CHINA DEPLOYS HEAVY WEAPONS IN SPRATLYS PHL to deal with China ‘diplomatically’ – Palace

MANILA, Jan. 17 (PNA) – Malacañang emphasized on Tuesday the need to formally deal with the existence of anti-aircraft and anti-missile weapons installed by China on its man-made islands in the South China Sea. “Aggressive and provocative diplomacy will bring us nowhere so we dealt with the issue formally,” Presidential Spokesperson Ernesto Abella said in a press statement. Abella said the Philippines through the Department of Foreign Affairs (DFA) has issued a note verbale to China to protest the weapon systems buildup in the disputed territory. “The Philippines will continue to assert its sovereignty over disputed territory in the South China Sea while remaining consistent with the efforts of President Dute-

rte to revitalize longstanding ties with China,” Abella said. “As always, we shall staunchly support all efforts to maintain peace and stability in the region,” he added. Attorney Paul Allen answers questions on creditor harassment and bankruptcy protection. Q: Creditors are harassing me but I lost my job, and cannot pay. How do I stop them calling? A: If you cannot pay your bills, creditors will take steps to collect. That’s natural, but continued harassment can be emotionally depressing. If you have lost your job, or simply cannot cope, because debts have grown to the point where you have to choose who gets paid this month, and who doesn’t, then you need to consider the benefits of filing a bankruptcy. Q: Will a bankruptcy stop collection agencies from calling me? A: Yes, filing a bankruptcy protects you from creditor harassment, and provides peace of mind. Creditors will not contact you if you filed bankruptcy and have an attorney representing you. Otherwise they risk being cited for contempt of federal court, something they will not risk. Another reason to consider a bankruptcy now, even if you do not have assets to protect, is that after a bankruptcy, you can immediately begin the process of repairing your credit. This usually takes between 6 to 12 months, so an early start will get you there faster. Q: I have just received a summons from a creditor. Is it too late to file a bankruptcy? A: No. When you file for bankruptcy, an automatic stay goes into effect immediately stopping any lawsuit filed against you and any action against your property by a creditor, collection agency or government entity. This can be very important, Especially if you are at risk of being evicted or foreclosed on, being found in contempt for failure to pay child support or losing such basic resources as utility services, welfare or unemployment Here is how the bankruptcy filing affects some common emergencies: Utility disconnections. If you’re behind on a utility bill and the company is threatening to disconnect your water, electric, gas or telephone service, the automatic stay will prevent the disconnection for at least 20 days. Bankruptcy will also discharge the past due debts for utility service. Although the amount of a utility bill itself rarely justifies a bankruptcy filing, preventing electrical service cutoff might be justification enough. Q: Will filing a bankruptcy stop the foreclosure on my home? A:If your home mortgage is being foreclosed on, the automatic stay temporarily stops the proceedings, but the creditor will often be able to proceed with the foreclosure sooner or later. If you are facing foreclosure and wish to save your home, Chapter 13 bankruptcy is the appropriate

remedy because it provides for a repayment plan on the arrears. Q: Can a bankruptcy stop an eviction? A: No, under the new rules, a bankruptcy will not stop a court ordered eviction, but it will prevent a landlord from seeking to evict you, at least for a while, perhaps just enough time to find somewhere else to live. However, don’t file for bankruptcy solely because you’re being evicted. You’ll probably be better off looking for a new place to live or fighting the eviction in Municipal court instead. Remember, the main idea behind bankruptcy is to discharge debt. Q: Will bankruptcy protect me; I’m behind in my child support payments? A: If you owe child support or alimony, bankruptcy will not interrupt your obligation to make current payments. And while the automatic stay will temporarily stop proceedings to collect back support you owe, usually the bankruptcy court will permit collection to go forward if the creditor requests it. In any event, these debts will survive bankruptcy intact and will have to be paid once the case is closed. Chapter 13, however, lets you pay the back support as part of the repayment plan. Q: A creditor is garnishing my wages. Will bankruptcy help me? A: Yes. Although no more than 25% of your wages may be taken to satisfy a court judgment (up to 65% for child support and alimony), many people file for bankruptcy to protect their income. For some people, any loss of income is devastating. Your employer may also get angry at the expense and hassle of facilitating a succession of garnishments and take it out on their employees. Although federal law prohibits you from being fired for one garnishment, an employer can fire you for multiple garnishments. Filing for bankruptcy stops garnishments dead in their tracks. MANILA, Jan. 18 (PNA) – A lawmaker at the House of Representatives has filed a bill that seeks to prohibit the imposition of additional taxes unless concerned government agencies meet a set absorptive capacity benchmark and tax collection target. Kabayan Partylist Rep. Harry Roque authored House Bill No. 4755, or known as “Ultimate Tax Reform Act�, which requires the Department of Finance (DOF), the Bureau of Internal Revenue (BIR) and the Bangko Sentral ng Pilipinas (BSP) to set a threshold absorptive capacity benchmark as well as a collection rate target for taxes. Absorptive capacity benchmark refers to the percentage of unused appropriations of the annual national budget divided by the total amount of appropriations available for any given year. “A look at the national budget would reveal that a significant portion of government appropriations is unused every year. This unused portion shows that the absorption capacity of the government is low, making the additional imposition of taxes redundant,� Roque said.

MANILA, Jan. 18 (PNA) – After being stalled for several years, the construction of a common station that will connect the Light Rail Transit (LRT) and the Metro Rail Transit (MRT) will start in December 2017. This after a memorandum of agreement (MOA) was signed Wednesday by the Deartment of Transportation, SM Prime Holdings Inc., Universal LRT Corporation (BVI) Limited of the San Miguel Corporation (SMC), Light Rail Manila Corporation (LRMC), North Triangle Depot Commercial Corporation (NTDCC), Department of Public Works and Highways (DPWH) and the Light Rail Transit Authority (LRTA). The MOA consists of the parameters for the common station which will be the basis of its detailed engineering design. The common station that will link LRT Line 1 and MRT Lines 3 and 7 seeks to provide seamless transfer of passengers and interconnectivity between the railway lines. It is expected to be completed by April 2019. “We hope that this initiative will be able to provide comfort and ease to passengers,� DOTr spokesperson Asec. Cherie Mercado said in an interview. The station will be located between the SM North and Trinoma in Quezon City, and will be broken down into 3 components: Area A wherein the platform for LRT-1 and MRT-3 are located; Area B which consists of two common walkways connecting Areas A and C; and Area C, where the platform for MRT-7 is located. The DOTr will finance the construction of the PHP 2.8 billion Area A while the operation, maintenance and development will be split between LMRC for LRT-1 and DOTr for MRT-3.

In a statement, the debt rater said its ratings on the country “reflect our assessment of the country’s lower middle-income economy and rising uncertainties surrounding the stability, predictability, and accountability of its new government.� �Offsetting these weaknesses is the Philippines’ strong external position, which features rising foreign exchange reserves and low and declining external debt,� it said. Palace welcomes EU plan to help PHL’s drug rehab eorts MANILA, Jan. 17 (PNA) – MalacaĂąang welcomed on Tuesday a plan of the European Union (EU) to offer support in the illegal drug campaign and drug rehabilitation efforts in the Philippines. “As the Duterte administration gains ground in the war on drugs, the Palace welcomes all plans and offers of help without conditions for the country’s drug rehabilitation program including those coming from the European Union,â€? Abella said in a press statement. EU Ambassador to the Philippines Franz Jessen reportedly said the EU is looking to divert funding from within the health sector to the drug problem. Jessen said the EU is now coordinating with the Department of Health (DOH) on how it can help the Duterte administration’s rehabilitation program for illegal drug dependents. Abella said the Palace expects better ties between the Philippines and EU, noting “that there are issues for stronger areas of cooperation such as trade, justice and security, and economic development.â€? Some countries, particularly

China and Japan, have already expressed support in the Philippines’ war on drugs particularly on its rehabilitation and treatment programs for drug dependents. In November last year, President Rodrigo Duterte led the inauguration of mega drug rehabilitation facility in Nueva Ecija. Donated by Chinese billionaire philanthropist Huang Rulun, the mega drug rehab center can house 10,000 in-patients once the construction of the 60,000-square meter facility is completed. Duterte administration’s war on drug has been considered a success after more than one million drug personalities surrendered to authorities in just the first six months of the campaign. According to the Philippine Drug Enforcement Agency (PDEA), drug problem has contaminated over 3 million Filipinos, prompting President Duterte to wage bloody war against drug menace. The campaign has already left 2,212 drug pushers and users dead in legitimate police operations and over 44,000 arrested drug dependents.

PNP-Crime Lab needs 2,000 more personnel MANILA, Jan. 18 (PNA) – The Philippine National Police Crime Laboratory (PNP-Crime Lab) is needing 2,000 more personnel. This was prompted by the numerous crime incidents the PNP-Crime Lab has to respond everyday in connection with the its “Oplan Double Barrel Alpha�. PNP-Crime Lab Director Chief Supt. Aurelio Trampe Jr. said each police district has only one SOCO (Scene of the Crime Operation) and because of the incidents that have to be responded to, the SOCO personnel are “over worked� in processing of the crime scene. Trampe added attending court hearings in cases filed by the PNP

He stressed if such a situation persisted, their personnel would be working too much and in doing so, it could not be avoided their work will be affected because of over fatigue. For her part, Supt. MANILA, Jan. 17 (PNA) – House Speaker Pantaleon Alvarez on Tuesday revealed there are two incumbent congressmen included in the “validated� narcotics list of President Rodrigo Duterte. In a press conference, Alvarez hinted that one implicated lawmaker has already been verified as a “protector� of illegal drugs. Alvarez also noted that one of the two solons is “definitely� from Mindanao. The House leader, however, did not divulge any other details of his colleagues with alleged links to illegal drugs. “The list that was sent to me is validated as it went through several agencies. On my part, I still double

check the information,â€? Alvarez said. Last December, President Duterte has given copies of his final list of drug personalities to Alvarez, Senate President Aquilino Pimentel III, Chief Justice Maria Lourdes Sereno, and Armed Forces of the Philippines chief General Eduardo AĂąo. Lacson wants PNP’s ‘Oplan Tokhang’ investigated MANILA, Jan. 17 (PNA) – Sen. Panfilo “Ping� Lacson on Tuesday sought for a probe on the “Oplan Tokhang� of the Philippine National Police (PNP) amid reports of kidnap for ransom cases under the guise of this project. PNP’s Oplan Tokhang involves police officers visiting houses of suspected drug users and traders to persuade them to stop their involvement in the illegal drugs trade. Under Senate Resolution 265, Lacson directed the Senate Committee on Public Order and Dangerous Drugs to look into the reported cases guised under Oplan Tokhang. Lacson, former PNP chief, made this call in light of an abduction of a 53-year-old Korean businessman, Jee Ick-Joo, who was seized by at least eight armed men in his home in Angeles City, Pampanga last Oct. 18, 2016. Duterte urged to certify bills extending passport validity as ‘priority’

MANILA, Jan. 17 (PNA) – To live up to his promise of extending the validity period of Philippine passports, Senate Minority Leader Ralph Recto on Tuesday urged Pres. Rodrigo Duterte to certify the bills lengthening validity from five to 10 years as “priority measures.” Recto made this call reminding Pres. Duterte of his first State of the Nation Address (SONA) last July 2016 where he promised that passports would have longer validity. Duterte, who has openly expressed his distaste for long lines, said that he wanted queues in all government offices shortened and

travel documents, licenses validity extended. The senator, however, pointed out that extending the validity of the passport would require a revision of Republic Act 8239, the Philippine Passport Act of 1996. Recto previously filed Senate Bill 795, extending the passport validity to 10 years, by amending Section 10 of RA 8239 days before Pres. Duterte issued his SONA call, In his bill’s explanatory note, Recto specifically cited the inconveniences experienced by OFWs in securing a passport. He said that most OFWs are al-

lowed to return to the Philippines from two weeks to a month for a vacation but the application, processing of passports “can take up that entire period.” “This might be too short a time for OFWs to secure new passports. Many spend their entire vacation in queues for multiple government-issued permits needed for their employment,” Recto said. The senator also pointed out that while the bill extends the passport validity to a decade, it will not cover minors in accordance with international norms that they be issued five-year passports.

Recto’s bill also grants the Foreign Affairs Secretary the right to limit the validity of a passport to less than 10 years if he deems that national security, public safety or public health or whenever the applicant’s supporting documents appear inadequate. Recto said representatives of the Department of Foreign Affairs (DFA) have said during budget hearings in the Senate that they do not object to the proposal. DFA is expected to collect PHP4.6 billion from passport processing. The agency receives about 15,000 applications a day.

MANILA, Jan. 18 (PNA) – More than 200 Chinese nationals who were earlier arrested for illegally working in an online gambling facility inside the Fontana Leisure Parks and Casino in Clark, Pampanga last year, have been deported, the Bureau of Immigration (BI) said on Wednesday. According to Atty. Antonette Mangrobang, BI Spokesperson a total of 259 out of the 1,316 Chinese nationals have been allowed to go back to China. “So far from December 20, 2016-January 17, 2017, a total of 259 Chinese nationals have been deported,” she said. The BI official noted that that those who will be allowed to leave the country depends on how soon they can provide their tickets and the go signal given by the National Bureau of Investigation (NBI). “The number of actual deportees depend on how soon can they provide their outbound tickets and clearance from NBI that they do not have pending criminal cases,” Mangrobang explained. She added that the more than 1,000 foreigners have deportation orders already. “The Bureau’s intention is to deport all of them as soon as possible. However, the numbers of those who will be actially deported depends on the Chinese nationals themselves and how soon they can provide us with outbound tickets back to China,” Mangrobang said. “Depende sa pagsubmit nila ng tickets and clearance sa NBI,” she added.

MANILA, Jan. 18 (PNA) – A recruiter consultant on Wednesday hailed the plan of Malaysian authorities to issue temporary passes for undocumented Filipino workers in Sabah. Emmanuel Geslani, recruitment and migration consultant said it is a positive move by the Malaysian government favoring more or less half a million undocumented Filipino migrants. “This will allow them to continue working for their Malaysian employers who are mostly in the palm oil business and also in various small industries in Sabah,” he told reporters in a teleconference. He said the number of illegal migrants could be more or less than half a million because palm plantation owners allow their workers to

go back to their provinces. ‘‘I don’t know if they have passports but they’re accepted in Sabah mainly of their religion since most of them are Muslims,” he pointed out. Geslani explained that since the palm oil is not so attractive to Malaysian citizens, plantation owners are forced to hire illegal Muslim Filipino migrants from Mindanao. Malaysians considered working in palm plantation as “dirty work” and landlords are forced to hire undocumented aliens. According to Geslani, it is good news for illegal aliens for they have steady income and can assure their family of better living. Although they have no benefits and security of tenure, still earning for a living for their loved ones is their priority.

MANILA, Jan. 17 (PNA) – The Bureau of Customs (BOC) on Tuesday ordered over 3,000 importers to update their contact information including phone numbers and e-mail addresses or face sanctions. According to Commissioner Nicanor Faeldon, stakeholders should amend their contact details to ensure effective communication between importers and the Bureau. “This is one of the ways to better serve the importers, so they should also do their duty by informing us of any changes in their phone numbers or email addresses,” he said in a statement. The list which includes over 3,000 importers that have outdated/incor-

rect phone numbers or email addresses in their system is published on its website, Bureau of Customs | Department of Finance: Bureau of Customs and Facebook account, @ bureauofcustomsph. The BOC reported that upon verification, phone calls made to 1,206 importers reveal incorrect or non-working numbers, while e-mails to 2,365 importers bounced back. Pursuant to Section 7 of Customs Memorandum Order (CMO) No. 112014, failure of the importers to update the bureau’s Account Management Office (AMO) of their updated email address and/or contact details within 30 days from the date of the list’s posting will cause suspension of their accreditation.

On the other hand, 10.82 percent cited search engines and 5.53 percent go to social media websites. Miss U bets help NGO pack 3,600 meals for pregnant, lactating women MANILA, Jan. 18 (PNA) – While some Miss Universe are enjoying the cool breeze and warmth of Cordillerans in Baguio City Wednesday, others are in Manila to support a non-government organization to help deliver around 3,600 meals to women in need. At least 56 candidates gathered at the Conrad Hotel in Pasay City to help non-government organization Rise Against Hunger (formerly Stop Hunger Now) and the Department of Health (DOH) pack meals for pregnant, lactating women and their babies. Rise Against Hunger Philippines Executive Director Jomar Fleras told reporters in an interview that the meals will benefit pregnant women who live in two pilot areas selected by the DOH namely Pampanga and Zambales.

These food pack meals will be provided to 50 nutritionally-at-risk women in Porac, Pampanga and another 50 nutritionally-at-risk women in Candelaria, Zambales. Fleras said that the Rise meals are rice-based meals using iron-fortified rice, texturized vegetable protein, dehydrated vegetables and flavoring mix with added 23 essential vitamins and minerals. Some meals packed by the candidates include chicken arroz caldo, beef congee, fish flakes, ginataan, and champorado. The candidates, who wore hairnets and gloves while packing meals, said that they were humbled by the opportunity to help nutritionally-at-risk women especially as most if not all of them were no stranger to volunteer work. In fact, the State wants to follow your wishes should something happen. However, the only way to properly follow your wishes is to do these documents and have them properly done so they are legal, enforceable and revocable. Question: What if I have more kids or later want to change who gets what, or to change the successor trustee? Answer: None of that is a problem. All of these documents are revocable at the time they are made. This means, you can properly change anything you want at anytime.

A brief and pleasant evening with Martin Andanar, PHL’s new Press Secretary On his way to represent the Philippines at President-elect Donald Trump’s inauguration, our country’s new Press Secretary, Martin Andanar, met with some of us briefly. We were all surprised to meet a tall, former award-winning broadcast executive, podcaster and blogger who used to head TV5’s News, as well as anchor of its video and radio portal, called “Aksyon sa Umaga, “ and “Punto Asintado,” (on Radyo 92.3 News FM, a sister station of TV5). Soft-spoken, but well-versed in President Duterte’s current administration, Mr. Andanar certainly impressed some of us, as one of Digong’s choice selection for this vital position. He graduated with a Bachelor of Arts in Social & Political Studies, along with Film and Media Studies from the University of Ballarat in Australia; he also has a Masters in Entrepreneurship from the Asian Institute of Management (AIM). Initially, Martin Andanar’s purpose in meeting with us was to update us on our country’s state of affairs as well as clear some “clarificatory statements,” published by worldwide media. He said that President Duterte really “works hard for the Filipino people, because at his age of 72, he wants immediate change,” and though “he’s hitting the ground sprinting and not running, while his job requires more time from him,” his election to the presidency came about because “majority of our kababayans have been disheartened economically, as compared to our ASEAN neighbors, and that majority of our kababayans felt that our country has been left behind for quite sometime now.” Andanar lauded the recent visit of Shinzo Abe, Prime Minister of Japan, who authorized a $10 billion (or 1 trillion yen) aid to the Philippines from Japan. The Prime Minister was welcomed by President Duterte in his

home in Davao, which to the Japanese people is a symbol of support because in Japan, visiting someone’s home is a “sacred” and “private” gesture of friendship. Further, Mr. Andanar updated us on some of the issues and/or new developments that are currently being handled by the D30 administration. One of the issues that came about was the question on judicial killings; how sure are they (the government) that some of these are not politically-motivated? Bayani and though there were some protests by the opposition, the people spoke and he was still elected. Regarding the rumor of imposing Martial Law, Andanar said that the Filipino psyche changes and that people should respect the country’s electoral process and that Duterte’s rumored imposition of Martial Law has a qualifier. Per Andanar, President Duterte said he will impose Martial Law IF drugs, terrorism and corruption will not be curtailed. On the economic front, Andanar said that when President Duterte took office on May 9, 2016, PHL’s economic growth rate was only between 6-6.5%, but surprisingly, PHL’s GDP went up to 7%, the highest it has been, and certainly attributed to President Duterte’s leadership, along with admiration of our Southeast Asian neighbors. Included in the country’s economic growth is the City of Davao’s GDP which grew exponentially to 9%, likewise attributed to Duterte, who was its Mayor for more than 20 years. Regarding the traffic situation in Metro Manila, Duterte’s administration just acquired the problem from the previous administration, but for the next 6 years, they already have plans in place to improve the Metro

Railway System, from Manila to Mindanao. As for the Philippines’ diplomatic relations with the United States, though President Duterte and former President Obama started on the “wrong foot,” Duterte is hopeful on building a good relationship with the newly-sworn US President Donald J. Trump. Per Andanar, our kababayans should give President Duterte a chance to prove himself as he works tirelessly for all of us. One perfect example was during the holidays when President Duterte visited a cancer patient on December 24th and that he (President Duterte) might not be able to “cure him,” but that he can offer him hope to look forward to the future. And on Christmas day, December 25th, he went to visit the bombing victims in Visayas. Finally, before our pleasant and cordial meeting ended, Press Secretary Martin Andanar handed all of us copies of PHL’s government-issued paper called “MASA,” a brochure on the ASEAN 2017 Summit, booklets of “Winning the War on Drugs & Poverty, Working for Peace,” and a Year-End Report on the Duterte Administration’s “Key Accomplishments.”

Senior wants Chapter 7 to discharge $30k credit cards

Client is 64, a young senior. I say young because I consider seniors in their sixties as still active and robust. Except for more white hair, they still feel like they are 30. The problem with being in the sixties is that seventy is just around the corner. Now when one becomes 70, after ten years you become 80. In your eighties, your hoping that Putin’s anti aging pill is already in commercial production. Putin is 64 right now, just like client. He has a pharmaceutical company in Russia that is doing in depth research on mitochondria cells that focus on delaying aging and extending human life to 130. So, maybe this is why PEOTUS Trump wants to be his best friend. I wouldn’t mind being his best friend either if the Russian company actually makes this pill available for humans in the next 10 or even 20 years, I might still be around to benefit from it. Client says that his net income is $3,500 and that he is separated from his wife. His rent is $600 for a room. He sends money to his brothers and sisters in his country of origin. The problem is that he owes $30K of credit card debt. He pays minimum of $1K a month for the credit cards. He also has a car payment of $350. We don’t have to do more calculation here. The minimum payment of $1K for credit cards is almost a third of his next income. That is just way too much. He wants to get rid of his credit cards now that he is 64 so he can start saving some money. Well, it’s a little late to start saying money now but at least with the discharge of all of his credit cards, he can save $12K in the next 12 months, and $24K next year, then $36K then $48K. So when he turns 69, just before he becomes 70, he can have $50K saved up which he can use any way he wants. This is a lot better than keeping these cards, paying them $50K for the next 4 years, then still owe them the same principal of $30K when he turns 70. So, this is really a no brainer, isn’t it? Would he rather have $50K in cash and not owe anything at the age of 69, or throw away $50K in minimum payments and still owe $30K credit cards at age 69? He asks if his brother whom he used as reference for a personal loan who did not sign a personal guaranty is legally liable for his debt if it is discharged in bankruptcy; of course not. Brother can only be made liable for his debt if brother signed a written personal guaranty. Without a signed personal guaranty, brother used a reference, cannot be sued because he has no legal liability to the creditor of client. Seniors need Chapter 7 to discharge $45k credit cards Next client are husband and wife who are 72 and 71. Wife made sure

that I understood that she was only 71 and one year younger than her husband who is 72. Yes, I got that. One year makes all the difference. I told her that I stopped counting 20 years ago and advised her to do the same. It’s useless to keep counting, what’s the big deal anyway? Who wants to know that you are now one year closer to leaving this earth; certainly not yourself. Look at the picture of the Indonesian guy who is the oldest man alive at 145. I mean what can you do at 145? You’re practically a cadaver and blind. Can’t hear anything. Quality of life is just zilch. Clients owe $46K of credit card. Their social security is $3K a month. Rent is at $1200. They have $1800 left but their credit cards need minimum of $1500. How are they going to eat and pay for other necessities if they continue to pay $1500 for credit cards? They can grow their own vegetables in their backyard, if they had a backyard. They rent an apartment with no backyard. Husband says that he has all kinds of muscle pain and has a pacemaker, so that kills his plan to drive for UBER so he can raise another $1500 to pay for their credit cards. He says they have already lived a full life, having travelled all over the world, using the cards. But they have paid the cards for the last 20 years a total of $360K yet they still owe the very same $46K of credit cards today. I told them that they should have done their Chapter 7 twenty years ago, so today they would have $360K in their portfolio earning them at least 5% or $1500 a month, or $18K a year. That certainly helps now, instead of paying them a small fortune and still owing them the same amount of $46K. Should have gotten rid of these cards a long time ago. They decide immediately to file for Chapter 7 to discharge the $46K of credit cards. Peace of mind without credit card payments is what they need now at 72 and 71. Business owners need Chapter 7 to discharge $200k loans and to stop wage garnishment by SBA Last client were business owners. They are also seniors at 60 and 61. The owned a business that closed down in 2007. When the business closed, the company, which is an S corporation, owed an SBA loan of $49K, which is now $89K because of the accrued in-

Duterte clears ‘wrong perceptions’ with tycoons

MANILA, Jan 18 (Mabuhay) – President Rodrigo Duterte hosted dinner for the country’s top businessmen to clear “wrong perceptions� and lay out his plans to grow the economy and defeat illegal drug rings, one of his aides said Wednesday. MANILA, Jan. 18 (PNA) – Some 10 million households will be placed under the government’s cash transfer program for a period of one year once lawmakers approve the Department of Finance’s (DOF) proposal to hike the excise tax on oil products. This was disclosed by Finance Undersecretary Karl Chua during the hearing of the House of Representatives’ ways and means committee Wednesday to assure lawmakers that the poor will not be negatively impacted by the proposed 10-percent increase in excise tax on oil. Chua said 40 percent of the targeted 10 million families that will be covered by the non-conditional cash transfer are those who are already part of the government’s Pantawid Pamilyang

Pilipino Program (4Ps). He said the proposed cash transfer program will be financed by the higher tax revenues from excise tax on oil. �This is to bridge the gap and not a permanent program‌ It’s not the solution by itself,� he said, citing that the real solution to alleviate the lives of the poor is to ensure the continued expansion of the domestic economy by building more infrastructure and to ensure inclusive growth. Chua said the higher excise tax on oil will increase inflation rate by about 1.5 percentage point but the over-all inflation environment will remain manageable since the average rate of price increases in the country remains below the government’s 2 percent to 4 percent target until 2019, with the 2016 figure at 1.8 percent.

Can a Divorcing Couple agree to pay for their adult children’s college expenses in their Divorce Judgment? Divorcing couples with children sometimes worry about who is going to pay for their children’s college education after the divorce once their children graduates high school. They want a guarantee that their soon to be ex-spouse will share in the college expenses of their children. This is specially the case when the other spouse has moved on with a new family. The old family becomes less of a priority. In California, there is no legal basis for a spouse to request the family court to order the other spouse to pay for their adult children’s college expenses. However, the divorcing couple can agree to pay for their adult children’s college education as part of a marital settlement agreement. Family Code section 3587; In re Marriage of Rosenfeld and Gross, 225 Cal. App. 4th 478 (2014). Pursuant to statute and court cases, college expense payment provision in a stipulated marital settlement agreement, as incorporated into a Court’s judgment, constitutes adult child support such that court had jurisdiction to modify the provision in light of the settlement’s failure to specifically provide that adult child support was not subject to modification. In re Marriage of Rosenfeld and Gross, 225 Cal. App. 4th at 488 (2014). Providing for payment of adult children’s college expenses is recognized more of an “add on� to adult child support. Family Code 4062(b)(1). However, the parties may “opt out� or restrict the court’s jurisdiction to modify an adult child support order (including college expenses) but the parties must expressly and specifical-

ly state in their marital settlement agreement that any resulting adult child support order will not be subject to modification or termination by the Court because the adult child support order is rooted in the parent’s contractual agreement. Cal. Family Code Section 3587, 3651(a). So if you are concerned about your spouse sharing for the college tuition and expenses of your children after the divorce, you should negotiate a provision in your marital agreement that both of you will share on the college tuition and expenses of your children. In doing so, you should also think about whether you want this provision to be non-modifiable or not. In the absence of a specific provision limiting adult child support as non-modifiable and non-terminable, the default is that child support is modifiable. Sometimes, leaving the adult child support provision as modifiable protects the spouses from unforeseen future events such as a disability or retirement which limits the earning capacity of a spouse and ability to comply with the adult child support provision in the MSA. DOLE expands ban on employment of minors MANILA, Jan. 18 (PNA) – The Department of Labor and Employment (DOLE) on Wednesday expanded the coverage of the ban on the employment of minors in agriculture and livestock farming in a bid to prevent young people from exposure to hazardous work conditions. Based on Department Order No. 149-A issued by Labor Secretary Silvestre Bello III, it classified other work and related farming activities such as plant propagation activities that involve grafting, budding and marcotting, and tending activities that involve weeding of soil, as hazardous and among the worst forms of child labor. Also classified dangerous are handling, spraying and application of harmful fertilizers, pesticides, herbicides and other toxic chemicals; and loading and carrying of heavy loads. The order also strengthens the existing ban on the employment of minors in farm activities such as clearing of land, plowing, harrowing, irrigating, constructing paddy dike and cutting. “Child workers are compelled to help augment their families’ meager income by engaging in hazardous work. That is why the labor department will strictly monitor and assess occupational safety and health standards (OSHS) related to child labor,� Bello said in a statement. In making sure that OSHS is strictly followed, the DOLE chief noted that it would ensure that workers’ employment does not endanger their life, safety, health and morals, nor impair their normal development. The DOLE order also prevented minors to work in harvesting activi-

ties that involve cutting and picking, spreading for drying, hauling, topping, tumbling, tuxying, stripping, burning of field, sticking and classifying, threshing, loading and carting of produce. In post-harvest, young workers may not be employed in de-husking, scooping, sacking of products, charcoal making, hauling of products as led by animal guide, loading and unloading of packed farm products, coconut kilning and de-meating from shell or core, sealing and carting of produce for warehousing and transport to market and all ancillary work such as clearing, cleaning, and recycling of farm waste in its preparation as animal food and other related processes. In livestock farming, the work and related activities that are declared hazardous to minors include: rearing such as collecting, loading, unloading and transporting of feeds, maintenance and care of large and/ or dangerous animals, collecting and disposal of dead animals, animal manure and other waste materials, administering of vaccines and vitamins, and handling of disinfectants used for cleaning animal pens/enclosures or for disinfecting animals. Likewise, minors are not allowed to engage in harvesting activities that involve catching or collecting, ranching, and milking in preparation for warehousing or transport to market, and post-harvest activities including the packaging and processing of dairy and other animal by-products in preparation for warehousing and transport to market; and working in slaughterhouses or abattoirs.

MANILA, Jan. 17 (PNA) – The Philippine Consulate General in Vancouver assured the family of 13 Filipino crew members of detained container ship, ‘Hanjin Vienna’, that they are in good health. The Department of Foreign Affairs on Tuesday said the 280-meter container ship, owned and managed by Hamburg-based Reederei NSB and chartered by Hanjin shipping company, has been in detention since September 1, 2016, after the company suffered from financial crisis. Consul Rogelio Villanueva Jr. said on January 15, he met the 13 Filipino crew while the ship was anchored at Vancouver’s Inner Harbour Anchorage. Villanueva met with Captain Hans-Ruediger Kroeger who briefed him on the current status of the ship. He was able to talk with the Filipino crew who are all in good condition and who have enough supplies and food onboard. Most of the crew are nearing the end of their contracts and are eager to return to their families in the Philippines after spending their Christmas and New Year on board the ship. The Filipino crew thanked the Consulate General for continuously monitoring their situation and for looking after their welfare.

MANILA, Jan. 18 (PNA) – Senate President Aquilino “Koko” Pimentel III on Wednesday assured that the Senate super majority is still intact despite some differences on political issues. “The point is one member of the majority is not the majority,” Pimentel told reporters in an interview after a colleague expressed concern that senators in the majority bloc who were members of the Liberal Party (LP) would usually vote against the majority. Sen. Joseph Victor “JV” Ejercito on Tuesday asked LP senators to make a decision whether to stay in the Senate super majority bloc or transfer to

the minority. Ejercito said it was not fair for LP senators to enjoy the “benefits of being in the majority but on the same time we are also attacking and hitting and going against the majority.” Pimentel, however, said that after having a word with Ejercito, the latter admitted that he made a slight mistake in his recent comment. The Senate President said that what mattered was that senators belonging to the majority bloc were not divided in “substance” and instead had “a common legislative agenda”. “Pero huwag kami dapat maghati-hati sa substance ng aming common legislative agenda of the majority. Kapag doon kami nagkahati-hati,

it is time to rethink why we are together. (But we in the majority should not be divided in substance of our common legislative agenda. MANILA, Jan. 16 (PNA) – House Speaker Pantaleon Alvarez on Monday allayed apprehension that President Rodrigo Duterte would declare martial law in connection with his continuing war against illegal drugs in the country. At the same time, the House leader emphasized that the war on drugs, criminality and corruption is really intended to lay the ground for the restoration of law and order so that the Duterte administration can focus on growing the economy, reducing poverty and improving the living standards of Filipinos. Earlier, opposition lawmakers pounced on Pres. Duterte’s pronouncements that if it becomes necessary to preserve the nation he would not hesitate to do it. “I said it before and I’ll say it again: I know him personally and I sincerely believe he will not declare martial law,” Alvarez said. The Speaker said he believes the recent pronouncement of Duterte on the possible declaration of martial law is consistent with the Chief Executive’s style of issuing dramatic statements to stress his message. “That statement merely shows President Duterte’s resolve to end the scourge of illegal drugs in the country,” Alvarez said. Alvarez said that even if his critics take the President seriously, it is far-fetched for him to declare martial law because the administration is clearly gaining headway in its war against illegal drugs in the country. He noted that the administration has now begun to address corruption in the bureaucracy and illegal gambling. Alvarez said that besides being a lawyer, President Duterte is well aware of the legal requirements as well as limitations regarding the declaration of martial law. “That is why I believe all the apprehension about the prospect of declaration of martial law is largely unfounded,” Alvarez stressed. The House leader said that once the drug menace has been substantially reduced, then the government can focus its efforts and resources on infrastructure development and faster delivery of vital social services such as education and health to the most vulnerable sectors in society. Alvarez cited the reported nearly PHP1 trillion in official development assistance from China and Japan in the first seven months of the Duterte administration as a positive development that would certainly accelerate economic growth and poverty reduction. “If President Duterte has been able to gain the trust and confidence of the leaders of China and Japan as shown by their unqualified support for our economic development through ODA, then I am very optimistic that we can harness the support of other members of the international community for our development programs in the years ahead,” Alvarez said. “The President’s consistently high approval and trust ratings among Filipinos across geographical areas and social classes since he took office in July last year tell us one thing: he has been doing the right things and we should unite and fully support his efforts to achieve ‘tunay na pagbabago’ or real change that he promised during the campaign,” he added.

However, video footage and recordings of Duterte’s speech in Davao recently before members of the Davao Chamber of Commerce and Industries is contrary to what Andanar is claiming. In the video, Duterte said if he were to declare martial law, nobody could stop him, not even the Supreme Court. This prompted the National Union of Journalists of the Philippines (NUJP) to write an open letter to Andanar, castigating him for being “dishonest” and for blaming the media for accurately reporting exactly what Duterte said in his speech. The NUJP also said that while they expressed sympathy to Andanar’s job of having to spin Duterte’s words every time he says something improper or not suitable for publication, the media should not be blamed for being truthful and honest in its news reporting. Andanar should make himself more accessible and transparent to the media. If reporters will not get their “facts” from responsible government officials, they will usually get it from someone else, which is less accurate most of the time. I, however, understand where Andanar is coming from. He is the Communications Secretary of Duterte. His job is to protect the image of Duterte and deflect all criticisms thrown against the President. This is a tough and stressful job for anyone to do. The media plays a major role in nation building by serving as a means to distribute and convey information to the public on issues concerning news about local, national and foreign events. The relationship between government officials and the media has always been characterized as a “love and hate” relationship. The government wants to control the release

of information and wants to present only positive news to inquisitive reporters . The media, on the other, always likes to look for something that is the opposite of what government information officers are feeding them. It is only right for reporters not to swallow “hook, line and sinker” of what government agencies are feeding them. The role of media is never allow itself to be used by the government or by a political party as a propaganda machine to prop up its image. Reporters should always write their stories based on facts rather than feelings or opinions in order not to undermine their credibility. I hope Philippine media will always strive and perform a noble mission of enlightening the people and discourage divisive trends and will refrain from using its power to resort to sensationalism and distortion of truth just to attract attention and prop up its publication or television station ratings. *** PNP Chief Rolando De la Rosa should look seriously into allegations that a large number of “rogue” cops are involved not only in the illegal drugs trade but in kidnap for extortion racket as well. This has put once again the PNP, dubbed as one of the most corrupt government institutions, in a bad light. It was very alarming also to find out that policemen, who are supposed to protect citizens from criminals, are the ones doing the crime themselves. This nefarious activities of certain policemen involved in kidnap for ransom syndicates was uncovered after the wife of a South Korean businessman came out in the open and complained to the police that she paid several policemen more than P5 million for the safe return of her husband. Although the South Korean businessman was killed on the same day he was abducted in Angeles city, the wife was made to believed that her husband was still alive. It is very shocking to know the involvement of some policemen in the kidnap murder of the Korean businessman. At least it is good that one of the suspects is already in police custody. He was identified as Ricky Sta. Isabel. All policemen involved in the kidnap murder case, including Sta. Isabel, are from the Anti Illegal Drugs Group based at PNP headquarters. General De La Rosa should try to solve this case and punish the perpetrators as soon as possible in order to dispel public perception that the government are condoning illegal acts committed by cops on the pretext that they are just doing their duties. This has to be done soonest in order not to erode whatever confidence the people has with the police after Duterte took office seven months ago.

Donna Villa, producer and wife of Carlo J. Caparas, dies Donna Villa, who, together with husband, filmmaker Carlo J. Caparas, brought to the silver screen trueto-life massacre movies, has passed away on Tuesday. She was 57. Villa died at the University of Santo Tomas Hospital in Manila, according to reports. Health dept to pilot diet supplementation among poor pregnant women under ‘First 1,000 Days’ advocacy MANILA, Jan. 18 (PNA) – The Department of Health (DOH) starting next month will pilot a project that will provide dietary supplements to the poorest pregnant women in two selected areas in the country, as part of its “First 1,000 Days” advocacy. The department, in partnership with Rise Against Hunger (formerly Stop Hunger Now), will provide the diet supplements, which will come in the form of rice-based meals, to 50 “nutritionally at-risk” pregnant women each in Porac, Pampanga and Candelaria, Zambales to look after their babies’ health from the start of the women’s pregnancy, during lactation and up to two years after childbirth. “The primary objective of the meal provision is to improve the nutritional status of selected nutritionally at-risk pregnant women in selected areas to prevent low birth weight and other birth defects, which are predictors of stunting among children,” Health Secretary Dr. Paulyn Ubial said during a press conference held Wednesday at the DOH Convention Hall in Tayuman, Sta. Cruz, Manila, following the signing of a memorandum of agreement by the department and Rise Against Hunger, led by executive director Jomar Fleras. Ubial said the distribution of the meals will be an opportune time to educate the pregnant women on the importance of proper nutrition during pregnancy, lactation, breastfeeding, complementary feeding, child health care, nutrition and monitoring so children would attain optimum growth and development. Fleras said the meals will consist of iron-fortified rice, texturized vegetable protein, dehydrated vegetables and flavoring mix with added 23 essential vitamins and minerals. “It is cooked like ‘lugaw’ or porridge,” he said, noting that there will be five flavors to choose from -- chicken arroz caldo, beef congee, chicken, guinatan and champorado. To prevent the women from selling the meals, the beneficiaries will be required to surrender the empty packs. The meals will be donated by Rise Against Hunger, which has donors from banks, BPOs and other members of the private sector. Terry Allan Farris, managing director of Pass It Forward, an NGO tied with the Miss Universe beauty pageant, said 50 candidates will join the advocacy during the packing of the meals that will be distributed to the pilot areas. The “First 1,000 Days” is globally recognized as the “golden window of opportunity” to improve nutrition and ensure that women and their babies are healthy in the latter’s first 1,000 days.

Taguiwalo said the Department of Social Welfare and Development (DSWD) will support President Rodrigo Duterte’s executive order on attaining and sustaining “zero unmet need for family planning” to enable poor couples to make informed choices on financial and family planning. Noting the serious need to prioritize advocacy and information campaigns on women’s reproductive and maternal health, the social welfare chief said, “We want couples and families to engage in family planning because it will help ensure the health of mothers, unborn babies, and young children.” She explained that family planning, its different methods, and the reasons for spacing births and limit-

ing the number of children should be explained to women in urban and rural poor communities, not because of the “scornful and unjust belief” that the poor are irresponsible when it comes to having and raising children but because “we want a stronger, healthier population whose members can work for themselves, ensure their own well-being, defend and articulate their own rights under the law” so they can contribute to the development of the Philippine society. Taguiwalo said reproductive health and maternal and children’s health programs are already being taught during the family development sessions of the Pantawid Pamilyang Pilipino Program (4Ps), while reproductive health concerns are discussed by social workers with the urban poor. Duterte promises to rid Philhealth of corruption CABANATUAN CITY, Nueva Ecija, Jan. 19 (PNA) – President Rodrigo Duterte vowed to reform the Philippine Health Insurance Corp. (PhilHealth) to provide better healthcare for Filipinos. In a speech during the 20th anniversary celebration of Premiere Medical Center (PMC) here on Wednesday, January 18, the President said PhilHealth is plagued by problems particularly corruption that needs to be fixed with urgency. “Pero napag-usapan na lang naman ho natin itong profession ninyo, malaki ho ’yung problema ko sa gobyerno and this is not the first time that I have heard again complaints sa PhilHealth,” the President said before a crowd of doctors and health officials. He said he plans to summon medical associations, PhilHealth and Department of Health (DOH) officials to a meeting in Malacañan to craft policies aimed at reforming the health insurance agency. “There has to be a corrective measure put in place now,” he said. Corruption must be eliminated, he said, asking the public to support

government’s anti-corruption drive. The people must also be assertive to fight abuses and misdeeds, he added. Skeptics of the economy moving forward We have been hearing optimism from the new government towards job creation, global economy, GDP growth etc. Lets see what the Doom and Gloomers are saying about our down spiraling economy, even a great recession coming soon. Base on one analyst, Marc Faber “ US stocks, compared to emerging markets or European companies or Japanese stocks, are significantly ahead of themselves. In 2017, emerging markets will outperform the US or by going up substantially more than the US. So I would essentially avoid the US and rather invest in emerging economies....” The second view he claims is that recently investors have been obsessed with growth in the United States and with interest rates going up because the Fed has said that they would essentially increase the Fed fund rates three times this year but in the US, the treasury bond market is grossly oversold and for the next three months, we can have a rebound in US treasuries. Short-term and long term interest rates in the US are going to ease again in the next three months. You could get the 5% to 10% upside move in US treasuries. The third view is the whole world seems to think that the only way the US dollar can go is upward. I doubt this is to be the case. First of all, if you have a strong dollar, the trade deficit in the US and the current account deficit are likely to weaken as well as the economy. So, within the next three to six months or even already now, the US dollar has become rather vulnerable against foreign currencies. I would rather be short on the US dollar in 2017 than go long. His recommendation would be to accumulate precious metals stocks and the physical in 2017. Mortgage Rate Outlook When the market embarked on bull market in 1991, interest rates say on treasuries were still around 8-9% and we had a big correction in 1987 whereby the valuations of stocks in 1990 were not particularly high. Valuations of US stocks today are very high. Also in the 1980’s, do not forget the US market had significantly under-performed emerging economies in particularly Japan. The Japanese markets was the story of the 1980’s. By early 1990’s, the market in the US was relatively inexpensive compared to stock markets overseas but this is not the case at the present time. If you look at that figures or charts that go back 30 years. the US market has never been this expensive compared to other markets in the world then it is now and I believe whether you are contrarian or not, eventually there is a reversion to the mean. I believe the stock market in the US will either go down more than emerging markets because we are in a global bear market or emerging economies stock markets will go up more than the US if the super bulls are right. But we have very strong headwinds. One of the headwinds is obviously if the economy strengthens a lot, I think that consumer price inflationary pressures will come up and that interest rates will go up. Once the 10 years yield goes to around 3%, the stock market will notice and those stocks will face this headwind of rising interest rates. Secondly, do not forget if the US dollar is strong, it means that foreign

earnings of American companies are translated into dollars in the US and so the earnings of multinationals will suffer. Also, if the US dollar is very strong , it is a symptom that global liquidity is tightening and when the dollar is very strong, usually stocks do not perform particularly well. What a difference a few months can make. Early in the fall the Federal government made sweeping changes to mortgage qualification rules, the most prominent being the requirement The average rate for a 30-year fixed-rate mortgage fell to 4.20% from 4.32% from last week, according to Freddie Mac. The treasury money might not hit the economy in 2017.” The higher rates have had an effect on the mortgage market recently, particularly refinancing activity. The number of mortgage applications dropped 12% from two weeks ago, according to the Mortgage Bankers Association, while its Refinance Index tumbled 22%. But the bond market can be volatile. We are going to have to wait and see if this is an ongoing trend. Despite the recent rise, rates are still very low by historic standards. MANILA, Jan. 18 (PNA) – The bill seeking to grant special powers to the Duterte administration in addressing the country’s worsening traffic problem has hurdled the committee level at the House of Representatives. The House committee on transportation approved on Wednesday House Bill (HB) No. 4334 entitled, “Traffic Crisis Act of 2016”, which was authored by committee chair Cesar Sarmiento, House Speaker Pantaleon Alvarez and Majority Leader Rodolfo Fariñas. “This traffic crisis act is not forever. We’re just addressing the traffic crisis for a limited period of time,” Sarmiento said during the committee’s 12th hearing on emergency powers. “If you look at the whole traffic crisis act, this is not emergency power. This is a law that contains strategy and reforms that we identified in the course of the 16th Congress and even now in the hearings of (the) traffic crisis act,” he added. Sarmiento noted

that many ideas from the House bill had been adopted in the Senate version, thus making the harmonization of the two versions easier. HB 4334 identifies and limits the scope of the bill to the land traffic crisis in Metro Manila, Metro Cebu and Davao City. Under the bill, the Secretary of the Department of Transportation is designated as the ex officio Traffic Chief and shall have the power of supervision and control over the following: Metro Manila Development Authority (MMDA), Cebu Coordinating Council, Philippine National Police-Highway Patrol Group (PNP-HPG), Land Transportation Office (LTO); Land Transportation and Franchising Regulatory Board (LTFRB), Road Board, and the Metropolitan Davao Traffic Administrator. The Traffic Chief will be allowed to also implement similar mechanisms and systems provided in the bill to other cities and municipalities around the country which may suffer from a traffic crisis.
