By DAVID SCHOLZ Martinez Tribune MARTINEZ, Calif. – JRR Construction Co. was fined $4,050 for its role in a gravel truck accident that took the life of a Martinez woman and her unborn child on March 23, 2015. But a year later, the matter still remains unresolved as San Mateo-based JRR Construction opted to appeal the fine last August. No hearing date has yet been set to hear the firm’s challenge of the citation issued by the state’s Division of Occupational Safety and Health (OSHA). JRR refused to comment for this story. Lifelong Martinez resident Lindsey Combs, 32, who was two months pregnant at the time of the accident, was killed when a big-rig trailer tipped and spilled its contents onto her vehicle as she was moving her vehicle at the request of workers at the scene along Shell Avenue. Cal/OSHA determined that

Every election season, candidate signage of all sizes and messages, like weeds, start sprouting along roadsides as well as on poles and fence lines throughout the area. In the waning days of an election, it never fails that the numbers of unsightly signs increase. But now, the clock is ticking for candidates and their supporters to not only remember where campaign signs that dot the city and county landscape were placed, but go out and remove them. Within the city limits of Martinez, signage must be removed no later than 10 days after the

election, while the county requirement is 90 days. Dave Scola, the city’s Director of Public Works, noted the candidates or their supporters have been pretty good, by and large, when it comes to retrieving signs. After that 10 day period, Scola said candidates are given a call to remind them that their signage is still up and it needs to come down within a couple of days. Under the current system, candidates are only charged a fee for recovery and storage costs if Public Works staff has to go out to get the signs and hold them at the City yard for candidates who want them back. Otherwise, campaign signs that go uncollected by their owners are now simply picked up and disposed of by Public Works staff. Deputy City Clerk Mercy Cabral acknowledged this is a financial loss to the city. But candidates are forewarned that this practice will change in the near future. Cabral said whether or not candidates want their signs back, they will be charged a fee if city workers have to go out and pick up signage. “We have not decided how much that fee will be,’’ she said, but it will happen soon in order to update literature that candidates receive from the City about dates and regulations for erecting campaign signs. Tuesday, May 31 A suspicious woman was reported to have been yelling and cussing at no one in particular around 4:15 p.m. near the Martinez Chamber of Commerce on Marina Vista Avenue. At 4:27 p.m., a shoplifter was suspected to have taken $80 worth of blood pressure medicine from the Nob Hill supermarket. He was restrained into the manager’s office after a fight with an employee. An apparent homemade arrow fell from the sky and landed into an Ortega Drive resident’s backyard, sticking into the lawn.

A transient woman whose belongings were beside her in a baby stroller was reported to have been screaming about government conspiracies at the Amtrak station near 8 p.m. The truth is out there. At 11 p.m., a burglary allegedly took place at the Virginia Hills Safeway supermarket when two trucks went to the back of the store and stole five bales of cardboard, which can be traded for gold on the black market, I assume.

Wednesday, June 1 Three people reportedly got their truck stuck in the water at the marina near midnight. A man purportedly threw trash cans at passersby at the corner of Alhambra Avenue and Main Street at 5:36 a.m. A woman was allegedly kicked out of the Copper Skillet restaurant for yelling and screaming. She was probably just exclaiming her love for a good meal.

At 10 p.m., four men were observed around a bonfire, cooking in the back parking lot of the John Muir Inn. Those in-room microwaves just do not cut it sometimes.

Thursday, June 2 At 12:44 a.m., a man on Alhambra Avenue reported that someone was outside screaming at him. At 1:30 p.m., a man allegedly stole two phones from the AT&T store on Arnold Drive. The two phones were worth $1,500 combined. Two men were “yelling at the moon” in the Main Street Plaza at 1:37 p.m. Another man was running back and forth across Alhambra Avenue while screaming at 9:20 p.m.

was reportedly talking to himself and laying down on the sidewalk in front of the county hospital on Alhambra Avenue around 3 p.m.. Two people were locked into the bathrooms at Cappy Ricks Park on Brown Street, for about two hours. At 8:16 p.m., a picture frame was purportedly thrown at a car that was occupied. I am still trying to figure out the symbolism. A suspicious man was reported at the Quik Stop Market on Alhambra Avenue. The man appeared to be under the influence, swinging a baton around and acting erratic. Life is hard for drum majors past high school.

Saturday, June 4 Around 5 a.m., a man reportedly attempted to steal a fan and air freshener from the John Muir Inn. When confronted, he threw the stolen items onto the ground and claimed he had a knife.

A couple had a verbal fight that escalated when a man pushed a woman. It then de-escalated when the man went into the Starbucks on Main Street, presumably to order a relaxing chai tea. Another assault was reported at 3:10 p.m. A woman slapped, pushed, and threw meatloaf at a man in his residence. Was the meatloaf that bad? A pickup truck was observed to be driving erratically, nearly hitting other cars, when it reached its destination at the Virginia Hills Safeway where the driver was seen buying “more alcohol.”

Sunday, June 5 Around 12:50 a.m., a white Ford Explorer was reportedly driving on two rims with sparks flying from underneath the car. At 2:47 a.m., a group of four juveniles were loudly walking on Ridgewood Drive where one of them was heard screaming, “Don’t tell my

parents I’m drunk!” At 10:20 p.m., a customer at the Front Room restaurant on Main Street refused to pay for his dinner because he did not have enough money.

Monday, June 6 At 1:20 p.m., a man wearing a white jersey with a letter on it purportedly was grasping at poles on Alhambra Avenue in order to stay on his feet because he looked like he was drunk. Near 5 p.m., two juveniles were allegedly throwing candy at people from the roof of a building at the corner of Main Street and Estudillo Street. I am sad I missed the free candy throwing. What sounded like a fight was heard on Alhambra Avenue and Main Street around 11:15 p.m. One of the fighters reportedly said, “I’m going to kill you.” Arrest logs available at http://martineztribune.com.

Glover in run-off with Avila Farias By DAVID SCHOLZ Martinez Tribune Disappointed yes, but at the same time not surprised was Federal Glover’s perspective as he now looks toward November when he will be in a run-off for his 5th District seat on the Contra Costa County Board of Supervisors against AnaMarie Avila Farias. With such a large field of candidates, Glover expected the vote to be splintered. The two candidates finished one-two, respectively, in the five-person race with Glover besting the field with 8,791 votes or 35.6 per-

cent of the 24,800 ballots cast. Avila Farias followed with 7,649 votes or 31.8 percent. “I am excited about being number one in this large contingent,’’ said Glover. “Now I am looking forward to going through in November and continuing the job I have been elected to do.’’ Despite having to go forward with the run-off, that did not diminish Glover’s confidence that he is still the right person for the position at this time. He noted while his challenger speaks of the housing affordability issue and works in that industry, he emphasized work is be-

ing accomplished to address that concern throughout the county. Similarly, he cited the progress to address issues related to the Highway 4 corridor. Along with improvements to the region’s infrastructure, such as the widening projects, he also pointed to dollars being brought in to bring relief to related issues from one end of the county to the other. “I will be sharing a clear picture of work I have done and my visions for the future, and that will all be part of my message,’’ he said. The majority of campaign signage is picked up by the responsible party after the election. Ricci noted that depending on the materials contained in the signs, efforts are made to recycle the signage. The expectation for these types of temporary signs also goes for Realtor signs and other advertisements such as garage sales and estate sales, Ricci said.

“prior to and during the course of the investigation, including but not limited to March 23, 2015, the employer did not make a thorough survey of the conditions of the work site to determine the predictable hazards to employees and safeguards necessary to prosecute the work brought about by the unloading operation of the dump truck in a safe manner on a sloped and uneven ground with inadequate space.’’ JRR Construction was contracted to demolish and build a half-mile stretch sidewalk along Shell Avenue known as the “Shell Avenue Pedestrian/ Bicycle Improvement Project.” The truck’s owner, Daryl

Crocket, from Greg’s Trucking Service, who was not cited by state investigators, had rented the trailer that tipped. The driver was raising the trailer to dump the gravel when the rig tipped onto Combs’ car that was still in her own driveway. Moments before, Combs had been asked to move her car by work crew members, according to Martinez Police. “This surely is not the cost of a human life,’’ said Erika Monterroza, a spokeswoman for the Department of Industrial Relations, of the $4,050 fine imposed in this case. Monterroza emphasized that Cal/OSHA does not do

criminal investigations. Rather, the fine in this case, regarded as “serious,” reflects the civil process that has been set by the legislature. Regardless of the size of the company, $25,000 is the maximum fine that could be imposed. A check of previous actions against JRR Construction showed a prior “serious’’ incident in June 2010 at a Gilroy project site incident that resulted with a $2,025 fine. A pair of other infractions filed against the company since 2009 totaled $150 and $200 respectively. Monterroza described the company’s safety track record

as “not remarkable.’’ In the wake of the tragedy, relatives established a pair of fundraisers. One set up to help bring relatives from Montana to California for the funeral raised $6,290, and the second one (www.gofundme.com/ lindseycombs) was collecting funds to help pay for funeral expenses and establish an education fund for Combs’ daughter, Lyric. As of June 6, $17,923 had been raised. A check of court filings in the Contra Costa County Superior Court showed no civil actions were initiated by the family against the construction company in the wake of the accident.

LADY DOGS TAKE NCS DIVISION II TITLE Alhambra High School Varsity Girls Softball seals three-peat with win over Newark

Alhambra sealed the three-peat on Saturday, June 4, with the perfect blend of great pitching, three home runs and that bulldog mentality. Top seeded Alhambra beat the number two seeded Newark Memorial in a seven inning battle of the bats, 12-6. The two teams had one previous meeting earlier this season, which took place during the Reed High School Softball Tournament in Sparks, Nevada. The Bulldogs beat the Cougars in their previous matchup 5-3. Alhambra came out swinging in the first inning. Karlee Sparacino hit a line-drive double through the gap that leadoff hitter Kimiko Zapanta and Bri Perez were able to score off of. Junior Morgan Azevedo also hit a double that allowed Sparacino to cross home. Newark Memorial quickly responded in the top of the second, showing they weren’t going down without a fight. The Cougars had a runner at first when Haylee Nelson laid down a bunt. However, the Bulldogs’ third baseman overthrew the ball allowing not only Savanna Norberg-Swickard to score from first, but also Nelson. “We just launched the ball into right field. Bad enough it’s an error, throwing the ball to right field, but then they got

a tarp laying out in right field and my right fielder put her hands up because the ball was under the tarp,” Head Coach Buccellato explained about the play. “But since it wasn’t lodged under the tarp, they let the girl keep running.” The Cougars were able to tie the game on a single by Newark Memorial’s leading hitter and San Jose State commit, Maricela Matos. Alhambra was able to rally behind two homers in the bottom of the second. The home-runs came off the bats of Perez, who drove in three runs, and Cara DiMercurio, who drove in another two runs to put the Bulldogs up 8-3. Perez previously homered off of Newark’s starting pitcher, Jiana Rojo, in their matchup earlier this season. Newark Memorial responded with a home run of their own in the top of the fourth on a shot to center field by Matos. The Cougars scored another run in the fourth on an error by Alhambra’s third baseman, Lindsey Osmer. The bottom of the fourth was bittersweet for the Bulldogs. DiMercurio walked with the bases loaded and no outs, allowing Zapanta to come home for a run. Alejia Lewis came in to run for DiMercurio and on a sacrifice fly ball hit by Regan Silva, Perez was able to score. However, Lewis wasn’t able to stand after sliding into second base and had to be carried off the field. “The trainer said (Alejia) may have a broken ankle ... Ale-

jia is a great kid, she’s part of the reason our team is happy and everyone gets along. She’s a big part of the team,” Buccellato reported on the injured runner. Miranda Nilson ended the scoring with a two-run homer to left field, for her second home run of the season off of Rojo, putting the Bulldogs up 12-6 over the Cougars. “It’s a team effort. You look down the line, one through nine, like Miranda Nilson is batting sixth in our lineup and she had a home run today – a big home run that put the nail in the coffin,” the head coach said about his left-fielder. The Bulldogs’ senior starting pitcher, Sierra College commit Sam Whitworth, dueled for all seven innings on Saturday. Whitworth gave up eight hits and three walks. She also struck out seven batters after 122 pitches. “I was gonna let Brianna Edwards throw one inning ... but Sam was pretty persistent in saying, ‘I’m not coming out, I’m gonna sit on the field, you’re not taking me out,’” Coach Buccellato said when asked why he didn’t take Whitworth out of the game after some struggling. “It’s her senior year, the last time she’ll play (high school softball). She was pitching well today, so I decided to leave her in there ... I got Bri all next year.” The game ended in similar fashion to another recent Bay Area championship – a popup in foul territory, caught by the third baseman, and teammates rushing the field. Martinez, just like the Bay, is home to champions once again.

Two Martinez City Council seats up for grabs this November

Councilmember AnaMarie Avila Farias enters Supervisorial run-off With incumbent Martinez City Council member AnaMarie Avila Farias now in a runoff for the 5th District Supervisor’s seat on the Contra Costa County Board of Supervisors, it appears that leaves not one but two seats up for grabs on the Martinez City Council for the November General Election. The seat now held by Mark Ross is the other seat to be contested this Fall. The reason Avila Farias’ seat on council is open is because her name cannot appear twice on the ballot.

Avila Farias could not be reached for comment for this story, but she has previously indicated that she would vacate her seat on the City Council if she made it to a run-off after the June 7 Primary Election stage of the race for Federal Glover’s supervisor seat. No candidate on Tuesday in the 5th District contest achieved the 50-percent-plus-one vote threshold to win the seat outright. July 18 is the first day when interested parties can file papers for the November election, and Aug. 12 is the deadline to file.

need allies, and you need something to offer. Over the decades George has had his share of successes and failures. Mostly successes. He’s a believer in “pay as you go.” Years ago he proposed a balanced budget. For a time, the government agreed. Then things changed. We’ve been paying for our wars by borrowing. We’re passing the cost to future generations. Ditto for infrastructure like bridges and roads, which are decaying. Bad! Ditto too for education, which is getting ever more expensive. Education is the key to the nation’s economic survival. When we short-

change education and science, we short-change our kids and grandkids. Science “tells it like it is” – whether we like it or not. In some areas we accept science. When you have a toothache, you want a well-trained dentist. When you go to Kaiser or John Muir for help with your arthritis, you want your doctor to be trained in arthritis medicine. You don’t call your dentist! If you want to build a bridge, you go to a trained engineer – neither your M.D. nor your dentist. Climate change seems different. Why are there so many deniers? The proper approach is: If you want to know about

climate change, you should ask someone whose made a career of studying climate. What’s so hard about that? The answer: It’s real; and it’s going to affect us all.
