The Supervisor of Elections office might not move but instead stay in Bartow, the elections supervisor said this week. “The absolute truth is, we don’t have a concrete plan,” said Lori Edwards, the supervisor of

elections. “When I met in the work session I should have said we don’t know, but I was trying to give answers (to commissioners’ questions). I will study this and be responsive to the concerns of the citizens of Bartow.” On Tuesday, the Polk County Commission voted 4-1 to spend

$1.19 million for a building in Winter Haven intended to be for the Supervisor of Elections. The building would help satisfy a study done 10 years ago that the office needs a minimum of 45,000 square feet. The office in Bartow on the corner of Summerlin Street and Broadway is 18,000 square feet. This

This past Tuesday, Care 2 Dance put on a performance at the Rohr Home. As part of the program, Sutton and Johnston, as well as Betty Ski, demonstrated a number of ballroom dances, from foxtrot to waltz to east coast swing to rumba, cha-cha-cha and even the polka. (Note, this reporter also participated in one dance routine, the foxtrot.) The program was brought to the Rohr Home by its activities director, Pamela D. Jones, who had called the Sutton Law Firm on a matter. “Mona’s the one

who told me about Care2Dance,” said Jones, who until then was not aware of the program. “It was one of those perfect accidents.” Mona is Mona Beedle, receptionist at the Sutton Law Firm. As part of the program, after the troupe, it gets residents dancing. At the Rohr Home, many of those who attended were in wheelchairs; some were bedridden. No matter, Care2Dance members, as well as Rohr Home staff, got a number of the residents dancing. Smiles came to the faces of those dancing, as well as to those who chose to simply observe. Others engaged in conversation with the dancers. “They got to participate. This was awesome.” said Jones. She added she definitely would have Care2Dance back. “As soon as we can.”

Both members of the Care2Dance troupe, and Rohr Home residents and staff get onto the dance floor for one final dance. know, I took up ballroom dancing in earnest approximately a year ago, although I had taken lessons intermittently in the prior months, and I have Debra Sutton to thank. It’s a long story I have recounting ballroom dancing after having done an article on her hobby as a competitive ballroom dancer on the pro-am level (she being the amateur). This past Tuesday was the first time I participated with Care2Dance, although several weeks earlier I had attended an exhibition at another assisted living facility. In both instances, the looks on the faces of those who attended were heartwarming. More than once I would catch that “look of recognition” as a longterm memory would

come to the forefront of someone, prompted by the music and, I would tend to believe, the dancing itself. However, the joy on their faces when we got them on the floor to dance — even those wheelchair-bound (and a couple who were bedridden) — was a beautiful sight to behold. I don’t know who smiled more, me as I danced a foxtrot with Debra Sutton, or espying the joy Care2Dance brought to the residents of the Rohr Home. Care to Dance provides the program for seniors wanting to improve cognitive skills, balance, etc., and is in association with T.A.P. (The Alzheimer’s Project). Fast government is seldom good government

In the private sector, the ability to make fast decisions — often in secret — and implement them quickly can be an asset. In government, quite the opposite is true. While an entrepreneur risks his own money, and perhaps money put up by investors, government is steward of taxpayer funds, paid, often begrudgingly, by citizens who have no choice. Government owes it to the taxpayers to move with caution, and to seek to build consensus among its “investors.” When this principle is violated, and government action is taken in haste, the result is seldom good government. Such, in our view, is the case with last week’s decision by the Polk County Commission to spend $1.196 million in tax funds to buy a new headquarters building south of Auburndale for the Supervisor of Elections. As we said in an earlier editorial, we think this decision flies in the face of a requirement of the Florida Constitution that the “principal offices” of county government be located in the county seat. There are five constitutional officers in county government, including the SOE. If hers is not a “principal office” of county government, we cannot imagine what is. Elections Supervisor Lori Edwards said she figured that if she left two employees in Bartow, that would meet the “principal offices” mandate. We disagree. Supporters of the decision say it has been discussed openly at county commission meetings. County

Our Viewpoint Commissioner Melony Bell, in whose district Bartow is located, said the first she knew about the proposal to buy the land was July 30. That is the same day this newspaper learned of the proposal, discovering it summarized in a single sentence on the second page of the five-page county commission agenda for its Aug. 4 meeting. Neither the Bartow City Commission, the Bartow Chamber of Commerce, nor Main Street Bartow Inc., all major players in the health of downtown Bartow, were aware of the proposal. Perhaps more significant, none had been asked for ideas or assistance in locating more suitable quarters for the SOE office in the county seat. For whatever reason, this million-dollar proposal with a major impact on the county seat stayed under the radar. A request from the city at Tuesday’s county commission meeting to delay the decision until local officials could become involved found little support from the county. The die had been cast for “government in a hurry.” Commissioner Bell, who proudly and correctly states that while she is elected from District 2, she represents all of Polk County, cast the only vote against this hurry-up purchase. We commend her for her action. After this decision was reached, a bizarre Florida law, Florida Statutes 138.12, passed in 1973, has been

cited that allows a county commission, after two public hearings, to redefine the “county seat” as being an amorphous blob that recognizes no municipal boundaries. It allows commissioners to draw random lines anywhere on the map that they choose and declare the area thus defined to be the “county seat.” Had this been the county’s above-board plan for justifying the relocation of the SOE office, the time to have pursued it was before the decision was made to move the office. That would have put the public on notice as to what was afoot. As absurd as we think it is for a county commission to create a “county seat” whose boundaries are so meaningless that they can be changed for the convenience of property purchases and office relocations, it appears that is the law. That does not change the fact that the commonly understood definition of a county seat is a city at which the headquarters — “principal offices” in the words of the Florida Constitution — of county government is located. The most charitable thing that can be said of the decision to spend $1 million-plus to relocate the SOE’s office is that it was made in haste and without consultation with the key stakeholders in the “real” county seat. This bad decision can be corrected simply by delaying implementation of this ill-conceived exercise in fast government. We urge the County Commission to take that action. Better solutions can be found, and there are leaders in the county seat willing to help find them.

Right wing should stop its nonsense about Medicare America’s doctors have long since made their peace with Medicare, which marked its 50th anniversary last week, but its oldest and most implacable enemy, the ideological right wing, is still bent on destroying it. If you were a politician who shared that purpose, how might you go about it? You’d harp on how the trust fund is running out of money, with no possible solution except to deny Medicare to those who don’t already have it. You’d exempt those already on the rolls, but those who aren’t would have to settle for something less. If that sounds familiar, it’s a rephrasing — but not by much — of what Jeb

Early education Today I am going to talk about the importance of education from an early age. Every year is important from the parental period through age five. Those years provide children with experience that lead to the development of a broad base of knowledge, cognitive skill, and important social-emotional skills. These are the years for the brain to rapidly grow, when the child’s brain has reached 90 percent of its adult size. Without adequate support from good mental health and parental care even early education can fall behind in their academic and social skills before they

even reach kindergarten. The first three years are the most important for children. Their grasping power is very high in those years. We are so lucky that we are in a country where children are provided with free education until high school. I am addressing parents to let them know the importance of the VPK Program. The program is completely free. Let me tell you why it is important being in a VPK class. It’s three hours from Monday to Friday The program doesn’t only teach your child academics but much more. Daily opportunities are

there for language, literacy, science, math, block play, dramatic play, arts & crafts, music and a lot more. VPK is designed to help children in Florida develop the skills they need to become good readers and successful students. It includes high literacy standards, strict accountability, appropriate curriculum, substantial instruction periods, manageable class sizes, and qualified instructors. What children learn in VPK helps them for kindergarten? Children will be prepared when they enter kindergarten, but on it’s own it cannot ensure

the children will have all they need to succeed in school. Children also need experiences outside of class that expose them to language and learning. Good schools are prepared to foster their learning. For that parents need to be aware of the importance of education. Parents who love, nurture, and teach their children are the most important of all. I believe that all parents should take full advantage of the VPK program and I look forward to get more children in school. SWATI PATEL Winter Haven

Florida organizations show support for Planned Parenthood In response to the recent video smear campaign aimed at discrediting Planned Parenthood, 39 Florida organizations representing doctors, working families, students, women’s advocates, retirees and religious leaders, and with supporters stretching from Key West to Pensacola, have stood up for the immense contribution Planned Parenthood has made toward expanding and protecting reproductive health care access in Florida. Planned Parenthood has been an essential healthcare provider in Florida and across the country for nearly a century. It provides life-saving cancer screenings, testing and treatment for HIV and other STDs, well woman exams and contraception, as well as abortion care. But the extremists behind the false attacks on Planned Parenthood, and politicians such as Gov. Rick Scott and Sen. Marco Rubio who are aligned with them, would like

receiving the benefits. But we need to figure out a way to phase out this program for others and move to a new system that allows them to have something — because they’re not going to have anything.” (Emphasis supplied.) Medicare’s long-term solvency does need to be assured, and there are responsible suggestions for doing that. But the scare tactic those italicized words express is grossly irresponsible. So is the strategy of splitting off the senior vote. It’s as if Bush thinks we won’t give a damn whether our children and grandchildren get what should be theirs so long as we keep what’s ours. That presumption of selfishness is personally insulting. What does he want? Generational warfare? Let’s get some facts straight: Medicare is an insurance program into

In response to this manufactured controversy, Rubio has stated that Planned Parenthood shouldn’t “receive a penny of taxpayer funding.” Meanwhile, Scott ordered an investigation into Planned Parenthood health centers in Florida, despite Planned Parenthood not having an active tissue donation program in Florida, the crux of the manufactured controversy. Furthermore, although some Planned Parenthood organizations in other states participate in these programs, they are completely lawful and follow the ethical guidelines of medical experts – not politicians. Not only is the practice of

which nearly everyone pays or has paid premiums. The benefits are reserved, however, for the 46 million who are over 65, along with 9 million disabled younger people. Medicare’s legal commitment is not just to “those that have already received the benefits,” but to everyone who is paying for them. To the extent that Medicare is drawing down its trust fund, a younger generation is already partly subsidizing an older one. Tell them often enough that “they’re not going to have anything,” and maybe they’ll believe it. There’s time to do better. The Hospital Insurance Trust Fund is now expected to be in the black until 2030, four years later than before Obamacare began to yield economies. Even then, income from payroll taxes would suffice to pay 86 percent of benefits, according to the Medicare Board of Trustees. That’s 15 years to enact responsible

Stem cells, and fetal tissue specifically, are used for important medical research into debilitating diseases such as Parkinson’s disease, diabetes and Alzheimer’s disease along with research to reduce birth defects, treat spinal cord injuries and more. Those behind the attacks on Planned Parenthood won’t mention those benefits because their motivations are purely political. If they were truly committed to reducing the rate of abortion, they would support proven programs such as Planned Parenthood’s work to provide comprehensive sexual education and to increase access to contraception. This past week, Hart Research Associates announced the results of a nationwide poll that showed overwhelming opposition to Republican efforts to sabotage Planned Parenthood in

solutions that cover the other 14 percent. Not all proposals are or will be responsible. Bush seems to like Congressman Paul Ryan’s voucher scheme, or has said so in the past. (The official government terminology is “premium support system.”) People would buy their entire coverage in the private market, as many of us do now to supplement what Medicare pays. There would be a federal voucher pegged to regional costs of service. The benefits to the Treasury would be relatively modest, and as, the Congressional Budget Office notes, “highly uncertain.” What’s very certain is that everyone would pay more out of pocket, The great devils in the details are that once Medicare is no longer a single-payer system, cost control becomes the consumer’s responsibility and Congress can more easily get away with contributing less money. Medicare is one of the most successful government programs ever. It

Those who are using such baseless attacks to condemn Planned Parenthood are rewarding the deceptive and illegal behavior of fringe extremists. An investigation is clearly warranted, but the target of the investigation should be the organization that illegally hacked into Planned Parenthood’s computer system, falsified documents to the IRS to create a fake charity, and surreptitiously recorded and released the heavily edited, deceitful videos.

has prolonged the lives of millions of people and saved countless numbers from bankruptcy. Its low administrative overhead puts the commercial insurance industry to shame. Its weakness is in spending too little to detect and prosecute fraud. But Medicare’s overall success is what keeps it high on the right wing’s hit list. As Paul Krugman explained it in The New York Times last week: “The real reason conservatives want to do away with Medicare has always been political: It’s the very idea of the government providing a universal safety net that they hate, and they hate it even more when such programs are successful. But when they make their case to the public they usually shy away from making their real case, and have even, incredibly, sometimes posed as the program’s defenders against liberals and their death panels.” It’s the same motive that commits an entire political party to trying to destroy the Affordable

For years now, politically motivated extremists have shown they will stop at nothing to intrude into women’s personal medical decisions. They continue to intimidate women and doctors, acting on their goal of an all-out ban on safe and legal abortion. Fortunately, the U.S. Senate defeated the bill to defund Planned Parenthood in its first vote brought on by this latest attack. Florida Sen. Bill Nelson is to be applauded for siding with women and science, and Sen. Marco Rubio and those who would insert government between a woman, her doctor, her family and their faith, should be opposed at every turn. Fortunately, dozens of Florida organizations are doing just that and are standing up loud and proud in support of Planned Parenthood. Health Care Act. Every enrollment increase is bad news to the Koch Brothers and their allies. In their libertarian outlook, any government program that helps people deprives them of liberty. I don’t doubt that some of them truly believe this, although with others it’s simple selfishness coated with snake oil. Their remedy for everything, Krugman notes with scorn, is “the magic of privatization.” It’s magic in this sense: They’re the wizards of ooze. ••• Another anniversary passed with less notice last week. It was the 101st birthday of Frances Oldham Kelsey, a medical doctor and pharmacologist to whom uncountable thousands of baby boomers literally owe their lives or good health. In 1960, during her first month of employment at the Food and Drug Administration, she resisted heavy pressure from a pharmaceutical company to allow the

sale of thalidomide, which was being widely marketed in Europe as a wonder drug for insomnia, headaches and morning sickness. She questioned whether it was safe. There was soon proof that it wasn’t. Children all over Europe began to be born with missing arms or legs, or flippers where limbs should be, or with serious internal injuries. Thalidomide’s effect on early fetal development was pernicious. As many as 20,000 children were harmed. Many died. That it didn’t happen here was thanks to Frances Kelsey, who received a medal from President John F. Kennedy for her courage under pressure. She lives in quiet retirement at Chevy Chase, Md. Her district covers Bartow. “Citizens didn’t have time and it looks like a done deal … the building is a done deal.” A handful of Bartow residents showed up at Tuesday’s meeting and spoke about the impact it will have, urged the BOCC to delay the vote and that Bartow should have been consulted on looking for land. However, the vote was not delayed. A concern Edwards has is moving her operations as quickly as possible as the Presidential primary election is only six months away. “The elections office is under a big time crunch with the 2016 election cycle,” she said. On Tuesday, Edwards told commissioners she would relocate her main staff to the Winter Haven site and have offices in Bartow where the county parks and recreation department

However, as she said later this week, that plan is not concrete. “I do not have a concrete plan on which staff will be in which office,” she said. The Supervisor of Elections Office has 22 people working in there, 20 of the full-time employees. With the hue and cry that people had not had the time to protest the potential move of the election headquarters from the county seat, there may still a time people can do that. Craig told commissioners Tuesday afternoon after they voted to buy the land that in Section 138 of the Florida Constitution, two public hearings have to be held if the main office of any constitutional office moves. A corridor would have to be drawn to make the new building part of the county seat. With that in mind, Jeff Clark, the executive director of the Bartow Chamber of Commerce, is putting together a cadre of people to fight the move of the main office. “We are going to meet and get a group of us to move forward with this,” he said. The move of the main office of the Supervisor of Elections, though only 22 workers, can have a big economic

impact on the city, he said. “To me,m the economic impact is there,” he said. “Our economy in Bartow is very tied to the county and state workers who spend their day working here and it goes far beyond them going somewhere for lunch.” He pointed out commuters use the dry cleaning stores, gas stations, supermarkets, take cars in for service, have their hair done and list goes on. While with far fewer workers in town than when the sheriff’s office moved in 2010 (22 in the Supervisor of Elections Office compared to more than 400 in the Polk County Sheriff’s Office) Clark said the impact would still be large. “If you take the county out of Bartow there would be a huge effect,” he said. Main Street Bartow Inc. Executive Director Laura Simpson said while she was not living in Polk County when the Sheriff’s Office move five years ago, she still hears from business people almost immediately what impact it had on them. “If you look deep enough you’ll see the economic impact,” she said, adding there was also the point of community pride. That extends even to election day, which if the main office moves to Winter Haven, counting votes would be done there.

“On the votes being county here, there is a lot of excitement happening. There are the smaller things … the sound bites would identify Bartow, so there would be an ID loss.” Her concern is also one of precedence. If the Supervisor of Elections Office moves its main center to Winter Haven, that would be the second constitutional agency in five years to have moved. “One (move) is a situation, two is a precedence.” She said people in town should concern themselves with that and even talk to other agencies about what their needs are now and what they will be in the future. “We have to be less reactionary and more proactive. “Let’s go to Joe Tedder (the tax collector) and Marsha Faux (the property appraiser) and let’s start the conversation.” She said one of the biggest concerns, too, is the lack of communication. She said of the properties looked at in Bartow, if there were problems, people in the city could have helped. “Had they reached out about the process, we could have helped,” she said. “There’s more we could be doing.” She said Bartow people should have been at the table.

The recipes tested Thursday will be on breakfast menus in September says School Nutrition Coordinator Jenna Kaczmarski. She said that there were three chicken and waffles recipes, one southern breakfast bowl and a Cajun breakfast bowl recipe tested and prepared at the Thursday session. The recipes will be voted on by students and the winning selections will become permanent additions to the menus, Kaczmarski said. “Not only will kids get a chance to say which ones they liked, they will also get a chance to enter a drawing to win tickets to a concert featuring one of the hottest stars on the pop music scene,” she added. There will be 10 winners of two tickets each to attend the October concert in Tampa. Most of the breakfast and lunch meals provided at Polk schools are free, based on the federal economic standards of the area in which the schools are located. Kaczmarski said those students in the few schools that don’t provide the meals free will only pay $1 for breakfasts. Ramping up menus is part of the district’s five-year plan to lure more students into both the breakfast and lunch programs, explained Kaczmarski. “We have already passed our goals for increasing

For Scott, he recounted how he thought he had died and gone to heaven when he arrived in Florida from Indiana, discovering how passionate people are about football, and that one of his first experiences once arriving was the Cryin’ Towel. He did tell a joke on Bartow High School coach Jake McCrae. According to Scott, McCrae was on the university’s campus when he came across a talking frog. According to Scott, the frog told McCrae that if he kissed it, the frog would turn into a beautiful princess and make passionate love to him for eight straight days. Instead, McCrae put the frog in his pocket. He’d rather have a talking frog. When Dodge spoke, he referred to all the orange and blue clothing many people wore; the colors of the Bartow Yellow Jackets, it is also those of the University of Florida, and Dodge — who went on to play in the NFL and was on a Super Bowl championship team — was a Florida State University graduate. “All this orange and blue, I feel like I’m in The Swamp,” said Dodge. As for this year’s prospects, Mulberry faces an uphill challenge, as it does every season. “We’re trying to rebuild and rekindle tradition.” That, he said meant bringing back pride and passion and he likened it to the birth

Tate began his coaching career in Bartow as an assistant before he reached the ranks of head coach, including a stay in Bartow. He cited his father, who was also a football coach and pointed to Dodge. “The greatest compliment you can give a player is to ask him to come home,” said Tate. He then began leavening the evening’s mood telling a joke about two mischievous brothers whose mother takes the younger one to be lectured by a rabbi who asks the boy what does he know about God. The little boy, who never replies, is so frightened that he rushes out and runs home and into his brother’s bedroom. “We’re in trouble now. God’s missing and they think we did it.” The laughs began in earnest with Fort Meade coach Jemalle Cornelius,

But aside the Mr. Bartow (Jeff Roslow) Contest, this karaoke thing sounds pretty cool, so go ahead and try it out yourself. Sean Serdynski is hosting it, so you know it’s going to be entertaining. The auditions are being held three times, all at 6 p.m., Tuesday, Wednesday and Aug. 18 — that’s a Tuesday — at the

One of the first was that of a request to buy fireworks to shoot off at home games and he was told it would be a waste of money. “The only time we’re going to shoot the fireworks is when you score a touchdown,” said Cornelius. Another joke involved his wife insisting they move to a house closer to the football stadium, and he said they did move. One day he asked his wife why she wanted to live in a house where it was just a short walk to the stadium, and she told him that way she could personally apologize to the fans after each game. A similar joke about moving told earlier involved signs on his front lawn. “The signs said, ‘Leave now.’” Plus his three children were not immune. He announced that his three children are enrolled in Bartow schools. But before he enrolled them in Bartow, they attended schools in Fort Meade, and it was a bad situation. Finally, one day one of his sons told him why. “If you don’t win on Friday, they don’t feed us on Monday,” said Cornelius. As for how awful the Fort Meade Miners football team is, they are usually the visiting team when other high schools hold their homecoming game or senior night. The Miners are so bad that a team from Halifax that went 0-11 last season invited Fort Meade to be the visiting team for their homecoming game. Bartow High School Jake McCrae, the last to take to the stage, immediately launched into a jibe against Cornelius. He asked Cornelius why he had moved his family, to

Here’s some of the recognition, Mr. Bartow’s (Jeff Roslow’s) name will go on the traveling trophy for a year, a newsletter link to your company’s web site on Main Street’s web site, good parking at the Halloween and Christmas parade (I like those) and a little something on the car that says Mr. Bartow (Jeff Roslow). The winner can emcee the quarterly Morning on Main meetings. The first one is Sept. 10. It’s a time when Main Street business owners can get together for breakfast before going to work. It’s at 8 a.m. — at Terri Lobb’s place in the old hospital at the corner of Main Street and U.S. 17. The winner will also be recognized at all special events and ribbon cuttings (next Friday, by the way, is the Comic Book store and I hear Wonder Woman is going to be there). And, the last bit of recognition on the typed out form for the contest from Main Street is a good one. Forever noted for service as Mr. Bartow (Jeff Roslow). So this is a winning deal for all of us, so go ahead and vote, even for Steve if you feel you must, but help me prove my point, for every dollar you spend on him, vote twice for me. He then praised the Kiwanis Club for reviving the Cryin’ Towel and urged it become an annual event once again. “They’d better do the Cryin’ Towel. My wife’s getting tired of my jokes.” Being a high school coach isn’t easy and coaches often have to supplement their income. One way used to be serving as driving instructors for high school students. However, due to cutbacks, driver’s ed has been eliminated in many schools. “I’m sorry they got rid

of driver’s ed, because sex ed needed the cars,” quipped McCrae. As for how bad Bartow is, he minced no words, but there was a bright spot. “Last year we had the leading tackler in Polk County. Unfortunately, he’s our quarterback.” McCrae didn’t let up on his quarterback, who needs two hours to watch “60 Minutes.” Worse, when looking over college brochures, his quarterback said he wanted to go to San Josie State. McCrae had to explain that it was pronounced San Jose, that it’s Spanish and in Spanish the letter “j” is pronounced as if it was

an “h” sound. Once that was explained, McCrae said he would arrange a campus visit and asked the quarterback when did he want to visit. “Hune or Huly.” As funny as McCrae was, in the end, though, he fell inches short of the goal line and Cornelius was selected the overall favorite. Of course, it might not have hurt that two of Cornelius’s assistant coaches also are brothers who played on state title Fort Meade teams and who both currently are Polk County Sheriff’s deputies and accompanied Cornelius to and from the stage.

Gareth Washington estimated that approximately 2,000 people were present Saturday, Aug. 1, at the Tom E. Walker football field, located at the park on County Road 555, and those were just the spectators. It did not include the children ages 4-15 who came to play youth football at the annual jamboree the Mid-Florida Football & Cheerleading Conference holds to kick off its season. Washington is involved with the Bartow Yellow Jackets youth football team as well as an officer with the district. This was the second year of the jamboree in its current format, which also served as a fundraiser for the host team, he said. A total of 10 sites, including the one in Bartow, hosted the 43 organizations that sponsor teams. In addition to the Bartow Yellow Jackets, the teams that Players and coaches go over last minute instructions prior to taking the field. participated were the Lake Wales Steelers, Polk City Panthers and Lake Alfred Raiders. The reason for the change in format came about as a result of what occurred two years earlier. At that time, the jamboree was held at fields located near Spirit Lake off Recker Highway in Winter Haven. The turnout, which Washington believed neared 70,000, had an adverse impact. “It tied up traffic in all four directions,” he said, adding that by splitting the venues into 10 areas the event has become more manageable He’s broken free! He’s at the 40! He’s at the 30! He’s at the 20! He’s going in, all the way! Touchdown! and accessible. The season lasts 10 games and ends Oct. 3, he said. It is followed by a three-round playoff and ultimately the Super Bowl.

High school teammates reunite By BARBARA BOXLEITNER correspondent Jamal Lawson and Weedlens Beauvil have found a home in minor-league professional basketball. The Bartow High School graduates have reunited to play for the Heartland Prowl, one of four teams in the Florida Basketball Association. “It’s designed to get us to the next level and get us more exposure,” Lawson said about the league, a tier below the American Basketball Association. Lawson is a second-year player, Beauvil a first-year player for Heartland, which faces the Palm Beach Knights in the playoffs Saturday at Kirkland Gym. The winner advances to the league championship. Shooting guard Lawson said he feels more

comfortable this season because he has adjusted to the different rules and faster pace. For example, teams have 12-minute quarters instead of the 20-minute halves in college, he said. “I’ve become a better scorer,” he said. “I have had to be more of a deeper shooter. You have to find ways to score.” Boosting his perimeter shooting hasn’t diminished his ability to drive to the basket. “I’m more of a slasher,” said Lawson, who had 13 points and a team-best eight rebounds July 19 against the Miami Midnites. “I like to attack.” Beauvil graduated in May from Tennessee Temple University, where he reached 1,000 points during his four years there. Playing alongside Lawson has been rewarding. “It’s a pretty good feeling coming

back home,” Beauvil said. “Old high school teammates. It’s a great experience bringing back good-time memories.” The perimeter shooter also has had to adjust to the fast pace and rule changes, notably that the three-point line is farther back. Both are grateful to be extending their playing careers, especially in a league where they know their teammates and opponents. At the end of the season, Lawson said, team management indicates to players whether they are wanted back. “It’s more of a family thing. Scott seeks contract audits of hospitals, insurers Gov. Rick Scott on Monday directed the state Agency for Health Care Administration to audit at least some contracts between hospitals and health insurers to determine if they comply with a state Medicaid law. Scott contends contracts could exceed a legal limit on Medicaid payment rates. AHCA Secretary Liz Dudek on July 17 requested that hospitals and insurers certify that they did not exceed the limit, which is 120 percent of a Medicaid fee schedule. The letter listed an Aug. 1 deadline to respond. In a follow-up letter released to the news media Monday, Scott directed Dudek to conduct audits of contracts that had not been certified by Aug. 1 as complying with state law. Also, he directed Dudek to inform “non-responsive” hospitals and insurers

that the state will take action if contracts exceed the 120 percent limit. Such actions would include changing or terminating contracts that are not in compliance with state law. The follow-up letter did not detail how many contracts might be audited or how many hospitals or insurers were considered non-responsive. “Any hospital or insurance plan that did not submit their compliance information to you by your Aug. 1 deadline necessitates immediate further action to ensure taxpayers are not being over-charged due to contracts above and beyond the legal Medicaid rate limit …” wrote Scott, a former hospital-company CEO. Also, Scott directed Dudek to make a public presentation on the issue during an Aug. 12 meeting of the state Commission on Healthcare and Hospital Funding, which Scott created this year to delve into financing issues.

Polk on watch for emergency declaration for floods Gov. Rick Scott declared a state of emergency Thursday for Dixie, Hillsborough, Pasco, Pinellas, and Taylor counties, which were hit by severe weather, including heavy rains and flooding, from July 25 through Monday. Scott added the order could be expanded to Alachua, Bradford, Citrus, Hernando, Levy, Manatee, Polk, Sarasota, and Union counties “depending upon conditions and public safety concerns,” as more above-normal rainfall is forecast for parts of the state through the next 14 days. The order, in part, authorizes Florida Division of Emergency Management Director Bryan Koon to execute the state’s emergency-response, recovery, and mitigation plans, which could include seeking federal assistance. Scott’s order noted that the majority of Dixie, Levy, Citrus, Hernando, Pasco, Hillsborough and Pinellas counties received more than 10 inches of rain during the 10-day period, while western Pasco County received more than 20 inches of rain during that period.

Beginning Aug 16, there will be two services at First United Methodist Church in Bartow. The first service is from 9-10 a.m. is a contemporary service with music led by the Praise and Worship Team. The second service, from 11-noon will be traditional. Music will be provided by the choir. Pastor Alan Jefferson will speak at both services. Each service will also have a children’s message in the service, and children from pre-K to fifth grade will go with a teacher to have a Bible study lesson after the children’s message. There will be two adult Sunday School classes from 9:30-10:30 a.m. The Joy class is led by Judy Gay, and the Disciple Class, led by David Brooks. From 10-11 a.m. there will be Children’s Church in the Annex. This will focus on upbeat music, games, craft, skits, and lessons. Curriculum will be based on three basic truths modeled by Jesus in Luke 2:52. “And Jesus grew in wisdom and stature, and in favor with God and man.” The Youth Group will also be involved with this program. In addition, during this time period, there will be a small group class offered for parents with children, using Bible studies that are geared for parents. Man charged with child pornography A man arrested July 30 on two counts of possession of child pornography is now charged with another 80 accounts after detectives looked through his cellphone after his arrest. The son of a former Major League Baseball player faces life in prison after he was arrested Thursday, July 30, in Davenport. Deputies served a search warrant at 418 Riggs Circle in Davenport and arrested three residents for a variety of drug related charges. Inside officers found several Felix Millan baggies of cocaine packaged for sale, a digital scale with cocaine residue, a larger bag containing 135 grams of cocaine, several empty baggies containing cocaine residue in the sink appearing to be recently emptied into the drain to destroy/conceal from law enforcement, police reported. There was an AK-47 semi-automatic pistol 7.62 by 39 caliber with attached loaded magazine, a 9 mm handgun and a trafficking amount of marijuana, police reported. Felix Millan, 45, told detectives he sells cocaine because he doesn’t make enough money in the barber shop to get by and pay for the things his kids want. He admitted to trying to get rid of some of the cocaine down the sink before the deputies came inside. He told detectives the cocaine and firearms belonged to him. Millan was arrested and convicted in Arizona for attempting to transport more than 100 pounds of marijuana on Southwest Airlines. He served about 2 ½ years in prison. He told detectives he is the son of Major League Baseball All-Star Felix Millan, who played for the Atlanta Braves and New York Mets in the 1960s and 1970s. Yvette Noedel, 38, told detectives she has been in a relationship with Millan for approximately

When deputies arrived at the home with a warrant, Pierce’s wife advised her husband was at work. Mrs. Pierce said she has seen images on her husband’s phone, and believed he had a “sickness” when it came to child pornography, and that he uses a Kik messaging app on his phone. Mrs. Pierce did not believe any of the images she saw were of the children living in the home, however, she did believe the images were of juvenile females. Detectives notified DCF to respond to the scene to interview the children living in the home. At this time it does not appear that the children in the home have been sexually abused, nor do they appear to be in any of the images located so far, the sheriff’s office reported. When Pierce arrived at his home, he was taken into custody without incident. Post-Miranda, he told detectives he uses the Kik

mobile phone messaging app to trade images, and uploads the images to Dropbox. Pierce told detectives he has a “sickness” and that he prefers females between the ages of 15-19 years old. Pierce told detectives he has a second cellphone that he uses to trade pornography, and to take photos or videos of young females that he sees in public or sunbathing while he works as a pool cleaner. Pierce would not tell detectives where the second cellphone is. Detectives have obtained a search warrant for a storage unit belonging to Pierce. During a forensic examination, Pierce’s cellphone (the one he had on him during his arrest, not the second one he indicated to detectives that he had), detectives found 80 images depicting child pornography, with children as young as 3-month-old to 6-month-old infants. All of the images located so far do not appear to be original images taken/ created by Pierce, but are images recognized by computer crimes detectives as child pornography that was downloaded/traded in previous investigations.

In 2009 Rachel Bouchillon was honored by the Bartow Crickette Club after she was named the valedictorian of Bartow High School. Annually, the club recognizes the girls at the top of the class from that school, the IB and Summerlin Academy. After spending the last seven years in college, mostly in Gainesville, she returned to the club Monday to tell them what she’s done and where she is heading. She is going to the Mariana Islands for the next two years and she’s heading out Sunday. “Saturday, I’m moving out (from Gainesville) and Sunday, I’m flying to the Mariana Islands,” she said. For those who don’t know, the islands form the eastern limit of the Philippine Sea. They are southeast of Japan

and southwest of Hawaii, east of the Philippines. Bouchillon spending the next two years studying marine wildlife in the Philippines may have come as a surprise to Crickette Club members who last saw her six years ago planning to major in French. “French is wonderful, but I didn’t know what I could with that,” she said. Ultimately she majored in environmental science and earned a minor in French and Spanish. Recently she completed work to earn a master’s degree. Even still, though, moving the northern Pacific is a surprise to her. “I’ve lived in Florida all my life and I’ve never gone that far from home,” she said. While being nervous about it, her friends and family asked her essentially when she looks back at the opportunity if she didn’t take it, what would be more disappointing? “So

In her years of study she has spent time studying biofuels in North Carolina – which she said was one of the best things she’s done – spent time in Cedar Key studying oysters and learned a lot about wildlife and the politics surrounding oysters. “It’s so complex and political. Georgia and Florida are in a lawsuit over water rights and I kind of got swept up in it. I can’t believe something as innocuous as oysters can cause so much,” she said. She said she learned “more than I ever thought I would.” “I’ve studied reefs and fish I never saw before, and I’ve lived in Florida all my life,” she said. Ultimately though, she wants to work for National Oceanic and Atmospheric Administration and this move to the Mariana Islands may make it so she can do that and work on the policy

Bartow Kiwanis Club hosts division meeting The Bartow Kiwanis Club hosted the Division Council Meeting on Thursday, July 30, which was held at the Bartow Civic Center. It was the final council meeting of the current Kiwanis year and it also extended the celebration of the first 100 years of Kiwanis. A roll call of clubs produced reports from all but one of the clubs in the division and provided insight into the diverse endeavors of each club in Division 15. Featured speaker was current District Governor, Chuck Gugliuzza. He summarized the accomplishments the past 10 months of the Florida district, including the building of three new Kiwanis clubs. Also touched upon were goals that still

need to be attained by September’s end and Gugliuzza asked every club induct two new members by Sept. 30. Two new members were inducted, one for the Bartow club: Mary Ellen Schmitt. Current Bartow President Sarah Case was honored with a surprise presentation of an “Eliminate Centennial Award,” presented her by Gugliuzza. The Eliminate Project is an effort by Kiwanis International and UNICEF to eliminate maternal and neonatal tetanus. In his presentation of the award to Case, Gugliuzza noted there are four “Model Clubs for Eliminate” in the division. However, there was also a moment of levity with an “exercise” of passing an orange to determine the winner of the floral centerpieces that adorned the tables.

Bartow and Polk County’s water needs are more than being currently met, but that may — and probably will — not be the situation over the span of the next several decades as the population is expected to rise dramatically; that increase will also be noted throughout much of Florida, including coastal counties. Thus in a departure from the usual procedure City Commission work sessions are conducted, Danny Kushmer, with the Southwest Florida Water Management District — better known by Swiftmud — made a presentation on the Central Florida Water Initiative at the City Commission’s Monday, Aug. 3 session. An effort is underway to create a collaborative effort with the South Florida and St. Johns River Water Management Districts. The intent is to work together for one goal, addressing the future water needs of Polk County (as well as four other counties). One of the hopes is that the collaboration will garner more grant money. Another goal is to establish consistent rules regarding water management. “That will happen,” said Kushmer. “We’re not there yet.” Crucial to Bartow and Polk County, said Kushmer is what he and Swiftmud believe is participation from each and every municipality in Polk County — as well as the county itself — to be represented and be a part of the make-up of the CFWI committee. “We want you to have a seat at the table,’” he

said. Currently, 90 percent of Polk County’s water comes from its aquifer, but future sources will need to be found and created. One of those includes conservation, and residents and businesses in Polk County have done well at that. Historic water use over the past years has shown that while the population has grown, water usage has decreased. “We need to find alternatives,” Kushmer said. “The question is how.” Time, though, is tight, and when Kushmer made his presentation he told them that on Monday, Aug. 10 there would be a Water Summit starting 8:30 a.m., at the Lake Eva Banquet Hall in Haines City. In addition to himself, others making presentations included Adam Putnam, Commissioner of Agriculture, and Polk County Commissioner George Lindsey, who is also this year’s BOCC chairman. “What are you looking to glean from the summit?” Commissioner Leo Longworth asked. Kushmer’s reply was in two parts: One) For Bartow to be part of the council, and Two) the creation of a central Florida water entity. The overall consensus of opinion by commissioners was positive. Commissioner Pat Huff was the first to come out in favor of Bartow participating. He believed that a singular entity needed to be created, especially in future years when coastal counties will be seeking water. He was supported by Mayor Adrian “A.J.” Jackson. “A regional approach is long overdue,” said Jackson, who plans to attend the meeting.

Remarkably, instructor Anthony Arzave was able to dial 911 to report the single-engine airplane crash that claimed the life of his student July 22 near Lake Wales Municipal Airport. In obvious distress and disbelief throughout the call which lasts several minutes, Arzave stayed on the line with an unidentified Polk County dispatcher until the sound of rescuers could be heard as they approached the down plane. Arzarve’s first words upon reaching a 911 operator who asked the address of the emergency were “Lake Wales Airport. I’m in the airplane that crashed, on the ground.” Asked next if he was involved, Arzave replied “I’m the pilot.” He was then asked what phone number he was calling from and he desperately replied, “I don’t know. I’m losing consciousness.” The dispatcher then contacts a second dispatcher. In the background, several moans can be heard followed by the simple plea, “Please send an ambulance.” The second dispatcher again asks the caller twice to “tell me exactly what happened,” but Arzave is unable to form a coherent answer, but finally responds after being asked what kind of plane is involved. “Airplane made an emergency landing to the airport, we crashed. Please I need assistance. I’m in a very uncomfortable position,” he said. Arzave confirms that the aircraft is not on fire and that he didn’t know that if any building or structures were involved, “We’re in trees, we’re in brush, near the airport,” he said. The dispatcher then asks if he is in immediate danger.

“I think, possibly … I have student pilot,” he managed to stammer. He also identified himself as the “pilot in command” an aviation term used to refer to the person who is ultimately in charge and responsible for the plane’s safety. Arzave then reports he can hear fire trucks, and that at the moment, “both pilots are alive.” He then reports that someone “is coming closer. I see somebody. I see people.” The dispatcher asks Arzave to focus on his breathing, and whether or not they are pinned in the wreckage. Some portions of the call have been redacted, seemingly about injuries sustained to student pilot Sheyn ye Chen, who died several days after the crash. The Lake Wales Police Department also reports that Arzave is scheduled to be discharged this week from the hospital where he has been recovering from unspecified injuries. The rescue was aided by workers from Dickerson Florida, a construction firm on a job at the Lake Wales Municipal Airport. They were scheduled to be cited last night for their efforts by the Lake Wales City Commission.

If you’ve got lungs (and maybe some dancing moves) you can take part in the Bartow Idol contest. It is scheduled to take place at Friday Fest, Aug. 21, downtown. It’s going to be emceed by SLS Entertainment President Sean Serdynski, who has run hundreds of karaoke contests. Serdynski said don’t worry about whether or not you can sing or even know the real lyrics of the

song you pick. “Ninety percent don’t know the right words,” he said. “Then there’s a lot of people who do parody (words).” There are three auditions scheduled for the show’s debut. They are all at 6 p.m. The first one is Tuesday, the second is Wednesday and the third one is Tuesday, Aug. 18. People can go to all three auditions, but there is a $10 fee each time. The auditions are at Hacienda Mexico Restaurant, 195 E. Main St. There will be five judges looking

at the entertainment value, stage presence, attire and crowd interaction. People will sing two different songs and on the 10 item judging form, the maximum score is 20. According to the contest rules, first place wins $100, second wins $50 and third place wins $25. Serdynski said people can bring their own disc, but he has plenty. Jennifer Hall said when she was named one of the emerging leaders in 2012, it was not only an honor and humbling, it has turned out to be a stepping stone. “That was in 2012 and this year I’m the president of the Crickette Club, next year I’m going to be the president of the (Bartow) Chamber,” she said. “I think it gives you more confidence and people become more aware of you.” That could happen to a handful of people on Tuesday when the Emerging Leaders Award for 2015 are given at the Bartow Civic Center. In its fifth year, nominations are taken from throughout the county over two months for the event that is sponsored by the young business professionals organizations from the Winter Haven, Bartow and Lakeland chambers of commerces. Those clubs are the Endeavor, ENGAGE and Emerge, respectively. “The Winter Haven Chamber Foundation started this as a way to honor the work of young professionals and what they are doing,” said Winter Haven Chamber president Katie Worthington. Each year nominations are taken for a few months and those people then get a form they fill out. “We have an application process and they are able to give us more information. It asks about their professional life,” Worthington said. She said this year, like others, there are about 25 people in the running and that came from more than 35 applications. Judges review them and award goes to a few people every year. Worthington said the judges are comprised of two

Ejected medical pot applications likely to be challenged BY DARA KAM

TALLAHASSEE – Even before selecting five nurseries to become Florida’s first legal pot producers, Department of Health officials will face a challenge from at least one grower whose application was tossed out because it was late. The department’s Office of Compassionate Use staff rejected two of the 30 applications from nurseries hoping to get chosen as one of the five coveted “dispensing organizations.” Both were tossed because they were received after a 5 p.m. deadline following a frenzied scene during a torrential downpour July 8 at the agency’s headquarters. Both nurseries say their representatives were told by Department of Health workers that the 5 p.m. deadline didn’t apply. Lawyers for O.F. Nelson & Sons say they intend to challenge the rejection because the Apopka-based nursery’s representatives were told that the deadline was extended for a day, in part because of the weather. “Our application was complete, and we were prepared to submit it until the DOH expressly represented that it would extend the deadline a day. We relied on that representation, and the following day the DOH accepted our application and fee without reservation. We only recently discovered that the DOH rejected the application despite its previous assurances that we were timely,” Derek Young, a lawyer with Kaplan Young & Moll Parron who represents the nursery, told The News Service of Florida on Friday. The O.F. Nelson application was timestamped 12 p.m. on July 9. “Our dispensing organization is by far the most qualified and includes one of the leading medical cannabis companies in the world. Florida’s patient population deserves the high standards of quality and safety our dispensing organization represents, and we therefore intend to challenge the DOH’s indefensible position to ensure our patients receive exactly that,” Young said. Ed Miller and Son Nursery also received a letter from Patricia Nelson, then-director of the Office of

Compassionate Use, saying that the application from the Palm City nursery --- time-stamped at 5:27 p.m. July 8 – was “untimely.” Nelson left the Office of Compassionate Use post a week ago. The certified letters, sent July 16, also say that the nurseries have 21 days to file a challenge. Department officials referred to state law in response to questions about the rejections. Ed Miller and Son is trying to get a license in the southeastern region of Florida. Anthony Ardizzone, a partner in the nursery, said the deadline wasn’t clear and he is considering a challenge. “We’re reviewing our options,” he told The News Service of Florida this week. While the application for the dispensing organizations said that documents would be accepted “no later than 5 p.m.” July 8, the Office of Compassionate Use’s website says that the applications would be taken “through” 5 p.m. Ardizzone is relying on Webster’s Dictionary definition of “through,” which means “during the entire period of” or “from the beginning to the end of.” That means the applications should have been accepted all through the 5 o’clock hour until 6 p.m., according to Ardizzone. Ardizzone also said that a representative who delivered his nearly 2,000-page application was told by a Department of Health worker that applications received before 5:30 “would be OK.” “The doors were open. It was accepted. It was received,” Ardizzone said. “Our contention is that they took it. And they took additional information two days later.” The health department responded to requests for comment with excerpts from a rule, which says that applications would be received “no earlier than 10:00 AM, Eastern Time, on the effective date of this rule and no later than 5:00 PM, Eastern Time, 21 calendar days after the effective date of this rule.” The rule went into effect on June 17. Health Department spokeswoman Mara Burger also referred to the language in letters sent to the two nurseries citing Florida law allowing affected parties to petition for administrative hearings within 21 days of receiving the letters. Nearly all of those seeking licenses

waited until the last day to submit the applications, resulting in a frenzy at the health department’s Tallahassee headquarters as the 5 p.m. deadline loomed and a downpour raged during rushhour traffic, according to one observer. The door to the building facing the street was locked and visitors were supposed to enter through a side door, creating more confusion as individuals toting boxes of documents scrambled to beat the clock, said Jeff Sharkey, a lobbyist who represents the Medical Marijuana Business Association of Florida, which he founded. “You could smell the anxiety and the desperation in the air as the clock ticked towards 5 p.m.,” Sharkey said. “People are coming in and handing in their applications. … One person came at 4:55 and ran up to the door and I opened the door for him. They stamped in at 4:57.” Things worsened one minute before 5 p.m., Sharkey said. “It’s raining. There’s no place to park out there now. And this poor kid comes screaming up in some little car and grabs this box of stuff and runs up to the door and he’s pounding on the door. And 5:00 is like a minute away,” he said.”His face was up against the glass. He’s mouthing ‘Please open the door!’ He’s sopping wet.” Sharkey said he opened the door for the man, who was told by a worker that he had missed the 5 p.m. deadline. “And the poor kid just freaked out,” Sharkey said. A three-member panel, which includes the new head of the Office of Compassionate Use, has three months to choose five nurseries – one from each region of the state – to grow, process and distribute marijuana that is low in euphoria-inducing tetrahydrocannabinol, or THC, and high in cannabadiol, or CBD. Parents of children with a severe form of epilepsy pushed the Legislature last year to approve the low-THC cannabis, believing it can end or dramatically reduce life-threatening seizures. Doctors were supposed to be able to begin ordering the medical marijuana for patients with severe muscle spasms or cancer on Jan. 1, but the 2014 law has been mired in challenges. In November, Administrative Law Judge W. David Watkins rejected health

officials’ first attempt at a rule governing the pot industry, agreeing with Miamibased Costa Farms and others that objected to the Department of Health’s proposed use of a lottery to pick the licensees. Watkins upheld a second version of the rule in May after it, too, was challenged. Under the current regulations, the panel will pick the five licensees based on a weighted scorecard that evaluates cultivation, processing, dispensing, financials and the operation’s medical director. Nurseries that have been doing business in Florida for at least 30 continuous years and grow a minimum of 400,000 plants at the time they apply are eligible for a license. The applications ask nurseries about their investors, pot consultants, protocols and the types of cannabis they intend to cultivate. Applicants had 21 days to collect documents, secure the $5 million bond required in the law and submit them to state health officials, a timeline many grumbled was too hasty. Some out-ofstate consultants were charging at least $150,000 to craft the applications. Nearly everyone in the industry, including those on the sidelines, predict that, once awarded, the licenses will be challenged. From four to seven nurseries applied in each of the five regions. In addition to the non-refundable $60,063 application fee, $5 million bond and costs to submit the license, Ardizzone estimated that it would cost $12 million to get his operation up-and-running. The possibility that Florida voters could have another shot at legalizing full-blown medical marijuana in November 2016 makes the licenses even more appealing. The applications are a public record, except for information that is deemed “proprietary” or is exempt by Florida’s broad open records laws, so losers will be able to scrutinize their competitors’ winning documents. “Everyone involved in this process has always assumed that the losers of the selection process will challenge. I think that is a given,” said Louis Rotundo, a lobbyist who represents the Florida Medical Cannabis Association.
