Eat, Drink and Be Merry!

Anyone who knows me is aware of the fact that I like fine wine and fine dining. I also love comfort food that is not necessarily on the approved list of healthy food fanatics. If I did not punish myself at the gym almost every day, I’d probably be shaped like a blimp.

To celebrate our Wine & Food issue, I want to discuss the present state of dining out in our community…or for that matter anywhere else. As restaurants recover from the impact of the pandemic on their businesses, we have arrived at the point of a full-blown dining out mode, much of which has returned indoors. Hopefully, it stays that way and gets even better. Just make your reservation early in the week.

All of that is good news. However, even if we factor in the increase in costs due to inflation, the dinner tab in too many places is much higher than the inflation rate. A USDA Prime New York steak entree that formerly cost $50 should not cost $80. Fine wine by the glass that formerly cost $15 should not cost $25. I could go on and on, but I think you get the picture.

Good news folks—there is a solution! There are wonderful restaurants in our Conejo Valley community that have had to increase prices, but they have kept that increase in line with inflation. Their kitchens have also recovered to pre-pandemic quality as their staffing quantity and quality has continued to improve. None of the following restaurants are our advertisers, so I have no skin in the game. I simply think they are the best and that they deserve your business based on the quality of the food and service and fair prices. At this point, we either prepare a great weekend meal at home (I love to cook) or we patronize the following local restaurants. I am judge, jury and hungry guy.

The winners are Tuscany il Ristorante in Westlake Village, Basta Restaurant in Agoura Hills, Rustico Restaurant in Thousand Oaks (North Ranch) and Geofrey’s in Malibu. Mangia, mangia!

Michael and Zelene partnered with the renowned Guillaume Fabre, a sixth generation French Winemaker to develop the vineyard and make the wine. Fabre says, “Creating great wine is about balance…that unique equation that enables an ideal blend of climate, soil and the grape itself.” The Mizel Estate soil is a fertile mix of clay and sand, which Fabre says brings tannin structure and a certain elegance that is so difficult to find. Leaning into Fabre’s unique Bordeaux-style approach, the Mizel team is producing deep, velvety reds punctuated with fruit and spice that elevate the Malibu Coast AVA (American Viticultural Area) and show what the region can achieve.

ESTATE-GROWN PERFECTION

Mizel’s sumptuous reds are made from 100% estategrown grapes. Cabernet Sauvignon, Mourvèdre, Grenache, Syrah, Petit Verdot and Cabernet Franc contribute their alluring profiles to Mizel Estate’s signature wines—First Impression Bordeaux Blend, Easy to Please Grenache and Smooth Touch Syrah.

The vines are nurtured throughout the growing season under the direction of Estate Manager Hector Ambriz, who leads an experienced team that builds protective canopies, prunes the vines and drops excess clusters to concentrate the flavors in the remaining grapes. Fabre and Ambriz carefully monitor the grapes to determine when to harvest.

The wine making commences in Paso Robles with the crush, press and fermentation in the finest French oak barrels.

“There’s a little bit of an art and science to figuring out which types of oak and how old the barrels should be for each varietal. Guillaume is the expert, and he knows best,” says Michael Fowler.

When the aging is complete, the Fowlers meet with Fabre to taste wine from 30 to 40 barrels and decide which ones

to blend. Michael and Zelene have been blending wine since 2016, and their relationship with each other, winemaker Guillaume Fabre and the wine all come through in the blending process. The pleasing and harmonious results are reflected in Mizel Estate’s superb, limited-production red wines.

Slowly pull up to the front of The Ruse and images of New England may come to mind. The story begins with Ansel Adams who taught Jack Cakebread photography in the 1950s and when the sales from Jack’s coffee table book took off in San Francisco, it bankrolled a down payment for the house and land that exists today. Not a winemaker then, Jack went to UC Davis to learn viticulture and took the advice of neighbor Robert Mondavi to plant Chardonnay.

Stroll through the culinary garden and relax in the courtyard to take in the views with sips of Chardonnay and Sauvignon Blanc. Santa Barbara Lifts Glasses at Wine Fest

What a wonderful time to visit the Santa Barbara Museum of Natural History and at the same time enjoy all of the goodies offered by the many local California wineries like Mizel Estate from the Malibu AVA, Tablas Creek from Paso Robles and Longoria Wines from Santa Barbara. Planning to secure your legacy is a daunting task. We all want to make sure that our hard-earned assets—a lifetime of work and accomplishment—are properly passed down to our children or other heirs. The complicated and shifting landscape of estate planning can make it difficult to ensure that your assets are not subjected to prohibitive and oppressive taxes.

Some of our most prized assets, such as real estate, appreciate over our lifetime. Here in California, that appreciation may be hundreds of thousands, if not millions, of dollars. After real estate is inherited by heirs, those heirs often choose to sell that property. However, those selling inherited property may be subject to capital gains tax on the appreciation of the asset. Capital gains tax can be up to 20% of the appreciated value.

Fortunately, the IRS implements a “step-up in basis” for inherited assets. In general, this means that at the time that the property passes to a decedent’s heirs, it receives a new “baseline” for capital gains tax at its fair market value (what the property would have sold for, if it was sold on the day the property passed to the heir). After receiving a step-up in basis, only the appreciation since inheriting the property is subject to capital gains tax. This is only the difference between the fair market value of the asset at the time they inherited it, and the price they sold it for.

For example, John Doe’s father, David Doe, purchased Casa de Westlake 40 years ago for $200,000.

David Doe named John Doe his heir, and when David Doe sadly passed in 2019, John Doe inherited Casa de Westlake, now valued at $1,200,000. John Doe chooses to sell the home in 2022 for $1,300,000. Without a step-up in basis, John Doe would be subject to capital gain tax on $1,100,000, easily hundreds of thousands of dollars in tax. With a step-up in basis, however, he would only pay capital gains on $100,000, significantly less.

Taking advantage of the step-up in basis is a great way to protect your heirs from egregious taxes. However, receiving the step-up in basis is now more

difficult for families utilizing irrevocable trusts since the IRS passed Revenue Ruling 2023-2 in March 2023. Irrevocable trusts are a tool often used to help “spend-down” assets enabling people facing long-term aged-care or other expenses to qualify for Medicaid or other government-funded programs. “Spending-down” assets is a complex decision that should be discussed with a legal professional. Like most legal tools, it may not be right for everyone.

Before March 2023, assets passed to heirs through an irrevocable trust would receive a step-up basis. However, since IRS Revenue Ruling 2023-2, property held in an irrevocable trust that is not included in the taxable estate at death does not get a step-up in basis. Fortunately, with the help of a trusted legal professional, irrevocable trusts can be structured to be included in the taxable estate so that the assets held within the trust still receive a step-up in basis. This may be a valuable tool to help protect your hard-earned assets and keep your money in the family instead of your heirs paying hundreds of thousands in taxes.

Estate planning can be complex, and there are many different instruments through which assets may be held, and hopefully, protected. Helping you structure a trust is one of the many ways a lawyer experienced in tax and estate law can make sure that your legacy is protected long after you are gone. Without a professional, it can be difficult to understand exactly what will happen to your assets or maximize the inheritance you worked so hard to leave for your children. Failure to set up an estate for your heirs does not mean that you don’t have an estate plan, it simply means you are using the government’s plan.

Q. HOW DID YOU GET STARTED IN THE BUSINESS?

A. About 6 years ago, my “side hustle” from my full-time job as a Department of Defense contractor was barbecuing and smoking meats like ribs and briskets and catering for friends and family. I’m a big believer in quality and when I started hearing about different quality meats, I envisioned barbecuing with better meats. I connected with a source for high-quality meats in Seattle and started a private Facebook group to share and sell the meat online with friends. The group grew from half a dozen friends to more than 4,000 people in a few years! We opened our retail location last October, located at 2260 Townsgate Road #1 in Westlake Village.

Q. WHAT DO YOU ENJOY MOST ABOUT THE BUSINESS?

A. What I enjoy most about my business is when I have customers come back in, after trying something new, and explaining to me how that was the best steak, or the best piece of seafood, or the best pork chop they have ever had—that is what motivates me! Community Conscience Celebrates Mardi Gras
