A Lifetime of Exploration

Our editorial theme this month is Explore. Since travel often involves exploring new places that offer new vistas, new cultures, new food and new people, we have some entertaining and enlightening travel articles for you to read. We also engage in dialogue about exploring new personal adventures and new ideas.

Looking back on my personal exploration of places, ideas and lifestyle, I came to the conclusion that it could coalesce into a conversation I might have with my grandchildren. Two of them are either in college or about to start. The other is 11 and as we like to say, “going on 21.” Their transitions either into adulthood or middle school (scarier in some ways than adulthood) are part of their lifetime of adventure and exploration.

I am from a first-generation immigrant family. Staring out on Marshall Street in Philadelphia (that city’s version of Delancy Street in New York), they were factory workers who strived to do better. When you do that, you need to take chances and try things that do not guarantee security, just opportunity. That quest has taken me to nine different cities. Opportunity knocked—sometimes very successfully, sometimes not so. In the process I also learned a great deal about a lot of places. I value that knowledge and experience.

Lately, I have settled down. Twenty years in the Conejo Valley is for me a personal record of staying in one place. However, being here that long does not mean that I stopped exploring. When the opportunity to become a publisher in the Conejo Valley for Lifestyle Publications came up 9 years ago, I discussed it at length with Robin and we added this business partnership to our domestic partnership. At first it was a real adventure. Now it is a blessing.

So, my advice to my granddaughters is nothing ventured, nothing gained Always explore and always grow.

Burnett et al v. the National Association of Realtors et al: Answering Some Questions About the Recent Settlement.

To Answer Some of your Questions

I have had a lot of people ask me questions about the Burnett et al v. the National Association of Realtors et al Lawsuit. I am not an attorney and cannot explain it to you, but if you purchased or sold a property within the dates of February 1, 2020 through February 1, 2024, you may be entitled to a settlement.

I have had clients contact me to tell me that they are concerned about filing for a settlement because they are worried that it will affect me personally, it won’t. The settlement is a lump sum that is being paid by a lot of companies and whether or not you apply for a portion of the settlement does not affect the amount paid out from each company. If less people apply for it – the portion to each person who is entitled to a settlement is larger. I wouldn’t want any of my clients who are entitled to these funds to refrain from applying for it.

How Do I Know if I am Part of a Settlement?

You are a part of the Settlement Class if you: (1) sold a home during the Eligible Date Range; (2) listed the home that was sold on a multiple listing service anywhere in the United States; and (3) paid a commission to a real estate brokerage in connection with the sale of the home.

Real Estate Going Forward

Things are changing. Commencing in late summer, REALTORS® need signed Agency and Broker compensation agreements in the future to represent Buyers in Real Estate. The term REALTOR® is a registered collective membership mark that identifies a real estate professional who is a member of the National Association of REALTORS® and subscribes to its strict Code of Ethics. The National Association of REALTORS® advocates every day on behalf of the nation’s 1.5 million REALTORS® and 75 million property owners fighting for policy proposals intended to make homeownership more affordable and accessible for all Americans. I am proud to be a REALTOR®.

As part of the settlement, the National Association of Realtors has agreed to put in place a new MLS rule prohibiting offers of broker compensation on the MLS to agents that represent Buyers. This would mean that offers of broker compensation could not be communicated via the MLS, but they could continue to be an option consumers can pursue off-MLS through negotiation and consultation with real estate professionals. Offers of compensation help make professional representation more accessible, decrease costs for home buyers to secure these services, increase fair housing opportunities, and increase the potential buyer pool for sellers. They are also consistent with the real estate laws in the many states that expressly authorize them. Further, NAR has agreed to enact a new rule that would require MLS participants working with buyers to enter into written agreements with their buyers. NAR continues, as it has done for years, to encourage its members to use buyer brokerage agreements that help consumers understand exactly what services and value will be provided, and for how much. Real Estate Commissions are now and have always been Negotiable. It’s important to understand that the National Association of REALTORS®’ rules do not require any particular amount or type of compensation. Compensation is negotiable between Brokerages/Realtors and their clients.

NAR also does not set commission amounts. It is up to the listing broker and their client how much compensation if anything to offer a buyer broker.

The compensation structure in which listing brokers offer compensation to buyer brokers for finding a buyer – promotes consumer choice, encourages market competition and boosts access to homeownership.

Buyers, whether experienced purchasers or first-time owners, benefit from professional representation as well. For lower- and middle-income buyers in particular, saving for a down payment can be difficult, and the daunting prospect of buying a house will, for many, be the most significant and complex purchase of their lives.

For these buyers, adding broker compensation on top of closing costs would push the dream of homeownership even further out of reach. This especially would be true for veteran homebuyers because VA loans prohibit them from paying buyer broker fees.

Commencing in June 2024, the proposed revised listing agreements within my MLS shall provide for a new option that Sellers can choose or not choose to utilize.

Concessions in Price: The seller can designate an amount that they will consider offering as potential concessions. Price Type: Where the seller can choose a selection to classify the number as either $ or %. Seller Consider Concessions?: A selection of either Yes or No. If Yes, then the listing will include the auto-populated phrase: “A Seller may consider a buyer concession if made in an offer.”

A SHINING MOMENT OF PHILANTHROPY

Peppers, puppies and pop stars were the order of the evening at Oaks Christian School’s annual dinner auction gala at the Beverly Wilshire Hotel.

The school’s premier night of philanthropy and fellowship returned a second time to the iconic venue with over 500 guests in attendance to enjoy a night featuring Motown legend Diana Ross and celebrity emcee Jay Leno.

Themed “One Shining Moment,” the inspiring evening raised funds for all OCS programs through the live auction, the online auction (setting a record at $126,00 raised), sponsorships and table sales.

“The purpose of tonight is to support students. Oaks Christian is a beacon on the hill and a beacon in the community,” said Head of School Rob Black.

Guests enjoyed a delightful welcome hour reception, followed by a gourmet dinner and student entertainment before Leno kicked off the evening with his punchy one-liners and comedic talent.

Back for another year was professional auctioneer Jim Nye, who pleaded, pressured and prodded guests to open up their hearts and wallets to support the school. The three biggest live auction items were a Los Angeles Rams VIP package for $50,000, a pair of adorable 10-week-old Australian doodle puppies for over $50,000, and several tours of Jay Leno’s Garage (with his classic car and motorcycle collection) which totaled over $50,000.

A last-minute surprise included an appearance by Colby Parkinson, OCS Class of 2019 and newly signed Los Angeles Rams tight end. He helped auction off the first-ever Rams No. 86 Parkinson jersey, much to the delight of the audience.

Also, part of the lively bidding wars were a premium ticket and a private jet to a Red Hot Chili Peppers live performance, a pair of Super Bowl tickets, and exclusive trips to Cabo San Lucas, Maui and the Mexican Riviera.

Before Ross took the stage, OCS students shared their thoughts and talents.

Senior Shelby Snyder, who will major in criminal justice this fall at Boston’s Northeastern University with hopes of joining the FBI, recounted how Oaks Christian has shaped her since her seventh-grade year.

“The person I will become in college is because of Oaks. For that I am eternally grateful,” she said, acknowledging the mentorship and guidance of faculty and the support of friends.

Senior Hannah Lowe, an aspiring vocalist and student in the school’s Institute of Arts and Innovation, thrilled the audience with her powerful rendition of Whitney Houston’s “The Greatest Love of All.”

The much-anticipated finale—Ross’ performance—did not disappoint. With her signature wardrobe and stage presence, Ross wowed the audience with powerful performances of several of her hits, including “Ain’t No Mountain High Enough,” “Stop, in the Name of Love,” “Reach Out and Touch (Somebody’s Hand),” “I’m Coming Out,” “Baby Love” and “Theme from Mahogany (Do You Know Where You’re Going To?).”

Oaks Christian is a college-preparatory, day and boarding school serving over 1,600 students in Grades 4-12. Exploring Life

Have you ever thought about life as your project and really checked in to see how you are doing with it? Is it everything you imagined it would be? Are you living cautiously or are you venturing out and living your best life possible?

Life is about exploring every single day in every way. We don’t have a crystal ball that tells us how or what to do or how our day is going to turn out, but what we do have is our instinct. Some of us have trained ourselves to use it, while others go through life living by accident. Which one describes you? Are you exploring your way through life, knowing that what you go through you grow through? Those experiences are life lessons that if you don’t learn, you will have to go through again, so don’t make the same mistakes.

Life is all about exploring our experiences, personally, professionally and emotionally. Saying yes to invitations is a great way to allow for new experiences and just saying yes to life. Be open and ready! I love making new friends, knowing it will open new doors. I am a YES person, even if I can't do it that day, I will say yes and take a rain check.

Don’t leave any life on the table. Every day presents a new way to make a friend, a memory and to explore another experience; how you react is your choice. Make it a great one!

This sponsorship of the Fourth of July Fireworks comes full circle for me!

When California voters approved Proposition 13 on June 6, 1978, the City of Thousand Oaks announced that they would not hold the 4th of July Fireworks show the following month. Proposition 13 was going to drastically reduce the budget.

As the Fourth of July was one of my favorite holidays. I was determined to keep the fireworks show alive. In 1973 – I was only 23 years old and had been selling real estate in the Conejo Valley for three years. I spearheaded a drive, by going door to door to businesses and other real estate companies on Thousand Oaks Boulevard soliciting donations and raised the $5,000 I was told at the time was needed.

Later that year, Grant Brimhall, the new Thousand Oaks City Manager recognized my efforts with a commendation from the City of Thousand Oaks for my willingness to step up to the plate and save the 4th of July in 1978!!!
