Words from the President

Your Excellencies, ladies and gentlemen, dear friends and cherished partners of Chile, it is my distinct honor and privilege to express my gratitude for your presence at the 2015 Awards Dinner of the North American-Chilean Chamber of Commerce. Welcome to this special night of celebration at the very heart of New York’s fall season, the city alive with the very dynamism that marks the ever closer relationship between Chile and the United States. Tonight both the fellowship and the business relationship between our countries are the first order of business. Indeed, the one could not flourish without the other. Your presence here tonight exemplifies both dimensions of this vital Chile-US connection.

Mario J. Paredes President

It is humbling to consider that we are but three short years removed from the 100th anniversary of the founding of the North American-Chilean Chamber of Commerce; and what a fruitful century it has been, with hard work and determination building up an international bond whose warmth and commercial success has few equals. Chile’s free economy and resilient democratic institutions make it one of the most reliable countries for US exports and imports in Latin America. Chile’s unique status as an economic leader and model in the region was fully recognized in 2003, when our respective governments signed the US-Chile Free Trade Agreement between our nations, which went into effect in 2004. Already in 2004, 85 percent of tariffs on our exports and imports were eliminated, and as of Jan. 1, 2015, the remaining tariffs have been scrapped as well. Such is the power of mutual trust and ingenuity in the exploitation— in the positive sense of the word—of open-market economies. The fruits of doing business are more jobs on both sides of the Atlantic and, particularly in Chile, growing corporate and small business success, which, in turn, translates into an increase of government revenue and private philanthropy—both key factors in eliminating the stubborn remaining pockets of extreme poverty in Chile. Amazingly, while US exports to the rest of the world increased by approx. 120 percent in the past decade or so, exports to Chile grew by more than 500 percent in the same period! Most recent data show that trade between our countries exceeds at least $33B—with some $22B in US exports and $11B in Chilean exports. We can be confident that, even as Chile is passing through an extremely difficult and unsettling political moment for both its government and opposition, the trade between our countries will continue to grow. Yet, there is no doubt of course that a transparent political

system in the service of the common good is the indispensable foundation for the continued flourishing of the Chilean economy. All of you here contribute to this amazing relationship between our countries by your hands-on work and support throughout the year. You make possible the work of the North American-Chilean Chamber of Commerce by insuring that the legal and financial framework remains in place—and evolves as needed— to ensure the continued success of the US-Chilean free trade relationship. Tonight we honor two very special individuals from among our growing international family of friends and business partners—two leaders in their field who exemplify the creativity and dedication that drive the success of our mutual grand enterprise: Kathleen C. Barclay is Principal at Asesorias KCB Ltda., a Chilean strategic consulting firm that specializes in the encouragement and creation of trade and a full range of business relationships between the US and Latin America. Her expertise covers not only trade and finance, but media, culture and academia as well. A former executive at J.P. Morgan Chase, she is fully at home in both countries and on both continents: she is also a Past President of the Association of American Chambers of Commerce in Latin America. Nicolás Shea is an exemplar of today’s business leader par excellence, an innovator, entrepreneur and start-up specialist. He brings valuable government experience to his current role as CEO of the Cumplo peer-to-peer lending platform. It is a particular honor to have with us tonight this business leader whose vision, creativity and leadership have inspired business men and women throughout Latin America to take the risk of embarking on new ventures. Your Excellencies, dear ladies and gentlemen, friends of Chile, thank you so very much for joining in this celebration of the work of our two honorees. Enjoy the food and drink, and make the best of the opportunity for fellowship our time together offers. Thank you!

NACCC - Annual Dinner 2015

Howard L. Vickery II

NACCC - Annual Dinner 2015

Howard Vickery specializes in the area of complex commercial litigation with most of his work involving international disputes. In his twenty-five years of practice, Mr. Vickery has acquired broad experience with conflict of laws, civil law legal systems, recognition of foreign judgments here and abroad, parallel judicial proceedings, the Foreign Sovereign Immunities Act, transnational discovery, proof of foreign law, provisional remedies, long-arm jurisdiction, forum non conveniens, and cross-border litigation generally. From December, 1999 to January, 2004, Mr. Vickery served as the lead counsel for Petroleo Brasileiro S.A. - Petrobras, the Brazilian national oil company, in an action against U.S. performance bond sureties and a consortium of Brazilian construction companies in the United States District Court for the Southern District of New York. The case involved claims and counterclaims in excess of one billion dollars for cost overrun and delay damages arising from the conversion of two offshore oil production platforms in Brazil. Experts in the case compared the platforms to NASA space projects in terms of technological sophistication. In describing the discovery in the case as "massive," the Court noted that that the parties exchanged more than a million pages of documents and took 110 depositions. After a two month bench trial, the Court awarded Petrobras $370 million in damages. The Court observed that the case" required an understanding of complex issues of naval architecture, construction contracts, performance issues, financial and accounting issues, suretyship law, Brazilian corporate law, and many other issues." Moreover, "the case was exceedingly difficult and pursued with skill and efficiency" by the Petrobras legal team. Mr. Vickery speaks Portuguese and is a director of the Portuguese Chamber of Commerce and the North American-Chilean Chamber of Commerce in New York. From 1978 to 1981, Mr. Vickery was a defense analyst in the Office of the Under Secretary of Defense for Policy. Mr. Vickery spoke on litigating international construction and performance bond disputes at the 2004 Offshore Technology Conference in Houston. He has written articles on drafting shipbuilding contracts, recovering assets from offshore asset protection trusts, money-laundering, international bank regulation, and judicial appeals of informal agency action.

Our History

• The North American-Chilean Chamber of Commerce, Inc. is celebrating this year its 97th anniversary. Everything began with the vision of Mr. Charles M. Pepper, who visited Chile in 1917.

• The New York Times reported on November 5th of 1930 about Mr. Pepper: “In 1917 he went to Chile as the representative of American firms and companies engaged in Chilean trade and the development of that country’s mineral resources. The Chile-American Association was formed, owing to this visit, to promote better understanding between Chile and the United States and as an unofficial medium of intercourse.”

• Summer 1918: Chile-American Association, Inc. (CAA) was founded by Charles M. Pepper. Mr. Pepper was the first president of the CAA from 1918 until his death in Nov. 4th of 1930.

• Lieut. Col. A. Kenny C. Palmer was the second director of the CAA from 1930 until August 28th of 1942.

• September 2nd of 1975: the Chilean-American Chamber of Commerce, Inc. (CACC) was incorporated in Delaware.

• August 12th of 1977: CACC changed its name to North American-Chilean Chamber of Commerce, Inc. (NACCC).

• February 19th of 1980: CAA & NACCC merged into NACCC.
