Aquino: Why support another dictator? MANILA, May 4 (Mabuhay) – Survey front runner Davao City Mayor Rodrigo Duterte was again the target of President Benigno Aquino III’s campaign speech in Iloilo on Tuesday, wherein he questioned Duterte’s style of leadership. Aquino said Duterte acts like a dictator who threatens to violate the Constitution, citing the mayor’s statement that he will close down Congress to thwart attempts to have him impeached over allegations of hidden wealth. “Pinag-aralan ko po ‘yung ating Saligang Batas at hinahamon ko po kayo lahat dito, lahat ng nakikinig sa atin, hanapin niyo sa Saligang Batas: Saan ang kapangyarihan ng Presidente na i-abolish ang Kongreso?”

MANILA, May 5 (PNA) – Five Filipino scientists were recently hailed among the Top 100 Scientists in Asia. The list was released by The Asian Scientist Magazine (ASM), an online publication which aims to raise awareness on the quality research in Asia. Four of the Filipino scientists are members of the National Academy of Science and Technology (NAST), an attached agency of the Department of Science and Technology (DOST). They are National Scientists (NS)

Ramon Barba, Angel Alcala, Edgardo Gomez and Gavino Trono, Jr. The other Filipino scientist is Alfredo Mahar Francisco Lagmay, a member of the National Research Council of the Philippines (NRCP), which as also an attached agency of DOST. The Department of Labor (DOL) has been doing a remarkable job of protecting and enforcing the rights and privileges of workers in California, whether they here working illegally or have H-1 visas (working). A federal court in San Francisco has recently entered a consent judgment that ordered an electronics manufacturer based in Silicon Valley to pay $80,000 in minimum wage and overtime back pay to some of their Filipino workers they hired overseas. The court also ordered the electronics company to pay an additional amount in damages to its Filipino workers in violation of the Fair Labor Standard Acts (FLSA). $8000 in civil penalties were also assessed by the court against the electronic firm identified as BITMICRO Networks Inc based in Fremont in Northern California. The court also reminded the employer that they are prohibited from retaliating against workers who exercise their rights under the law. BITMICRO Networks Inc. is a publicly traded tech company that develops, manufactures and deploys flash stortage systems.

MANILA, May 5 (Mabuhay) – The camp of Vice President Jejomar Binay on Thursday advised other presidential candidates not to celebrate yet amid their rise in the surveys. “To the other candidates: Do not celebrate yet, good things are about to happen, Binay is coming,” lawyer Rico Quicho, the Vice President’s spokesperson, said in a press statement. “It will be a tight race all the way to Election Day,” he added. He said the surveys do not capture the intense ground campaigning by the Vice President’s core supporters and parallel groups nationwide.

Creditors are harassing me! Attorney Paul Allen answers questions on creditor harassment and bankruptcy protection. Q: Creditors are harassing me but I lost my job, and cannot pay. How do I stop them calling? A: If you cannot pay your bills, creditors will take steps to collect. That’s natural, but continued harassment can be emotionally depressing. If you have lost your job, or simply cannot cope, because debts have grown to the point where you have to choose who gets paid this month, and who doesn’t, then you need to consider the benefits of filing a bankruptcy. Q: Will a bankruptcy stop collection agencies from calling me? A: Yes, filing a bankruptcy protects you from creditor harassment, and provides peace of mind. Creditors will not contact you if you filed bankruptcy and have an attorney representing you. Otherwise they risk being cited for contempt of federal court, something they will not risk. Another reason to consider a bankruptcy now, even if you do not have assets to protect, is that after a bankruptcy, you can immediately begin the process of repairing your credit. This usually takes between 6 to 12 months, so an early start will get you there faster. Q: I have just received a summons from a creditor. Is it too late to file a bankruptcy? A: No. When you file for bankruptcy, an automatic stay goes into effect immediately stopping any lawsuit filed against you and any action against your property by a creditor, collection agency or government entity. This can be very important, Especially if you are at risk of being evicted or foreclosed on, being found in contempt for failure to pay child support or losing such basic resources as utility services, welfare or unemployment Here is how the bankruptcy filing affects some common emergencies: Utility disconnections. If you’re behind on a utility bill and the company is threatening to disconnect your water, electric, gas or telephone service, the automatic stay will prevent the disconnection for at least 20 days. Bankruptcy will also discharge the past due debts for utility service. Although the amount of a utility bill itself rarely justifies a bankruptcy filing, preventing electrical service cutoff might be justification enough. Q: Will filing a bankruptcy stop the foreclosure on my home? A:If your home mortgage is being foreclosed on, the automatic stay temporarily stops the proceedings, but the creditor will often be able to proceed with the foreclosure sooner or later. If you are facing foreclosure and wish to save your home, Chapter 13 bankruptcy is the appropriate remedy because it provides for a re-

payment plan on the arrears. Q: Can a bankruptcy stop an eviction? A: No, under the new rules, a bankruptcy will not stop a court ordered eviction, but it will prevent a landlord from seeking to evict you, at least for a while, perhaps just enough time to find somewhere else to live. However, don’t file for bankruptcy solely because you’re being evicted. You’ll probably be better off looking for a new place to live or fighting the eviction in Municipal court instead. Remember, the main idea behind bankruptcy is to discharge debt. Q: Will bankruptcy protect me; I’m behind in my child support payments? A: If you owe child support or alimony, bankruptcy will not interrupt your obligation to make current payments. And while the automatic stay will temporarily stop proceedings to collect back support you owe, usually the bankruptcy court will permit collection to go forward if the creditor requests it. In any event, these debts will survive bankruptcy intact and will have to be paid once the case is closed. Chapter 13, however, lets you pay the back support as part of the repayment plan. Q: A creditor is garnishing my wages. Will bankruptcy help me? A: Yes. Although no more than 25% of your wages may be taken to satisfy a court judgment (up to 65% for child support and alimony), many people file for bankruptcy to protect their income. For some people, any loss of income is devastating. Your employer may also get angry at the expense and hassle of facilitating a succession of garnishments and take it out on their employees. Although federal law prohibits you from being fired for one garnishment, an employer can fire you for multiple garnishments. Filing for bankruptcy stops garnishments dead in their tracks. A memorable trip to Cebu and Bohol

Sometimes, the most unlikely and inexplicable good luck seems to just happen. Travelling to Cebu and Bohol was one of those times – thanks to the courtesy of Philippine Airlines, which hosted a Familiarization Tour to the “Queen City of the South” for the members of the US media when it launched the new LAX-Cebu flight on March 15, 2016 which coincided with the flag carrier’s 75th anniversary. Cebu is one of the most developed provinces in the Philippines and its capital Cebu City is the main center of commerce, trade, education and industry in the Visayas. For the past several years Cebu has been recognized as one of the country’s prime tourist destinations by many respected travel and tourism organizations including the highly influential Conde Nast Travel Magazine. This is not so surprising considering that the Central Philippines island-province offers the tourists numerous opportunities for diving, nature tourism, sun and beach adventure, cultural tourism, health and wellness, not to mention shopping and leisure. It was my first trip to Cebu and naturally I was excited – like most of my Fam Tour buddies. From day one, it was easy to see why any traveler would fall in love with Cebu. The city is a crossroad where modern and provincial life meet; a bustling metropolis with a rural feel to it. And unlike Manila, traffic is not as bad. Our first stop was a visit to the Kenneth Cobonpue showroom. Kenneth Cobonpue is a renowned and award winning industrial designer who had placed the Philippines arts and craft on the spotlight with his signature furniture designs using abaca, rattan, bamboo and other natural fibers. His never before seen furniture designs make them in high demand among the world’s elite and Hollywood celebrities including Bratt Pitt and Angelina Jolie. During our showroom visit I could only wish I could afford those uniquely designed and crafted furniture. I may not have the resources to own one of them but nothing is stopping me from dreaming. Providing a stark contrast from the modern and exotic display at the Cobonpue showroom is the Yap-San Diego Ancestral House, which was our next destination. Upon entering the threshold, I had the strange feeling that I was being transported back to the past. Like a picture that

is frozen in time, the house showcases authentic objects from the past that provide a glimpse of what kind of life our ancestors lived centuries ago. It even contains the furnitures and belongings of those who lived there in the past. It was built over 400 years ago. What is most amazing was that the house has been in the same family line for eight generations and remains habitable to this day. In fact, a member of the family – whom we had the privilege of personally meeting during the tour – still sleeps in the old house at least once a week. A visit to Magellan’s Cross is an opportunity to review my knowledge of Philippine history. Planted by the Portuguese explorer who history says was the “discoverer” of the Philippines, Magellan’s Cross is an icon worth seeing if only for its historical and religious significance. Naturally tourists tend to crowd in and around the small edifice where local women come to you and ask you to buy their candles for offering. Close by, of course, is the Basilica del Santo Nino, home to the oldest religious relic in the Philippines -the statue of the Child Jesus. While the church’s beautiful ancient architecture, its religious adornments and paintings are enough reasons for a visit, you simply cannot ignore the place’s religious significance to the country’s history. For more of history, paintings and antique collections, another place to see is the 18th century Fort San Pedro, the oldest and smallest fort in the country. Pressed for time, we could only spare a few minutes for a quick glimpse of what this centuries-old military defense structure has on display. Still it was worth a visit. Cebu is definitely a beautiful tourist destination, with lots of product offerings to the traveler. Exotic and scenic spots abound in the island as well as unique and interesting arts and crafts that are helping in propelling the city’s economic growth. Island Girl fashion accessories is one such industry. The products – fashion accessory pieces – were very stylish, vibrant and imaginative. What better way to cap our day than a visit to Island Girl showroom, where we get to design our own accessory and take it home. The following day took us to beautiful Bohol via Supercat 2Go. Travel was fast! The ferry took less than two hours sail through

the calm waters of the Cebu Strait before reaching Bohol. And by the time we disembarked in Tagbilaran City, everyone was raring to go on the countryside tour. Tarsiers here we come! Let’s talk about those cuddly little adorable creatures that resemble tiny ETs. Easily mistaken for a monkey or a rat, Tarsier is probably the smallest mammal on the face of the planet. It can easily fit in the palm of your hand. Whatever, it’s so easy to fall in love with these teeny tiny bizarre animals, which according to our guide spend the day sleeping and getting active only during the night. Another interesting thing about them is that they can rotate their heads 180 degrees. How’s that for an amazing feat? One thing to remember though: when visiting the Tarsier Sanctuary, be extremely quiet as they are very sensitive to the noises and light, so you better be cautious around them. Another activity that made our trip to Bohol exciting was the Loboc River Cruise. The journey on the river took at least half an hour each way – and all the time, food and entertainment were in abundance. Food was served buffet style and everything is quite tasty. Loboc River may not be affluent, but it was definitely picturesque. On both sides lush jungles fringed the waters and offered great photo opportunities. Few houses on shore and fishing boats complete a simple rural landscape that made me missed life in the province. And – I definitely didn’t expect the small waterfalls at the end of the route. They are called Busay Falls and are simply gorgeous! Another pleasant surprise was the performances of the barge cum restaurant crew who doubled as entertainers, much to the delight of the members of our Fam Trip. Nothing could be more charming than having your meal with friends while you’re being serenaded by talented music-loving Filipinos. It was not surprising that after a few minutes, we were on our feet dancing and singing karaoke-style. Everything happened spontaneously, so what could be more fun than that? Of course one doesn’t go to Bohol and miss the “Chocolate Hills”. To reach the Chocolate Hills in the town of Carmen, we drove through the two-kilometer stretch of densely planted mahogany trees called the Man-made Forest in the border of Loboc and Bilar towns, passing by

old churches along the way. Chocolate Hills are the greatest pride of Bohol. These perplexing geological formations are a strange group of oddly shaped hills – a lot of hills, in fact, they total at least 1,260 spread over an area of more than 50 square kilometers or 20 square miles. It is not easy to describe the place. Being there for the first time, I was completely awestruck. The scenery was unbelievable. Surely, I am not the only one baffled by these strange earth formations that are truly fascinating. We had such a wonderful time in Bohol. Unfortunately we did not have the luxury of time to see and experience everything that Bohol has to offer. It was truly regretful that we had to leave so soon. Again, we travel back to Cebu via ferryboat. It was an exhausting trip, but I was truly exhilarated by the day’s activities. Dinner at Radisson Blu Hotel was another highlight of the Fam Tour. Radisson Blu in Cebu City exudes a unique elegance and comfort that makes you feel at home. It is conveniently located in Downtown Cebu near the SM Shopping Mall, which you can reach by using a walkway from the hotel. Of course, SM Mall needs no further introduction especially to us Filipinos, but its proximity is one of the many advantages Radisson Blu Hotel offers to its guests, besides of course the excellent dining and the courteous and helpful staff, led by Ann Olalo, Radisson Blu Hotel’s Area Director of Sales and Marketing who made each one of us in the Fam Tour very welcome. Our visit to Cebu and Bohol was definitely worthwhile, fun and memorable. Besides Philippine Airlines, credit also goes to DOT VII Regional Director Rowena Lu Y. Montecillo, who commissioned Southwind Travel to oversee the Cebu and Bohol legs of. the Fam Trip. In return, Southwind Travel did not disappoint because they provided Unfortunately, all things had to end – even the good ones. Two days had gone by so quickly. It was amazing, however, at how much we’ve done, seen, and experience in the past 48 hours that would make others want to experience the same. Yet there were so much left to do, see, discover, and explore in both provinces. Before boarding the plane that would take us to Manila, I made a promise to myself: I will come back – for sure!

LP bet Roxas up in latest ABS-CBN, Pulse Asia survey MANILA, May 4 (PNA) – More Filipinos are signifying their preference for the continuation of the good governance bid as shown on the improvement of ranking of Liberal Party (LP) presidential candidate Mar Roxas in the latest Pulse Asia and ABS-CBN survey, a Malacanang official said. Based on the results of the ABSCBN pre-electoral national survey conducted by Pulse Asia from April 19-24, 2016, Roxas came in third among the first choice preference, after Davao City Mayor Rodrigo Duterte and Sen. Grace Poe. Roxas got a 20 percent rating after Duterte’s 33 percent and Poe’s 22 percent. This is an improvement from the

MANILA, May 4 (Mabuhay) – With only five days left before the elections, the names topping the senatorial race remain the same as in the past surveys, results of the latest Pulse Asia survey released Wednesday showed. In the survey conducted from April 26 to 29, Senate President Franklin Drilon enjoyed solo first place with an overall voter preference of 47.8 percent followed by former frontrunner Senator Vicente Sotto III who got 43.5 percent (2nd to 3rd places). Former Senator Francis Pangilinan got 41.9 percent (2nd to 4th places). Only the ranking of the top Senate bets were changing. Former Senator Juan Miguel Zubiri got a voter preference of 38.9 percent, bringing him to 3rd to 7th places from his previous 4th to 8th places ranking. Ex-Senator Panfilo Lacson received 38.5 percent at 4th to 8th places from his previous 4th to 6th ranking. Among those consistent in the top 12 slots were Sarangani Rep. Manny Pacquiao (37.0 percent, 4th to 10th places); former Akbayan Rep. Filipino-Austrian makes wave in ice skating KALIBO, Aklan, May 5 (PNA) – A 14-year old Filipino-Austrian is making waves in the field of slalom ice skating and aims to be a professional ice skater in the future. In a recent interview with his mother, Gemma Imbang Umgeher, she said that his son Marco Umgeher won several awards in the field of ice skating since 2012. His latest achievement in the field of so-called competitive winter

sports is being first place in the total rating of the national championship in Austria. He also won first place in the slalom race National Championship in Hochkar, Austria; 3rd place, giant slalom race National Championship in Lackenhof, Otscher, Austria, and 5th place, in Supr-G race, National Championship. Marco started joining and winning the ice skating sports since he was

12 years old. Gemma traces her roots in Sebaste, Antique. “My son Marco wants to visit the Philippines. PHL’s first strategic sealift vessel now undergoing sea trials MANILA, May 5 (PNA) – The Philippine Navy (PN) announced that sea trials are now being conducted for the country’s first strategic sealift vessel (SSV) which was built by Indonesian builder PT PAL (Persero) in its Surabaya shipyard. “This week, our SSV is undergoing sea trials and hopefully, (once she completes these) she will be scheduled for an endurance run,” PN spokesperson Capt. Lued Lincuna said in Filipino. Lincuna said these testing phases aim to check the performance of all machineries and equipment of the SSV. “It is also conducted to check and

measure the ship’s general performance and seaworthiness,” he added. The first SSV is expected to arrive in the Philippines by the third week of May or well in time for the PN’s 118th founding anniversary on May 20. The Philippines has a two-SSV order with PT PAL (Persero) for Php3,870,000,000 which is sourced from the AFP Modernization Fund. The SSV acquisition project for the PN was initiated upon the approval of Acquisition Decision Memorandum Number 2012-060 by Defense Secretary Voltaire Gazmin last Oct. 30, 2013. The Department of National De-

fense declared Persero as the Single Calculated Responsive Bidder with a bidding price of PHP3.87 billion on Nov. 18, 2014. The SSVs are programmed to be the PN’s floating command center carrying out their main purpose as military sealift and transport vessels and also for humanitarian assistance and disaster response. The ships are estimated to weigh around 7,300 gross register tons. Further, these vessels are critical assets for civil-military operations due to their capability of transporting large number of soldiers, logistics, and supplies.

Northern Palawan towns declare state of calamity due to El Niño By Jesus M. Ustares

PUERTO PRINCESA CITY, May 5 (PNA) – The northern Palawan municipality of Roxas is next in declaring a “state of calamity” due to the effects of the El Niño phenomenon, one of which is dried up water sources. Municipal Disaster Risk Reduction Management Officer Jerry Alili confirmed Wednesday the declaration of Roxas under a state of calam-

ity following the approval on May 2 of an ordinance pertaining to it by the Sangguniang Bayan. Alili said Roxas has now become thirsty for water, and about 819 hectares of farm and agricultural lands have also been affected by the long dry spell. The municipal government, he explained, is serious in its plan to put water pumps in barangays in Roxas, where there are sources of water to be able to deliver to other areas.

At present, he said they are rationing water with the help of the fire trucks of the Municipal Fire Station (MFS), and are contemplating on packing relief goods for distribution to families just in case they need food support since they cannot till their farmlands. Aside from Roxas, the northern towns too, of Dumaran and Taytay, have proclaimed states of calamity due to El Niño.

MANILA, May 4 (PNA) – The use of paints with no added lead, a brain-harming chemical, in schools got resounding thumbs up from doctors, bishops, educators, trade unionists, environmentalists and “green” candidates for the May 9 polls. To signify their support for this civil society-initiated advocacy, over 100 groups and individuals coming from diverse backgrounds have signed the “Solidarity Statement towards a Lead-Safe School Environment for Bright and Healthy Children.” Last March 28, the EcoWaste Coalition wrote to Department of Education (DepEd) Secretary Armin Luistro requesting him to issue a directive that will make it mandatory for schools to use lead-safe paints to minimize, if not eliminate, sources of lead pollution in the school environment. “We join the EcoWaste Coalition, a non-profit environmental group, in calling on the DepEd to declare the entire educational system as a lead-free zone by adopting a leadsafe paint procurement policy and by carefully addressing lead paint hazards,” the statement said. “Childhood lead exposure, mainly through the ingestion and inhalation of lead-containing paint, dust and soil - which are major sources of lead exposure among children - can and must be prevented to protect our children’s brains, their health and future,” it stated. “With broad support from a cross section of the society, we are certain that Sec. Luistro will swiftly take action before students and teachers return to class to ensure only lead-free paints are used to decorate schools,” said Aileen Lucero, Coordinator, EcoWaste Coalition. “The adoption of a lead-safe school policy will have enduring health benefits for the students and also for the teachers and non-academic personnel,” she said, noting that lead exposure in adults can cause, among many lead-induced health effects, abnormal sperm, reduced sperm count, miscarriages and stillbirths. Politicians known for their “green” platforms were among those who

signed the statement, including presidential candidate Grace Poe and her runningmate Chiz Escudero, as well as senatorial candidates Neri Colmenares, Risa Hontiveros and Juan Miguel Zubiri. House leader moves to end labor contractualization

MANILA, May 4 (PNA) – The chairman of the House Committee on Labor and Employment has called for support on pending bills designed to put an end to the practice of “endo” or labor contractualization in the country. Rep. Karlo Alexei B. Nograles (1st District, Davao City) said at least three bills were filed to address the gaps in Presidential Decree 442, or the Labor Code of the Philippines, as amended, and provide an alternative approach to the political gridlock of workers and employers on the issue of contractualization, better known as “endo” or end of contract. “These bills seek to institutionalize the multiple approach adopted by the Department of Labor and Employment in addressing the issue of ‘endo’ or contractualization, which is synonymous to circumvention of labor laws on labor standards and occupational safety and health standards, security of tenure, and right to self-organization and collective bargaining,” Nograles said.

Nograles said one of the pending measures is House Bill 5415, which clearly defines legitimate contractor or subcontractor as an employer engaged in providing job, work or services to another business. “The measure enumerates the requirements and elements of legitimate contracting or subcontracting and allows industry-based contracting and subcontracting arrangement through tripartite consultation,” Nograles said. Nograles said one of the amendments to Article 106 to 109 of Presidential Decree 442, as amended, shifts from registration to licensing of contractor or subcontractor, but retains the solidary liability of the principal employer with the contractor or subcontractor for unpaid wages, labor standards, and other welfare benefits of the workers. “The measure recognizes trilateral relationship and includes provisions on liabilities of the parties, and rights of workers including the right to self-organization,” Nograles said.

Relief from default in divorce cases There are situations in both Divorce and Child Support cases where the Summons and Petition resulted to a default against one party for failing to respond on time. In certain situations, the defaulted party failed to respond on time because he or she did not even know that he or she was served with a Summons. This situation places the defaulted party in a precarious situation in that the first time the defaulted party usually becomes aware of the existence of the case is when the default child support judgment or divorce judgment is actually being enforced against the defaulted party. At this point, the party no longer has the right to participate or defend itself in the litigation. Based on my experience in practice, the defaulted party usually gets in this situation because they moved residences and the summons was served at the prior residence. Sometimes, the proof of service of summons is fraudulent or defective. Fortunately, relief is available for the defaulted party. If a default judgment is entered against a party who was served with summons, but service did not result in actual notice in time to defend the action, the party may serve and file a notice of motion to set aside the default or

Night market along Roxas Avenue, Davao City now a tourist attraction DAVAO CITY, May 5 (PNA) – The night market along Roxas Avenue here has not only helped raised revenues for the city but has also become a must-visit for both locals and tourists since it started three years ago. Yusop Jimlani, head of the Drainage and Demolition Unit (DMDU) under the City’s Mayor’s Office that monitors the night market, said for its three years of operation, the income on taxes had increased. He said income went more than double with P5,473,421.56 or 144 percent in 2015 compared to the 2014 income pegged at P2,242,867.07. The income last year was much higher than its target of P4 million, Jimlani said. For the first two months this year, he said DMDU already collected some P1.1 million. He attributed the increase in revenues to their aggressive monitoring and collection. Jimlani said the night market has become a frequent destination of visitors and tourists, who are looking for rummage sale, used imported items or “ukay-ukay” and an array of street food. “The business in the night market is booming and the Roxas Night Market is already a destination of people,” he said. There are about 690 vendors in the night market. Of this number, 180 are selling accessories; 160, food; and 350 are selling ukay-ukay. A plan to replicate the night market concept is being developed in other areas in the city such as in Toril, Ilustre Extension, Sta. Ana Avenue, Magsaysay St. and in Agdao. Part of the plan is to put up some structures and provide entertainment, additional lights, signage, and a lot more, Jimlani said. The night market was established to decongest sidewalks occupied by vendors and allow them to continue selling their goods in a designated area from 6:00 pm to 2:00 am on weekdays and 4:00 pm to 12:00 midnight on weekends. Receipt of summons and complaint by a non-English speaking defendant lacking in business sophistication may not impart “actual

knowledge.” Goya v. P.E.R.U. Enterprises, 87 Cal. App. 3d 886, 151 Cal. Rptr. 258 (2d Dist. 1978); Tunis v. Barrow, 184 Cal. App. 3d 1069, 229 Cal. Rptr. 389 (2d Dist. 1986) So even if you actually received the complaint, if you do not speak English and are not sophisticated with business and legal matters, you may use the arguments that the default judgment should be set aside because you did not receive “actual notice.” It is the Court’s policy to, as reflected in the Olvera case, to liberally grant setting aside such defaults and having the case heard on the merits. Default Judgment may be set aside by an attorney by filing a Motion for relief from default. This would be accompanied by a declaration from the defaulted party that he never received actual notice. A copy of the proposed response is also required to be filed with the court. This type of motion must be filed and served within 2 years after entry of default judgment or within 180 days after service of a notice of default or default judgment on the defaulted party, whichever comes first. If you are a defaulted party, you should retain the representation of an experienced attorney to set the default aside as soon as you can.

Honoring those who loved and cared for us on Mother’s Day As we celebrate Mother’s Day on Sunday, May 8th, I’d like to honor my grandmother “Potenciana Ebuen - Yap) and my mother’s two sisters: Antonina “Tia Toning,� and Remedios “Tia Meding� Rimando, who all loved and cared for me when I was around three years old. My mother left me in their loving care, as she had to take care of my Dad in another province, who was medically discharged from his military officer duties after his Death March experience, battled various illnesses and finally passed away. These three women in my early life, pampered me tremendously and when my mother came back, it took a while for us to re-establish our mother-daughter bond I recalled my grandmother, whom I called “Papo,� would always bring me to the market, to buy whatever I like such as clothes and toys and gave me additional money once we got home, so I can buy candies and comic books at the corner store. My cousin

Amang and I used to fight for her attention, as we were the youngest among her eight (8) grandchildren. Los Angeles City Council member David Ryu, Board of Public Works Commissioner Joel Jacinto, the Los Angeles Department of Cultural Affairs (DCA) and several other LA City Council members, celebrated the Asian-Pacific Heritage month at the City Hall on April 22, 2016. The month-long celebration, attended by various elected government officials, Asian community leaders and Asian media, kicked off with a welcome speech by Councilman David Ryu who welcomed everyone and said that “today marks a combination of our past and future. As Asians, we are now more visible in the community.� Councilmember Herb Wesson also said that “celebrating the Asian Pacific Heritage Month is an important day for all of us here in LA, to honor the Asian Americans who make LA a better place, such as Korean Air Lines who’s currently building a $1.2 billion building on the corner of Wilshire and Figueroa.� Entertainment was provided by a ukulele player and a Korean cultural dance group along with a wide selection of breakfast plates at the 3rd floor of the City Hall Rotunda.

A special presentation followed at the City Hall’s Council Chambers, where a month-long calendar of activities and cultural guide was unveiled. Various City Council members spoke honoring Asian-Pacific community leaders, businesses and companies who support the 2016 Asian Pacific Heritage Month celebration and its theme of “We Are LA.� Among the honorees mentioned at the Council Chambers were: Korean Air Lines, the Asian Policy and Planning Council (A3PCON) and AC Martin. Seniors plan their golden years One gets rid of debt. the other attempts to collect monies lent I got my senior’s week last week. Two different seniors, both over 80 came to see me for different reasons. The first was 83. He was in good health, just a little stooped. Still works full time and receives social security. Wife receives a small social security. He and his wife live with their son, so they have no mortgage or rent expense, which is good. He has a new car and pays a car loan of $400. He wants to keep the car. He has an old car that he used as collateral for a high interest loan. He does not want to keep the old car because the high interest loan requires $500 a month at 50% annual interest. Yes, that’s pretty high interest for a secured debt. His problem is $35,000 of credit card debt that he has kept current for the last 15 years, paying $1,000 a month. He though it wasn’t such a great idea keeping them current in the last 15 years because he already forked over $180,000 in the last 15 years to keep them current, and surprise! He still owes the same $35,000 now. He thought he certainly would have been happier now if he had that $180,000 in his pocket. He could take his wife, his sweetheart of 60 years cruising all over the world and pay cash for His wife wanted to take a cruise to the Greek isles and the Mediterranean coast, maybe spend a couple of days in Barcelona, enjoying the artwork of Dali and the whimsical architecture of Gaudi. He wanted to see the office of the Philippine tobacco company, which was in Barcelona when the Spaniards were still lording it over the islands. I asked him what’s your connection with the Philippine tobacco company anyway? He said his grandfather worked for that company his whole life and all

he got from it was a gold plated watch and a gold plated cigar. Not even a good pension that he could live with. Why was your grandfather a Spaniard, I asked? He was an illustrado, he said, with a moustache that made him look like Pancho Villa. I asked him if he could still speak Spanish and he said “Claro que si, senor abogado.� In fact, he told me that he still had many relatives in Barcelona, that’s why he wanted to bring his sweetheart to visit, and he wanted to meet all his Spanish relatives. Well, I told him that if you had gotten rid of your $35K of credit card debt 15 years ago with a Chapter 7 petition, then today, you could actually buy a condo in the south coast of Spain, and retire there with your sweetheart for a quarter of the cost of living in LA. Instead of being able to retire there with a fully paid condo overlooking the tranquil Mediterranean, you now have to get rid of your $35K of credit card debt, and live in a tiny room with your son. Think about the opportunity you missed to live in the South coast of Spain now, just because you wanted to keep your $35K of credit cards current for 15 years. And even if you prefer to live here in LA, the $180K of cash in your pocket, well managed, can give you an extra $700 of income a month which you can use to indulge what you and your wife want to do now. Otherwise, you wake ip everyday and just stare at each other, or watch TV the whole day. DOJ sets next hearing on USD81-M money laundering scam on May 19 MANILA, May 4 (PNA) – The Department of Justice (DOJ) has set the next preliminary investigation into the alleged USD81-million money laundering scam on May 19, 2016 at 10 a.m. This after the camp of casino junket operator and businessman Kim Wong failed to comply with the order of DOJ Assistant State Prosecutor Gilmare Fe Pacamara for him to submit his counter-affidavit on the case of violation of the Anti-Money Laundering Law until 5 p.m. on Tuesday. Instead, Wong, through his legal counsel, Atty. Christopher James Purisima, filed a motion for reconsideration (MR) questioning the dismissal made by Pacamara on his motion for an additional 15-day extension within which to file the counter-affidavit. In an ambush interview, Purisima said that the reason why they asked for an extension was because they would like to know whether Kim Wong was included in the new case filed by the Anti-Money Laundering Council (AMLC) last Thursday against the spouses Michael and Salud Bautista, the owners of Philrem. Purisima added that if indeed his client was included in the new case filed by the AMLC before the DOJ against the Philrem, they are planning to also include the same in their counter-affidavit so that they will have a consolidated counter-affidavit on the said case.

During the closed-door preliminary investigation conducted by Pacamara, former Rizal Commercial Banking Corporation (RCBC)-Jupiter, Makati City branch manager Maia Deguito, together with her legal counsel, Atty. Ferdinand Topacio, and Kim Wong’s legal counsel both asked for additional extension to submit their respective counter-affidavits. However, this was opposed by the representative of the AMLC in the sense that they were both granted an extension during the last hearing to file their counter-affidavits. Hence, Pacamara decided to deny the motion of the respondents wherein they were given until 5 p.m. on Tuesday to submit their respective counter-affidavits. Only the camp of Deguito was able to comply and filed the counter-affidavit. This was in connection with the case filed against her by the AMLC on her alleged involvement in the money laundering of the stolen USD81 million from the Central Bank of Bangladesh. Deguito executed and subscribed to her 15-page counter-affidavit before DOJ Prosecution Attorney Roxanne Cu. However, the camp of Deguito refused to give details on the contents of the counter-affidavit, except to say that they asked the DOJ to dismiss the case. (PNA)

So, at least you end up with money judgments that accrue legal interest at 10% yearly. In addition, placing judgment liens on real property can enforce these money judgments, wages can be garnished, and bank accounts can be levied. This is a lot better than waiting for his beloved relatives to start paying him back, which knows when. The truth is, which is better left unsaid, beloved relatives are probably waiting for client to kick the bucket so they can forget about paying him back. After all, he won’t need cash in heaven, would he? Nope.

DOH considers PhilHealth as solution for reducing What women want I really can’t figure out what women out- of-pocket expenditures of its members want as the next guy next to me. And, MANILA, May 4 (PNA) – The Department of Health (DOH) said on Wednesday that the Philippine Health Insurance Corporation (PhilHealth) can play a major role in bringing down the out-of-pocket expenditures of its sick members. According to DOH Secretary Janette L. Garin, the PhilHealth can be the “biggest consumer of medicines� as part of the enhancement of its health coverage which can help in the reduction of additional costs that patients shell out in the treatment of their illnesses. Secretary Garin said that such initiative is something that the next administration should push through as part of enhancing the healthcare

system as there are variations in the prices of medicines. She also said that in the process, PhilHealth can become a procuring entity, especially for the medicines that are usually and directly used by patients. She noted that it can also help bring down the costs of medicines at the same time. However, the Health chief said that such innovation will require legislation to allow PhilHealth to do it. According to her, other ways to do it is through insertion of changes or amendments on the PhilHealth charter and its implementing rules and regulation (IRR). Infants with vaccinated moms less likely to get flu: study WASHINGTON, May 4 (PNA/ Xinhua) – Babies are much less likely to get the flu during their first six months of life, if their moms get flu vaccinations while pregnant, a U.S. study said Tuesday. Infants six months and younger, whose mothers were vaccinated when pregnant, had a 70-percent reduction in laboratory-confirmed flu cases and an 80 percent reduction in flu-related hospitalizations, compared with babies whose moms weren’t immunized, according to the study published online in the U.S. journal Pediatrics. “Babies cannot be immunized during their first six months, so they must rely on others for protection

from the flu during that time,� said lead author Julie Shakib, assistant professor of pediatrics at the University of Utah School of Medicine. “When pregnant women get the flu vaccine there are clear benefits for their infants.� In the new study, Shakib and colleagues examined more than 245,000 de-identified health records of pregnant women and more than 249,000 infant records for nine flu seasons from December 2005 through March 2014. About 10 percent of the women --23,383-- reported being vaccinated while pregnant compared with 222,003 who said they were not vaccinated, they found.

Aquino opens Mt. Hamiguitan Eco Park in Davao Oriental By Lilian C. Mellejor

MT. HAMIGUITAN, Davao Oriental, May 5 (PNA) – President Benigno Aquino III officially opened the Mt. Hamiguitan Eco Park and Interpretation Site which also houses the Natural Science Museum on Wednesday afternoon. Mr. Aquino, who together with Governor Corazon Malanyaon unveiled the park’s marker, lauded the opening as it would serve as a critical habitat to protect biodiversity. He said the site will spike tourist arrivals in the province and open more opportunities for jobs and livelihood. As he is bowing out of office in June, President Aquino said he is leaving as legacy to the province the improved roads to the heritage site. The national government has complemented building of roads and bridges in the province at the cost of Php236 million. Governor Malanyaon thanked the President for his administration’s support to the province. She said the museum is the centerpiece and symbol of the collective efforts of the national and local government. The museum is located at Hamiguitan’s buffer zone which was developed with support of the Tourism Infrastructure and Enterprise Zone Authority (TIEZA) and the Department of Tourism. The Eco Park features a Visitor’s Information Center, museum, research and tourists cabins, mountain trails and camping grounds, among others. Recently, Mt. Hamiguitan bagged another international recognition as

ASEAN Heritage Park after being inscribed in UNESCO’s World Heritage list last year. The Mt. Hamiguitan Range Wildlife Sanctuary now joins other Southeast Asia’s ASEAN heritage areas which are recognized for biodiversity importance and exceptional uniqueness throughout the Association of Southeast Asian Nation (ASEAN) member states. Mt. Hamiguitan is the 8th declared ASEAN Heritage Park in the Philippines and the 34th in Southeast Asia. The other ASEAN heritage parks in the country are Mt. Apo; Mt. Iglit-Baco Natural Resources; Mt. Kitanglad Range Natural Park; Mt. Malindang; Mt. Makiling Forest Reserve; Mt. Timpoog Hibok Hibok Natural Park and Tubbataha Reefs Natural Park. Mt. Hamiguitan was nominated along with Tubbataha Reef. It was during the 15th informal ASEAN Ministerial Meeting on the environment when the nomination was approved. This is the second recognition for the mountain range. Last year, Mt. Hamiguitan was inscribed to the World Heritage list of the United Nations Educational, Scientific and Cultural Organization (UNESCO). It is also identified and declared as one of the sites in the Philippines under a site-based Long Term Ecological Research (LTER) by the Philippines LTER, which is one of the country-based networks of International LTER. ILTER consists of networks of scientists with the aim to improve understanding of global ecosystem.

Rosal has expressed his deepest gratitude to President Benigno Simeon Aquino III for giving importance to the province of Albay in terms of infrastructure projects.The Chief Executive is slated to visit Legazpi City on Thursday to inaugurate the completed improvement and expansion of the Yawa Bridge, which connects Legazpi City and the first district of Albay. To be inaugurated also is the completed Tibu Pumping Station in Barangay San Roque as part of the Urban Drainage Improvement Project, the Philippine Information Agency said during a media briefing Wednesday afternoon. The improvement and expansion of the former two-lane Yawa Bridge to now four-lane highway have now been completed by the Department of Public Work and Highway (DPWH) Bicol regional office. The project costs some Php90 million, including the widening of the 140-linear-meter bridge to more than two lanes, 720-linear-meter fourlane PCCP including bridge approach and roads, drainage structure and 313 linear-meter slope protection works,” Reynaldo Tagundando, DPWH Bicol regional director, said. Rosal said the expansion of the Yawa Bridge will facilitate the means of transporting agricultural products and other basic services and make transportation convenient for the riding public. The bridge and connecting road network cater to motorists taking the Legazpi City-Sto. Domingo-Tabaco-Camarines Sur boundary route and is within the territorial bounds of Barangay Rawis where the national government’s regional offices are located. Rosal said the expanded bridge will serve as an instrument of uniting the people and open a new horizon for progress, peace, education, business and employment. Quezon City – By next week, the Philippines will have a new president that will hopefully address the endemic problems the country has been dealing with, for a long period of time which includes poverty, crime, corruption and unemployment. People are hoping that their next president will be able to rally and unite the fragmented Filipinos into one nation so that it can move on and progress economically like its neighboring Asian countries. Most often than not the country for so many years has been unable to attain economic progress due to partisan politics and pervasive corruption in all corridors of the government. Ever since the downfall of the Marcos regime, the country has not so far attained the economic growth every president after Marcos has envisioned, in order for the government to at least improve the lives of millions of destitute Filipinos, particularly those living in far-flung provinces. By Monday, May 9, on election day here in the Philippines, Davao City Mayor Rodrigo Duterte appears to be the top choice of most Filipinos to be their next president. Most people that I have talked with, from taxi drivers, restaurant workers, sales workers as well as jeepney and tricycle drivers and young college students, are all rooting for a Duterte presidency. They all have the same answer when asked why Duterte. They want radical change. They said they are tired of all the empty promises of traditional politicians who do nothing to improve the lives of the “common tao.” The frustrations, disappointments and anger of the people have catapulted Mayor Duterte as the top choice of Filipinos to be their next president. Latest Pulse Asia survey showed that Duterte is still ahead over his rivals in the presidential derby with a 33 per cent voter preference. The poll survey, commissioned by television network ABS-CBN and conducted from April 26 to April 29, showed that Duterte is still maintaining his 58 per cent preference rating among voters in Mindanao. Out of nowhere, former DILG Secretary Mar Roxas, LP presidential bet and the anointed candidate of President Noynoy is now in third place based on the same Pulse Asia Survey conducted last week. Based on the same survey, Roxas is now statistically tied with Senator Grace Poe Llamanzares. Vice President Jojo Binay has slid down to fourth place. Despite that, however, Binay remains upbeat on his chances of being elected as the next president. In a news conference held in Isabela, Binay said he is no longer paying attention to surveys. He said he will just wait for the outcome of the election on May 9.

In the vice presidential race, Senator Bongbong Marcos is still on top based on the same survey. In second is Congresswoman Leni Robredo. Senator Francis “Chiz”Escudero is now in third place. In Manila, some people are saying that the tight race between Erap Estrada and former city mayor Alfredo Lim might enable Congressman Amado Bagatsing to pull a surprise to win the mayoralty contest. Estrada is heavily depending on the thickly populated Tondo district will help him win his second term as mayor in Manila. Meanwhile, people all over the country remain uneasy with the election only a few days away as of this writing. The voting public are hoping that the election will be peaceful and orderly, although they expressed reservation regarding the assurances made by the Commission on Election (Comelec) that there is no way that the PCOS machines can be manipulated to favor certain candidates. Shirley Buenorostro, a Grade 10 public school teacher at the San Francisco high school in Quezon City said she will ensure that voters will be able to cast their votes in favor of their preferred candidates. “I hope that I may be able to preserve the sanctity of every ballot to be cast in my precinct to ensure a fair, clean and honest election that every voters desires,” she said. Jane Pamintuan, a house helper in Antipolo city is a Duterte volunteer worker, In her spare time after her work, she and her fellow volunteer friends conduct house-to-house campaign to ensure a Duterte victory in the May 9 election. Pamintuan, a mother of three kids, age from 10, 8 and 4, is happy doing volunteer work with her friends without expecting any renumeration from the Duterte camp. Hopefully, Pamintuan said, a Duterte presidency will be able to address the common problems the people are facing in their daily struggle to survive. She remains hopeful that Duterte will be able to solve the surging crime incidence and drug problems in the country. Pamintuan’s husband, Carlos, is a tricycle driver. He has been robbed of his earnings twice by holdup artists in Antipolo city while plying his routes from early morning up to late in the evening. The couple hopes that with a Duterte as chief executive, there will be less crime in the city as well as in the whole nation.

Move up sellers are now becoming move up buyers; Great sign in our real estate cycle As home equity levels improve, the move-up buyer is back on the market. More move-up buyers are selling their current properties to replace them with pricier homes, according to the what I have been noticing. Believe it or not, but a lot of homeowners stuck it out thru the tough economic downturn because they can’t sell their home, they can’t refinance and they feel obligated to stay in the home, their conscience out weighted their practicality to let go of their mortgage and responsibility. But now, the home prices in most areas are back in the mid 2007-2008’s high and a lot of home owners are starting to consider selling their home. I have been getting a good number of calls from current homeowners wanting to sell and buy a bigger, better and newer home. My wish and prediction that if the move up sellers and buyers come back into the market, our Real Estate run will continue to be steady and strong. The move-up buyers are coming with larger down payments on new homes as recent improvements in home equity levels have allowed them to move. So, key to sell is to improve on your existing property for first time buyers. First time buyers now a days are typical working class couple, both employed possibly with

a couple of children. Last thing they want to do when they buy a house is to remodel, fix it up, improve or add to it. First time buyers now want a nice property, does not have to be new but completely upgraded and totally move in condition. These types of property priced right will sell very fast. An important sign of a healthy and sustainable recovery is increased housing turnover driven by trade-up buying, which is more or less discretionary spending. You will continue to see more move up buyers. These buyers are typically more responsive to market conditions and financial incentives. Thought of a Rising mortgage rates are driving the higher demand because move-up buyers are wanting to take advantage before mortgage rates rise any more, but now is the perfect time before rates actually move or inch up. Residents continue saving water efforts in state SACRAMENTO May 3, 2016 – Californians sharpened their water saving efforts in March, conserving 24.3 percent compared to the amount used in March 2013 – double February’s savings and evidence that residents and businesses remain concerned about the persistent drought now in its fifth year. Statewide cumulative savings from June 2015 to March 2016 totaled 23.9 percent compared with the same months in 2013. “While some parts of the state saw rain and snow, other parts, specifically the Central Valley and Southern California, didn’t; and yet, all Californians stepped up again to conserve water, because they know they can and that it is good for California,” said State Water Resources Control Board Chair Felicia Marcus. “Twenty-four percent in March is a stunningly welcome number. As we head into the warmer summer months, we need to keep conserving. We may not need the same levels of conservation as last year, but we still need to keep all we can in our reservoirs and groundwater basins in case this winter is just a punctuation mark in a longer drought.” With nearly 1.3 million acre-feet of water conserved from June 2015 through March 2016, the state continues to save an impressive amount of water. The March data show a strong start following renewed emergency water conservation regulations adopted by the Board on Feb. 2. A recent Field Poll indicates that a majority of California residents characterize the ongoing drought as “extremely serious,” with three quarters of those polled committed to ongoing water conservation. Statewide, the conservation rate doubled from 12 percent in February to 24.3 percent in March, likely due to wetter weather and more seasonal temperatures, along with awareness that drought conditions could outlast existing water supplies. A staff proposal that may offer revisions to the Feb. 2 emergency water conser-

vation regulations is expected soon, following review of written and oral comments from a public workshop on April 20 to receive input on conservation needs through the summer and fall. The workshop was conducted to solicit ideas for adjustments to the current emergency regulations given changes in water supply, storage, and snowpack as compared to last year’s historic statewide deficiencies. This staff proposal will be considered by the Board for comment and adoption on May 18. “It’s not time yet for a drought’s over party. That said, March brought us much needed rain and snow—still less than average but huge compared to the worst in 500 years, which is where we were last year,” Chair Marcus said. “We’ve gotten a bit of a reprieve, but not a hall pass. Now we are figuring out how to appropriately adjust to a better but not ideal situation.” Until the Board acts in May, residents are urged to continue applying their water conservation skills and habits through the spring months to include complying with urban water supplier directives on when outdoor irrigation is permitted, not irrigating outdoors during and within 48 hours following a rain event, and fixing leaks that are discovered during individual water user audits. An updated and extended emergency regulation was adopted by the Board on Feb. 2, with most revisions taking effect for the March reporting period. The regulation extends restrictions on urban water use through October while providing urban water suppliers some latitude in their conservation requirements. The action follows Governor Edmund G. Brown Jr.’s Nov. 13, 2015,Executive Order directing the State Water Board to extend the emergency water conservation regulation through Oct. 31, 2016should drought conditions persist. Any changes made by the Board May 18, would be anticipated to take effect in June, and remain in effect through Oct. 31, 2016.

The equity that was not there before due to the downturn of the real estate market is not very strong and rising. Also, 8.3 million additional home owners are expected to have at least

20 percent equity within the next 15 months if home prices continue to appreciate at the same pace, says RealtyTrac. Realty Traccomments adds that if 5 percent of these home owners decide to sell their homes, that would amount to an additional 415,000 homes for sale in the coming months. Cuisia, in his keynote address, described the Philippines’ path towards good governance, growth, and development as challenging, fulfilling, and dynamic, crediting the country’s economic transformation to the good governance program of the Aquino Administration and economic policies centered on inclusive growth. Ambassador Cuisia also cited the deepening Philippines-US relations along the defense and security, people-to-people and economic tracks as an avenue of continued cooperation for the next administration. “The Philippines is committed to be a proactive, reliable and responsible ally of the US, but more importantly, a strong Philippines is critical to the stability of South East Asia, and I do look forward to the Philippines continuing along its current path,” Ambassador Cuisia said. During the 1st panel on Governance, Growth and Development, Motoo Konishi, former World Bank Country Director for the Philippines emphasized the importance of addressing corruption and improving governance, protecting the population from climate change and environmental disasters and having peace in eliminating extreme poverty. The Aquino Administration has actively pursued these three objectives, according to Konishi. “Fighting poverty and eliminating poverty means that you have to know each poor, who they are and where they live, and your investments need to be targeted to those people. Fast growth doesn’t eliminate poverty, you have to choose your policies carefully,” Konishi said. “The Aquino Administration focused on pro-poor policies,” Konishi further added, stating that the Philippine experience will be a highlight of the World Bank’s flagship World Development Report this year. “The Filipino people are looking forward to more changes and to the continuation of reforms that the Aquino Administration started,” USAID’s Gloria Steele stressed, highlighting the accomplishments of the Aquino Administration in competitiveness, transparency,

corruption, tourism, infrastructure, education, and health. “Growth needs to be geographically dispersed throughout the country,” Steele noted on what more needs to be done, citing improvements in airport infrastructure and quality energy regulations as the two components of growth that the next administration can improve and focus on. Matthew Bohn of the Millennium Challenge Corporation lauded the first compact with the Philippines, which supported poverty reduction, inclusive growth, and elimination of corruption, as being one of MCC’s best compacts. He also expressed confidence that despite the challenges ahead, the Philippines will be able to sustain its growth and development largely because of the ground work that the Aquino administration has set in place. “The Aquino Administration has successfully put down deep and important roots for creating the conditions for (sustained) economic growth,” Bohn said. The second panel discussion on Security and Peace focused mainly on internal and external security challenges. Professor Zachary Abuza of the National War College described the modernization of the Philippine air force, military and marine forces, the deepening defense relations with the United States through the Enhanced Defense Cooperation Agreement (EDCA), and Balikatan exercises as some of the major accomplishments of the Aquino Administration. However, peace and security challenges remain in Mindanao, one of which is the coercive capacities of political dynasties and political families through the use of private armies. “For any lasting peace to happen in Mindanao, you have to eliminate the private armies,” Professor Patricio Abinales of the University of Hawaii at Manoa said. Professor Abinales also linked the private armies with the pervasive presence of the illicit sector, stating that the presence of illicit trade in Mindanao cannot be weakened without first eliminating the private armies. “Unilateral naming doesn’t change the status of a territory, sea or land,” Professor Ruth Wedgwood of Johns Hopkins SAIS said, switching the discussion from internal to external security challenges. Referring to the impending decision of the Arbitral Tribunal, Professor Wedgwood further stated that

Filipinos March Against Wage Theft in Long Beach on May Day LONG BEACH, CA - Filipinos were among hundreds of Long Beach community members who took to the streets and marched from MacArthur Park to City Hall on May 1, 2016 in support of workers’ and immigrants’ rights. The march was organized by the May Day Long Beach Coalition, consisting of 19 local organizations including the Filipino Migrant Center (FMC), Anakbayan Long Beach, and Gabriela Los Angeles. Towards the front of the march, a large Philippine flag waved next to an FMC banner stating “End Wage Theft! Fund Wage Enforcement!” In 2014, the Filipino Migrant Center along with other community organizations formed the Coalition to End Wage Theft in Long Beach to call for stronger enforcement against wage theft, the act of employers stealing of wages from workers, in the city. The most common forms of wage theft Filipino workers experience include unpaid hours, missed rest and meal breaks, and late paychecks. The Long Beach City Council voted in January 2016 to raise the minimum wage in the city to $19 per hour by 2019, with an option to increase it to $15 by 2021. Since the vote, the council has yet to draft the new ordinance, which organizers assert must include language on how to enforce the law. “We cannot raise the minimum wage without the city creating a local wage enforcement office. Otherwise, there will be no teeth to ensure that employers actually pay the new minimum wage,” said Nikole Cababa of the Filipino Migrant Center. “Filing a wage claim with the California Labor Commissioner’s Office takes years due to the severe backlog of cases and understaffing across the state. Few wage theft victims ever get their back pay under the current system.” In addition, organizers expressed concern over the Long Beach City Council’s proposed “training wage” policy that would be tacked on to the minimum wage increase. This proposal deems that newly hired workers in an industry would be paid only 85% of the minimum wage for a probationary period of 180 hours to as long as 480 hours. “The ‘training wage’ is essentially legalized wage theft. It’s a crime to pay below the minimum wage, and a ‘training wage’ would only perpetuate the problem.” said Cababa. Youth workers and newly arrived immigrant workers are expected to be most vulnerable to exploitation from the training wage. Cababa added, “What would prevent employers from constantly hiring and firing new workers before their probationary period is over? It only creates a loophole for squeezing more profits from new workers who do the same amount of work as their co-workers.”
