-to-face confrontations. The screenplay eventually gets around to making Burt’s story into a rise-and-fall tale with some semblance of

recovery and redemption. But the resolution of these plot points is half-hearted at best.

It has movie-scale production values and a story arc of sorts all right, but most of that superstructure turns out to be little more than a convenient place to hang a string of somewhat disparate comedy sketches, not all of which are particularly well-conceived.

Oz the Great and Powerful

It’s been 74 years since the release of The Wizard of Oz, and director Sam Raimi (Spiderman) and company are exploring its title character, pre-Dorothy and gang. Struggling magician/con-artist/womanizer Oscar “Oz” Diggs (James Franco) isn’t living up to his “great” potential, working the circus scene in Podunk, Kansas. So when a tornado sweeps him away to the land of Oz, where the inhabitants believe that he’s their awaited wizard, he goes with it. With the help of Glinda The Good Witch (a sappy Michelle Williams), this amateur hero attempts to save the citizens of Emerald City from the wicked sister witches (Rachel Weisz and Mila Kunis). There’s plenty of visual oohing and ahhing to be had, but the fun stops there. The dialogue falls flat and the mediocre acting does little to save it.

Keep traveling down that yellow brick road.

Quartet

Ronald Harwood has adapted his own play about retired opera singers putting on one more show for the retirement home that is their special last refuge. Dustin Hoffman, making his directorial debut, amiably indulges a frisky cast of veteran Brit actors.

The arrival of haughty diva Jean Horton (Maggie Smith) makes possible an on-stage reunion of the eponymous quartet, but maybe not—Horton’s still-heartbroken exhusband (Tom Courtenay) figures in the erstwhile quartet and the now-humbled diva has her own pride and self-doubt to deal with. The other members, the exuberantly randy Wilf Bond (Billy Connolly) and the sweetly erratic Cissy Robson (Pauline Collins), nudge things toward geriatric farce early on. But once the diva is present, the tone changes to something verging on the tragicomic, and the feel-good finish (with a decorous touch or two of the bittersweet) is certain to draw a few well-earned tears.

Deseo Maria Bacardi Breaking Records Deseo (Spanish for “desire”) is the debut album from Cuban-born New York singer Maria Bacardi (whose great-grandfather founded the Bacardi rum company). For Deseo, Bacardi—who was raised in Europe after leaving Cuba in 1961 at age 4, following Fidel Castro’s ascent to power—chose only “the songs her mother sang to her while exiled in Spain,” as her website describes it (go to www.mariabacardi.com for more info). The titles alone—such as “Sufre Más” (“Suffer More”) and “Noche Cubana” (“Cuban Night”)—often reflect a deep passion and longing for her native country. Likewise, her heartfelt delivery of each bolero-style Cuban ballad on the CD—including the beautiful “Júrame”—evokes deep emotion from the listener. As Bacardi has been quoted as saying, “My art and music are both fed from my desire for looking for the truth in beauty, despite the forces of pain and grief.” Interestingly, singing is a later-in-life career change for the 55-year-old Bacardi, who spent years in the world of theater and visual art (and went by the name Maria Pessino until earlier this year). A top-notch ensemble, including Carlos Gómez on guitar, Pablo Vergara on piano, bassist Yunior Terry and Vicente Sánchez on congas, provides the laid-back musical support for Bacardi’s lovely vocals.

’Round Midnight Harry Allen & Scott Hamilton Challenge Records Int. This two-tenor-saxophone group features an “old” master—the 58-year-old Rhode Islandborn Scott Hamilton—paired with the (new to me) 46-year-old Harry Allen, a Washington, D.C., native whose catalog of 30-plus CDs rivals Hamilton’s. When Hamilton began his career at 22 he didn’t join the prevailing free jazz or fusion movements—he looked back to the masters, e.g. Ben Webster and Zoot Sims. Allen is on the same page and this, their third collaboration since 2003, features the duo backed by Allen’s rhythm section (pianist Rossano Sportiello, bassist Joel Forbes and drummer Chuck Riggs) in a program of both pop and jazz standards.

Opening with the least melancholy version I’ve ever heard of “My Melancholy Baby,” the group serves notice of the good times ahead. Allen’s “Great Scott,” a tribute to his compeer, jacks up the tempo a few more notches and spotlights the saxists in a churning sequence of chase choruses—long a highlight of tandem tenor teams from the ’40s on. They shift into a bossa nova mood on the delightful “Baubles, Bangles and Beads.” On “Lover” everyone gets into high gear, and Sportiello’s solo is, once again, extra icing on the cake. Thelonious Monk’s ballad, “’Round Midnight,” gets a gorgeous treatment. Highly recommended!

Live at Scullers Grace Kelly Pazz Music I was in no way prepared for how much I wasn’t going to like this album. The cover didn’t incline me to think I wouldn’t appreciate the music made by the pretty young woman depicted there, cast in blue light. And the jazz standards included on the set list of songs recorded live at a famous Boston jazz club made me think I was in for some pretty good sounds by a singer/songwriter/sax player. Grace Kelly is only 20, but she’s played behind some pretty big jazz names already. And she’s got real chops, having earned the regard of more seasoned sax men like Phil Woods and David Sanborn. But when she sings, it takes a different set of ears than mine to appreciate what she’s doing. From her annoying vocals on the opening track—“Please Don’t Box Me In”—to the self-indulgent interplay with her backup singers on “Falling,” this album plummets whenever Kelly removes her lips from her sax to begin singing. “Searching for Peace” is an extended instrumental, as is “The Way You Look Tonight,” both of which explain to this listener, at least, how it was that Kelly gained her following in the first place. It wasn’t for her vocals.

After 30 years, Johnson said—by phone from Oakland while on tour with his latest band, The Hive Dwellers—that working with friends wasn’t just why he started, but how he keeps going.

“I’m fortunate that I get to work with such visionary and creative people,” he said. “There’s always something going on, always people feeding off each other, and it’s easy to just jump in and keep going.

“It’s in our nature. Music is part of us. It’s like food.

People gather around the table, they share food and music the same way, always offering up little morsels.

There’s a constant flow of people in every direction that you get to meet and work with. That’s exciting.”

While many of Johnson’s past collaborations have been one-offs and studio projects, The Hive Dwellers, which also features Gabriel Will (bass/electric guitar) and Evan Hashi (drums), toured for three years before recording a full-length, last year’s Hewn from the Wilderness.

ate, to let the songs go their own direction before recording them,” Johnson said of the approach. “It was an experiment for me.”

In addition to his role as rock ’n’ roll ringleader,

and in keeping with the DIY, power-to-the-people ethos with which he approaches music, Johnson also throws his considerable clout behind political causes in his hometown. Alongside bits about K’s latest releases, the label website’s news feed also carries bits about Olympia’s populist power struggles to its considerable international audience. Last year it supported a ballot measure to allow public power, and it recently focused on striking hospital workers.

“We try to keep in touch with local things that don’t get a lot of attention,” Johnson said. “With the publicpower issue it was mostly a news blackout, because the utilities are so powerful it wasn’t covered at all. So we figured we have this platform, it’s something we’re interested in, so we’re going to write about it.”

The recent labor struggle, for which Johnson performed at a rally, involved workers striking after the owners of Olympia’s Providence St. Peter Hospital made cuts to their health-care benefits.

“Everyone was just like, ‘That’s ridiculous, you’re a hospital,’” Johnson explained. “And they’re like, ‘It’s not ridiculous, we’re a corporation that wants to cut costs, and this is an unnecessary cost.

“Because corporations have become so big and so powerful, every single labor issue is significant, because the ability of workers to organize and bargain collectively is not an industry-by-industry issue but across the board.”

As for the music industry, which Johnson has made a career of skirting, he just chooses to ignore it altogether.

“I really don’t know anything about it. I live in my own little world, so the music industry … I don’t know what goes on with it.” Ω

Ray White is a soul vocalist and rock and blues guitarist. White was part of Zappa’s touring ensembles for many years. Robert “Bobby” Martin toured with Zappa from 1981 until 1993, when Zappa passed away.

D OR D? As I read some of the statements made by the Protect Marriage lawyer speaking before the Supreme Court this week, I found myself struggling to come up with a way to describe those fighting against marriage rights for same-sex couples. Are they douches? Or are they dicks? Both of the “D” words are among my favorites, so when the lawyer talked about “responsible procreation,” I was torn between screaming “he’s being a total dick” or yelling “what a 09 douche.”

Douche isn’t it though. I mean, I love finding and pointing them out, but douches are basically those whose behavior is obnoxious to the point that everyone agrees they’re pretty annoying—if fairly harmless—while the douches 10 remain oblivious to it all. No, this smells more like dick— someone who knows full well that what they’re doing is wrong, and that they are affecting others negatively with their choices and yet continue with their dickish behavior regardless.

The Protect Marriage people are definitely dicks. I do not for one 09 second believe that they are being truthful. I do believe that they know that if they tried to go into a courtroom and make their argument based solely on religious grounds, they’d get spanked red by the First Amendment. So they’ve come up with the “protect marriage” workaround, where their main point is that the primary purpose of 10 marriage is “to increase the likelihood of children being raised by the mother and the father who brought them into the world.” Huh? That’s news to me and my wife of nearly 20 child-free years; our purposes including such off-the-wall ideas as love, security, companionship, sex, friendship, bacon and noisy rock music.

The truth is, opposite-sex couples have, and will always have, the right to marry for any “primary reason” they choose. I think the Protect Marriage folks are being disingenuous, and their choice to willfully hide behind that ridiculous premise is hurting others. That is 09 exactly what being a dick is all about. If, like the sign-waving masses they represent, the lobbyists just said, “Screw homos! We don’t want them to marry because our religion tells us so,” then I’d have way less of a problem. They’d at least be saying what they really believe, and not be hiding behind some made-up line of reasoning. Of course, 10 trying to push your religious views on others is hovering over the douche/dick border, but thanks to religious freedom it’s less a threat and more of an annoyance.

Now, as much as I believe that sometimes a firm sock in the crotch can greatly reduce one’s dickishness, I don’t think getting physical with these particularly stiff members of the Protect Marriage lobby would do anything but bolster their cause. However, maybe if a judge or nine were willing to punch some D, we could start down the road of being a less dickish country.

Local musician/promoter Matt Savage has relocated his Band Creator concert venue/recording space to the former 10 stand-up spot’s old digs at 167 E. Third St., and he’s already taking advantage of his new downtown visibility and putting on a busy and eclectic calendar of shows featuring mostly local bands. Just this weekend there are four: a rap and dubstep party with Sykopath and JT (tonight, 8 p.m.); a local-band night with Threk (dance/funk) and deathmetalers Astronaut (Friday, March 29, 8 p.m.); a morning-time music-student recital and open mic (Saturday, March 30, 10 a.m.); and a performance by Redding/Red Bluff metal crew The Silent Cartographer (Saturday, 8 p.m.). Banzai skydiving is a step beyond ordinary skydiving. To do it, you hurl your folded-up parachute out of the airplane, wait a while, and then leap into midair yourself. If all goes well, you free-fall in the direction of your parachute and catch up to it. Once you grab it, you strap it on and open the chute, ideally before you hit the earth. As I’m sure you know, your brain is not even close to being full of that much data. And in accordance with the current astrological omens, I suggest you cram in as much new material as possible. April fool! I told you a half-truth. While it’s correct that now is an excellent time to pour more stuff into your brain, you should be highly discerning about what you allow in there. Seek out the richest ideas, the most stimulating information, the best stories. Avoid trivial crap.

PISCES (Feb. 19-March 20): July 2012 was a sad time in the history of mythic creatures. I don’t really foresee the discovery of a flesh-and-blood mermaid—by a Pisces or anyone else. For the person who has always dreamed of riding in a motorcycle side car, Chico resident Chris Canterbury can make it happen. He builds them for people all over the world. He also uses his mechanical and welding skills to do BMW motorcycle restoration, build overland vehicles, and create (weld) metal art, such as gates and water features. He puts about 90 hours a week into his business, Boxer Metal. In his leisure time, Canterbury camps with his wife and two daughters in their Volkswagen Bus. How did you get into welding and mechanics?

I was born and raised around it [in the Monterey area]. My dad always had hot rods and race cars and motorcycles, so he and his friends were my influence my whole life. My dad took me everywhere when I was a kid. We were always at the races or at a friend’s shop.

I grew up in a VW car dealership. My first business was detailing cars.

Why did you gravitate toward BMWs?

ured, why not, so I bought it. My first attempt failed—I tried to put it on an old Triumph motorcycle. I did some research, and I took a BMW motorcycle and attached the sidecar to that. I put about 30,000 miles on it the first year I had it, and I fell in love with it and decided it was time to build something on my own from scratch for the first time. Then my friends wanted side cars, so I built more.

What’s ahead?

I want to continue building fun vehicles for people, manufacturing my own parts and building my [company’s] name, Boxer Metal.

And I want to keep traveling. We love traveling.

Have advice for others who want to start their own business?

German engineering. Over-built and understated.

How did you end up building side cars?

The stress of making a living—I love that. It’s motivating to me. Calling the shots on my own creativity. And the freedom to come and go when I want.

What do you like about owning your own business?

Somebody offered me a really inexpensive side car. I had never thought in my life before that I’d ever want to ride with a sidecar, but I fig-

Journal A couple of people have suggested that I keep a journal as a way to express myself and release the pressure or somedamnthing. I kept a journal in the late-’70s to mid-’80s, six volumes altogether, and I read a few entries while I tried to work up a head of steam to do it again.

From Oct. 31, 1977: Backgammon is like life. From Dec. 24: Capitalism requires morality if it is to be of real service to people. Capitalism in the United States has begun to feed on itself. I really think we’re for it.

What skills will we need then?

January 9, 1978: Pure corn—I need a new page in the Book of Life. I’m going to have to turn this mother myself, though. I don’t know why I feel I must write something, even this stuff. Is it a bid for immortality?

I don’t know.

When I’m 90— Interviewer: If you can, sir, tell us what it was like in the old days.

Me, reaching for a crate: I just happen to have some notes I jotted down.

March 17, 1978: Jennifer (my ex-wife) used to be lousy at the use of profanity. She got much better

toward the end, though.

March 31, 1978: I think differently somehow. It must be the reefer. About a week ago I decided to give myself another chance. I used to think I knew what the odds were. Now I’m not so sure. I want to sell my thoughts; this just occurred to me. I talked to Toot yesterday about my lack of a quest. Her goal is to be a famous artist and live in her leather pants in her house on the beach in Jamaica. Amen.

She suggested I write. My mother was right. I have little self-confidence. I do want to write. I’m lazy, though, so it’ll have to be a short form.

April 25, 1978: One of the good things about growing older is that behavior and even character patterns become observable in people. Anybody can see them, most people, anyway. The Catch is that they seem to act in a cumulative way on our senses, i.e., you have to see lots of different people in order for your threshold to be reached, at which time something which many different people have in common becomes clear.

April 30, 1978: It has begun to dawn on me that there are lots of things that I’ve always assumed I couldn’t do, so I never tried. I must see to them.
