AWARDS CEREMONY A PROUD MOMENT FOR THE LBA The LBA Awards represent the culmination of all the efforts made by our executive board, our directors, and our members. Each year, we take the time to honor those who have gone above and beyond their responsibilities to do their part, and in turn, make the association better as a whole. Aside from the activity within the association, we also take the time to honor those who have made an impact in their respective industries. It gives me great pride to see the talent and dedication within the LBA. I see the executive board and directors putting forth a tremendous effort to expand the association and their hard work has allowed for wonderful changes to happen this year. We can thank our junior directors as well, for stepping up to the plate and involving themselves, while simultaneously becoming the future leaders within our association. I look forward to celebrating with all of our Award nominees and winners at our luncheon. While the economy has not completely recovered - and in turn, our industry – I am still able to see those companies that are out there excelling at what they do best. Our association can proudly boast that we have some of the finest industry leaders right now. All industries are being recognized: Marketing and Public

Relations, Contractors, Financial Services, Law Firms, and many, many more. This recognition is something that I was proud to receive when my own company was nominated – and now I am able to pass along that recognition to a company that has excelled tremendously. Aside from Awards, I would like to take this opportunity to discuss another great achievement of the LBA this year: The LBA Construction and Business Management Academy Charter School. After a successful groundbreaking with Superintendent Alberto Carvalho, school doors opened on August 21. I am greatly anticipating seeing the incredible things that these students will be creating. After an incredible summer featuring the annual LBA Fishing Tournament, I am looking forward to the amazing events coming up this fall: the LBA Awards Luncheon, our October Luncheon, our Golf Tournament, and our Holiday Party with the Kiwanis of Little Havana. I hope that all of you can join us at these events, as we wrap up the year with a bang. Un Fuerte Abrazo,

Bernie Navarro is the current president of the Latin Builders Association (LBA). He was born and raised in Miami and attended St. Brendan’s Elementary and High School. He received his Bachelor’s in Business Administration degree in Finance and Marketing from the University of Miami and his Master’s degree in Government from Harvard University. Mr. Navarro has nearly twenty years of mortgage lending, real estate development and construction experience, including operations, sales and regulatory compliance. He has extensive knowledge and expertise in secondary markets and financial retail operations. He is president and founder of Benworth Capital Partners LLC, a privately held asset-based real estate finance firm focused on residential and commercial properties, headquartered in Coral Gables. Prior to forming Benworth, he established HomeMortgage, which became the South Florida leader in new construction residential mortgages, and ultimately sold that company to the nation’s number-one home lender at the time. Earlier in his career, Mr. Navarro worked in the finance and mortgage areas for Fortune 500 companies such as Citibank, GMAC and JP Morgan Chase. In addition to the LBA, Bernie serves on the University of Miami School of Business Real Estate Advisory Board. Mr. Navarro has led a number of trade missions on behalf of the South Florida business community, working with the U.S. Department of Commerce, the U.S. State Department, the City of Miami Mayor’s Office and the Greater Miami Chamber of Commerce.

Each of these events provides an ideal venue to create and strengthen relationships that will provide a catalyst for your business.

We are in the midst of Awards season. At our Annual Awards Luncheon, we take the time to recognize those amongst us who have put in that extra effort and really taken their businesses to the next level. Some of the faces you will recognize – and some others may be new to the LBA family. Perhaps next year, with involvement and a renewed dedication to the LBA, you will be an award winner!

AS THE NEW SEASON COMES, SO DO THE CHANGES This year has flown past us, and I am completely in awe of all the amazing things that have happened here since I have begun my role here as Communications Specialist and Editor of Proyecto Magazine. As the summer nights gradually give way to cooler temperatures, and beach days are replaced by trips to the pumpkin patch, a certain excitement can be felt in the air. The year may be winding down, but things here at the LBA have not slowed down for an instant. Between revamping the website, hosting the radio show Proyecto Live, and producing the magazine, I have had an incredible opportunity to learn and to create. Now that our website has been completely launched, myself and the technology committee have been dedicated to learning all the new things that the site is capable of. We are constantly searching for new ways to present information to serve you, our association members, best. I personally have been trying to expand on our social media efforts so that we can connect with you in a more personal fashion. I look forward to hear from you on all of our plat-

forms: Facebook, Twitter, and LinkedIn. Apart from connecting digitally, I am looking forward to seeing everyone at our upcoming events, starting with the Awards luncheon. It has been a very rewarding journey for me to be able to meet and get to know many of the important directors and members within our association. Being able to see them recognized as leaders, innovators, and dedicated members of the association is something I am humbled to be a part of. We also have our Golf tournament and the Holiday party with the Kiwanis of Little Havana to look forward to. While the main focus is on these two upcoming events, a brief glance ahead at 2013 provides a positively fantastic outlook: a brand new design for the magazine, an expansion of the website, and many other changes on the horizon. Plus – a whole new year of events! The year is almost over, but there are still plenty of things buzzing around here at the LBA office. Tina Dominguez is the Communications Specialist at the LBA, and the Editor for Proyecto magazine. A Miami native, Tina received her bachelor of arts in Communications at the University of South Florida in 2009. Since graduation, Tina has worked in marketing and communications, as well as freelance writing for South Florida blogs and magazines. Before beginning her work at the LBA, Tina worked for a South Florida start up that created a mobile application targeted to college students as Marketing Manager. She also was an intern at two record labels, including Universal Music Latino. When not working, Tina continues to write for Miami magazines, specifically about music. She can be seen at any of the amazing concerts that hit South Florida. Apart from music, Tina also enjoys volunteering, baking, and practicing Yoga.

Lien Stripping and its Effect on Secured Creditors By D. Grayson Kelly

ly, when the creditor does object, the court will schedule a hearing to determine (a) the debtor’s right, if any, to “strip off” or “strip down” the creditor’s lien and, if necessary, (b) the fair market value of the property.

L

ien stripping affects the rights of secured creditors more than nearly any other tactic employed by debtors seeking relief under the Bankruptcy Code. It enables a debtor to diminish (“strip down”) or eliminate (“strip off”) a creditor’s lien on the debtor’s property to the extent there is insufficient equity in the property to secure the lien. This tool, however, has its limits. Thus, a proper understanding of how, when and the extent to which a debtor may strip a lien is necessary for a creditor to preserve its security interest, if at all possible. A debtor commences the lien stripping process by filing a motion with the bankruptcy court to value the underlying property and determine the secured status of the creditor’s lien. The motion must set forth the grounds for relief including, most significantly, the debtor’s proposed fair market value of the property. If the creditor fails to file a written objection within the prescribed time period, the court will generally accepted the debtor’s proposed valuation and enter an order stripping the creditor’s lien accordingly. Converse-

Until recently, “strip off,” which avoids and removes a creditor’s lien on the debtor’s property, was available only to debtors filing under Chapters 11 and 13. A May 2012 opinion of the 11th Circuit Court of Appeals extended its application to Chapter 7 debtors. Where a creditor’s lien on the debtor’s property is wholly unsecured, i.e., there is no value in the property to secure the amount owed to the creditor after the payment of all senior liens and property taxes, the debtor may eliminate the lien entirely, leaving the creditor with a general unsecured claim. A creditor may only object in this scenario if it believes the debtor has undervalued the property and the true value of the property is sufficient to at least partially secure the creditor’s claim.

first mortgage on the debtor’s property in the amount of $100,000, and the fair market value of property is only $75,000, the debtor may “strip down” the mortgage balance to $75,000; the remaining $25,000 is treated by the bankruptcy court as a general unsecured claim. There is one important restriction – a mortgage lien on a debtor’s primary residence may not be “stripped down” or otherwise modified if it is at least partially secured by the value of the property. Thus, under the scenario above, if the value of the property was $105,000 and the property served as the debtor’s primary residence, the debtor would be precluded from “stripping down” any portion of any second mortgage. To protect its security interest, a creditor should immediately file a written objection to a debtor’s motion to value whenever the debtor impermissibly attempts to “strip down” a portion of the creditor’s lien or when the debtor incorrectly values to the property to the creditor’s detriment.

Unlike “strip off,” “strip down” is available solely to debtors filing under Chapters 11 or 13. If the fair market value of the property only partially secures the creditor’s lien, the debtor may “strip down” the unsecured portion of the lien, resulting in a bifurcation of the creditor’s claim based on the secured and unsecured amounts. For example, where a creditor holds a

RECENT NUMBERS SHOW CONTINUED PROGRESS

s the residential market recovering? July sales of single-family homes and condos in South Florida were 11 percent higher than July of last year. Prices were up about three percent from a year ago, and they marked an eight-month rise in prices. Part of the reason those numbers are better is the loss of inventory. July listings in Miami-Dade were down over 25 percent from last year. Broward’s supply of homes was down almost 50 percent. Some in the real estate business think South Florida is down to a three or four month supply of homes. These local numbers make sense. All across Florida, housing shows similar positive numbers for sales,

prices and supply. Sales nationwide? The National Association of Realtors reports a gain in housing stats of about 10 percent since last summer. Low mortgage rates are helping. It pays to look at other positive indicators. American paychecks in the first half of this year grew the fastest in five years. People are paying off their debts a little better than before—payment histories on car loans, mortgages and credit cards are improving. Retail spending has increased in many categories: furniture, electronics, building supplies, automobiles and sporting goods. In July it was the highest in five months.

MICHELLE PRADERE Michelle Pradere is a Junior Director at the LBA. Michelle serves on the board on behalf of Pradere Office Products, a Hialeah based company. Pradere Office Products is a manufacturer of fine office products, and also represents some of the best office furniture manufacturers in the business. 1.

2. Education: Bachelors in Finance from FIU and currently working on Bachelor’s in Interior design from the Art Institute 3. Where do you work and what is your role there? Pradere Office Products, which is celebrating a milestone this year. We are celebrating 40 years of supplying high quality office furniture and providing innovative office solutions with superior customer service. My role is in business development as I try to find new opportunities in which we can sell our products. I also work very closely with the design and space planning team as my true inspiration is creating the overall look and feel of a space. 4. What aspect of your work do you enjoy the most? I really love working with a team of professionals and having the client excited about the finished product. That creative process is what really gives me the most joy. Getting to work every day knowing that I have an opportunity to use my creative side and at the same time work with clients on a project

that helps establish an internal culture or brand is very rewarding. 5. What is your most important achievement to date (personal or professional)? Along with my sisters, being able to not only sustain the company during these hard economic times, but also realizing growth in both profitability and clients, is something that I am very proud of. 6. What kind of a kid were you? I was very determined and competitive, none of which has changed. I feel the world needs more understanding and compassion, it is very easy to judge from an outside perspective but we should always think what we would do in the position of the other person before we judge. 12. Favorite place in the world? Anywhere in France 13. Name the one thing you cannot do without: Internet, I truly appreciate how so much information is so easily accessible and how helpful and efficient it allows us to be. 14. If you could spend one afternoon with someone, who would that be and what would you do, talk about? My grandfather, who has now passed, was born in 1902. I would always get excited to see him as I knew I would have another opportunity to listen to a new story from his time. I could never get enough of hearing all of his stories as the world was so different then.

A

Maylen Montoto shares her story on how her professional and personal life came together, and how her passion for care was renewed.

t 20 years old almost no one thinks about death. However, for some reason after the age of 35, must of us begin to get apprehensive with this concept, perhaps because we have already experienced parenthood and immediately the wellbeing of our children and their safekeeping begins to take priority in our life

planning.

It was precisely during that period of my life that I got acquainted with a wonderful organization that has provided me with a new perception of life. God´s will through my life circumstances brought me to this experience. In 2001, I was offered a position at the Public Relations and Events department of Catholic Hospice. At that moment I was in need of employment, but the fact of having the opportunity to work for a Catholic organization, made the different in my decision to accept the challenge. At the beginning I was focused completely in being austerely professional regarding my job, but it was not until months after, during my grandfather’s terminal illness and passing that I identified myself with the existent mission of Catholic Hospice. Since then I have grown to love and give my upmost personal and professional dedication to this unique mission. My mother as an only child had to make the difficult decision after the death of my grandmother to place her elderly father in nursing home. Like many families, ours tried to keep our loved one in the family household and care for him ourselves, but it was financially impossible, much less with advanced Alzheimer’s disease. Shortly after entering the St Anne’s nursing home, it became completely evident to us that the disease was wearing my grandfather and the reunification with my grandmother in heaven was imminent. The doctor then recommended in conjunction with the care of St Anne’s the care of Catholic Hospice for him, and to give relief to my mother and the rest of the family. Since my work at Catholic Hospices was entirely focused towards the outside, the community, it was not until this moment that I discovered the true work of dedication, service, compas-

sion and professionalism of the Catholic Hospice patient program. Hospice care is precisely this; we specialized in meeting the needs and fulfilling the aspiration of the patient and family when life is ending. The focus of Catholic Hospice is in the quality of life. It is very difficult to see a loved one in the final stage of its existence. You may quickly notice physical changes such as loss of appetite and mobility, changes in mood or emotional. That’s when we need a helping hand and support, someone to help us deal with our own emotions and conflicts. That’s is precisely when we wonder if we are making the right decisions and need a helping hand, a caring touch from the experts. Catholic Hospice provides relief with medicines to control physical pain, offers crucial home assistants to provide care such as bathing the patient and assist in daily activities, but more important is the spiritual and emotional support through counseling and following the religious traditions of each family, whether Catholic, Protestant or Jewish, under the L’chaim.program. It is definitively not easy to understand this concept, especially for Hispanic families in our community, who often see the hospice as a prelude to death, however once

Captain’s Night

LBA Fishing Tournament /Ocean Reef Club / August 1 - 5, 2012

The first night of the 2012 LBA Fishing Challenge was celebrated with a special Captain’s Night at the Ocean Reef Club. The night was not only meant as the primary celebration, but also was the night to announce the rules. President Bernie Navarro spoke a few words to formally welcome everyone to the 2012 LBA Fishing Challenge. Soon after, Andy Fernandez announced the rules of the tournament to the anglers, and announced the categories that would be judged. The final categories were: first, second, and third place overall, as well as biggest grouper, biggest kingfish, biggest mahi mahi, and biggest snapper. With official business out of the way, the crew members and captains were free to enjoy hors d’oeuvres and libations. Also joining the anglers were their families, who were given the schedule of events for the entire challenge. The cocktail party portion of the evening served as the official kickoff party for the Fishing Challenge.

Fishing Day 1

In the early hours of Thursday morning, all of the teams participating in the 2012 Fishing Challenge met on the docks to prep their boats. Once they were all checked in, the teams left the Ocean Reef Club to begin the first day of the Fishing Challenge. After many hours at sea, the crews rounded up and headed back to the Ocean Reef Club to begin the weigh-in process. Andy Fernandez led the weigh-ins, with the LBA staff keeping track of all the points. At the weigh-in station, many of the teams gathered to see the results of their long day at sea. The main prizes were determined by total weight that each team had overall. Other teams concentrated on getting the biggest fish for the other categories being awarded. The first day was a great day for some teams that were able to establish an early lead, especially in the category for biggest mahi-mahi.

Picoteo Event

LBA Fishing Tournament /Ocean Reef Club / August 1 - 5, 2012

After a long day of fishing, the boats in the challenge came back to the docks. The docks were transformed into the hub for Picoteo, a potluck event that doubled as a challenge. Each boat presented a different food or drink, and guests were able to walk to each boat at the dock to taste what they were offering. Among the dishes served: lobster ravioli, ceviche, and arroz con pollo. Custom made drinks were also served at the event, including a punch and a drink simply known as shark bites. Guests were not only encouraged to try all of the different foods, but were also encouraged to vote. Each guest was able to cast their ballot for their favorite food and drink, and the competition was fierce. As the night began to wind down, guests were able to also enjoy a party on the dock, complete with music provided by Team Cruz Control. At the Awards ceremony, it was then announced that Team Cruz Control won the Picoteo challenge with their lobster ravioli and garlic bread.

Crook & Crook Kid’s Tournament

LBA Fishing Tournament /Ocean Reef Club / August 1 - 5, 2012

While the adults had plenty of events to attend, the Junior Angler Fishing Tournament was solely for the little ones who were at the 2012 Fishing Challenge. Bright and early on Friday morning, all of the junior anglers lined up with their rods on the Ocean Reef docks. The rods were courtesy of Crook & Crook, and each participant was able to keep their rod after the challenge ended. After some help from the parents to bait the hooks, the junior angler challenge began. The 2012 Junior Angler challenge was one of the biggest in LBA history, with over 40 children participating. Over the course of the two hour challenge, the junior anglers enjoyed the morning catching plenty of fish with their new friends, while parents watched over. Each angler enjoyed catching a fish or two, but the grand prize winner was Ava Gonzalez, who caught a total of five fish.

TD Bank Beach Party As the sun set on Friday night, the festivities went from the docks to poolside. After enjoying a Golf Tournament and Kid’s Fishing Tournament earlier that day, everyone was looking forward to kicking back. All of the families attending were able to begin the evening with a pool party, which all the children were fans of. The party eventually went beachside, as a full buffet was served right by the ocean. While guests savored the delicious barbecue style food, they also enjoyed the sounds performed by a steel drum band. The party went will into the evening, as all who attended the event enjoyed the ocean breeze and relaxed attitude.

Saturday morning brought forward the second day of the fishing challenge, and once again the crews lined up early at the docks to begin. With this being the last day, the teams were eager to go out to the water and catch all they could. While day one had left certain teams empty handed, day two was full of promise, especially in the categories for biggest grouper and biggest kingfish. In the early afternoon, all of the teams came back to weigh in their final catch of the challenge. As with day one, Andy Fernandez was the official chosen to do all the weighins in conjunction with the LBA staff. After the final weigh in, the total weights were collected, and the LBA staff began putting together the final numbers. Later that evening, the top winners in the overall and biggest catch categories were announced at the Awards Ceremony Dinner.

The 2012 Fishing Challenge culminated in the Awards Ceremony Dinner. After days of fishing and other events, guests were able to kick back at the Awards Dinner at the Ocean Reef Club. Guests enjoyed a buffet dinner, featuring a lechon. At the event, the ceremony featured the winners of the Crook & Crook Junior Angler’s Fishing Challenge, where all participants received a medal. The grand prize winner was Ava Gonzalez. After the children received their awards, the main awards were given out, starting with Picoteo. The best overall went to Cruz Control with their Lobster Ravioli, Meatballs, and Garlic Bread. Afterward, the overall prizes were distributed, starting with third place overall winner, Team Your Agent. Second place overall went to Team SEES, and the grand prize winner went to Team Formcrete. Biggest Kingfish award went to Cruz Control, while Biggest Snapper went to Team SEES. Team Rockstar won for Biggest Grouper, and Biggest Mahi Mahi, at 13 pounds, went to Team Formcrete. After the awards were distributed, everyone was able to enjoy a lively party with plenty of dancing.

They provide pain control and symptom management, as well as spiritual and psychological support to over 550 patients and their bereaved families daily, regardless of race, religion, age, gender, ethnic background, handicap, diagnosis or financial resources. Catholic Hospice also sponsors programs such as the L’chaim Jewish Hospice Program, Stars Program a Hospice Care for children, Camp Hope, a bereavement camp for children as well as other bereavement support groups. The tournament registration fee is $185 per player and $700 for a foursome. The fee includes lunch, beverages, greens fees, goody bag, shirt, cocktail reception and prizes. Octavio Hernández, Vice Chairman, President and CEO of US Century Bank Announces his Retirement Octavio Hernández, Vice Chairman, President, and C.E.O. of U.S. Century Bank announces his retirement. “After much deliberation and soul searching, I informed the Board of Directors of the bank of my decision to retire,” said Hernández. “As a founding member of U.S. Century Bank, I dedicated much time and effort to US Century Bank for the past 10 years, particularly during these difficult economic times, but it has taken its toll on my personal life and I want to make it up to my family,” he added. “As a founding member of U.S. Century Bank, Mr. Hernández’s leadership and vision was pivotal to the bank’s success and growth in our market. We appreciate the many years he dedicated to the institution and accept his decision to retire,” said Ramon E. Rasco Chairman of the Board of Directors of U.S. Century Bank.

U.S. Century Bank Announces Carlos J. Dávila as New President, C.E.O. and Director The Board of Directors of U.S. Century Bank has appointed Carlos J. Dávila as President, Chief Executive Officer and member of the Board of Directors. Chairman Ramon E. Rasco made the announcement yesterday to bank management and staff.

“When Octavio Hernandez, current bank president, informed us of his intended retirement several months ago, we began a thorough search for his replacement. After interviewing several candidates, we firmly believe that Carlos has the experience to lead U.S. Century Bank in the right direction,” said Ramon E. Rasco. “Hernández’s support and dedication was instrumental to U.S. Century Bank’s success, but we understand and respect his decision to retire at this time. It is our commitment to overcome the challenges the bank is facing and protect stockholder value,” Rasco added. Carlos J. Dávila is a native of Puerto Rico with 25-years-banking experience. From 2007 to 2010, he was Chief Operating Officer of Westernbank in Puerto Rico; a local banking institution with $14 billion in assets. During his tenure at Westernbank he dealt with many of the same challenges currently affecting U.S. Century Bank: a high level of non-performing assets, heightened regulatory enforcement and the need to raise capital. Previously from 2003 to 2007, Dávila served as President of Florida and Puerto Rico for Citibank where he managed the expansion of its branch network. Under his leadership, the institution grew from 25 to 45 branches throughout the region. During this time, he resided in South Florida and participated in a number of business and non-profit organizations. “I have heard many good things about U.S. Century Bank and about its

leaders and management staff. The bank’s brand is very well-recognized and it has a good reputation throughout this community. In the months that follow, Octavio Hernández and I will work closely with management to ensure that this is a smooth transition for everyone,” said Dávila. “Having met the staff of U.S. Century Bank, I am confident that we have a talented group of professionals who are eager to overcome the challenges we face. Along with the bank’s Board of Directors, we will work to raise capital, reduce the level of non-performing assets, meet all the requirements of the Consent Order and return the bank to profitability. These are the goals we will work toward as a team in the coming months,” he added. Established in 2002, U.S. Century Bank is one of the largest community banks headquartered in Miami, with assets of $1.2 billion. Through its network of 24 branch locations and its online banking platform, it offers its customers a wide range of financial products and services. U.S Century Bank is the recipient of the 2008 Beacon Award in Financial Services and a 2008 and 2009 Outstanding Minority Business Award from the Greater Miami Chamber of Commerce. It has also received numerous accolades from the Coral Gables Chamber of Commerce, South Florida Hispanic Chamber of Commerce, The March of Dimes and the Minority Chamber of Commerce.

QUE PASA? Bueno, pues aquí estamos de vuelta después de un breve descanso este verano. Estuvimos festejando y pasándola muy bien especialmente en Ocean Reef para el torneo de pesca. Tenemos muchas cosas que contar ya que ha habido muchos acontecimientos. Nos enteramos que la cigüeña le va a hacer visita otra vez a Michael Alvarez y la bella Giny Santamaria. Estamos muy orgullosos de nuestro buen amigo, el alcalde de Sweetwater, Manny Maroño que es el nuevo Presidente del League of Cities. Felicidades! Y hablando de a zona de Sweetwater, el comisionado de Miami-Dade. Pepe Diaz celebro su cumpleaños visitando su distrito para revisar los daños causados por Isaac. Parece que fue lo suficiente para ponerse las botas. Están muy guapos los dos…
