How to spot a property bargain
Everybody likes a bargain. Whether it’s everyday goods, such as food and clothing, or more expensive items, such as cars and property, there are bargains to be had.
Forced sales will often result in properties selling at lower than expected prices. However, low prices don’t always mean it’s a good buy.
So how can you spot a ‘bargain’ property deal in the making?
Bargains are often bought because other people don’t see the potential of the property. Most people will walk through an old house and only see the peeling paint, ugly carpet and an old fashioned kitchen.
• Keep your eye on properties for sale • Recognise any renovation potential • Understand the development potential • Ask the right questions Obviously, you’ll need to be looking regularly and in detail at what’s on the market in order to spot a bargain. Look closely at how long a property has been for sale, and how the price has changed – or not changed – over that time. A property that’s been on the market for a long time but whose asking price has not changed is unlikely to be a good deal. This indicates that the seller is not willing to budge on their price and may be difficult to negotiate with. On the other hand, if you see that the asking price has continually dropped over a period of time, your eyes should start to light up as this is a sign that the seller is flexible and could be willing to negotiate as they have to sell. When people are forced to sell, due to a death or arrears bond (before the bank foreclose), the property can often sell for less than it would under normal circumstances. A deceased estate can be off putting to some buyers. The property is often not presented in its best state, as it may have been vacant for a period of time, the house may have a musty smell and the garden is probably overgrown. The faults of the house are immediately evident. In the end, the sale price will be determined by how quickly the beneficiaries are keen to receive their money.
Buying bruised fruit at half the normal cost doesn’t represent a bargain. Nor does buying imitation top brand names at a fraction of the real cost. Buying something cheaply doesn’t always represent good value.

Divorce, The primary asset in most divorce matters is an immovable property. It is usually the asset with the greatest value in either party’s estate. A divorce inevitably has a direct effect on the ownership of immovable property.
In South Africa we have three matrimonial property regimes. The marital regime the couple elects to be applicable to their marriage will determine the proprietary consequences at the time of the dissolution of the marriage, whether by death or divorce.
Out of Community of Property with the Application of the Accrual System The second matrimonial property regime is one out of community of property with the application of the accrual system. If a couple elects to be married according to this matrimonial property regime they have to enter into an ante-nuptial contract before they enter into their marital relationship and have it registered at their local Deeds office within 3 months after their wedding.

If parties fail to enter into an ante-nuptial contract before entering into their marital relationship they will automatically be married in community of property.
Where an immovable property was purchased jointly during the course of the marriage, on divorce, the immovable property either has to be sold and the nett proceeds be split between the parties, or one of the parties can buy out the other party the nett worth of his/her half share in the immovable property concerned.
On divorce the immovable property of their joint estate is sold with the nett proceeds of the sale divided equally between the parties. Alternatively, one spouse can purchase the other spouse’s half share in the immovable property by payment of half of the nett market value of the property to the other spouse. The aforementioned is only available to a spouse when he/she has the necessary capital available in cash to make such payment.
Again where a mortgage bond is registered over the property, the party retaining the property after the divorce also has to be in the financial position to pay the balance owing on such mortgage bond. The transfer of the half share of the one spouse to the other in a divorce is also exempted from transfer duty.

Maintenance Claims
Where an immovable property was purchased prior to marriage and not excluded as an asset of that spouse in the ante-nuptial contract or, if purchased after the marriage it was registered only in one spouse’s name and not both, then the nett value of the property will form part of the total nett value of that spouse’s estate, which will evidently significantly increase the growth in value of the estate which will have a direct impact on the accrual calculation.

It should also be noted that where one party is unemployed during the marriage and stays at home to raise the children while the other spouse in employed and is earning an income, the former spouse may have no assets and will be able to have a claim for maintenance from the latter spouse. Biological parents as well as the legal guardian of a child have a legal obligation to pay maintenance, in other words to support the child financially. This obligation includes contributions towards paying for food, clothing, accommodation, medical care and education. Maintenance must be paid to ensure the proper living and upbringing of the child. It is compulsory to pay maintenance and the amount of maintenance will be determined in proportion to each parent’s income. Regardless of whether or not the child is born in or out of wedlock, both parents are responsible for the maintenance of that child.
