It is illegal for anyone under 21 years of age to drive a vehicle with a blood alcohol content of .02 percent or higher. A first-time offense individual, under certain circumstances, may qualify for an Accelerated Rehabilitative Disposition (ARD) program.

DRIVER REFUSING A CHEMICAL TEST Any person who drives a motor vehicle automatically gives consent to one or more chemical test (e.g. breath, blood, or urine). This implied consent means that you don’t have the right to an attorney before testing. If a person refuses to submit to a chemical test: (1) the test will not be done; (2) the person’s license will be suspended for one year; (3) the person will most likely be charged with DUI.
