Partner or Child Support: Partner support is the amount received by a partner after divorce or separation. The central government has different laws regarding support amounts. Child support is received by the parent with whom the child lives. The court decides the amount of partner and child support.
Division of Property: The partners are to receive an equal share of the family property. Family property includes the family home, any properties bought during the marriage, investments, etc. The excluded properties like property purchased before marriage or inheritance of one partner are not divided. Partners choose to enter into agreements to decide the division of the property. The court will uphold the written document in case of any disagreement.
Child Custody: No law states that only a mother is fit to look after the child. Both parents have equal rights to fight for custody. The court looks at the circumstances of various cases before taking a decision. Third parties like aunts, uncles, grandparents can also apply for custodial rights.
