Tittle Insurance Explained

Title is the legal term for ownership of property. Buyers want “good and marketable” title to a property - good title means title appropriate for the buyer’s purposes; marketable title means title the buyer can convey to someone else. Prior to closing, public records are “searched” to determine the previous ownership of the property, as well as prior dealings related to it. The search might reveal, for example, existing mortgages, liens for outstanding taxes, utility charges, etc., registered against the property. At closing the buyer expects property that is free of such claims, so normally they must be cleared up before closing. For example, the seller’s mortgage will be discharged and outstanding monetary expenses (such as taxes and utility charges) will be paid for (or adjusted for) at closing. Sometimes problems (or defects) regarding title are not discovered before closing, or are not remedied before closing. Such defects can make the property less marketable when the buyer subsequently sells and, depending on the nature of the problem, can also cost money to remedy. For example, the survey might have failed to show that a dock and boathouse built on a river adjoining a vacation property was built without permission. The buyer of the property could be out-of-pocket if he is later forced to remove the dock and boathouse. Or, the property might have been conveyed to a previous owner fraudulently, in which case there is the risk that the real owner may come forward at some point and demand their rights with respect to the property. Title insurance policies can be issued in favour of a purchaser (on new/ resale homes, condos and vacation properties), a lender, or both the purchaser and lender. Lenders will sometimes require title insurance as a condition of making the loan. Title insurance protects purchasers and/or lenders against loss or damage sustained if a claim that is covered under the terms of the policy is made. The premium for title insurance is paid once (at the time of purchase). Generally speaking, in Canada the purchaser of the property pays for the title insurance, though there can be situations where the seller pays for it. Some policies automatically cover both the purchaser and lender; others will cover both for a small additional fee.

Land Transfer Tax Purchasers in most large Canadian centres can add Land Transfer Taxes to their list of closing costs. Unless you live in Alberta, Saskatchewan, or rural Nova Scotia, land transfer taxes (or property purchase tax) are a basic fact of life. These taxes, levied on properties that are changing hands, are the responsibility of the purchaser. Depending on where you live, taxes can range from a half a per cent to two per cent of the total value of the property. Many provinces have multi-tiered taxation systems that can prove complicated. If you purchase a property for $260,000 in Ontario, for example, .5 per cent is charged on the first $55,000, 1 per cent is charged on $55,000 - $250,000, while the $250,000 - $400,000 range is taxed at 1.5 per cent. Your total tax bill? $2,375.00.

Make an

Offer

When it comes time to make an offer you will require current market information and assistance in drafting your offer. You will need a Real Estate Professional. A Real Estate Professional will communicate your Offer to Purchase to the seller, or the seller’s representative, on your behalf. Sometimes there may be more than one offer on a property at the same time. A Real Estate Professional can guide you through this process.

Firm Offer to Purchase Usually preferable to the seller because it means buyers are prepared to purchase the home without any conditions.

Conditional Offer to Purchase Usually means there are one or more conditions on the purchase, such as “subject to home inspection”, “subject to financing” or “subject to sale of buyer’s existing home”. The home is not sold until all conditions have been met.

Acceptance of Offer An Offer to Purchase is presented to a seller who may accept the offer, reject it, or submit a counter-offer. The counter-offer may be in reference to the price, closing date, or any number of variables. Offers can go back and forth until both parties have agreed to terms or either side ends the negotiations.

Closing Costs Closing costs are a list of charges your lawyer presents to you on the closing date of your home. Many people are surprised at the additional costs over and above the price of the home. According to the CMHC and Genworth Financial you should have at least 1.5% of the purchase price for closing costs in addition to the down payment (have around 2.5% to be on the safe side). The costs vary among provinces and cities. Below you will find a brief explanation of these costs. Please note these are some of the closing costs you may encounter depending on your specific situation. Use this as a guideline then talk with your lawyer who can provide a more realistic estimate for your situation.

Appraisal Fee Generally Required with New Homes An appraisal provides the lender with a professional opinion of the market value of the property. This cost is normally the responsibility of the homeowner and it can cost between $100 - $300.

Home Inspection Fee A professional inspection of the home, top to bottom, is for the benefit of the buyer. A home inspection can cost anywhere from $300 - $400 and is well worth the investment. When hiring a home inspector make sure the inspector has liability insurance just in case they overlook something.

Fire Insurance Mortgage lenders require a certificate of fire insurance to be in place from the time you take possession of the home. The amount required is generally the amount of the mortgage or the replacement cost of the home. This cost can vary on the property size, amount of coverage, the insurance company and the municipality. The cost can vary anywhere from $250-$600 annually for most properties.

Provincial Sales Tax on Mortgage Insurance If your mortgage is insured, (CMHC or Genworth Financial), you will be required to pay the applicable taxes on the insurance premium on closing. While the insurance premium can be added to the mortgage amount, the tax must be paid at closing.


Land Survey Fee or Title Insurance Fee A recent survey of the property is usually required by lenders. If one is not available the cost can range between $600 - $900 for a new survey. In lieu of the survey most lenders today will accept title insurance which can cost considerably less.

Legal Costs and Disbursements Lawyers and notaries charge fees for their services involved in drafting the title deed, preparing the mortgage, and conducting the various searches. Disbursements are out-of-pocket expenses incurred during the process such as registrations, searches, and supplies. (The legal cost can be from $1,000 to $1,200 Plus HST)

Land Transfer Tax Most provinces charge a land transfer tax payable by the purchaser. The amount varies depending on the province. Land transfer tax is based on the purchase price. First time home buyers purchasing a new or re-sale home may be entitled to a refund. (See Page 10 for Land Transfer Tax Cost for different properties)

New Home Warranty In most provinces new homes are covered by a new home warranty program. The cost to the purchaser for this warranty is approximately $600 and should the builder default or fail to build to an agreed-upon standard the fund will finish or repair the deficiencies to a maximum amount. HST HST is payable on the purchase of a newly constructed homes only. If you are purchasing a new home make sure you know who pays this, you or the builder. On the offer the purchase price will say “Plus HST” or “HST Included” and who gets any HST rebates. Many builders have included this cost into the purchase price so the buyer does not have to come up with it at closing.

Closing Adjustments An estimate should be made for closing adjustments for bills the seller has prepaid such as property taxes, utility bills, and other charges. Any bills after the closing date are the responsibility of the purchaser. A lawyer will let you know what they are once the various searches have been completed.

What To Do To Prepare The following are some key factors to keep in mind when listing your property for sale: 1. CURB APPEAL Keeping your landscape pristine, and adding creative touches to your yard (such as colourful annuals or hanging baskets), and doing a simple clean up such as: cutting the lawn, removing garbage & debris and putting away recycling boxes, can create an immediate impact on passers-by and potential buyers.

2. PROPERTY REPAIRS AND UPDATES Perform minor repairs & updates as needed, simple things such as repairing foggy windows, and putting a fresh coat of paint in the most frequently used rooms will instantly brighten up the property.

3. CLEANLINESS AND STAGING We can’t stress this enough: Keep your property uncluttered, sweet-smelling and well-lit from top to bottom. Pay attention to details: put away kitty litter, place a vase of fresh flowers near the entryway, pop a batch of cookies in the oven, have your carpets cleaned. Accepting an Offer The Price is Not Always Right “The higher the price, the better the offer” Do not let yourself be fooled by this popular misconception. Price is not always the determining factor when accepting an offer for several important reasons: the initial offer is usually not final, and there are a number of terms and conditions that may influence the final outcome of a price. Negotiating The Right Way We take the ethical responsibility of fairly negotiating contractual terms very seriously. It is our job to find a win-win agreement that is beneficial to all parties involved. You may even have to deal with multiple offers before ratifying the one you judge to be the most suitable for you – and as your agents, we will guarantee a thorough and objective assessment of each offer to help you make the right choice.

The Offer Process Once a buyer decides that your home is the right one for them, they will put in an offer. At this point your REALTOR® will discuss with you the terms of the offer and advise you on what to do next, based on your situation and needs. You may even receive several offers at once, in this situation your REALTOR® will guide and advise you but it is ultimately your decision when determining which offer you’d like to work with. Typically offers will go back and forth a few times between the buyers and the sellers as you try to agree on price and terms. When an offer goes back and forth like this it is referred to as being in ‘signback’. Any changes from the original offer will be documented in writing, although in extenuating circumstances negotiations will continue verbally until they can be documented in writing. This is where your REALTOR®’s negotiation skills and experience really go to work for you!

Some Important tips to keep in mind to streamline the process: Keep written records of everything For the sake of clarity, it will be extremely useful to transcribe all verbal agreements including counter-offers and addendums, and convert them to written agreements to be signed by both parties. We will draft all of the paperwork for your sale and make sure that you have copies of everything. Stick to the schedule Now that you have chosen your offer, you and the buyer will be given a timeline to mark every stage in the process of closing the real estate contract. Meeting the requirements on time ensures a smoother flow of negotiations and also ensures that each party involved is not in breach of their agreements. Conditions, Inspections & Appraisals The Conditional Period Once the offer is accepted the conditional period begins. All of the conditions in the offer must be met before it can become firm and the deal finalized. Most offers contain the following conditions: • Finance: Mortgage approval for the purchase will need to be obtained by the buyers for this condition to be met. • Appraisals: Expect an appraiser from the lender’s company to review your property and verify that the sales price is appropriate. • Inspection: A professional home inspector will thoroughly check the home and let the buyers know if there is anything to be concerned about. The inspection will be scheduled by the buyer’s agent. • Insurance: Buyers who are obtaining a mortgage, are required by their lender to purchase insurance on the property. And sometimes: • Sale of Purchasers Property or SSPIf your buyers are purchasing a property and still need to sell their current property they might make this condition part of their offer. Your agent will guide you and help you decide whether to accept an offer with this condition or not, and what type of timeline you will allow if you do accept it. Depending on the outcome of the inspections, one of two things may happen: • Either each milestone is successfully met and the conditions will be removed, bringing you one step closer to the closing; or • The buyer, after reviewing the property and the papers, requests a renegotiation of the terms of the contract (usually price). • How do you respond objectively and fairly to the buyer when a renegotiation is demanded, while acting in your best interests? This is when a professional listing agent can make a real difference in the outcome of the transaction. Having dealt with various property sales in the past, we guarantee our expertise and total commitment to every customer, no matter what their situation is. When all of the negotiations have concluded, conditions have been met and the appropriate paperwork is signed and submitted the offer is considered firm.

Once an Offer to Purchase has been accepted, the agreement enters the conditional period. Now is the time when all of those conditions laid out in the contract must be fulfilled in order for the deal to go forward. Once all conditions are filled, the deal is said to be firm.

Closing The Final Walk-Through More of a formality than anything else, the final inspection takes place anywhere from a few days before closing to the day before; The buyer visits the property to verify that all is in working order, everything is the same as when the buyer last viewed the property, and that there are no extra items left behind.

Cancel Home Services & Utilities We will provide you with a list of useful numbers for you to contact for the termination of home services & utilities before closing day.

Be Prepared We are ready to assist you should an unforeseen glitch pop up, even at this last stage. If something at the property breaks down, or some other minor issue arises – there is no need to worry! We have encountered these problems before so we know how to handle them efficiently and in a stress-free manor.

Closing Day – What to Expect The biggest misconception when it comes to closing is that come closing the new owners get the keys right away and can start moving in, although this would be ideal it’s simply not the way things work. In order for the keys to be passed from the seller to the buyer you have to wait for the title to be transferred. The title transfer is handled by your lawyer, who is your biggest ally come closing day. Your lawyer will notify you after the title has transferred. This generally happens between 1:00 and 5:00 PM. What a lot of people aren’t aware of is that as soon as the title has transferred, legally the house is no longer yours and you must vacate the premises. Because you can never be sure what time the title will transfer we recommend, if possible, to try and have everything packed and out of the house the day before closing or the morning of. This will just help to keep closing day as stress-free as possible.

Once the title has officially transferred, it’s time to celebrate; your house has officially sold and you can move on to your next stage in the property ladder!
