With government plans to establish a monitored and accountable rental sector, regulated agents are leading the way for landlords in the city.

In a move that went relatively unnoticed amidst the furore of the expenses scandal, the government recently published proposals to change the way the private rental sector is managed. These proposals, which include plans to introduce licensing for all landlords and the regulation of all lettings agents, came in light of the Rugg review, a report into the private rental sector undertaken by the Centre for Housing Policy at the University of York. Some critics believe the move, which 38 Your Move

is forecast to cost billions to implement, would tie up the sector in red tape and bureaucracy. Supporters suggest compulsory regulation is long overdue and would root out rogue elements in the industry. SETTING THE STANDARD ARLA, the Association of Residential Lettings Agents, was established in 1981 as the professional and regulatory body for lettings agents in the UK. The organisation was founded on the premise

that the requirements of residential lettings markets were so detailed and specific that a separate organisation was required to promote standards in the ever growing sector. ARLA now has 3,500 member offices throughout the UK, with membership granted on the proviso that agents demonstrate a thorough knowledge of their profession and conduct best management practice. The association is able to measure this by the courses and qualifications it provides to agents.

Entrepreneurs’ tax relief – the problem with rental The office and accounts manager Cara Bailey, City Residential Cara Bailey, office and accounts manager at City Residential, took a detour from studying sports development to discover her flair for property. Cara has been thriving in the city centre office now for five years. How did you get into property? I was working at a sandwich shop opposite the City Residential offices whilst finishing off a university course in sports development. People from the City Residential office came in for lunch. I discovered that there were job vacancies available. I applied for a job as office junior, but only did it for a week before I was moved to the lettings side of the company as a property manager. How has your role progressed? Six months later I was promoted to lettings advisor, and then began to do accounts for the lettings department. I now manage accounts for the whole company and have been promoted to office manager. I also run the furnishings side of the business which includes interior design of apartments for sale or let, as we are able to provide full packs for landlords, investors, first time buyers or serviced apartments. What would be on your summer wish list? I would love some air tickets for my boyfriend and I to jet off to Cyprus or Egypt. It would be great to get a tan, enjoy the sun, sea, and sip some strawberry Daiquiri cocktails whilst sampling the nightlife!

Q. I own a successful retail business, trading as a limited company, which I am planning to sell in a few years time. The properties which the business uses are owned personally by me, and the business pays me rent. I was banking on only paying 10% tax when I sold the business and properties but someone has told me the rules have changed. What is the position? A. When the Chancellor originally announced the New Entrepreneurs’ relief in early 2008, the rules contained a number of important differences from the old ‘Taper Relief’ regime. One of those related to property (usually land and buildings, but also occasionally plant and machinery) held outside the business. Under the old Taper relief rules, subject to all other conditions being met, disposal of these assets would attract tax of only 10% even if they had been let to the business throughout the period of ownership at full market rent. Holding assets in this way and charging rent became a common set-up because it minimised tax through the life of the business and also eventually upon its disposal. This changed in April 2008, because the new Entrepreneurs’ Relief regime treats such assets as ‘investments’, i.e. owned personally and let at full market rent by the owner, which means they no longer qualify for relief.

Q. Is there anything I can do now to improve my position? A. Potentially yes. The new rule is that that if a property is let to the business for rent then only the rent paid on or after the 6 April 2008 will be taken into account and also the extent to which the rent paid falls short of the full market rent will also be taken into consideration in the calculations. In your case, if the property will be sold at the same time as the business and you will not utilise your £1million Entrepreneur’s Relief limit against the business itself, then you may need to stop charging rent as soon as possible. You should speak to your accountant or tax advisor as soon as possible – as always good advice will be critical to optimise your position.

This will have a negative impact on not just the student housing market but on the job market, as bright but less well off students won’t be able to pursue graduate level careers, affecting social mobility. The Labour government conveniently forgets their own university educations were paid for by the taxpayer.”

Will rising fees stop students moving out? As tuition fees rise but student grants and borrowing remains fixed, will the shortfall of funds have a negative impact on the student housing market?

“No. If students can’t afford the rentals commanded due to a drop in income, we may see the return of the landlord parent. This produces an improvement in property sales as well as offering potential management opportunities for agents. The less savoury landlords are then eased out; a development which should be positively welcomed.”

“No, I think that the squeeze on student’s finances may have a positive effect on the housing market in Liverpool. As the pool of students that ‘go away’ to University inevitably becomes smaller, all things being equal, Liverpool will represent a value for money alternative to further education in more expensive cities, particularly to parents.”

“Yes, definitely. Many students in Liverpool’s universities are from the city, and they move into student properties in the city centre or suburbs just a matter of a mile away from their parents’ homes. With rising costs, they’re unlikely to continue being able to do this. With a £40,000 student debt after finishing their course, which could take them the rest of their career to pay off, it’s also likely to affect the first time buyer market.”

Dealing with the mortgage company first. There are some things that you can do if you are in trouble paying your mortgage. There are various guidelines which have been produced and the lender is expected to comply with these guidelines. If the lender does not comply, or is otherwise unreasonable in pursuing a possession claim then you can tell the Court about this. In addition, most lenders have agreed with the government not to bring possession proceedings unless the mortgage is at least three months in arrears. However, this does not apply to all mortgages and does not apply to all lenders. You should try and negotiate with the lender to come to an arrangement for the payment of any outstanding arrears as soon as possible. The lender is under an obligation to

The smaller room is where I do all my ironing so I suppose it’s a sort of utility room! We’re planning to turn it into a nursery when we have kids. The other room is for anyone who stays.

Do you have any outdoor space? We have patio doors leading to quite a big garden at the back. We’ve got a lot of space to work with, so my partner is going to put in decking and a rockery area. At the front there are bark chippings and a small lawn.

First time buyers Sam Foley, 22, and Mike Benson, 25, recently moved to a three bedroom end terrace property in the Montreal Gardens development in North Huyton. And the bathroom? The bathroom has a stone effect wall and floor tiles with lovely white units. There’s a bath, shower, toilet, sink and a black mosaic mirror we bought in IKEA.

What’s in the living room? We have a black coffee table from the Look Again catalogue and a 42 inch plasma screen TV with full surround sound. Our two black couches from the Empire Stores catalogue are probably my favourite items in the house.

Take us into the kitchen... It’s a fully fitted kitchen, with black flooring and work surfaces, wooden units and a nice chrome sink.

What would be your dream buy? I’m not too sure about that as I think we have everything we need! I think a wet room would be nice though.

What’s your theme? Orange and black are the predominant colours in the living room. We’ve got a large black vase with big orange flowers on it. On one wall we’ve hung a picture of a lake and the other features a photograph of black and white boats, so it’s got a bit of a waterside theme.

For the majority of those who grew up in the ‘80s, the loud shirts and wacky antics of Timmy Mallett will be entrenched in their minds forever. The ‘Wacaday’ presenter was the main attraction for young viewers during their summer holidays, and even managed to secure a place at the top of the charts with an infamous song about a polka dot bikini. Years later he was thrust back into the national consciousness with an appearance on ‘I’m a Celebrity...Get Me out of Here!” and now the man with the mallet is in Liverpool to raise funds, and the roof, for the disability charity Children Today.

Mallett’s

palette What brings you to the city? I’ll be up to host ‘It’s a Knockout’ at the Riversdale Police Club to raise funds for Children Today. It’s a fun game if you don’t mind getting soaking wet and covered in foam. My role will be the wielder of the mallet. I was there last year and I’m thrilled to bits to be doing it again. It’s guaranteed to be a day of good fun. Tell us a little about the charity... I’ve been involved with them for 18 months and I’m very impressed by their dynamism. What I like about them is that they help kids straight away and they focus on what’s needed now. The children need any help they can get and it was great that I could raise £20,000 for them when I was doing ‘I’m a Celebrity’. Do you like getting out and about around the country? I love it. Whether it’s doing a show, something for charity, or hosting an art exhibition,

I feel that I’m a very lucky man because I get to travel all over. In fact my many trips are where I find the inspiration for my art. You’ve developed a growing reputation as an artist. How long have you been painting? I’ve always loved art. I used to take the paints on Wacaday but now I can put a bit more time and effort into it. That doesn’t mean I’m a bore with it, I can just give it a bit more focus. I held a recent exhibition of my acrylics and water colours in Essex which was really enjoyable and I’ve got another exhibition coming up in Eccleston. People don’t often realise that I’m an artist. Is painting a way to relax? No, I don’t find it relaxing. It’s a lot of hard work and all about concentrating the mind to make sure you’ve got it right. These things don’t necessarily come easy. Who’s your inspiration? Rolf Harris and I are good

mates. We speak on an almost daily basis. In fact, his is the next call I’ll make today before he goes off to play at Glastonbury. Which entertainers do you admire at the moment? CBBC have a number of great shows and I like a lot of the double acts such as ‘Dick and Dom’ and ‘JK and Joel’. We’ve got a lot of new talent coming though and we should encourage it. What’s been the highlight of your career? I think ‘Itsy Bitsy’ getting to number one was pretty amazing and I also love the fact that my paintings are so warmly received. What’s been your most memorable moment in television? Bashing Margaret Thatcher with the mallet has to be up there. I met her when she was prime minister and she reached for the mallet and asked, “What does this do?” I just let her have it. What was the jungle experience like? I enjoyed it. I love the great outdoors. The deprivation is quite entertaining. You do get hungry and tired but that’s the easy bit. The hardest part is dealing with the other people. It isn’t easy but of course when you are watching it’s hilarious. I do like to have a laugh, so moments like Kilroy getting covered in gloop keep you entertained. What’s next for you? I’ve become a patron at St Deiniol’s Library in Hawarden through a family connection. It’s the only prime ministerial library in the UK and well renowned internationally. I’ve become involved in raising money for a new addition to the library – an Islamic Reading Room and Religious Resource Centre. Our feeling is that in this day and age we need some sort of understanding with each other. I think we should all be getting on with each other

because you never know when it’s going to end. Any plans to do panto this year? I’d like to do panto again this year but the family are coming from all over the world to enjoy a Hogwarts style Christmas as caretakers at St Deiniol’s. I’d love to do a panto at the Liverpool Empire though. That would be my dream venue to perform.

One of the bars, which we used to go into, had fantastic colourful glass chandeliers with lots of beads wrapped round them. I loved the lights and would like to have them in my home. Do you know anywhere that may sell similar lights?

Without seeing the lights it’s really hard to direct you to the right supplier. However, Hiccup Gifts at www.hiccupgifts.com has a really glamorous multicoloured glass chandelier. The light with its Leitmotif design has six arms and is draped with colourful beads. It sounds similar to the lights, which you have seen on holiday. I would definitely suggest that you have a look online.

Boxing Clever I’ve recently moved, and the bathroom really needs decorating. There are some exposed pipes in one corner, which look really ugly! Do you have any ideas on how to disguise these? Boxing in is usually the best way to hide exposed pipes. The job is quite simple to do yourself if you are good at and confident in your DIY skills, but if not I would recommend using a good joiner, as the joints need to be as neat as possible for the new addition to merge as part of the wall. If you’re attempting the job yourself, I would use plywood and be as accurate with the measurements as possible. If you have trouble getting the edges to fit smoothly against the wall, use a good quality filler. Finally I would paint the boxing in the same colour as your walls to disguise those pipes completely!

Go for Graphics I’m living in a rented apartment in town. My landlords are fantastic but have said that if I make any changes to the apartment, I would have to make good before I leave in order to receive my full deposit. The walls in the apartment are painted white, and I would like to add some colour or pattern without spending a great deal of money or causing any damage to the property. Do you have any ideas?

For a simple arbour design, dig the postholes around 30 inches deep in your chosen location and fill the first few inches with gravel for drainage. Plumb the posts with a level and hold in place with foundation stakes before setting in concrete. When the concrete is dry pull out the foundation stakes and top the holes with gravel. Attach the beams with stainless steel washers and screws and do the same with the crosspieces, spacing them evenly on top. Make the arbour more attractive by first cutting an interesting design into the end of each beam and crosspiece. Top tip – Try incorporating a seat into your desired design.

A Parr-fect team An ambitious new team has taken over operations at Parr Street Studio’s Studio 3. Beatmatch Productions hopes to nurture local talent at the Liverpool studio, which has housed recording sessions from artists such as Coldplay and Oasis. Beatmatch managing director George Tudor-Williams commented: “We want to create new music in Liverpool. There are good new artists out there and we want to help them get a foot in the door. The main part of our plan is to give something

back to the city because it has given us so much.” The Beatmatch team, which also includes producers Chris Deas and Richard Turvey, met while studying at LIPA. Aside from its more conventional uses, the newly refurbished studio will also host corporate team bonding exercises. George added: “People tend to feel least confident when they’re singing in front of people, so we feel the studio offers a unique opportunity for team building.”

Table Talk //// LUCY OLIVER INTERVIEWS MIKE BLACK AT THE SWAN INN IN AUGHTON

The newly refurbished Swan Inn in Aughton has been drawing attention for its interior fit-out, and is also enjoying a warm reception for its fresh, cookedon-the-premises, locally sourced produce, and traditional ales. The drive to Aughton, near Ormskirk, where I meet Mike Black of Blacks Estate Agents, offers a welcome rural retreat from the city and from Mike’s Bootle office, where he’s been based for five years now. Covering the area between Kirkdale, Crosby and Aintree, Blacks sells houses from the lower end of the market upwards, catering for first time buyers and expanding families, right up to more expensive properties. Sales have been coming in pretty quickly of late: “Things have been picking up a good deal. Dealing for the most part with cheaper properties, my business hasn’t been as badly affected as others’, but it is starting to move more quickly again now.” With four staff members in the Bootle office and working in partnership with Platinum lettings agents, Blacks is the first port of call for sales in the north Liverpool area, with a

particular appeal for first time buyers and those requiring a one stop shop, in-house service. Mike opts for the Thai fishcakes to start, which arrive in a portion of three with chopped fresh peppers and salsa. I choose the Bury black pudding which, I’m told, uses the head chef ’s spice mixture in its recipe, topped with bacon and a fried egg. We choose to share and sample the adventurous combination of cultures as we discuss Mike’s varied career, which has seen him work in hospitality in Tenerife before choosing to get into property. From joining Collertons as a trainee manager, Mike quickly rose through the ranks to become area manager for Liverpool running eight branches: “When it came to setting up on my own and concentrating on just one branch it was obviously a new business challenge and a gamble, but I knew I had the experience behind me to make it a success.” For our main course, I opt for the short crust chicken pie, served with mash and steamed vegetables, while Mike is

tempted by the fresh salmon fillet, served on a bed of puréed mash and fine green beans. Head chef Robbie informs us that all the vegetables are locally grown and that everything is prepared on the premises – as all good pub food should be. Blacks is also part of The Home Market on Marion Square in Netherton, which sees estate agents from across the area come together in a joint venture to offer properties, financial and legal advice, HIPs and conveyancing, under a single roof. It’s a move which has seen Sefton businesses decide to work together for mutual benefit. In his spare time, Mike likes to write short stories and poems, and enjoys training for the annual Sefton Triathlon which he supports each year. He says: “It’s a brilliant community event which I’m really proud to be part of, and everyone says that after you’ve been once to watch or take part, you can’t help but get the bug.” He hopes to continue contributing to the event sponsorship next year but for now, with the market picking up, he’s certainly got plenty on his plate.
