Don’t Hold Attempted Payments in the Drawer EVICTIONS CAN BE time-consuming and costly. The last thing

we need is to have the process stopped in its tracks by accepting, either knowingly or accidentally, any form or amount of payment. Tennessee Code Annotated 66-28-508, states in its entirety: “If the landlord accepts rent without reservation and with knowledge of a tenant default, the landlord by such acceptance condones the default and thereby waives such landlord’s right and is estopped from terminating the rental agreement as to that breach.”

This statute is crystal clear. DON’T DO IT! If you are aware of a tenant’s breach of lease and you accept rent without reservation, you can no longer evict for that breach. Period. Don’t accept rent without reservation if you wish to move forward with the eviction process. So what do you do if the tenant comes to the rental office with a payment after you are aware of their breach? Simply do not accept the payment. You can explain to them as politely as possible that due to their breach of the lease, their attempted payment cannot be accepted. What if the tenant drops a payment on your desk and quickly leaves the office? There is no need to chase the tenant down and force them to take the payment back. Immediately document the time the payment was received, make a copy, and forward the original payment to your attorney without delay. The tenant will be made aware that the payment has been accepted with reservation and that the eviction process is continuing. What if the payment appears in the drop box? The same procedure applies. Document the time the payment was received or discovered, make a copy and forward the original to your attorney. The longer you wait, the more likely it is that a judge may interpret that delay as your acceptance without reservation. Be sure not to mark the payment “Received” or stamped “For Deposit.” Do not write the tenant a receipt. You must do everything possible to document and make clear the fact that the payment was not negotiated or applied to the balance due. Please note that this statute is triggered as soon as you are aware of a breach of the lease. If a tenant is harboring an unauthorized tenant, an unauthorized pet, or they’ve had noise complaints over the weekend, acceptance of rent will void your right to terminate tenancy for those breaches. Be careful! Tenants, their attorneys, and the judiciary are well aware of this statute and have successfully used it countless times to sabotage an otherwise legitimate eviction case. They will attempt to have a payment accepted any way they can. They may drop a payment in the night drop box, they may try to hand a payment off to a maintenance technician making a repair, or they may have a friend try to leave it at the desk. Be sure your entire staff is aware of your pending evictions and your policy regarding rent payments attempted or received after a breach of the lease. Finally, we’ve previously written about these precautions regarding electronic payments. Keep in mind that the statute applies equally to these payment systems, and they also should be closely monitored and maintained to prevent online payments from spoiling your eviction case. Acceptance of payments after being aware of a default is and always has been the best friend of a tenant who has breached their lease. Educate all staff, especially new members of your team, as to the dangers of the waiver of right to terminate statute. Communicate with all staff members as to those tenants who are in breach of their lease. Then, REACT AND DON’T HOLD ATTEMPTED PAYMENTS IN THE DRAWER! GN AA N E WS & EVEN TS

Tuesday, January 12, 2016. In ceremonial fashion, the legislature began with the swearing in of newly-appointed or newly-elected members to take the place of members who have stepped down or resigned. In both legislative bodies, Republicans still hold their strongest margins in history with a 73-26 majority in the House and a 28-5 majority in the Senate. Following the conclusion of some general housekeeping business, both the Senate and the House hit the ground running with bills heard and voted on in both floors, and several bills heard and voted on in committee meetings throughout the week. With a projected adjournment date of the week of April 11, this legislative session is certain to move quickly – potentially even quicker than in years past. The bill filing deadline was set for Thursday, January 21, and the Senate and House committees will begin concluding their business the week of March 14. Consequently, a great deal of work is required to be done in a very short period of time to inform our state legislators of the consequences of their proposals to ensure that policy changes remain positive and business friendly. TAA’s objectives remain to coordinate support for or opposition to legislation that affects multi-family housing in the state of Tennessee and to enhance the legislative involvement of the industry at the state level. As bills are filed, TAA will continue to identify and analyze bills of interest to the multi-family housing industry, and will keep you updated on these bills, their impact, and their progression throughout the committee process. Of specific interest to TAA is the issue of affordable and workforce housing. At both the state and local level, TAA and GNAA continue to focus their attention on proposed inclusionary zoning policy changes. At the local level, the proposed amendments to the Zoning Code incentivize inclusionary housing with any additional development entitlements requested by a development, including bonus residential floor area through Adaptive Residential Uses, Special Exceptions for height, zone changes, and the Downtown Code (DTC) bonus height program. GNAA is continuing its work with the Metro Planning Department and the Metro Council to address questions and concerns with the proposal. At the state level, TAA is pursuing legislation that would clarify the rent control restriction currently in the Code to specifically include mandatory inclusionary zoning policies. The legislation has been drafted and Senator Ferrell Haile and Representative Glen Casada will sponsor the bill. The legislation still allows local governments to implement incentive-based, voluntary programs. Both efforts have gained a lot of support from other interested groups including the National Federation of Independent Business, the Home Builders Association, and the Realtors Association. Also of interest to TAA is legislation that would allow a victim of domestic violence additional protections under the Landlord-Tenant Act and under the eviction statutes. The bill has been introduced by the City of Chattanooga’s Mayor’s Council for Women and is somewhat different than bills we have seen introduced in the past. It attempts to preserve the contractual rights detailed by the lease; however, there are still several concerns with the proposal, specifically with liability. Currently, work is being done to address these concerns, and to try to find compromise language that all parties can support. Finally, please make plans to attend the 2016 NAA Capitol Conference on March 8-9, 2016. TAA is in the process of scheduling appointments with all members of the Tennessee Congressional Delegation.

When we decided to join the GNAA in the beginning of 2015, we truly didn’t know what to expect. Much to our hopeful encouragement, Green Village Recycling was graciously welcomed into the GNAA with open arms, and we are sincerely grateful. Through our paticipation in committees, events, networking with other Associates and the support of the GNAA staff, we have experienced one of best years ever for Green Village Recycling. The support and resources afforded to us through our involvement in the GNAA are invaluable. Many of the relationships we have established may never have come to fruition without the networking opportunities in the GNAA. We offer single stream recycling, junk removal service, electronics recycling and sustainability consultation. Well, we quickly realized that many of our fellow members had a firm grasp as to the importance of reduce – reuse – recycling. At the time, as a new member, this was very encouraging! There are too many people to individually thank for helping Green Village Recycling get started with the Greater Nashville Apartment Association, but please know we very much appreciate the kind reception and the tremendous help along the way. Joyce brings a wealth of apartment community experience and understanding of the need for good professional service in your communities. Joyce began her career in the apartment industry in 1986. She has been active in the Greater Nashville Apartment Association since 1989 serving on the Board of Directors, working on numerous committees and co-chairing the very successful and exciting Trade Show Committee along with her partner in crime, Jill Carpenter. She was elected as GNAA Chairman of the Board in 1995, and is a lifetime board member. Joyce was President of the Tennessee Apartment Association in 1998, and ARM Chairman of Chapter 71 in 1993. She is unique in that she also brings experience from the vendor perspective of working with on-site professionals to bring about solutions for the community crossing over to the vendor side several years ago as Marketing Consultant for an advertising company. Joyce’s greatest success stories center around her two children, Bryan and Rachelle; and three grandchildren—Bryan as a vendor, Rachelle in management, and granddaughter Bryanna in management. Joyce is a very proud mama and Gaga.
