President’s Message “LEGAL RED CARPET— LBA ROYAL WELCOME” When we see the words “red carpet”, we tend to immediately think—lights, cameras, action. In the legal community, the equivalent of this is commitment, dedication, excellence! This month LBA rolls out its red carpet for attorneys that have served the legal profession, local community, state and local bar associations with unwavering commitment, dedication, and sustained excellence. Join us in celebrating these attorneys at the LBA Hall of Fame Ceremony. There are many noteworthy events that pave the road to celebrating professional achievement. While difficult to measure, I assure you, it is easily recognizable. Most of the individuals that are honored for professional achievement deserve a nod for personal achievement. As attorneys, we all strive to serve the legal profession with the highest integrity. The attorneys that will be inducted into the Hall of Fame have spent their professional careers demonstrating this integrity, and as a result advanced their professions. They have protected the interest of clients, and as a result, strengthened

They have challenged themselves to be better—better attorneys, better community volunteers and organizers, better board volunteers--and as a result, cultivated the profession. It is important for us to publicly celebrate those that forge a path in the legal profession. It is important that we mark extraordinary legal and civic contributions proudly and loudly! LBA is on its way to doing just that and we hope to continue for years to come. LBA is proud to give our hall of famers the royal welcome because they are an example of what the legal profession should be reflective of. As we celebrate their accomplishments, we celebrate our strength as a legal community. See you on the legal red carpet.

I wasn’t at all surprised when I read that Lafayette is the happiest city not only in Louisiana but the entire United States. Television talking heads, various journalists and many experts mused as to how our city on the bayou could possibly be so happy. We don’t have weather perfection like the city by the bay, this is not the city that never sleeps, we are neither the healthiest nor wealthiest, and Disney World—the trademarked “happiest place on earth” is more than a 12 hour drive away. To those of us who live and work here, the answer was clear: we are a resilient people who work hard, play harder, embrace our faith, and revel in what makes us unique. We find a way to turn the most quotidian of soirées into revelry and elevate special occasions to incredible celebrations. We create those magical moments that make us happy. Here at the LBA, your board and staff have been super busy planning red carpet worthy events where many more of those happiness-inducing moments can be made. First is the Lafayette Young Lawyers installation at LaFonda
on August 28 honoring incoming president, Trey Hightower. Next, the inaugural class of the Lafayette Bar Hall of Fame will be inducted at a reception and cocktail party at the Petroleum Club on September 4th. Please join us to honor these gentlemen who have contributed so much, not only to the Lafayette Bar but also to our whole community: Honorable Kaliste Saloom, Jr.; James Diaz, Sr; Harmon Roy; Robert McBride, and Bob Wright. Members shouldn’t mind sharing the spotlight at the Attorneys Bankers & CPAs social on September 18 from 5:30 to 7:30 at the French Press sponsored by Whitney Bank, Andrus Boudreaux Complete Title, Evergreen Working Capital, and Northwestern Mutual. Get ready to be treated like a celebrity at the Bench Bar Conference October 2nd through 4th at the RitzCarlton in New Orleans. The 2014 conference theme is Hollywood South: Rolling Out the Red Carpet and the planning committee is working hard to make it a bigger and better than ever production. Happiness is also having all of your CLE hours complete well before year end, and LBA has made considerable options available to our members. Thanks to Dona Renegar for planning a free Small Firm/Solo Practitioner CLE on August 15 here at the bar center hosted jointly by the LSBA and LBA. Vandana Chaturvedi will present Immigration Basics on August 22 also here at LBA. We are hosting a Legislative Update CLE with the Acadia Parish Bar on September 4 at the Crowley Town Club, and the annual Maritime CLE is September 11-12. Don’t despair if you’d rather wait until the credits are about to roll to get your CLE hours. We’ve already begun planning CLE By-the-Hour for November and December.

LA Center for Law and civic education annual seminar Twenty-seven teachers from around the state attended the LA Center for Law and Civic Education Annual Seminar in New Orleans. This is an annual event hosted by Mrs. Peggy Cotogno, Director of the Center. Ms. Liz Tullier, Director/Mock Trial coach for Northside High School’s Academy of Legal Studies gave a presentation on the basics of conducting a mock trial. After this presentation, teachers were given an assigned role, either attorney, witness, or juror. The case performed was “Billings v. Pearson”, a civil case involving cyberbullying. Each side presented their argument, giving opening statements, direct and cross examination, and closing arguments. The teachers had a great time and were actively engaged. Ms Tullier was the presiding judge over the trial stating, “It was a great learning experience for all teachers involved and hopefully they will be able to utilize what they have learned in their civics and law-related courses.”

LSBA Annual Meeting in Destin, FL The Louisiana State Bar Association held its 73rd Annual Meeting on June 1-6, 2014 in Destin, FL. Participants enjoyed 6 days full of exciting activities, engaing speakers, and various programming, giving them the opportunity to network with colleagues and enjoy the sunny beaches of Destin, FL. Several memebers of the LBA were recognized and received prestigious awards at ceremonies that took place over the course of the week. Congratulations to each recipient for this great accomplishment. Blake R. David, founding partner of Broussard & David, LLC was installed on the Board of Governors, Third District Sara B. Rodrigue, an associate of NeunerPate received the Bat P. Sullivan, Jr. Chair’s Award. The Lafayette Young Lawyers Association received the Service to the Bar Award for its Young Lawyer’s Continuing Legal Education (CLE) Program.

Introducing the Hall of Fame The Lafayette Parish legal community has a rich tradition and legacy of producing highly successful lawyers, Bar leaders and community servants. In order to recognize the careers of these outstanding attorneys and members of our local bar, the LBA has established an LBA Hall of Fame. The Hall of Fame Award shall be presented to honor the contributions these exceptional lawyers have made to the legal profession, the Bar or the public. Induction into the Lafayette Bar Association Hall of Fame is presented as a lifetime contribution award to LBA members who have achieved a high degree of professional achievement or who have displayed long term outstanding leadership and participation in the activities of the Bar. These recipients have had professional career marked by the highest standards of ethical conduct, professionalism, civility and collegiality; and have demonstrated outstanding contributions and commitment to the legal profession, the Lafayette Bar Association and our community. Inclusion in the LBA Hall of Fame is intended to recognize an exemplary career as an attorney or dedicated service to the community or the Bar. The Lafayette Bar Association Board of Directors is pleased to announce the inaugural class of the LBA Hall of Fame: JAMES E. DIAZ, SR. James E. Diaz, Sr. was admitted to the Louisiana Bar almost sixty (60) years ago, in 1956. He is a graduate of Tulane University Law School. In the mid 70’s Jim was a founding member and named partner of what would become one of Louisiana’s preeminent law firms then known as Onebane, Donohoe, Bernard, Torian, Diaz, McNamara and Abel, now simply The Onebane Law Firm. Over the course of his legal career, Jim has been
universally recognized by judges and lawyers alike, as one of the top maritime lawyers in the country. Jim is known as a consummate professional and always a gentleman, no matter the circumstances or the case. James E. Diaz, Sr.’s body of legal work easily demonstrates, among other things that he is always prepared and is a very skilled courtroom advocate. Over three 3 decades ago, Jim was first recognized as one of the outstanding members of the Louisiana Bar by the Woodward & White publication known as Best Lawyers in America. He is AV rated by Martindale Hubbell. Surely, one of the crown jewels of Jim’s very long and successful legal career is his 1969 appearance before the United States Supreme Court in the landmark case entitled: Rodrigue v. Aetna Casualty & Surety Co., 395 U.S. 352, 89 S.Ct. 1835, 23 L.Ed2d 360 (1969) which established the legal proposition, still the law today, that the legal remedies available to a Gulf of Mexico platform worker accidently injured or killed, is generally defined by federal legislation, then relatively new when Jim argued Rodrigue, called the Outer Continental Shelf Lands Act, rather than, as argued by his opponent, the general maritime law. The Supreme Court’s decision in Rodrigue sent a tsunami through the maritime legal community, because, until Rodrigue, it was an established legal rule that maritime law remedies were always available to Gulf of Mexico platform workers. ROBERT R. “BOB” McBRIDE Robert McBride obtained his law degree from Louisiana State University in 1959 and his license to practice law in that same year. An excellent trial attorney and recognized as one of the most skilled litigators in Louisiana, Bob was particularly known for his litigation of personal injury actions resulting from electrical contacts. Bob served in both the U.S. Army and U.S. Air Force and is a veteran of the Korean War. He served our local bar as President of

the Lafayette Parish Bar Association. Bob is recognized for his highly ethical and professional standards when dealing with clients, witnesses, and fellow attorneys. Bob exemplified how lawyers should conduct themselves in court, in the community and with each other. He was a founding partner of the McBride, Foret, Rozas & Leonard firm. He later became an of counsel attorney in the Davidson, Meaux,Sonnier, McElligott, Fontenot, Gideon & Edwards firm. HARMON ROY Harmon Roy was licensed to practice law in Louisiana in 1952. Mr. Roy is a graduate of Tulane University Law School. During his legal career, Mr. Roy had the distinction of representing many of Lafayette’s most influential businesses, public officials and community leaders. He achieved a Martindale-Hubbell AV rating during his time practicing law. He practiced law with the Mouton Roy Law Firm which became the Mouton, Roy, Carmouche, Bivens, Judice, & Henke firm, and ultimately Roy, Bivens, Judice, Roberts and Wartelle, where his practice primarily involved the defense of personal injury and maritime claims. Harmon’s professionalism and courtesy to litigants and opponents was matched by his reputation as a tenacious and zealous advocate and litigator. He is the founder of the Harmon F. Roy Foundation and the Harmon F. Roy Endowed Scholarship at the University of Louisiana at Lafayette. Numerous Lafayette attorneys count Mr. Roy as their mentor. HON. KALISTE SALOOM. JR Judge Kaliste Saloom, Jr. earned a Bachelor’s Degree from Southwest Louisiana Institute of Liberal and Technical Learning, now the University of Louisiana at Lafayette and his law degree from Tulane University Law School in 1942.
Judge Saloom was admitted to the Louisiana State Bar in 1942, but delayed his practice of law until after his service in the U.S. Army during World War II. He served as Lafayette’s city attorney and assisted in the development of the Lafayette Utility System (LUS) and the establishment of the Permanent Voter Registration Program in the Parish of Lafayette. He served as Judge of the City Court of Lafayette from 1953 to 1993 and in 1992, he temporarily served in the Louisiana Third Circuit Court of Appeal. He has received numerous local, state and national recognitions including honors from the U.S. Supreme Court; the Louisiana Supreme Court; the National Center of State Courts in Williamsburg, Virginia; the National Highway Traffic Safety Administration in Washington, D.C.; the American Bar Association; the American Judges Association and the Louisiana Bar Foundation. He also received the National Distinguished Jurist Award from the Mississippi State University Pre-Law School Society in 1987. He has served as lecturer in judicial seminars in the United States, Canada and England. He received the Lafayette Civic Cup in 1965. He has reigned as both King Gabriel of the Lafayette Mardi Gras and King Lacassine I of the Krewe of Attakapas. Judge Saloom continues to be an active member of many community organizations in Lafayette. BOB F. WRIGHT Recognized as one of the best trial lawyers in America, Bob Wright was admitted to

Hall of Fame continuted practice law in Louisiana in 1957. He is a graduate of Tulane University Law School, where he was a member of the Tulane Law Review, Moot Court Board and Omicron Delta Kappa. He is admitted to practice in all federal and state courts in Louisiana, the Fifth Circuit, and the U.S. Supreme Court. Bob has been awarded the highest possible peerreviewed rating by MartindaleHubbell Law Directory for professional excellence and integrity. He is also listed in Woodward White’s The Best Lawyers in America, a publication that has been described as “the most respected referral list of attorneys in practice.” He has served as Chairman of he Louisiana Judiciary Commission, President of the Louisiana State Bar Association and President of Louisiana Trial Lawyers Association. He has also been inducted as a Fellow of the International Academy of Trial Lawyers. Bob has also served as President of the Lafayette Parish Bar Association and as a Delegate to the American Bar Association. He has an impressive record of service as counsel for various governmental associations and as an office holder and member of numerous social and civic organizations. In addition to the Hall of Fame induction, other Lafayette Bar Association awards will be presented. LBA President Tricia Pierre has selected Frank X. Neuner, Jr. and Gary McGoffin as the 2014 President’s Award Recipients. Also, Kevin Blanchard will receive the Outstanding Young Lawyer Award. Frank X. Neuner, Jr. received his J.D. from Louisiana State University (1976). He joined Cliffe E. Laborde Jr. in 1987 to form Laborde & Neuner. Mr. Neuner’s areas of practice include Admiralty & Maritime, Insurance, Employment Law, Commercial and Toxic Tort
Litigation. Gary McGoffin received his J.D. from Louisiana State University (1976). He is an Eagle Scout and cofounded Durio, McGoffin, Stagg & Ackermann in 1983 with fellow Eagle Scouts, Buzz Durio and Bill Stagg. His practice is focused on business, healthcare and public interest issues. Kevin Blanchard graduated cum laude from Louisiana State Univeristy and received his J.D. (2011). He was recently appointed as Chief Development Officer for the City of Lafayette in November 2013. As CDO he is responsible for coordinating and overseeing development and longterm planning efforts of the city-parish government, including implementation of the comprehensive plan. As an attorney, Kevin practiced commercial and oil and gas law at Onebane Law Firm. Please join us at the Hall of Fame reception on September 4th at the Petroleum Club. 10 Questions to ask your IT Director Too often, law firm managing partners are content to let their IT departments operate on cruise control – until a crisis strikes. There are so many questions that they should be asking that it was hard to winnow our list down to 10. 1. How do we ensure that we are installing all critical updates and patches for our software and hardware? Believe it or not, this is the number reason for data breaches –the failure to patch. There should be a reporting mechanism so that you receive weekly reports of all updates made–you don’t have to read it, but at least there will be an audit trail–and making the report will constantly remind your IT director to be vigilant. 2. How often do we require passwords to be changed and what are our rules for password strength? Today, sadly, the answer should be every 30 days (no repeats) 12 characters, using upper and lower case, numbers and special characters. 3. How are we preparing to move beyond passwords? Passwords will be obsolete in the near future. Google is already moving to two factor authentication and has announced that it will move away from “passwords only” in the future. Biometrics is one option, but we prefer two factor authentication using some kind of token (something you physically have) in addition to a password (which should still follow normal password rules). 4. What is our process for securing data when we terminate employees? There should be a checklist of items to go through, including the return of all data, killing IDs and the ability to connect remotely, retrieving all firm cell phones laptops, prox cards, keys, etc. If they have a personal code to get in the office, terminate the code. The list is long. 5. Do we change the defaults on all our equipment? This is the second most common reason for breaches – default values are unchanged on routers, etc. and even the script kiddies (never mind the true cybercriminals) know all the defaults. There should be reports verifying this as well. 6. What is our incident response plan? If you suffer
a breach, is there a team in place? Who needs to be notified? Do you have a digital forensics company that you can call to investigate and remediate a breach? Do you have an attorney who is a data breach specialist who can assist in helping you comply with any federal or state notification laws and regulations? Another long list here. 7. Do we have redundant hot and cold backups and a plan for business continuity in the event of an emergency? 8. Do we have a Bring Your Own Device (BYOD) policy? If so, have we recently evaluated the risks of having personal devices connected to our network? Do you even know if personal devices are accessing your data? 9. Are we storing data in the cloud? If so, make sure that a lawyer has actually read the Terms of Service and your IT Director has adequately investigated the cloud for physical and data security –including whether the provider will advise you of any law enforcement requests for your data in time for you to file a Motion to Quash. No notice will be given if the requests are under the Patriot Act, but most of them are not. 10. How are we protecting mobile data? Do all laptops have full disk encryption? Do we have adequate remote access policies? When attorneys connect remotely, is the data encrypted in transit? Legal Lagniappe Congratulations to Jeff Coreil on recieving the Sandra Day O’Connor Award presented by the National Inns of Court. The purpose of the award is to honor an Inn member each year for exemplary service and to honor Justice O’Connor for being the paragon of professional service throughout her distinguished career while exemplifying legal excellence, civility, ethics and professionalism. It will be presented to him by the American Inns of Court at their annual Celebration of Excellence at the United States Supreme Court in October.

Simien & Miniex held its 19th Annual Virginia Miniex/ Margo Simien Scholarship Reception. Each year, the Miniex and Simien families award scholarships to deserving high school graduates who strive to do well in furthering their education.
The Color of Justice was held on Saturday, May 10, 2014 at the Clifton Chenier Center Auditorium. The event was presented to students ranging from 6th grade throughout high school. The Color of Justice is an outreach program created by the National Association of Women Judges to encourage and motivate students on how to obtain a career in the legal profession. The mission of the association is to promote the judicial role in protecting the rights of individuals under the rule of law
through strong, committed, diverse judicial leadership; fairness and equality in the courts; and equal access to justice. The program was initiated several years ago in our Southwest Acadiana Area by the Honorable Phyllis Keaty to encourage minority youth to aspire for careers in the legal profession. Presenters included Judge Sylvia Cooks, Judge Jules Edwards, Judge Phyllis Keaty, Judge Edward Rubin, Judge Susan Theall, Louis A. Martinet Society President Karen King, Valerie Garrett, Curtis Hollinger, Patrick Magee, and Harold Register, Jr.

Full Name: Jacques E. deMoss Place of birth and hometown: Lafayette, Louisiana Family: Wife Melanie and son Mason Education: Lafayette High School, USL, and Oklahoma City University School of Law What was your inspiration to go to law school? I was inspired to go to law school by my parents. I’ve always had wide and varied interests. They knew that even if I chose not to practice law full time, the education and experience I gained would be invaluable in other endeavors. They were right. What type of law do you practice? I currently maintain a part-time general commercial practice, representing mainly agricultural focused businesses in the North East Louisiana area. Is this what you originally thought you would do when you were in law school? No. Initially, I really thought I would end up practicing law full time my whole career. I really enjoyed the practice, but my many interests eventually led me to going into business in other divergent fields. The Promulgator Editorial Committee has been told that you own Wild Country Safari Park. Please tell us about that. Yes, my wife and I bought Wild Country Safari Park three years ago. It is a 300 acre drive through safari park/zoo located in Delhi, LA (30 minutes East of Monroe) near Poverty Point Lake. We are Louisiana’s only drive through safari park where you have the option to drive your own vehicle or take a guided safari tour bus or wagon through the park. We have over 300 animals representing over 25 species. Our animal herd includes Giraffe, Camel, Water Buffalo, American Bison, Kangaroo, Llama, exotic cattle, various species of antelope and deer, Elk, Red Stag, Zebra, etc. We also have a petting zoo and party pavilions. Building off the experience I’ve gained operating the safari park, last year I partnered with my in-laws and purchased a commercial hunting lodge/ranch in Missouri called Winter Quarters Wildlife Ranch. We specialize in breeding and guided hunts for Red Stag, Elk, Whitetail Deer, Spring Turkey, and African Exotics.
