FORUM SentriLock or Supra? Tell us by voting. Our Association has a very important task ahead of us: choosing which lockbox system we will use for the next several years. We have members who are very passionate about one system over the other and we also have members who are indifferent, but by the end of this year, a decision will be made. No matter what decision is made, there will be members who are not happy with the decision.

In a perfect world, we would be able to offer two systems and our members could choose one or both systems depending upon their personal business and client needs. Unfortunately, this cannot happen: we are bound to choose only one system exclusively.

The Board of Directors has appointed a Task Force whose mission is, along with the Board of Directors, to gather information on both Supra and SentriLock and provide this information to our members so our members are wellinformed on both systems. Our Task Force has done a great job in offering information sessions at the Association building last month. Our Board of Directors has already made a few decisions concerning what our lockbox system (no

matter which system is ultimately chosen) will offer our members. The first is the decision to lease as opposed to buy. Leasing technology makes sense. As the technology gets better and changes, we can get the updated systems without having to purchase a new system. The Board of Directors is striving to keep the cost to the members as low as it can be, keeping the cost structure right in line with what we currently pay and what neighboring associations charge for their key systems.

The second decision is to offer day codes to our lockboxes. With this technology, a member can give a day code to an agent from outside our area so that agent can show the property, eliminating the need for multiple lockboxes on one property. Day codes will be available no matter which system we use (both Supra and SentriLock offer them, though both offer them in different ways). Currently, the Board of Directors is reviewing the written proposals from both companies with a fine tooth comb, asking questions, clarifying costs and benefits, and reading the fine print. Our Board wants to ensure that our members are informed of all facets of each system before our members vote. If you would like to sit in on a Board meeting to get an idea of what our discussion is at the moment, you are certainly welcome to join us.

The ballot will have three choices: 1: urging the Board to vote for SentriLock, 2: urging the Board to vote for Supra, and 3: telling the board that either choice is good for you.

The voice of our members, through this straw poll vote, will be the most important factor in deciding which lockbox system gets the contract. The last time we asked the members for a vote on lockboxes, fewer than 300 members voted. We need all members to vote, so the Board of Directors has a better understanding of what our members want. The Board of Directors will not make a final decision, nor will they debate one system over the other, until we have the results of the straw poll vote. At the end of the day, our Association needs informed members who are educated about both systems, have made a personal decision about which best fits your business model, and have made that decision known by casting a vote in the straw poll. We need to hear your voice, so please vote.

If they have a proven track record, are available and accessible, and make it a point to attend FAAR events, we try to meet with them to touch base, but we support them without going through the formal interview process time and again. Candidates fill out the survey, return it to FAAR, and then set up an interview with the Public Policy Committee. The interview is a chance for the Committee members to get to know that individual but also for the candidate to learn about our issues. The Committee

asks questions pertaining only to real estate and those issues that impact the business such as taxes, transportation, environmental regulation, and economic development. The Committee then deliberates about endorsements based on the survey answers and the interview. An endorsement means public support for a candidate, but also financial support through RPAC, the REALTORS® Political Action Committee. Running for office, even local office, can be expensive and candidates often rely on outside support to help them across the finish line. If we can provide

them with some of that support, it’s something that is not quickly forgotten. Once we make an endorsement, we alert our members so that you can consider that information when making a decision about who to vote for on Election Day. The Committee and our association understand that many factors go into the decision about who to support, but if real estate is one of those factors, we try to make it as easy as possible for you to assess who is strong on real estate issues.

Attention FAAR Agents & Brokers! Dues billing for 2016 has been completed and mailed to the Broker. They are due no later than September 30, 2015. Bills paid after that date will incur a $25 late fee. Membership will be dropped if not paid by December 31, 2015. Membership may be reinstated by completing an application for membership and paying the $275 application fee and the 2016 dues of $590.

FAAR releases 2015 Legislative Package

By Kim McClellan, Government Affairs Director Every July, FAAR submits its legislative priorities for the coming year to the Virginia Association of REALTORS速 (VAR) for possible inclusion in the statewide legislative agenda. The issues included in FAAR's package come directly from the membership and deal with issues that FAAR agents encounter in their real estate business. The FAAR Public Policy Committee reviews all issues submitted and decides which issues are appropriate for inclusion in the legislative package. Once the package has been assembled by the Public Policy Committee, it is then sent to the FAAR Board of Directors for their input and approval.

With the Board's blessing, the package is sent up to VAR for consideration by the state's Public Policy Committee, which sets the statewide legislative agenda. Once the Public Policy Committee reviews and considers all of the issues, a statewide agenda is assembled and VAR's lobbying team starts working with members of the General Assembly in preparation for the next General Assembly session. This long process all starts with agents in the trenches of real estate encountering a problem and bringing it forward. The Public Policy Committee is always available to hear about issues of concern to FAAR members, no matter what time of year. Email Kim McClellan

Here is a detailed explanation of FAAR's main legislative issues for 2016. To view the entire legislative package including standing positions, visit the FAAR website at www.faarmembers. com/legpackage. 2016 FAAR Legislative Issues PROFESSIONALISM ISSUES State Issue

As more and more individuals enter the real estate profession, FAAR feels strongly that professionalism needs to be a greater focus of pre and


post-licensing education. One of the top threats to agents, as identified in the recently published Swanepoel D.A.N.G.E.R. Report commissioned by NAR, are the “masses of marginal agents” who are destroying the reputation of REALTORS®. These marginal agents are parttime, untrained, unethical, and/ or incompetent, according to this report. The knowledge gap between these types of agents and those that are competent and treat it as a profession is undermining the credibility of the industry as a whole. FAAR proposes the following changes to the current prelicensing and post-licensing structure. 1. Allocate at least 6 of the 60 hours of current prelicensing to cover practical topics such as buyer and listing paperwork and writing contracts. 2. Allow licensees to complete only 50% of their education via online or correspondence courses. The other 50% must be in a classroom. 3. Allow more of the 30 hours of post-licensing education to be offered as electives. The current 2 hour elective is not enough. 4. Add a 1 or 2 hour finance requirement to the current post-licensing education. This is a vital topic for new agents and there is currently no postlicensing requirement for it. APPRAISAL ISSUES State Issue

Appraisals continue to be a major

issue in the real estate industry. FAAR has heard many concerns about geographic competency, wild swings in appraisal values for the same property, and issues challenging faulty appraisals. FAAR recommends the following steps to foster better quality appraisals. 1. Appraisers currently certify geographic competency but that is often not the case. There needs to be a better system for assessing geographic competence, especially in cases of specialty markets such as historic downtowns, lake front communities, and agriculture properties.

2. There needs to be a mandated third party review of contested appraisals. Right now, the process for appealing an appraisal varies from AMC to AMC. Some AMCs run the appeal through the original appraiser with no third party review. There needs to be a system for review of contested appraisals that involves a third party review, which may be completed internally as long as it is not done by the original appraiser.

3. There is currently no right for the seller to see the appraisal, only the lender certification that it didn’t meet the sales price. That appraisal could stick with the property so it has the potential to become a major issue for sellers. FAAR recognizes that the buyer pays for the appraisal and that the seller should not have an unrestricted right to see it, but in cases of a low appraisal, the seller should have

access. It is often the situation that the buyer and seller could work together to challenge a low appraisal so seller access to that appraisal would benefit both parties. HOUSING DISCRIMINATION State Issue

FAAR supports legislation to prohibit discrimination in housing transactions on the basis of sexual orientation and gender identity. Our Association believes that all consumers should be treated equally in their housing transactions, which includes prohibiting discrimination on the basis of sexual orientation or gender identity. FAAR requests that VAR work with other stakeholder associations to develop a proposal to hold all housing providers to an equal non-discrimination standard for sexual orientation and gender identity. DMV TITLE SURRENDER REQUIREMENT FOR MANUFACTURED HOMES State Issue

FAAR requests that VAR work with the Virginia Manufactured Home Association to either draft

legislation or work through the DMV regulatory process to correct an issue with a 2014 regulation on manufactured homes that requires the original DMV title to be surrendered before the home can be properly converted to real property. FAAR understands and supports the intent of the regulation, but the process required by DMV to secure a replacement title can be cumbersome and has the potential to greatly impact some transactions. An agent of our Association represented a seller in the transaction of a manufactured home. The manufactured home in question was originally purchased in 1999, the wheels were removed and the home was placed on a permanent foundation, and the property began being taxed as real property, consistent with common practice of the time. The home subsequently sold a few times and was eventually purchased with financing by the current sellers in 2006. The home had been continuously taxed as real property, not personal property since 1999. When the current sellers were very near the settlement date, the lender discovered that the original DMV title was never properly surrendered. Research uncovered a lien still active on the title so DMV would not reissue the title to the current owners. 8

The agent representing the sellers went above and beyond and spent weeks working with the DMV trying to secure title for the manufactured home. The local DMV office did not possess the knowledge to assist and even the staff in Richmond was unhelpful and seemed confused about what needed to happen. The agent was told that they wouldn’t release the title until the original owners submitted the surrender form. The agent was able to track down the 88 year old original owner in Florida and was able to secure her signature on some documentation, but even that wasn’t enough for DMV. The woman’s deceased husband was also listed on the title and DMV requested his death certificate and power of attorney for the original owners to be able to do anything with this issue. The agent even tracked down the lien release form so the fact that there was a lien was not the only issue. Finally, the sellers called

Senator Ryan McDougle’s office who contacted the DMV Commissioner and then the issue was finally resolved. FAAR believes that in cases of an original DMV title that was not property surrendered, the current owners should not have to bear the burden of going through a process like this due to the new regulations. If the property has been taxed as real property, the appraisal shows that it is on a permanent foundation, and the regulations were not in place when the current owners purchased the property, there should be a simplified process for securing and then properly surrendering title. MEDICAID GUIDANCE ON SALE OF A HOME State Issue

FAAR requests that VAR consider legislation that will change the state Medicaid requirement that a home for sale be listed at the


tax assessed value. According to state Medicaid guidance, the current market value of a home is 100% of the tax assessed value. This presents an issue for homeowners and their families when the tax assessed value is significantly higher than the fair market value.

The process for securing a price reduction is time consuming and frustrating for homeowners and their families often going through one of the toughest time of their lives. Our members have repeatedly come across this issue when trying to assist a homeowner or their family with disposing of the primary residence when the homeowner needs to enter Long Term Care.

MORTGAGE DEBT CANCELLATION RELIEF Federal Issue

NAR publishes the D. A. N. G. E the real estate industry? By Pat Breme, RCE, CIPS Chief Executive Officer

D

.A.N.G.E.R. stands for definitive analysis of negative game changers emerging in real estate. It is a fancy way of stating what are the upcoming issues that can/will affect the real estate industry. NAR commissioned Stephan Swanepoel to research the threats to the industry. He conducted interviews with 74 CEOs, 7899 REALTORS®, did 850 hours of research, and examined over 6951 pages of data.

The report is divided into 5 areasDangers to Agents, Brokers, NAR, State/Local Associations and MLS. While the Report identifies dangers, it does not provide solutions or guesses what “Black Swans”, unpredictable future events, will occur. Each category has ten dangers. FAAR 1998 President Melanie Thompson serves on NAR’s Strategic Thinking Advisory Committee and has special insight into the project because it was unveiled to the group.

“In my mind, this report is a great value to members because of the immense amount of research that was conducted but also because it can be easily customized to apply to an agent, a brokerage, or even an association.”

NAR has provided a tool where the variables can be adjusted to suit the end user. The game changers are evident in the industry. How they impact an agent, a brokerage, an association, or MLS can be computed by selecting probability, timing and impact.

The top 4 concerns that are predicted to occur in a year are: large number of marginal agents destroying the reputation of others; commissions spiral downward; agent teams threaten the survival of brokerages; and the perceived value of agents declines due to unmet demands and expectations of consumers.

Dangers to Brokers

The top two issues rating a 100%

probability are: a regulatory tsunami of increasing financial penalties raise compliance costs; with no walls and little operating costs, paper brokerages proliferate and become a major force overnight.

Dangers to NAR

All but one indicator says there is a 80% chance that in 3-5 years the following will have a moderate impact on the national association- decision-making is hampered by the complex structure; the local/state/ national tier structure is plagued by conflicts between each level; NAR’s position as industry spokesperson decreases; mission creep, NAR expands beyond its core focus; push back over NAR getting into technology initiatives that are not successful; discord over whether NAR should be an association for everyone or only the best; insufficient new (young) blood; shortage of leadership talent; REALTOR® brand loses its desirability and power.

Dangers for Associations

The most serious issues rated with a 100% probability factor are: leaders not keeping up with the time; too many uninformed decisions being made; unwieldy

The Power of Donating to the Fredericksburg REALTORS® Foundation By Mary Beth Rich, President of the Fredericksburg REALTORS® Foundation

W

hen you donate to the Fredericksburg REALTORS® Foundation, you can be sure the money you’ve invested is being put to good use. In fact, the Foundation is so focused on making the most of the money we raise that we recently took advantage of an opportunity to double a grant request to support Homes for Our Troops builds across the state.

Each year, the Virginia Leadership Academy (VLA) at VAR takes on a major class project. The VLA class project this year is to raise $50,000 for Homes for Our Troops builds across the Commonwealth including Nokesville, Haymarket, Yorktown, and Charlottesville. These homes are specially built to accommodate returning wounded veterans. FAAR is fortunate to

have two VLA class members: Chip Taylor of Century 21 Battlefield and Rebecca Straley of Fathom Virginia Realty. Chip and Rebecca approached FAAR about making a contribution to the VLA cause and the Foundation stepped up to contribute $1,250 that was then matched by the FAAR Board of Directors for a total of $2,500.

Homes for Our Troops.

The VLA met their goal of $50,000 and exceeded it by $1,175. VAR is adding another $10,000. The money contributed to this worthy cause came straight from members just like you. The Foundation continues to seek out local and regional organizations that are making a difference through providing housing assistance. I am proud of the Foundation’s record of support and I hope that FAAR members will continue to support us so that we can keep supporting groups like
