ihue, Nawiliwili Harbor, and Kalapaki Beach are the first areas you spy as your plane approaches Kauai’s main airport or your cruise ship nears Kauai’s main harbor. Kalapaki beach is the crescent-shaped beach carving out the harbor entry. Just a few minutes inland is the main town of Lihue, the county government seat and business district. Sheltered by mountains on one side and bordered by acres of former sugar cane fields on the other, this center of commerce and government is also a focal point for cultural events, education, and retail services. There are tantalizing reminders of this area’s rich history, particularly the Alekoko (or Menehune) Fishpond. Walls forming this large lagoon are of hewn and tightly fitted stone blocks. Because the Polynesians who migrated from the Marquesas Islands to Hawaii did not have the tools to do such fine work, the “Menehune,” a mythical band of miniature people, are attributed with this seemingly-impossible construction. A system of gates was used to lure fish into the pond where they would remain to grow and be easily harvested. From Nawiliwili harbor, you can paddle a rented kayak up to the fishpond or drive a short distance uphill to a scenic lookout above the lagoon. Huleia Stream empties into Nawiliwili Bay, and kayaking upstream is a jungle cruise beyond compare. Gliding past dense jungle growth reaching to the water’s edge, you’ll imagine that you’re the first explorer of this remote place. You might recognize one stretch as the spot where Indiana Jones (in the film Raiders of the Lost Ark) swung across a river on a continued on page 8

vine and scampered into a seaplane, escaping, from the angry arrow shooting natives, by inches. Native birds including Koloa ducks, stilts, and coots live in the marshy areas bordering the stream, protected as a national wildlife refuge. At Nawiliwili Harbor, barges arrive from Honolulu several times each week bringing everything from building supplies to groceries to cars. Cruise ships also call at Nawiliwili, and sport fishing boats leave early in the morning, hoping to return later with some trophy marlin, tuna, or mahi-mahi. Outrigger canoe clubs paddle their craft out of the harbor to practice and surf the incoming ocean swells. Kauai’s first luxury resort, Marriott’s Kauai Lagoons, spreads from the harbor mouth along Kalapaki Beach. Modern-day equivalents of the Menehune created the lagoons and the islets and bridges that form the setting for the 18-hole golf courses designed by Jack Nicklaus. The adjacent Kauai Marriott Resort & Beach Club, sporting the island’s tallest buildings, has lush gardens and elegant Hawaiian accents. All the resort amenities - upscale art galleries and shops, entertainment, spa, dining and activities - are available. The adjoining Kalapaki Beach is a favorite surfing and swimming spot, and fishing from the breakwater is a regular weekend activity for locals. The County Building in “downtown” Lihue has its own history, as it was built in the days when people came to town on foot or on horseback. A block away, the Kauai Museum’s main building is also an historic landmark. In the mezzanine gallery, Kauai’s artists mount impressive shows of their work. The gift shop has an eclectic selection of crafts, art, literature, and gifts. The various restaurants in the business district serve a great variety of Oriental, Hawaiian, Mexican, Italian and American foods. The Kauai Concert Association presents musical events in the Kauai War Memorial Convention Center, the Kauai Community Players, Kauai Kids at Play perform at the Puhi Theatrical Warehouse.

The War Memorial Convention Center also hosts many benefit concerts. At the adjacent Vidinha Stadium, there is a worldclass 4th of July fireworks display and signature event benefiting the Kauai Hospice. On August 13, all the locals go to the annual Farm Bureau Fair at least once (some attend every night) at Vidinha Stadium. Just west of downtown across the newly constructed bridges is the island’s largest and mainland-style shopping mall, Kukui Grove Center. Next to it is the18-hole Puakea Golf Course. Lihue is one of the main residential areas, so all the modern conveniences and services are available nearby, including Home Depot, Costco, KMart and, soon to open, Safeway and Petco. A short distance to the west of Lihue is the University of Hawaii’s Kauai Community College campus located in Puhi. Its library is open to all, and the Performing Arts Center is a 21st-Century state-of-the-art venue for theater and musical productions. And yet, just down the highway to the east of Lihue, the Wailua Falls (featured in the opening of the Fantasy Island series) brings you back to paradise. The Lihue-Koloa Forest Reserve is near Puhi, as well as the Kilohana Crater (the remnant of a small shield volcano) and Huleia National Wildlife Refuge (a location for Jurassic Park and Raiders of the Lost Ark). Lihue has all the action of a business and civic center while Nawiliwili Bay and Kalapaki Beach have an ancient history you can discover as you enjoy their modern resort amenities and the island’s natural wonders. Though the island’s major shopping centers and numerous stores are found in Lihue, it certainly isn’t exclusively commerce and governance. The Sport of Kings. The sport of surfing was once reserved for only the allii (royalty) and was called “hee nalu”. Surfing, boogie boarding, kite-surfing, windsurfing, stand-up paddle boarding and water skiing are popular water sports on Kauai. If you have a favorite board, you can check it as airline baggage (for an extra fee) or you can rent gear on island and get lessons from local instructors. Key spots for surfing include: Polihale; Major’s Bay at Barking Sands; Davidson’s at Kekaha; Pakalas; Poipu Beach; Lawai Beach (also called PKs and Acid Drop); Shipwrecks; Nawiliwili Harbor; Hanalei Bay; Tunnels; and Cannons. Check with local lifeguards and surfers for a report on conditions and be aware of dangerous currents, increasing swells, and rip currents.

Whale-watching Cruises

A whale-watching ocean tour is an intimate way to experience the awesome Humpback Whale and enjoy the variety of Kauai’s beautiful landscapes from an off-island perspective. Every fall, Humpback Whales leave their Alaskan feeding grounds to journey to the waters of the Hawaiian Islands to sojourn for the winter, mate, birth, and nurse their young. (Whales think that Hawaii is romantic, too!) Whale-watching cruises give you an up-close and personal 12 • Kauai Magazine • July / August / September 2015

encounter with these magnificent mammals from about November to March, when Humpbacks are most prevalent. So, plan your trip early. You can choose to whale-watch from aboard catamarans, zippy rubber zodiac rafts, cruise vessels, and sail boats. Some tour companies offer dual-powered (motorized and sailing) catamarans for snorkeling, whale watching, and sunset cruises. Some provide the more extreme rigid-hull zodiac inflatables. Be sure to bring a camera. A waterproof disposable camera is a good idea, as well as a towel and an extra set of dry clothes, because you will get wet. Binoculars will help with closer observation of whale activity. For best viewing with binoculars, use 8x40 or 7x50 magnification. If you don’t have sea legs, consider taking nonprescription or homeopathic motion sickness prevention medication before getting on any ocean craft. Hawaii winter wave swells can be immense and the sea ride can get quite bouncy. Departing Port Allen (on the southwest shore), whale-watching boats pass an old sugar mill and plantation near Waimea. Niihau, the “forbidden” island, populated exclusively by native Hawaiians is visible in the distance. Passing the U. S. western tip of the island is a long, empty, perfect stretch of white sand beach named Barking Sands and Polihale. Light turquoise blue waves break undisturbed along these shores. Whales abound in the waters all around Kauai, putting on a show with playful behavior such as fin slapping, lobtailing (slapping the tail fluke), and breaching (jumping out of the water). Don’t be surprised to see a school of Spinner dolphins, traveling in parallel pairs along your tour boat, rhythmically leaping out of the sea. Baby dolphins flip themselves into the air with abandon alongside their parents. You may also spot albatross and Boobies (birds which nest and hatch in the caves of the Na Pali cliffs). Along the Na Pali Coast, tour boats pass by the beach landing featured in the film Six Days, Seven Nights. This area, very popular with filmmakers, also appears in the remake of King Kong. Finally, the wild and inaccessible Kalalau Valley comes into view. The remote and gorgeous Kalalau Beach can only be reached by boat, helicopter, or by hiking an arduous 11-mile trail in the summer months (by permit only), as the beach disappears in the winter due to the heavy seas.

buildings from another era. In Lihue (central Kauai), the Huleia River empties into Nawiliwili Harbor. The river follows the base of Haupu Ridge and meanders past the legendary Menehune Fish Pond. The Huleia National Wildlife Refuge shelters migratory and resident waterfowl. Guided kayak tours through these waters offer a real-life jungle cruise. The Wailua River is easily accessible. This wide, calm river mouth at the ocean, the adjacent bay, and the banks and bluffs above the river were once important religious centers. Hawaiian allii made their home near the river mouth, as evidenced by the remains of heiau (ancient sacred sites). You can explore waterfalls or the famous Fern Grotto on a leisurely kayak trip up the Wailua River or by shared riverboat. On the North Shore, the Kalihiwai River, north of Kilauea, wanders through fertile lowlands. Its sandy mouth is located at the Kalihiwai Bay, just south of Princeville. The Hanalei River (just north of Princeville) is encircled by erosion-carved, misty mountains streaked with silver waterfalls, tracing its way through varied green hues of taro patches in Hanalei Valley. Most kayak tour operators offer waterfalls tours combining a perfect blend of paddling, hiking, swimming, and picnicking at places like Secret Falls up the Wailua River.

Millions of years of erosion and weathering have created more plains and rivers on Kauai than on any other Hawaiian island. Kauai’s six rivers are the only navigable rivers in Hawaii: Waimea; Hanapepe; Huleia; Wailua; Kalihiwai; and Hanalei. Via river kayaking, you can discover tropical rainforests, woods, and swampy jungles amidst a profusion of colorful flowers and butterflies. On the west side, the Waimea River is Kauai’s longest and pours into the bay where British explorer Captain James Cook anchored in 1778, making him the first westerner to set foot on Hawaii. Snorkeling, Diving, and Swimming

A trip to the Garden Island is not complete without some time spent in the water swimming and/or underwater snorkeling or scuba diving. Beneath the kayaks’ paddles, the surfboards’ swooshing fins, and the touring catamarans’ bouncing pontoons, lives a cool, quiet blue world that belongs to Kauai’s abundant sea life. Diving and snorkeling tour operators provide instructions on how to use their equipment and even how to get great photographs and videos of your sea adventures. Some of the best locations for snorkeling are: Koloa Landing; Lawai Beach; Poipu Beach Park; Lydgate Park; Tunnels Beach; and Kee Beach. Soar Like the Birds Na Pali Coast

There are few places on the planet with aerial views as spectacular as Kauai’s. From a tropic bird’s vantage point, the Na Pali coast looms above and below the helicopter. Visitors to the Garden Isle naturally want to absorb as much of paradise as possible. Those who

arrive on Kauai by jetliner get just a glimpse of the island’s breathtakingly gorgeous landscapes. However, to view the gushing waterfalls and emerald rainforest of the remote interior requires a smaller form of transportation that provides a closer perspective. A trip to the Garden Island is not complete without an airborne adventure. Because 90 percent of the island is inaccessible by vehicle and 70 percent inaccessible by foot, only from an aircraft can Kauai be seen to the fullest. Typical flight routes around the island revolve either clockwise or counterclockwise. Originating out of the Lihue helipad, many helicopters follow a route out over the Kauai Marriott Resort and Menehune Fish Pond, past the Haupu Mountain range and westward to Hanapepe, Olokele and Waimea Canyons. In the Kokee uplands, the aircraft pop over Puu Ka Pele (literally, the volcano hill), and glide down into the spectacular and remote valleys of the Na Pali coast . Completing the circle, pilots fly up Hanalei Valley, past more incredible waterfalls and on into the “Blue Hole.” This ancient crater - of which Mt. Waialeale is the highest lip - boasts the rainiest (and one of the most beautiful) places on earth. clockwise and counterclockwise variations on standard routes, depending on weather conditions and the direction the pilots choose. Helicopter tours are operated on a weather-permitting basis and reservations should be made in advance. Some companies will arrange custom tours or photo charters to specific sites. Partly cloudy skies with a little rain shouldn’t keep visitors from taking a flight. A veil of mist behind a pali accentuates its razor-sharp edge and, as everyone knows, sun and showers are the ingredients for Kauai’s world-famous rainbows (and sometimes double rainbows). A slower, more relaxed adventure by air is via a small, fixed-wing airplane or an open cockpit biplane. Fixed-wing air tours are 30 minutes to one hour or longer and cover the entire island of Kauai. You’ll enjoy aerial views of the Tree Tunnel, Waimea Canyon, the majestic Napali Coastline including the famous valleys of Kalalau, Hanakapiai, Nualolo, and Milolii. HAWAII PROPERTY OWNERSHIP EXPLAINED: FEE SIMPLE VS LEASEHOLD Most people only know of one type of real estate ownership; fee simple, also known as freehold. Hawaii and a few other states have another form of ownership known as leasehold. The difference in these two types of land tenure is very different and affects the value of the real estate. It is important to know the difference, especially if you’re buying real estate in a leasehold state. FEE SIMPLE: Fee simple ownership is probably the most familiar form of ownership to buyers of residential real estate. A fee simple buyer is given title to the property, which includes the land and any improvements to the land in perpetuity. In the case of a condominium the purchaser would own a pro-rata share of the land. Aside from a few exceptions, no one can legally take that real estate from an owner with fee simple title. The fee simple owner has the right to possess, use the land and dispose of the land as he wishes--sell it, give it away, trade it for other things, lease it to others, or pass it to others upon death. 26 • Kauai Magazine • July / August / September 2015

LEASEHOLD: A leasehold interest is created when a fee simple land-owner (Lessor) enters into an agreement or contract called a ground lease with a person or entity (Lessee). A Lessee rents the land from the Lessor for the rights of use and enjoyment of the land much as one buys fee simple rights; however, the leasehold interest differs from the fee simple interest in several important respects. First, the buyer of leasehold real estate does not own the land; they only have a right to use the land for a pre-determined amount of time. Second, if leasehold real estate is transferred to a new owner, use of the land is limited to the remaining years covered by the original lease. At the end of the pre-determined period, the land may legally revert back to the Lessor, and is called reversion. At the end of the lease term many lessors and lessees have agreed on either a new lease or the Lessor may agree to sell the land to the Lessee. In the case of a condominium depending on the provisions of any surrender clause in the lease, the buildings and other improvements on the land may also revert to the lessor. Finally, the use, maintenance, and alteration of the leased premises are subject to any restrictions contained in the lease. hawaiigateway.com

The project identifies Kauai’s five moku (major districts expanding from Kauai’s highest mountain, Waialeale, to the sea), with Ni‘ihau as the sixth moku of the County, and with Kauai Island’s estimated fifty-four ahupua‘a (subdivision within a moku).
