Through this booklet, we offer you the opportunity to explore the novelties of the latest legislation. The new legislation is applicable as from the 10th of November 20171 : This law aims to frame the contribution that the private sector can make to integrated security. Every company that offers security services must have an authorisation to do so. The authorisation also mentions each individual security activity for which authorisation is granted. Indeed, a security company is not automatically authorised to perform all security activities! You can check the authorisation at any time on www.luppo.be

Specifications. 1. Guarding WHAT ARE THE MAIN GUARDING ACTIVITIES :

Handling of technical means -

WHAT MEANS ARE AT THE DISPOSAL OF THE GUARDS : Generic competences : competences that can be applied when performing guarding activities whatever the circumstances: • Access control of people • Vehicle checks at the entrance of premises • Control of peoples identity at the entrance of the part of the premise’s not accessible to the public (new) • Surveillance of the security perimeter, on public roads, during emergencies (new)

Competences and/or requirements related to specific guarding activities (new): These specific competences can only be applied if the guard is carrying out the following specific competences : • Store inspector : the interpellation of customers suspected of theft • Escorting a road traffic : the guard officer also has the task of a signalman • Security transport of goods : for protecting the values, the security company will make use of a neutralisation system • Night-club security : the security activities at the entrance and the exit have to take place in the field of vision of the cameras, except in the occasional dance places Competences applicable at specific sites (new) : these specific competences are only at the disposal of the guard in specific locations or situations: airports, military sites, embassies, ISPS port sites, SEVESO sites • Search for people in designated port infrastructure (new) • Visual inspection of luggage and superficial palpation of clothing • Vehicle searches Security guards have a very specific uniform and it is mandatory that their uniform shows the Vigilis emblem and their security identification card!

Attention : -

the security guard can-not intervene in political or work related conflicts ! the guarding missions can be entrusted to subcontractors, only if your contractor has stipulated so in the contract providing quality guarantees (new) Penalties : the use of unauthorised guarding companies can gove rise to fines up to 25.000 euros !

TRANSPORTATION OF VALUES (new) Transportation of money or property other than money, which by reason of its valuable nature or specific nature is subject to threats, must be transported by a guard-service, if • the transport of money exceeds an amount over 30,000€ provided that it is not a transport to and from customers • the transport of money for up to € 3,000 by staff of credit institutions to or from customers,

2 & 3. CCTV and alarm installations Installers of camera systems (new) and alarms are aware of the sensitive security issues of their customers. It is for this reason that they must be reliable and have an authorisation.

5. Maritime security The law provides for the possibility of hiring maritime security guards on board of Belgian ships for protection against piracy.

6. Training Security guards will receive the necessary training before being granted their identification card. Training in the field of private security is given by training organisations approved by the Minister. However, these courses are also offered as part of secondary education (7th year of specialisation).

7. Security consultancy This new law provides for additional obligations for security consulting firms (new) : The new law provides the following principle for Security consultants : the consultant must be neutral in relation to the mandator's mission. For this reason, they are prohibited by law from offering products or services such as guarding, alarm and camera installations, ... We confirm that our firm is fully compliant with all the demands of the legislation.

Conclusions. This new legislation shows that the private sector and the public sector are more and more equal partners in an integrated security approach. This booklet provides you with an overview of the main new novelties in the new legislation concerning the organisation of security. However, it is not possible to comment in detail.
