THE SUMMER OF GRAND OPENINGS FOR THE CITY OF MENIFEE By: Michelle Rivas The City of Menifee has seen the Grand openings of The Habit Burger Grill, Jimmy John's, Rubio's Grill, Buffalo Wild Wings, El Pollo Loco, Petsmart, Home Goods, Forever 21, Headliners Barbershop, Dog Haus, and Sonic Drive-In. The Openings and Ribbon Cuttings of these new establishments spanned from late June to August with more to come in September and October. All these new locations are indicative of the immense growth the City of Menifee has experienced this year. There is still so much more to come including a new Starbucks inside Ralphs, Pieology Pizzeria, Active, Party City and a Krispy Kreme Doughnuts. The residents of Menifee seem

to be flocking to all the new developments, and business is booming! Here is a bit of insight on how all these new establishments are faring in Menifee and about what they have in store. The community of Menifee has responded really well and it’s been very busy here since our grand opening. MENIFEE TO KICK OFF THE INTERNATIONAL FILM FESTIVAL SEASON Written by Michelle Mears-Gerst The motto, Keep Menifee Moving, has helped this once small western town, gallop its way into the spotlight of international leaders and filmmakers. Menifee is now home to the new California DocuFilm Festival kicking off the global season of film festivals. A meet and greet was held on Monday, August 22 at the Santa Rosa Academy where foreign diplomats and sponsors converged to support the international film festival. On hand for the press conference were Eugen Chivu, Consul General of Romania; Sinisa Girgic, Consul General of Croatia; Gregory Karahalios, Consul General of Greece; Henri Vantieghem, Consul General of Belgium;

and Mariusz Brymora, Consul General of Poland. There will be a dozen foreign ambassadors signed on to support the international film festival. Also on hand were Santa Rosa Academy Executive Director Laura Badillo and MSJC President Dr. Roger Schultz. The festival is taking place from Dec. 6 -11in Menifee. Menifee Mayor Scott Mann helped bring the festival to the city by introducing television personality Daphne Barak to Menifee in 2015 when her partner Bill Gunasti was running for mayor of Palm Springs. Mann convinced Barak to help develop a magnet and lead it as its chairwoman. Barak, is known for her books and exclusive TV interviews with A-listers of Hollywood and world leaders. The magnet Barak thought must be something to do with the entertainment and media industries. That is how the DocuFilmFestival was born. Page A3

Local HARVEST HILL STEAM ACADEMY

A School Like You’ve Never Seen Before On August 19, the new Rubio’s in Menifee, located at 30091 Haun Road, hosted a fundraiser for Harvest Hill STEAM Academy during its soft opening. Community Leaders and Harvest Hill families were invited to join the Rubio’s team for dinner for a $5 donation. All proceeds from the event were given directly to Harvest Hill and Rubio’s generously matched the donations collected, earning the school over $3,000 at this event. The money raised from this event will be used for materials, tools, and art supplies.

This innovative elementary school specializes in Science, Technology, Engineering, Arts and Mathematics, or STEAM. Using Common Core State Standards and emphasizing imaginative problem solving, the students are preparing for college and advanced careers. The students at Harvest Hill STEAM Academy foster their ingenuity and creativity through the use of progressive learning tools. One such tool, Maker Spaces, allows students to bring their designs to life from an idea to an actual build, fusing technology and art. Students will also have opportunities to engage logical thinking skills through computer programming activities, cultivating a community garden, utilizing a media lab and the use of the Lego Robotics Program. As if this isn’t exciting enough, students get the opportunity to work side-by-side with industry leaders such as the Honda Research and De-

sign Team and Executives from the world of television media. One of the goals of Harvest Hill STEAM Academy is to build a culture in which students, parents, and local businesses work together for the overall success of the community. None of this would be possible without the generous outpouring of donations and support from local businesses like, Rubio’s, The Pizza Factory of French Valley and Miguel’s Mexican Restaurant. MENIFEE SUMMER CAMP ENJOYS ART PARTNERSHIP By Arts Council Menifee To children, summer camp is a time for fun. It’s a time to sing, run and play. The City of Menifee Community Services department offers all of that and more each summer at Lazy Creek Park. This year, city parks staff desired to offer a well-rounded program that included opportunities for youth campers to be creative. They

Each week the summer camp offered a different theme, so the art teachers modeled the children’s projects to match. For example, the children worked together to illustrate a giant poster that depicted action figures during “super hero” week, and made jewel-filled under water treasure chests using envelopes during “pirate” week. The best programs for children are often found when public agencies partner with local service organizations. Volunteers that work with youth are often rewarded by the joy that is seen in the eyes of boys and girls who just discovered that they have talent. Although Zimmerman coordinated

reached out to Menifee’s non-profit art organization to provide art instruction as part of the summer camp’s weekly curriculum. “The city’s Community Services staff was familiar with our recent successful Summer Youth Art Institute program, and asked if we would continue something similar as part of the Lazy Creek Summer Camp,” said Bill Zimmerman who volunteered to coordinate the program for Arts Council Menifee. One of Arts Council Menifee’s goals is to utilize the North Annex Co-Op building at the Kay Ceniceros Community Center by providing free art classes at the building. So they developed an art program for the camp kids at the building. “It worked out perfectly. The art room is one block from the park, so our counselors could escort all the

These teachers are professional level artists who understand how to make learning fun,” he said. Becoming a partner to the festival will contribute to the college’s future growth. The festival will take place on the 25acre campus of Santa Rosa Academy. The campus will be transformed into the FestivalGrounds. If you have never been to the Santa Rosa Academy, it is unlike any charter school campus in Southwest Riverside County. The festival will feature documentaries from filmmakers around the world. However, youth and first time filmmakers will also have a category. Mann has told reporters, “With Menifee's centralized location in Southern California -- an hour from San Diego, Los Angeles, the beaches, and the mountain and desert resorts -- we are well positioned to have such an incredible international event here. Collaborating with our premier community college MSJC and Santa Rosa Academy charter school helps deliver a new dimension to their programs. It's all very exciting." Mann brought Barak to Menifee with a vision and she is going big. The DocuFilmFestival plans to fill a large void in the birthplace of movies. According to its website, DocuFilmFestival plans to become the only international documentary film festival in California, big enough to challenge the current leading documentary film festivals worldwide. They are holding the event during the first two weeks of December when no other major film festival is taking place around the world.

The MSJC volleyball team kicked off their 2016 campaign on Saturday by splitting a pair of matches played at San Diego Mesa College. The Lady Eagles opened the season with a straight set loss to the host Olympi-

RIVERSIDE COUNTY GOOGLE LEADERSHIP SYMPOSIUM FOCUSES ON PROVIDING A BETTER EDUCATION AND FUTURE FOR CHILDREN By: Dr. Kristina Nelson Google’s dedication to improving the educational experience of K-12 students by training teachers in technological creativity and application came to the forefront of Menifee at the end of July. On July 26, 27, 28 and 29, the Google Leadership Symposium, sponsored by a partnership between Menifee Union School District and RCOE, helped to edu-

cate around 350 K-12 teachers about the use of Google applications, programs, and products in order to provide an improved learning experience for students. Studying problems obstructing students in the classroom and the solutions offered via the utilization of Google tools was the focal point of the teacher training. In order to promote the utilization of Google tools in the classroom, the workshops were primarily hands on and student centered. Instruction focused on

the utilization of creative technological methods that can inspire a better educational experience. The first workshop, entitled Riverside County Google Leadership Symposium, kicked off the activities as a two-day session of professional development on July 27 and 28. Google leaders as well as keynote speaker Michael de la Cruz, Google’s Head of Education for North America, led up the training. The Google leaders promoted concepts about what improvements te c h n o l o g i c a l innovation can bring to the classroom experience and how to introduce the change, a notion that Google defines as the Google Transformation Frame- MSJC Board of work. FIVE ADDITIONAL FOOTBALL PLAYERS MOVING ON FOR 2016 SEASON Five more former MSJC football players will be suiting up for their new four year universities this Fall, wrapping up a highly successful off season for the Eagles. VanelDossoussigns-15.jpg Vanel Dossous became the 8th player from the Eagles 2015 team to sign with an NCAA Division I school when he signed with Bowling Green University earlier this Summer. Dossous, a native of Hamilton, New Jersey, was a First Team All American Mountain Conference selection during his sophomore year with MSJC. Dossous had a team high 53 receptions for 841 yards and 6 touchdowns during 2015. He also added a pair of TD's on punt returns and finished the season averaging a whopping 21 yards on punt returns for the year. Bowling Green is a member of the Mid American Conference (MAC) and is coming off a very strong year in which they finished 10-4 and had an appearance in the GoDaddy Bowl. Former Eagle linebacker John Hauso and running back David Mayaka have both signed with South Dakota School of Mines. Hauso, a graduate of Yucaipa High School, was fourth on the team for MSJC last season in tackles with 41 for the season. Mayaka from Morrisville, North Carolina, ran the ball 39 times for the Eagles during the 2015 season and also had 3 receptions. South Dakota School of Mines is an NCAA Division II school that plays in the Rocky Mountain Athletic Conference (RMAC). Mines had

During the workshops, groups and interactive discussions and solutions were encouraged among the IT administrators. The IT administrators utilized critical thinking strategies during hands-on applications to solve problems similar to the ones they will face in their own classrooms, encouraging them to have the necessary skills needed to prepare for the change. Learning how to integrate technology in the classroom, many K-12 teachers and IT administrators attended the function. These participants were taking advantage of Google’s dedication to the use of educational technology to improve the student learning experience. Furthermore, a key benefit noted by Google about this type of technological restructuring is the way a technological classroom actually better prepares the K-12 students in the district for both a successful college education and a positive lifelong career experience. The dedication to making learning better for students of all of those involved, participants and Google leaders alike, should help provide a better future for the children of today.

FOLLOW YOUR DREAMS THEY KNOW THE WAY On The Mark with Robbie Motter The world has been glued to their televisions watching the wonderful Olympics in Rio. Every contestant in every category at the Olympics had a dream. To make it to the Olympics, to win! One thing for certain, they never gave up. They had many setbacks but did not let those setbacks stop them from achieving their dreams. Their goals were to leave with medals and to make their countries proud. They looked for the best trainers in their fields and stayed on course no matter how hard it was. They wanted and saw themselves achieving greatness. So many times people have dreams and/or goals to accomplish and let friends and/or family talk them out of achieving them. They are your dreams or goals, not theirs. The task to be accomplished may seem at first impossible to realize but as you put it out to the Universe, amazing things start to happen. I myself have recently taken on a dream of achieving a goal for the Canine Support Teams. It is a non-profit in Menifee and for years has done so much for so many. Their Marketing Director would love to get their property driveway paved. It is a long time dream of theirs. The funds they raise are used for their programs of raising and training their clients’ dogs and not for paving their driveway. Their CEO is in a wheelchair. It is always an issue for her to get out of her car, get into her wheelchair and get the wheelchair moving over the dirt road. Others come to their location in wheelchairs and experience the same problem. When she told me her dilemma, I thought maybe I could make this happen for them. Since I absolutely know nothing about paving a road, I had to educate myself. The next day I visited a business associate in Temecula and shared my task with him. He used to be a contrac-

Biz Buzz MARRIAGE AND BUSINESS Wedding Days and Grand Openings have much of the same feelings going into each one as they hold a special place in a person’s life. Both tend to cost money and both seem to have an ominous understanding of the future. A person wants their marriage to succeed as much as their business needs to thrive because many times one is contingent on the other and as one goes so does the other. Disclaimer: I’m no expert on either marriage or business but I’ve been married for over 13 years and been in business for 14 so I’ve witnessed a few trends. When business was bad my personal feelings lowered and my marriage suffered. When my marriage suffered I treated my staff poorly and business was negatively affected as I altered my routine. Sadly, I’ve seen many friends go through the same cycle and some could never recover either their marriage, business or both. Reading about the number one cause of divorce being money trouble, a business owner can constantly have money woes. Sales cycles, holidays, and employee

VOTE FOR SMART INVESTMENT MOVES The presidential election is little more than a month away. Like all elections, this one has generated considerable interest, and, as a citizen, you may well be following it closely. But as an investor, how much should you be concerned about the outcome? Probably not as much as you might think. Historically, the financial markets have done well – and done poorly – under both Democratic and Republican administrations. Also, many factors affecting investment performance have little or nothing to do with the occupant of the White House. Consequently, no one can claim, with any certainty, that one candidate is going to be “better for the markets” than another one. Still, this isn’t to say that any given presidential administration will have no effect at all on investors. For example, a president could propose changes to the laws governing investments, and if Congress passes those laws, investors could be affected. But in looking at the broader picture, there’s not much evidence that a particular president is going to affect the overall return of your investment portfolio. As mentioned above, many factors – corporate earnings, interest rates, foreign affairs, even natural disasters – can and will in-

But in evaluating a president’s potential effect on your investments, you also need to consider something else: Our political system does not readily accommodate radical restructuring of any kind. So it’s difficult for any president to implement huge policy shifts – and that’s actually good for the financial markets, which, by their nature, dislike uncertainty, chaos and big changes. The bottom line? From your viewpoint as an investor, don’t worry too much about what happens in November. Instead, follow these investment strategies: Stay invested. If you stop investing when the market is down in an effort to cut your losses, you may miss the opportunity to participate in the next rally – and the early stages of a rally are typically when the biggest gains occur. Diversify. By spreading your dollars among an array of investments, such as stocks, bonds and other investments, you can help reduce the possibility of your portfolio taking a big hit if a market downturn primarily affected just one type of financial asset. Keep in mind though, that diversification can’t guarantee profits or protect against all losses. Stay within your risk tolerance. Investing always involves risk, but you’ll probably be more successful (and less stressed out) if you don’t stray beyond your individual risk tolerance. At the same time, if you invest too conservatively, you might not achieve the growth potential you need to reach your goals. So you will need to strike an appropriate balance.

Forget about chasing “hot” stocks. Many so-called “experts” encourage people to invest in today’s “hot” stocks. But by the time you hear about them, these stocks – if they were ever “hot” to begin with – have probably already cooled off. More importantly, they might not have been suitable for your needs, anyway. In any case, there’s really no “short cut” to invest-

For savvy business owners like yourself, it presents some great marketing opportunities. To help businesses cash in on this hot new game, we’ll give you some tips to boost your sales using Pokémon Go. Before we dive into the promotion ideas, it helps to have a basic understanding of the game. What is Pokémon Go? Pokémon Go is a mobile game that encourages users to collect little pocket monsters or

Pokémons that roam around the neighborhood with the goal being to “catch them all.” The game uses a phone’s GPS to track movements, so as a player walks down Main Street, for example, they see a real map of the area and try to catch “Wild Pokémons” that are nearby. Pay for a “lure” to be placed near your business Essentially, Pokémon Go players are wandering around trying to capture “Wild Pokémon” that spring up unexpectedly during their walk. What if you could make more Pokémon appear near your business? You can. Pokémon Go allows players (or you, as a business) to buy “Lures,” which increase the number of Pokémon around a PokéStop for 30 minutes. The more Pokémon around, the more players and potential customers you’ll have. The Lures only cost a few dollars, so experimenting with this idea won’t break the bank. Don’t forget to promote it. Tell your customers when and where you’re setting up Pokémon Lures to encourage them to visit the area at a specific time. 3. Host a Pokémon Hunt Encourage your customers to start their Pokémon Go tour at your business. You have a few options here. You could set a date and time and go for a “Poke-hunt” with a small group of customers. It’s a great way to get to know your customers while doing something fun. At the end of the tour, give customers a pre-

Local END OF SUMMER MARKS PERFECT TIME FOR CAR CARE Preventative maintenance now can help ensure worry-free driving this winter The vacations are over, the kids are back in school and cooler evenings have begun. Take advantage of the lull to prepare your vehicle for the winter ahead, advise the pros and the non-profit National Institute for Automotive Service Excellence (ASE). Breakdowns, never convenient, can be dangerous in cold weather period. The following tips from ASE should give parent and student alike a road map to fall car care. First things first Read your owner’s manual and follow the manufacturer’s recommended service schedules. There are usually two schedules listed: normal and severe. Engine Performance Have engine drive-ability problems (hard starts, rough idling, stalling, diminished power, etc.) corrected at a good repair shop. Cold weather will make existing problems worse. Replace dirty filters air, fuel, PCV, etc. Fuel A gas tank that’s kept filled helps prevent moisture from forming. Oil Change your oil and oil filter as specified in your manual more often (every 3,000 miles or so) if your driving is mostly stop-and-go or consists of frequent short trips. Cooling System The cooling system should be flushed and refilled as recommended. The level, condition, and concentration of the coolant should be checked periodically. (A 50/50 mix of anti-freeze and water is usually recommended.) If you’re doing your own work, allow the radiator to cool down completely before removing the cap. (Newer vehicles have coolant reservoirs.) The tightness and condition of drive belts, clamps, and hoses should be checked by a certified auto technician. Heater/Defroster The heater and defroster must be in good working condition for passenger comfort and driver visibility. Windshield Wipers Replace old blades. If your climate is harsh, purchase rubber-clad (winter)

blades to fight ice build-up. Stock up on windshield washer solvent you’ll be surprised how much you use. Carry an ice-scraper, for frost, even in Menifee. Battery The only accurate way to detect a weak battery is with professional equipment. But do-it-yourselfers can do routine maintenance. Scrape away corrosion from posts and cable connections; clean all surfaces; re-tighten all connections. If battery caps are removable, check fluid level monthly. A word of caution: Be sure to avoid contact with corrosive deposits and battery acid. Wear eye protection and rubber gloves. Note too that removal of cables can cause damage or loss of data/codes on some newer vehicles so refer to your manual for instructions. Lights Inspect all lights and bulbs; replace burned out bulbs; periodically clean road grime from all lenses with a moistened cloth or towel. To prevent scratching, never use a dry rag. Exhaust System Your vehicle should be placed on a lift and the exhaust system examined for leaks. The trunk and floorboards should be inspected for small holes. Exhaust fumes can be deadly. Tires Worn tires will be of little use in winter weather. Examine tires for remaining tread life, uneven wearing, and cupping; check the sidewalls for cuts and nicks. Check tire pressure once a month. Let the tires “cool down” before checking the pressure. Rotate as recommended. Don’t forget your spare, and be sure the jack is in good condition. Emergencies Carry gloves, boots, blankets, flares, a small shovel, sand or kitty litter, tire chains, a flashlight, and a cell phone. Put a few “high-energy” snacks in your glove box. The National Institute for Automotive Service Excellence (ASE) was founded in 1972 as a non-profit, independent organization dedicated to improving the quality of automotive service and repair through the voluntary testing and certification of automotive technicians. Meet Deborah Norman and Dolly By: Robbie Motter Deborah Norman entered California Institution for Women (CIW) in 1989 with a 15 to life sentence. She was released in October, 2012. When Canine Support Teams launched its Prison Pups Program at CIW, Deborah was among the first to volunteer. Seeing a dog for the first time in thirteen years had a profound emotional impact on her. Deborah said: “Dogs were always important to me, a part of my life. When I first saw “MARTI”, I felt emotions that I forgot I had. I started bawling. Prison is a hard place, you become hard, you have to shut down emotionally. Suddenly, I have a dog I can interact with every day and I had HOPE for the first time in years.” Deborah was one of the original trainers with the Prison Pups Program at CIW. Through the program, she obtained certifications as Pet Dog Trainer (Basic Obedience), Professional Service Dog Trainer, and Service Dog Training Instructor. At the time of her release, she was training the trainers within the program, and serving as a resident mentor to the newest instructors. She applied those skills as a private trainer with clients in Whittier, Pomona, Yorba Linda and the Greater Los Angeles Area. She then became General Manager and Trainer for a canine rescue in Studio City. Deborah was hired by Canine Support Teams in Menifee in October 2015. Now she leads a service dog training program at California Rehabilitation Center in Norco. Deborah proudly represents the hundreds of women who have been served by CST’s rehabilitative programs. She is a model of

The beautiful and well trained Service Dog, DOLLY, is now helping a fantastic individual live a wonderful life. The owner of the dog is so grateful to Canine Support Teams for the dog has made her life so much easier. Years ago, Carol Roquemore, their CEO and Founder, spoke at the GFWC Menifee/Sun City Women’s Club about the dog training program. This organization is totally amazing. They do great work and their commitment is massive. They are located on Scott Road in Menifee, a beautiful location donated to them years ago. In September of 2002, the California Institution for Women (CIW) in Chino, CA, became the first prison within the State of California to have a Service Dog Training Program. Canine Support Teams is proud of its “Prison Pups Program” where the inmate trainers play a vital role in the advanced training of their Service Dogs for the disabled community. CST has gone on to start 3 additional programs at Riverside County-Southwest Juvenile Hall (RCSJH), California Institution for Men (CIM) & California Rehabilitation Center (CRC). CST Founder and CEO, Carol Roquemore, takes joy in the fact that in addition to serving those with disabilities, the Prison Pups Program also positively impacts the lives of the participants.

“We’ve seen many inmate trainers go on to be gainfully employed in the animal training and animal care industry upon their release from the prison system. Nearly every single Prison Pups Program participant has stayed out of prison after their release, so we know that our program is an excellent example of a rehabilitation effort that really works.” At the CIW, CIM & CRC programs, the dogs are assigned to an inmate trainer at 18 months of age, after being raised in a puppy raiser home where they are well socialized and taught basic obedience skills. They remain at the prison for 4-6 months. CST staff provides training to the inmate handlers weekly, training them to become Dog Trainers, Behavior & Service Dog Specialist. This is one of the longest standing prison dog programs in the nation! The program at RCSJH teaches dog handling & basic training skills to the minor participants using shelter dogs that are rescued and re-homed after their 14 weeks of training. MEET LINDA HENRY By Robbie Motter I first met Linda Henry in 2005 when I served as the President of the Social Club at Hillside Mobile Home Park in Sun City. She moved to Sun City in 2003 and prior to that lived in numerous areas of Orange County and Victorville, Ca. In late October, I moved a few blocks away from Linda. She became one of my neighbors. I got to know this dynamic woman who has a heart of gold and cares so much for Seniors and their needs. She was born in Mobile, Alabama. At age of six, her stepfather was sent to Bermuda to work as a Head Carpenter for the Air Force Base. She lived in Bermuda, married there and had a daughter named Tammy. Linda’s husband worked for the Air Force and got transferred to California. Tammy was a baby then when they moved. Linda has a sister that lives in Bermuda. They get to see each other when they have the opportunity to visit. Linda stayed home as a mother and housewife until Tammy entered school. She had two other children, Michael and Mark. As the years passed, Linda was blessed with 4 granddaughters, as well as 6 great grandchildren, and a step granddaughter. Spending time with her grandchildren and great grandchildren gives her great joy. She loves dancing, reading and doing yard work. She has a beautiful yard and really, she can do anything. When her time permits, she goes to Karaoke at Menifee Lakes Country Club on Monday nights and sings. What a beautiful voice she has. Everybody loves her. Linda was trained years

ago, as a caregiver, went to work for Sun City Gardens where she served clients for over 15 years. Now she has her own company named Linda’s In Home Care. Her clients are in the Sun City area. Some family members pay her to take their love ones out for recreation and go out to eat. Linda has had various careers in her life, from being a waitress to being an Electronic Technician. She decided years ago that she would end her working career and train to become a caregiver. She is with IHSS County of Riverside where they refer her to various clients who have part time needs. She likes working with the elderly. That's her passion. Being a caregiver is not an easy job. Some need assistance to go to their doctor's appointments, grocery shopping, take showers. Making sure her dementia patients take their medications. Linda loves seniors and wants to make sure they are cared for properly. All her clients bond with her and many tell her not to ever leave them. She feels great that she can touch a life and make a difference. Many of the families she works for are unable to come and be with their loved ones so they hire Linda as they know she cares and will give them outstanding care. In February Linda will be taking a few days off to go on a cruise with 50 of us to Catalina and Mexico. It will be fun to have her part of the group. WORKING WITHOUT A CONTRACTOR’S LICENSE CAN VERY RISKY AND EXPENSIVE Under California Contractor’s State License Law enumerated in Business and Professions Code Sections 7000 to 7191, a contractor may not “bring or maintain” any action for compensation for performing any act or contract for which a license is required unless the contractor was duly licensed “at all times” during performance. Bus & Prof Code Section 7031(a). The License Law requires contractors to establish experience and take a test in the particular specialty category for which they seek a license. Parties are required to also have a License Bond to protect their customers, and comply with numerous other statutes and regulations. Who is a "contractor" - and thus the kinds of persons required to have a contractor's license - is set forth in the Business and Professions Code. A "Contractor," is synonymous with "builder" and, within the meaning of Business and Professions is any person who undertakes to or offers to undertake to, or purports to have the capacity to undertake to, or submits a bid to, or does himself or herself or by or through others, construct, alter, repair, add to, subtract from, improve, move, wreck or demolish any building, highway, road, parking facility, railroad, excavation or other structure, project, development or improvement, or to do any part thereof, including the erection of scaffolding or other structures or works in connection therewith, or the cleaning of grounds or structures in connection therewith, or the preparation and removal of roadway construction zones, lane closures, flagging, or traffic diversions, or the installation, repair, maintenance, or calibration of monitoring equipment for underground storage tanks, and whether or not the performance of work herein described involves the addition to, or fabrication into, any structure, project development or improvement herein described of any material or article of merchandise. "Contractor" includes subcontractor and specialty contractor. "Roadway" includes, but is not limited to, public or city streets, highways, or any public conveyance. The law attempts to protect the party who hires a contractor by making sure they are at least minimally qualified and by requir-

ing contractors to have a bond in place. So what happens when you hire an unlicensed contractor? Well, first of all you are unable to determine whether the person is qualified to perform the work. How does the state attempt to prevent unlicensed contractor from performing unlicensed work. Easy, they make it completely acceptable not to pay them. Sounds harsh? It is. Under Business and Professions Code § 7031 it states in part: “Except as provided in subdivision (e), no person engaged in the business or acting in the capacity of a contractor, may bring or maintain any action, or recover in law or equity in any action, in any court of this state for the collection of compensation for the performance of any act or contract where a license is required by this chapter without alleging that he or she was a duly licensed contractor at all times during the performance of that act or contract, regardless of the merits of the cause of action brought by the person…” "Regardless of the equities, section 7031 bars all actions, however they are characterized, which effectively seek "compensation" for illegal unlicensed contract work. (Lewis & Queen, supra, 48 Cal.2d at pp. 150-152.) Thus, an unlicensed contrac-

tor cannot recover either for the agreed contract price or for the reasonable value of labor and materials. (See Davis Co. v. Superior Court (1969) 1 Cal.App.3d 156, 159 [81 Cal.Rptr. 453]; Grant v. Weatherholt (1954) 123 Cal.App.2d 34, 41-42 [266 P.2d 185].) The statutory prohibition operates even where the person for whom the work was performed knew the contractor was unlicensed. (Pickens, supra, 269 Cal. App.2d at p. 302; Cash v. Blackett (1948) 87 Cal.App.2d 233 [196 P.2d 585].) "It follows that an unlicensed contractor may not circumvent the clear provisions and purposes of section 7031 simply by alleging that when the illegal contract was made, the other party had no intention of performing. Section 7031 places the risk of such bad faith squarely on the unlicensed contractor's shoulders. "Knowing that they will receive no help from the courts and must trust completely to each other's good faith, the parties are less likely to enter an illegal arrangement in the first place. [Citations.]" (Lewis & Queen, supra, 48 Cal.2d at p. 150, italics added" There you have it - If you are performing work as an unlicensed contractor you will receive no assistance from the courts. If you are a party that hired an unlicensed contractor the law not only allows you not

to pay the contractor - you can possibly recover any amounts paid to an unlicensed contractor. Do not take this article as an endorsement to intentionally hire unlicensed contractors with the intention not to pay, but rather as a warning to make sure you obtain the proper licenses or work with professionals when you consider hiring a contractor.

Through the partnership with Caltrans, the State Department of Transportation has cleaned up the corridor along Newport Road to Scott Road, and has scheduled a clean-up from Newport Road to McCall Blvd this week, and from

 NEIL R. WINTER RUNNING FOR MAYOR OF MENIFEE WHY ME WHY NOW? Last year as running my first campaign for the Menifee City Council, I really did not know much about the Menifee political scene I just knew that I have skill sets that lend to building teams and using strong businesses practices to get things done. The most common question people ask me is. “How are you going to make positive changes?” My answer starts with explaining how the City works presently, Menifee uses the General Plan crafted after the Riverside County General Plan. Overall, it is a good plan, outlining the economic development corridors, the housing development, zoning, and everything else in between. What it does not cover is how the Council and City Staff perform the various functions of attracting businesses, handling growth issues, improving public safety, making it easy to do business in Menifee, and many other issues and areas. The crux of these issues is not worrying about the General Plan but how much time does an elected official spend daily, weekly, and monthly to ensure the needs of the citizens are being considered and met. It is my belief that, at least, the Major act on

the behalf of all the businesses and citizens FULL time!!! Anyone having multiple responsibilities in and out of the city boundaries means the present Mayor spends time more time working outside the City. If one has a full time job how can they give 100% to the City of Menifee! Citizens need to know the job of serving as Mayor pays less than $10,000 per year! Knowing this, you have to ask a critical question, “Why spend $20K to $80K on winning a campaign to earn less than $10K per year?” The clear answer is campaign money spent is not the candidate’s but special interest groups investing their money to aid their needs not necessarily those of the City. Candidates looking to advance their political career have huge amounts of monies funneled into their campaign coffers. You wonder why the candidates don’t contribute more of their own personal funds so they can vote with a clear conscience. Menifee is growing rapidly and this growth is bringing more new families and businesses to Menifee in record rates. In just one year the population has grown by nearly 5,000. An elected official must accept the massive responsibility to meet all the needs of residents and businesses. They must follow sound business practices making it easy to do business here. Work tirelessly to increase the level of law enforcement coverage allowing residents to feel safe. Ensure the balance

protecting our rural aspects but also bringing in the right types of industries so people can live and work here. Your elected officials must be accessible above and beyond just City council meetings and special events. They need to be there for you communicating constantly and consistently keeping you aware of what is going on in

your city. In essence, you deserve full time efforts for your full time growing city. I bring a unique aspect being retired giving me the time, energy, and skill sets do all of the above, no special interests, no outside careers, and no distractions. It is time Menifee has a full time Mayor and voting for me accomplishes this goal.
