MANILA, Aug. 8 (PNA) – Excited for his first privilege speech as neophyte senator, Manny Pacquiao made his presence felt in front of the heavyweights of the Philippine Senate to push his Senate Bill No. 185 which seeks the re-imposition of death penalty for heinous crimes and drug traffickers. ”My first ever privilege speech as a Senator will focus on one of the biggest issues plaguing our country. I speak before you because of the sense of urgency on the issue of drug problem which has become alarming as it gets worse each day,” Pacquiao said in his six-page speech. Armed with verses from the Bible, the born again Christian senator claimed God allows capital punishment against criminals. Pacquiao quoted Genesis 9:6 which says “Whoever sheds human blood, by humans shall their blood be shed; for in the image of God, has God made mankind.”

He also quoted another verse from the Bible’s Old Testament in Exodus 21:12 which states: “He who strikes a man so that he dies shall surely be put to death.” The former eight-time world boxing defending champion gladly yielded to the request of fellow senators to be questioned about his proposal to revive death penalty. Senators ready to tackle emergency powers for PRRD to solve traffic woes By Jelly F. Musico

MANILA, Aug. 8 (PNA) – Senators expressed on Monday their readiness and openness to grant emergency powers to President Rodrigo Duterte to resolve the worsening traffic problem, particularly in Metro Manila. Senator Grace Poe, chairperson of the Senate committee on public services, said the officials of the Department of Transportation (DOTr) and its attached agencies and the Metro Manila Development Authority (MMDA) would be given enough time to inform her panel about the traffic situation in the public hearings starting on Wednesday. ”It will be followed by an extensive discussion of the government’s plan to address the traffic problem, including appropriate modes of procurement and the safeguards that need to be instituted to promote transparency and eliminate opportunities for corruption,” Poe said. Poe added that she fully supported the government’s plan to immediately address the traffic situation plaguing the metropolis, but pointed out that a well-defined scope of the President’s emergency powers must be put in place to ensure transparency, accountability and effec-

Senator Leila M. de Lima expressed openness to grant President Duterte with emergency powers to address traffic woes. “I’m open to grant emergency powers to the President, subject to scrutiny of the details of their plans. If I see there is nothing constitutionally or legally objectionable with the proposed measure, then I will be glad to support it,” she said. “Like many of you, I too share the public’s frustration over the present traffic problem. But I also hope the Executive (Branch) lists down the existing limitations of the present laws so that amendments can be properly introduced and empower them to solve the traffic crisis,” she added. Recently, Senate President Pro Tempore Franklin Drilon and Senator Joseph Victor Ejercito filed separate bills entitled “Traffic Crisis Act” which seeks to grant emergency powers to President Duterte for two years and create a “superbody” to address the road and air traffic congestion. The measure also seeks to do away with the mandatory

bidding on procurement of transportation equipment and take over errant transport franchises to resolve the traffic woes on roads and airports in Metro Manila and Cebu. De Lima said she would want to scrutinize the proposed measure for emergency powers to ensure that there would be enough safeguards or oversight measures against possible abuses. Since the emergency powers would require certain authority to make necessary procurements, she maintained that the bidding process for all government projects is a non-negotiable aspect before Congress could grant emergency powers. “Now, for as long as they will not do away completely with the bidding process, I am willing to support. Kasi may iba’t-ibang paraan ng pag-procure. Huwag lang iyung wala talagang bidding,” she stressed.

MANILA, Aug. 8 (PNA) – The Department of Tourism (DOT) assured on Monday the Philippine hosting of Miss Universe in January 2017 will not add to Metro Manila’s traffic woes as most pageant events will be held in other parts of the country. Tourism Secretary Wanda Corazon Teo made this guarantee following public worries that the hosting of the prestigious pageant would trigger heavy traffic as it did during the Asia-Pacific Economic Cooperation (APEC) meetings last year. “The maddening traffic mess is obviously the one single problem that beset our daily economic activities in Metro Manila, and we will find ways so as not to aggravate this with the hosting of Miss Universe,” Teo said. Pageant events will be held outside Metro Manila at tourist destinations like Palawan, Cebu, Batangas and Isabela to avoid creating inconvenience to the general public, Teo said.

The cities of Davao, Vigan, and Cagayan de Oro, where reigning Miss Universe Pia Wurtzbach hails from, are also slated as possible venues of the pageant’s pre-coronation segments. Teo also suggested that the multi-agency Philippine Host Committee (PHC) could help come up with a solution to the traffic gridlock. The DOT-led panel endorsed to Pres. Rodrigo Duterte a draft administrative order that will formally constitute the Miss Universe PHC with at least 12 agencies to map out the master plan for holding the event. The hosting panel tackled other issues raised during the recent PHC meeting including facilitating the arrival and admission of Miss Universe participants from over 90 countries and organizers, security at the various pageant venues, and coordination with partners in the private sector. To recall, Pres. Duterte gave the DOT the go signal to host the Miss Universe

pageant in the country as long as no public funds will be used in hosting the pageant. Teo earlier assured that private sponsors will shoulder the production costs of the pageant which will hold its coronation on Jan. 30, 2017 at the Mall of Asia Arena. PHC members include the Office of the Executive Secretary; the departments of Public Works and Highways; Foreign Affairs; Trade and Industry; Information and Communications Technology; Interior and Local Government; Transportation; Health; Bureau of Immigration of the Department of Justice; Bureau of Customs and Bureau of Internal Revenue of the Department of Finance; Philippine National Police; and the Manila International Airport Authority. Members meanwhile expressed their full support for the DOT initiative of hosting the event which is meant to boost the country’s tourism numbers.

Tourism sector to double promotion efforts amid Iloilo’s tag as drug haven ILOILO CITY, Aug. 8 (PNA) – Iloilo’s latest tag as “most shabulized” area will not discourage the tourism sector from pushing Western Visayas as a destination. “This office considers this newly acquired attribute given by no less than the President of the Republic of the Philippines as a challenge to propel the region, especially Iloilo City, to greater tourism heights,” said Atty. LEGAZPI CITY, August 8 (PNA) – Albayanos are ecstatically happy and thankful to President Rodrigo Duterte over the recent approval by the National Economic Development Authority (NEDA) of three major infrastructure projects, which they see as decisive growth propellers for their province and the entire Bicol region. Delayed for a number of years, the three major transport infrastructure projects worth about Php 185.64 billion, were approved by the NEDA Board, chaired by President Duterte, on recommendation by the NEDA Investment Coordinating Committee (ICC). Albayanos and other Bicolanos now look forward to what they expect to be an unprecedented economic boom for their area. PDP-Laban Rep. Joey Sarte Salceda (Albay, 2nd District), as former Albay governor and chairman of both the Bicol Regional Development Council (BRDC) and the Luzon Area Development Committee (RDCOM) for nine and six years, respectively, have initiated and labored doubly hard to push them during the previous administration. He identified the projects as the Php 170.7 billionNorth-South Railways Project (NSRP) South Line, the Php 4.79-billion long delayed Bicol International Airport (BIA) in Daraga, Albay with an increase in its Passenger Terminal Building (PTB)

The three projects are among the first batch of NEDA approvals worth Php 300 billion under the new Duterte administration, 60 percent of which will benefit Bicol, especially Albay. They were recommended by the NEDA ICC to the board for final approval and release of funds. The NSRP Southline and the BIA are projects Albayanos take pride in. Minutes after Salceda posted the news of the approval in his social media account, it gained more than a thousand likes and was flooded by comments from Albayanos thanking the Duterte administration for releasing their long awaited projects, with record speed. Himself elated over the positive development on the stalled projects, Salceda said he was informed of their approval by Socioeconomic Planning Secretary and NEDA Director-General Ernesto M. Pernia and Department of Budget Secretary Benjamin E. Diokno. He said the Duterte administration wanted to fast track the rollout of infrastructure and development projects so that the lower income class, especially in the countryside, could immediately feel the effects of rapid economic growth. Faster deliberation and eventual approval await other major projects in the pipeline.

The 653-kilometer NSRP Southline, which runs from Tutuban in Manila to Legazpi and eventually to Matnog, Sorsogon was approved following several modifications, including the shift to the use of standard gauge, a newer and more internationally accepted technology. A monumental government project, Salceda said it would give about 24 percent economic returns to the countryside and is expected to offer massive growth opportunities for Bicol, particularly Albay, the regional center and hub. Formerly known as the Bicol Express, the link is the oldest rail system in Southeast Asia. “I am privileged as former BRDC and Luzon RDCom chair to have contributed to this game changer infrastructure for countryside development,” Salceda shared. As for the BIA, a new domestic-Principal Class 1 airport of international standards, the budget was maintained at Php 4.79 billion since the proposed changes would not entail additional cost, and the construction would be shorten to 2.5 years, he added. The BIA is expected to open the floodgates for international tourism to the Bicol region, particularly Albay which is now a UNESCO World Biosphere Reserve, and an emerging global ecotourism destination. The IPAC, on the other hand, will particularly benefit Albay’s third district.

I will be announcing formally (the list of tax evaders), but I would like to have the list completed,” the Chief Executive

said during his 15-minute speech at the Philippine Army 8th Infantry Division headquarters, this city, on Monday. Mr. Duterte said he will invite wealthy tax evaders to questioning. “If you will not come, I will send the police and ask why you’re not paying.” “Follow the law, follow the rules and do not cause agony to your fellowmen. He also mentioned about the ongoing anti-drug campaign of the government. President Duterte arrived 3:45 p.m. Monday at Camp Lukban here, attended a security briefing with top military officials, and delivered a speech to about 500 soldiers at the covered court. No Metro Manila mayor in Duterte drug list? Just wait, says DILG MANILA, Aug 8 (Mabuhay) – Metro Manila mayors with alleged links to the illegal drug trade should not be complacent because President Duterte is not yet done revealing the names of “narco-politicians”, Interior Secretary Ismael Sueno said Monday. Sueno said investigating agencies are still gathering evidence against Metro Manila officials who have alleged links to drug rings. “Basta taga-Metro Manila talagang validate nang

validate iyan kasi talagang iniipon iyung mga ebidensya laban sa kanila,” he said. The interior and local government secretary said Duterte will not spare anyone, noting how even some of the President’s friends were named in his list of narco-politicians. The President earlier named over 150 individuals from local governments, law enforcement agencies and the judiciary as alleged drug coddlers and drug

lords. The Cabinet official said some of the named officials have opened themselves to investigation by the Department of the Interior and Local Government (DILG) and Criminal Investigation and Detection Group (CIDG). DTI may publish list of shortchanging stores MANILA, Aug 6 (Mabuhay) – Establishments that shortchange their customers might someday find their name in a government “hit list” much less frightening but no less embarrassing than that of the president’s for people suspected to be involved in the drug trade. According to Lilian Salonga, assistant director at the Department of Trade and Industry’s (DTI) Consumer Protection Bureau, said it may be useful to publish the names of stores that violate the No Shortchanging Law. “Naatasan kami sa batas na ito, sa education and

information,” she said. As such, it may be worth releasing such a list to deter establishments from trying to pad their incomes with small change. However, this should only be done after the violators undergo due process in accordance with the law’s yet-unwritten implementing rules and regulations to avoid merely doing a shame campaign. BSP Deputy Governor Diwa Guinigundo meanwhile said that to help people get the change they need, Filipinos should be active in recirculating coins. “If you have 8.1 billion

MANILA, Aug. 9 (PNA) – Lawmakers are calling for a ban on the hiring of public school teachers on contracts of service or job orders. ACT Party-list Reps. Antonio L. Tinio and France L. Castro filed House Bill 60 that prohibits the hiring of teachers at all levels through contracts of service or job orders to carry out the duties and functions of regular teaching staff. Tinio said the practice of hiring public school teachers and higher education teaching personnel on contracts of service or job orders is all too common. “Local governments, the Department of Education, and public higher education institutions resort to this practice primarily to deal with growing student enrolments in the context of acute shortages of regular teaching items funded by the national budget,” Tinio explained. He said at present, there are about 600,000 teachers who are hired in such a manner, working at all levels of the public education system. Tinio said teachers on contracts of service or job orders experience exploitative and discriminatory compensation, benefits, and working conditions, as they do not have employer-employee relationship with the institutions that hired them. “Although possessing the same qualifications as their regularly-employed counterparts, they receive lower pay, enjoy none of the benefits, have no security, and are deprived of their right to unionize,” Tinio said. These teachers, Tinio said, are also denied benefits such as Personnel Economic Relief Allowance (PERA),

Cost of Living Allowance (COLA), Representation and Transportation Allowance (RATA), midyear bonus, productivity incentive, Christmas bonus and cash gifts, and the social security coverage provided by the Government Service Insurance System (GSIS) and PhilHealth. “Having no security of tenure, they are often rehired on the same terms, year in and year out,” he said. For her part, Castro explained that hiring teachers through contracts of service or job orders is contrary to Article XIV, Section 5(5) of the 1987 Constitution and

existing laws, including Republic Act 4670 (the Magna Carta of Public School Teachers) that are intended to protect the status of the teaching profession. The bill provides that no teacher shall be hired to carry out the duties and functions of regular teaching staff, either on a full-time or part-time basis, through contacts of service or job orders. Post-secondary education institutions requiring teachers with highly specialized or technical expertise, which cannot be provided by their regular teaching staff are exempt from the prohibition on contracts of service.

Kim claimed that the SSS erred in computing the company’s liability by including the contributions for employees who were on forced leave during the covered period. He also invoked

The King has instructed the Ministry of Labor to waive immigration penalties due to expired working visa, provide plane fare to OFWs returning to the country, food aid, and re-employment assistance to those who wish to work in other companies, and legal assistance to money claims.

Bello said the Ministry of Labor has confirmed the King’s instruction to guarantee and protect the rights of foreign workers in Saudi Oger and other companies affected by oil crisis. “This is a welcome development and, indeed, a big help in our ongoing efforts to secure the welfare of our OFWs,” said Bello. MANILA, Aug. 8 (PNA) – Chief Justice Maria Lourdes P. Aranal Sereno on Monday advised the judges who were named by President Rodrigo Roa Duterte as purportedly involved in illegal drugs not to surrender. In her four-page letter, the Chief Magistrate advised the judges who were included in the list not to surrender to any police officer without a warrant of arrest. Sereno said that this was to protect the judges as the protectors of the rights of the citizens under the Constitution. Sereno also asked President Duterte to allow those judges who were named to continue to carry their licensed firearm for as long as charges are not yet filed against them. This as Sereno expressed her apprehension that the said judges will also be the “target” of incidents of extra-judicial killings and that they may also become “collateral damage” in the war against illegal drugs. The Supreme Court (SC) has previously asked the Philippine National Police (PNP) to allow them to carry firearm such that the SC has no sufficient personnel to provide protection to the judges. Sereno added that although the judiciary appreciates the intention of the President to help in the clean-up of the ranks of the judiciary, the informal report from the President or the members of his Cabinet would be sufficient enough for the SC to take action and conduct an investigation without the need of ordering the judges to report to any office and thereby not impede in their scheduled court activities.

President Duterte was deeply hurt Sunday when he included some friends in his list of local officials, lawmen and court judges with alleged drug ties, Interior Secretary Ismael Sueno shared Monday. Sueno said Duterte first presented his list of “narco-politicians” to his Cabinet Secretaries before announcing it in a live televised speech. Duterte’s announcement of an informal investigation on the alleged involvement of seven judges in the illegal drugs trade “was premature”. ”The SC would consider it important to know the source and basis of any allegation that specific judges are involved in the illegal drugs trade,” Sereno said in her four-page letter to President Duterte. She expressed alarm over the announcement of the ‘narco-judges’, saying that judges are vulnerable to extra-judicial killings and this would have an impact on the performance of the judges’ “adjudicative role”. Sereno emphasized the importance of the good reputation and credibility of judges. She said they are expecting this to have an effect on the schedule of trials and conferences of the judges. Admitting that the President’s announcement sprang a surprise on them, the Chief Justice said it would have been better if the High Court was given the opportunity to conduct preventive measures before the announcement was made. Sereno also disclosed that the SC is investigating a judge who may be involved in the trade of illegal drugs but is not in the list of President Duterte. President Duterte has earlier named Judge Lorinda Toledo-Mupas of Dasmarinas, Cavite; Judge Reyes of Baguio City; Judge Savilo of Iloilo City Regional Trial Court (RTC) Branch 13; Judge Casipli of Kalibo, Aklan Municipal Trial Court (MTC); Judge Rene Gonzales of Iloilo City Municipal Trial Court in Cities (MTCC); Calbayog City, Samar RTC Judge Navidad; and Dapa, Siargao MTC Judge Ezekiel Dagala. MANILA, Aug. 8 (PNA) – The Department of the Interior and Local Government (DILG) has highlighted the need for local government units (LGUs) to come up with more resilient strategies in the long run, not only in disaster preparedness, but also in local economic development. “We need to be compelled to consider resilience and sustainability in the vision of local economic development as much as we have to be fair to the future generation in our economic decisions and productive choices,” DILG Undersecretary Austere Panadero said in his speech during the Japan-Philippines Knowledge Exchange Forum at Crowne Plaza Manila Galleria. According to Panadero, there is a need to pursue the strengthening of local autonomy of LGUs through knowledge exchanges on local administration. “We need to be disturbed by the risks and challenges that we face but we also need to be inspired by what works in both Japan and the Philippines,” Panadero said. “By the very nature of sustainability, we want future opportunities and benefits to be as robust and as accessible to our children and those who will come after us. Sustainability, therefore, is a commitment to the future generation that what we are enjoying now should also be made available to them and hopefully, must promote a better and meaningful life,” he added.

Hontiveros to conduct inquiry on violations of hospital deposit law Akbayan Senator Risa Hontiveros vowed to conduct a senate inquiry on the reported violations of several hospitals of Republic Act 8344 or the Anti-Hospital Deposit Law, which prohibits any hospital and medical facility to demand any deposit or any other form of advance payment, as a prerequisite for admission or medical treatment of a patient to prevent death or serious harm. Hontiveros, who is the newly-elected chairperson of the Senate’ Committee on Health expressed alarm regarding cases of some hospitals’ refusal to follow the law. SACRAMENTO – California’s birth rate among adolescents has continued to decline to record-low levels, reports California Department of Public Health (CDPH) Director and State Health Officer Dr. Karen Smith. The state’s 2014 numbers indicate a record low of 20.8 births per 1,000 females between the ages of 15 and 19. Those numbers reflect a 10 percent decline from 2013 and a 55 percent decline from the 2000 rate of 46.7. “California’s continued success in reducing births among adolescents is an excellent

example of public health at work,” said Dr. Smith. “We can have a positive influence on the lives of young people when we empower them with knowledge, tools and resources to make healthy choices.” The birth rate among adolescents decreased among all racial and ethnic groups between 2000 and 2014. During this time, the birth rate dropped from 77.3 to 31.3 (births per 1,000 females aged 15 to 19) among Hispanics, 59.1 to 24.6 among African Americans, 22.3 to 8.4 among Whites and 15.0 to 3.7 among

Asians. Despite these declining birth rates, racial disparities persist in adolescent childbearing in California. African American and Hispanic adolescents are three to four times as likely to give birth as White females. In addition, the birth rate among adolescents varies considerably across counties, from a low of 7.0 in Marin County to a high of 45.1 in Kern County. DOH oversees reopening of express lanes for dengue patients in gov’t hospitals MANILA, Aug. 8 (PNA) – The Department of Health (DOH) is overseeing the reactivation of express lanes for dengue patients in government hospitals. “As we observe National Hospital Week, our Secretary of Health (Dr. Paulyn Jean B. Rosell-Ubial) has been going to hospitals to monitor the (reactivation of) dengue express lanes,” said DOH Assistant Secretary and spokesperson, Dr. Eric Tayag. Tayag said dengue express lanes are reactivated during the rainy season in anticipation of a rise in the incidence of the mosquito-borne disease. He explained that the express lanes ensure that those suspected of having

dengue fever are given immediate attention to determine if they need to be confined in the hospital or if their illness could be managed at home. Meanwhile, Tayag reminded everyone to check areas where mosquitoes thrive, especially with the onset of the rainy season. The DOH spokesperson said that keeping the surroundings clean and disposing of vessels where mosquitoes could breed will help a lot in eliminating mosquitoes. He said such measures should be coupled with the use of insect repellant and wearing protective covering. He further emphasized the importance of early consultation as soon as a patient

experiences symptoms of the disease. He discouraged indiscriminate fogging as this only drives mosquitoes to other areas. For its part, Tayag said, the DOH has partnered with the Department of Education (DepEd) in providing public schools Insecticide Treated Screens (ITS). The department has also spearheaded the vaccination of Grade 4 students in public schools in regions prone to dengue fever, among them the National Capital Region, CALABARZON and the Southern Tagalog region. These students will receive the second and third doses of the dengue vaccine six months apart. The vaccine, developed by

Sanofi Pasteur during more than 20 years of research, will protect the children from four strains of dengue. Tayag meanwhile stressed that such medical breakthroughs as the dengue vaccine could help but winning against dengue requires concerted efforts. The department has recorded a total of 66,299 dengue cases as of July 16. GMA seeks additional exemption for taxpayers taking care of elderly parents MANILA, Aug. 9 (PNA) – Rep. Gloria Macapagal-Arroyo (2nd District, Pampanga) is seeking additional personal exemption for individual taxpayers who take care of their elderly parents to relieve them of tax burden and allow them to save money for the nutrition, education, medicines and other basic needs of other dependents. The country’s former chief executive said many family members today face economic difficulties due to high cost of living. In some instances, she said it is common to find households where both spouses work to support their children and provide care for their aging parents. Arroyo, however, said despite entailing additional expenses in looking after their elderly parents, it does not seem to matter for the ordinary Filipino family who would rather personally take care of their elderly parents rather than entrusting

them to other people. “One praiseworthy Filipino value is devotion to family ties. Married children take care of their parents by supporting them during the twilight years as an act of gratitude for all their pains and sacrifices. Thus, it is not surprising to see family members who provide their aging parents a wide array of assistance from medications, adult healthcare and in some cases, medical procedures. And since family is the backbone of the long-term health care system in the country, we always make sure that care for older persons is left in the hands of family members” said Arroyo. In line with this, Arroyo said Republic Act 7432 which is “An Act to Maximize the Contribution of Senior Citizens to Nation-Building, Grant Benefits and Special Privileges and for Other Purposes” was enacted to give assistance to individuals who take care of

their elderly parents. “It allows a taxpayer, who is head of the family to include a senior citizen as a dependent under the National Internal Revenue Code or the NIRC of 1997 and in any of its implementing rules and regulations. Hence, there is a need to legislate anew this matter by incorporating it in RA 8424, or the NIRC as amended, in order for individual taxpayers to full avail of this additional tax exemption,” said Arroyo. By including parents who are senior citizens as dependents, Arroyo said the State relieves taxpayers from tax burden and allows them to save money which can be used to meet the nutrition, education, medicines and other basic needs of other dependents, according to Arroyo. In House Bill 1522, which is now pending at the House committee on ways and means, Arroyo sought the

amendment of Paragraph (B) of Section 35 of RA 8424, as amended, which pertains to additional exemption for dependents. The amendment provides that “An additional exemption of P25,000 for each elderly parent shall likewise be allowed to the individual taxpayer. Provided, that the elderly parent is chiefly dependent on and living with the taxpayer.” Moreover, the amendment provides “For purposes of this Subsection, a ‘dependent’ means a legitimate, illegitimate or legally adopted child chiefly dependent upon and living with the taxpayer if such dependent is not more than 21 years of age, unmarried and not gainfully employed or an elderly parent who is at least 60 years old with no means of support or if such dependent, regardless of age, is incapable of self-support because of mental or physical defect.”

DOH wants PhilHealth to cover blood and blood products 100% free among mothers giving birth MANILA, Aug. 8 (PNA) – The Department of Health (DOH) said that blood and blood products administered in mothers giving birth in hospitals should be 100 percent covered and paid for by the Philippine Health Insurance Corporation (PhilHealth). DOH Secretary Dr. Paulyn Jean B. Rosell-Ubial said they are making this recommendation as they continue to explore means to improve the benefit packages of PhilHealth in line with the universal health care (UHC) or “Kalusugang Pangkalahatan” program. Dr. Ubial noted that ideally, such service should not be included in the case rates of PhilHealth among the mothers giving birth. She cited that while it is true that some pregnant women giving birth need units of blood, there are many others who do not need blood transfusion during and after birth delivery. As an example, she said that in cases where mothers give birth through caesarian section, some will require at least 10 units of bags of blood because of postpartum hemorrhage. “Some of them do not need blood… So why will you put it in the case rates? So the case rates should only cover the things needed,” she said. The Health Chief said she will closely network with the PhilHealth on how the recommendation can be done as they continue to find ways to improve the benefit packages of PhilHealth to ensure that the battle cry of “Health for All! All for Health” can be fully achieved.

With the increase in California’s minimum wage to $10 an hour on January 1, 2016, that means a 24- hour caregiver must be paid $315 a day to comply with the current law. Many caregivers are working under a day rate or monthly salary. A day rate or monthly salary

does not compensate for the overtime hours worked and results in a substantial unpaid overtime claim for the caregiver. Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent contractor.”

In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver such that that California law will find the caregiver to be an employee. This change in the overtime rules for caregivers became effective on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law. Other key findings from an analysis of AAA’s 2015 roadside assistance data include: Battery failures, flat tires and keys locked inside the vehicle remain the top roadside assistance requests. Vehicles fewer than five years old have a higher proportion of tire, key and fuel-related issues than older vehicles. Due in part to complex, electronic vehicle designs, one-in-five service calls for a newer vehicle required a tow to a repair facility. Vehicles between 6 and 10 years old have the highest proportion of battery-related issues, as most batteries have a three- to five-year life. Roadside assistance calls peak in the summer (8.3 million) followed by winter (8.1 million), fall (7.8 million) and spring (7.7 million). Drivers are most likely to request roadside assistance on Mondays and least likely to request assistance on Sundays. Drivers in the West experienced the most breakdowns, followed by the South, the Northeast and the Midwest. Despite advances in key technology, AAA came to the rescue of more than four million drivers locked out of their vehicles. “Drivers today have increasingly-connected lifestyles, and want reliable, flexible service options when trouble strikes,� continued Ruud. “AAA has responded with flexible roadside assistance offerings nationwide including app-based service requests and the ability to track assigned service vehicles in real time on a smartphone.� To help prevent millions of roadside breakdowns from happening, AAA offers the following recommendations for common roadside problems: Check for a spare tire: Before purchasing a car, check that the vehicle includes a spare tire. If it doesn’t, consider adding one as an option. Tire inflator kits — which have replaced spare tires on tens of millions of vehicles –cannot remedy all types of tire damage. Check tires: At least once a month, check the tire pressure to ensure proper inflation. This affects tire wear and vehicle handling. Tires should be rotated based on the manufacturer’s recommended schedule for the vehicle. Lockouts: AAA recommends motorists take special care of their “smart keys� and keyless entry fobs. Always take keys when exiting the car, avoid exposing keyless-entry remote or smart keys to water and always replace the key or fob battery when recommended by the vehicle manufacturer. Battery: AAA recommends that drivers have their vehicle’s battery tested when it reaches three years of age and on an annual basis thereafter. AAA’s Mobile Battery Service offers free battery testing for AAA members. Pack an emergency kit: A recent AAA survey shows that more than 40 percent of motorists do not carry an emergency kit in their vehicle. AAA recommends that every driver have a wellstocked emergency kit, which includes a mobile phone and car charger; a flashlight with extra batteries; a first-aid kit; drinking water; extra snacks/food for your travelers and any pets; battery booster cables; and emergency flares or reflectors.

Old-Fashioned Upside Down Cake Prep time: 20 minutes Total time: 35 minutes Servings: 8 2/3 cup margarine, divided 2/3 cup packed brown sugar, divided 1 can (20 ounces) Dole Pineapple Slices 10 maraschino cherries 3/4 cup granulated sugar, divided 2 eggs, separated 1 teaspoon grated lemon peel 1 teaspoon lemon juice 1 teaspoon vanilla extract 1 1/2 cups all-purpose flour 1 3/4 teaspoons baking powder 1/4 teaspoon salt 1/2 cup sour cream Heat oven to 350 F. In 10-inch cast-iron skillet, melt 1/3 cup margarine. Remove from heat. Add brown sugar and stir until blended. Drain pineapple slices; reserve 2 tablespoons syrup. Arrange pineapple slices in sugar mixture. Place cherry in center of each slice. Beat remaining 1/3 cup margarine with 1/2 cup granulated sugar until light and fluffy. Beat in egg yolks, lemon peel, lemon juice and vanilla. Combine flour, baking powder and salt. Blend into creamed mixture alternately with sour cream and reserved pineapple syrup. Beat egg whites to soft peaks. Gradually beat in remaining 1/4 cup granulated sugar to make stiff meringue. Fold into batter. Pour over pineapple in skillet. Bake 35 minutes, or until toothpick inserted comes out clean. Let stand 10 minutes then invert onto serving plate. Serve warm or cold.

Chocolate Mandarin Orange Cake

Prep time: 15 minutes Total time: 40 minutes Servings: 16 1 1/2 cups butter, softened, divided 1 cup packed brown sugar 1 cup granulated sugar 4 eggs 1 can (20 ounces) Dole Crushed Pineapple, drained 4 cups shredded carrots 1 cup Dole Seedless Raisins 2 teaspoons vanilla extract 3 cups all-purpose flour 2 teaspoons baking soda 1 teaspoon ground cinnamon 1 teaspoon ground ginger 1/2 teaspoon salt 1 package (8 ounces) cream cheese, softened 1 1/2 cups powdered sugar 1 teaspoon grated lemon peel 1 tablespoon lemon juice Heat oven to 350 F. Grease and flour two (9-inch) round pans. In large bowl, beat 1 cup butter and sugars until light and fluffy. Beat in eggs. Fold in crushed pineapple, carrots, raisins and vanilla. In medium bowl, stir together flour, baking soda, cinnamon, ginger and salt. Gradually add to pineapple mixture and fold until wellblended. Pour into prepared pans. Bake 35-40 minutes, or until toothpick inserted comes out clean. Cool in pans 15 minutes. Remove from pans; cool completely on wire racks. Beat cream cheese with remaining 1/2 cup butter until smooth. Beat in powdered sugar, lemon peel and lemon juice until smooth. Frost completely cooled cake. Garnish with additional crushed pineapple and grated carrots, if desired. Note: Cake can be baked in 13-by-9-inch pan. Bake 50-60 minutes at 350 F. Cool completely in pan on wire rack.

Prep time: 10 minutes Total time: 45 minutes Servings: 12 2 cans (15 ounces) Dole Mandarin Oranges, divided 1 box (2 layer) devil’s food cake mix 3 eggs 1/2 cup vegetable oil 1 orange, peel grated (optional) 1 package (4-serving size) vanilla flavor instant pudding 2 cups frozen whipped topping, thawed 1 cup heavy whipping cream 1 cup semisweet chocolate Heat oven to 350 F. Spray two (9-inch) cake pans with cooking spray. Drain mandarin oranges, keeping fruit and syrup reserved separately. In large bowl, combine cake mix, juice from one can of mandarin oranges, eggs, oil and orange peel; beat 2 minutes. Pour cake mix into prepared pans. Layer mandarin oranges from one can over each cake and gently submerge them into cake batter. Bake 25-30 minutes, or until toothpick inserted in center comes out clean. Cool in pan 10 minutes. Remove from pan onto wire rack; cool completely. Pour 1/2 cup reserved juice from second can of oranges in bowl with pudding mix; whisk 2 minutes, or until pudding mix is completely dissolved. Remove 12 orange slices from second can and dry with paper towel; set aside. Fold in whipped topping and remaining mandarin oranges. Spread mandarin frosting on top of first layer of cake and out to edges. Place second layer on top of first layer. In small saucepan, heat cream until just beginning to steam, but do not boil. Remove from stove and stir in chocolate. Stir until well-blended. Pour chocolate mixture over cake and garnish with reserved mandarin oranges. Refrigerate half hour before serving.
