Seminar 1: Elements of a Successful Rule 26(f) Meet & Confer Sponsored by: National Bar Association Objective: This seminar will provide some key elements to cover in a meet & confer.

Seminar 6: The Effective Argument Sponsored by: Appellate Law Section Objective: This seminar will teach and enhance the legal skill of writing briefs for review by an appellate body. This CLE will cover the following skills: presenting the issue for review, writing a persuasive statement of facts, writing an effective argument, and legal ethics in appellate practice. The skills learned at this CLE will serve lawyers in writing other pleadings, including an argument filed in support of a motion presented to the trial court. This CLE will end with comments from an appellate judge on effective arguments.

Seminar 2: Trademark and Copyright Litigation Year in Review Sponsored by: Intellectual Property Section Objective: This seminar will inform the audience of the important legal issues surrounding U.S. trademark infringement cases that have made their way to the federal court system within the last year. Seminar 3: Mandatory Immigration Compliance Issues Employers are Ignoring Sponsored by: Immigration Law Section Objective: This seminar will focus on immigration related compliance issues beyond I-9. This session will cover legal issues that arise when hiring foreign workers. Seminar 4: Supreme Court Review of the 2012-2013 Term Sponsored by: Civil Rights Law Section Objective: To review the Supreme Court cases affecting civil rights jurisprudence in the recent term. Seminar 7: Ethical Considerations: Diversity & Inclusion and Compliance Sponsored by: Andrews Kurth LLP To examine the ethical considerations that attorneys may face when advancing diversity and inclusion strategies and confronting evolving employment law issues. The goal is for attorneys to be able address ethical considerations and leverage diversity and inclusion strategies to minimize the risk of exposure in U.S. Department of Labor audits and employment litigation. Seminar 8: Affordable Housing: Recent Legal Developments & Trends Sponsored by: Real Estate & Probate Law Section Objective: This seminar will provide an overview of how HUD, public housing authorities, state agencies and developers are working together to address the issue of providing desirable housing that is affordable to middle income, working class and lower income families. Topics to be covered include HUD/FHA multifamily loan programs, HOPE VI/Mixed Finance Programs for redevelopment of public housing, low income housing tax credits and various state and other federal housing programs. Seminar 9: How to Obtain and Navigate to a Successful Result in a Personal Injury or Complex Litigation Case Sponsored by: Region V Objective: The panelists will discuss how to successfully handle a personal injury case and steps that must be taken from the beginning to the end to obtain a successful result. CONTINUED Seminar 10: Prosecuting Patents that will hold up in Litigation Sponsored by: Intellectual Property Section Objective: This seminar will explore the interplay of patent prosecution and litigation by discussing lessons learned in recent patent litigation cases, and what resulting best practices impact patent prosecution. Seminar 11: The Ethical Implications of Transitioning In and Out of Government Positions Sponsored by: Government Lawyers Division Objective: This seminar will address the ethical implications of transferring in and out of government service. The panelists will discuss statutes, regulations and recent cases that govern the pre and post government employment process, such as seeking employment, recusal and disqualification, conflicts of interest and prohibition. Seminar 13: Your Secret's Safe With Me: Protecting Proprietary Information in the Digital Age Sponsored by: Corporate Law Section Objective:This seminar will equip outside and in-house counsel with the tools to advise their clients on the best practices and strategies for protecting the security and maintaining the confidentiality of their and others' proprietary information. Through real-life scenarios, attendees will learn from experienced faculty, about how to protect intellectual property and other proprietary information when contracting and working with third parties, strategies for securing confidential information internally and methods for protecting information in cyberspace.

Seminar 14: Family Law and Same-Sex Partners Sponsored by: Family Law Section Objective: The seminar will address Section 3 of the Defense of Marriage Act. Panelists will discuss the effects of this section and how it has legally affected married same-sex couples in the U.S. in terms of receiving various types of federal benefits, both as citizens and employees. We will also address same-sex adoptions and discuss how Full Faith and Credit is applied to same sex adoption decrees by states that allow for same-sex adoptions and also how equal protection has been applied in terms of the adoption decree and issues that arises after that decree has been executed. Seminar 15: Brady and the Law: Avoiding Prosecutorial Misconduct Sponsored by: Criminal Law Section Objective: This seminar will examine the Boundaries of Discovery under Brady v. Maryland. Seminar 16: Captive Insurance-An Emerging Practice of Law Sponsored by: Corporate Law Section Objective: This seminar will introduce an area of law to minority attorneys with which they may not be familiar, but which lends itself to various legal disciplines. Seminar 17: Re-crafting Your Drafting: How to Improve Your Drafting Skills and Make the Partners Praise Your Work Sponsored by: Young Lawyers Division Objective: This course is designed to take a beginning or mid-level associate's drafting of contracts, briefs and motions to the next level. It will provide key clauses that most contracts contain that will increase the contract's enforceability, and provide basic drafting and legal writing techniques that will make the partners praise the young lawyers' work. Key concepts covered including, basic organization of contracts, warranties, conflicts of laws, damages, arbitration, and catchall clauses. Case Studies will be based on Sports Law and Sports Arbitration. Seminar 18: Leverage Your Expertise: A Review of Tax Hot Topics That Impact Your Practice Sponsored by: Tax Law Section Objective: This seminar will explore the practice of tax law beyond a basic state or federal tax return. A multitude of factors, including the domestic economic environment, global considerations and the desire to leave a solid financial base for the next generation, insure that tax law expertise, encompassing many disciplines, will always be in demand. In particular, the session will address the different types of white supremacist and antigovernment, paramilitary groups and organizations. The session will include discussion of the legal and illegal activities that are important to the persistence of extremist groups and the different dimensions of an extremist mindset. The speaker will rely on his award-winning, co-authored book, American Swastika: Inside the White Power Movementʼs Hidden Spaces of Hate, and another book he is in the early stages of writing, Overreach: the FBIʼs Approach to Domestic Radicalization. The session will also feature firsthand experiences drawn from fieldwork observation and interviews with current and former members of extremist groups and criminal cases involv ing these extremists groups where the speaker has provided expert legal consultation. 10:30 a.m. ‒ 11:45 a.m. CLE Seminar IV: The Effects of Mass Incarceration and Overcriminalization Objective: Courts can address the problem of mass incarceration at sentencing. Although some scholars suggest that the most effective response may be through policy and legislative reform, judicial consideration of mass incarceration at sentencing would provide an additional response that can largely be implemented without whole sale reform. Mass incarceration presents a difficult problem for courts because it is a systemic problem that harms people on several scales̶ individual, family, and community̶and the power of courts to address such broad harm is limited.

NATIONAL BAR ASSOCIATION NOMINATIONS & ELECTIONS The nomination of candidates for Officers and At-Large Members of the Board of Governors of the National Bar Association (NBA) shall be by application to the Nominations Committee (Committee). An application may be made for one or more of the following positions: President-Elect, two Vice Presidents (two-year term), one Secretary (two-year term), and three At-Large members of the Board of Governors (two- year term) Each application must include the 2013 application for Nomination, which shall be signed by the nominee, the nominee’s biographical resume, and a statement prepared by the nominee that includes details of how the nominee meets the specific requirements for the office he/she is seeking, as outlined in the NBA Constitution and Bylaws. Any regular member of the association in good standing at the time of nomination who meets the requirements of the office sought, as stated in the NBA Constitution (Article VII and Article VIII) and Bylaws, shall be eligible as a candidate for election. To obtain a copy of the updated NBA Constitution and Bylaws and for application materials, please visit www.nationalbar.org or call (202) 842-3900.

Please mail (first class, overnight, or priority) or e-mail completed applications to the Chairperson of the Nominations Committee and to each member of the Committee. To be considered by the Committee, applications shall be postmarked or sent via e-mail on or before Wednesday, May 15, 2013 (11:59 p.m. EDT). In his/her application, the nominee must advise the Committee members of the time of his/her arrival in Miami Beach so that the Committee will be able to develop an interview schedule to accommodate all of the nominees for each office. All nominees must be available on July 27, 2013, for his/her interview at the time assigned by the Nominations Committee. The Committee will conduct all interviews on Saturday, July 27, 2013 (9:00 a.m. until 6:00 p.m.). The interview room location will be posted at the Fontainebleau Miami Beach Hotel. In addition, the Nominations Committee will hold a Candidates’ Forum on Sunday, July 28, 2013, from 1:15 p.m. until 2:15 p.m. The NBA Elections will be held on Monday, July 29, 2013 at the Fontainebleau Miami Beach Hotel. NATIONAL BAR ASSOCIATION ENERGY FORUM MONDAY, JULY 29, 2013, 2:15 P.M. - 5:30 P.M. The International Global Energy Connection: How The Global Energy Industry Impacts Us Domestically As a result of increased global energy demand, a new global energy landscape has started to gradually develop. This new global energy landscape is being redesigned by the global spread of natural gas production, continued rapid growth of alternative energy sources, the resurgence of oil and gas production in the United States (notably fracking), and the retreat of nuclear power by many countries. As a result, new policy initiatives have been developed in a concerted effort to address the new landscape and to improve global energy efficiency. This panel will address what the new global energy landscape, recent foreign investments and new policy initiatives mean for domestic economic development, energy security, and environmental sustainability. The Energy Update: What始s New In Energy Regulation, Technology, Employment, and Environmental and Safety Issues With the increase of domestic natural gas production, oil and gas production and increased usage of alternative energy sources, new energy regulations are being developed to address the new energy landscape in the United States. The recent upturn in domestic energy production, particularly fracking, has necessitated the need for new technology and as a result, spurred vital economic activity. This panel will address current and pending energy legislation, new technology relative to the energy industry, the economic outlook resulting from the new domestic energy landscape, and environmental and safety issues created by domestic energy development. Minority Owned Companies and How They Can Service The Energy Community In the field of energy as in many others, supplier diversity is essential to a productive workforce. Similar to other fields, energy companies始 have recognized they cannot retain the best talent unless they recruit across diverse groups who put a priority on safety, innovation, and reliability, and of course, demonstrate competence and add value. This panel will address energy companies supplier diversity programs and how these programs strive to bring more women, minority and service-disabled veteran-owned business enterprises and small businesses into their supply chain and how said groups are essential for creating a productive workforce.
