INSIDE BUSINESS LAW UPDATE

Murrieta: Twelve Mayors, Four Scandals in one Decade Written by Michelle Mears-Gerst The City of Murrieta is in the midst of another game of political football when it comes to the sexual harassment accusations against the current Mayor Harry Ramos. Ramos is under investigation by the City for alleged misconduct towards a woman at a Murrieta Chamber of Commerce event, among several other serious accusations that question his capability to serve as Mayor. Ramos is the fourth Mayor in ten years to undergo a legal investigation of either a personal or city matter. Some of the investigations have cost taxpayers' money while others have not. The City does have a code of conduct outlining how City Council members should conduct themselves on and off duty. However, residents in Murrieta have proven they are not shy to stand up and kick out an elected official who they feel doesn't represent their values and goals. The following is a recap of some of the most headline-catching news among Mayors in Murrieta in the past ten years. The current Mayor Ramos who is mar-

ried with three children served in the United Stated Marine Corps for almost ten years before running for City Council in 2012. The other muckraking Ramos is facing includes accusations of bad-mouthing other Council members on the record, harassing City staff members and making derogatory and racist remarks after interviewing commission appointments. There is also the conundrum of the missing gavel. In 2005, a vote to recall Jack Van Haaster from his office as Mayor of Murrieta took

place. Residents wanted Jack Van Haaster recalled for a multitude of reasons including accusations he called one-onone meetings with members of the Murrieta Planning Commission to talk about a plan his daughter had to open a Daycare Center. Recall supporters said he had a conflict of interest. Van Haaster served on City Council for 12 years before being ousted on May 3, 2005. City Council members also targeted for recall by the group Rescue Murrieta who spearheaded the campaign were Council members, Doug McAllister, and Kelly Se-

yarto. Van Haaster was the only one ousted. After being recalled, Van Haaster was arrested and charged with five counts of perjury, five counts of filing false documents and five counts of violating the State of California's conflict of interest laws. The former Mayor faced eight years in state prison. He pled guilty in 2007 to violating the State's conflict of interest laws and filing false documents with the City of Murrieta and the State regarding his financial interests in the city. One of the charges he pled guilty to was a felony, but he avoided prison time and spent 30 days in jail, was under house arrest according to reports and spent three years on probation. In January 2006, Mayor Warnie Enochs, self-proclaimed, "Champion of the People," who helped recall former Mayor Van Haaster was charged with extortion, forgery and subornation of perjury, threatening to break a tile contractor's leg if he didn't help him cheat his wife out of money in a divorce settlement. In 2009, Enochs was sentenced to 180 days in county jail where he was able to serve those days on weekends to avoid prison time after a jury convicted him on a dozen charges including forgery and preparing false records. Enochs, according to city records, was Mayor from May 2005 to December 2005. Continuation on page2

Page 8 Another Inmate Found Dead in Southwest Detention Center Concerns and questions surround the Southwest Detention Center in French Valley this month, as another inmate was found dead on August 21 inside of his cell. Investigations have been launched to determine the cause of the inmate’s death, but in the wake of this new scandal, many are remembering that in the past year, 13 other inmates have also died in the custody of authorities at Detention Centers in Riverside County. Written by Michelle Mears-Gerst Enochs was also found guilty of forging a police officer's signature on a fix-it-ticket, flashed a Councilman's badge while on Big Bear Lake to a deputy from the San Bernardino Sheriff's Department and the next day when he was stopped in Murrieta for having an expired registration and given a warning, he signed the ticket as "Steve Baxter." The Murrieta Police, according to reports, told the courts they never employed a Steve Baxter. The City of Murrieta was moving through smooth waters for the next few years despite the recession and troubled economy. Then in June 2014, Murrieta made national news when the residents revolted against undocumented immigrants being bused into the city from Texas by the Federal Government. Residents forced the buses to be turned around and Mayor Alan Long stood up and supported his constituents at a press conference that made international news. Long was elected to City Council in 2010 and was running for a second term on November 4, 2014 election. On October 17, 2014, Long was arrested for drinking and driving after he hit a car from behind that was occupied with four teenagers. Since Long just made national news as one of the first mayors in the country to stand up against the federal government on an immigration issue, his arrest thrust him and the city back into the spotlight. According to media reports, Murrieta Police Lt. Ron Driscoll said Long was given a field sobriety test that registered at and below two Preliminary Alcohol Screening tests. Long, who works as a Battalion Chief with Anaheim's City Fire Department stepped down as Mayor four days after his arrest. Long read his resignation from a prepared statement during a news conference at City Hall. "This will ensure that there is not even

one hint of impropriety and that I will be treated in this matter just like anyone else," he added. Long stepped down as Mayor but he continued his run for election to the City Council and won in November. Ramos replaced Long as Mayor in December 2014. Despite the plethora of arrests and trials among the City's Mayors in the past decade, the city was spared much of the expense. According to Murrieta's City Manager, Rick Dudley: "The city spent $61,604.27 related to the 2005 recall election. Out of that money spent, $3,664.44 was reimbursed by candidates for statement costs, for an actual total of $57,939.83". Dudley said the city was spared all costs for the Enochs' scandal because it was not a city issue. Enochs' arrest, investigation, and trial were not related to his position with the City Council. According to Dudley, Long's arrest and ongoing case was not related to his position on the City Council and did not cost the city money. Long's case is before Judge Mark Mandio at the Southwest Justice Center in Murrieta. The next hearing is scheduled for September 11, 2015. The current investigation of Mayor Ramos has cost the city $14,000 to date according to Dudley. "The investigation is ongoing and no report has been delivered as of today," said Dudley. The City Manager explained why there have been twelve mayors in ten years. "We are like many cities in California where the mayor is not selected by the voters, but rather chosen by members of the City Council from among their ranks on a rotating basis," said Dudley. "In Murrieta, there is a policy in place

to ensure a consistent and fair practice that allows all Council members to serve in that role. Each person serves in that role for a twelve-month period. It is not an issue of stability as the Mayor's role is primary to preside over Council meetings (in addition to serving on the Council). The Mayor has no more (or less) power/authority than any other Council member." Although the names and faces in City Council may change, City Management has been stable. The City Manager, Rick Dudley has been with the City since November 2007. The City Attorney, Leslie Devaney has been with the City since May 2007 and the City Clerk, Sarah A. Manwaring has been with the City since January 2011 and serving as City Clerk since January 2014.

Local Low-Flow Toilets Required In California For All Home Renovations From the Desk of Tony Falco, The state of California passed a law that no more than 1.28gpf (gallons per flush) toilets can be sold in stores, i.e. Lowes, home depot, or home improvement stores. This is due to the recent drought in California. As the CEO and Certified Restorer it has been a concern of mine on how these toilets will affect our plumbing drain systems. Toilets in the early 1980’s were 5.0gpf, and then late 1990’s until recently were 3.5 gpf. Drain lines were designed to drop a foot after every 10ft of drain pipe. This was to carry the waste and water through the drain line ensuring it reaches the city sewer, by-passing any

Page 3 movements and place all feminine products and wipes in the trash can (just like you do in your motor home or trailer). There are toilets that are power flush toilets, these toilets are great for pushing the waste down the drain. A power flush toilet is a pressure assisted tank

belly’s bends, or small root intrusions that may be in the line. As a plumber for over 25 years, the only thing going down the drain line should be waste and toilet paper. Feminine products and wipes are not meant for the drain system. Do not fall for the “flushable” marketing labels on the outside of the packages. Our waste and toilet paper alone already absorb the water from 3.5gpf, putting things down the line that aren’t designed for the drain line with 1.28 gallons will really cause a problem, meaning toilet overflow or sewer back up into the home. For homeowners and homeowner insurance companies, toilet bowl overflows or backed up drain lines will start to become more common over the next few months and/or year. The bill/ law passed did not state how long the stores are to only supply 1.28gpf toilet for, whether it is to continue until the drought is over or not. So as homeowners it is our job to regulate what is put down the drain system. You can protect your homes from sewer backups and toilet overflows, by only putting toilet paper and waste in the toilet. By Robbie Motter Gary Hawthorne in addition to running Hawthorneworldwide.com. is also an Entrepreneur, and sales and marketing professional. I first met Gary Hawthorne about 5 years ago when he was introduced to me by Menifee resident Robert "Hollywood" Moreno. Over the years I have used Gary's great talent to create flyers for my clients and recently he designed some unique U Tube Videos for my Nafe networks across the country. Gary has been married to his wife Michelle for 36 years. He has been building websites since 2008, and in fact Gary did my website www.robbiemotter.com. and did our www.wrnafe.com website which for over three years was also used to promote some Menifee Valley Chamber events that I created and was the Chair of. Gary and his wife Michelle have been residents of Murrieta for 10 years moving here in April 2005 After high school Gary enlisted in the Marine Corps and under President Kennedy at the height of the cold war still feels that the show of force regarding the Cuban Crisis in the early sixties averted further military action with Russia. This is also Ironic considering Gary is now working with Yakov Smirnoff on a PBS SoCal special. For those who don't know Yakov, he was billed as Ronald Reagan's favorite comedian and came from Russia with love. Yakov gained worldwide fame for his comedic talent and was sworn in as a citizen of The United States in 1986. He is doing a big performance at the Performing Arts Center in Escondido on September 26th which will be filmed by PBS and Gary is doing all the marketing strategies for that event. Gary is a man of great talents, he has developed a talent as a website developer, whiteboard video guru and was featured on Talk of The Town. Blessed to have a diverse background that helped to bring out the skill and passion for the work he does in helping small businesses get a

presence on the web. I know I am so glad I met him as I can call him and need something and within a day or two I have it. His whiteboard U Tube videos have been a big hit with my Nafe networks across the country. I told him I needed to get the word out globally on Nafe and the next day he created the Global video and then my networks across the country each wanted one that was about their networks. I gave him the task and he completed those in a few days. Already those videos have helped Nafe see a great increase in New Members as well as some old members who dropped out have returned. Some of my members saw them and loved them and have hired Gary to do some for their businesses. The Nafe videos are being marketing by each Nafe director across the country on their network pages and also their own personal social media pages as well as they are asking their members to post them on their social media pages so they are going viral very quickly and getting results. Since also recently chartered the new Menifee Valley Lions Club I asked Gary to do one of the Videos for them as well and the next day I had it, here is that link.He is working with their President to get them a website as well. I know I am so happy that I met him

and love doing business with him. Relax at Work

When we're honest with ourselves -- if not with our bosses -- we have to admit that the office isn't our favorite place to be. There's no budget to replace these terrible desk chairs, and the air-conditioning is always turned up too high. The cafeteria color scheme is a terrible shade of orange and your toes are pinched into office-appropriate pumps, making it impossible to concentrate on your latest deadlines. When your stomach metamorphoses from a digestive organ into a pit of anxiety, or your ears start jangling with nerves, just take a deep breath. Calm down, and check out a few of our simple office relaxation tips: Take breaks Get up and stretch: Pausing for five minutes once every hour or so does wonders for your mental stress level. The best way to reset your brain is to stand up and get the blood flowing. Print out a PDF of desk stretches and run through the routine at least a few times a day. Take a walk: Those durned hippies were right. Multiple studies show that being outdoors (or even just looking at pictures of natural landscapes) reduces stress and causes heart rates to decrease. If your

office is in an urban area, try to find some local parks. Besides the physiological benefits of exercise and vitamin D, being around trees or absorbing natural daylight will have an uplifting effect on your mood. If your building happens to be located in a park-free zone, try opening the windows or putting a few houseplants on your desk. Block out the chatter With e-mail, IM and two different phone lines pinging you all day, it's no wonder if you end up a bit frazzled. By eliminating pesky distractions, you can maintain a sense of calm at your desk. Tweak your e-mail settings. Build filters for personal e-mail, so it gets dumped into a separate folder. By keeping your inbox all business, you'll have fewer distractions. Turn off new mail notifications, they interrupt your flow. Also, set up your

e-mail client to grab new messages once or twice daily, instead of constantly checking your inbox. If you use Gmail or Yahoo mail, minimize the browser tab or close it entirely. If you have the kind of job that requires you to be instantly available, there are other tricks you can do to maintain a sense of calm at your desk. Go invisible on IM. You can stay logged in and you can still initiate chats, but you won't get roped into any unexpected fire drills. Google Chat and a few other popular clients have an invisible status choice.

Breathe Stress and anxiety are common causes of hyperventilation, which increases the amount of oxygen in your blood but can also have the unfortunate side effect of causing you to pass out. Since fainting is not a very productive way of easing out of your latest assignment, practicing meditation and yogic breathing techniques can keep your mind, hands and heartbeat steady. Even the most staunchly non-Buddhist can get a leg up with the help of apps like Be Happy Now, which includes a helpful "bonus" meditation called "Doing the Work." If you don't have 20 minutes to set aside, simply taking a few deep breaths while counting backwards from ten can work wonders. Quit Even in an economic downtown, the pros and cons of a job that gives you unmanageable amounts of stress have to be weighed. Finding a new job will be difficult, but is the prolonged anxiety of paying the rent any worse than dreading coming into work? Only you will know for sure.

Pursuing hobbies (50%) Spending time with grandkids (48%) Taking on volunteer work (36%) While, Generation X is confident about their ability to save for retirement, but they maintain some worries as they consider their future. Some respondents are concerned about potential costs of caring for aging parents (46%) and supporting children (22%). The cost of healthcare also weighs on them with 75 percent saying it’s one of their concerns.

Generation X: Taking Retirement into Their Own Hands With all the attention paid to baby boomers, it’s hard to believe another generation is rapidly approaching retirement age. In 2015, the first wave of Generation X is turning fifty. And Gen Xers are taking retirement into their own hands. According to the recent Ameriprise Financial Retirement 2.0 study1, an overwhelming majority of Gen X say they started saving and investing early for retirement. They’re also looking to redefine retirement. As this generation heads into their golden years, health, wealth and work are their top priorities. Thoughts on Work The Gen Xers see work as an important part of their lives. Half of the group is currently working to achieve financial stability (55%) while a third say they can’t afford not to work (33%). With retirement on the horizon, Gen X does not plan to say goodbye to work anytime soon. Instead, they plan to continue working in retirement, but in a way that is more meaningful than just earning a paycheck. Nearly 3 out of 4 survey respondents plan to stay in the workplace beyond retirement age in order to pursue something meaningful (73%). Staying mentally and socially engaged tops the list of priorities for work in retirement. Gen Xers anticipate work at this time in their lives to be less stressful (50%), more rewarding (33%), socially meaningful (24%) and more interesting (18%). They see themselves possibly working part-time, as consultants or running their own business. Money Matters For the most part, this group seems to be taking ownership of saving for retirement, with 77 percent reporting they are taking steps to save enough to afford the

lifestyle they want. In addition, 64 percent are investing with the goal of generating extra income for their retirement. Not everyone is on board, however. A minority of Gen Xers in this study say they haven’t really planned for their retirement (22%) and a few have not even thought about it (1%). The majority of Gen Xers surveyed have taken advantage of an employer-sponsored savings plan. Eight in 10 report currently saving in a 401(k), while seven in 10 regularly put money aside in an IRA or similar account. Nearly one third of this group expects these savings to be a main source of income in retirement (29%). Far fewer respondents expect to rely on Social Security or pensions to help fund their new lifestyle—a significant change from previous generations.

The Role of Financial Advice Gen Xers who work with a financial professional appear to be more proactive with retirement saving. With the support and insight of a financial expert, they are more likely to be on track to save enough to live comfortably in retirement (38%), cover emergency expenses (35%) and leave a legacy (17%). BUSINESS LAW UPDATE

By Jeremiah Raxter, Esq If you run a business in California you are probably well aware that the minimum wage in California is increasing to $10.00 per hour on January 1, 2016. In fact, a small number of cities in California are increasing the minimum wage even more. There is a ballot initiative to increase minimum wage to $15.00 dollars. If you are an employer or employee, this should be reason enough to get out and vote in the next voting season. There are some employees who are exempt from the minimum wage law, such as outside salespersons, individuals who are the parent, spouse, or child of the employer, and apprentices regularly indentured under the State Division of Apprenticeship Standards. There is an exception for “learners”, regardless of age, who may be paid not less than 85% of the minimum wage rounded to the nearest nickel during their first 160 hours of employment in occupations in which they have no previous similar or related experience. There are also exceptions for employees who

are mentally or physically disabled, or both, and for nonprofit organizations such as sheltered workshops or rehabilitation facilities that employ disabled workers. Such individuals and organizations may be issued a special license by the Division of Labor Standards Enforcement authorizing employment at a wage less than the legal minimum wage. Just for trivia purposes, did you know that effective January 1, 2016, the minimum monthly salary for sheepherders will be $1777.98? However, wage and hour labor issues expand much further than just determining minimum wage. Employers are required to provide their hourly employees certain rest periods which are calculated by the total amount of hours worked. Rest periods are not required for workers that work less than three and half hours. Generally, the “lunch” period should be given to workers in the middle of their shift. The penalty of not providing employees with their rest period is the payment of one hour of their regular rate of pay. Employers should be aware that pursuant to Murphy v. Cole, the California Supreme Court

held that the remedy for meal and rest period violations of “one additional hour of pay” under Labor Code section 226.7 is a wage subject to a three-year statute of limitations. Whether you are a business or employee that may have questions regarding wage and hour issues you should consult a local business attorney. This is certainly the case of… “spending a little on education is better than spending a lot on learning a lesson.”

DID YOU KNOW THAT TESTIMONIALS ADD PUNCH TO YOUR MARKETING MATERIALS? Testimonials from satisfied clients and customers can add flair to your marketing materials, But some business owners don't know where to start or how to properly use testimonials. Here are a few tips. Soliciting Testimonials: If your customers don't send you, letters of praise then you need to ask them to give you a testimonial. Simple send a letter or an email to clients and customers who are happy with your product or service and ask for their comments. Remember there is POWER in the ASKING. In your letter or email, you should ask your customers to give you their opinion of your service and the products they purchased. Ask these clients what they liked about your services and encourage them to give you any suggestions or criticisms.Also let your client know that this information will help you gather valuable information, which will help you serve your clients better in the future. Using Testimonials: Always use authentic testimonials. Do not make them up. It is very hard to match the sincerity and credibility of praise from real customers and clients, now matter how great a writer you are. If a customer tells you to just write what you want and they will just sign it, let them know that you would prefer if they just give you their own opinion in their own words. Longer testimonials that consist of two or three sentences are more believable than single rod testimonials. Ask for specific, detailed testimonials rather than general testimonials. Use Full Attribution: To increase the believability for your testimonials, it is important to have the person's name, city and state, and if it is a business customer, include their job title and company. The readers are more likely to believe a full disclosure testimony than those that conceal the identity of the speaker.

Keep Testimonials Together Most marketing experts believe that it is better to group all your testimonials together within your materials. When a prospect reads all the testimonials in one place, one right after the another, they have more impact and power than when the testimonials are separated and scattered all over your material piece. You can do this in a box, on a separate page or on a separate sheet. The separate sheet of paper has a certain advantage in that as new testimonials come in, they can be changed without having to redo your marketing materials. Always Get Permission Make sure you get permission from your customer to reprint what they have sent you before you include it any copy that you send out. Sent them a letter or email outlining the quote you want to reprint and ask permission to include them in ads, social media, direct mail, brochures and other materials used to promote your firm. This general release allows you to use the testimonial over and over without having to ask permission every time you want to use the quotes in any letters or marketing materials. Start today by identifying those customers who are pleased with your services and asking them to put it in writing. Leger Concerns and questions surround the Southwest Detention Center in French Valley this month, as another inmate was found dead on August 21 inside of his cell. Investigations have been launched to determine the cause of the inmate’s death, but in the wake of this new scandal, many are remembering that in the past year, 13 other inmates have also died in the custo-

dy of authorities at Detention Centers in Riverside County. According to reports made by the Riverside County Sheriff’s Department, around 7:20 PM on Friday, August 21, authorities at the Detention Center were alerted about an unresponsive inmate. Personnel at the facility immediately contacted the medical staff on-site to administer first aid compressions. However, the inmate shortly after, was pronounced dead before he could be transferred to a hospital. After the incident, the inmate’s body was believed to have been transferred to the local Coroner's Office where detectives of the Sheriff’s Department Homicide Unit opened a preliminary investigation. Authorities did not immediately determine the inmate’s cause of death or the mode. As stated before, since December 31, there have been at least 13 deaths within the

confines of Detention Centers in Riverside County, two of which that we know of occurred in the Southwest Detention Center. In the spring, we reported on the death of Julio Negrete, an inmate at the Southwest Detention Center who was murdered by his cellmate and stuff under a bed bunk for hours before authorities check on the cell. Report showed that an altercation between both men had resulted in loud sounds coming from the wing, which were never investigated. Around the same time, 51-year-old James Dean Clifton was found dead in his cell after an apparent suicide. Dean reportedly hung himself. Dean was also an inmate at

the Southwest Detention Center. Reports showed that the most deaths occurred in Banning Jail, a facility that houses inmates with mental health disabilities. In the mental health wing, Robert Anthony Hearn, 69, was found dead in his cell within an apparent fatal head wound consistent with being bludgeoned. His cellmate was charged with his murder. Gonzalez, 45, who died of a “medical emergency”. While foul play was not suspected in his death, authorities did not release any more information regarding the cause of Gonzalez’s death. Vincent Criscuolo also died in the Banning Jail in May. However, authorities did not release any information regarding his death either, but they did state that foul play was not suspected. erside County, the facilities with the most deaths appeared to be Banning Jail, Riverside Jail, and Indio Jail. Both Riverside Jail and Indio Jail have two reported deaths each. For now, authorities are asking for help in the resolution of the investigation regarding the death of the inmate at the Southwest Detention Center on August 21.
