WELCOME TO well connected SUMMER 2014 H

ello again, welcome to the Summer issue of well connected magazine. Liverpool is absolutely buzzing with preparations for the International Festival for Business (IFB). We held our most recent Secret Breakfast meeting for members in the IFB Hub at 1 Mann Island and everything is coming together with the best possible facilities there for those who have signed up as business club members. There are over 200 confirmed attendees at the Chamber’s ‘Power of the Chamber Global Network’ event in July with representatives signed up from over 25 different countries! We will report back on our successes in the next edition. I am also delighted to report the recent success by Liverpool Chamber Training (LCT) in achieving an overall grade of Level 2 ‘Good’ in its recent Ofsted inspection. LCT was deemed to be ‘Good’ in such areas as the number of Apprenticeships achieved; the quality of teaching; and leadership and management and I am so proud of Mary Smyth, Operations Manager and her team for this achievement, especially considering the increased monitoring standards that Ofsted has introduced in the new framework. The achievement of this grade also means that we are able to deliver a better outcome for our apprentices and encourage more employers to sign up with us so that we can create more jobs for young people throughout Liverpool. (Read more on pages 6-7) Finally, I would like to say congratulations to our Spark Up businesses. They attended a breakfast event and presented to VIPs and business professionals from across the City. Their 60 second pitches were judged by a panel with two winners receiving substantial cash prizes. Mayor Joe Anderson was so impressed, he also awarded each business that pitched, £500 – so there were no losers! (See the article on page 19) We are continuing to work with our Bright Sparks, whilst liaising with organisations in the city to create new business and encourage entrepreneurship. LCT Apprentices honoured at Graduation Ceremony

The Apprenticeship Graduation was a huge success.

L

iverpool Chamber Training (LCT) students embarking on new careers were honoured at the

Richard Else, operations manager at Jaguar Land Rover and chair of the education and skills board, was one of the guest speakers at the event.

UK’s biggest Apprenticeship Graduation ceremony, organised by the Liverpool City Region Apprenticeship Hub. In total, 400 Merseyside Apprentices graduated at the Anglican Cathedral in the inaugural event held on Tuesday 29 April. A total of eleven LCT Apprentices celebrated Level 3 and Level 4 Apprenticeship qualifications. Katie Jones, recently promoted to Recruitment Team Leader at LCT, commented: “I thought it was a great event, and hope it becomes bigger each year. We think that a big celebration like this at the end of an Apprenticeship acknowledges trainees’ hard

work and will encourage more young people to undertake training, which is definitely a good thing. I always wanted to go into management, and my Level 3 Apprenticeship has enabled me to gain fulltime employment in a role where I can help others fulfil their potential.” Ashley Terron was on hand as a guest speaker. He works as assistant site manager at Redrow Homes’ New Heys development in Allerton, having previously completed an Apprenticeship in bricklaying, and last year he won a gold medal in this category at the Skills Olympics. Ashley said: “It’s fantastic that Apprentices have been properly recognised

and been able to formally celebrate achieving their qualification with family and friends. As a former bricklaying Apprentice, I wish I could have experienced an Apprenticeship Graduation

iverpool Chamber Training honoured the achievements of Apprentices and employers at its recent Apprenticeship Awards. The 2014 Awards, held during Apprenticeship Week at the Richmond Hotel, saw the LCT team recognise those who have made great strides via the Chamber’s Apprenticeship programme, as well as the organisations which

have allowed these and other Apprentices to flourish. There were seven awards presented by the LCT team on the night, beginning with the Apprentice Of The Year category which covered three different age groups. Katie Van Der Woude of MGMA Studio picked up the 16-18 award; Hayleigh John of Peter Edwards Law received the 19-23

LCT achieve level 2 grade in Ofsted inspection L

iverpool Chamber Training (LCT) is celebrating after achieving an overall grade of Level 2 “Good” in its recent Ofsted inspection. LCT was deemed to be “Good” in such areas as the number of Apprenticeships achieved; the quality of teaching; and leadership and management. Jenny Stewart, Chief Executive of Liverpool Chamber, said: “There has been an increased focus on quality in everything we do, whether that be in the placements we find for these young people, the standard of teaching and learning, or the systems in place to effectively monitor progress and continually raise and exceed both learners’ and employers’ expectations.” Mary Smyth, Operations Manager at LCT, commented: “We have a highly talented and dedicated staff team, a highly effective board, superb employers and young, dynamic Apprentices who are helping the local economy to thrive. Our young people are the lifeblood of the city, and I am very proud of their achievements.” Of particular note to inspectors was the in-house Chamber Apprenticeship training model which demonstrates good practice to local employers. Ofsted were so impressed they have recommended that the model developed by the Chamber be showcased throughout the UK as best practice. Mary added: “I am very pleased

when I completed my qualification two years ago.” Mary Smyth, Operations Manager at LCT, added: “The ceremonies showcased the variety and value of

award; and Sheila Hayes of Liverpool Hope University won the 24+ award. Chantelle Owens of Hampson Hughes Solicitors was named Apprentice Of The Year for Excellence In Achievement, whilst Adam Wain of Crest Reprographics received the award for Apprentice Of The Year for Outstanding Contribution To The Community. Hampson Hughes Law were named Employer Of The Year, and Gemma Parkinson of BridgeStreet Liverpool ONE received the award for Honorary Apprentice Of The Year.

that the hard work and commitment of our staff and learners has been formally recognised by Ofsted, and I look forward to building upon the results we achieved.”

Speaking at the end of the ceremony, Mary Smyth, Operations Manager for LCT, commented: “Thank you to everyone who attended our awards this evening, and indeed to all our companies who support the young people of our communities. Last but not least, I want to thank all team members in Liverpool Chamber Training who help make this happen. Together, we really are making a difference to the lives of young people across the city, and I thank you for doing such a wonderful job.”

Look before you leap!

W

ith increasing signs of an economic recovery becoming evident, new business start ups will find themselves in the potentially daunting position of negotiating a new commercial lease. It is obviously advisable to seek assistance from a Commercial Property Solicitor with such negotiations, but for those who are brave enough to go it alone it may be worth giving some thought to the following issues. Is the length of duration of the lease sufficient for your needs? The longer the lease term the more extensive the financial liability. Depending on the rental figures you may find that the lease will attract Stamp Duty Land Tax which will be another unwelcome expense for your new start up business. Conversely, a longer lease term will provide security and certainty for your business. Take advantage of any break rights (ideally unconditional ones) that the Landlord is prepared to grant. This will enable you to walk away from the lease should you need to, before its natural expiry. Be clear on whether or not you will have the right to renew your lease once expired. If you do not have what is known as a protected lease under the Landlord and Tenant Act 1954 then you may find yourself in the position of having to relocate which in effect is starting over again. Before getting too carried away establish whether or not you can actually use the property concerned in conjunction with your proposed venture. Your solicitor can check this out on your behalf but early time saving enquiries can be made via the Planning department at the council. Another hazardous area relates to the cost of the repair and maintenance of the property. Typically a Landlord will seek to ensure that the Tenant is responsible for these costs. Caution needs to be exercised where the subject property is in poor condition. Efforts need to be made to limit the extent of your liability in this regard at the outset. Perhaps your Landlord may entertain the prospect of a rent free period in your favour whilst you complete any fitting out works. Take account of other additional costs over above the rent such as insurance rent or potential service charges. iverpool John Lennon Airport (LJLA) has announced a change to the structure of its ownership. The Peel Group, which previously held a 35% shareholding in Vantage Airports UK, has reached an agreement to acquire the remaining 65% stake in the business from Vantage Airport Group. Peel are now the sole owner of the airport company. Over the past four years, under the ownership of Vantage, LJLA has undergone

significant improvements, providing a strong in-class airport experience for both passengers and airlines. Peel believes that by investing in LJLA, the business can be taken to the next level, attracting new airlines and new services by capitalising on the excellent operational and commercial performance. It will remain business as usual for airport employees, airlines and passengers, with LJLA continuing to serve the needs of the travelling public

in Merseyside and the North West. Matthew Thomas, CEO of Liverpool John Lennon Airport, commented: “The Airport is a key project in Peel’s Ocean Gateway programme, which will see £50 billion of investment in the North West. Riverside recognised for inclusive employment by Stonewall

R

iverside is one of Stonewall’s 100 best employers, placed at 61 in the league table, compiled by the gay rights campaigning organisation. Riverside joined nine other housing providers nationwide in the top 100 and gained 77 places from its 138th position last year. Neil Townsend, divisional director and chair of the lesbian gay bisexual and transgender (LGBT) staff group, is delighted with the recognition. Neil said: “We’ve made lots of progress over recent years to ensure that we are a truly inclusive place to work. I’m very proud to work alongside people who are comfortable being themselves in the workplace. Our commitment to inclusivity means that we can all get on with the job of transforming lives and revitalising neighbourhoods, regardless of sexual orientation.”

Merseyside shops join forces to fight against criminals

A

new anti-shoplifting scheme has revolutionised how Merseyside businesses are protecting themselves from thieves. Liverpool, Wirral and St Helens have joined a network which is alerting shops to potential and persistent offenders in their areas within minutes. The system, which shares CCTV images and descriptions, has already proven successful with shops in the region. The Database Internet for Safer Communities (DISC) was introduced by Liverpool & Sefton Chambers of Commerce for a trial period just before Christmas before being taken on permanently. DISC allows hundreds of Chamber members to receive bulletins which warn them of shoplifting incidents, often complete with CCTV images of the offenders, regardless of whether Merseyside Police are involved. The force has access to the data after linking up with the scheme, but the system allows shops to warn others about individuals and gangs almost immediately, offering vital protection

if the person has already left the shop or if the theft has been discovered afterwards. DISC is being overseen by Tony Jopson (pictured), Crime Reduction Manager at the Chamber, who monitors offences and offenders and draws up alerts. Mr. Jopson, who served as a Merseyside police officer for 31 years, said: “Our main focus is to prevent offences. Detection is the second leg and we do that too, but it’s about reducing their opportunity to commit offences.” Tony added: “When travelling offenders find something successful they do it over and over again. That’s what they do; confine themselves to that activity, so we can warn potential victims. It’s doing what we have been doing for years, but doing it a lot smarter, and I think it’s brilliant. It’s changing the way we think. We are getting there and it’s getting more and more important, particularly for the region’s travelling offenders because they are the ones that hurt us the most.”

Former chamber board member releases his autobiography

E

ddie Clein, a former member of the Chamber board and Lord Mayor of Liverpool, has released his autobiography. In his book Falling off the Fence, Mr Clein writes about the experiences of his political career, relating tales of his encounters with the likes of Princess Anne and the

Duke of Edinburgh, whilst explaining the reasoning behind key decisions made during his 2000-2001 tenure as Lord Mayor of Liverpool. In addition to recapping an eventful career, Eddie provides an insight into his conversations with Lord Derby, long-time President of Liverpool Chamber, and how their original meeting revealed a past link between their two families. Mr Clein also relives the times when he shared company with such star names as David Beckham and Michael Jackson.

Trust Wills can stop estates slipping over Inheritance Tax threshold after Government freeze By head of Wills and Probate at Jackson & Canter, Naomi Pinder

Nil Rate Band Discretionary Trust Wills are coming back into fashion after the Government froze the Inheritance Tax threshold at £325,000 until at least 2017-18. Not raising the threshold means more and more people may be sleepwalking into the Inheritance Tax trap. Under the current rules an individual can leave an estate worth up to £325,000 to their loved ones without incurring inheritance tax. That allowance can be passed on to a spouse (including civil partners) so that upon their death, loved ones can receive an estate up to the value of £650,000 taxfree. This is known as the Nil Rate Band. But if property prices continue to outstrip inflation, people whose only asset is their home may find they are dragged across the threshold. People who are never usually affected by the tax could run the risk of the Government taking a slice of whatever they leave behind. Nil Rate Band Discretionary Trust Wills do cost more than standard Wills, but justify this by protecting your assets from Inheritance Tax and protecting assets against care home fees and second marriage by the surviving spouse. By putting the Nil Rate Band itself into a Will Trust, naming the beneficiaries as each other, their children or anyone else they choose, couples can ensure their estate passes to those they wish rather than the taxman. BUSINESS OPPORTUNITIES IN HISTORIC ARCADE

W

ayfarers Shopping Arcade, a member of Sefton Chamber, has been at the heart of Southport since 1898 and has undergone much sympathetic restoration in recent years. The Grade II listed arcade was originally opened as the Leyland Arcade by John Humphrey Plummer, a Victorian entrepreneur. There were 32 shops on the ground floor, 24 rooms on the first floor, and a bandstand, grand piano and chairs to hire for the day. Located on the town’s main shopping street, the arcade was quite a visitor attraction at the time. When Mr Plummer died he left the arcade to Cambridge University who took over the running of it in 1935. Local businessman, Vyvian Pedlar moved his shop, Wayfarers Arts, from Lord Street into the Leyland Arcade in 1935 and the Pedlar

family have been there ever since, eventually taking over ownership of the arcade. Vyvian’s granddaughter, Nicola Lynch took over from her mother as managing director of Wayfarers Shopping Arcade in 2004. Nicola, who has guided the arcade through the most recent renovations and is incredibly proud of how it now looks, says: “Wayfarers

is one of the town’s most recognisable landmarks and we have continued to invest in this iconic building over recent years to make it more welcoming and appealing to our visitors. It is definitely one of Southport’s main shopping destinations.” Wayfarers is still at the heart of Southport shopping and continues to offer contemporary style in traditional surroundings and

is a leisure destination worth visiting. The family owned business is renowned for supporting their tenants. When other shopping arcades are struggling with many empty units, Wayfarers continues to buck the trend. Nicola continued, “We are always keen to talk to sole traders of unique retail businesses who would see the value of starting a business or moving an existing retail business into the celebrated Wayfarers community in Southport”. To drive footfall, regular promotions, events and exhibitions take place within the arcade. These events range from photographic and art exhibitions to musical events and fashion shows. The Poet Laureate, Carol Ann Duffy is to make a welcome return on the evening of 24 June when she will read her poems and sign her books. Wayfarers has always been at the centre of Southport events and supports local activities around the town like the annual Jazz, Comedy and Food festivals. Robinson & Neal join Brewers T

wo historic family businesses have come together with Robinson & Neal becoming part of the Brewers group. Robinson & Neal was founded as a decorators’ merchant in Dale Street, Liverpool in 1899 by Joseph Neal, grandfather of the most recent Managing Director, Richard Neal. Brewers was founded five years later in Eastbourne and is today run by the fourth generation of the family with almost 150 branches across the UK. The ‘Robinson’ in Robinson & Neal comes from a commitment that Mr Joseph Neal made when he started the business and borrowed a sum of money from Mr Robinson – a Nottingham businessman who also ran a decorators’ merchant! Joseph Neal’s two sons Daryl and Jack joined the business in the 1930s and ran the business through the difficult times of the Liverpool bombings during WWII. In 1960, Jack’s son John joined the company, followed by Daryl’s son Richard in 1980. During this period, the business flourished resulting in the opening of shops in Chester, Birkenhead and Bangor. In more recent years, Richard’s wife Julia came into the business to expand and develop the retail side. Robinson & Neal was the first distributor of Farrow & Ball paint in the North of England and a winner of the HDRA Retailer of the Year award in 2010. It’s great to be living and working in Liverpool at a time when I think there are real signs of economic upturn and lots of opportunities for businesses in the city. Outside of work, I’m a keen tennis player and an LFC season ticket holder. I also like to cook and am partial to a nice glass of wine.

iverpool & Sefton Chambers of Commerce entertained over 380 members in April at the Opening Day of the Grand National Festival at Aintree. Attendees enjoyed an exclusive day of racing, hospitality and entertainment whilst networking with fellow colleagues. The day had a festival feel from the off with colourful outfits, fabulous hats and perfect weather. Members and

their guests enjoyed a complimentary bar for the day and a four course luncheon with a table magician providing entertainment between courses. Later on, everyone enjoyed afternoon tea. There were several big winners some using racing form, others the colour of the jockey’s silks and some just picking out of a hat. However, everyone that attended was a winner! Some of the more hardy racegoers

then headed into the city where the fun continued into the small hours. BRIGHT SPARKS ARE REWARDED A

s reported in previous issues of well connected, the first programme of Spark Up, based in the Liverpool Chamber of Commerce offices is well underway and it offers mentoring, coaching, office space and IT facilities free to 15 startup entrepreneurs, known as Bright Sparks, and fledgling businesses. Entirely private sectorfunded, it is hoped the project will create 500 Merseyside businesses in the next five years and is modelled on similar schemes in Scotland and Boston, USA. The Chamber hosted an inaugural Spark Up breakfast event, hosted by chief executive of Liverpool & Sefton Chambers of Commerce Jenny Stewart and attended by Mayor of Liverpool, Joe Anderson and other leading business and political figures. The 15 Bright Sparks delivered a 60-second pitch presenting their business objectives and needs, hoping to attract support from the distinguished guests. A panel of judges including Mayor Joe Anderson, Jenny Stewart, John Sutcliffe (chair of

How team building can help your bottom line “Let’s organise a team building event”, is a phrase often heard in the corporate arena.

he benefits of a well organised event are sometimes difficult to relate directly to the bottom line but they are unquestionable – improved morale, improved internal communication, stress reduction in the workplace, a feeling of belonging, clearer understanding of goals and better interpersonal relationships these all lead toward improved productivity, better bottom line, and a happier workforce in general. number of Liverpool & Sefton Chamber members picked up gongs at the 2014 Echo Environment Awards, held at the Isla Gladstone Conservatory. n 23 July 2014, Vince Ferguson, Chairman of INCINER8 Ltd, and Peter Hughes, a leading Consultant Orthopaedic Surgeon, are setting off on a charity cycle ride from London to Paris in aid of Cancer Research UK. The pair are hoping to raise over £10,000 for Cancer Research UK, which is the world’s leading charity dedicated to beating cancer through research. Vince Ferguson said: “We will all have friends or family who have battled

cancer; it has touched all our lives. The positive news is that slowly we are beating this disease, and hopefully with the work of the likes of Cancer Research UK, it will no longer be a word that we all fear. I am hoping that our cycle challenge will go some small way to raise awareness and plenty of money for our chosen charity.” Peter himself hasn’t been on a road bike for 25 years, so it will be something of an epic task for him to finish this long ride.

Clarke Energy were recently selected to supply Australia Pacific LNG with 19 new Jenbacher J620 gas engines for two on-site power projects in rural Queensland.

The company received the award in recognition for sustained international growth. Clarke Energy executives were invited to a reception at Buckingham palace later in the year. s most health and safety managers will be aware, as of 1st October 2013, the Health & Safety Executive (HSE) removed all approval and accreditation for First Aid at Work training. Prior to this it was common to see workplace courses advertised as ‘HSE approved’. This approval offered organisations a degree of insight into training quality when making their choices. So where does this decision leave you when it comes to assessing the suitability of training for your staff? It remains a legal requirement for trained first aiders to be available in the workplace, and the

HSE continues to determine the syllabus for workplace courses. In addition, the HSE provides guidance on the number of first aiders required and the depth of training they should receive. However, the burden of responsibility in assessing and determining course suitability now rests with you. You must show that due diligence (reasonable investigation) has been carried out for the selection of a training provider for your organisation. For companies offering OFQUAL, SQA or Welsh Government accredited training, such as Kays Medical, no due diligence is

required. The HSE accepts this training to be nationally accredited and a regulated qualification. To health and safety managers and their employers this offers peace of mind in knowing a course is of suitable quality, reduced burden of responsibility in assessing training providers and reduced costs associated with administration of training for their organisation. In the absence of HSE course approval, OFQUAL approval is the next best thing in providing a measure of nationally recognised course quality. And if nothing else it will save you time and money.

RECORD-BREAKING CONTRACT FOR LOCAL MANUFACTURER – A “ROCKY” ROAD TO SUCCESS

T

ithebarn Ltd are continuing to grow after securing a recordbreaking contract with Chinabased Shandong Qingfeng Animal Husbandry Co Ltd. Tithebarn manufacture mineralised salt blocks at their factory in Winsford, Cheshire. This is a strategic location as they are ideally placed to be in close proximity to the rich source of salt that was once the seabeds, which covered the land some 200 million years ago. Today, that salt forms the base of specialist animal feed supplements that are called Rockies. The blocks are as “hard as rock” which enable them to be fed either indoors or outdoors, regardless of the weather conditions. Every day, the livestock lick

the Rockies, and by doing so they receive a full complement of minerals and trace elements, which enable them to have improved appetites and better feed conversion, which will lead to increased milk and meat production. Tithebarn’s venture into China started back in 2000, and like most inexperienced companies they met challenges, inconceivable difficulties and a few small successes, which encouraged them to persevere. Sales became stagnant at a few hundred tonnes per year. A fresh approach was required, and a new distribution agreement was formed with Shandong Qingfeng Animal Husbandry Co Ltd in 2009. This would prove to be a significant event

in the company’s history. In 2013, record sales of 2,000 tonnes were achieved and the factory was stretched to keep up with production. Mr. Sun, the owner of the China partnership, recently visited the UK to strengthen the relationship between the two companies. With over 1,000 tonnes already shipped to China in the months prior to his arrival, Mr. Sun placed contracts for a further 2,000 tonnes for immediate production and delivery. This major increase in sales of over 50% on the previous year reflects the significant inroads that Shandong Qingfeng are making into the everexpanding dairy sector in China. This year will see 3,000 tonnes of Rockies exported

to China. That is 600,000 blocks (which weigh in at 5 kg), which will be sufficient for 150,000,000 days of animal licking. And with China now accounting for some 25% of all production at the factory, Denis Sowler, Export Sales Executive at Tithebarn, is committed to maintaining and expanding this market as much as possible. In addition, Tithebarn also export to other countries. With his experience of exporting to Bulgaria, Mr. Sowler presented his case study at the Chamber’s “Doing Business in Eastern Europe” event this past March, which was part of the Get Fit for IFB series led by BCC representatives from several Eastern European countries.

Building services engineering skills in greater demand

E

conomic upturn has seen a marked rise in the number of people being employed in the building services engineering disciplines of electrical installation and maintenance, plumbing, heating and ventilating as well as the wider arena of engineering maintenance The leading training provider in all of these fields is JTL, a charitable company that was formed in 1989 and is believed to have been responsible for the training of some three quarters of all qualified electricians currently working. A key route to entry into all these sectors is via apprenticeships so the decision for a business to engage is as much an expression of its belief in the future as is capital investment or spending on a new marketing campaign. Drawing upon public support funding is crucial

in many decisions and JTL works closely with employers to ensure they receive the maximum grant for those aged 16-18, with declining support levels for older ages. Another reason for JTL’s success in this work is because each employer and apprentice is supported by a dedicated training officer who has first-hand experience of working on the job. Employment – quick dismissals without slow repentance

A

common question asked by employers is how to go about effecting a quick dismissal without ending up in legal hot water. There is no substitute for a proper and fair process, the starting point for which in cases of misconduct or poor performance is the ACAS Code of Practice 1 – Disciplinary and Grievance Procedures. However, such a process need not be a protracted one if clear parameters are set from the outset. Employers should have clear written policies explaining their disciplinary procedure. They should heed the following principles, which should underlie that procedure: Raise and deal with issues promptly and do not unreasonably delay meetings, decisions or confirmation of those decisions.

Act consistently • Carry out any necessary investigations, to establish the facts of the case • Inform employees of the basis of the problem and give them an opportunity to put their case in response before any decisions are made • Allow employees to be accompanied at any formal disciplinary meeting • Allow an employee to appeal against any formal decision made. The code sets out appropriate action to deal with misconduct or poor performance. For the first act of misconduct or poor performance it is usual to give an employee a written warning. A further act of misconduct or failure to improve performance within a set period would normally result in a final written warning.

Any further misconduct or failure to improve would result in dismissal. Two recent legal

developments may assist employers, the first relates to “protected conversations” and the second to relying on earlier > continued on page 42

e are major participants at the IFB because of that one simple word International. This is the biggest festival celebrating international business since the Festival of Britain in 1951 and the lure of rubbing shoulders with thousands of visitors from dozens of countries was too much for me to resist. Embassy on 9 June, following this with eight sector focused days and eight market days, a day working with Medium Sized Businesses and conferences on Aid Funded Business and Undersea Technology. We are bringing UKTI people from all over the world to make business connections and providing a state of the art business matching service for IFB delegates, along with a package of support to help each and every one of them to prosper in overseas markets. I am relocating my office to Liverpool during the whole of June and July and I am personally attending many of the events with my

team and speaking at over 30 different conferences. We will have a permanent presence in the Hub with at least two advisors on hand at all times and I will be hosting a weekly Export Clinic. This all matters because international business matters. Exporting firms are 34% more productive, 75% more innovative, spend 3 times as much on R&D and are 12 % more resilient than those who don’t export. Prosperity for the Liverpool City Region, the North West and the North in general will be driven by getting more businesses to begin exporting and encouraging those that are already exporting to get into new high growth emerging markets. If every company that exports now were to enter one new market the effect on the total exports

from the region would be dramatic, possibly growing it by £2bn. That is why we are putting on so many market events, so many events targeting growth sectors and providing networking opportunities for so many businesses all coming together in Liverpool. The IFB starts a fantastic Summer of Exporting that could transform our international trading position. I’m going to be there. I’m excited about being there. Leanvation was founded by Jonathan Day and Tony Downes, who both have a strong background in healthcare, having worked with established surgical product brands, before breaking out to set up their own team, in 2013. The investment from The North West Fund for Venture Capital has allowed the business to recruit a company Chairman and two sales staff, whilst also providing them with the financial support to bring their products to market, both here in the UK and across Europe. The team at Leanvation were keen to tap into export markets from an early stage and began talking to their contacts at UKTI straight away. However, Jonathan explained that existing networks and contacts have also been invaluable, he said: “A number of former colleagues have

also ‘broken out’ to set up their own thriving businesses. By tapping into this network, we have been able to hit the ground running, using their local knowledge of the competitive landscape.” Lisa Ward, Investment Manager at Enterprise Ventures, which manages The North West Fund for Venture Capital said: “Jonathan and his team are experienced managers with strong commercial judgement. > continued from page 40 warnings in taking the decision to dismiss: 1. “Protected Conversations” also known as pretermination negotiations or discussions: Employers will be aware of “without prejudice” conversations, which take place to discuss the proposed termination of employment contracts. But employers may be less familiar with the legal protection which “without prejudice” does, and, in many cases does not, afford. Since 9 July 2013 a new section 111A of the Employment Rights Act 1996 (ERA) has been in force which is intended to provide both employers and employees with a safe space in which to enter into negotiations about the proposed termination of the employee’s employment, without what the parties have said to one another being admissible in any subsequent ordinary unfair dismissal proceedings. There are two important caveats however: first,

such conversations are admissible evidence in other legal proceedings such as whistleblowing or discrimination claims. Second, such conversations will not be protected if there has been “improper behaviour”. This concept is widely defined and includes when the employer puts “undue pressure” on the employee. Examples of undue pressure include where an employer does not give an employee sufficient time to think over an offer made during a protected conversation. It also includes where an employer essentially says that the employee will be dismissed unless s/he accepts what has been offered through the protected conversation. Given the risks these caveats entail, employers should proceed with caution and keep careful notes of any protected conversation. 2. Previous warnings: two appeal court decisions from

2013 address how far an employer can have regard to previous warnings when deciding whether to dismiss an employee for a further misdemeanour. These cases are Davies v Sandwell MBC [2013] EWCA Civ. 139 and Wincanton Group Plc v Stone and Gregory (EAT) UKEAT/0011/12 LA. In both cases the employment tribunal (ET) had undertaken its own assessment of the warnings which preceded the dismissals, and had queried whether the employers were reasonable to have given weight to the warnings in deciding to dismiss the employees. The Court of Appeal in Davies was clear that only in exceptional circumstances should an ET investigate previous warnings and their validity or appropriateness. Such exceptional circumstances might be bad faith or the manifest inappropriateness of the warning. Otherwise the ET should adopt the warning and apply section

98 of ERA to determine whether the dismissal was fair in all the circumstances, including the employer’s reliance on the previous warning. The Employment Appeal Tribunal made a similar finding in Wincanton. Employers should therefore feel confident to take previous warnings into account when making a dismissal decision, and should not feel the need to re-investigate the subject of these warnings (unless they suspect bad faith or something else manifestly wrong about the warning). In summary, employers should keep abreast of the evolving legal developments in the field of unfair dismissal law and ensure that their policies and procedures reflect these. Solicitors or direct access barristers (who may be instructed without employers first using the services of a solicitor) will be able to assist in explaining these developments and advising on the specifics in particular cases.

TNT POST HIRES 500 POSTIES IN LIVERPOOL · Posties to deliver mail in L Postcode using latest technology · Mayor of Liverpool delighted with job creation · Employment Minister – This is excellent news for local area TNT Post, the UK’s second largest private postal operator and main competitor to Royal Mail, is now delivering mail to households and businesses in the L Postcode, following the recruitment of 500 Posties in the Liverpool area. Liverpool joins Manchester and London as the latest location for TNT Posties, taking the number of people hired by TNT Post to 3,000 in less than two years. The company chose Liverpool as its next destination to roll out its delivery service because of the positive approach the City had in welcoming inward investment and the help it gave in targeting the jobs at the hard to reach youth and long term unemployed. The TNT Post Postie’s will complete their deliveries using bicycles. In addition, for the first time, every letter is scanned, with a track and trace service to the door. Mayor of Liverpool Joe Anderson said: “I am delighted that TNT Post has chosen Liverpool as the latest location for their delivery service. Together with our partners, we worked really hard with

them to help target and recruit people with the right skills. I keep saying that Liverpool is open for business, and we are now having real success in attracting high quality firms delivering substantial numbers of jobs.” The jobs have been filled by people who have found it hard to get back into employment. The flexibility of the roles has made them particularly appealing for women returning to work, second jobbers, those balancing childcare commitments and school/college leavers. The company, together with Liverpool City Council developed a Pre-Employment Training course which saw over 170 candidates to establish their suitability for the role. It also worked with Job Centre Plus and Aventa to fulfil the rest of the roles. Rum Warehouse welcomes world class business

iverpool’s most exciting new events space is opening exclusively for the launch of the highly anticipated International Festival for Business (IFB).
