What happens to my car if I file bankruptcy? There are several issues to consider in answering this question. The most important point is the value of your car. In most cases, you can protect your car using the allowable bankruptcy code exemptions. An exemption allows you to file for bankruptcy relief and protect some of your property. The bankruptcy courts understand you need a car to get to work and to pick your kids up from school. So long as you aren’t driving an antique classic car, or an expensive sports car you will likely be able to keep your car. The next question is whether you have clear title to your car. If you have pledged your vehicle as security for a debt, or if you are financing or leasing a vehicle, you have three options for secured car loans when you file Chapter 7 bankruptcy. Reaffirm: A reaffirmation agreement is a contract between you and the car creditor in which you agree to pay the balance owed on your car note, despite the bankruptcy filing. You continue to make payments, and the creditor promises that, as long as payments are made, the creditor will not repossess or take back the property. Reaffirmed debts are not discharged, the debt survives the bankruptcy. If you do not make your car payments after you reaffirm the car loan the car lender can repossess the car and sue you for the deficiency balance. After the finance company repossesses the car they will sell the car at the auto auction. Usually the finance company does not get enough money from the auction to pay off your loan. This shortfall is called a “deficiency” and you would still be legally obligated to pay the creditor the deficiency balance. As you can see, the decision to reaffirm your car loan is a serious financial matter. Reaffirmation agreements are strictly voluntary. You are not required by the Bankruptcy Code or other state or federal law to reaffirm your car loan. Before entering into such an agreement, you will want to speak to your bankruptcy attorney to make sure that the reaffirmation is in your best interest. Redeem: In Chapter 7, you have the right to purchase or redeem your car from the creditor by making a lump sum payment equal to the car’s fair market value. The 2005 bankruptcy code provides that you must pay the creditor the replacement retail cost of the car. The balance of the debt will be discharged. For example, assume you own a car worth $5000.00, but owe the finance company $10,000.00. In this circumstance, you could redeem the vehicle by paying the creditor $5000.00 and the remaining balance will be discharged in your bankruptcy. Your bankruptcy attorney can advise you on the benefits of redeeming your financed car and identifying lenders that will provide the funds for your vehicle redemption. Surrender: If you cannot afford the monthly payments on your car loan, or if you determine that you owe more than the car is worth, you can unload the car and the debt in your Chapter 7 bankruptcy by surrendering the vehicle to the creditor.

Car Leases in Chapter 7 Bankruptcy If you are leasing your car when you file Chapter 7 bankruptcy you can choose to either continue making the monthly lease payments, or surrender the car back to the creditor. If you surrender the leased car, any obligation under the lease will be eliminated in your Chapter 7 bankruptcy case. Car Loans in Chapter 13 Bankruptcy Chapter 13 bankruptcy is a powerful tool to protect your car from repossession. If you have fallen behind on your car payments, you can file a Chapter 13 bankruptcy to stop the repossession of your vehicle and repay any delinquent monies due. If you are not delinquent, you have the choice of just continuing your regular payments, or surrender the vehicle, and discharge the balance as an unsecured debt, much te same way as in chapter 7. 910 Claims: If you bought your vehicle less than 910 days of filing your bankruptcy case, you must repay the entire car loan. The good news is that the interest rate you pay on your car loan may be significantly reduced. For example, if you owed $10,000 on a car loan whose blue book value was only $5000, you would be required to pay the entire $10,000 balance if the car was purchased less than 30 months, or 910 days, of filing. In short, debtors who want to keep their cars must pay the full loan amount, rather than “cram down” the debt to the value of the car. Cram Down: If you bought your car more than 910 days before you file bankruptcy, you will only have to repay an amount equal to the present value of the car. For example, if you owed $5000 on a car that is worth only $2500, upon filing Chapter 13 you would be required to repay the finance company only $2500 over the three to five year term of your Chapter 13 Plan. Car Leases in Chapter 13 Bankruptcy You car lease cannot be paid through the Chapter 13 Plan you devise with your bankruptcy attorney. You can “assume” the lease and continue making the monthly payments. You can “reject” the lease and return the car to the creditor. The creditor will sell the leased vehicle, apply the sale proceeds to your lease balance and then file a claim in your Chapter 13 bankruptcy case for the lease deficiency. This deficiency is an unsecured, non-priority claim, which means you will likely only pay the finance company pennies on the dollar. DFA, AFP verifying report China has taken over atoll near Palawan

MANILA, Mar 2 (Mabuhay) – The Department of Foreign Affairs (DFA) and the Armed Forces of the Philippines (AFP) on Wednesday said they are verifying a newspaper report that said that China has taken over a Philippine atoll near Palawan in the disputed West Philippine Sea (South China Sea). “We are in the process of verifying this report with concerned agencies,” DFA spokesperson Charles Jose said in a text message. The Philippine Star reported that China has seized Quirino or Jackson Atoll, a rich fishing ground for locals, with at least five gray and white Chinese ships. Filipino fishermen were reportedly not allowed to come near the atoll, which is within the Philippine exclusive economic zone and is between the Philippine-claimed La-

wak Island and Chinese-occupied Panganiban (Mischief) Reef. The AFP, meanwhile, refused to comment while the verification process is taking place. A military source who requested anonymity due to lack of authority to speak on the matter, confirmed that there is an “on and off presence” of Chinese ships in Philippine-claimed islands in the Spratlys including the Quirino Atoll. Kalayaan Mayor Eugenio Bito-onon Jr. was quoted as saying in the report that the Chinese ships in Quirino Atoll have been stationed there for more than a month. The Philippines is currently waiting on a decision by an arbitration court in The Hague on its territorial dispute China, which has repeatedly refused to participate in the proceedings. The ruling is expected by midyear.

Manila, Philippines | AFP | Wednesday 3/2/2016 – A German sailor whose mummified body was found on a yacht adrift off the southern Philippines had died of a heart attack about a week earlier, according to an autopsy report released Wednesday. Police earlier named the victim as Manfred Fritz Bajorat, based on documents found on the yacht last Friday, but still do not know where he had sailed from or where he was heading. “The cause of death is acute myocardial infarction based on the autopsy by (the) regional crime laboratory,” national police spokesman

VP Binay, Poe share lead in latest Pulse Asia survey

MANILA, Mar 4 (Mabuhay) – Presidential candidates Vice President Jejomar Binay and Senator Grace Poe are statistically tied on top in the latest presidential preference survey conducted by pollster Pulse Asia. In a media release on Friday, Pulse Asia announced the results of its latest presidential preference survey indicating that Poe (scoring 26 percent) and VP Binay (25 percent) share the lead. It said the rankings of the presidential candidates in the January study remain basically unchanged in the survey it conducted from February 15 to 20 this year. Saudi cleric’s shooting in PHL captured on film Manila, Philippines | AFP | A failed attempt to assassinate a prominent Saudi cleric in the Philippines was caught on television, showing the hooded assailant firing at the preacher from close range. The gunman walked toward Sheikh Aaidh al-Qarni’s car on Tuesday night as he was leaving a packed auditorium in the southern port city of Zamboanga, where he had given a lecture. The assailant hid behind a crowd seeking selfies with a smiling Qarni as his vehicle slowly rolled out of the venue, footage on local station Mensahe TV showed.

Qarni, who was on an Islamic State hit list, survived the attack with wounds to his right shoulder, left arm and chest, according to police. A shocked crowd scampered for safety covering their heads as the shots were fired. His companion in the car, Saudi Arabia’s religious attaché to the Philippines, Sheikh Turki Assaegh, was also wounded in the attack. Qarni’s police escorts shot the assassin dead. Identification cards found on his body indicated he was a 21-year-old student though police said they were not ruling out forgery.

He said the various local groups that had pledged allegiance to IS were “planning big operations, like bombings, attacks or assassinations”. Such violence has plagued large areas of the southern Philippines for decades, as Muslim rebels have fought a separatist insurgency that has claimed 120,000 lives. Latest survey results don’t reflect ‘real sentiments of Filipinos’ Duterte DAVAO CITY, Mar 4 (Mabuhay) – The camp of presidential candidate Davao City Mayor Rodrigo Duterte said the recent Pulse Asia survey results “do not reflect what we believe are the real sentiments of the Filipinos.” “On the ground, we are heartened and inspired by the positive and overwhelming responses from the people since we hit the campaign trail,” Peter Laviña, Duterte’s spokesperson, said in a statement. “We have seen our numbers steadily advancing overall. But we have also seen where we are weak and need to catch up, as well as recognize where we are making great headways,” he said. “The elections are still a good two months away and we have plenty of time to move up. We will remain vigilant and be on the lookout and will continue to work very hard,” Laviña added. Gunmen who have pledged allegiance to the jihadists controlling vast swathes of Iraq and Syria have instigated a series of deadly battles with the army since the nation’s parliament blocked the peace push last month. An assassination attempt this week on a visiting Saudi Arabian preacher who was on an IS hit list has raised the alarm further, although police emphasized they were yet to determine the gunman’s motives.

India demanded consultations over measures slapping fees on some kinds of temporary work visas for the United States, as well as rules limiting how many visas are handed out. India charged that the rules breached commitments Washington had made under international trade laws by treating Indians working in certain sectors, including in the computer and related services indus-

tries, within the United States less favourably than American citizens. DHS launches pilot program on hiring alien workers

WASHINGTON – The U.S. Department of Homeland Security (DHS) today announced the launch of a Known Employer pilot to assess a new process for employers seeking to hire certain workers through employment-based visa categories. By modifying the process U.S. Citizenship and Immigration Services (USCIS) uses to reviews an employer’s eligibility to sponsor individuals under certain employment-based immigrant and nonimmigrant classifications, the Known Employer pilot is expected to reduce paperwork, costs, and delays in the processing of these benefit requests. USCIS will oversee the pilot in collaboration with the DHS Office of Policy, U.S. Customs and Border Protection (CBP) and the U.S. Department of State (DOS). “Last year, DHS announced it would explore a Known Employer pilot to modernize and streamline the process for U.S. employers seeking to employ certain foreign workers,” said USCIS Director León Rodríguez. “Today, we’re partnering with a select group of representative organizations across a variety of industries to determine how we can improve efficiency and cut costs. If successful, we will continue to build on this trial program and promote robust trade, travel, and economic prosperity.” DHS first announced in January 2015 that it would explore a Known Employer pilot under the United States-Canada Beyond the Border initiative. The pilot also was highlighted as a recommendation in a report from federal agencies submitted to the President in July 2015, Modernizing and Streamlining Our Legal Immigration System for the 21st Century. The goals of the Known Employer pilot are to make the employment el-

igibility adjudication process more efficient while reducing delays for U.S. employers that wish to employ foreign workers under certain immigrant and nonimmigrant visa programs by: Reducing the amount of paperwork filed by employers and retained by USCIS; Promoting consistency in the adjudication of employment-based petitions and applications; Streamlining the adjudicative process to achieve greater efficiency within USCIS; and Providing greater support to CBP and DOS in support of greater efficiency and consistency at ports of entry and consular posts. Under the Known Employer pilot, up to nine preselected employers will file applications requesting that USCIS predetermine that they meet certain requirements relating to certain immigrant and nonimmigrant visa classifications. When making this request, employers will create a profile in the Web-based Known Employer Document Library (KEDL), and upload documents relating to the requirements. USCIS officers will review and predetermine whether a prospective employer has met certain requirements relating to the visa classifications, and if USCIS approves the employer’s predetermination request, the employer may then file petitions or applications for individual employees without needing to resubmit company information with each petition or application. Employers will not be charged any additional fees to participate in the Known Employer pilot. PHL hunts tomb raider-priest Iloilo, Philippines | AFP | Wednesday 3/2/2016 – Philippine authorities said Wednesday they are looking for a parish priest who allegedly damaged part of a historic cemetery chapel in search of treasure. Father Nelson Silvela, parish priest of the town of San Joaquin in the central island of Panay, vanished after the arrest of 10 men he allegedly hired to dig up the chapel known as the ‘Camposanto’, said Mayor Eduardo Servidad. “We consider the Camposanto a holy place and we did not expect a priest like him to do a thing like this,� he told AFP. The men had dug a hole about 18 meters (60 feet) long which had weakened the structure of the chapel located at the centre of the cemetery built in 1892, the mayor said. The cemetery and chapel, famous for its oriental baroque architecture

and ornate carvings, were declared a “national cultural treasure� in 2015 and have long been a tourist attraction. The 10 men, armed with tools, a metal detector and a water pump, were arrested on February 24 and later identified the priest as having hired them to dig for an unspecified treasure, Servidad said. The local archbishop, Angel Lagdameo, told AFP he had suspended the priest and would support any criminal charges against him. He said Father Silvela’s act was “a big violation� that had deeply hurt the people of his parish. The mayor said the priest may be charged with damaging cultural treasures, a crime punishable by 10 years in jail. 5 -year prison sentence for former Senator Leland Yee The 5-year prison sentence received by former Senator Leland Yee during an hour-long hearing by U.S.District Court Judge Charles Breyer was less than the eight year sentence requested by Yee’s prosecutors, claiming that Yee received “thousands of dollars in campaign contributions which he admitted was illegal. During the hearing, Yee asked the judge for leniency but Judge Breyer said that he was “not inclined to be lenient because Yee’s actions were ‘vile’ showing abuse of public trust.” Likewise, Assistant U.S. Attorney Susan Badger added that “Yee’s abuse of public trust, is the worst possible way to retain power as a public official.” As I recall, around August, 2013, this author was one of the guests invited at Mr. Yee’s political rally in Long Beach, when he was campaigning for the position of Secretary of State. In his attempt to woo the Filipino community, earlier in 2014, Mr. Yee also met with our media group, along with some leaders of the Filipino community. At the time, we were all impressed by his tenacious and devoted work with the Filipino community both here in LA, San Francisco and throughout the entire State of California as well. Sadly, to our surprise, around the latter part of 2014, Yee was caught in an FBI sting that allegedly recorded him promising votes and guns to an undercover agent, where he ended up pleading guilty “for doing political favors in exchange for campaign cash,” or as the judge plainly called it “for selling his vote.” The FBI sting included the convictions of Raymond “Shrimp Boy” Chow, a San Francisco Chinatown mobster and Keith Jackson, a former school board president and fundraiser for Yee, whose anomalous school board activities were also mentioned in an article published by a media colleague. Madani released his statement following his meeting with MILF chairman Alhaj Murad Ebrahim last Feb. 28. During their dialogue, Madani appealed to all parties to remain committed to the peace process even as he expressed disappointment over the Aquino administration’s failure to pass the bill. “A failure of peace process could adversely affect the good relation existing between the Philippines and the Muslim world,” Madani was quoted in the statement as saying. The proposed BBL, a product of the peace negotiations between

the government and MILF peace panels, would formalize the creation of a new political entity that will replace the existing Autonomous Region in Muslim Mindanao (ARMM). Despite Murad’s reiteration of the MILF’s vow to uphold the peace process, Madani said further delay in the BBL’s passage or the adoption of a “modified weak version” of the bill would have adverse effects on human, security and developmental aspect of the region. He also warned against the risk of worsening the situation that could allow the spread of violent extremism. As Madani stressed the urgency of passing the proposed BBL, he reiterated the OIC’s firm support for the peace process and the full implementation of Comprehensive Agreement on the Bangsamoro (CAB) and all related agreements, namely the 1976 Tripoli Agreement and the 1996 Jakarta Agreement.

Seven things you should not do when served with divorce papers by your spouse For most people, being served with divorce papers by your spouse is probably one of the biggest surprises in your life. The spouse in the receiving end of the divorce sometimes are not offered any explanation for the divorce petition by their spouse. You may start getting upset about how this can happen to you and start doing things that are going to be seriously detrimental to your divorce case later on in the proceeding. Here are seven things you should not do. Do not confront your spouse and commit domestic violence Many spouse feel very angry and upset upon receiving the divorce papers. You may start blaming your spouse and attacking your spouse. You may even yell, threaten, scream, or even physically assault your spouse. This type of confrontation is called “domestic violence.� You may be arrested criminally if your spouse calls law enforcement. Your spouse may also file a domestic violence restraining order against you. Either one would compromise your ability to seek custody of your children, child support, and spousal support. It would also affect your credibility as a witness for future proceedings. In addition if you do this in front of the children, this may be looked at as domestic violence and abuse against the children. The incident may be reported to Child Protective Services for investigation. Do not run to the bank and empty out all your bank accounts or sell assets except for funds necessary retain legal representation in the divorce. If you have assets, do not run and empty out your bank accounts with the goal of securing it from your spouse. The divorce petition and summons includes certain automatic temporary restraining orders (ATROS) which prohibits transferring and encumbering assets. You will be in violation of the ATROS if you do this. Your spouse may also make a claim for breach of fiduciary duty against you. However there are certain exceptions to withdrawing funds such as funds necessary for your living expenses and funds you need to retain an attorney. Do not cut off your spouse from any insurance policies One of the ATROS prohibits you from removing your spouse from health insurance coverage and other insurance policy. It would be a violation of ATROS to do so. You need to maintain your spouse on all existing insurance until the divorce is finalized or the status of marriage is dissolved in a bifurcated trial. Do not take off with your child and move out of state or out of the country If the child has been living in this state, California Court has jurisdiction over your child even if you leave

California after being served the divorce. Your spouse can get an order from the California court to return the child to California and get sole physical custody of your child. This can be enforced through law enforcement in other states. In addition, this would also be an ATROS violation. Such a move would seriously undermine your claim for custody of the children. Do not use your child as a messenger to communicate with your spouse Divorce process is a very difficult process for the children. Children often blame themselves for the divorce of their parents. Children sometimes manifest this through their academic performance during the divorce process. Do not involve the children in your divorce case. Using the children to communicate messages to your spouse puts them in a difficult and very stressful situation. This will also affect your claim for custody of your children if you regularly involve your children in your attempt to communicate with your spouse. In addition, you should not say disparaging remarks about the other parent to your children. Do not stalk your spouse in social medias such as facebook or tweeter. Your spouse probably stopped informing you as to what is going on in his/her life at this point. You may be curious if your spouse hooked up with a third party or an old flamer. You may be curious what your spouse are telling your friends and family. Do not stalk your spouse in social media such as facebook. Do not hack into your spouse’s e-mail. This is a crime. Your spouse can also file a domestic violence restraining order against you for stalking. Most of the evidence obtained illegally is not admissible in court anyways. If you have been unfriended by your spouse, let it be. Do not quit your job voluntarily If you think you can dodge child support and spousal support by quitting your job voluntarily, it is not going to happen. Your spouse’s lawyer will argue that there was no legitimate reason for you to leave your employment and may seek the court to impute income on you. Your spouse may seek vocational evaluation for purposes of determining your earning capacity. In addition, the amount of income you will lose by quitting is substantially more than the money you will owe in child or spousal support. Even if you are successful in dodging the support orders

Business owner files for Chapter 7 as losses mount Young client seeks Chapter 7 relief for $70k credit card debt

Clients are spouses who own and run a business together. They own an S-corporation that has been in business for 20 years. They have 10 employees. An S-corporation, as distinguished from a C-corporation, is one where the profits of the business “flows through� to the 1040 of the individuals, unlike a C-corporation that pays its own income tax based on corporate profits. For instance, if the S-corporation business makes a net profit of $100K for 2015, that net profit is added to the gross income of the stockholders of the S-corporation. If you own 20% of that S-corporation, you will have to add $20K to your gross income for 2015 in addition to your income from all other sources. Whereas if that were a C-corporation, the corporation would pay income tax by itself on the $100K profit for 2015, and either keep the net profit after tax in the coffers of the corporation as retained earnings, or distribute the net profit to the stockhold-

ers, in which case, the profit distribution becomes a dividend to the stockholder which the stockholders declares as dividend income in his individual tax return. Other than this differentiation in the treatment of corporate profit, both S and C-corporations have all the same benefits that a corporation provides. Both S and C corporations are legally separate entities from their stockholders. Liabilities of the S and C corporations and deemed liabilities of the corporations themselves and do not transfer to the individual stockholders. This is called the “corporate shield� given to stockholders. For all intents and purposes by law, the corporation is treated as a separate and distinct “legal person� from the individual stockholders. For example, Volkswagen was recently found cheating on emissions. The company programmed the computers in their diesel cars to act in a way that it appeared that emission standards were being complied with. In fact, they were not. In other words, Volkswagen, the corporation told a bold face lie. When it was found out, there was a big scandal and its stock tanked. Massive penalties for fraud soon followed levied by the Feds in the billions. There were multiple lawsuits filed against Volkswagen. Buyers wanted to return what they bought. If you were a stockholder of Volkswagen, can you be sued for this corporate fraud with millions of victims worldwide? If you were a stockholder of Volkswagen, do you have to worry about being sued by the victims because you own shares in Volkswagen, certainly not. Because the fact that Volkswagen is a corporation means that the company is legally a separate and distinct entity from you as a shareholder. Therefore, you cannot be sued as a stockholder of Volkswagen for the corporate wrongdoing of the company. This is called ‘corporate legal fiction’ which is actually quite a brilliant idea that allows

free enterprise to prosper. Without this ‘corporate shield and legal fiction’ people will be afraid to invest in businesses for fear of having their individual assets exposed to liability for anything that goes wrong with the corporation that causes damage to anyone. In clients’ case, their business was doing well for 17 years. But the last 3 years was bad. Clients had to refinance their house to put in another $80K in the corporation to finance the loss of the last 3 years. Refinancing their house was actually making a bad situation worse. Why suck out the equity in your house causing you to pay a higher mortgage to keep a business that is hemorrhaging to keep it afloat? You’re letting the business loss drag your house down too. The corporation is supposed to be separate from your personal assets, but by refinancing your house, you combine the two together. In other words, if the business is sinking, why let your house sink with it too? You business can sink and die, that happens many, many times in the world of business. But to link your house to the business, that’s the same as getting a gun and shooting yourself in the leg. Clients’ S-corporation owes $120K of bank loans and suppliers credit, which it can no longer pay. Clients decided to discontinue the business because of mounting losses. I ask them if they want to continue the business with a Chapter 11 and perhaps get away without paying any of the $120K. They decide for a Chapter 7 because too much competition has made the future of the business very bleak. Will the S-corporation Chapter 7 affect the stockholders as individuals, of course it will not. The stockholders keep their good credit and everything else. They are not affected by the bankruptcy of the S-corporation, because after all, even an S-corporation is a legally separate and distinct entity under the law, therefore, it can file a bankruptcy by itself without affecting the individual stockholders. Young Client Seeks Chapter 7 Relief for $70k Credit Cards Client is 33, and recently married. He also dabbled into business, using his credit cards to fund the business. The business

never turned a profit. He maxed out his credit cards at $70K. One credit card sued him to collect $14K of credit card debt. At that time, he was still optimistic that his business would turn around and become profitable. But that was not to be. He entered into a stipulated judgment agreeing to pay $200 a month until the $14K was fully paid off. He just got married and wants a fresh start without debt, and opts for Chapter 7 relief. This will wipe out the $70K of credit card debt including the $14K stipulated judgment. Without debilitating debt, client can look forward to a fresh, new and productive life, and can even start another business that has a better chance of being successful from all the mistakes he learned from his failed business. This is what happened to Mr. Walt Disney who also sought Chapter 7 relief twice before his Disneyland business became successful. From two bankruptcies, Disney is now a global multi-billion dollar business with the new $6.0 billion theme park opening in Shanghai this June. Who knows, my young client may be another Disney in the making, learning from his previous mistakes. Maybe 10 years from now, client may become a business tycoon. Further, client’s decision to seek chapter 7 relief is completely confidential. Nobody needs to know unless he discloses it himself. His new wife is totally not affected even if she has her own assets. Washington, United States | AFP | Wednesday 3/2/2016 – Donald Trump’s triumphal march toward the Republican presidential nomination left his party in disarray Wednesday, as Democrats coalesced around their White House frontrunner Hillary Clinton after her slew of Super Tuesday victories. Both candidates emerged the clear winners on Tuesday after several party nominating contests, piling up delegates on the biggest, most pivotal day of primaries in the race to succeed President Barack Obama. Trump was victorious in seven of 11 states, weakening but not eliminating his top rivals Ted Cruz and Marco Rubio, both US senators. Retired neurosurgeon Ben Carson meanwhile announced after his poor Super Tuesday showing that he did not “see a political path forward” in the race. Carson’s campaign soared last year but steadily lost steam amid questions over his personal narrative and lackluster debate performances. Should Carson officially drop out, that would leave Trump and a trio of pursuers: Cruz, Rubio and Ohio Governor John Kasich. Clinton equaled Trump’s score with wins in seven states against Senator Bernie Sanders, absorbing a formidable challenge from the left. But whereas Clinton appeared to solidify her support ahead of the next key round of primaries March 15, divisions among Republicans deepened over Trump’s success with a slashing campaign that has galvanized disaffected voters but opened wounds on racial, ethnic and gender fronts. With the 69-year-old billionaire powering past their favored candidates, Republican stalwarts have raised the possibility of the party splintering if Trump wins the nomination. ‘Desperate and angry’ “I think that’s a very real possibility,” Christine Todd Whitman, a former New Jersey governor, told National Public Radio. “There are a lot of people who just cannot see themselves supporting Trump. However, Niñez Cacho Olivares, the feisty executive editor of the Daily Tribune is claiming that her story was based on facts and not just a figment of someone’s imagination. If Senator Llamanzares has been accused of lying several times. Meanwhile, her runningmate claimed that he will welcome support from other political parties provided that these politicians were not involved in the P10 billion pork barrel scam. He must have been under the influence of alcohol when he made the statement. Someone should refresh his memory as to how much pork barrel funds he got from the six-year term of President Aquino, including the P50 million pork barrel fund he got for voting to convict former Chief Justice Renato Corona in the Senate. If he thinks that the endorsement of support he and Llamanzares got from the Nationalist People’s Coalition (NPC) will mean a lot come May 16, he must be dreaming. So many pedophile priests a ‘disastrous coincidence”: Pell Sydney, Australia | AFP | Thursday 3/3/2016 – Vatican finance chief Cardinal George Pell said Thursday it was a “disastrous coincidence” that five pedophile priests preyed on children in the Australian town where he was based, as survivors repeatedly accused him of lying. Pell gave evidence to the Royal Commission into Institutional Responses to Child Sexual Abuse via videolink from Rome for a fourth day and came under intense questioning from lawyers representing victims of abuse by the clergy. He has consistently denied any wrongdoing during his time in the town of Ballarat and the city of Melbourne in the state of Victoria, where he grew up and worked, in the 1970s and 80s, when pedophile priests abused dozens of victims. Pell, who revealed Pope Francis was being given a summary of each day’s evidence, has claimed at least two archbishops and other people in authority all deceived him by not revealing what was happening during a time of what he called “crimes and cover-ups”. Asked Thursday if he felt the attention on him amounted to a witchhunt, he replied: “I have never expressed such a view but I must confess the idea has occurred to me.” He called the congregation of at least five pedophile priests in Ballarat at the same time in the 1970s a “disastrous coincidence”, while admitting a boy complained to him

in 1974 about Christian Brother Edward Dowlan. Pell said the boy “mentioned it casually in conversation” that Dowlan was “misbehaving” with boys and he ran the rumours past a school chaplain but did nothing more. “With the experience of 40 years later, certainly I would agree that I should have done more,” he said when told Dowlan, who is in jail, went on to abuse dozens of children. ‘Lied to’ Another notorious priest based in Ballarat was Gerald Ridsdale, who Pell shared church accommodation with. Pell again denied trying to buy the silence of Ridsdale’s nephew David, who was abused by his uncle. “That certainly did not happen because I would certainly remember it,” said Pell, who accompanied Ridsdale to court as part of his “Christian duty”, when he was convicted of more than 100 charges of sexual abuse against children. Pell, who denies knowing about Ridsdale’s abuse, also again dismissed allegations “as demonstrably false” that he was once heard saying to a fellow priest: “Haha, I think Gerry’s been rooting boys again.” On Tuesday, the head of the Vatican Treasury told the commission the crimes of Ridsdale were “not of much interest” to him at the time, a statement he backpedalled from Thursday.

Filipino community in Metro DC remembers EDSA in Embassy ‘Talakayan’ WASHINGTON, D.C. – Members of the Filipino community in the Metro DC area swapped stories and insights into the 1986 EDSA People Power Revolution in a Talakayan held on 29 February 2016 at the Romulo Hall of the Philippine Embassy. The Talakayan was jointly organized by the Embassy and the Philippine Arts, Letters and Media Council (PALM) to commemorate the 30th Anniversary of People Power. “The first peaceful uprising in history, EDSA not only restored democracy and supremacy of civilian authority in the Philippines, but also laid out for the world to see the best of the Filipino – courageous, peace-loving, and compassionate,” said Philippine Ambassador to the Philippines Jose L. Cuisia, Jr. in his keynote address. Consistent with this year’s anniversary theme, “Pagbabago: Ipinaglaban N’yo, Itutuloy Ko,” Ambassador Cuisia made a call to action for the protection of People Power’s legacy. “To honor the memories of those who fought for the restoration of Philippine democracy, we are duty-bound to ensure that the lessons of the Revolution are well-learned and never forgotten,” the Ambassador stressed. He highlighted the need to engage the younger generations of Filipinos and Filipino-Americans in order to keep the spirit of EDSA alive. “It is therefore my fervent hope

that what we are doing today will make the Filipino and Filipino-American youths realize that EDSA is not just a traffic congested avenue in Metro Manila, but the birthplace of modern Filipino empowerment,” Ambassador Cuisia added. PALM President Mitzi Pickard echoed the Ambassador’s message as she shared her involvement as a young activist in those days. “For all of us, EDSA People Power 1986 was a pivotal part of Philippine history—a shining period for the Philippines that brought it into worldwide cynosure. EDSA was an exciting experience we were proud to participate in—whether we were in the Philippines or in Metro DC,” Ms. Pickard stated. “It is more important than ever to pass on these majestic, memorable moments in Philippine/Filipino American history to our younger generations. It is incumbent upon the ‘young once’ to pass on the legacy of this peaceful transition of democracy to our ‘young ones,’” she further said. Richard Villa Mercado, an alumnus of the University of the Philippines Diliman, offered an eyewitness account of the events on 22-26 February 1986 and described the sense of pride felt by the Filipino community when President Corazon Aquino embarked on her first official visit to the United States in September 1986. “The People Power Revolution is one of the pivotal moments of my life. Jon Melegrito, a Filipino community leader and National Coordinator of the Coalition Against the Marcos Dictatorship (CAMD) from 1978 to 1986, opined that the events in February 1986 were a culmination of years of dissidents’ and activists’ fighting a “lonely battle”. He recalled those who sacrificed their lives in the name of freedom and democracy. “Like Ninoy, they believed that the Filipino is worth dying for,” Mr. Melegrito underscored. Following the panel discussion

was a Q&A that also tackled the role of the US Government and the Filipino community in the United States in shaping the outcome of the EDSA Revolution. Steven Rood, currently the Philippine Country Representative for The Asia Foundation, likewise shared his experiences as a professor in UP Baguio during People Power. MUNTINLUPA – Former Philhealth director and senatorial aspirant Risa Hontiveros today pushed for the stricter implementation of RA 8344, also known as the Anti Hospital Deposit Bill, which prohibits hospitals from demanding a monetary deposit before confinement or medical treatment in emergency or serious cases. “Nakakabahala ang mga balita, kung totoo ito, ng mga namamatay dahil hindi binibigyan ng agarang kalinga ng mga pribadong ospital gayung mayroon namang batas na pinagbabawal ang pagtanggi ng mga pasyente dahil walang pambayad,� Hontiveros opined. “Kailangan ng mas strict na implementasyon sa RA 8344, kailangan may ngipin ang batas para higit na

maprotektahan ang karapatan ng mga kababayan nating maysakit.� Hontiveros was responding to a story being circulated in social media about a baby who died after allegedly being rejected by a resident doctor at the UST hospital. Republic Act 8344 also states that while a patient may be transferred to another hospital, it can only do so after administering the appropriate medical treatment and if such transfer does not entail more risk to the patient. Veterans cancel or decline coverage on Medicare (or other health care or insurance programs) solely because they are enrolled in VA health care. Unlike Medicare, which offers the same benefits for all enrollees, VA assigns enrollees to enrollment priority groups, based on a variety of eligibility factors, such as service-connection and income. There is no guarantee that in subsequent years, (US) Congress will appropriate sufficient funds for VA to provide care for all enrollment priority groups. This could leave veterans, especially those enrolled in one of the lower priority groups, with no access to VA health care coverage. For this reason, signing up for Medicare as a secondary source of coverage may be in the Veteran’s best interest. “In addition, a veteran may want to consider the flexibility afforded by enrolling in both VA and Medicare. For example, veterans enrolled in both programs would have access to non-VA physicians (under Medicare Part A and Part B) or obtain prescription drugs not in the VA formulary if prescribed by non-VA physicians and filled at their local retail pharmacies (under Medicare Part D).� On acquiring eligibility for Medicare, a veteran should consider

timely enrollment on Medicare Part B so as not to incur late enrollment penalty. Here is why: “Creditable coverage for Medicare Part B can only be provided through an employer. As a result, VA health care benefits to veterans are not considered creditable coverage for the Part B program. So, although a veteran may avoid the late enrollment penalty for Medicare Part D by citing VA health care enrollment, that enrollment would not help the veteran avoid the late enrollment penalty for Part B�. WASHINGTON – To enhance Veterans’ access to care and eliminate delays in Choice provider payment, the Department of Veterans Affairs (VA) is eliminating administrative burdens placed on VA community providers. Previously, payments to Choice providers were not allowed until a copy of the Veteran’s medical record was submitted. Now, community providers, under the Choice program, will no longer be required to submit medical records prior to payment being made. To facilitate the change, VA has modified the Choice Program contract, making it easier for Health Net and TriWest to promptly pay providers. VA continues to require pertinent medical information be returned to ensure continuity of care; however, it is no longer tied to payment. VA is taking these steps to more closely align with industry standards.

“This administrative step just makes sense,� said VA Under Secretary for Health Dr. David J. Shulkin. “It ensures Veteran access, timely payments and strengthens our partnerships with our Choice providers. We know that providing Veterans access to high-quality, timely healthcare would be impossible without collaboration with our community providers.� VA’s Plan to Consolidate Community Care Programs outlines additional solutions to improving timely provider payment. VA is moving forward on two paths to further improve timely payment. First, VA is working toward a single community care program that is easy to understand, simple to administer and meets the needs of Veterans, community providers and VA staff.
