April 2019 Dear LPTV & TV Translator Industry: Welcome to the 6th annual edition of the Coalition’s NAB Show Book. This past year has seen a lot of changes in our industry, including the completion of a large consolidation of stations and permits into a new mega station group, and the FCC completing its rulemaking for the qualification and distribution of the $150 million in Congressional relocation funding. The post incentive auction and its subsequent repacking displaced about 2100 LPTV and TV translators. The FCC dismissed about 547 of these applications, has taken about 68 into a mutual displacement settlement and auction process, and granted new displacement construction permits for a total of 1396, so far. The 547 which were dismissed are eligible to file when the filing freeze is lifted on 4/18/19, and may still qualify for relocation funding. However, Congress put in the funding legislation that a 2nd test, that of being on air and not dark for 9 of the 12 months preceding the incentive auction. The Coalition does not know how many of those which got new CPs do not meet this 2nd test, and we estimate it could be in the 100s of stations. There is a new marketplace for the sale and purchase of LPTV licenses and permits. But the pricing this past year has not risen all that much because of a steady and large full power merger divestiture market. And we have not yet seen the primary stations look to Class A’s and LPTV for next gen TV spectrum. The pricing for Class A’s has been between $1.00 to $1.50/pop, and for LPTV the price has been between $0.35-$0.55/pop. This is less than we expected a year ago, but we are hopeful we will see a dramatic price rise happen, especially with next gen TV launching, and the need for our spectrum increasing. And there is a movement afoot to get the FCC to weaken the next gen TV simulcast requirement for the primary stations. LPTV has an advantage which we might lose, since we are eligible to flashcut to ATSC 3.0, and I hope we can maintain that posture with the new rules. News was made at last year’s event when we found out that not everything was ready for the LPTV displacement filing window. So the Coalition asked the FCC to extend the displacement filing window, they agreed, and we heard from many comm counsel that this extension helped the full power, LPTV, and translator groups get their filings done on time. OBITS

Byron St; Clair 1924 - 2019 Dr. Byron St. Clair was President Emeritus of the National Translator Association, which he served as president for nineteen years. He made regular visits to Washington, D.C. where he worked tirelessly to preserve effective and universal free TV delivery. He pioneered the development of mountain-top repeaters that rebroadcast metropolitan signals on an automatically switched channel, devices known as TV translators. St. Clair was director of R&D for Adler Electronics, and a founder and president of EMCEE, manufacturer and installer of TV translators, and was president of Television Technology Corp., later Larcan-TTC, Inc. In 1978 he became an informal advisor to the FCC Low Power Television Task Force, which was developing rules to enable TV translators to originate programs from any suitable source. Byron helped many LPTV owners find channels in tight places, and there are literally 1000s of stations, and new construction permits with his unique signature on them.

Gary Kenny 1950 - 2019 Gary began his career in broadcasting at the Melody Shop, Keene, NH installing antennas and tvs. He bootlegged an FM Radio Station as a teenager; helped to build the Keene State College FM Station; moved on to DJ in Brattleboro, VT before moving to television at WGBY (PBS) as a Transmitter Engineer. Gary and WIFE Debbie started the first locally owned TV Stations in SW Missouri March 1988 airing Trinity Broadcasting Network, PAX TV, ION TV, and Retro TV. Highlights in his life was running sound for Bobby Goldsboro Snake hunting, 3 months in Nigeria, Africa working on TV Stations, working on transmitters on top of the World Trade Center, NY City, running cable in the 1982 World Series, covering area High School Football, KU basketball, Major league baseball, and Christian concerts, events, and political debates.

Jeff Lyle 1963 - 2019 Jeff’s love of music and broadcasting began at an early age and led to many adventures. He started singing and playing cello in many concerts in elementary school and continued through his college years. He toured with the Cedarville University Swordbearers, lending his beautiful tenor voice to the group while also running and setting up the sound system. He helped run the campus radio station. In Davenport, Jeff worked at a CBS station, joined forces with a business partner and started a Christian radio station that exists in Des Moines to this day. He started several TV production businesses and pioneered a process of broadcasting over fiber optics. In 2013, Jeff began working with a group in Little Rock, and The Media Gateway was formed, where he provided the feeds for many LPTV stations.

There are two tests to meet in order to qualify for relocation funding. You first must be issued a new displacement construction permit in the 2018 filing window, or had your application dismissed, and was issued a new permit when the filing freeze is lifted in April 2019. The second test, the one which may trip up a lot of fillers, is that you must make a declaration and have proof that your station was on the air 9 of the 12 months before the incentive auction ended. We expect many filers will not meet this test, as this requirement is not in the LPTV rules and regulations, and as such they did not plan for this and may have been dark for many legal, technical, and operational reasons.

It is a huge vote of confidence and worthiness that Congress authorized $150 million for LPTV and TV translator relocation funding. While our part of the industry is considered a secondary service, in many smaller communities, LPTV and translators are the ONLY source of free broadcast television services. Combined with the LPTV EAS (emergency alert services) requirement, LPTV, with this Congressional funding, will continue to keep this essential lifeline service available throughout the country. We thank the FCC Commissioners, Media Bureau, and Video Division for their diligent work to both fairly and timely implement the Congressional funding directive.

The facts are that more LPTV and TV translators were NOT displaced by the auction and repack, than those that were. The facts are that many 100s of displaced stations will have had to wait over 2 years for funding to reimburse them. The facts also are that the many 1000s of stations not displaced by the auction or repack have had their valuations become severely depressed for years now by all of the uncertainty of the incentive auction process. And the fact remains, that despite a movement to end the LPTV service, our industry has prevailed over those forces, and is now poised with the new next gen TV standard, to blaze the trail into the future, once again.

MEDIA BUREAU LIFTS LPTV AND TV TRANSLATOR APPLICATION FILING FREEZES EFFECTIVE APRIL 18, 2019 The Media Bureau announces that, effective April 18, 2019, it is lifting the displacement and digital companion channel application filing freezes related to low power television and TV translator stations (LPTV/translator stations). These freezes were imposed to preserve channels for the window for LPTV/translator stations displaced by the Incentive Auction to file displacement applications (Special Displacement Window or Window). The displacement freeze was temporarily lifted to accommodate the filing of displacement applications by licensed LPTV & translator stations which were displaced by Incentive Auction matters in the Special Displacement Window. With completion of the Special Displacement Window on June 1, 2018, and post-Window settlement opportunity on January 10, 2019, the Media Bureau deems it appropriate to now lift these filing freezes. Interested parties may resume filing of the below-referenced applications on a first-come, first-serve basis on April 18, 2019. Displacement Applications The freeze on the filing of displacement applications, enacted in 2014, is lifted effective April 18, 2019. Digital Companion Channels The freeze on the filing of applications for digital companion channels, enacted in 2017, is lifted effective April 18, 2019. New Filings & Major Changes The freeze on the filing of applications for new LPTV/translator digital stations and major changes remains in effect. The Congressional funding of $150 million will be provided for qualifying construction permits from three types of applicants. The first are the already granted 1,396 newly granted displacement CPs. The second are the pending & MX’d CPs. The third are the 547 or so dismissed applications, which are eligible to file when the filing freeze is lift on 4/18/19. $60M of the funds will be issued in FY 2020, and $90M in FY 2021.

Not all of the potential 2,011 CPs and new apps will be granted relocation funds. The Coalition estimates that as low as 10% to as high as 30% of all newly issued CPs may not meet the second Congressional test of being on-air 9 of 12 months before the auction ended. 22

The FCC’s Catalog of Eligible Expenses will be used as a guide to the types of items the government will reimburse you for, and the range of the pricing it will approve. The charts on these next few pages list the LPTV and TV translator expenses which the FCC has identified for reimbursement. In all cases you will need to prove you need the equipment or service.
