A Fatwa of the Sharia Committee of Qaedat Al-Jihad organization

A Fatwa of the Sharia Committee of Qaedat Al-Jihad organization in the Arabian Peninsula regarding fighting the Houthi Shi'ites in the South of the Arabian Peninsula ‫ ا ا ا‬ (And when Allah made a covenant with those who were given the Book: You shall certainly make it known to men and you shall not hide it) 187 Surah Aal-e-Imran ،-. /0‫ أ‬.345‫ وذر‬39‫ وأزوا‬3 /;<‫ وأ‬3 = >?@‫ و‬- ;0 ‫ل ا‬BC‫م @?> ر‬E ‫ة وا‬EG ‫ وا‬/. ‫ رب ا‬- ; ‫ا‬ Allah has ordered his slaves to refer to Allah and his messenger in the cases of ignorance or conflict, the Almighty says: (then if you quarrel about anything, refer it to Allah and the Messenger, if you believe in Allah and the last day; this is better and very good in the end) 59 Surah An-Nisa.

And the Muslims when calamities happen should refer to the people of knowledge as the Almighty said: (And when there comes to them news of security or fear they spread it abroad; and if they had referred it to the Messenger and to those in authority among them, those among them who can search out the knowledge of it would have known it, and were it not for the grace of Allah upon you and His mercy, you would have certainly followed the Shaitan save a few) 83 Surah AnNisa.

In order to carry the Sharia obligation on the carriers of the knowledge, from declaring the truth and implementing the Sharia regulations on the happening calamities, the Sharia Committee of Qaedat Al-Jihad organization in the Arabian Peninsula issues a Fatwa regarding what the South of the Arabian Peninsula is witnessing from the aggression of the Shi'ite Houthi movement on the blood, property and honors of the Muslims.

After viewing the condition of the Houthis, their beliefs, acts and their committing of several crimes which include:

- assaulting the honour of the prophet peace and blessings of Allah be upon him and his family by insults and cursing by accusing Umm Al-Momineen Aisha may Allah be pleased with her with what Allah have acquitted her.

- harming the prophet peace and blessings of Allah be upon him and his family by cursing his two in laws, viziers and caliphs after him Abu Bakr Al-Siddiq and Umar ibn Al-Khattab may Allah be pleased with them.

- cursing the noble Sahabah from the Muhajirin and Ansar whom have been recognized with favor and equity and opposing what Allah Almighty said: (And (as for) the foremost, the first of the Muhajirs and the Ansars, and those who followed them in goodness, Allah is well pleased with them and they are well pleased with Him, and He has prepared for them gardens beneath which rivers flOw, to abide in them for ever; that is the mighty achievement) 100 Surah AtTaubah - imposing the Rafidi Shi'ite Mazhab on the Muslims forcibly by arms.

- fighting Muslims and seizing their lands and imposing the unjust Shi'ite regulations the violate the Quran and Sunnah.

- besieging the Muslim villages and strongholds of Sharia knowledge and attacking it with arms and fighting who are in it from the unarmed, women and children.

Thus the Sharia Committee of Qaedat Al-Jihad organization in the Arabian Peninsula gives the following Fatwa: Firstly: jihad against the Houthis and fighting them is a legitimate obligation on every capable Muslim to defend the honour of the peace and blessings of Allah be upon him and his family and defend the sanctities, blood and property of the Muslims. Allah Almighty says: (Surely (as for) those who speak evil things of Allah and His Messenger, Allah has cursed them in this world and the here after, and He has prepared for them a chastisement bringing disgrace) 57 Surah AlAhzab, and the Almighty says: (And fight with them until there is no persecution, and religion should be only for Allah, but if they desist, then there should be no hostility except against the oppressors -193- The Sacred month for the sacred month and all sacred things are (under the law of) retaliation; whoever then acts aggressively against you, inflict injury on him according to the injury he has

inflicted on you and be careful (of your duty) to Allah and know that Allah is with those who guard (against evil) -194-) Surah Al-Baqara.

Secondly: fighting the Houthis is from the compulsory defensive jihad where no condition is needed for the capable and the proof on that is the unanimity of the Ulema on the obligation of repelling the assaulting enemy – the aggressor - Sheikh Ul-Islam Ibn Taymiyyah: ‘As for the defensive fight, then that is of the most intensive form of defense against an “assailant” (ṣā’il) in protection of sanctity and religion. So it is obligatory by consensus. Thus, after belief, there is nothing more obligatory than defending against the assailant enemy who corrupts both the religion and the material world. So there are no conditions placed upon it. In fact, it is defended against as much as is possible’. Al-Fatawa Al-Kubra.

Thirdly: the Houthis are an Abstaining sect from adherence to the regulations of Sharia by armed force aggressing against the Muslims with fighting, so everyone who belongs to the fighting Rafidi Houthis his blood is Halal and should be killed anywhere found and on every land as have Abu Bakr Al-Siddiq may Allah be pleased with him fought those who withheld the Zakat and the Sahabah may Allah be pleased with them were unanimous on that.

Fourthly: Be excluded from being killed all who came from the Houthis repentant leaving fighting, Allah Almighty says: (And fight with them until there is no persecution, and religion should be only for Allah, but if they desist, then there should be no hostility except against the oppressors) 193 Surah Al-Baqara.

And the Sharia Committee of Qaedat Al-Jihad organization in the Arabian Peninsula issues this Fatawa as a disclaimer and to preserve the religion, blood and honours of the Muslims.
